say_a appeal_n to_o be_v null_n and_o void_a provide_v always_o that_o every_o such_o appeal_n shall_v be_v leave_v with_o the_o person_n or_o person_n so_o convict_v as_o aforesaid_a at_o the_o time_n of_o the_o make_v thereof_o and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n justice_n of_o the_o peace_n and_o chief_a magistrate_n respective_o or_o the_o respective_a constable_n headborough_n and_o tything-man_n by_o warrant_n from_o the_o say_a justice_n justice_n or_o chief_a magistrare_fw-la respective_o shall_v and_o may_v with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n to_o enter_v break_v open_a and_o enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v any_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v as_o well_o within_o liberry_n as_o without_o and_o take_v into_o their_o custody_n the_o person_n there_o unlawful_o assemble_v to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act_n and_o that_o the_o lieutenant_n or_o deputy-lieutenant_n or_o any_o commissionated_a officer_n of_o the_o militia_n or_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n and_o foot_n and_o also_o the_o sheriff_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o readiness_n with_o the_o soon_o on_o certificate_n make_v to_o they_o respective_o under_o the_o hand_n and_o seal_n of_o any_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n of_o his_o particular_a information_n or_o knowledge_n of_o such_o unlawful_a meeting_n or_o conventicle_n hold_v or_o to_o be_v hold_v in_o their_o respective_a county_n or_o place_n and_o that_o he_o with_o such_o assistance_n as_o he_o can_v get_v together_o be_v not_o able_a to_o suppress_v and_o dissolve_v the_o same_o shall_v and_o may_v and_o be_v hereby_o require_v and_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custsdy_n such_o and_o so_o many_o of_o the_o say_a person_n so_o unlawful_o assemble_v as_o they_o shall_v think_v fit_a to_o the_o intent_n they_o may_v be_v proceed_v against_o according_a to_o this_o act._n provide_v always_o that_o no_o dwellinghouse_n of_o any_o peer_n of_o this_o realm_n where_o he_o or_o his_o wife_n shall_v be_v then_o resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o constable_n head-borough_n tythingman_n churchwarden_n or_o overseer_n of_o the_o poor_a who_o shall_v know_v or_o be_v credible_o inform_v of_o any_o such_o meeting_n or_o conventicle_n hold_v within_o his_o precincts_n parish_n or_o limit_n and_o shall_v not_o give_v information_n thereof_o to_o some_o justice_n of_o the_o peace_n or_o the_o chief_a magistrate_n and_o endeavour_v the_o conviction_n of_o the_o party_n according_a to_o his_o duty_n but_o such_o constable_n head-borough_n tythingman_n churchwarden_n overseer_n of_o the_o poor_a or_o any_o person_n lawful_o call_v in_o and_o of_o the_o constable_n head-borough_n or_o tythingman_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n and_o he_o thereof_o convict_v in_o manner_n aforesaid_a he_o shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o five_o pound_n to_o the_o levy_a upon_o his_o good_n and_o chattel_n and_o dispose_v in_o manner_n aforesaid_a and_o that_o if_o any_o justice_n of_o the_o peace_n or_o chief_a magistrate_n shall_v wilful_o and_o witting_o omit_v the_o performance_n of_o his_o duty_n in_o the_o execution_n of_o this_o act_n he_o shall_v forfeit_v the_o sum_n of_o one_o hundred_o pound_n the_o one_o moiety_n to_o the_o use_n of_o his_o majesty_n the_o other_o moiety_n to_o the_o use_n of_o the_o informer_n to_o be_v recover_v by_o action_n suit_n bill_n or_o plaint_n in_o any_o of_o his_o majesty_n court_n at_o westminster_n wherein_o no_o essoin_fw-fr protection_n or_o wager_n of_o law_n shall_v lie_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n be_v at_o any_o time_n sue_v for_o put_v in_o execution_n any_o of_o the_o power_n contain_v in_o this_o act_n otherwise_o than_o upon_o appeal_n allow_v by_o this_o act_n such_o person_n shall_v and_o may_v plead_v the_o general_n issue_n and_o give_v the_o special_a matter_n in_o evidente_n and_o if_o the_o plaintiff_n be_v nonsuit_n or_o a_o verdict_n pass_v for_o the_o defendant_n or_o if_o the_o plaintiff_n discontinue_v his_o action_n or_o if_o upon_o demurrer_n judgement_n be_v give_v for_o the_o defendant_n every_o such_o defendant_n shall_v have_v his_o full_a treble_n cost_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o this_o act_n and_o all_o clause_n therein_o contain_v shall_v be_v construe_v most_o large_o and_o beneficial_o for_o the_o suppress_n of_o conventicle_n and_o for_o the_o justification_n and_o encouragement_n of_o all_o person_n to_o be_v employ_v in_o the_o execution_n thereof_o and_o that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v by_o reason_n of_o any_o default_n in_o form_n and_o in_o case_n any_o person_n offend_v against_o this_o act_n shall_v be_v a_o inhabitant_n in_o any_o other_o county_n or_o corporation_n or_o fly_v into_o any_o other_o county_n or_o corporation_n after_o the_o offence_n commit_v the_o justice_n of_o the_o peace_n or_o chief_a magistrate_n before_o who_o he_o shall_v be_v convict_v as_o aforesaid_a shall_v certify_v the_o same_o under_o his_o hand_n and_o seal_v to_o any_o justice_n of_o peace_n or_o chief_a magistrate_n of_o such_o other_o county_n or_o corporation_n wherein_o the_o say_a person_n or_o person_n be_v inhabitant_n or_o be_v flee_v into_o which_o say_a justice_n or_o chief_a magistrate_n respective_o be_v hereby_o authorize_v and_o require_v to_o levy_v the_o penalty_n or_o penalty_n in_o this_o act_n mention_v upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n as_o sully_v as_o the_o say_v other_o justice_n of_o peace_n may_v have_v do_v in_o case_n he_o or_o they_o have_v be_v inhabitant_n in_o the_o place_n where_o the_o offence_n be_v commit_v provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o provide_v and_o be_v it_o far_o enact_v by_o the_o authority_n aforesaid_a that_o every_o alderman_n of_o london_n for_o the_o time_n be_v within_o the_o city_n of_o london_n and_o the_o liverty_n thereof_o shall_v have_v and_o they_o and_o every_o of_o they_o be_v hereby_o impower_v and_o require_v to_o execute_v the_o same_o power_n and_o authority_n within_o london_n and_o the_o liberry_n thereof_o for_o the_o examine_v convict_a and_o punish_v of_o all_o offence_n within_o this_o act_n commit_v within_o london_n and_o the_o liberry_n thereof_o which_o any_o justice_n of_o peace_n have_v by_o this_o act_n in_o any_o county_n of_o england_n and_o shall_v be_v subject_a to_o the_o same_o penalty_n and_o punishment_n for_o not_o do_v that_o which_o by_o this_o act_n be_v direct_v to_o be_v do_v by_o any_o justice_n of_o peace_n in_o any_o county_n of_o england_n provide_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o person_n offend_v and_o convict_a as_o aforesaid_a be_v a_o feme-covert_a cohabit_v with_o her_o husband_n the_o penalty_n of_o five_o shilling_n and_o ten_o shilling_n so_o as_o aforesaid_a incur_v shall_v be_v levy_v by_o warrant_n as_o aforesaid_a upon_o the_o good_n and_o
as_o they_o call_v it_o a_o silent_a meeting_n yet_o even_o such_o assembly_n of_o they_o seem_v to_o be_v within_o the_o first_o section_n and_o be_v a_o conventicle_n within_o the_o meaning_n of_o this_o act_n for_o it_o be_v a_o meeting_n under_o colour_n of_o the_o exercise_n of_o religion_n though_o none_o be_v exercise_v they_o pretend_v that_o they_o meet_v out_o of_o conscience_n and_o for_o such_o purpose_n and_o it_o be_v plain_o within_o the_o mischief_n viz._n the_o danger_n of_o contrive_v mutiny_n and_o insurrection_n at_o such_o assembly_n and_o there_o be_v as_o much_o danger_n of_o that_o in_o such_o congregation_n as_o any_o other_o and_o by_o the_o design_n of_o this_o clause_n such_o construction_n ought_v to_o be_v make_v as_o may_v most_o suppress_v the_o mischief_n intend_v to_o be_v remedy_v by_o this_o act_n the_o like_a equitable_a construction_n ought_v to_o be_v make_v for_o the_o encouragement_n and_o justification_n of_o the_o officer_n of_o justice_n and_o other_o employ_v in_o the_o execution_n of_o this_o act_n the_o meaning_n of_o which_o be_v that_o by_o no_o strain_a interpretation_n ought_v such_o person_n to_o be_v bring_v to_o damage_n for_o any_o thing_n do_v by_o colour_n of_o this_o statute_n and_o so_o this_o clause_n require_v all_o encouragement_n to_o be_v give_v to_o such_o person_n by_o the_o king_n court_n of_o record_n of_o westminster_n upon_o all_o occasion_n and_o particular_o by_o the_o next_o clause_n which_o be_v that_o no_o record_n warrant_v or_o mittimus_fw-la to_o be_v make_v by_o virtue_n of_o this_o act_n or_o any_o proceed_n thereupon_o shall_v be_v reverse_v avoid_v or_o any_o way_n impeach_v for_o any_o default_n in_o form_n i._n e._n no_o record_n of_o conviction_n warrant_v for_o to_o disperse_v a_o conventicle_n or_o to_o levy_v the_o penalty_n by_o distress_n or_o mittimus_fw-la to_o prison_n shall_v etc._n etc._n this_o extend_v to_o all_o court_n as_o to_o the_o session_n so_o to_o the_o kings-bench_n or_o any_o other_o court_n where_o such_o record_n etc._n etc._n may_v be_v remove_v or_o otherwise_o come_v in_o question_n upon_o any_o action_n that_o may_v be_v bring_v against_o any_o person_n for_o any_o thing_n do_v in_o pursuance_n of_o this_o act_n although_o the_o court_n of_o kings-bench_n may_v by_o certiorari_fw-la command_v such_o record_n to_o be_v remove_v thither_o etc._n etc._n yet_o it_o be_v a_o good_a act_n of_o their_o legal_a discretion_n to_o deny_v such_o certiorari_n as_n of_o late_a year_n be_v do_v it_o be_v a_o writ_n discretionary_a and_o not_o ex_fw-la debito_fw-la justitiae_fw-la send_v only_o to_o certify_v his_o majesty_n in_o his_o say_a court_n of_o the_o proceed_n against_o such_o a_o man_n and_o the_o justice_n below_o be_v the_o proper_a judge_n of_o the_o fact_n and_o this_o act_n seem_v to_o order_v the_o final_a determination_n of_o such_o offence_n to_o the_o justice_n particular_o for_o that_o this_o very_a law_n give_v a_o appeal_n to_o the_o session_n where_o the_o party_n have_v his_o advantage_n for_o matter_n of_o law_n as_o well_o as_o fact_n but_o it_o may_v be_v question_v what_o shall_v be_v deem_v a_o default_n in_o form_n i_o confess_v that_o may_v be_v of_o some_o difficulty_n but_o however_o by_o the_o virtue_n of_o this_o clause_n though_o it_o be_v by_o a_o penal_a law_n it_o ought_v to_o be_v help_v by_o intendment_n and_o presumption_n as_o much_o as_o any_o plea_n in_o bar_n or_o any_o other_o plead_v in_o a_o civil_a action_n but_o to_o make_v the_o best_a judgement_n in_o this_o case_n will_v be_v to_o compare_v this_o clause_n with_o the_o statute_n of_o demur_n viz._n the_o 27_o elizabeth_n cap._n 5._o where_o the_o word_n be_v any_o imperfection_n defect_n or_o want_v of_o form_n and_o the_o word_n here_o be_v by_o reason_n of_o any_o default_n in_o form_n which_o be_v plain_o all_o one_o upon_o the_o former_a the_o rule_n be_v whatsoever_o it_o be_v without_o which_o the_o right_a do_v sufficient_o appear_v to_o the_o court_n it_o be_v form_n within_o that_o law_n and_o so_o è_fw-la conuerso_fw-la whatsoever_o be_v want_v or_o imperfect_a whereby_o the_o right_a appear_v not_o be_v not_o remedy_v as_o form_n within_o that_o statute_n so_o here_o whatsoever_o it_o be_v without_o which_o the_o offence_n do_v sufficient_o appear_v to_o the_o court_n that_o be_v form_n within_o our_o law_n so_o if_o it_o appear_v a_o conventicle_n be_v hold_v against_o this_o law_n and_o the_o party_n mean_v to_o be_v convict_v be_v present_a at_o it_o if_o there_o be_v but_o sufficient_a express_v that_o it_o may_v appear_v upon_o the_o whole_a record_n the_o party_n convict_v be_v a_o offender_n against_o this_o law_n it_o will_v be_v well_o enough_o and_o there_o need_v no_o more_o for_o which_o see_v above_o under_o the_o first_o section_n the_o description_n of_o a_o conventicle_n which_o will_v direct_v you_o how_o such_o a_o conviction_n ought_v to_o be_v make_v as_o the_o precedent_n hereafter_o give_v you_o be_v and_o in_o case_n any_o person_n offend_v against_o this_o law_n shall_v fly_v into_o any_o other_o county_n or_o corporation_n etc._n etc._n this_o clause_n make_v provision_n for_o the_o punishment_n of_o such_o person_n convict_v on_o this_o act_n as_o be_v stranger_n inhabit_v or_o fugitive_n fly_v into_o any_o other_o county_n or_o corporation_n that_o must_v be_v mean_v such_o corporation_n where_o the_o justice_n convict_v have_v no_o jurisdiction_n so_o as_o the_o penalty_n can_v be_v levy_v by_o his_o warrant_n and_o therefore_o this_o paragraph_n provide_v that_o there_o may_v be_v a_o certificate_n make_v of_o such_o conviction_n under_o the_o hand_n and_o seal_n of_o such_o justice_n as_o make_v it_o that_o must_v be_v mean_v a_o certificate_n that_o there_o be_v such_o conviction_n make_v or_o a_o transcript_n thereof_o under_o the_o justice_n hand_n and_o seal_n not_o the_o very_a record_n of_o conviction_n itself_o for_o that_o perhaps_o may_v be_v return_v into_o the_o session_n and_o divers_a other_o person_n inhabit_v where_o the_o offence_n be_v commit_v may_v be_v perhaps_o convict_v by_o the_o same_o record_n and_o then_o it_o will_v be_v inconvenient_a to_o transmit_v that_o same_o it_o may_v be_v to_o any_o justice_n of_o the_o peace_n of_o such_o other_o county_n or_o corporation_n and_o if_o such_o offender_n be_v inhabit_v or_o flee_v into_o a_o corporation_n where_o the_o county_n justice_n have_v nothing_o to_o do_v there_o the_o certificate_n may_v be_v to_o any_o justice_n of_o that_o corporation_n as_o well_o as_o to_o the_o chief_a magistrate_n of_o the_o same_o notwithstanding_o the_o wilful_a error_n of_o some_o who_o in_o corporation_n will_v have_v none_o but_o the_o chief_a magistrate_n of_o that_o corporation_n as_o mayor_n etc._n etc._n and_o no_o other_o justice_n of_o such_o place_n impower_v by_o this_o law_n whereas_o the_o whole_a tenor_n of_o the_o forego_n section_n show_v the_o contrary_a such_o justice_n be_v to_o levy_v the_o say_a penalty_n as_o full_o as_o the_o justice_n convict_v might_n etc._n etc._n i.e._n by_o warrant_n for_o distress_n and_o sale_n of_o the_o offender_n good_n and_o chattel_n but_o it_o may_v be_v query_v what_o shall_v such_o foreign_a justice_n do_v with_o money_n so_o levy_v i_o think_v this_o somewhat_o plain_a that_o he_o ought_v to_o return_v it_o to_o the_o justice_n that_o do_v convict_v and_o he_o to_o the_o quarter_n session_n for_o the_o place_n where_o the_o offence_n be_v commit_v and_o the_o foreign_a justice_n must_v not_o return_v it_o to_o the_o quarter_n session_n of_o his_o own_o county_n and_o my_o reason_n be_v first_o because_o the_o conviction_n be_v not_o to_o be_v return_v thither_o second_o a_o three_o part_n of_o such_o penalty_n be_v to_o go_v to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n be_v commit_v three_o the_o three_o be_v to_o go_v to_o the_o informer_n or_o informer_n or_o such_o other_o person_n etc._n etc._n which_o distribution_n the_o foreign_a session_n can_v convenient_o make_v but_o than_o it_o may_v be_v query_v what_o will_v become_v of_o the_o party_n appeal_v how_o shall_v that_o be_v make_v i_o answer_v if_o he_o have_v the_o benefit_n of_o any_o as_o i_o think_v he_o have_v notwithstanding_o it_o must_v be_v to_o the_o quarter_n session_n of_o the_o place_n where_o the_o offence_n be_v commit_v for_o the_o statute_n express_o require_v it_o shall_v be_v deliver_v to_o the_o justice_n convict_v he_o be_v to_o take_v recognizance_n for_o the_o prosecution_n thereof_o with_o effect_n and_o this_o with_o the_o conviction_n he_o be_v to_o return_v into_o the_o session_n but_o than_o it_o may_v be_v again_o query_v how_o such_o offender_n shall_v know_v who_o be_v the_o justice_n convict_v for_o to_o he_o he_o must_v deliver_v his_o appeal_n in_o writing_n
and_o that_o within_o a_o week_n after_o the_o penalty_n pay_v or_o levy_v i_o answer_v that_o will_v be_v know_v by_o the_o warrant_n of_o the_o foreign_a justice_n upon_o which_o the_o levy_n be_v make_v for_o his_o warrant_n either_o mention_n a_o conviction_n by_o himself_o or_o by_o another_o justice_n of_o another_o county_n or_o corporation_n which_o will_v inform_v he_o but_o he_o must_v take_v this_o note_n with_o he_o always_o that_o his_o appeal_n must_v be_v deliver_v in_o person_n for_o he_o himself_o be_v to_o enter_v into_o a_o recognizance_n to_o prosecute_v it_o and_o this_o be_v to_o be_v do_v at_o the_o same_o time_n before_o the_o justice_n convict_v the_o rest_n of_o this_o pargraph_n be_v plain_a enough_o sect_n 14._o provide_v also_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n unless_o etc._n etc._n prosecute_v within_o three_o month_n it_o be_v not_o necessary_a that_o the_o penalty_n be_v actual_o levy_v within_o three_o month_n nor_o that_o a_o conviction_n be_v make_v of_o record_n but_o to_o fulfil_v the_o sense_n of_o this_o clause_n i_o think_v it_o sufficient_a if_o information_n be_v give_v to_o some_o justice_n of_o a_o conventicle_n already_o hold_v in_o order_n to_o the_o make_v a_o conviction_n of_o it_o this_o be_v within_o three_o month_n be_v enough_o for_o such_o information_n be_v in_o order_n to_o a_o conviction_n be_v a_o prosecution_n within_o the_o meaning_n of_o this_o clause_n it_o be_v not_o say_v convict_v but_o prosecute_v and_o such_o information_n be_v a_o commencement_n of_o the_o suit_n this_o be_v the_o primum_fw-la movens_fw-la towards_o a_o conviction_n after_o the_o offence_n commit_v as_o in_o civil_a action_n which_o be_v limit_v to_o be_v bring_v within_o such_o a_o time_n the_o beginning_n of_o a_o suit_n be_v the_o sue_v a_o original_a or_o other_o first_o writ_n as_o latitat_fw-la etc._n etc._n if_o within_o the_o time_n limit_v be_v well_o enough_o though_o the_o suit_n be_v not_o effectual_o prosecute_v though_o there_o be_v no_o judgement_n in_o a_o long_a while_n after_o so_o in_o capital_a criminal_a cause_n which_o must_v be_v prosecute_v within_o a_o certain_a time_n by_o the_o order_n of_o any_o particular_a law_n if_o a_o indictment_n be_v find_v within_o the_o certain_a time_n if_o the_o first_o act_n of_o the_o suit_n be_v begin_v it_o be_v enough_o though_o the_o party_n be_v not_o convict_v within_o twice_o the_o time_n so_o here_o the_o same_o rule_n will_v govern_v no_o person_n shall_v this_o extend_v to_o a_o offend_a justice_n or_o constable_n as_o well_o as_o to_o the_o conventicle_n yet_o if_o such_o justice_n constable_n or_o other_o officer_n neglect_v his_o duty_n against_o the_o tenor_n of_o this_o act_n be_v indict_v or_o otherwise_o sue_v within_o three_o month_n after_o such_o neglect_n or_o refusal_n to_o do_v their_o duty_n it_o be_v a_o sufficient_a prosecution_n within_o the_o three_o month_n although_o not_o convict_v within_o that_o time_n as_o i_o say_v before_o and_o that_o no_o person_n who_o be_v punish_v by_o this_o statute_n shall_v be_v punish_v for_o the_o same_o offence_n by_o any_o other_o law_n for_o the_o same_o offence_n notwithstanding_o this_o a_o conventicler_n may_v be_v punish_v for_o his_o absence_n from_o church_n because_o such_o meeting_n and_o his_o absence_n be_v several_a offence_n shall_v be_v punish_v this_o do_v not_o hinder_v but_o that_o such_o offender_n may_v be_v prosecute_v and_o punish_v as_o at_o the_o common_a law_n for_o any_o thing_n prohibit_v by_o this_o statute_n which_o be_v a_o offence_n at_o the_o common_a law_n i_o say_v he_o may_v be_v prosecute_v as_o at_o common_a law_n if_o he_o have_v be_v actual_o punish_v for_o the_o very_a same_o offence_n by_o virtue_n of_o this_o law_n but_o if_o he_o have_v be_v once_o punish_v by_o this_o law_n if_o sue_v as_o at_o common_a law_n or_o on_o another_o statute_n he_o may_v
