of_o the_o say_a parish_n and_o the_o other_o part_n thereof_o to_o he_o that_o shall_v discover_v and_o prosecute_v for_o any_o of_o the_o say_a offence_n the_o say_a penalty_n to_o be_v levy_v by_o distress_n of_o all_o or_o any_o of_o the_o say_a horse-beast_n or_o ox_n and_o to_o be_v distribute_v as_o aforesaid_a by_o the_o constable_n surveyor_z or_o surveyor_n of_o the_o say_a highway_n overséer_o or_o overséer_v of_o the_o poor_a or_o any_o of_o they_o and_o in_o case_n the_o say_a penalty_n shall_v not_o be_v pay_v within_o three_o day_n after_o such_o distress_n that_o then_o it_o upon_o this_o act_n shall_v be_v lay_v in_o their_o proper_a county_n and_o the_o defendant_n may_v plead_v the_o general_a issue_n and_o be_v hereby_o declare_v and_o adjudge_v to_o be_v common_a highway_n that_o all_o sum_n of_o money_n so_o rate_v and_o assess_v as_o aforesaid_a and_o all_o charitable_a gift_n former_o give_v or_o to_o be_v give_v for_o the_o make_n amend_v and_o keep_v in_o repair_n of_o any_o common_a and_o public_a highway_n pavement_n and_o cawsey_n except_o as_o hereafter_o be_v except_v and_o all_o fine_n penalty_n forfeiture_n and_o other_o sum_n of_o money_n arise_v by_o assessment_n or_o otherwise_o by_o this_o act_n not_o otherwise_o by_o this_o act_n dispose_v of_o and_o all_o issue_n to_o be_v forfeit_v for_o not_o appear_v to_o any_o information_n or_o indictment_n for_o not_o repair_v any_o highway_n or_o remove_v nuisance_n out_o of_o the_o same_o and_o all_o fine_n and_o amerciament_n to_o be_v impose_v upon_o any_o parish_n town_n village_n or_o hamlet_n or_o upon_o any_o private_a person_n for_o not_o repair_v of_o common_a and_o public_a highway_n which_o be_v not_o otherwise_o dispose_v by_o this_o act_n shall_v be_v employ_v and_o bestow_v by_o the_o say_a surveyor_n within_o the_o respective_a parish_n town_n village_n and_o hamlet_n to_o which_o such_o charitable_a gift_n be_v give_v and_o bestow_v and_o within_o which_o such_o assessment_n fines_n penalty_n forfeiture_n issue_n and_o amerciament_n be_v impose_v happen_v or_o make_v in_o pay_v for_o material_n workmen_n wage_n and_o for_o such_o other_o employment_n receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o person_n so_o choose_v shall_v and_o be_v hereby_o require_v upon_o notice_n thereof_o to_o he_o or_o they_o give_v under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n by_o who_o he_o or_o they_o shall_v be_v so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n and_o to_o execute_v the_o same_o in_o such_o manner_n and_o under_o such_o and_o the_o like_a penalty_n as_o if_o he_o or_o they_o have_v be_v choose_v by_o the_o justice_n at_o their_o session_n of_o the_o peace_n in_o manner_n as_o aforesaid_a issue_n suit_n upon_o this_o act_n shall_v be_v lay_v in_o the_o proper_a county_n and_o the_o defendant_n may_v plead_v the_o general_a issue_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n have_v occasion_n to_o pass_v any_o place_n where_o the_o toll_n be_v take_v and_o return_v the_o same_o day_n with_o the_o same_o horse_n coach_n wagon_n or_o other_o carriage_n or_o with_o cattle_n shall_v be_v compel_v in_o the_o same_o day_n to_o pay_v the_o say_a toll_n a_o second_o time_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v also_o that_o all_o and_o every_o person_n and_o person_n who_o by_o law_n be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a shall_v still_o remain_v so_o chargeable_a any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o toll_n the_o continuance_n of_o this_o act_n for_o 11._o year_n only_o proviso_n for_o exempt_n certain_a person_n and_o thing_n from_o pay_v any_o toll_n provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o any_o stowe_n great_a papworth_n little_a papworth_n bear_v and_o elsley_n adjacent_a to_o caxton_n in_o the_o say_a county_n of_o cambridge_n and_o yaxley_n washingley_n glatton_n cunington_n waddon_n and_o stibbington_n adjacent_a to_o stilton_n in_o the_o say_a county_n of_o huntingdon_n shall_v have_v a_o liberty_n to_o carry_v any_o quantity_n or_o quantity_n of_o stone_n sand_n etc._n stone_n that_o purpose_n and_o that_o the_o respective_a sheriff_n shall_v be_v allow_v or_o pay_v from_o the_o king_n upon_o their_o respective_a account_n in_o the_o exchequer_n all_o such_o charge_n by_o they_o expend_v for_o convey_v embarque_a and_o transport_v of_o such_o person_n which_o shall_v be_v allow_v by_o the_o say_v respective_a court_n from_o whence_o they_o receive_v their_o offence_n shall_v pay_v into_o the_o hand_n of_o the_o register_n or_o clerk_n of_o the_o court_n or_o session_n where_o he_o shall_v be_v convict_v before_o the_o say_a court_n or_o session_n shall_v be_v end_v the_o sum_n of_o one_o hundred_o pound_n that_o then_o the_o say_a offender_n shall_v be_v discharge_v from_o imprisonment_n and_o transportation_n and_o the_o judgement_n for_o the_o same_o offence_n punishment_n of_o offender_n after_o the_o three_o offence_n and_o be_v it_o further_o enact_v that_o the_o like_a imprisonment_n indictment_n arraignment_n and_o proceed_n shall_v be_v against_o every_o such_o offender_n as_o often_o as_o he_o shall_v again_o offend_v after_o such_o three_o offence_n nevertheless_o be_v dischargeable_a and_o discharge_v by_o the_o payment_n of_o the_o like_a sum_n as_o be_v pay_v by_o such_o offender_n for_o he_o or_o her_o say_a offence_n next_o before_o commit_v together_o with_o the_o additional_a and_o increase_v sum_n of_o one_o hundred_o pound_n more_o upon_o every_o new_a offence_n commit_v the_o say_v respective_a sum_n to_o be_v pay_v as_o aforesaid_a and_o to_o be_v dispose_v of_o as_o follow_v viz_o the_o one_o moiety_n for_o the_o repair_n of_o the_o parish_n church_n or_o church_n dispose_v how_o the_o say_a penalty_n of_o 100_o l._n shall_v be_v dispose_v chappel_n or_o chapel_n of_o such_o parish_n within_o which_o such_o conventicle_n assembly_n or_o meeting_n shall_v be_v hold_v and_o the_o other_o moiety_n to_o the_o repair_n of_o the_o highway_n of_o the_o say_a parish_n or_o parish_n if_o need_v require_v or_o otherwise_o for_o the_o amendment_n of_o such_o highway_n as_o the_o justice_n of_o the_o peace_n at_o their_o respective_a quarter-session_n shall_v direct_v and_o appoint_v and_o if_o any_o constable_n headborough_z or_o tythingman_n shall_v neglect_v to_o execute_v any_o the_o say_a warrant_n make_v unto_o they_o for_o sequester_v distrain_v and_o sell_v any_o of_o the_o good_n and_o chattel_n of_o any_o offender_n against_o this_o act_n for_o the_o levy_v such_o sum_n of_o money_n as_o shall_v be_v impose_v for_o the_o first_o or_o second_o offence_n he_o shall_v forfeit_v grow_v by_o such_o seditious_a and_o tumultuous_a meeting_n under_o pretence_n of_o religious_a worship_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o lieutenant_n or_o deputy-lieutenant_n or_o any_o commissioned_n officer_n of_o the_o militia_n or_o any_o other_o of_o his_o majesty_n force_n with_o such_o troop_n or_o company_n of_o horse_n or_o foot_n and_o also_o the_o sheriff_n and_o justice_n of_o peace_n and_o other_o magistrate_n and_o minister_n of_o justice_n or_o any_o of_o they_o joint_o or_o several_o within_o any_o of_o the_o county_n or_o place_n within_o this_o kingdom_n of_o england_n dominion_n of_o wales_n or_o town_n of_o berwick_n upon_o tweed_n with_o such_o other_o assistance_n as_o they_o shall_v think_v meet_a or_o can_v get_v in_o enjoin_v to_o repair_v unto_o the_o place_n where_o they_o be_v so_o hold_v or_o to_o be_v hold_v and_o by_o the_o best_a mean_n they_o can_v to_o dissolve_v and_o dissipate_v or_o prevent_v all_o such_o unlawful_a meeting_n and_o take_v into_o their_o custody_n such_o of_o those_o person_n so_o unlawful_o assemble_v as_o they_o shall_v judge_v to_o be_v the_o leader_n and_o seducer_n of_o the_o rest_n and_o such_o other_o as_o they_o shall_v think_v fit_a to_o be_v proceed_v against_o according_a to_o law_n for_o such_o their_o offence_n house_n the_o penalty_n of_o suffer_a conventicle_n in_o private_a house_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o every_o person_n who_o shall_v witting_o and_o willing_o suffer_v any_o such_o conventicle_n unlawful_a assembly_n or_o meet_v aforesaid_a to_o be_v hold_v in_o his_o or_o her_o house_n outhouse_n barn_n or_o room_n yard_n or_o backside_n wood_n or_o ground_n shall_v incur_v the_o same_o penalty_n and_o forfeiture_n as_o any_o other_o offender_n against_o this_o act_n ought_v to_o incur_v and_o be_v proceed_v against_o in_o all_o point_n in_o such_o manner_n as_o any_o other_o excise_n upon_o foreign_a liquor_n import_v to_o be_v pay_v in_o money_n before_o land_v duty_n and_o charge_n of_o excise_n or_o new_a impost_n above_o mention_v hereby_o set_v or_o impose_v upon_o all_o and_o every_o the_o say_v foreign_a liquor_n which_o shall_v be_v import_v or_o bring_v into_o all_o or_o any_o the_o port_n of_o this_o kingdom_n and_o dominion_n thereof_o aforesaid_a from_o and_o after_o the_o five_o and_o twenty_o day_n of_o december_n next_o shall_v be_v from_o time_n to_o time_n satisfy_v and_o pay_v by_o the_o merchant_n or_o merchant_n importer_n or_o importer_n of_o the_o same_o in_o ready_a money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a etc._n entry_n to_o be_v make_v at_o the_o office_n of_o excise_n by_o common_a brewer_n innkeeper_n etc._n etc._n that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a alehouse-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n entry_n the_o penalty_n for_o not_o make_v entry_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v ten_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n pay_v the_o penalty_n for_o not_o pay_v who_o shall_v not_o pay_v and_o clear_v off_o
against_o he_o for_o discharge_v such_o prisoner_n personal_a delay_n in_o suit_n by_o reason_n of_o 15_o day_n between_o the_o testae_fw-la and_o retorn_a of_o writ_n remedy_v in_o action_n value_n thereof_o shall_v be_v forfeit_v and_o lose_v the_o one_o moiety_n to_o the_o king_n majesty_n and_o the_o other_o moiety_n to_o he_o or_o they_o who_o shall_v or_o will_v seize_v inform_v or_o sue_v for_o the_o same_o to_o be_v recover_v of_o the_o importer_n or_o proprietor_n thereof_o and_o that_o no_o person_n or_o person_n whatsoever_o bring_v any_o exciseable_a liquor_n except_o béer_o ale_n cider_n perry_n and_o metheglin_n into_o any_o part_n or_o place_n of_o this_o realm_n by_o coast_n cocquet_n transire_fw-la or_o certificate_n nor_o any_o person_n or_o person_n to_o do_v brew_v their_o own_o béer_n and_o ale_n within_o their_o own_o precinct_n and_o size_n it_o out_o to_o their_o respective_a member_n within_o their_o own_o precinct_n only_o be_v not_o liable_a to_o the_o payment_n of_o any_o duty_n of_o excise_n for_o the_o same_o either_o by_o this_o or_o any_o the_o forementioned_a acts._n provide_v also_o and_o be_v it_o enact_v that_o all_o difference_n appeal_n and_o complaint_n that_o shall_v happen_v and_o arise_v between_o party_n and_o party_n county_n complaint_n to_o be_v determine_v in_o the_o proper_a county_n in_o order_n to_o the_o payment_n of_o the_o duty_n of_o excise_n shall_v be_v hear_v and_o determine_v in_o the_o proper_a county_n or_o in_o the_o several_a riding_n and_o division_n of_o yorkshire_n and_o lincolnshire_n where_o they_o shall_v arise_v and_o not_o elsewhere_o fe_n commissioner_n or_o farmer_n may_v take_v no_o fe_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o farmer_n commissioner_n sub-commissioner_n or_o other_o officer_n of_o excise_n shall_v direct_o or_o indirect_o take_v or_o receive_v any_o money_n fee_n or_o reward_n for_o or_o concern_v the_o take_n of_o any_o bond_n or_o give_v any_o receipt_n or_o note_n in_o write_v relate_v to_o the_o excise_n to_o or_o from_o any_o person_n or_o person_n whatsoever_o upon_o pain_n that_o every_o such_o person_n so_o offend_v shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o shilling_n act._n who_o may_v hear_v and_o determine_v matter_n upon_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n of_o the_o peace_n or_o any_o two_o or_o more_o of_o they_o or_o chief_a magistrate_n in_o the_o several_a county_n city_n division_n and_o place_n within_o england_n and_o wales_n respective_o shall_v meet_v once_o in_o every_o month_n in_o their_o respective_a division_n or_o often_o if_o there_o shall_v be_v occasion_n to_o hear_v determine_v and_o to_o adjudge_v all_o matter_n and_o offence_n against_o this_o or_o the_o aforesaid_a acts._n recover_v how_o the_o penalty_n upon_o this_o act_n shall_v be_v dispose_v and_o recover_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o one_o three_o part_n of_o all_o fine_n penalty_n and_o forfeiture_n not_o herein_o otherwise_o dispose_v shall_v be_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n &_o one_o other_o three_o part_n to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v &_o the_o other_o three_o part_n to_o he_o that_o shall_v inform_v and_o sue_v for_o the_o same_o and_o that_o all_o fine_n penalty_n and_o forfeiture_n for_o which_o no_o remedy_n be_v ordain_v for_o cause_n of_o excise_n within_o the_o immediate_a limit_n of_o the_o chief_a office_n of_o london_n nor_o within_o the_o limit_n of_o the_o present_a farm_n of_o london_n during_o the_o continuance_n of_o such_o farm_n shall_v be_v admit_v unless_o the_o same_o be_v bring_v within_o two_o month_n next_o after_o the_o first_o judgement_n and_o notice_n thereof_o give_v or_o leave_v at_o the_o dwellinghouse_n of_o the_o party_n or_o party_n concern_v therein_o nor_o shall_v any_o appeal_n in_o any_o matter_n or_o cause_n of_o excise_n in_o any_o other_o county_n city_n town_n or_o place_n
