or_o both_o of_o the_o house_n will_v not_o consent_v to_o it_o in_o such_o a_o case_n i_o say_v not_o according_a to_o my_o own_o but_o mr._n baxter_n opinion_n such_o a_o law_n or_o such_o law_n may_v be_v make_v by_o the_o king_n without_o nay_o against_o the_o consent_n of_o both_o house_n and_o à _fw-la paritate_fw-la rationis_fw-la for_o the_o same_o cause_n and_o by_o the_o like_a reason_n money_n may_v be_v raise_v if_o without_o raise_v of_o money_n a_o naval_a force_n for_o example_n as_o may_v be_v sufficient_a for_o the_o preservation_n of_o the_o kingdom_n from_o imminent_a danger_n by_o a_o foreign_a invasion_n can_v be_v have_v and_o then_o according_a to_o mr._n baxter_n hypothesis_n ground_n what_o can_v be_v say_v against_o raise_v of_o ship-money_n by_o the_o late_a king_n he_o be_v the_o judge_n of_o the_o greatness_n and_o imminency_n of_o the_o danger_n and_o that_o it_o can_v not_o stay_v for_o a_o parliamentary_a supply_n there_o be_v no_o parliament_n then_o sit_v and_o the_o great_a extraparliamentary_a judicatory_a of_o the_o nation_n have_v be_v advise_v with_o by_o the_o king_n and_o give_v he_o their_o opinion_n that_o he_o may_v legal_o do_v what_o he_o do_v certain_o these_o thing_n consider_v if_o mr._n baxter_n aphorism_n be_v true_a the_o king_n be_v raise_v or_o endeavour_v to_o raise_v ship-money_n without_o consent_n of_o parliament_n be_v not_o so_o heinous_a a_o violation_n of_o the_o legal_a constitution_n which_o he_o be_v oblige_v or_o have_v oblige_v himself_o to_o govern_v by_o especial_o after_o it_o be_v by_o his_o consent_n condemn_v in_o parliament_n as_o to_o be_v make_v as_o it_o be_v by_o mr._n baxter_n one_o of_o the_o principal_a cause_n of_o his_o side_v with_o the_o parliament_n in_o rebellion_n against_o the_o king_n for_o if_o the_o king_n be_v maximè_fw-la dignus_fw-la istâ_fw-la contumeliâ_fw-la indignus_fw-la illequi_fw-la faceret_fw-la tamen_fw-la if_o he_o do_v never_o so_o much_o deserve_v this_o affront_n yet_o it_o do_v not_o become_v mr._n baxter_n to_o give_v it_o he_o not_o only_o because_o by_o the_o high_a judicature_n then_o in_o be_v it_o be_v declare_v to_o be_v legal_a but_o because_o according_a to_o mr._n baxter_n own_o judgement_n declare_v in_o this_o aphorism_n the_o king_n may_v have_v do_v it_o suppose_v it_o necessary_a for_o the_o preservation_n of_o the_o public_a though_o it_o have_v not_o be_v legal_a but_o this_o shall_v not_o be_v my_o answer_n to_o the_o aforesaid_a objection_n i_o remember_v what_o i_o have_v say_v before_o answer_n upon_o another_o occasion_n viz._n that_o a_o mischief_n be_v better_a than_o a_o inconvenience_n which_o i_o think_v be_v a_o maxim_n of_o our_o law_n and_o the_o meaning_n of_o it_o be_v as_o i_o conceive_v that_o it_o be_v better_a to_o run_v the_o hazard_n of_o a_o very_a great_a evil_n which_o possible_o may_v but_o be_v very_o unlikely_a will_n befall_v we_o than_o for_o the_o avoid_n or_o prevent_v of_o it_o to_o make_v use_n of_o such_o a_o remedy_n as_o frequent_o may_v be_v and_o probable_o will_v be_v make_v use_n of_o when_o there_o be_v no_o such_o occasion_n therefore_o for_o answer_v to_o the_o aforesaid_a objection_n i_o will_v not_o say_v that_o the_o king_n can_v make_v law_n to_o oblige_v the_o whole_a nation_n without_o the_o consent_n of_o both_o house_n of_o parliament_n though_o never_o so_o much_o for_o the_o public_a good_a or_o never_o so_o necessary_a for_o the_o preservation_n of_o the_o whole_a kingdom_n but_o this_o i_o will_v say_v that_o though_o such_o law_n can_v be_v make_v without_o their_o consent_n yet_o it_o be_v not_o they_o nor_o law_n their_o consent_n to_o they_o that_o make_v they_o to_o be_v law_n for_o then_o either_o the_o bill_n will_v be_v law_n assoon_o as_o they_o be_v pass_v by_o both_o house_n or_o the_o be_v pass_v by_o the_o two_o house_n must_v oblige_v the_o king_n to_o pass_v they_o also_o but_o neither_o of_o these_o be_v true_a according_a to_o the_o legal_a and_o fundamental_a constitution_n of_o our_o government_n as_o appear_v not_o only_o by_o the_o constant_a practice_n to_o the_o contrary_a but_o by_o the_o frequent_a and_o importunate_a address_n make_v unto_o the_o late_a king_n by_o the_o two_o house_n of_o the_o rebellious_a parliament_n to_o make_v their_o
