give_v in_o a_o superior_a of_o which_o no_o such_o precedent_n be_v to_o be_v find_v in_o regular_a time_n scarce_o in_o the_o most_o confuse_a and_o disorderly_a 2._o because_o it_o be_v in_o case_n of_o privilege_n which_o be_v the_o most_o tender_a part_n of_o every_o court_n for_o if_o the_o right_n and_o privilege_n of_o any_o court_n be_v make_v light_n of_o the_o court_n itself_o will_v soon_o come_v to_o nothing_o because_o they_o be_v as_o it_o be_v the_o most_o effential_a part_n of_o it_o if_o not_o the_o very_a essence_n of_o the_o court_n for_o what_o signify_v a_o court_n if_o its_o order_n can_v be_v execute_v it_o be_v better_a that_o a_o court_n be_v not_o than_o that_o its_o privilege_n shall_v not_o be_v due_o observe_v for_o without_o that_o it_o become_v a_o snare_n and_o mischief_n to_o the_o people_n rather_o than_o a_o advantage_n 3._o because_o by_o this_o they_o have_v set_v the_o foot_n above_o the_o head_n for_o as_o they_o have_v by_o this_o declare_v themselves_o to_o be_v superior_a to_o the_o lord_n so_o it_o will_v natural_o follow_v that_o a_o quarter-session_n may_v reverse_v their_o order_n or_o suspend_v their_o privilege_n and_o a_o more_o inferior_a court_n shall_v supersede_n what_o the_o quarter-session_n do_v and_o thus_o it_o must_v go_v on_o till_o the_o course_n of_o nature_n be_v invert_v 4._o because_o they_o may_v as_o well_o deny_v a_o lord_n or_o over-rule_v any_o other_o privilege_n as_o well_o as_o this_o and_o so_o consequent_o when_o the_o house_n of_o lord_n be_v not_o actual_o sit_v every_o peer_n must_v be_v behold_v to_o the_o judge_n for_o every_o privilege_n that_o he_o enjoy_v 5._o if_o this_o judgement_n be_v according_a to_o law_n then_o may_v the_o king_n bench_n try_v a_o peer_n for_o misdemeanour_n at_o the_o very_a time_n when_o the_o house_n of_o lord_n be_v sit_v and_o consequent_o the_o house_n must_v want_v a_o member_n if_o the_o king_n bench_n see_v it_o good_a to_o have_v it_o so_o and_o what_o a_o confusion_n will_v it_o make_v and_o the_o consequence_n of_o it_o will_v be_v be_v easy_o discern_v the_o want_n of_o one_o member_n make_v that_o house_n think_v itself_o to_o be_v lame_a as_o be_v see_v in_o the_o case_n of_o the_o earl_n of_o arundale_n 3_o car._n how_o many_o petition_n do_v the_o lord_n make_v and_o how_o many_o message_n pass_v to_o and_o fro_o between_o the_o king_n and_o they_o who_o will_v not_o proceed_v to_o any_o business_n till_o he_o be_v restore_v to_o his_o place_n in_o that_o house_n for_o they_o tell_v the_o king_n that_o no_o lord_n of_o parliament_n the_o parliament_n sit_v or_o within_o the_o usual_a time_n of_o privilege_n of_o parliament_n be_v to_o be_v imprison_v or_o restrain_v without_o sentence_n or_o order_n of_o the_o house_n unless_o it_o be_v for_o treason_n or_o felony_n or_o for_o refuse_v to_o give_v security_n for_o the_o peace_n sure_o the_o judge_n do_v not_o give_v that_o judgement_n for_o want_n of_o understand_v that_o judgement_n of_o the_o lord_n for_o nothing_o can_v be_v more_o express_a and_o plain_a for_o it_o and_o say_v direct_o that_o sit_v the_o parliament_n or_o within_o usual_a time_n of_o privilege_n no_o peer_n shall_v be_v molest_v unless_o for_o treason_n or_o felony_n or_o for_o refuse_v to_o give_v security_n for_o the_o peace_n the_o earl_n of_o devonshire_n do_v all_o that_o the_o judge_n can_v require_v of_o he_o by_o find_v surety_n for_o the_o peace_n and_o what_o the_o judge_n do_v more_o be_v not_o ground_v upon_o that_o judgement_n of_o the_o lord_n but_o be_v a_o manifest_a and_o presumptuous_a invasion_n and_o violation_n of_o the_o privilege_n of_o the_o whole_a peerage_n of_o england_n it_o be_v very_o obvious_a how_o the_o peerage_n have_v be_v undermine_v ever_o since_o hen._n vii_n time_n what_o endeavour_n have_v be_v use_v to_o make_v it_o less_o and_o less_o first_o by_o multiply_v the_o number_n of_o they_o second_o by_o raise_v people_n of_o mean_a extraction_n to_o that_o dignity_n both_o which_o tend_v to_o render_v it_o contemptible_a but_o nothing_o can_v make_v it_o more_o despicable_a than_o that_o its_o privilege_n shall_v depend_v upon_o the_o beck_n of_o the_o king_n bench_n and_o therefore_o consider_v how_o groundless_a and_o without_o precedent_n it_o be_v what_o they_o have_v do_v in_o the_o case_n of_o the_o say_a earl_n it_o be_v no_o more_o than_o probable_a that_o they_o thereby_o aim_v at_o pull_v down_o the_o peerage_n for_o what_o seem_v so_o likely_a as_o it_o do_v it_o carric_n its_o evidence_n in_o its_o face_n for_o it_o manifest_o take_v away_o the_o privilege_n of_o the_o peer_n and_o till_o it_o do_v appear_v for_o what_o other_o end_n it_o be_v do_v all_o man_n of_o sense_n and_o that_o be_v unprejudiced_a must_v believe_v it_o be_v to_o pull_v down_o the_o peerage_n for_o all_o that_o can_v be_v pretend_v be_v either_o to_o secure_v the_o peace_n or_o to_o punish_v the_o offence_n the_o earl_n do_v give_v security_n for_o the_o peace_n and_o he_o do_v not_o design_n to_o shift_v off_o his_o trial_n but_o that_o it_o shall_v be_v in_o its_o proper_a season_n for_o though_o it_o delay_v the_o trial_n yet_o it_o bring_v it_o to_o the_o proper_a time_n and_o so_o consequent_o the_o more_o legal_a and_o reasonable_a but_o the_o judge_n must_v go_v out_o of_o the_o way_n of_o reason_n and_o the_o law_n to_o make_v a_o breach_n in_o the_o privilege_n of_o the_o peer_n it_o be_v too_o common_o the_o discourse_n every_o where_o and_o i_o fear_v with_o too_o much_o reason_n that_o the_o judge_n make_v very_o bold_a with_o the_o law_n but_o it_o be_v plain_a by_o this_o judgement_n that_o they_o have_v stick_v the_o privilege_n of_o the_o peer_n under_o their_o girdle_n whether_o it_o do_v proceed_v from_o ignorance_n or_o corruptness_n will_v appear_v upon_o what_o they_o shall_v say_v for_o themselves_o it_o be_v too_o plain_a from_o one_o of_o they_o it_o be_v and_o either_o of_o you_o render_v they_o unmeet_a to_o sit_v in_o that_o place_n i_o do_v remember_v that_o the_o puny_a judge_n give_v this_o reason_n for_o overrule_a the_o earl_n privilege_n say_v he_o your_o lordship_n and_o all_o the_o peer_n receive_v all_o your_o privilege_n from_o the_o king_n and_o therefore_o it_o will_v be_v very_o unreasonable_a to_o make_v use_n of_o they_o against_o he_o and_o see_v the_o king_n be_v concern_v in_o this_o case_n i_o be_o of_o the_o opinion_n that_o their_o plea_n be_v overrule_v it_o be_v say_v that_o he_o have_v some_o law_n and_o therefore_o it_o be_v the_o great_a presumption_n in_o he_o to_o judge_v upon_o the_o lord_n privilege_n who_o be_v not_o qualify_v by_o law_n to_o sit_v as_o a_o judge_n in_o any_o case_n for_o he_o be_v a_o papist_n as_o every_o body_n say_v and_o so_o consequent_o have_v not_o take_v the_o oath_n and_o test_n that_o the_o law_n enjoin_v before_o he_o take_v his_o place_n on_o the_o bench._n but_o as_o to_o his_o doctrine_n which_o he_o lay_v down_o since_o it_o do_v not_o proper_o come_v into_o this_o debate_n i_o will_v only_o ask_v he_o a_o few_o question_n whether_o there_o be_v not_o a_o people_n before_o there_o be_v a_o king_n whether_o the_o king_n beget_v all_o his_o people_n and_o if_o people_n of_o several_a nation_n shall_v be_v cast_v upon_o a_o island_n and_o see_v no_o probability_n of_o get_v thence_o they_o agree_v upon_o certain_a law_n and_o rule_n for_o the_o common_a good_a and_o make_v choice_n of_o the_o wise_a man_n among_o they_o as_o their_o king_n to_o rule_v and_o govern_v they_o according_a to_o those_o law_n can_v it_o then_o be_v say_v that_o the_o people_n receive_v their_o privilege_n from_o he_o or_o that_o he_o be_v not_o strict_o bind_v to_o govern_v they_o by_o those_o law_n and_o no_o other_o i_o desire_v to_o ask_v this_o one_o question_n more_o whether_o the_o king_n be_v not_o bind_v as_o well_o by_o his_o oath_n as_o by_o the_o nature_n of_o the_o government_n to_o protect_v and_o defend_v every_o subject_a in_o his_o just_a right_n and_o property_n but_o allow_v his_o doctrine_n as_o orthodox_n yet_o his_o reason_n be_v admirable_a for_o the_o subject_n be_v not_o to_o make_v a_o defence_n in_o any_o case_n if_o the_o king_n have_v any_o title_n or_o concern_v in_o it_o all_o corporation_n must_v deliver_v up_o their_o charter_n of_o course_n whenever_o a_o quo_fw-la warranto_fw-la be_v bring_v and_o why_o because_o it_o be_v a_o grant_n from_o the_o king_n and_o it_o will_v be_v very_o hard_a to_o oppose_v he_o with_o his_o own_o gift_n whoever_o hold_v any_o thing_n by_o gift_n from_o the_o crown_n and_o though_o make_v as_o sure_a as_o the_o broad_a seal_n can_v make_v it_o
constitute_v by_o god_n himself_o but_o that_o can_v be_v so_o for_o it_o will_v follow_v that_o god_n be_v unjust_a which_o he_o can_v be_v there_o neither_o be_v nor_o be_v any_o government_n of_o that_o sort_n but_o only_o that_o of_o the_o jew_n the_o rest_n of_o the_o world_n be_v leave_v to_o themselves_o to_o frame_v such_o a_o government_n as_o suit_v best_o to_o their_o inclination_n and_o to_o make_v such_o rule_n and_o law_n as_o they_o can_v best_o obey_v and_o be_v govern_v by_o we_o be_v compound_v of_o a_o absolute_a monarchy_n and_o a_o commonwealth_n and_o the_o original_n of_o it_o we_o have_v from_o the_o saxon_n but_o be_v it_o what_o it_o will_v or_o whence_o it_o will_v it_o be_v without_o question_n that_o the_o first_o original_n of_o our_o king_n be_v that_o the_o people_n find_v it_o for_o their_o advantage_n to_o set_v one_o over_o they_o because_o of_o his_o wisdom_n valour_n and_o justice_n and_o therefore_o they_o give_v he_o several_a prerogative_n above_o the_o rest_n of_o the_o people_n that_o he_o may_v be_v the_o better_a able_a to_o govern_v and_o defend_v they_o for_o there_o be_v none_o of_o the_o king_n prerogative_n but_o be_v for_o the_o good_a of_o the_o nation_n if_o right_o employ_v but_o it_o will_v be_v a_o strange_a conclusion_n to_o suppose_v that_o the_o people_n oblige_v themselves_o to_o submit_v to_o the_o posterity_n of_o that_o man_n who_o they_o first_o choose_v for_o their_o king_n because_o of_o his_o extraordinary_a endowment_n let_v they_o be_v what_o they_o will_v and_o never_o so_o unfit_a for_o the_o government_n for_o the_o next_o of_o blood_n may_v be_v incapable_a of_o govern_v in_o several_a respect_n suppose_v a_o fool_n or_o lunatic_n by_o his_o principle_n if_o he_o aim_v at_o arbitrary_a power_n by_o his_o religion_n if_o he_o be_v a_o papist_n or_o a_o heathen_a or_o by_o his_o practice_n before_o he_o come_v to_o the_o crown_n to_o destroy_v the_o religion_n and_o government_n by_o law_n establish_v now_o this_o i_o do_v not_o say_v to_o argue_v that_o the_o election_n of_o the_o king_n be_v in_o the_o people_n though_o i_o think_v much_o may_v be_v say_v in_o that_o case_n neither_o be_v it_o now_o the_o question_n but_o that_o which_o i_o speak_v for_o be_v to_o prove_v that_o the_o next_o of_o blood_n have_v not_o so_o absolute_a a_o inherent_a right_n to_o the_o crown_n but_o that_o he_o may_v for_o the_o good_a of_o the_o nation_n be_v set_v aside_o there_o be_v yet_o another_o inconvenience_n to_o allow_v the_o next_o of_o blood_n to_o have_v so_o absolute_a a_o right_n to_o the_o crown_n because_o the_o possession_n of_o the_o crown_n take_v away_o all_o disability_n but_o only_o such_o as_o be_v by_o act_n of_o parliament_n which_o be_v so_o every_o king_n must_v thank_v his_o successor_n for_o every_o moment_n that_o he_o live_v if_o he_o kill_v he_o himself_o he_o can_v be_v question_v for_o it_o because_o as_o soon_o as_o the_o one_o be_v dead_a the_o other_o be_v king_n for_o here_o the_o king_n never_o die_v if_o therefore_o the_o next_o of_o blood_n have_v so_o absolute_a a_o right_n the_o king_n be_v very_o unsafe_a for_o though_o the_o d._n be_v not_o incline_v to_o shorten_v his_o brother_n day_n nay_o though_o he_o be_v averse_a to_o it_o yet_o in_o obedience_n to_o the_o pope_n and_o his_o priest_n it_o must_v be_v do_v either_o by_o himself_o or_o some_o other_o hand_n and_o then_o how_o long_o we_o expect_v his_o majesty_n life_n if_o king_n be_v good_a man_n a_o absolute_a monarchy_n be_v the_o best_a government_n but_o we_o see_v that_o they_o be_v subject_a to_o the_o same_o infirmity_n with_o other_o man_n and_o therefore_o it_o be_v necessary_a to_o bound_v their_o power_n and_o by_o reason_n that_o they_o be_v flesh_n and_o blood_n and_o the_o nation_n be_v so_o apt_a to_o be_v bad_a by_o their_o example_n i_o believe_v be_v that_o wherefore_o god_n be_v averse_a to_o let_v the_o jew_n have_v a_o king_n till_o they_o have_v king_n they_o never_o revolt_v so_o whole_o from_o he_o when_o their_o king_n be_v good_a they_o be_v obedient_a to_o he_o but_o when_o they_o be_v idolatrous_a than_o the_o people_n go_v mad_a of_o idol_n i_o hope_v it_o be_v no_o regis_fw-la ad_fw-la exemplum_fw-la that_o make_v our_o nation_n so_o lewd_a and_o wicked_a at_o this_o day_n a_o speech_n against_o arbitrary_a and_o illegal_a imprisonment_n by_o the_o privy_a council_n there_o be_v not_o any_o thing_n that_o a_o englishman_n can_v claim_v as_o his_o right_n that_o we_o value_v more_o than_o freedom_n and_o liberty_n i_o mean_v that_o of_o the_o body_n because_o imprisonment_n be_v a_o sort_n of_o death_n and_o less_o tolerable_a to_o some_o than_o death_n itself_o for_o by_o it_o we_o be_v deprive_v of_o all_o our_o earthly_a comfort_n what_o be_v a_o man_n the_o better_a for_o have_v never_o so_o great_a a_o estate_n never_o so_o great_a honour_n or_o what_o else_o be_v desirable_a in_o this_o world_n if_o he_o be_v restrain_v of_o his_o liberty_n now_o there_o be_v several_a sort_n of_o restraint_n or_o imprisonment_n and_o they_o be_v all_o forbid_a by_o our_o law_n unless_o the_o cause_n be_v very_o just_a and_o reasonable_a not_o for_o bare_a surmise_n or_o vain_a story_n that_o a_o man_n shall_v be_v imprison_v and_o hurry_v from_o his_o abode_n but_o only_o for_o such_o cause_n as_o shall_v prove_v that_o it_o be_v for_o the_o good_a of_o the_o government_n and_o the_o support_n of_o it_o that_o this_o or_o that_o man_n be_v imprison_v or_o restrain_v although_o the_o law_n have_v take_v very_o good_a care_n yet_o the_o subject_n be_v often_o abuse_v in_o his_o liberty_n sometime_o by_o the_o court_n in_o west-hall_n sometime_o by_o other_o court_n and_o particular_a magistrate_n but_o the_o great_a cause_n of_o complaint_n proceed_v from_o the_o privy_a council_n the_o privy_a council_n that_o be_v though_o they_o have_v be_v much_o to_o blame_v in_o this_o particular_a yet_o it_o be_v not_o a_o new_a thing_n that_o they_o practice_n but_o this_o itch_n of_o send_v for_o and_o imprison_a the_o subject_a upon_o vain_a pretence_n have_v descend_v from_o one_o privy_a council_n to_o another_o like_o a_o infirmity_n that_o run_v in_o a_o blood_n for_o no_o soon_o be_v a_o man_n make_v a_o privy_a councillor_n but_o this_o spirit_n rest_v upon_o he_o this_o mischief_n be_v early_o espy_v even_o in_o henry_n iii's_fw-la time_n and_o several_a law_n have_v be_v make_v to_o restrain_v the_o privy_a council_n by_o i_o hope_v that_o on_o which_o of_o they_o soever_o popery_n shall_v most_o depend_v when_o it_o be_v raise_v itself_o to_o the_o pitch_n that_o it_o design_n that_o they_o will_v slip_v away_o its_o be_v not_o so_o much_o king_n to_o all_o intent_n and_o purpose_n as_o he_o be_v after_o he_o be_v crown_v for_o if_o the_o crown_n of_o the_o king_n be_v but_o a_o mere_a ceremony_n or_o compliment_n of_o state_n and_o not_o essential_a in_o give_v he_o a_o right_n to_o the_o allegiance_n of_o the_o subject_a then_o certain_o no_o king_n of_o england_n will_v be_v trouble_v with_o the_o ceremony_n of_o be_v formal_o crown_v because_o then_o there_o will_v lie_v no_o obligation_n upon_o he_o to_o take_v the_o coronation_n oath_n and_o so_o he_o may_v be_v more_o at_o liberty_n to_o act_v according_a to_o his_o will_n because_o his_o conscience_n will_v not_o be_v clog_v with_o the_o weight_n of_o so_o solemn_a a_o oath_n and_o then_o with_o less_o infamy_n and_o reflection_n he_o may_v suspend_v or_o pervert_v the_o law_n and_o therefore_o with_o submission_n to_o better_a judgement_n i_o be_o not_o convince_v that_o the_o king_n whilst_o he_o be_v uncrowned_a have_v that_o right_n in_o our_o allegiance_n as_o he_o have_v after_o that_o the_o crown_n be_v set_v upon_o his_o head_n in_o the_o same_o way_n that_o it_o ought_v to_o be_v do_v for_o before_o the_o crown_n be_v set_v upon_o his_o head_n by_o the_o archbishop_n or_o other_o person_n appoint_v to_o do_v it_o the_o nobility_n and_o people_n be_v ask_v if_o they_o will_v do_v their_o homage_n and_o service_n to_o he_o which_o by_o the_o way_n imply_v that_o the_o people_n be_v at_o liberty_n in_o the_o thing_n and_o that_o if_o he_o be_v crown_v it_o be_v by_o their_o leave_n and_o election_n then_o if_o the_o people_n consent_n the_o king_n take_v the_o coronation_n oath_n which_o be_v to_o preserve_v the_o church_n our_o law_n liberty_n and_o property_n and_o to_o administer_v justice_n indifferent_o and_o thus_o when_o he_o have_v swear_v to_o we_o the_o crown_n be_v immediate_o put_v upon_o his_o head_n and_o then_o the_o nobility_n and_o people_n do_v their_o homage_n to_o he_o and_o according_a to_o this_o have_v be_v the_o practice_n ever_o since_o there_o be_v king_n in_o england_n and_o i_o believe_v there_o be_v scarce_o a_o instance_n where_o the_o people_n ever_o swear_v to_o the_o king_n before_o be_v have_v take_v his_o oath_n to_o they_o if_o there_o be_v any_o such_o precedent_n it_o be_v to_o be_v look_v upon_o as_o irregular_a and_o not_o to_o be_v a_o direction_n to_o we_o for_o it_o be_v not_o impossible_a but_o such_o a_o thing_n may_v happen_v but_o however_o be_v it_o reasonable_a that_o one_o or_o two_o instance_n shall_v be_v sufficient_a to_o invalid_a a_o practice_n of_o several_a hundred_o year_n to_o the_o contrary_a and_o be_v it_o not_o a_o piece_n of_o nonsense_n that_o we_o shall_v adventure_v our_o religion_n and_o property_n and_o all_o we_o have_v in_o the_o hand_n of_o he_o that_o for_o aught_o we_o know_v have_v a_o obligation_n on_o he_o to_o ruin_v or_o give_v we_o up_o to_o a_o foreigner_n and_o not_o in_o the_o first_o place_n to_o take_v security_n from_o he_o that_o he_o will_v defend_v and_o do_v we_o right_o before_o we_o repose_v so_o great_a a_o trust_n in_o he_o for_o otherwise_o such_o confusion_n and_o such_o contradiction_n will_v follow_v that_o the_o wit_n of_o man_n can_v invent_v how_o to_o salve_v they_o but_o i_o acknowledge_v there_o be_v some_o instance_n where_o the_o people_n have_v swear_v to_o the_o succession_n in_o the_o life-time_n of_o the_o father_n and_o thence_o some_o do_v infer_v that_o the_o king_n be_v entitle_v to_o our_o allegiance_n before_o the_o crown_n be_v set_v on_o his_o head_n but_o this_o under_o correction_n will_v not_o hold_v for_o it_o do_v not_o appear_v but_o that_o the_o intend_a successor_n swear_v to_o they_o also_o at_o the_o same_o time_n and_o it_o be_v very_o probable_a he_o do_v yet_o if_o he_o do_v not_o it_o can_v thence_o be_v conclude_v that_o the_o king_n have_v right_o to_o our_o allegiance_n before_o he_o be_v crown_v for_o whenever_o it_o happen_v that_o the_o successor_n be_v swear_v to_o in_o the_o life-time_n of_o his_o father_n if_o afterward_o he_o come_v to_o the_o crown_n he_o take_v the_o coronation_n oath_n before_o the_o people_n swear_v allegiance_n to_o he_o and_o therefore_o it_o be_v very_o plain_a that_o a_o oath_n take_v to_o the_o successor_n in_o the_o life-time_n of_o his_o father_n be_v nothing_o more_o but_o a_o declare_v the_o good_a like_n they_o have_v of_o the_o successor_n and_o that_o if_o in_o case_n he_o will_v promise_v to_o defend_v they_o and_o their_o property_n when_o his_o father_n or_o predecessor_n die_v they_o will_v elect_v he_o for_o their_o king_n as_o possible_o it_o may_v now_o fall_v out_o if_o in_o case_n the_o duke_n of_o monmouth_n be_v legitimate_a do_v you_o think_v that_o the_o people_n will_v be_v very_o inclinable_a to_o swear_v to_o his_o succession_n next_o after_o the_o king_n and_o i_o believe_v you_o will_v never_o find_v it_o do_v but_o when_o the_o king_n have_v the_o heart_n of_o the_o people_n or_o out_o of_o the_o hope_n they_o have_v in_o the_o successor_n for_o english_a man_n if_o the_o king_n please_v they_o he_o may_v have_v all_o they_o have_v even_o to_o their_o skin_n as_o a_o wise_a man_n say_v if_o a_o english_a king_n will_v be_v kind_a to_o the_o people_n he_o can_v never_o want_v their_o head_n hand_n and_o purse_n and_o therefore_o it_o be_v that_o in_o the_o most_o peaceable_a and_o tranquil_a time_n that_o ever_o the_o land_n see_v when_o king_n and_o people_n have_v a_o mutual_a confidence_n of_o each_o other_o we_o find_v thing_n do_v by_o the_o king_n that_o be_v more_o irregular_a in_o those_o time_n of_o agreement_n than_o be_v do_v in_o time_n of_o great_a confusion_n and_o the_o reason_n be_v because_o
man_n so_o it_o can_v be_v imagine_v that_o the_o law_n have_v leave_v man_n to_o so_o wild_a a_o justice_n as_o be_v guide_v by_o passion_n and_o affection_n for_o it_o have_v be_v so_o great_a a_o defect_n in_o the_o constitution_n of_o this_o government_n that_o long_o before_o this_o it_o will_v have_v be_v reform_v and_o as_o it_o be_v most_o clear_a that_o they_o be_v thus_o restrain_v so_o those_o bound_n and_o limit_n be_v no_o less_o know_v to_o they_o that_o be_v acquaint_v with_o the_o law_n there_o be_v two_o thing_n which_o have_v heretofore_o be_v look_v upon_o as_o very_o good_a guide_n one_a what_o have_v former_o be_v express_o do_v in_o the_o like_a case_n 2_o for_o want_v of_o such_o particular_a direction_n then_o to_o consider_v that_o which_o come_v the_o near_a to_o it_o and_o so_o proportionable_o to_o add_v or_o abate_v as_o the_o manner_n and_o circumstance_n of_o the_o case_n do_v require_v these_o be_v think_v very_o good_a and_o safe_a direction_n till_o it_o be_v declare_v and_o ever_o since_o have_v be_v practise_v in_o the_o king_n bench_n that_o they_o do_v not_o regard_v precedent_n but_o will_v make_v they_o and_o for_o aught_o that_o i_o can_v learn_v or_o find_v this_o of_o my_o lord_n devonshire_n be_v a_o original_a what_o obscurity_n soever_o may_v be_v pretend_v in_o other_o case_n yet_o in_o this_o the_o law_n have_v give_v so_o positive_a and_o plain_a a_o direction_n that_o it_o seem_v very_o strange_a how_o they_o come_v to_o lay_v a_o fine_a of_o 30000_o l._n upon_o my_o lord_n devonshire_n the_o court_n of_o starchamber_n be_v take_v away_o because_o of_o the_o unmeasurable_a fine_n which_o it_o impose_v which_o alone_o be_v a_o plain_a and_o direct_a prohibition_n for_o any_o other_o court_n to_o do_v the_o like_a for_o otherwise_o the_o mischief_n remain_v for_o what_o advantage_n be_v it_o to_o the_o nation_n if_o it_o have_v not_o be_v whole_o suppress_v the_o shift_n of_o hand_n give_v the_o people_n no_o ease_n in_o the_o burden_n that_o lie_v upon_o they_o it_o be_v all_o one_o whether_o the_o starchamber_n or_o king_n bench_n do_v crush_v they_o by_o immoderate_a fine_n but_o to_o put_v all_o out_o of_o dispute_n the_o statute_n 17_o car._n say_v express_o that_o from_o henceforth_o no_o court_n council_z or_o place_n of_o judicature_n shall_v be_v erect_v ordain_v constitute_v or_o appoint_v within_o this_o realm_n of_o england_n or_o dominion_n of_o wales_n which_o shall_v have_v use_v or_o exercise_v the_o same_o or_o the_o like_a jurisdiction_n as_o be_v or_o have_v be_v use_v practise_v or_o exercise_v in_o the_o say_a court_n of_o starchamber_n and_o this_o be_v upon_o very_o good_a reason_n because_o those_o great_a fine_n impose_v in_o that_o court_n be_v inconsistent_a with_o the_o law_n of_o england_n which_o be_v a_o law_n of_o mercy_n and_o conclude_v every_o fine_a which_o be_v leave_v at_o discretion_n with_o salvo_n contenimento_n if_o the_o fine_n impose_v in_o the_o starchamber_n be_v a_o intolerable_a burden_n to_o the_o subject_a and_o the_o mean_n to_o introduce_v a_o arbitrary_a power_n and_o government_n as_o that_o statute_n recite_v the_o like_a proceed_n in_o the_o king_n bench_n can_v be_v no_o less_o grievous_a and_o must_v produce_v the_o same_o evil._n law_n that_o be_v make_v upon_o new_a occasion_n or_o sudden_a immergency_n the_o reason_n upon_o which_o they_o be_v make_v may_v cease_v and_o consequent_o they_o do_v cease_v also_o but_o law_n that_o be_v ground_v upon_o the_o ancient_a principle_n of_o the_o government_n can_v cease_v because_o the_o reason_n of_o they_o will_v ever_o continue_v and_o this_o statute_n of_o 17_o car._n be_v such_o no_o doubt_n hold_v good_a and_o be_v now_o in_o as_o much_o force_n as_o the_o first_o moment_n in_o which_o it_o be_v make_v and_o therefore_o this_o fine_a impose_v on_o my_o lord_n devonshire_n be_v in_o open_a defiance_n of_o that_o statute_n i_o think_v no_o man_n can_v altogether_o excuse_v my_o lord_n devonshire_n for_o my_o part_n i_o do_v it_o but_o think_v it_o be_v a_o very_a inconsiderate_a rash_a act_n and_o i_o believe_v the_o indiscretion_n of_o it_o abstract_v from_o the_o fine_a be_v a_o very_a sensible_a trouble_n to_o he_o yet_o if_o those_o thing_n be_v want_v which_o may_v be_v urge_v in_o his_o excuse_n the_o offence_n and_o punishment_n do_v seem_v to_o bear_v proportion_n can_v not_o the_o merit_n of_o his_o father_n be_v lay_v in_o the_o balance_n nor_o the_o surprise_n of_o meeting_n coll._n culpepper_n for_o my_o lord_n have_v be_v abuse_v by_o he_o a_o man_n of_o so_o great_a courage_n and_o honour_n as_o my_o lord_n devonshire_n must_v needs_o feel_v and_o remember_v it_o a_o long_a time_n have_v receive_v no_o satisfaction_n or_o reparation_n make_v he_o for_o it_o but_o if_o there_o be_v nothing_o of_o this_o in_o the_o case_n can_v all_o that_o may_v be_v say_v to_o alleviate_v his_o offence_n be_v urge_v against_o he_o with_o a_o double_a weight_n be_v the_o circumstance_n of_o the_o fact_n as_o foul_a and_o aggravate_v as_o the_o malice_n of_o his_o enemy_n can_v wish_v yet_o sure_o a_o less_o fine_a may_v have_v serve_v for_o the_o law_n cast_v in_o a_o great_a many_o grain_n of_o mercy_n into_o every_o judgement_n and_o have_v ever_o look_v upon_o a_o to_o be_v summa_fw-la injuria_fw-la but_o beside_o all_o this_o i_o do_v conceive_v with_o submission_n that_o where_o the_o law_n have_v entrust_v the_o judge_n with_o a_o power_n to_o fine_a it_o be_v in_o a_o much_o less_o degree_n than_o they_o have_v do_v in_o this_o case_n first_o because_o the_o law_n be_v very_o cautious_a who_o and_z with_o what_o it_o do_v intrust_v it_o repose_v a_o great_a confidence_n in_o the_o king_n yet_o in_o some_o case_n his_o act_n be_v not_o regard_v by_o it_o as_o the_o king_n can_v do_v no_o ministerial_a act_n a_o commitment_n per_fw-la speciale_a
