bring_v to_o the_o bar_n and_o the_o ld._n high_a steward_n inform_v he_o the_o lord_n have_v find_v he_o guilty_a he_o say_v god_n holy_a name_n be_v praise_v for_o it_o confess_v it_o surprise_v he_o for_o he_o do_v not_o expect_v it_o and_o that_o he_o have_v only_o this_o to_o say_v for_o suspend_v of_o judgement_n that_o he_o do_v not_o hold_v up_o his_o hand_n at_o the_o bar_n which_o include_v in_o the_o act_n of_o the_o 13_o of_o this_o king_n he_o ought_v only_o to_o lose_v his_o seat_n in_o parliament_n which_o be_v the_o punishment_n there_o put_v down_o for_o a_o peer_n submit_v to_o their_o lordship_n and_o desire_v their_o judgement_n in_o these_o point_n then_o the_o lord_n adjourn_v into_o the_o parliament-chamber_n and_o the_o committee_n of_o commons_o return_v to_o their_o own_o house_n and_o the_o speaker_n have_v re-assumed_n the_o chair_n the_o whole_a body_n of_o the_o house_n go_v with_o their_o speaker_n to_o the_o bar_n of_o the_o house_n of_o lord_n to_o demand_v judgement_n of_o high-treason_n against_o william_n viscount_n stafford_n upon_o the_o impeachment_n of_o the_o commons_o of_o england_n in_o parliament_n in_o the_o name_n of_o the_o commons_o in_o parliament_n and_o of_o all_o the_o commons_o of_o england_n then_o the_o commons_o with_o their_o speaker_n go_v back_o to_o their_o house_n then_o the_o lord_n take_v into_o consideration_n what_o judgement_n be_v to_o be_v give_v and_o it_o be_v move_v that_o he_o may_v be_v behead_v after_o some_o debate_v the_o judge_n be_v ask_v whether_o if_o any_o other_o judgement_n than_o the_o usual_a judgement_n for_o high-treason_n be_v give_v upon_o he_o it_o will_v attaint_v his_o blood_n the_o judge_n be_v of_o opinion_n that_o the_o judgement_n for_o high-treason_n appoint_v by_o law_n be_v to_o
where_o the_o case_n be_v evident_a but_o this_o court_n he_o take_v to_o be_v of_o the_o same_o nature_n though_o of_o a_o degree_n high_o with_o the_o other_o ordinary_a court_n of_o judicature_n where_o there_o can_v be_v no_o adjournment_n after_o evidence_n give_v but_o for_o satisfaction_n the_o judge_n be_v order_v to_o withdraw_v to_o consult_v which_o they_o do_v and_o then_o the_o lord_n nottingham_n and_o falconbridge_n move_v that_o the_o peer_n ought_v to_o be_v the_o judge_n hereof_o because_o it_o concern_v their_o privilege_n and_o so_o it_o be_v also_o permit_v for_o they_o to_o withdraw_v and_o after_o about_o half_a a_o hour_n the_o judge_n return_v and_o after_o a_o hour_n the_o peer_n and_o then_o the_o ld._n ch._n justice_n herbert_n deliver_v the_o opinion_n of_o the_o judge_n that_o this_o matter_n be_v whole_o new_a to_o they_o they_o can_v not_o determine_v but_o only_o tell_v what_o the_o law_n be_v in_o inferior_a court_n in_o case_n of_o the_o like_a nature_n and_o the_o reason_n of_o the_o law_n in_o those_o point_n and_o then_o leave_v the_o jurisdiction_n of_o this_o court_n to_o its_o proper_a judge_n after_o which_o the_o ld._n h._n steward_n tell_v they_o he_o be_v the_o only_a judge_n of_o that_o court_n and_o therefore_o he_o be_v to_o determine_v it_o show_v of_o what_o ill_a consequence_n the_o adjournment_n of_o the_o court_n may_v prove_v if_o it_o shall_v happen_v to_o be_v illegal_a and_o therefore_o he_o order_v the_o prisoner_n to_o proceed_v the_o lord_n delamere_n therefore_o do_v begin_v his_o defence_n in_o protest_v his_o innocency_n and_o reflect_v on_o the_o loyalty_n of_o his_o family_n particular_o his_o father_n who_o have_v be_v so_o signal_o instrumental_a in_o the_o restoration_n of_o the_o royal_a family_n that_o the_o late_a king_n cause_v it_o to_o be_v insert_v in_o the_o patent_n which_o create_v his_o father_n a_o peer_n which_o clause_n he_o read_v out_o of_o the_o patent_n to_o the_o court._n and_o as_o to_o the_o evidence_n against_o he_o he_o observe_v that_o it_o be_v all_o but_o circumstantial_a and_o by_o hear-say_n only_o except_o that_o of_o saxon_n and_o therefore_o he_o apply_v himself_o particular_o against_o that_o and_o call_v his_o witness_n mr._n richard_n hall_n testify_v how_o in_o 1683_o saxon_n counterfeit_v a_o letter_n in_o the_o name_n of_o one_o he_o ever_o write_v for_o it_o mr._n francis_n ling_n declare_v how_o this_o saxon_a receive_v 25_o s._n at_o this_o same_o hildage_n at_o newcastle_n for_o mrs._n wibbram_n without_o her_o order_n nor_o do_v she_o ever_o receive_v any_o of_o it_o richard_n shaw_n declare_v how_o he_o also_o forge_v a_o letter_n in_o william_n paugston_n a_o bailiff_n name_n and_o send_v it_o to_o he_o because_o he_o owe_v he_o a_o little_a mony_n peter_n hough_n declare_v how_o saxon_n cheat_v he_o in_o make_v he_o of_o a_o bond_n for_o 20_o s._n less_o than_o be_v due_a from_o saxon_a to_o he_o read_v it_o false_a to_o he_o at_o the_o seal_n edward_n wilkinson_n declare_v that_o saxon_n hire_v his_o horse_n june_n 23d_o last_o for_o only_o three_o day_n at_o 12_o penny_n a_o day_n but_o he_o never_o come_v again_o nor_o have_v he_o have_v any_o satisfaction_n for_o his_o horse_n it_o be_v suppose_v this_o be_v the_o horse_n he_o rid_v into_o the_o rebellion_n with_o william_n wright_n say_v he_o have_v deal_n with_o saxon_n but_o never_o find_v he_o so_o good_a as_o his_o word_n then_o the_o prisoner_n go_v off_o from_o this_o part_n of_o the_o evidence_n to_o prove_v that_o neither_o sir_n robert_n cotton_n nor_o mr._n offley_n crew_n nor_o himself_o be_v in_o cheshire_n at_o that_o time_n saxon_n have_v swear_v he_o see_v they_o at_o mere_a together_o and_o to_o this_o end_n one_o which_o day_n he_o go_v from_o sir_n willoughby_n house_n homeward_o mr._n gregory_n and_o thomas_n kid_n his_o servant_n testify_v that_o he_o go_v direct_o home_o to_o crew-hall_n in_o cheshire_n that_o night_n and_o be_v not_o at_o mere_a it_o not_o be_v in_o his_o way_n at_o all_o as_o to_o the_o prisoner_n himself_o mr._n booth_n one_o of_o his_o brother_n declare_v that_o he_o see_v his_o he_o in_o town_n the_o four_o and_o the_o lord_n lovelace_n testify_v that_o he_o see_v he_o the_o 5_o of_o june_n in_o the_o house_n of_o lord_n at_o the_o lord_n macclesfield_n trial_n against_o mr._n fitton_n after_o it_o be_v thus_o clear_v that_o none_o of_o they_o 3_o be_v where_o saxon_n have_v swear_v they_o be_v at_o that_o time_n the_o prisoner_n show_v the_o incredibility_n of_o his_o evidence_n and_o proceed_v to_o give_v a_o account_n of_o his_o go_v down_o so_o often_o and_o so_o speedy_o that_o the_o first_o time_n he_o go_v which_o be_v betwixt_o the_o coronation_n and_o up_o his_o evidence_n and_o conclude_v very_o handsome_o and_o judicious_o his_o excellent_a defence_n then_o mr._n sol._n gen._n have_v sum_v up_o the_o evidence_n and_o the_o lord_n high_a steward_n speak_v a_o few_o word_n to_o this_o point_n of_o law_n which_o the_o prisoner_n in_o his_o defence_n seem_v to_o urge_v that_o there_o be_v a_o necessity_n of_o two_o positive_a witness_n to_o convict_v a_o man_n of_o treason_n and_o show_v his_o mistake_n about_o it_o the_o peer_n withdraw_v for_o about_o half_a a_o hour_n the_o prisoner_n be_v take_v into_o a_o little_a room_n appoint_v for_o he_o at_o the_o entrance_n into_o the_o court_n and_o then_o be_v return_v their_o appearance_n be_v take_v by_o a_o sergeant_n at_o arm_n and_o their_o verdict_n take_v by_o the_o lord_n h._n bishop_n answer_v that_o if_o he_o have_v do_v amiss_o it_o be_v not_o a_o wilful_a fault_n and_o that_o he_o have_v take_v the_o best_a advice_n he_o can_v get_v and_o be_v inform_v he_o can_v not_o be_v think_v enough_o and_o so_o they_o adjourn_v only_o until_o monday_n next_o aug._n 9_o 1686._o then_o and_o there_o the_o bishop_n come_v attend_v with_o his_o nephew_n the_o earl_n of_o chancellor_n tell_v he_o they_o be_v now_o ready_a to_o hear_v his_o reason_n but_o the_o bishop_n reply_v he_o be_v not_o so_o ready_a as_o he_o may_v have_v be_v because_o he_o can_v not_o light_v of_o the_o commission_n to_o see_v it_o until_o last_o night_n though_o he_o employ_v all_o his_o time_n to_o search_v for_o it_o and_o he_o have_v not_o have_v time_n since_o to_o take_v advice_n what_o to_o answer_v and_o that_o his_o counsel_n be_v out_o of_o town_n in_o who_o he_o think_v to_o confide_v then_o withdraw_v for_o a_o quarter_n of_o a_o hour_n the_o chancellor_n tell_v he_o they_o will_v not_o admit_v of_o any_o quarrel_v with_o their_o commission_n for_o that_o they_o be_v well_o assure_v of_o the_o legality_n of_o it_o but_o ask_v he_o what_o time_n he_o desire_v at_o his_o request_n they_o grant_v he_o a_o fortnight_n and_o adjourn_v it_o be_v observe_v that_o when_o the_o bishop_n speak_v concern_v the_o commission_n sir_n thomas_n clarges_n speak_v aloud_o say_v bishop_n of_o london_n be_v cause_n before_o the_o commissioner_n themselves_o tuesday_n aug._n 24._o 1686._o there_o be_v present_a in_o council_n the_o same_o as_o at_o first_o the_o lord_z bishop_n attending_z and_o be_v ask_v what_o he_o have_v to_o say_v after_o some_o apology_n for_o what_o he_o be_v about_o to_o say_v he_o say_v his_o counsel_n tell_v he_o that_o their_o proceed_n in_o this_o court_n be_v direct_o contrary_a to_o the_o statute-law_n and_o be_v there_o ready_a to_o plead_v it_o if_o their_o lordship_n will_v admit_v they_o but_o the_o chancellor_n tell_v he_o they_o will_v neither_o hear_v he_o nor_o his_o counsel_n in_o the_o matter_n they_o be_v satisfy_v of_o the_o legality_n of_o their_o commission_n then_o the_o bishop_n urge_v that_o their_o commission_n he_o conceive_v do_v not_o extend_v to_o the_o crime_n lay_v to_o his_o charge_n for_o they_o be_v to_o censure_v fault_n which_o be_v commit_v but_o this_o that_o he_o be_v accuse_v of_o be_v before_o the_o date_n of_o their_o commission_n the_o chancellor_n confess_v there_o be_v such_o a_o clause_n but_o that_o those_o be_v general_a clause_n that_o take_v in_o thing_n past_a as_o well_o as_o future_a then_o the_o bishop_n protest_v in_o his_o own_o right_n to_o the_o law_n of_o the_o realm_n as_o a_o subject_a and_o the_o right_n and_o privilege_n of_o lie_n church_n as_o a_o sunday_n june_n 20._o 1686._o to_o windsor_n and_o be_v not_o admit_v to_o be_v read_v which_o be_v as_o follow_v to_o the_o king_n be_v most_o excellent_a majesty_n the_o humble_a petition_n of_o john_n sharp_n clerk_n sheweth_z that_o nothing_o be_v so_o afflictive_a to_o your_o petitioner_n as_o his_o unhappiness_n to_o have_v incur_v your_o majesty_n displeasure_n which_o he_o be_v so_o sensible_a of_o that_o ever_o since_o your_o majesty_n be_v please_v to_o give_v notice_n of_o it_o he_o have_v forbear_v all_o public_a exercise_n of_o his_o function_n and_o still_o continue_v so_o to_o do_v your_o petitioner_n can_v with_o great_a sincerity_n affirm_v that_o ever_o since_o he_o have_v be_v a_o preacher_n he_o have_v faithful_o endeavour_v to_o do_v the_o best_a service_n he_o can_v in_o his_o place_n and_o station_n as_o well_o to_o the_o late_a king_n your_o royal_a brother_n as_o to_o your_o majesty_n both_o by_o preach_v and_o otherwise_o and_o so_o far_o he_o have_v always_o be_v from_o vent_v any_o thing_n in_o the_o pulpit_n tend_v to_o schism_n or_o faction_n or_o any_o way_n to_o the_o disturbance_n of_o your_o majesty_n government_n that_o he_o have_v upon_o so_o well_o assure_v of_o that_o he_o can_v but_o apprehend_v that_o his_o sermon_n have_v be_v very_o much_o misrepresent_v to_o your_o majesty_n but_o if_o in_o any_o sermon_n of_o he_o any_o word_n or_o expression_n have_v unwary_o slip_v from_o he_o that_o have_v be_v capable_a of_o such_o construction_n as_o to_o give_v your_o majesty_n cause_n of_o offence_n as_o he_o solemn_o profess_v he_o have_v no_o ill_a intention_n in_o those_o word_n or_o expression_n so_o he_o be_v very_o sorry_a for_o they_o and_o resolve_v for_o the_o future_a to_o be_v so_o careful_a in_o the_o discharge_n of_o his_o duty_n that_o your_o majesty_n shall_v have_v reason_n to_o believe_v he_o to_o be_v your_o most_o faithful_a subject_n and_o therefore_o he_o earnest_o pray_v that_o your_o majesty_n out_o of_o your_o royal_a grace_n and_o clemency_n will_v be_v please_v to_o lay_v aside_o the_o displeasure_n you_o have_v conceive_v against_o your_o humble_a petitioner_n and_o restore_v he_o to_o that_o favour_n which_o the_o rest_n of_o the_o clergy_n enjoy_v under_o your_o
