mean_a time_n 38._o provide_v always_o and_o it_o be_v further_o covenant_v dispose_v how_o he_o part_v of_o such_o as_o die_v during_o the_o four_o year_n shall_v be_v dispose_v grant_v conclude_v and_o agree_v by_o and_o between_o the_o say_a party_n to_o these_o present_n and_o each_o and_o every_o of_o they_o by_o and_o for_o himself_o his_o executor_n and_o administrator_n covenant_v and_o geant_v to_o and_o with_o each_o and_o every_o of_o the_o other_o of_o they_o his_o executor_n and_o administrator_n by_o these_o present_n severally_z and_o respective_o that_o in_o case_n any_o of_o the_o say_a copartner_n shall_v happen_v to_o decease_n before_o the_o expiration_n of_o the_o say_a term_n of_o four_o year_n and_o within_o three_o month_n next_o after_o the_o account_n shall_v be_v ageeed_o upon_o and_o balance_v between_o the_o say_a copartner_n or_o survivor_n of_o they_o that_o then_o the_o survivor_n or_o survivor_n of_o they_o the_o say_v party_n in_o full_a of_o the_o part_n and_o proportion_n of_o he_o or_o they_o so_o die_v in_o and_o to_o the_o say_a stock_n of_o twenty_o thousand_o pound_n and_o the_o gain_n benefit_n and_o increase_v thereby_o then_o get_v and_o arisen_a money_n lend_v to_o the_o joint_n account_v except_v shall_v and_o will_v only_o be_v liable_a to_o pay_v and_o shall_v and_o will_v pay_v unto_o the_o executor_n or_o administrator_n of_o the_o party_n so_o die_v within_o the_o say_a term_n of_o four_o year_n and_o within_o three_o month_n after_o balance_n of_o the_o say_a account_n the_o say_a executor_n or_o administrator_n first_o make_v good_a to_o the_o say_a joint_n account_v the_o charge_n of_o he_o so_o decease_v so_o much_o lawful_a money_n of_o england_n as_o by_o the_o last_o balance_n of_o account_n than_o before_o make_v up_o and_o agree_v upon_o between_o the_o say_a copartner_n shall_v be_v due_a and_o come_v to_o such_o of_o they_o the_o say_v copartner_n respective_o die_v as_o aforesaid_a within_o six_o month_n after_o such_o decease_n the_o say_a executor_n etc._n allowance_n for_o desperate_a debt_n etc._n etc._n or_o administrator_n respective_o there_o out_o allow_v and_o abate_v to_o the_o survive_a copartner_n for_o and_o towards_o the_o loss_n that_o may_v happen_v to_o the_o say_v survive_v copartner_n by_o desperate_a and_o bad_a debt_n due_a to_o the_o say_v joint_a account_n so_o many_o time_n fifty_o pound_n of_o lawful_a money_n of_o england_n as_o half_a year_n or_o six_o month_n of_o this_o copartner-ship_n shall_v remain_v then_o unexspire_v at_o the_o time_n of_o such_o decease_n and_o further_o that_o in_o case_n any_o of_o the_o say_a copartner_n shall_v decease_v before_o the_o end_n or_o expiration_n of_o the_o say_a term_n of_o four_o year_n and_o full_a three_o month_n after_o balance_n of_o account_n as_o aforesaid_a that_o then_o the_o part_n of_o he_o or_o they_o so_o die_v shall_v run_v on_o upon_o account_n and_o be_v employ_v by_o the_o survive_v copartner_n in_o the_o say_v joint_a trade_n until_o the_o next_o ensue_a time_n agree_v by_o these_o present_n for_o balance_v of_o the_o account_n and_o that_o the_o survive_v copartner_n in_o full_a of_o the_o portion_n part_n and_o share_n of_o he_o or_o they_o so_o die_v of_o in_o and_o to_o the_o say_a joint-stock_n of_o twenty_o thousand_o pound_n and_o the_o benefit_n and_o increase_v thereby_o then_o get_v and_o arisen_a money_n lend_v to_o the_o say_a joint_n account_v except_v shall_v and_o will_v only_o be_v liable_a to_o pay_v and_o
shall_v pay_v upon_o such_o decease_n within_o six_o month_n after_o the_o account_v balance_v and_o make_v up_o unto_o the_o executor_n or_o administrator_n of_o such_o of_o they_o the_o say_v to_o be_v make_v up_o by_o the_o survivor_n of_o they_o the_o say_v copartner_n shall_v just_o and_o true_o appear_v to_o be_v due_a and_o come_v to_o such_o of_o they_o the_o say_v copartner_n so_o decease_a as_o full_o as_o if_o the_o party_n be_v live_v the_o say_v executor_n or_o administrator_n respective_o thereout_o allow_v and_o defalk_v unto_o the_o say_v survive_v copartner_n for_o and_o towards_o the_o loss_n that_o may_v happen_v to_o the_o say_v survive_v copartner_n by_o and_o through_o desperate_a and_o bad_a debt_n due_a to_o the_o say_v joint_a account_n so_o many_o time_n fifty_o pound_n of_o lawful_a money_n of_o england_n as_o half_a year_n or_o six_o month_n of_o this_o copartnership_n shall_v remain_v then_o unexpired_a at_o the_o time_n of_o such_o decease_n 39_o and_o also_o that_o such_o of_o they_o the_o say_v die_v to_o save_v harmless_a executor_n of_o party_n die_v copartner_n survive_v shall_v and_o will_v save_v and_o keep_v harmless_a say_v joint_a account_n or_o by_o they_o the_o say_v party_n by_o reason_n thereof_o shall_v be_v due_o pay_v satisfy_v and_o discharge_v or_o otherwise_o equal_o secure_v by_o the_o bond_n of_o they_o the_o say_v copartner_n or_o survivor_n of_o they_o in_o case_n the_o say_a debt_n can_v in_o convenient_a time_n be_v pay_v as_o aforesaid_a 43._o and_o as_o for_o and_o concern_v the_o remainder_n money_n division_n of_o the_o debt_n and_o ready_a money_n of_o the_o say_a stock_n of_o twenty_o thousand_o pound_n and_o all_o gain_n profit_n and_o advantage_n by_o the_o stock_n accrue_v whether_o the_o sam_n shall_v consist_v in_o debt_n or_o ready_a money_n or_o both_o the_o money_n lend_v and_o add_v to_o the_o say_a stock_n by_o any_o of_o the_o say_a copartner_n with_o the_o interest_n thereof_o then_o due_a be_v first_o pay_v and_o satisfy_v the_o say_v remain_v money_n and_o debt_n be_v divide_v into_o equal_a part_n and_o proportion_n according_a to_o the_o number_n of_o the_o say_a copartner_n or_o such_o of_o they_o as_o then_o shall_v be_v live_v the_o same_o shall_v by_o lot_n cast_n or_o some_o other_o way_n as_o they_o shall_v think_v fit_a be_v distribute_v to_o the_o say_a copartner_n or_o such_o of_o they_o as_o shall_v be_v then_o live_v whereby_o each_o of_o they_o may_v have_v a_o ratable_a part_n and_o proportion_n of_o the_o say_a stock_n and_o of_o all_o clear_a gain_n and_o profit_n thereby_o arise_v 44._o and_o also_o that_o every_o of_o the_o say_a party_n debt_n power_n to_o recover_v debt_n his_o executor_n and_o shall_v happen_v any_o of_o the_o place_n no_o right_n of_o survivorship_n to_o take_v place_n say_a party_n to_o die_v or_o depart_v this_o life_n during_o the_o say_a copartnership_n that_o then_o in_o any_o such_o case_n no_o right_a of_o survivor_n or_o survivorship_n shall_v hold_v or_o take_v place_n or_o be_v bâ—_n they_o or_o any_o of_o they_o challenge_v claim_v or_o demand_v in_o any_o
