you_o will_v ask_v be_v not_o the_o title_n clear_a yes_o without_o doubt_n but_o the_o estate_n that_o be_v the_o parliament_n upon_o the_o great_a dislike_n of_o the_o present_a government_n their_o intend_v this_o to_o mere_a scholar_n and_o give_v they_o but_o their_o own_o language_n which_o i_o presume_v they_o can_v but_o apprehend_v these_o consideration_n make_v the_o parliament_n at_o westminster_n while_o yet_o unshatter_v otherwise_o then_o by_o defection_n base_a unworthy_a defection_n they_o shall_v as_o man_n have_v have_v resolution_n worthy_a their_o trust_n but_o their_o cause_n it_o seem_v give_v no_o courage_n at_o first_o to_o declare_v against_o these_o power_n of_o parishional_a presbytery_n to_o this_o effect_n that_o they_o do_v not_o intend_v to_o raise_v nine_o thousand_o odd_a hundred_o seat_n of_o judgement_n or_o judicatories_n that_o be_v so_o many_o as_o there_o be_v parish_n of_o england_n the_o least_o of_o which_o shall_v have_v more_o power_n than_o the_o parliament_n of_o england_n and_o i_o think_v few_o man_n know_v but_o will_v agree_v that_o the_o name_n only_o of_o bishop_n shall_v have_v be_v suspend_v or_o extinguish_v but_o the_o same_o power_n yea_o that_o so_o call_v by_o the_o presbyter_n unjust_a be_v exercise_v by_o the_o bishop_n the_o pre-eminence_n be_v now_o in_o the_o presbytery_n the_o same_o have_v be_v allow_v and_o indeed_o it_o please_v god_n so_o farto_fw-ge give_v way_n that_o these_o man_n be_v thorough_o try_v for_o the_o parliament_n do_v not_o see_v all_o at_o once_o constitute_v eldership_n to_o be_v choose_v and_o improve_v some_o man_n whether_o intentional_o as_o suppose_v that_o discipline_n best_o or_o so_o call_v politic_o to_o discover_v their_o temper_n i_o determine_v not_o but_o these_o man_n present_o fall_v hot_a upon_o the_o work_n and_o what_o have_v but_o just_a before_o ruin_v their_o predecessor_n the_o bishop_n and_o be_v their_o stumble_a stone_n namely_o the_o nonconformity_n of_o the_o now_o call_v presbyter_n become_v the_o presbyter_n rock_v of_o offence_n against_o the_o so_o now_o call_v independent_o and_o to_o assure_v this_o after_o the_o manner_n of_o the_o apostate_n church_n they_o call_v for_o the_o secular_a power_n or_o the_o power_n of_o the_o secular_a sword_n and_o a_o act_n be_v say_v to_o be_v prepare_v they_o talk_v much_o of_o it_o that_o nonconformist_n shall_v have_v a_o liberty_n to_o bear_v office_n either_o in_o church_n or_o commonwealth_n it_o be_v truth_n the_o rigidity_n of_o some_o its_o probable_a seek_v not_o only_o the_o supremacy_n of_o power_n but_o a_o addition_n of_o wealth_n for_o by_o they_o also_o be_v seek_v outward_a honour_n riches_n lay-power_n so_o call_v and_o what_o else_o be_v of_o the_o old_a babel_n trash_n to_o adorn_v the_o church_n and_o by_o they_o call_v the_o church_n right_n bound_v it_o to_o the_o so_o call_v priesthood_n be_v by_o these_o as_o much_o eye_a as_o by_o the_o very_a babylonian_a in_o the_o world_n and_o the_o commonwealth_n of_o england_n still_o make_v the_o stalking-horse_n to_o their_o lucre_n and_o the_o base_a man_n of_o a_o rout_n of_o people_n so_o call_v also_o cleri_fw-la or_o clergy_n man_n in_o who_o if_o st._n paul_n leave_v the_o qualification_n right_o set_v down_o be_v rather_o the_o priest_n of_o bacchanal_n if_o not_o of_o bacchus_n than_o pastor_n of_o right_o constitute_v congregation_n and_o these_o altogether_o take_v advantage_n of_o a_o ordinance_n make_v for_o tithe_n to_o give_v the_o deny_v treble_a damage_n they_o also_o upon_o the_o same_o ground_n get_v act_n order_n or_o ordinance_n for_o unite_n parish_n and_o can_v inform_v untruth_n for_o advantage_n which_o appear_v the_o union_n be_v for_o malice_n not_o conscience_n of_o the_o complainer_n dissolve_v for_o can_v the_o persecutor_n have_v have_v his_o tithe_n but_o for_o half_a value_n all_o have_v be_v whist_a but_o the_o priest_n see_v not_o where_o such_o agreement_n will_v rest_v he_o may_v undo_v the_o church_n that_o be_v his_o successor_n by_o that_o mean_n will_n probation_n fix_v as_o they_o be_v under_o a_o incertain_a irregular_a way_n and_o illegal_a till_o establish_v they_o continue_v the_o marriage_n of_o person_n as_o a_o sacrament_n to_o be_v the_o proper_a work_n of_o the_o priest_n baptise_v infant_n the_o eight_o day_n hold_v if_o not_o by_o the_o wise_a yet_o by_o the_o most_o of_o necessity_n to_o salvation_n yea_o some_o hold_v that_o the_o sacrament_n of_o the_o lord_n supper_n be_v a_o convert_v ordinance_n and_o so_o to_o be_v administer_v to_o all_o to_o who_o the_o gospel_n be_v to_o be_v preach_v namely_o the_o most_o profane_a of_o any_o this_o to_o many_o seem_v rather_o a_o allowance_n politic_a then_o religious_a to_o gain_v a_o party_n then_o to_o give_v forth_o a_o principle_n until_o some_o leader_n be_v find_v public_o to_o avow_v the_o tenent_n but_o this_o licentiousness_n lose_v they_o the_o best_a and_o most_o considerable_a party_n i_o shall_v not_o further_o wade_v in_o these_o controversy_n nor_o have_v i_o go_v thus_o far_o can_v i_o have_v otherways_o well_o clear_v what_o be_v to_o follow_v namely_o that_o the_o magistrate_n eye_v these_o tenet_n as_o sort_v with_o or_o against_o his_o interest_n and_o according_o seem_v to_o allow_v or_o disallow_v the_o presbyter_n strike_v so_o high_a at_o the_o root_n of_o magistracy_n make_v they_o their_o mere_a executioner_n and_o bring_v by_o text_n of_o old_a law_n what_o be_v give_v to_o the_o priest_n more_o imperious_o into_o the_o cleri_fw-la and_o on_o the_o other_o side_n the_o so_o call_v erastian_n give_v all_o to_o the_o magistrate_n not_o as_o of_o the_o church_n or_o in_o the_o church_n but_o mere_o from_o the_o civil_a jurisdiction_n and_o total_a subjection_n of_o the_o whole_a course_n of_o so_o call_v priest_n unto_o the_o mere_a will_n of_o the_o magistrate_n either_o by_o do_v or_o suffer_v not_o allow_v a_o
agreeable_a to_o the_o rule_n of_o proportion_n i_o may_v say_v that_o the_o law_n of_o england_n do_v own_o this_o as_o its_o necessary_a pattern_n it_o be_v seldom_o deny_v but_o if_o any_o do_v oppose_v or_o doubt_v let_v they_o first_o consider_v that_o no_o law_n in_o england_n be_v settle_v general_o at_o least_o until_o the_o pope_n have_v come_v to_o a_o oblige_a power_n and_o that_o agree_v sure_o as_o he_o ape_v the_o ceremonial_n he_o do_v engage_v a_o conformity_n in_o prince_n as_o far_o as_o may_v be_v to_o the_o judicial_n i_o shall_v now_o see_v the_o only_a or_o main_a objection_n against_o the_o judicial_n which_o may_v be_v reduce_v i_o take_v it_o to_z three_z chief_o first_o they_o be_v give_v to_o the_o jew_n second_o they_o be_v not_o or_o can_v all_o be_v perform_v by_o we_o for_o some_o be_v only_o proper_a to_o the_o jew_n some_o no_o way_n fit_v this_o nation_n for_o they_o be_v never_o receive_v and_o there_o be_v a_o necessity_n of_o alter_a law_n as_o vice_n increase_v and_o grow_v more_o obnoxious_a and_o also_o in_o regard_n the_o judicial_n themselves_z be_v not_o all_o so_o clear_a that_o it_o can_v be_v say_v which_o be_v all_o the_o judicial_n by_o reason_n of_o mixture_n of_o ceremonial_n with_o they_o three_o the_o law_n of_o christ_n be_v a_o law_n of_o love_n not_o revenge_n to_o pray_v for_o enemy_n do_v good_a to_o they_o that_o hate_v we_o turn_v the_o other_o cheek_n to_o he_o strike_v one_o and_o give_v the_o cloak_n to_o he_o take_v the_o coat_n and_o go_v two_o mile_n with_o he_o enforce_v thou_o to_o one_o god_n assist_v we_o will_v endeavour_v to_o clear_v these_o head_n and_o then_o in_o consideration_n of_o the_o particular_a law_n answer_v some_o particular_a objection_n if_o any_o be_v see_v needful_a now_o as_o to_o the_o first_o that_o these_o thing_n be_v immediate_o direct_v by_o the_o almighty_a wisdom_n to_o the_o jew_n it_o be_v agree_v but_o what_o do_v this_o hold_n forth_o sure_o only_o this_o that_o the_o jew_n be_v bind_v by_o they_o god_n have_v command_v they_o to_o that_o nation_n that_o god_n require_v not_o obedience_n from_o the_o other_o nation_n to_o who_o he_o have_v give_v no_o command_n but_o that_o any_o other_o nation_n may_v not_o use_v they_o it_o prove_v not_o but_o rather_o that_o those_o law_n as_o far_o as_o hold_v forth_o a_o rule_n of_o justice_n to_o they_o which_o have_v no_o rule_n or_o a_o better_a where_o defective_a ought_v by_o these_o nation_n to_o who_o they_o be_v know_v to_o be_v establish_v be_v sure_o out_o of_o controversy_n while_o legislator_n have_v just_a and_o good_a for_o their_o rule_n to_o the_o second_o that_o they_o can_v be_v all_o perform_v by_o we_o let_v we_o see_v the_o hindrance_n first_o some_o be_v suppose_v only_o proper_a to_o the_o jew_n if_o we_o come_v to_o search_v what_o those_o be_v which_o we_o can_v perform_v there_o appear_v here_o visible_o but_o the_o law_n concern_v the_o trial_n of_o adultery_n and_o virginity_n we_o allow_v these_o aught_o to_o be_v inquire_v into_o and_o satisfaction_n give_v to_o the_o jealous_a spirit_n but_o we_o presume_v the_o special_a law_n bind_v not_o that_o in_o case_n of_o virginity_n be_v though_o natural_a yet_o as_o it_o be_v only_o proper_a to_o that_o nation_n and_o that_o by_o some_o extraordinary_a power_n of_o divinity_n giving_z forth_o testimony_n to_o his_o own_o law_n the_o other_o simple_o extraordinary_a in_o regard_n the_o same_o water_n wrought_v so_o contrary_a effect_n so_o that_o the_o virtue_n be_v evident_o not_o in_o the_o water_n and_o if_o we_o shall_v search_v the_o depth_n the_o seed_n though_o conceive_v by_o of_o the_o adulterer_n can_v work_v no_o more_o than_o of_o a_o husband_n in_o the_o ordinary_a course_n of_o nature_n there_o be_v also_o some_o particular_a law_n of_o two_o wife_n humble_v of_o handmaid_n with_o some_o other_o the_o next_o sort_n of_o law_n be_v such_o as_o be_v say_v hold_v no_o proportion_n with_o the_o natural_a condition_n of_o the_o people_n of_o this_o or_o other_o christian_a nation_n and_o therefore_o the_o nation_n settle_v other_o and_o never_o receive_v they_o to_o this_o part_n i_o answer_v that_o if_o it_o never_o receive_v they_o there_o be_v no_o trial_n whether_o agreeable_a to_o the_o nation_n or_o not_o next_o if_o try_v how_o do_v this_o indisposition_n in_o nation_n general_o to_o the_o receipt_n of_o particular_a law_n appear_v sure_o it_o be_v not_o by_o way_n of_o antipathy_n so_o that_o the_o nation_n fail_v die_v or_o be_v remove_v upon_o receive_v of_o they_o truth_n be_v we_o all_o agree_v nation_n may_v be_v alter_v by_o law_n as_o the_o roman_n bring_v from_o natural_a savageness_n to_o a_o more_o moderate_a temper_n by_o numa_n law_n and_o the_o lacedaemonian_n by_o those_o of_o lycurgus_n and_o they_o may_v be_v heighten_v and_o debase_v in_o spirit_n as_o well_o as_o moderate_v but_o all_o this_o rest_v not_o in_o the_o law_n but_o the_o executive_a part_n or_o power_n of_o it_o now_o that_o force_n will_v naturalize_v law_n it_o be_v plain_a why_o then_o not_o reason_n it_o be_v evident_a law_n be_v the_o reins_o of_o reason_n over_o the_o beastial_a part_n of_o man_n therefore_o now_o to_o the_o reasonable_a man_n any_o just_a law_n be_v approvable_a as_o to_o his_o obedience_n he_o be_v a_o law_n to_o himself_o and_o happy_o give_v far_o less_o liberty_n to_o his_o particular_a beast_n his_o appetite_n be_v it_o to_o or_o in_o what_o it_o will_v than_o it_o be_v fit_a the_o general_a law_n shall_v hold_v forth_o and_o this_o have_v just_a wisdom_n in_o it_o hereby_o be_v the_o good_a and_o wise_a distinguish_v from_o the_o vain_a and_o idle_a even_o by_o the_o subjection_n of_o natural_a appetite_n from_o whence_o it_o be_v hereby_o clear_a that_o to_o govern_v a_o fierce_a nation_n the_o same_o law_n will_v not_o serve_v as_o to_o govern_v a_o quiet_a peaceable_a one_o but_o now_o our_o quaere_fw-la must_v be_v whether_o there_o be_v not_o be_v a_o just_a law_n in_o the_o generality_n agreeable_a to_o the_o light_n of_o nature_n set_v down_o in_o the_o judicial_a head_n of_o law_n which_o will_v agree_v to_o govern_v all_o nation_n by_o take_v two_o law_n for_o example_n murder_n and_o theft_n the_o first_o be_v the_o head-law_n of_o mankind_n towards_o his_o like_a the_o prime_a end_n of_o magistracy_n be_v to_o preserve_v life_n the_o next_o be_v good_n now_o in_o this_o i_o find_v no_o loose_a to_o the_o magistrate_n but_o life_n must_v be_v for_o life_n if_o murder_n that_o be_v lie_v in_o wait_n or_o as_o with_o we_o malice_n before_o hand_n in_o this_o the_o magistrate_n have_v no_o liberty_n to_o ingratiate_v in_o refine_a reason_n it_o lie_v upon_o the_o land_n if_o not_o expiate_v with_o the_o blood_n of_o the_o offender_n and_o so_o upon_o the_o city_n and_o so_o upon_o the_o army_n but_o the_o chief_a guilt_n sure_o lie_v upon_o the_o chief_a magistrate_n who_o be_v the_o prime_n in_o trust_n executive_a as_o to_o the_o fact_n this_o sure_a be_v and_o aught_o to_o be_v death_n in_o all_o nation_n the_o like_a head-rule_n of_o common_a justice_n be_v in_o the_o law_n of_o the_o manslayer_n at_o unaware_o and_o sure_o of_o this_o sort_n there_o will_v be_v no_o doubt_n nor_o of_o the_o expiation_n of_o incertain_a murder_n which_o ought_v to_o be_v settle_v right_o by_o a_o oath_n of_o inquisition_n etc._n etc._n but_o the_o great_a quaere_fw-la will_n be_v concern_v theft_n which_o be_v the_o matter_n most_o or_o with_o the_o most_o to_o be_v consider_v as_o a_o grould_a of_o controversy_n for_o the_o most_o of_o christian_a nation_n have_v make_v it_o death_n yet_o the_o judicial_a make_v it_o death_n in_o no_o kind_n that_o punish_v life_n with_o life_n and_o good_n with_o good_n etc._n etc._n in_o the_o rule_n of_o proportionate_a justice_n now_o this_o alteration_n be_v not_o without_o reason_n as_o thing_n stand_v that_o be_v upon_o the_o receive_a principle_n foremention_v out_o of_o the_o seem_a contrariety_n which_o christian_n have_v gather_v out_o of_o the_o law_n judicial_a and_o apostolical_a for_o they_o have_v gather_v that_o christ_n kingdom_n be_v of_o brother_n there_o shall_v be_v no_o servant_n that_o be_v no_o slavish_a servitude_n or_o bondman_n which_o be_v the_o issue_n of_o not_o satisfy_v what_o be_v steal_v with_o the_o jew_n and_o upon_o this_o presumption_n they_o at_o last_o whole_o abrogate_a as_o to_o theft_n the_o mulct_n of_o two_o three_o four_o or_o sevenfold_a restore_v for_o his_o life_n and_o take_v away_o his_o life_n now_o this_o be_v only_a practice_n can_v determine_v the_o controversy_n let_v we_o then_o see_v the_o reason_n if_o any_o be_v whereof_o the_o most_o eminent_a
