be_v if_o the_o treason_n have_v be_v commit_v in_o another_o county_n and_o that_o therefore_o his_o majesty_n have_v give_v order_n for_o a_o commission_n of_o oyer_n and_o terminer_n into_o cheshire_n in_o order_n to_o the_o find_n of_o a_o indictment_n against_o he_o for_o the_o say_a treason_n and_o that_o according_o a_o commission_n of_o oyer_n and_o terminer_n be_v already_o seal_v do_v also_o appear_v upon_o all_o which_o matter_n the_o say_a henry_n lord_n delamere_n do_v humble_o tender_v this_o his_o plea_n to_o the_o jurisdiction_n of_o your_o lordship_n in_o this_o cause_n he_o humble_o conceive_v by_o the_o law_n and_o custom_n of_o parliament_n which_o be_v part_n of_o the_o law_n and_o custom_n of_o the_o land_n ought_v not_o to_o proceed_v against_o he_o upon_o the_o say_a indictment_n but_o his_o say_a cause_n ought_v whole_o to_o be_v determine_v and_o adjudge_v in_o the_o say_a house_n of_o peer_n and_o not_o elsewhere_o as_o in_o like_a case_n have_v the_o peer_n every_o one_o of_o they_o be_v equal_o interest_v this_o my_o lord_n i_o humble_o demand_v as_o my_o right_n and_o privilege_n as_o a_o peer_n of_o england_n and_o submit_v to_o the_o direction_n of_o your_o grace_n and_o my_o noble_a lord_n l._n h._n steward_n what_o say_v you_o to_o it_o mr._n attorney_n mr._n attor_n general_n may_v it_o please_v your_o grace_n this_o plea_n house_n of_o lord_n and_o therefore_o it_o conclude_v that_o he_o ought_v not_o to_o be_v try_v by_o your_o grace_n and_o these_o noble_a lord_n upon_o this_o commission_n but_o by_o all_o the_o lord_n in_o parliament_n with_o submission_n my_o lord_n this_o be_v contrary_a to_o all_o the_o ancient_a precedent_n and_o against_o the_o know_a rule_n of_o law_n for_o the_o law_n be_v if_o the_o king_n please_v to_o try_v a_o peer_n in_o parliament_n than_o the_o record_n may_v be_v bring_v into_o the_o house_n and_o there_o they_o proceed_v as_o in_o other_o case_n and_o all_o the_o peer_n be_v judge_n thus_o it_o be_v in_o the_o time_n of_o a_o session_n of_o parliament_n but_o if_o the_o parliament_n be_v prorogue_v there_o be_v many_o instance_n and_o indeed_o none_o to_o the_o contrary_a that_o after_o a_o prorogation_n the_o proceed_n be_v before_o the_o high_a steward_n by_o commission_n and_o as_o to_o the_o other_o part_n of_o the_o case_n i_o have_v this_o to_o say_v to_o it_o that_o there_o be_v nothing_o at_o all_o depend_v in_o the_o house_n of_o lord_n that_o can_v oust_v this_o court_n of_o the_o jurisdiction_n for_o there_o be_v not_o so_o much_o as_o any_o indictment_n return_v there_o no_o nor_o so_o much_o as_o find_v during_o the_o session_n of_o parliament_n all_o the_o agitation_n be_v only_o upon_o my_o lord_n petition_v and_o the_o king_n answer_n that_o he_o intend_v as_o speedy_a a_o prosecution_n as_o can_v be_v beside_o my_o lord_n your_o grace_n see_v it_o be_v a_o plea_n in_o paper_n and_o in_o english_a without_o any_o counsel_n house_n of_o peer_n be_v possess_v of_o the_o cause_n which_o can_v not_o be_v and_o i_o will_v tell_v you_o why_o because_o there_o be_v no_o indictment_n ever_o remove_v thither_o or_o lodge_v there_o which_o plain_o prove_v that_o the_o lord_n be_v never_o possess_v of_o the_o cause_n nor_o indeed_o be_v the_o bill_n find_v upon_o which_o you_o be_v now_o arraign_v till_o after_o the_o prorogation_n of_o the_o parliament_n so_o that_o they_o can_v never_o come_v to_o be_v possess_v of_o this_o matter_n these_o be_v mistake_n in_o point_n of_o fact_n and_o your_o lordship_n can_v but_o well_o know_v they_o to_o be_v so_o and_o there_o be_v as_o great_a a_o mistake_n in_o the_o law_n that_o during_o the_o continuance_n of_o a_o parliament_n though_o it_o be_v prorogue_v yet_o if_o not_o dissolve_v a_o peer_n can_v be_v try_v but_o by_o the_o house_n of_o lord_n this_o certain_o be_v a_o very_a strange_a doctrine_n and_o be_v not_o only_o against_o the_o reason_n and_o method_n of_o law_n but_o contrary_a even_o to_o your_o lordship_n own_o experience_n for_o your_o lordship_n can_v but_o very_o well_o remember_v that_o during_o the_o continuance_n of_o the_o parliament_n after_o a_o prorogation_n the_o lord_n cornwallis_n be_v try_v before_o the_o high_a steward_n and_o such_o a_o number_n of_o peer_n as_o be_v then_o summon_v upon_o such_o a_o commission_n as_o i_o now_o sit_v here_o by_o but_o indeed_o during_o the_o sit_v of_o the_o parliament_n than_o all_o the_o peer_n be_v both_o tryer_n and_o judge_n as_o be_v in_o the_o case_n of_o my_o lord_n stafford_n and_o my_o lord_n of_o pembroke_n they_o be_v a_o court_n of_o judicature_n then_o actual_o sit_v and_o therefore_o this_o plea_n be_v ground_v as_o upon_o mistake_n in_o fact_n so_o upon_o a_o mistake_n in_o point_n of_o law_n so_o that_o though_o as_o i_o say_v at_o first_o it_o be_v both_o my_o duty_n and_o interest_n to_o preserve_v the_o privilege_n of_o the_o peer_n yet_o i_o must_v take_v
