entitle_v to_o be_v tenant_n by_o the_o courtesy_n a_o popish_a recusant_n convict_v marry_v a_o inheritrix_n in_o other_o form_n than_o be_v appoint_v by_o this_o act_n the_o wife_n die_v without_o issue_n bear_v alive_a of_o the_o marriage_n in_o this_o case_n although_o the_o husband_n be_v not_o entitle_v to_o be_v tenant_n by_o the_o courtesy_n yet_o the_o possibility_n which_o he_o once_o have_v to_o be_v so_o entitle_v seem_v to_o satisfy_v the_o intent_n of_o the_o act_n and_o he_o shall_v not_o forfeit_v the_o hundred_o pound_n so_o that_o here_o be_v another_o casus_fw-la omissus_fw-la for_o it_o may_v so_o happen_v that_o a_o popish_a recusant_n convict_v may_v have_v a_o great_a portion_n in_o money_n with_o his_o wife_n and_o but_o a_o small_a estate_n in_o land_n with_o she_o perchance_o but_o a_o few_o acre_n yet_o if_o he_o be_v a_o offender_n within_o this_o branch_n the_o land_n for_o that_o he_o may_v be_v entitle_v to_o be_v tenant_n of_o they_o by_o the_o courtesy_n shall_v save_v his_o hundred_o pound_n and_o if_o his_o wife_n die_v have_v have_v no_o issue_n bear_v alive_a he_o be_v whole_o exempt_v out_o of_o the_o act_n and_o can_v be_v punish_v either_o way_n child_n stat._n sect._n 16._o baptism_n of_o popish_a recusant_n child_n and_o that_o every_o popish_a recusant_n which_o shall_v hereafter_o have_v any_o child_n bear_v shall_v within_o one_o month_n next_o after_o the_o birth_n thereof_o cause_v the_o same_o child_n to_o be_v baptize_v by_o a_o lawful_a minister_n according_a to_o the_o law_n of_o this_o realm_n in_o the_o open_a church_n of_o the_o same_o parish_n where_o the_o child_n shall_v be_v bear_v or_o in_o some_o other_o church_n near_o adjoin_v or_o chapel_n where_o baptism_n be_v usual_o administer_v or_o if_o by_o infirmity_n of_o the_o child_n it_o can_v be_v bring_v co_fw-la such_o place_n than_o the_o same_o shall_v within_o the_o time_n aforesaid_a be_v baptize_v by_o the_o lawful_a minister_n of_o any_o of_o the_o say_a parish_n or_o place_n aforesaid_a upon_o pain_n that_o the_o father_n of_o such_o child_n if_o he_o be_v live_v by_o the_o space_n of_o one_o month_n next_o after_o the_o birth_n of_o such_o child_n or_o if_o he_o be_v dead_a within_o the_o say_a month_n than_o the_o mother_n of_o such_o child_n shall_v for_o every_o such_o offence_n forfeit_v one_o hundred_o pound_n of_o lawful_a money_n of_o england_n one_o three_o part_n whereof_o to_o be_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n one_o other_o three_o part_n to_o the_o informer_n or_o he_o that_o will_v sue_v for_o the_o same_o and_o the_o other_o three_o part_n to_o the_o poor_a of_o the_o say_a parish_n to_o be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o of_o the_o king_n majesty_n court_n of_o record_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v be_v admit_v or_o allow_v and_o if_o any_o popish_a recusant_n man_n or_o woman_n excommunicate_a stat._n sect._n 17._o burial_n of_o popish_a recusant_n not_o excommunicate_a not_o be_v excommunicate_a shall_v be_v bury_v in_o any_o place_n other_o than_o in_o the_o church_n or_o churchyard_n or_o not_o according_a to_o the_o ecclesiastical_a law_n of_o this_o realm_n that_o the_o executor_n or_o administrator_n of_o every_o such_o person_n so_o bury_v know_v the_o same_o or_o the_o party_n that_o cause_v he_o to_o be_v so_o bury_v shall_v forfeit_v the_o sum_n of_o twenty_o pound_n the_o one_o three_o part_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n the_o other_o three_o part_n to_o the_o informer_n or_o he_o or_o they_o that_o will_v sue_v for_o the_o same_o and_o the_o other_o three_o part_n to_o the_o poor_a of_o the_o parish_n where_o such_o person_n die_v to_o be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o of_o the_o king_n majesty_n court_n of_o record_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v be_v admit_v or_o allow_v the_o exception_n here_o of_o a_o popish_a recusant_n excommunicate_v excommunicate_v that_o be_v not_o actual_o excommunicate_v be_v intend_v only_o of_o one_o actual_o excommunicate_v and_o not_o of_o he_o who_o be_v a_o popish_a recusant_n convict_v who_o shall_v not_o be_v repute_v as_o a_o person_n excommunicate_a to_o this_o intent_n but_o only_o as_o to_o the_o point_n of_o a_o disability_n as_o have_v be_v say_v sect._n 12._o so_o that_o if_o any_o popish_a recusant_n not_o actual_o excommunicate_v be_v bury_v elsewhere_o or_o otherwise_o then_o be_v here_o mention_v although_o he_o be_v convict_v yet_o it_o be_v a_o offence_n punishable_a by_o this_o law_n and_o be_v it_o further_o enact_v by_o this_o present_a parliament_n realm_n stat._n sect._n 18._o child_n depart_v the_o realm_n that_o if_o the_o child_n of_o any_o subject_a within_o this_o realm_n the_o say_a child_n not_o be_v soldier_n mariners_z merchant_n or_o their_o apprentice_n or_o factor_n to_o prevent_v their_o good_a education_n in_o england_n or_o for_o any_o other_o cause_n shall_v hereafter_o be_v send_v or_o go_v beyond_o sea_n without_o licence_n of_o the_o king_n majesty_n or_o six_o of_o his_o honourable_a privy_a council_n whereof_o the_o principal_a secretary_n to_o be_v one_o under_o their_o hand_n and_o seal_n depart_v the_o forfeiture_n of_o such_o as_o depart_v that_o then_o all_o and_o every_o such_o child_n and_o child_n so_o send_v or_o which_o shall_v so_o child_n as_o shall_v be_v so_o send_v do_v or_o shall_v inherit_v and_o dwell_v and_o that_o in_o the_o mean_a time_n the_o next_o of_o he_o or_o her_o kin_n which_o shall_v be_v no_o popish_a recusant_n shall_v have_v and_o enjoy_v the_o say_v land_n tenement_n hereditament_n lease_n good_n and_o chattel_n so_o give_v convey_v descend_v or_o devise_v until_o such_o time_n
