will_v make_v their_o liberty_n to_o be_v very_o precarious_a he_o proceed_v to_o say_v that_o the_o earl_n of_o shaftsbury_n be_v allow_v to_o be_v a_o know_a man_n both_o in_o the_o law_n order_n and_o constitution_n of_o parliament_n he_o will_v beg_v leave_n to_o quote_v another_o part_n of_o the_o same_o speech_n viz._n that_o mr._n attorney_n which_o be_v then_o sir_n william_n jones_n be_v please_v to_o answer_v the_o instance_n of_o one_o of_o his_o lordship_n council_n that_o if_o a_o great_a minister_n shall_v be_v commit_v he_o have_v the_o cure_n of_o a_o pardon_n a_o prorogation_n or_o a_o dissolution_n but_o say_v the_o earl_n if_o the_o case_n shall_v be_v put_v why_o forty_o member_n or_o a_o great_a number_n may_v not_o as_o well_o be_v take_v without_o any_o remedy_n of_o any_o of_o the_o king_n court_n his_o lordship_n say_v that_o mr._n attorney-could_a not_o very_o easy_o answer_v and_o if_o in_o this_o case_n say_v he_o there_o can_v be_v no_o relief_n no_o man_n can_v foresee_v what_o may_v be_v hereafter_o and_o in_o another_o place_n of_o the_o same_o speech_n he_o say_v he_o do_v not_o think_v it_o a_o kindness_n to_o the_o lord_n to_o make_v they_o absolute_a and_o above_o the_o law_n for_o so_o it_o must_v be_v if_o it_o be_v adjudge_v that_o they_o may_v commit_v a_o man_n to_o a_o indefinite_a imprisonment_n he_o say_v he_o take_v these_o man_n who_o he_o have_v name_v for_o no_o small_a authority_n in_o this_o age_n and_o the_o earl_n of_o shaftsbury_n he_o say_v be_v a_o man_n still_o as_o much_o for_o the_o maintain_n of_o this_o order_n as_o ever_o but_o that_o his_o lordship_n do_v show_v himself_o at_o the_o same_o time_n to_o be_v for_o english_a liberty_n and_o he_o plain_o show_v his_o own_o sense_n both_o of_o this_o and_o of_o all_o order_n whatever_o which_o concern_v the_o liberty_n of_o the_o subject_a and_o declare_v that_o he_o take_v that_o court_n to_o be_v the_o proper_a judge_n of_o all_o such_o order_n he_o say_v it_o thereby_o appear_v how_o sensible_a that_o lord_n be_v that_o such_o case_n may_v concern_v forty_o as_o well_o as_o one_o and_o member_n of_o either_o house_n as_o well_o as_o other_o man_n and_o without_o relief_n if_o it_o shall_v be_v admit_v that_o ordinart_n court_n can_v not_o relieve_v and_o the_o earl_n of_o danby_n say_v that_o there_o be_v no_o answer_v of_o these_o argument_n of_o the_o earl_n of_o shaftsbury_n unless_o it_o can_v be_v deny_v that_o the_o king_n can_v impeach_v as_o well_o as_o the_o commons_o or_o that_o the_o king_n can_v call_v and_o dissolve_v parliament_n at_o his_o own_o will_n and_o pleasure_n for_o if_o he_o may_v as_o be_v not_o to_o be_v doubt_v he_o say_v he_o be_v sure_o every_o man_n in_o england_n be_v in_o the_o same_o danger_n when_o the_o king_n please_v and_o then_o he_o see_v nothing_o whereby_o we_o have_v any_o security_n but_o that_o we_o live_v under_o a_o king_n who_o will_v not_o exercise_v this_o power_n over_o we_o which_o we_o will_v needs_o put_v into_o his_o hand_n although_o he_o do_v not_o desire_v it_o himself_o as_o if_o we_o be_v so_o weary_a of_o our_o liberty_n that_o we_o will_v be_v industrious_a in_o contrive_v how_o we_o may_v insensible_o slide_v into_o those_o slavery_n which_o our_o ancestor_n have_v be_v some_o age_n take_v pain_n to_o secure_v we_o from_o and_o our_o king_n have_v be_v so_o gracious_a as_o to_o grant_v and_o confirm_v to_o we_o so_o many_o time_n over_o as_o they_o have_v do_v and_o which_o other_o king_n may_v be_v as_o ready_a to_o reassume_v hereafter_o as_o we_o be_v to_o give_v they_o away_o he_o conclude_v his_o observation_n upon_o that_o speech_n of_o the_o earl_n of_o shaftsbury_n with_o take_v notice_n that_o his_o lordship_n have_v show_v he_o be_v one_o of_o those_o peer_n who_o will_v take_v it_o for_o no_o kindness_n to_o be_v make_v absolute_a and_o above_o the_o law_n by_o such_o order_n of_o they_o be_v construe_v to_o extend_v to_o indefinite_a imprisonment_n he_o then_o repeat_v sir_n william_n jones_n his_o declaration_n in_o that_o court_n that_o either_o a_o pardon_n a_o prorogation_n or_o a_o dissolution_n be_v a_o cure_n against_o such_o imprisonment_n and_o he_o observe_v thereupon_o that_o if_o that_o doctrine_n be_v true_a that_o any_o one_o of_o those_o be_v a_o cure_n against_o such_o imprisonment_n and_o he_o can_v not_o doubt_v of_o its_o be_v good_a law_n then_o certain_o he_o ought_v to_o find_v relief_n from_o his_o imprisonment_n who_o have_v every_o one_o of_o those_o cure_n on_o his_o side_n he_o then_o desire_v to_o put_v the_o court_n in_o mind_n how_o in_o the_o worst_a of_o time_n justice_n have_v take_v place_n so_o far_o as_o to_o lay_v aside_o the_o force_n of_o order_n make_v in_o parliament_n after_o the_o dissolution_n of_o those_o parliament_n which_o make_v they_o although_o it_o be_v to_o the_o prejudice_n of_o the_o interest_n of_o those_o usurper_n themselves_o he_o cite_v a_o instance_n of_o one_o sir_n john_n stowel_n who_o by_o the_o article_n of_o exciter_n be_v to_o have_v be_v admit_v to_o composition_n for_o his_o estate_n but_o yet_o contrary_a to_o those_o article_n the_o parliament_n do_v afterward_o order_v his_o estate_n to_o be_v sell_v after_o the_o dissolution_n of_o which_o parliament_n sir_n john_n stowel_n plead_v by_o his_o council_n which_o be_v sergeant_n maynard_n and_o mr._n latch_n that_o that_o order_n be_v dissolve_v by_o the_o dissolution_n of_o that_o parliament_n and_o that_o therefore_o the_o article_n be_v again_o in_o force_n and_o that_o the_o plea_n be_v admit_v to_o be_v good_a and_o sir_n john_n restore_v to_o the_o benefit_n of_o the_o article_n upon_o that_o plea_n even_o by_o bradshaw_n himself_o but_o he_o say_v he_o be_v sorry_a that_o he_o can_v neither_o have_v sir_n william_n jones_n to_o argue_v those_o point_n for_o he_o which_o he_o have_v use_v against_o my_o lord_n shaftsbury_n nor_o sergeant_n maynard_n to_o make_v good_a the_o invalidity_n of_o parliamentary_a order_n after_o dissolution_n but_o he_o say_v that_o it_o be_v not_o his_o fault_n and_o he_o doubt_v not_o but_o he_o be_v before_o more_o just_a judge_n than_o there_o be_v in_o those_o ill_a time_n and_o that_o he_o hope_v that_o the_o liberty_n of_o the_o subject_n be_v not_o now_o more_o precarious_a than_o it_o be_v in_o those_o day_n he_o add_v that_o if_o upon_o such_o order_n man_n can_v not_o be_v bail_v in_o the_o interval_n of_o parliament_n they_o will_v become_v grievance_n equal_a to_o the_o multiplication_n of_o treason_n in_o former_a day_n which_o have_v some_o time_n be_v greedy_o make_v heretofore_o by_o parliament_n in_o distemper_a time_n but_o the_o commons_o have_v never_o be_v quiet_a till_o they_o can_v get_v their_o bear_n chain_v up_o and_o their_o law_n reduce_v to_o the_o old_a standard_n of_o treason_n again_o but_o yet_o those_o thing_n have_v be_v do_v by_o act_n and_o not_o by_o order_n of_o parliament_n he_o desire_v they_o likewise_o to_o remember_v that_o it_o have_v be_v one_o of_o the_o chief_a ground_n of_o the_o late_a war_n betwixt_o the_o king_n and_o his_o parliament_n in_o which_o so_o much_o blood_n have_v be_v shed_v that_o a_o ordinance_n of_o parliament_n shall_v not_o be_v hold_v equal_a to_o a_o act_n of_o parliament_n and_o yet_o those_o be_v order_n of_o both_o house_n and_o now_o say_v he_o shall_v we_o be_v defend_v that_o a_o order_n of_o one_o house_n only_o shall_v be_v equivalent_a to_o a_o law_n and_o shall_v be_v in_o force_n against_o our_o great_a and_o most_o sacred_a law_n of_o liberty_n which_o have_v be_v so_o confirm_v to_o we_o this_o say_v he_o i_o be_o not_o able_a to_o understand_v the_o reason_n of_o nor_o will_v any_o man_n who_o shall_v give_v himself_o the_o least_o leisure_n to_o think_v upon_o it_o he_o then_o say_v he_o desire_v to_o ask_v any_o man_n that_o then_o hear_v he_o or_o any_o commonor_n of_o england_n who_o will_v but_o take_v time_n to_o consider_v this_o case_n which_o may_v be_v any_o man_n be_v in_o england_n whether_o they_o will_v be_v content_v to_o invest_v the_o lord_n with_o such_o a_o inherent_a power_n over_o their_o liberty_n which_o they_o can_v no_o more_o be_v exempt_v from_o then_o the_o peer_n themselves_o and_o he_o say_v that_o the_o lord_n have_v already_o make_v it_o appear_v that_o they_o will_v not_o have_v any_o such_o arbitrary_a power_n place_v in_o they_o for_o that_o they_o have_v refuse_v to_o pass_v a_o favourite_n act_n which_o be_v for_o their_o own_o trial_n only_o by_o reason_n of_o a_o clause_n which_o be_v insert_v therein_o to_o have_v enact_v the_o substance_n of_o this_o present_a order_n into_o a_o law_n
answer_v and_o if_o it_o may_v not_o seem_v too_o great_a a_o vanity_n to_o say_v although_o the_o true_a reason_n do_v take_v away_o the_o vanity_n of_o it_o because_o it_o will_v not_o be_v for_o he_o but_o for_o their_o own_o sake_n as_o what_o may_v happen_v to_o be_v their_o own_o case_n he_o say_v he_o do_v believe_v he_o can_v have_v the_o major_a part_n of_o the_o house_n of_o lord_n to_o be_v his_o bail_n in_o this_o case_n and_o some_o of_o those_o very_a lord_n who_o be_v for_o the_o make_n of_o this_o order_n although_o not_o in_o that_o sense_n which_o will_v seem_v to_o be_v put_v upon_o it_o in_o so_o much_o that_o there_o will_v be_v no_o more_o to_o fear_v in_o the_o grant_v he_o bail_v than_o he_o hope_v there_o be_v either_o reason_n or_o justice_n to_o deny_v it_o and_o he_o doubt_v not_o but_o he_o be_v there_o before_o very_o just_a judge_n who_o will_v due_o consider_v what_o he_o have_v say_v the_o lord_n chief_a justice_n then_o speak_v do_v say_v that_o the_o earl_n of_o danby_n have_v seem_v to_o reflect_v upon_o the_o court_n as_o if_o they_o have_v deny_v he_o justice_n in_o not_o hear_v his_o counsel_n then_o the_o earl_n of_o danby_n desire_v leave_v to_o interrupt_v his_o lordship_n say_v that_o his_o lordship_n have_v mistake_v he_o for_o that_o he_o have_v say_v no_o such_o thing_n of_o that_o court_n nor_o do_v he_o mean_v it_o of_o that_o court_n but_o say_v it_o be_v very_o well_o know_v that_o his_o counsel_n have_v be_v forbid_v to_o plead_v for_o he_o in_o another_o place_n which_o be_v then_o acknowledge_v by_o justice_n jones_n to_o be_v very_o true_a the_o lord_n chief_a justice_n then_o proceed_v and_o say_v that_o for_o his_o lordship_n saying_n they_o need_v not_o to_o fear_v because_o he_o do_v believe_v the_o great_a part_n of_o the_o lord_n will_v be_v his_o bail_n that_o it_o be_v not_o the_o fear_n of_o another_o court_n that_o have_v any_o kind_n of_o influence_n upon_o they_o or_o that_o they_o shall_v do_v such_o thing_n as_o they_o fear_v to_o be_v call_v to_o a_o account_n for_o but_o that_o they_o be_v to_o govern_v themselves_o by_o the_o do_n of_o justice_n that_o they_o have_v hear_v his_o lordship_n with_o a_o great_a deal_n of_o patience_n and_o that_o he_o have_v say_v many_o material_a thing_n and_o with_o much_o acuteness_n and_o that_o they_o be_v not_o senseless_a of_o the_o hardship_n of_o his_o lordship_n case_n and_o of_o the_o greatness_n of_o his_o suffering_n that_o they_o be_v likewise_o sensible_a of_o the_o king_n desire_n that_o his_o lordship_n shall_v have_v no_o long_o imprisonment_n than_o the_o law_n require_v and_o he_o confess_v that_o the_o king_n have_v do_v as_o much_o as_o lay_v in_o his_o power_n that_o it_o be_v not_o deny_v because_o that_o court_n can_v not_o bail_v for_o treason_n for_o that_o they_o have_v a_o power_n to_o bail_v in_o all_o case_n whatsoever_o if_o the_o court_n see_v cause_n neither_o will_v the_o indictment_n which_o be_v find_v against_o he_o about_o sir_n edmondbury_a godfrey_n have_v hinder_v nor_o be_v it_o the_o order_n of_o the_o house_n of_o lord_n which_o hinder_v they_o but_o that_o they_o be_v to_o act_v there_o according_a to_o law_n and_o he_o pray_v his_o lordship_n to_o consider_v that_o they_o can_v not_o relieve_v he_o according_a to_o law_n that_o he_o do_v agree_v to_o some_o thing_n mention_v by_o his_o lordship_n and_o that_o it_o be_v a_o very_a hard_a case_n he_o shall_v lie_v so_o long_o in_o prison_n but_o here_o be_v the_o misery_n they_o can_v only_o compassionate_v he_o for_o that_o his_o lordship_n be_v imprison_v by_o a_o high_a hand_n and_o where_o they_o have_v no_o power_n to_o intermeddle_v he_o instance_a in_o indictment_n for_o treason_n and_o several_a other_o great_a crime_n in_o which_o they_o can_v bail_v man_n but_o in_o this_o case_n the_o supreme_a jurisdiction_n of_o the_o nation_n have_v lay_v their_o hand_n upon_o it_o which_o be_v attend_v by_o the_o house_n of_o commons_o with_o a_o impeachment_n whether_o their_o lordship_n have_v cause_n or_o not_o cause_n to_o commit_v his_o lordship_n they_o can_v not_o inspect_v but_o that_o they_o ought_v to_o believe_v that_o his_o lordship_n be_v just_o commit_v and_o that_o their_o lordship_n in_o their_o mature_a deliberation_n will_v do_v nothing_o unjust_o he_o say_v that_o they_o have_v a_o jurisdiction_n over_o all_o the_o court_n in_o the_o kingdom_n that_o only_o except_v and_o as_o it_o will_v be_v very_o incongruous_a for_o a_o inferior_a court_n to_o bail_v who_o they_o have_v commit_v or_o to_o call_v their_o process_n in_o question_n so_o will_v it_o be_v in_o like_a manner_n for_o they_o to_o do_v in_o this_o case_n because_o the_o lord_n exceed_v their_o jurisdiction_n and_o be_v above_o they_o he_o say_v also_o that_o the_o opinion_n of_o all_o the_o judge_n in_o england_n have_v be_v take_v therein_o and_o have_v deliver_v their_o opinion_n that_o he_o can_v not_o be_v bail_v and_o that_o the_o truth_n be_v his_o lordship_n be_v imprison_v by_o too_o high_a a_o court_n for_o they_o to_o bail_v he_o but_o that_o his_o lordship_n be_v not_o indefinite_o imprison_v as_o he_o have_v allege_v for_o whenever_o his_o majesty_n be_v please_v to_o call_v a_o parliament_n his_o lordship_n will_v have_v remedy_n that_o the_o king_n have_v power_n to_o do_v it_o when_o he_o please_v and_o for_o his_o people_n good_a no_o doubt_n he_o will_v when_o he_o see_v fit_a but_o that_o at_o some_o time_n the_o circumstance_n of_o state_n differ_v from_o other_o time_n and_o that_o it_o may_v not_o for_o some_o space_n of_o time_n be_v think_v convenient_a and_o though_o this_o may_v prove_v mischievous_a to_o a_o single_a person_n or_o to_o two_o or_o three_o person_n yet_o such_o thing_n must_v be_v endure_v for_o the_o good_a of_o the_o public_a he_o say_v also_o that_o if_o that_o court_n shall_v commit_v a_o man_n for_o high_a treason_n and_o the_o king_n shall_v adjourn_v they_o from_o time_n to_o time_n that_o man_n can_v not_o be_v bail_v until_o they_o sit_v again_o so_o that_o he_o must_v confess_v as_o his_o lordship_n have_v say_v that_o as_o this_o case_n do_v happen_v he_o be_v under_o a_o temporary_a indefinite_a imprisonment_n he_o conclude_v which_o tell_v his_o lordship_n that_o he_o must_v be_v contend_v to_o wait_v the_o king_n pleasure_n when_o he_o will_v call_v a_o parliament_n that_o for_o his_o part_n he_o be_v before_o of_o opinion_n that_o they_o can_v not_o bail_v his_o lordship_n and_o he_o be_v so_o still_o the_o earl_n of_o danby_n to_o all_o this_o answer_v that_o he_o must_v confess_v his_o ear_n do_v tingle_v to_o hear_v his_o lordship_n say_v that_o the_o king_n have_v do_v 〈◊〉_d much_o as_o lay_v in_o his_o power_n when_o his_o majesty_n be_v bind_v both_o by_o his_o coronation_n oath_n and_o by_o the_o law_n to_o see_v right_o do_v at_o all_o time_n to_o his_o subject_n and_o he_o desire_v to_o know_v whether_o this_o be_v not_o the_o king_n court_n and_o whether_o he_o have_v not_o depute_v a_o power_n to_o they_o to_o see_v right_o do_v to_o all_o according_o he_o say_v also_o that_o he_o be_v now_o under_o great_a amazement_n than_o before_o since_o his_o lordship_n have_v both_o grant_v that_o this_o court_n can_v bail_v any_o treason_n and_o that_o the_o order_n of_o the_o house_n of_o lord_n do_v not_o hinder_v it_o which_o till_o now_o he_o confess_v he_o have_v take_v to_o be_v the_o only_a obstruction_n to_o his_o liberty_n that_o he_o have_v hope_v he_o have_v satisfy_v his_o lordship_n that_o although_o he_o be_v imprison_v by_o a_o high_a hand_n yet_o that_o the_o bayl_n of_o he_o do_v not_o intermeddle_v with_o the_o jurisdiction_n of_o that_o high_a judicature_n and_o he_o have_v yet_o hear_v nothing_o to_o show_v he_o that_o it_o do_v that_o for_o what_o his_o lordship_n have_v say_v of_o the_o opinion_n of_o all_o the_o judge_n in_o england_n be_v take_v in_o his_o case_n he_o must_v needs_o inform_v his_o lordship_n that_o that_o be_v a_o mistake_n for_o that_o the_o opinion_n of_o the_o judge_n have_v never_o be_v ask_v in_o his_o particular_a case_n save_v once_o upon_o his_o petition_v the_o king_n for_o liberty_n to_o go_v to_o his_o country_n house_n at_o wimbledon_n with_o a_o guard_n or_o otherwise_o as_o his_o majesty_n shall_v think_v fit_a which_o petition_n be_v refer_v by_o his_o majesty_n to_o the_o judge_n and_o they_o according_a to_o their_o want_a prudence_n and_o caution_n do_v only_o report_n that_o they_o think_v his_o majesty_n can_v not_o legal_o grant_v the_o petitioner_n request_n that_o whereas_o his_o lordship_n say_v that_o he_o be_v not_o indefinite_o
