remedy_n all_o those_o mischief_n this_o most_o wholesome_a law_n be_v provide_v which_o we_o shall_v brief_o endeavour_v to_o divide_v into_o its_o several_a branch_n and_o explain_v it_o to_o the_o mean_a capacity_n since_o no_o man_n be_v sure_a but_o one_o time_n or_o other_o he_o may_v have_v occasion_n to_o make_v use_n of_o it_o this_o act_n concern_v either_o first_o person_n commit_v for_o some_o other_o criminal_a or_o supposedcriminal_a matter_n beside_o treason_n or_o felony_n and_o these_o be_v to_o have_v a_o habeas_fw-la corpus_fw-la immediate_o 2_o such_o who_o in_o their_o mittimus_fw-la be_v charge_v with_o treason_n or_o felony_n &_o these_o shall_v have_v the_o benefit_n of_o the_o say_v write_v after_o the_o time_n herein_o limit_v one_a if_o any_o gaoler_n or_o underkeeper_n shall_v not_o deliver_v a_o truecopy_n of_o the_o mittimus_fw-la within_o 6_o hour_n after_o the_o prisoner_n demand_v it_o the_o head-gaoler_n or_o keeper_n forfeit_v to_o the_o to_o trial_n the_o next_o term_n or_o session_n follow_v on_o the_o last_o day_n thereof_o he_o shall_v be_v bail_v and_o if_o not_o indict_v the_o second_o term_n or_o session_n shall_v be_v discharge_v 6._o this_o act_n extend_v to_o all_o place_n within_o england_n and_o wales_n the_o tower_n can_v be_v suppose_v to_o be_v exempt_v nor_o windsor_n castle_n nor_o any_o such_o royal_a fort_n for_o the_o word_n be_v general_a and_o beside_o there_o be_v a_o special_a act_n of_o parliament_n that_o unite_v the_o king_n castle_n to_o the_o county_n wherein_o they_o stand_v there_o have_v be_v it_o seem_v some_o pretension_n and_o ill_a practice_n to_o hold_v they_o district_n that_o therein_o they_o may_v detain_v man_n prisoner_n against_o law_n and_o not_o admit_v any_o writ_n to_o enlarge_v they_o for_o remedy_n whereof_o it_o be_v thus_o enact_v anno_fw-la 13._o rich._n secundi_fw-la item_n it_o be_v ordain_v and_o assent_v that_o the_o king_n castle_n and_o gaol_n which_o be_v wont_a to_o be_v join_v to_o the_o body_n of_o the_o county_n and_o be_v now_o sever_v shall_v be_v rejoin_v to_o the_o same_o county_n last_o no_o person_n shall_v be_v send_v prisoner_n or_o other_o of_o his_o majesty_n privy_a council_n 3._o that_o in_o every_o such_o case_n every_o person_n so_o commit_v restrain_v of_o his_o liberty_n or_o suffer_v imprisonment_n upon_o demand_n or_o motion_n make_v by_o his_o council_n or_o other_o employ_v by_o he_o for_o that_o purpose_n unto_o the_o judge_n of_o the_o court_n of_o king's-bench_n or_o common-plea_n in_o open_a court_n shall_v without_o delay_n upon_o any_o pretence_n whatsoever_o for_o the_o ordinary_a fee_n usual_o pay_v for_o the_o same_o have_v forthwith_o grant_v unto_o he_o a_o writ_n of_o habeas_fw-la for_o and_o recover_v 9_o provide_v always_o and_o be_v it_o enact_v that_o this_o act_n and_o the_o several_a clause_n therein_o contain_v shall_v be_v take_v and_o expound_v to_o extend_v only_o to_o the_o court_n of_o star-chamber_n 2._o and_o to_o the_o say_a court_n hold_v before_o the_o precedent_n and_o council_n in_o the_o march_n of_o wales_n 3._o and_o before_o the_o precedent_n and_o same_o that_o be_v offender_n against_o the_o statute_n of_o the_o 23._o and_o they_o be_v only_a papist_n therefore_o it_o be_v absurd_a and_o unjust_a to_o turn_v the_o edge_n on_o it_o upon_o protestant_n 4._o we_o come_v now_o to_o the_o statute_n of_o 1._o jac._n ca._n 4._o which_o confirm_v all_o the_o former_a statute_n make_v against_o popish_a recusant_n in_o the_o queen_n time_n but_o provide_v for_o their_o be_v discharge_v though_o convict_v upon_o their_o come_n to_o church_n and_o that_o it_o mean_n and_o intend_v none_o but_o jesuit_n and_o popish_a priest_n and_o other_o popish_a recusant_n appear_v manifest_o not_o only_o in_o the_o title_n but_o in_o the_o first_o section_n of_o the_o act_n itself_o and_o so_o throughout_o the_o title_n be_v a_o act_n for_o the_o due_a execution_n of_o the_o statute_n against_o jesuit_n seminary_n priest_n recusant_n the_o 2_o former_a word_n include_v the_o romish_a clergy_n the_o latter_a the_o laiety_n etc._n etc._n and_o begin_v thus_o for_o the_o better_a and_o more_o due_a execution_n of_o the_o statute_n heretofore_o make_v against_o who_o as_o well_v against_o jesuit_n seminary_n priest_n and_o other_o suchlike_a priest_n that_o be_v other_o popish_a priest_n though_o not_o breed_v up_o in_o the_o serminary_n as_o also_o against_o all_o manner_n of_o recusant_n that_o be_v papist_n though_o not_o in_o order_n be_v it_o enact_v etc._n etc._n that_o all_o &_o every_o the_o statute_n heretofore_o make_v against_o jesuit_n seminary_a priest_n and_o other_o priest_n deacon_n and_o religion_n and_o powder-plot_n of_o the_o papist_n which_o occasion_v the_o make_n of_o the_o statute_n 3_o jac._n ca._n 4._o entitle_v a_o act_n for_o discover_v and_o repress_v popish_a recusant_n so_o that_o both_o the_o occasion_n and_o the_o very_a title_n show_v evident_o against_o who_o this_o act_n be_v design_v which_o also_o appear_v further_o in_o the_o preamble_n the_o whole_a purport_n of_o this_o follow_v i_o a._n b._n do_v declare_v that_o it_o be_v not_o lawful_a upon_o any_o pretence_n whatsoever_o to_o take_v arm_n against_o the_o king_n and_o that_o i_o do_v abhor_v that_o traitorous_a position_n of_o take_v arm_n by_o his_o authority_n against_o his_o person_n or_o against_o those_o that_o be_v commission_v by_o he_o and_o that_o i_o will_v conform_v to_o the_o liturgy_n of_o the_o church_n of_o england_n as_o it_o be_v now_o by_o law_n establish_v and_o i_o do_v declare_v that_o i_o do_v hold_v there_o lie_v no_o obligation_n upon_o i_o nor_o any_o other_o person_n from_o the_o
