will_v be_v that_o our_o bishop_n derive_v their_o power_n from_o such_o as_o derive_v they_o with_o a_o power_n of_o communicate_v it_o in_o a_o continual_a succession_n from_o the_o apostle_n and_o this_o therefore_o be_v suppose_v that_o the_o first_o bishop_n of_o our_o english_a reformation_n receive_v their_o power_n from_o such_o as_o have_v derive_v they_o by_o a_o uninterrupted_a they_o both_o for_o the_o government_n of_o their_o present_a charge_n and_o communicate_v their_o power_n to_o succeed_a generation_n for_o nothing_o of_o this_o be_v pretend_v to_o exceed_v the_o power_n of_o a_o valid_a bishop_n the_o charge_n of_o heresy_n itself_o can_v hinder_v the_o validity_n of_o their_o order_n either_o receive_v or_o communicate_v though_o it_o may_v indeed_o in_o the_o judgement_n of_o they_o who_o believe_v they_o so_o render_v they_o obnoxious_a to_o canonical_a incapacity_n of_o execute_v they_o and_o to_o legal_a degradation_n not_o from_o the_o validly-ordained_n person_n themselves_o to_o be_v obnoxious_a and_o therefore_o can_v make_v that_o a_o argument_n against_o the_o validity_n of_o our_o order_n and_o yet_o even_o this_o charge_n of_o heresy_n against_o our_o bishop_n be_v not_o here_o to_o be_v judge_v by_o the_o pretence_n of_o our_o adversary_n but_o by_o the_o merit_n of_o the_o cause_n and_o therefore_o be_v not_o to_o be_v take_v for_o grant_v till_o it_o be_v prove_v that_o therefore_o which_o be_v indeed_o new_a in_o the_o church_n of_o england_n be_v that_o though_o her_o positive_a doctrine_n and_o order_n be_v when_o there_o be_v so_o great_a a_o want_n of_o that_o kind_n of_o grammatical_a and_o historical_a learning_n which_o be_v only_o fit_a to_o qualify_v a_o person_n to_o judge_n of_o ecclesiastical_a tradition_n at_o least_o they_o be_v not_o likely_a to_o have_v be_v discover_v by_o such_o a_o number_n as_o have_v be_v requisite_a to_o maintain_v a_o open_a opposition_n and_o if_o the_o error_n 1._o our_o negative_n be_v not_o pretend_v to_o be_v of_o perpetual_a obligation_n but_o only_o for_o prevent_v the_o malignity_n of_o the_o contrary_a affirmative_a article_n to_o which_o they_o be_v be_v think_v of_o nor_o to_o expect_v a_o reformation_n of_o abuse_n before_o there_o be_v abuse_n to_o be_v reform_v see_v that_o in_o course_n of_o nature_n these_o negative_n presuppose_v the_o contrary_a affirmative_n as_o a_o pretence_n of_o reformation_n must_v also_o presuppose_v abuse_n and_o therefore_o the_o pretence_n of_o the_o great_a antiquity_n of_o our_o adversary_n error_n and_o abuse_n be_v so_o far_o from_o prejudice_v the_o reputation_n of_o our_o negative_n and_o reformation_n as_o that_o it_o be_v indeed_o the_o best_a argument_n of_o their_o justice_n and_o seasonableness_n for_o such_o negative_n as_o these_o and_o such_o a_o reformation_n must_v needs_o have_v be_v unwarrantable_a if_o there_o have_v not_o be_v before_o error_n fit_a to_o be_v deny_v and_o abuse_v fit_a to_o be_v reform_v nor_o 2._o be_v it_o any_o prejudice_n to_o the_o justice_n of_o our_o cause_n that_o these_o error_n be_v not_o oppose_v with_o formal_a negative_n as_o soon_o as_o they_o appear_v for_o such_o error_n as_o these_o be_v usual_o first_o receive_v as_o the_o opinion_n of_o private_a person_n before_o they_o be_v countenance_v by_o authority_n and_o whilst_o they_o proceed_v no_o further_o there_o be_v not_o that_o mischief_n in_o they_o nor_o consequent_o that_o obligation_n to_o oppose_v
its_o lawfulness_n now_o this_o fundamental_a principle_n of_o our_o church_n proceed_n in_o these_o and_o the_o like_a particular_n concern_v the_o power_n of_o the_o church_n for_o innovate_a from_o ancient_a custom_n not_o only_o by_o add_v new_a one_o but_o abrogate_a old_a one_o may_v have_v be_v prove_v not_o only_o from_o the_o principle_n but_o from_o several_a practice_n of_o the_o roman_a church_n herself_o q._n 6._o why_o be_v reformation_n do_v by_o act_n of_o parliament_n reformation_n may_v be_v consider_v two_o way_n either_o 1._o as_o preach_v and_o impose_v under_o pain_n of_o spiritual_a censure_n and_o of_o exclusion_n from_o the_o communion_n of_o the_o church_n and_o a_o deprivation_n of_o all_o the_o privilege_n consequent_a to_o that_o communion_n and_o this_o be_v certain_o the_o right_n of_o the_o church_n and_o be_v according_o practise_v by_o the_o church_n in_o our_o english_a reformation_n 2._o as_o enact_v as_o a_o law_n of_o the_o land_n and_o consequent_o as_o urge_v the_o same_o way_n as_o other_o law_n be_v under_o temporal_a penalty_n and_o external_n coercion_n and_o encourage_v by_o temporal_a advantage_n and_o this_o be_v undoubted_o the_o right_n of_o the_o secular_a power_n and_o this_o be_v all_o in_o which_o the_o secular_a power_n do_v concern_v itself_o in_o the_o reformation_n what_o i_o can_v further_o foresee_v in_o favour_n of_o our_o adversary_n be_v that_o 1._o the_o secular_a power_n ought_v in_o conscience_n to_o be_v herein_o advise_v by_o the_o ecclesiastic_n and_o 2._o that_o though_o external_a obedience_n may_v be_v pay_v to_o the_o mistake_a decree_n of_o the_o secular_a power_n follow_v the_o mistake_a part_n of_o the_o ecclesiastic_n yet_o the_o obligation_n in_o conscience_n and_o right_n of_o such_o decree_n must_v be_v derive_v from_o the_o justice_n of_o the_o church_n proceed_n in_o advise_v the_o magistrate_n so_o that_o no_o act_n of_o the_o magistrate_n can_v make_v amends_o for_o any_o essential_a defect_n in_o the_o proceed_n of_o the_o church_n but_o the_o only_a effect_n of_o the_o magistrate_n concurrence_n in_o that_o case_n be_v that_o what_o be_v already_o perform_v without_o heresy_n or_o schism_n in_o the_o church_n may_v be_v by_o that_o mean_v settle_v in_o such_o a_o particular_a commonwealth_n without_o schism_n or_o sedition_n in_o the_o state._n and_o therefore_o see_v they_o suppose_v that_o at_o the_o reformation_n the_o great_a number_n of_o the_o bishop_n then_o be_v be_v overawe_v and_o deprive_v of_o the_o liberty_n of_o their_o vote_n by_o the_o secular_a magistrate_n and_o it_o be_v the_o nature_n of_o all_o society_n to_o be_v sway_v by_o the_o great_a part_n therefore_o they_o may_v think_v it_o unreasonable_a to_o ascribe_v the_o reformation_n to_o the_o church_n of_o england_n but_o only_o to_o a_o schismatical_a part_n of_o it_o so_o that_o the_o magistrate_n have_v attempt_v this_o reformation_n without_o warrant_n from_o the_o church_n they_o think_v they_o do_v well_o to_o call_v our_o reformation_n itself_o parliamentary_a to_o this_o therefore_o i_o reply_v 1._o that_o the_o use_n we_o make_v of_o this_o topick_n of_o the_o magistrate_n concurrence_n be_v indeed_o no_o other_o than_o to_o clear_v our_o reformation_n from_o be_v seditious_a which_o be_v ordinary_o charge_v on_o we_o by_o our_o adversary_n and_o much_o more_o ordinary_o on_o the_o foreign_a protestant_n 2._o that_o for_o clear_v the_o very_a proceed_n of_o the_o magistracy_n from_o be_v heretical_a or_o schismatical_a to_o the_o conscience_n of_o the_o magistracy_n itself_o it_o be_v sufficient_a that_o the_o magistracy_n give_v its_o assistance_n and_o protection_n to_o no_o other_o church_n but_o such_o as_o at_o least_o according_a to_o the_o genuine_a dictate_v of_o their_o conscience_n be_v neither_o heretical_a nor_o schismatical_a but_o this_o justification_n of_o the_o private_a conscience_n of_o the_o magistracy_n be_v i_o confess_v a_o thing_n we_o be_v at_o present_a not_o so_o necessary_o concern_v for_o and_o therefore_o 3._o we_o grant_v far_o that_o for_o satisfy_v our_o own_o conscience_n of_o the_o justice_n of_o these_o proceed_n of_o the_o magistracy_n it_o be_v requisite_a that_o we_o be_v satisfy_v that_o they_o be_v advise_v by_o that_o part_n of_o the_o clergy_n who_o advice_n we_o conceive_v they_o ought_v to_o have_v follow_v so_o that_o if_o this_o may_v appear_v in_o the_o case_n we_o be_v speak_v of_o this_o and_o this_o alone_a will_v be_v a_o sufficient_a vindication_n of_o the_o magistrate_n proceed_n to_o the_o conscience_n of_o his_o subject_n 4._o therefore_o the_o determination_n of_o the_o justice_n of_o the_o advice_n follow_v by_o the_o magistrate_n may_v be_v resolve_v two_o way_n either_o from_o the_o merit_n of_o the_o cause_n or_o from_o the_o legal_a authority_n and_o right_o the_o person_n may_v be_v presume_v to_o have_v to_o be_v consult_v on_o such_o occasion_n as_o for_o the_o former_a it_o be_v in_o the_o present_a case_n the_o principal_a dispute_n whether_o the_o reformation_n undertake_v by_o the_o magistrate_n be_v right_a or_o not_o and_o therefore_o very_o unfit_a to_o be_v rely_v on_o as_o a_o presumption_n to_o prove_v the_o magistrate_n proceed_n irregular_a the_o late_a therefore_o only_o be_v proper_a to_o be_v insist_v on_o here_o and_o it_o consist_v of_o two_o charge_n that_o by_o the_o law_n of_o the_o land_n the_o magistrate_n ought_v to_o have_v be_v advise_v by_o the_o bishop_n then_o possess_v of_o the_o several_a see_v and_o that_o in_o advise_v with_o the_o clergy_n whoever_o they_o be_v he_o ought_v to_o have_v allow_v they_o the_o liberty_n of_o speak_v their_o mind_n and_o to_o have_v be_v sway_v by_o the_o great_a part_n these_o thing_n be_v conceive_v so_o necessary_a as_o that_o the_o magistrate_n not_o observe_v they_o may_v be_v presume_v to_o act_v as_o no_o way_n influence_v by_o the_o clergy_n which_o be_v the_o reason_n why_o they_o call_v our_o reformation_n wherein_o they_o suppose_v they_o not_o observe_v parliamentary_a 1._o therefore_o as_o to_o the_o legal_a right_n of_o the_o popish_a clergy_n to_o advise_v the_o secular_a magistrate_n two_o thing_n may_v be_v reply_v 1._o that_o this_o legal_a right_n may_v be_v forfeit_v by_o the_o person_n by_o their_o personal_a misdemeanour_n and_o of_o this_o forfeiture_n the_o secular_a magistrate_n himself_o be_v the_o proper_a judge_n and_o that_o this_o be_v exact_o the_o popishs_n bishop_n case_n at_o that_o time_n 2._o that_o the_o consideration_n of_o this_o legal_a right_n be_v of_o no_o use_n for_o satisfy_v the_o conscience_n of_o their_o subject_n which_o yet_o be_v the_o only_a use_n that_o be_v seasonable_a for_o this_o occasion_n 2._o as_o for_o the_o canonical_a freedom_n to_o be_v allow_v they_o in_o advise_v and_o the_o obligation_n of_o the_o magistrate_n to_o follow_v the_o advice_n of_o the_o great_a part_n these_o canonical_a right_n can_v only_o satisfy_v the_o conscience_n of_o their_o own_o communion_n but_o can_v be_v pretend_v necessary_a to_o be_v observe_v where_o there_o be_v different_a communion_n for_o 1._o the_o romanist_n themselves_o never_o allow_v that_o freedom_n to_o person_n out_o of_o their_o communion_n as_o be_v plain_a in_o the_o council_n of_o trent_n and_o still_o appear_v on_o all_o occasion_n 2._o especial_o in_o particular_a national_a church_n as_o we_o be_v they_o themselves_o will_v not_o deny_v that_o the_o great_a part_n may_v prove_v heretical_a and_o therefore_o likely_a to_o prevail_v by_o plurality_n of_o vote_n in_o which_o case_n themselves_o will_v notwithstanding_o think_v it_o unequal_a for_o the_o magistrate_n to_o be_v sway_v by_o they_o 3._o this_o have_v always_o be_v the_o practice_n of_o the_o church_n and_o the_o catholic_n emperor_n never_o to_o allow_v any_o canonical_a right_n to_o the_o assembly_n and_o censure_n of_o heretic_n as_o athanasius_n be_v restore_v first_o by_o maximinus_n bishop_n of_o trier_n then_o by_o pope_n julius_n after_o that_o by_o maximus_n bishop_n of_o jerusalem_n and_o at_o last_o by_o the_o emperor_n jovinian_a without_o any_o canonical_a revocation_n of_o the_o synod_n that_o have_v condemn_v he_o many_o instance_n of_o the_o like_a nature_n may_v be_v give_v 4._o the_o popish_a clergy_n have_v give_v the_o first_o precedent_n of_o this_o liberty_n themselves_o in_o refuse_v to_o admit_v of_o the_o canonical_a appeal_n of_o the_o protestant_n from_o the_o pope_n to_o a_o free_a general_n council_n finis_fw-la
of_o the_o reformer_n be_v only_o that_o no_o one_o communion_n of_o the_o reformer_n have_v that_o advantage_n over_o the_o rest_n as_o that_o antecedent_o to_o all_o enquiry_n into_o the_o merit_n of_o the_o cause_n its_o word_n be_v fit_a to_o be_v trust_v as_o a_o guide_n in_o controversy_n to_o assure_v any_o of_o its_o own_o truth_n and_o of_o the_o error_n of_o all_o differ_v from_o it_o this_o if_o the_o gentlewoman_n will_v observe_v she_o will_v find_v that_o their_o argument_n from_o this_o and_o the_o like_a topic_n only_a aim_n at_o for_o because_o they_o challenge_v such_o a_o privilege_n themselves_o they_o fancy_v we_o to_o do_v so_o too_o and_o that_o our_o design_n be_v not_o to_o overthrow_v a_o judge_n of_o controversy_n but_o only_o to_o translate_v that_o title_n from_o the_o pope_n to_o luther_n or_o some_o other_o of_o our_o eminent_a reformer_n which_o be_v far_o from_o our_o design_n but_o this_o difference_n in_o opinion_n do_v not_o in_o the_o least_o prove_v but_o that_o upon_o a_o particular_a enquiry_n into_o the_o merit_n of_o the_o cause_n one_o party_n may_v be_v find_v to_o have_v the_o advantage_n of_o the_o other_o which_o be_v all_o that_o we_o pretend_v to_o 3._o that_o this_o difference_n of_o the_o several_a party_n of_o the_o reformation_n in_o other_o thing_n be_v rather_o a_o very_a strong_a presumption_n for_o a_o ignorant_a person_n who_o must_v conduct_v herself_o by_o presumption_n that_o there_o be_v great_a reason_n for_o those_o thing_n wherein_o they_o be_v all_o agree_v and_o indeed_o be_v a_o great_a argument_n for_o the_o credibility_n of_o the_o reformation_n in_o general_n than_o for_o that_o of_o the_o roman_a communion_n for_o to_o a_o disinteressed_n person_n the_o agreement_n of_o those_o be_v a_o more_o valuable_a argument_n for_o the_o truth_n of_o what_o they_o say_v who_o seem_v most_o of_o all_o act_v by_o the_o merit_n of_o the_o thing_n and_o least_o of_o all_o influence_v by_o the_o opinion_n and_o authority_n of_o a_o few_o and_o there_o can_v hardly_o be_v conceive_v a_o more_o considerable_a argument_n of_o their_o freedom_n in_o judgement_n than_o their_o actual_a difference_n in_o other_o thing_n what_o therefore_o the_o protestant_n be_v agree_v in_o seem_v more_o likely_a to_o be_v the_o real_a sense_n of_o all_o that_o be_v so_o agree_v upon_o a_o impartial_a enquiry_n whereas_o the_o romanist_n be_v general_o influence_v by_o a_o few_o of_o the_o court_n of_o rome_n to_o who_o the_o rest_n do_v general_o conceive_v themselves_o oblige_v in_o conscience_n to_o conform_v and_o this_o advantage_n of_o the_o difference_n of_o protestant_n for_o recommend_v their_o credibility_n in_o other_o thing_n above_o that_o of_o their_o adversary_n to_o the_o trust_n of_o a_o ignorant_a person_n will_v appear_v the_o more_o remarkable_a if_o it_o be_v consider_v 4._o that_o they_o be_v not_o only_o agree_v in_o general_a in_o the_o fitness_n of_o a_o reformation_n but_o also_o in_o most_o of_o the_o particular_n to_o be_v reform_v indeed_o if_o they_o be_v only_o agree_v in_o general_a that_o it_o be_v fit_v a_o reformation_n shall_v be_v but_o agree_v in_o no_o particular_n it_o may_v seem_v too_o probable_a a_o suspicion_n that_o it_o be_v not_o truth_n but_o faction_n and_o the_o disturbance_n of_o the_o public_a that_o be_v their_o common_a design_n but_o that_o be_v far_o from_o be_v the_o case_n here_o 5._o the_o division_n of_o the_o protestant_n in_o doctrine_n be_v not_o so_o irreconcilable_a as_o they_o may_v seem_v the_o harmony_n of_o confession_n show_v they_o agree_v in_o the_o principal_a as_o for_o the_o other_o it_o be_v plain_a that_o our_o church_n of_o england_n do_v not_o think_v they_o worth_a contend_v for_o whilst_o she_o admit_v the_o several_a party_n into_o her_o communion_n and_o if_o other_o protestant_n think_v otherwise_o yet_o she_o be_v not_o responsible_a for_o they_o because_o she_o be_v not_o of_o their_o mind_n the_o most_o pernicious_a principle_n of_o all_o which_o most_o natural_o tend_v to_o division_n and_o which_o make_v the_o difference_n result_v from_o they_o most_o impossible_a to_o be_v reconcile_v be_v the_o difference_n concern_v church-government_n and_o in_o that_o our_o church_n have_v innovate_v nothing_o that_o shall_v cause_v any_o breach_n even_o from_o the_o roman_a much_o less_o from_o any_o other_o part_n of_o the_o catholic_n church_n and_o most_o of_o their_o other_o difference_n be_v no_o long_o irreconcilable_a than_o the_o person_n be_v likely_a to_o continue_v averse_a to_o reconciliation_n but_o these_o difference_n about_o church-government_n be_v so_o derive_v from_o the_o nature_n of_o the_o thing_n as_o that_o they_o may_v cause_n division_n among_o person_n otherwise_o well_o meaning_n and_o of_o a_o peaceable_a disposition_n 6._o this_o argument_n from_o the_o division_n of_o protestant_n be_v principal_o proper_a for_o such_o as_o be_v not_o actual_o engage_v in_o any_o particular_a communion_n of_o they_o and_o even_o to_o they_o aught_o to_o have_v no_o more_o force_n than_o that_o of_o a_o prudent_a presumption_n till_o the_o person_n so_o presume_v may_v have_v leisure_n to_o examine_v particular_n but_o that_o seem_v not_o to_o be_v the_o gentlewoman_n case_n who_o i_o suppose_v to_o have_v be_v hitherto_o educate_v in_o the_o church_n of_o england_n and_o to_o have_v have_v sufficient_a opportunity_n of_o inform_v herself_o concern_v we_o for_o such_o a_o one_o it_o will_v sure_o be_v sufficient_a that_o our_o church_n be_v no_o way_n guilty_a of_o these_o division_n whatsoever_o may_v be_v the_o case_n of_o other_o protestant_n q_o 5._o why_o the_o church_n of_o england_n do_v not_o hold_v up_o to_o confession_n fasting-day_n holy_a oil_n which_o we_o ourselves_o commend_v it_o be_v a_o mistake_n that_o the_o questionist_n do_v suppose_v we_o to_o commend_v holy_a oil_n however_o we_o think_v all_o the_o instance_n here_o mention_v lawful_a and_o indifferent_a and_o so_o to_o be_v as_o obnoxious_a to_o the_o prudence_n of_o particular_a church-governor_n as_o other_o thing_n of_o that_o nature_n be_v by_o all_o acknowledge_a to_o be_v and_o we_o shall_v conceive_v ourselves_o secure_a of_o the_o gentlewoman_n communion_n if_o she_o will_v not_o alter_v till_o our_o adversary_n prove_v they_o necessary_a antecedent_o to_o church_n authority_n which_o be_v more_o than_o they_o will_v as_o much_o as_o pretend_v to_o at_o least_o concern_v some_o of_o they_o these_o thing_n therefore_o be_v thus_o suppose_v i_o shall_v propose_v two_o thing_n to_o the_o gentlewoman_n consideration_n 1._o that_o suppose_v we_o be_v to_o blame_v in_o omit_v they_o yet_o this_o be_v no_o ground_n for_o she_o to_o leave_v our_o communion_n 2._o that_o as_o far_o as_o they_o be_v not_o impose_v by_o our_o church_n there_o be_v reason_n for_o their_o not_o impose_v they_o 1._o suppose_v that_o we_o be_v indeed_o to_o blame_v in_o omit_v these_o ecclesiastical_a observance_n yet_o this_o will_v be_v no_o sufficient_a ground_n to_o excuse_v the_o gentlewoman_n for_o leave_v our_o communion_n for_o 1._o no_o indifferent_a thing_n how_o imprudent_a or_o inexpedient_a soever_o and_o that_o be_v the_o high_a charge_n that_o the_o church_n mistake_v in_o a_o matter_n of_o this_o nature_n be_v chargeable_a withal_o as_o long_o as_o the_o object_n be_v suppose_v of_o its_o own_o nature_n indifferent_a as_o long_o as_o it_o be_v not_o sinful_a and_o certain_o it_o can_v be_v no_o sin_n to_o submit_v for_o peace_n sake_n to_o a_o imprudent_a constitution_n can_v excuse_v a_o departure_n from_o a_o communion_n that_o be_v in_o other_o regard_v allowable_a 2._o whatever_o a_o separation_n on_o this_o account_n may_v be_v in_o other_o yet_o it_o be_v less_o excusable_a in_o subject_n who_o be_v no_o way_n responsible_a for_o as_o much_o as_o the_o imprudence_n of_o such_o constitution_n and_o who_o be_v certain_o bind_v to_o bear_v with_o all_o tolerable_a frailty_n of_o their_o lawful_a governor_n and_o who_o be_v not_o indeed_o so_o well_o qualify_v for_o judge_v concern_v they_o as_o neither_o be_v so_o well_o skill_v in_o politic_n general_o nor_o be_v make_v acquaint_v with_o the_o secret_a reason_n of_o such_o constitution_n which_o may_v make_v that_o which_o without_o they_o may_v seem_v strange_a appear_v high_o commendable_a when_o consider_v with_o they_o 3._o the_o gentlewoman_n sex_n and_o possible_o her_o particular_a condition_n may_v not_o have_v those_o advantage_n which_o many_o other_o though_o subject_n also_o have_v for_o judge_v concern_v they_o these_o argument_n be_v so_o agreeable_a to_o the_o principle_n of_o our_o adversary_n themselves_o as_o that_o they_o frequent_o make_v use_v of_o they_o for_o retain_v person_n in_o their_o own_o communion_n which_o the_o gentlewoman_n may_v be_v please_v to_o take_v notice_n of_o if_o any_o of_o her_o tempter_n shall_v question_v
