every_o way_n like_o to_o those_o in_o england_n and_o that_o they_o make_v and_o change_v law_n by_o the_o authority_n of_o this_z their_z parliament_n and_o therefore_o the_o statute_n which_o be_v make_v to_o bind_v in_o england_n do_v not_o bind_v they_o because_o they_o have_v no_o representative_n here_o in_o the_o parliament_n of_o england_n but_o it_o be_v always_o to_o be_v understand_v that_o this_o the_o law_n make_v in_o the_o parliament_n of_o ireland_n must_v only_o have_v relation_n to_o that_o country_n and_o to_o such_o matter_n as_o be_v transact_v among_o themselves_o therein_o but_o they_o the_o people_n of_o ireland_n be_v in_o their_o person_n subject_n of_o the_o king_n and_o kingdom_n of_o england_n and_o as_o subject_n they_o shall_v be_v oblige_v not_o to_o do_v any_o thing_n out_o of_o that_o country_n against_o statute_n make_v in_o england_n to_o prohibit_v they_o like_o as_o the_o inhabitant_n of_o calais_n gascony_n guien_n etc._n etc._n while_o they_o be_v subject_n and_o they_o shall_v be_v obedient_a to_o the_o admiral_n of_o england_n in_o all_o thing_n do_v upon_o the_o high_a sea_n in_o like_a manner_n also_o a_o writ_n of_o error_n upon_o judgement_n give_v in_o ireland_n lie_v from_o the_o court_n of_o king_n bench_n in_o england_n i_o confess_v this_o opinion_n be_v odd_o word_v but_o i_o shall_v make_v no_o further_o comment_n upon_o it_o here_o have_v occasion_n to_o speak_v at_o large_a to_o it_o in_o another_o place_n where_o it_o will_v appear_v whether_o the_o sense_n which_o i_o have_v put_v upon_o it_o may_v not_o be_v more_o agreeable_a both_o to_o the_o passage_n itself_o and_o to_o the_o opinion_n which_o we_o shall_v afterward_o find_v the_o lord_n chief_a justice_n cook_n give_v of_o it_o than_o to_o that_o turn_n which_o mr._n molyneux_n have_v give_v it_o but_o he_o note_n upon_o it_o that_o upon_o a_o second_o consideration_n of_o this_o case_n before_o the_o judge_n in_o the_o exchequer-chamber_n the_o one_a hen._n 7._o hussey_n the_o chief_a justice_n give_v his_o opinion_n 92._o that_o the_o statute_n make_v in_o england_n shall_v bind_v those_o of_o ireland_n which_o be_v not_o much_o gainsay_v by_o the_o other_o judge_n notwithstanding_o that_o some_o of_o they_o be_v of_o another_o opinion_n the_o last_o term._n and_o he_o be_v offend_v at_o this_o opinion_n and_o suggest_v as_o if_o it_o be_v the_o presence_n of_o the_o chief_a justice_n that_o influence_v those_o other_o judge_n which_o have_v not_o be_v of_o the_o same_o mind_n he_o note_n also_o that_o brook_n in_o his_o abridge_n this_o case_n make_v a_o note_n upon_o it_o intimate_v thereby_o that_o hussey_n be_v opinion_n be_v not_o reasonable_a yet_o this_o be_v no_o more_o than_o mr._n molyneux_n construction_n of_o this_o intimation_n but_o if_o he_o have_v any_o such_o scruple_n be_v it_o strange_a thing_n for_o lawyer_n not_o to_o jump_v in_o their_o opinion_n in_o some_o case_n yet_o it_o seem_v those_o that_o be_v present_a with_o hussey_n and_o hear_v the_o argument_n be_v so_o far_o convince_v as_o to_o become_v of_o his_o mind_n without_o say_v much_o against_o it_o but_o i_o can_v believe_v that_o judge_n be_v so_o easy_o to_o be_v influence_v contrary_a to_o their_o judgement_n by_o a_o lord_n chief_a justice_n then_o more_o than_o now_o when_o we_o have_v see_v two_o of_o they_o persist_v in_o a_o opinion_n against_o the_o other_o ten._n he_o comment_n also_o upon_o the_o first_o opinion_n in_o this_o case_n and_o say_v that_o those_o judge_n be_v not_o so_o conclude_v upon_o they_o as_o hussey_n and_o they_o do_v almost_o seem_v to_o extend_v the_o jurisdiction_n of_o the_o english_a parliament_n over_o the_o subject_n of_o ireland_n 93._o only_o in_o relation_n to_o their_o action_n beyond_o sea_n even_o this_o be_v handle_n enough_o for_o we_o to_o lay_v hold_v on_o for_o the_o do_v whatever_o we_o shall_v think_v requisite_a for_o the_o preserve_n of_o our_o commerce_n but_o he_o say_v this_o will_v appear_v unreasonable_a because_o by_o the_o same_o argument_n scotland_n may_v be_v bind_v by_o english_a law_n in_o relation_n to_o their_o foreign_a trade_n as_o they_o be_v the_o king_n subject_n the_o scot_n be_v subject_n of_o the_o king_n only_o as_o he_o be_v king_n of_o scotland_n and_o we_o have_v no_o pretence_n to_o meddle_v in_o their_o government_n but_o ireland_n be_v upon_o another_o foot_n it_o be_v not_o a_o independent_a kingdom_n though_o it_o have_v a_o parliament_n it_o be_v not_o complete_a in_o its_o own_o jurisdiction_n but_o be_v subordinate_a to_o england_n and_o they_o can_v transact_v nothing_o of_o weight_n in_o their_o administration_n without_o order_n and_o direction_n from_o the_o government_n of_o england_n all_o this_o i_o think_v be_v clear_o make_v out_o already_o but_o he_o make_v all_o the_o advantage_n possible_a of_o the_o word_n personae_fw-la eorum_fw-la sunt_fw-la subjecti_fw-la regis_fw-la etc._n etc._n and_o tell_v we_o if_o be_v the_o king_n of_o england_n be_v subject_n be_v a_o reason_n why_o we_o ought_v to_o submit_v to_o law_n in_o relation_n to_o our_o trade_n abroad_o which_o have_v not_o receive_v our_o assent_n 94._o the_o people_n of_o england_n will_v consider_v whether_o they_o also_o be_v not_o the_o king_n subject_n and_o may_v therefore_o by_o this_o way_n of_o reason_v be_v bind_v by_o law_n which_o the_o king_n may_v assign_v they_o without_o their_o assent_n in_o relation_n to_o their_o action_n abroad_o or_o foreign_a trade_n or_o parliament_n have_v not_o be_v ready_a to_o exercise_v this_o authority_n but_o when_o the_o welfare_n of_o the_o whole_a body_n require_v it_o and_o that_o they_o be_v then_o content_v to_o take_v no_o notice_n of_o such_o alteration_n make_v by_o they_o which_o may_v be_v needful_a and_o of_o use_n to_o they_o and_o he_o have_v reason_n to_o acknowledge_v their_o tenderness_n to_o they_o in_o this_o respect_n but_o i_o believe_v these_o english_a act_n be_v not_o repeal_v and_o therefore_o this_o instance_n will_v not_o maintain_v the_o assertion_n which_o he_o raise_v from_o it_o that_o as_o subject_n of_o the_o king_n be_v oblige_v to_o act_v nothing_o out_o of_o that_o country_n against_o the_o statute_n be_v of_o such_o english_a statute_n as_o name_n ireland_n for_o the_o subject_a of_o their_o debate_n be_v about_o a_o statute_n wherein_o ireland_n be_v name_v these_o judge_n of_o the_o exchequer_n do_v here_o make_v two_o conclusion_n that_o seem_v contradictory_n first_o they_o say_v our_o law_n do_v bind_v they_o but_o that_o be_v in_o respect_n of_o thing_n transact_v within_o themselves_o wherein_o the_o parliament_n of_o england_n dont_fw-fr meddle_v but_o then_o in_o the_o second_o place_n they_o say_v our_o statute_n do_v bind_v the_o people_n of_o ireland_n in_o matter_n not_o relate_v to_o what_o be_v do_v within_o themselves_o and_o therefore_o they_o conclude_v that_o this_o statute_n do_v because_o they_o be_v particular_o name_v else_o there_o have_v be_v no_o such_o dispute_n about_o it_o and_o this_o reconcile_v both_o these_o conclusion_n soon_o afterward_o as_o be_v aforesaid_a when_o this_o cause_n come_v to_o have_v a_o second_o hear_v before_o the_o judge_n in_o the_o exchequer_n chamber_n the_o chief_a justice_n hussey_n declare_v that_o the_o statute_n make_v in_o england_n shall_v bind_v those_o of_o ireland_n to_o which_o the_o other_o judge_n agree_v without_o say_v much_o against_o it_o but_o doubtless_o this_o opinion_n be_v to_o be_v understand_v of_o such_o statute_n only_o which_o name_n ireland_n and_o as_o to_o this_o statute_n they_o all_o agree_v that_o it_o have_v its_o full_a effect_n upon_o the_o people_n of_o ireland_n where_o then_o be_v this_o erroneous_a slip_n of_o the_o lord_n chief_a justice_n cook_n in_o repeat_v the_o word_n of_o the_o first_o opinion_n that_o our_o statute_n do_v bind_v they_o he_o note_n in_o a_o parenthesis_n the_o tenor_n of_o the_o latter_a opinion_n unless_o they_o be_v especial_o namedâ—_n this_o be_v not_o contrary_a but_o agreeable_a to_o both_o the_o former_a opinion_n how_o then_o do_v he_o differ_v from_o they_o indeed_o the_o first_o opinion_n say_v only_o that_o they_o shall_v be_v oblige_v in_o matter_n do_v out_o of_o that_o country_n but_o hussey_n and_o cook_n take_v no_o notice_n of_o this_o distinction_n but_o give_v their_o opinion_n somewhat_o more_o general_a cook_n infer_v that_o if_o ireland_n be_v special_o name_v our_o statute_n do_v bind_v they_o which_o still_o be_v not_o contrary_a to_o the_o case_n which_o he_o cite_v for_o that_o entire_o agree_v with_o he_o except_v only_o in_o this_o difference_n he_o infer_v that_o ireland_n be_v bind_v that_o assert_n that_o the_o people_n of_o ireland_n as_o subject_n of_o the_o king_n be_v bind_v the_o case_n stand_v state_v alike_o to_o both_o it_o be_v if_o they_o be_v name_v in_o a_o english_a statute_n if_o this_o distinction_n will_v do_v mr._n molyneux_n any_o good_a let_v he_o enjoy_v it_o for_o i_o it_o suffice_v if_o i_o have_v show_v that_o the_o lord_n chief_a justice_n cook_n be_v assertion_n be_v not_o direct_o contrary_a to_o the_o whole_a tenor_n of_o the_o case_n which_o he_o have_v cite_v he_o note_n that_o the_o english_a statute_n do_v bind_v ireland_n unless_o they_o be_v special_o name_v this_o case_n show_v that_o because_o ireland_n be_v name_v in_o it_o those_o judge_n be_v of_o the_o opinion_n that_o the_o people_n of_o but_o a_o great_a deal_n in_o that_o of_o mr._n molyneux_n where_o he_o say_v it_o be_v the_o vnanimous_a opinion_n of_o all_o the_o judge_n then_o in_o the_o exchequer_n chamber_n 120._o that_o within_o the_o land_n of_o ireland_n the_o parliament_n of_o england_n have_v no_o jurisdiction_n whatever_o they_o may_v have_v over_o the_o subject_n of_o ireland_n on_o the_o open_a sea_n i_o appeal_v to_o the_o word_n of_o the_o opinion_n whether_o it_o deny_v that_o the_o parliament_n of_o england_n have_v any_o manner_n of_o jurisdiction_n within_o the_o land_n of_o ireland_n there_o be_v nothing_o in_o it_o so_o positive_a if_o it_o say_v that_o ireland_n have_v a_o parliament_n within_o itself_o it_o note_n also_o that_o it_o be_v only_o for_o order_v of_o matter_n fit_a to_o be_v transact_v among_o themselves_o if_o it_o say_v that_o the_o statute_n in_o england_n dont_fw-fr bind_v they_o because_o they_o have_v no_o representative_n there_o it_o may_v well_o be_v understand_v of_o such_o statute_n that_o be_v direct_v for_o the_o particular_a occasion_n of_o england_n wherein_o ireland_n be_v not_o name_v it_o do_v not_o in_o the_o least_o offer_n at_o the_o deny_v the_o jurisdiction_n of_o the_o parliament_n of_o england_n in_o name_v ireland_n for_o it_o direct_o conclude_v they_o to_o be_v subject_n of_o the_o king_n which_o can_v be_v mean_v in_o any_o separate_a sense_n from_o the_o kingdom_n because_o it_o say_v they_o shall_v be_v under_o the_o obedience_n of_o the_o admiral_n of_o england_n and_o the_o king_n have_v no_o admiralty_n or_o navy_n distinct_a from_o the_o kingdom_n nay_o their_o quote_v the_o lie_v of_o a_o writ_n of_o error_n in_o the_o court_n of_o ireland_n after_o they_o have_v own_a they_o to_o have_v such_o court_n as_o well_o as_o a_o parliament_n in_o the_o very_a same_o manner_n as_o those_o in_o england_n from_o the_o king's-bench_n in_o england_n can_v be_v he_o here_o to_o no_o other_o purpose_n than_o to_o show_v that_o england_n have_v jurisdiction_n over_o ireland_n in_o some_o matter_n and_o certain_o where_o england_n have_v any_o authority_n at_o all_o it_o can_v be_v sever_v from_o the_o supreme_a legislature_n but_o since_o he_o lay_v so_o much_o stress_n upon_o the_o word_n ad_fw-la aliquam_fw-la rem_fw-la extra_fw-la terram_fw-la illam_fw-la faciend_n though_o it_o be_v to_o be_v note_v by_o the_o way_n that_o this_o deliberation_n be_v upon_o a_o statute_n respect_v only_a matter_n to_o be_v do_v out_o of_o the_o kingdom_n yet_o i_o will_v do_v he_o all_o the_o reason_n these_o assemble_v in_o common_a council_n and_o there_o enact_v law_n for_o the_o good_a government_n of_o the_o citizen_n which_o the_o grand_a parliament_n rare_o if_o ever_o control_n and_o that_o no_o grant_v ever_o do_v or_o can_v make_v ireland_n a_o absolute_a distinct_a separate_a kingdom_n and_o whole_o independent_a of_o england_n or_o invest_v it_o with_o such_o a_o supreme_a popular_a argument_n and_o be_v artful_o write_v and_o he_o that_o can_v take_v the_o latitude_n of_o advance_v his_o own_o imagination_n and_o mistake_a conjecture_n with_o the_o confidence_n of_o reality_n and_o certainty_n suggest_v falsity_n with_o the_o utmost_a assurance_n and_o omit_v material_a truth_n may_v impose_v much_o upon_o a_o unwary_a reader_n especial_o if_o be_v think_v what_o
