a_o vindication_n of_o the_o government_n in_o scotland_n during_o the_o reign_v of_o king_n charles_n ii_o against_o misrepresentation_n make_v in_o several_a scandalous_a pamphlet_n to_o which_o be_v add_v the_o method_n of_o proceed_v against_o criminal_n as_o also_o some_o of_o the_o fanatical_a covenant_n as_o they_o be_v print_v and_o publish_v by_o themselves_o in_o that_o reign_n by_o sir_n george_n mackenzie_n late_a lord_n advocate_n there_o london_n print_v for_o i._n hindmarsh_n at_o the_o golden_a ball_n in_o cornhill_n 1691._o a_o vindication_n of_o the_o government_n in_o scotland_n during_o the_o reign_n of_o king_n charles_n ii_o against_o misrepresentation_n make_v in_o several_a scandalous_a pamphlet_n the_o design_n of_o this_o paper_n be_v neither_o to_o seduce_v other_o into_o faction_n nor_o to_o make_v a_o apology_n the_o one_o be_v too_o malicious_a and_o the_o other_o too_o mean_a but_o because_o many_o honest_a and_o sincere_a man_n have_v be_v abuse_v by_o some_o late_a misinformation_n whereby_o the_o charity_n and_o unity_n of_o protestant_n among_o themselves_o be_v much_o weaken_v therefore_o this_o paper_n come_v to_o set_v thing_n in_o their_o true_a light_n by_o a_o bare_a narrative_n which_o will_v be_v sufficient_a to_o reclaim_v those_o who_o be_v abuse_v and_o to_o confute_v those_o malicious_a author_n who_o have_v endeavour_v to_o reproach_n a_o whole_a nation_n with_o villainy_n of_o which_o none_o but_o these_o author_n themselves_o can_v have_v be_v guilty_a because_o the_o civil_a government_n in_o scotland_n be_v never_o bigot_n in_o that_o king_n reign_n therefore_o we_o shall_v not_o run_v back_o to_o consider_v episcopacy_n or_o presbytery_n otherways_o than_o as_o they_o may_v concern_v the_o civil_a government_n neither_o shall_v we_o run_v so_o far_o back_o as_o to_o the_o government_n of_o king_n charles_n i._o be_v it_o not_o to_o prove_v that_o these_o of_o the_o same_o persuasion_n who_o now_o complain_v be_v the_o first_o aggressor_n and_o consequent_o what_o be_v do_v against_o they_o deserve_v rather_o the_o name_n of_o self-defence_n than_o persecution_n for_o clear_v this_o it_o be_v necessary_a to_o represent_v that_o in_o the_o year_n 1637_o we_o live_v under_o the_o most_o pious_a and_o orthodox_n prince_n of_o the_o age_n and_o yet_o a_o rebellion_n be_v form_v against_o he_o as_o a_o papist_n and_o a_o tyrant_n by_o which_o all_o the_o fundamental_a law_n be_v shake_v and_o all_o honest_a man_n ruin_v neither_o need_v there_o any_o other_o proof_n for_o this_o assertion_n than_o the_o record_n of_o parliament_n general_n assembly_n and_o justice_n court_n from_o the_o record_n and_o act_n of_o parliament_n it_o be_v undeniable_a that_o the_o power_n of_o nominate_a judge_n counsellor_n and_o all_o officer_n of_o state_n the_o power_n of_o levy_v war_n and_o raise_v tax_n be_v usurp_v by_o the_o people_n covenant_n be_v enter_v into_o by_o a_o part_n of_o the_o subject_n and_o by_o they_o impose_v imperious_o upon_o the_o rest_n league_n and_o covenant_n be_v enter_v into_o with_o england_n ambassador_n be_v send_v to_o foreign_a prince_n and_o state_n and_o even_o to_o france_n though_o little_o less_o terrible_a then_o than_o now_o exclaim_v against_o the_o injustice_n of_o the_o king_n justify_v their_o take_a arm_n against_o he_o and_o therefore_o entreat_v the_o french_a aid_n and_o assistance_n the_o king_n himself_o be_v inhumane_o deliver_v up_o to_o his_o enemy_n and_o thereafter_o the_o army_n that_o go_v in_o to_o defend_v his_o precious_a life_n be_v declare_v rebel_n all_o which_o be_v uncontraverted_o inconsistent_a with_o the_o law_n of_o the_o kingdom_n then_o stand_v from_o the_o act_n of_o the_o general_n assembly_n it_o be_v clear_a that_o the_o assembly_n 1639._o refuse_v to_o rise_v when_o dissolve_v by_o the_o king_n commissioner_n and_o most_o of_o the_o follow_a assembly_n do_v both_o sit_v down_o and_o rise_v without_o his_o warrant_n this_o assembly_n throw_v out_o the_o bishop_n and_o abrogate_a episcopacy_n without_o authority_n of_o parliament_n though_o the_o bishop_n be_v always_o the_o first_o of_o the_o three_o estate_n of_o parliament_n a_o new_a oath_n be_v invent_v call_v the_o covenant_n without_o the_o king_n authority_n and_o all_o man_n woman_n and_o child_n that_o be_v above_o ten_o year_n of_o age_n force_v to_o take_v it_o and_o such_o as_o take_v it_o not_o be_v excommunicate_v upon_o which_o all_o their_o movable_n or_o chattel_n be_v confiscate_v and_o they_o themselves_o be_v declare_v disobedient_a to_o the_o law_n be_v force_v to_o fly_v the_o king_n be_v negative_a voice_n be_v declare_v illegal_a and_o the_o act_n make_v for_o assist_v he_o in_o the_o year_n forty_o eight_o be_v declare_v void_a and_o null_a by_o a_o unparalleled_a invasion_n the_o general_n assembly_n imitate_v in_o this_o as_o in_o many_o other_o thing_n the_o church_n of_o rome_n raise_v themselves_o above_o king_n and_o parliament_n from_o the_o record_n of_o the_o justice_n court_n we_o find_v that_o the_o estate_n make_v advocate_n or_o attorney_n general_n by_o their_o own_o authority_n who_o prosecute_v to_o death_n such_o as_o defend_v their_o own_o house_n by_o virtue_n of_o express_a commission_n from_o the_o king_n and_o such_o as_o rise_v in_o arm_n for_o his_o defence_n though_o they_o have_v both_o his_o commission_n and_o remission_n though_o the_o judes_n that_n condemn_v they_o sit_v by_o virtue_n of_o that_o very_a king_n commission_n they_o not_o only_o borrow_v vast_a sum_n by_o mere_a force_n from_o private_a man_n who_o they_o never_o pay_v but_o also_o they_o be_v the_o first_o that_o bring_v in_o free_a and_o dry_a quarter_n cess_n excise_n and_o all_o these_o public_a burden_n afterward_o so_o much_o complain_v of_o when_o they_o be_v continue_v upon_o necessary_a exigency_n by_o lawful_a authority_n we_o have_v neither_o former_o know_v oath_n nor_o public_a burden_n under_o our_o gentle_a king_n against_o who_o they_o so_o much_o exclaim_v as_o tyrant_n because_o forsooth_o they_o keep_v they_o from_o be_v such_o all_o these_o proceed_n be_v not_o only_o condemn_v by_o the_o general_a opinion_n of_o both_o protestant_n and_o papist_n abroad_o but_o stand_v yet_o condemn_v by_o express_a act_n of_o parliament_n and_o by_o many_o act_n in_o the_o like_a case_n in_o scotland_n and_o england_n and_o so_o nothing_o which_o can_v be_v allege_v in_o justification_n of_o they_o deserve_v or_o need_v a_o answer_n king_n charles_n the_o second_o be_v restore_v by_o almost_o the_o universal_a consent_n of_o all_o the_o people_n the_o worst_a of_o who_o grow_v weary_a of_o their_o villainy_n the_o parliament_n of_o scotland_n be_v call_v they_o inquire_v very_o serious_o into_o the_o occasion_n of_o such_o disorder_n and_o soon_o find_v that_o they_o be_v all_o to_o be_v charge_v upon_o the_o solemn_a league_n and_o covenant_n and_o those_o who_o adhere_v thereto_o and_o therefore_o they_o endeavour_v to_o persuade_v the_o presbyterian_o to_o disow_v the_o covenant_n all_o favour_n be_v promise_v to_o they_o upon_o that_o condition_n but_o find_v that_o the_o presbyterian_o general_o think_v themselves_o bind_v to_o own_o the_o covenant_n the_o parliament_n conclude_v that_o the_o same_o man_n own_v the_o same_o principle_n will_v be_v ready_a upon_o occasion_n to_o act_v over_o again_o the_o same_o thing_n therefore_o they_o by_o vote_n which_o may_v be_v call_v unanimous_a see_v only_o four_o or_o five_o dissent_v restore_v episcopacy_n and_o that_o so_o much_o the_o rather_o because_o that_o government_n have_v in_o no_o age_n nor_o place_n force_v its_o way_n into_o the_o state_n by_o the_o sword_n but_o have_v still_o be_v bring_v in_o by_o the_o uncontraverted_a magistrate_n without_o ever_o thrust_v itself_o in_o by_o violence_n and_o yet_o the_o government_n do_v sustain_v episcopacy_n as_o a_o part_n of_o the_o state_n but_o never_o as_o a_o hierarchy_n whole_o independent_a from_o it_o the_o presbyterian_a preacher_n have_v all_o along_o teach_v the_o people_n that_o as_o their_o government_n be_v jure_fw-la divino_fw-la so_o the_o people_n may_v thereby_o be_v oblige_v to_o defend_v they_o and_o it_o under_o pain_n of_o eternal_a damnation_n even_o when_o episcopacy_n be_v establish_v by_o law_n and_o according_o some_o of_o the_o people_n who_o retain_v that_o principle_n frequent_v the_o conventicle_n at_o which_o these_o minister_n preach_v whereupon_o the_o state_n fear_v that_o the_o old_a humour_n may_v ferment_n again_o into_o a_o rebellion_n discharge_v under_o some_o small_a penalty_n any_o above_o five_o stranger_n to_o meet_v in_o a_o conventicle_n leave_v thereby_o at_o once_o the_o free_a exercise_n of_o their_o conscience_n in_o their_o family_n and_o yet_o secure_v the_o state_n against_o such_o a_o total_a defection_n as_o may_v involve_v we_o in_o a_o new_a civil-war_n which_o without_o doubt_n be_v all_o the_o state_n design_v
but_o to_o elude_v these_o penalty_n for_o house-conventicle_n some_o preacher_n among_o who_o be_v some_o of_o those_o who_o have_v be_v former_o banish_v gather_v the_o people_n together_o in_o the_o field_n they_o bring_v arm_n with_o they_o to_o secure_v their_o minister_n come_v at_o last_o to_o have_v such_o a_o opinion_n of_o their_o own_o strength_n that_o they_o form_v themselves_o into_o a_o army_n and_o be_v defeat_v at_o pentland_n hill_n novemb_n anno_fw-la 1666._o yet_o within_o a_o short_a time_n of_o that_o the_o state_n indulge_v they_o so_o far_o as_o to_o allow_v they_o their_o own_o minister_n settle_v they_o in_o church_n and_o allow_v they_o the_o enjoyment_n of_o the_o benefice_n in_o many_o place_n this_o do_v not_o satisfy_v these_o people_n because_o the_o minister_n so_o indulge_v acknowledge_v the_o king_n and_o council_n authority_n and_o they_o with_o some_o of_o their_o violent_a preacher_n rail_v as_o much_o against_o these_o indulge_v minister_n as_o against_o the_o bishop_n and_o regular_a clergy_n and_o call_v they_o council_n curate_n and_o separate_v from_o they_o the_o state_n consider_v that_o by_o the_o law_n of_o all_o nation_n rise_v in_o arm_n be_v to_o be_v account_v rebellion_n and_o that_o a_o preacher_n presence_n can_v legitimate_a the_o action_n no_o more_o than_o a_o priest_n can_v transubstantiate_v the_o element_n they_o declare_v by_o several_a act_n field-meeting_n to_o be_v the_o rendevouze_n of_o rebellion_n notwithstanding_o all_o which_o these_o dissenter_n proceed_v as_o from_o house_n to_o field-meeting_n so_o from_o field-conventicle_n to_o publish_v proclamation_n declare_v that_o the_o covenant_n be_v the_o original_a contract_n betwixt_o god_n the_o king_n and_o the_o people_n and_o therefore_o king_n charles_n the_o second_o have_v break_v it_o end_n forfault_v his_o crown_n and_o be_v to_o be_v consider_v only_o as_o a_o private_a subject_n and_o enemy_n to_o god_n they_o have_v declare_v a_o just_a war_n against_o he_o and_o that_o it_o be_v lawful_a to_o kill_v he_o and_o all_o who_o serve_v he_o follow_v as_o be_v pretend_v the_o noble_a example_n of_o phineas_n and_o eliud_fw-la and_o in_o consequence_n of_o this_o doctrine_n they_o murder_v the_o archbishop_n of_o st._n andrews_n and_o several_a other_o to_o defend_v these_o murderer_n a_o army_n be_v gather_v by_o they_o which_o be_v beat_v a_o bothuel-bridge_n anno_fw-la 1679._o but_o yet_o the_o king_n to_o reclaim_v they_o grant_v both_o a_o indemnity_n and_o indulgence_n notwithstanding_o of_o which_o a_o new_a plot_n be_v enter_v into_o and_o it_o be_v contrive_v in_o a_o meeting_n of_o the_o scot_n at_o london_n that_o 20000_o man_n shall_v be_v raise_v in_o scotland_n and_o that_o the_o garrison_n of_o berwick_n and_o carlisle_n and_o all_o the_o officer_n of_o state_n shall_v be_v seize_v which_o be_v likewise_o second_v by_o monmouth_n and_o argyle_n rebellion_n anno_fw-la 1685._o whereupon_o the_o parliament_n find_v that_o the_o preach_v up_o of_o rebellion_n in_o private_a conventicle_n have_v occasion_v all_o this_o danger_n to_o king_n and_o people_n and_o that_o nothing_o can_v be_v secure_a whilst_o every_o thing_n may_v be_v preach_v they_o enact_v that_o the_o minister_n who_o preach_v at_o conventicle_n shall_v be_v capital_o punish_v but_o by_o virtue_n of_o this_o act_n no_o man_n be_v ever_o punish_v much_o less_o execute_v this_o be_v the_o true_a progress_n and_o these_o the_o occasion_n of_o make_v those_o act_n it_o be_v admire_v why_o the_o government_n be_v tax_v with_o so_o much_o cruelty_n and_o the_o act_n themselves_o reproach_v as_o diabolical_a for_o first_o these_o against_o house-conventicle_n be_v the_o same_o with_o the_o law_n in_o england_n and_o less_o severe_a than_o those_o make_v against_o dissenter_n in_o queen_n elizabeth_n time_n or_o than_o those_o now_o stand_v against_o the_o calvinist_n in_o sweden_n or_o those_o make_v and_o now_o execute_v by_o the_o presbyterian_o and_o independent_o in_o new-england_n but_o much_o more_o gentle_a than_o those_o our_o presbyterian_o make_v when_o they_o govern_v 2._o whatever_o may_v be_v say_v against_o such_o act_n in_o country_n where_o dissenter_n never_o enter_v into_o a_o war_n yet_o in_o this_o isle_n where_o they_o upon_o the_o same_o principle_n overturn_v the_o government_n and_o law_n and_o be_v upon_o every_o occasion_n again_o attempt_v it_o so_o small_a a_o caution_n can_v be_v account_v severe_a 3._o this_o caution_n be_v much_o more_o just_a in_o scotland_n than_o even_o in_o england_n because_o the_o dissenter_n in_o scotland_n be_v more_o bigoted_a to_o the_o covenant_n which_o be_v a_o constant_a fond_a for_o rebellion_n 4._o the_o posteriour_a act_n make_v against_o field-conventicle_n be_v the_o necessary_a product_n of_o new_a accessional_a degree_n of_o rebellion_n and_o be_v not_o punishment_n design_v against_o opinion_n in_o religion_n but_o mere_o against_o treasonable_a combination_n which_o exceed_v what_o be_v attempt_v in_o england_n or_o elsewhere_o and_o the_o governor_n for_o the_o time_n can_v true_o and_o bold_o say_v that_o no_o man_n in_o scotland_n ever_o suffer_v for_o his_o religion_n but_o if_o any_o will_v pretend_v that_o religion_n oblige_v he_o to_o rise_v in_o arm_n or_o to_o murder_n this_o principle_n ought_v neither_o to_o be_v sustain_v as_o a_o defence_n nor_o the_o obviate_a of_o it_o to_o be_v make_v a_o crime_n and_o as_o the_o covenanter_n laugh_v at_o such_o a_o defence_n when_o propose_v for_o they_o who_o assisted_z king_n charles_n i._n mere_o for_o conscience_n sake_n so_o they_o can_v deny_v but_o they_o zealous_o press_v sir_n john_n dalrymple_n than_o they_o get_v a_o indulgence_n from_o king_n james_n against_o the_o accept_n whereof_o renwick_n and_o his_o party_n exclaim_v high_o and_o that_o so_o much_o the_o more_o plausible_o for_o that_o many_o of_o they_o who_o now_o accept_v a_o indulgence_n from_o a_o king_n profess_o popish_a have_v reject_v and_o preach_v against_o those_o who_o accept_v of_o one_o when_o offer_v by_o a_o king_n of_o the_o protestant_a profession_n i_o must_v also_o ask_v they_o if_o any_o shall_v now_o rise_v in_o arm_n in_o defence_n of_o episcopacy_n and_o allege_v conscience_n for_o so_o do_v will_v they_o sustain_v that_o as_o a_o just_a defence_n 5._o when_o ever_o any_o man_n offer_v to_o keep_v the_o church_n former_a fines_n be_v general_o remit_v if_o timeous_a application_n be_v make_v and_o more_o indulgency_n and_o indemnity_n be_v grant_v by_o this_o king_n than_o by_o any_o that_o ever_o reign_v and_o general_o no_o man_n be_v execute_v in_o his_o reign_n who_o will_v say_v
