that_o it_o shall_v continue_v to_o the_o end_n of_o the_o first_o session_n of_o the_o next_o parliament_n in_o such_o force_n and_o effect_n as_o it_o be_v the_o first_o year_n of_o charles_n the_o first_o when_o indeed_o it_o be_v then_o in_o no_o force_n at_o all_o 6._o in_o the_o 16_o caroli_n secundi_fw-la cap._n 4._o a_o act_n be_v make_v entitle_v a_o act_n to_o prevent_v and_o suppress_v seditious_a conventicle_n which_o begin_v thus_o whereas_o a_o act_n make_v in_o the_o 35th_o year_n of_o the_o reign_n of_o our_o late_a sovereign_a lady_n queen_n eliz._n entitle_v a_o act_n to_o divine_a service_n establish_v by_o the_o law_n of_o this_o kingdom_n and_o carry_v he_o or_o herself_o reverent_o decent_o and_o orderly_o there_o to_o teach_v any_o public_a or_o private_a school_n or_o take_v any_o boarder_n or_o tabler_n that_o be_v teach_v or_o instruct_v by_o he_o or_o herself_o or_o any_o other_o upon_o pain_n for_o every_o such_o offence_n to_o forfeit_v the_o sum_n of_o forty_o pound_n to_o be_v recover_v and_o distribute_v as_o aforesaid_a v._o provide_v also_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o respective_a county_n upon_o oath_n to_o they_o of_o any_o offence_n against_o this_o act_n which_o oath_n they_o be_v hereby_o impower_v to_o administer_v to_o commit_v the_o offender_n for_o six_o month_n without_o bail_n or_o mainprize_n unless_o upon_o or_o before_o such_o commitment_n he_o shall_v before_o the_o say_a justice_n of_o such_o person_n so_o wilful_o neglect_v shall_v not_o have_v any_o habeas_fw-la corpus_fw-la to_o be_v grant_v in_o vacation_n time_n in_o pursuance_n of_o this_o act._n v._o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o officer_n or_o officer_n his_o or_o their_o under-officer_n under-officer_n underkeeper_n or_o under-keeper_n or_o deputy_n shall_v neglect_v or_o refuse_v to_o make_v the_o return_v aforesaid_a or_o to_o bring_v the_o body_n or_o body_n of_o the_o prisoner_n or_o prisoner_n according_a to_o the_o command_n of_o the_o say_v write_v within_o the_o respective_a time_n aforesaid_a or_o upon_o demand_n make_v by_o the_o prisoner_n or_o person_n in_o his_o behalf_n shall_v resuse_v to_o deliver_v or_o within_o the_o space_n of_o six_o hour_n after_o demand_n shall_v not_o deliver_v to_o the_o person_n so_o demand_v a_o true_a copy_n of_o the_o warrant_n or_o warrant_n of_o commitment_n and_o detainer_n of_o such_o prisoner_n which_o he_o or_o they_o be_v hereby_o require_v to_o deliver_v according_o all_z and_o every_o the_o head_n gaoler_n and_o keeper_n of_o such_o prison_n and_o such_o other_o person_n in_o suit_n bill_n plaint_n or_o information_n in_o any_o of_o the_o king_n court_n at_o westmin_n wherein_o no_o essoign_n protection_n privilege_n injunction_n wager_n of_o law_n or_o stay_v of_o prosecution_n by_o non_fw-la vult_fw-la ulterius_fw-la prosequi_fw-la or_o otherwise_o shall_v be_v admit_v or_o allow_v or_o any_o more_o than_o one_o imparlance_n 4._o and_o any_o recovery_n or_o shall_v be_v advise_v aid_v or_o assist_v in_o the_o same_o or_o any_o of_o they_o 5._o and_o the_o plaintiff_n in_o every_o such_o action_n shall_v have_v judgement_n to_o recover_v his_o treble_n cost_v beside_o damage_n which_o damage_n so_o to_o be_v give_v shall_v not_o be_v less_o than_o five_o hundred_o pound_n 6._o in_o which_o action_n no_o delay_n stay_v or_o stop_v of_o proceed_v by_o of_o berwick_n upon_o tweed_n or_o any_o of_o the_o island_n territory_n or_o dominion_n thereunto_o belong_v 8._o and_o shall_v incur_v and_o sustain_v the_o pain_n penalty_n and_o forfeiture_n limit_v ordain_v and_o provide_v in_o and_o by_o the_o statute_n of_o provision_n and_o praemunire_n make_v in_o the_o sixteen_o year_n of_o king_n richard_n the_o second_o 9_o and_o be_v incapaple_n of_o any_o pardon_n from_o the_o king_n his_o heir_n or_o successor_n of_o the_o say_a forfeiture_n loss_n or_o disability_n or_o any_o of_o they_o 13._o provide_v always_o that_o nothing_o in_o this_o act_n extend_v to_o give_v benefit_n to_o any_o person_n who_o shall_v by_o contract_n in_o write_v agree_v with_o any_o merchant_n or_o owner_n of_o any_o plantation_n or_o other_o person_n whatsoever_o to_o be_v transport_v to_o any_o part_n beyond_o the_o sea_n and_o receive_v earnest_a upon_o such_o agreement_n although_o that_o afterward_o such_o person_n shall_v renounce_v such_o contract_n 14._o provide_v always_o and_o be_v it_o enact_v that_o if_o any_o person_n or_o person_n lawful_o convict_v of_o any_o felony_n shall_v in_o open_a court_n pray_v to_o be_v transport_v beyond_o the_o sea_n and_o the_o court_n shall_v think_v fit_a to_o leave_v he_o or_o they_o in_o prison_n for_o that_o purpose_n such_o person_n or_o person_n may_v be_v transport_v into_o any_o part_n beyond_o the_o sea_n this_o act_n or_o any_o thing_n therein_o contain_v to_o the_o contrary_a notwithstanding_o 15._o provide_v also_o and_o be_v it_o enact_v that_o nothing_o herein_o contain_v shall_v be_v deem_v construe_v or_o take_v to_o extend_v to_o the_o imprisonment_n of_o any_o person_n before_o to_o first_o day_n of_o june_n one_o thousand_o six_o hundred_o seventy_o and_o nine_o or_o to_o any_o thing_n advise_v procure_v or_o otherwise_o do_v relate_v to_o such_o imprisonment_n any_o thing_n herein_o contain_v to_o the_o contrary_a notwithstanding_o 16._o provide_v also_o that_o if_o any_o person_n or_o person_n at_o any_o time_n resiant_a in_o this_o realm_n shall_v have_v commit_v any_o capital_a offence_n in_o scotl._n or_o ireland_n or_o any_o of_o the_o island_n or_o foreign_a plantation_n of_o the_o king_n his_o heir_n or_o successor_n where_o he_o or_o she_o aught_o to_o be_v try_v for_o such_o offence_n such_o person_n or_o person_n may_v contain_v to_o the_o contrary_a notwithstanding_o 17._o provide_v always_o and_o be_v it_o enact_v that_o no_o person_n or_o person_n shall_v be_v sue_v implead_v molest_v or_o trouble_v for_o any_o offence_n against_o this_o act_n unless_o the_o party_n offend_v be_v sue_v or_o implead_v for_o the_o same_o within_o two_o year_n at_o the_o most_o after_o such_o time_n wherein_o the_o offence_n shall_v be_v commit_v in_o case_n the_o party_n grieve_v shall_v not_o be_v then_o in_o prison_n and_o if_o he_o shall_v be_v in_o prison_n then_o within_o the_o space_n of_o two_o year_n after_o the_o decease_n of_o the_o person_n imprison_v or_o he_o or_o her_o delivery_n out_o of_o prison_n which_o shall_v first_o happen_v 18._o and_o to_o the_o intent_n no_o person_n may_v avoid_v his_o trial_n at_o the_o assize_n or_o general_a gaol_n delivery_n by_o procure_v his_o removal_n before_o the_o assize_n at_o such_o time_n as_o he_o can_v be_v bring_v back_o to_o receive_v his_o trial_n there_o 2._o be_v it_o enact_v that_o after_o the_o assize_n proclaim_v for_o thatcounty_n where_o the_o prisoner_n be_v detain_v no_o person_n shall_v be_v remove_v from_o the_o common_a gaol_n upon_o any_o habeas_fw-la corpus_fw-la grant_v in_o pursuance_n of_o this_o act_n but_o upon_o any_o such_o habeas_fw-la corpus_fw-la shall_v be_v bring_v before_o the_o judge_n os_fw-la assize_n in_o open_a court_n who_o be_v thereupon_o to_o do_v what_o to_o justice_n shall_v appertain_v 19_o provide_v nevertheless_o that_o after_o the_o assize_n be_v end_v any_o person_n or_o person_n detain_v may_v have_v his_o or_o her_o habeas_fw-la corpus_fw-la according_a to_o the_o direction_n and_o intention_n of_o this_o act._n 20._o and_o be_v it_o also_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o information_n suit_n or_o action_n shall_v be_v bring_v or_o exhibit_v against_o any_o person_n or_o person_n for_o anyoffence_n commit_v or_o to_o be_v commit_v against_o the_o form_n of_o this_o law_n it_o shall_v be_v lawful_a for_o such_o defendant_n to_o plead_v the_o general_n issue_n that_o they_o be_v not_o guilty_a or_o that_o they_o own_v nothing_o and_o to_o give_v such_o special_a matter_n in_o evidence_n to_o the_o jury_n that_o shall_v try_v the_o same_o which_o matter_n be_v plead_v have_v be_v good_a &_o sufficient_a in_o law_n to_o have_v discharge_v the_o say_a defendant_n or_o defendant_n against_o the_o say_a information_n suit_n or_o action_n &_o the_o say_a matter_n shall_v be_v then_o as_o available_a to_o he_o or_o they_o to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o they_o have_v sufficient_o plead_v set_v forth_o or_o allege_v the_o same_o matter_n in_o bar_n or_o discharge_v of_o such_o information_n suit_n or_o action_n 21._o and_o because_o many_o time_n person_n charge_v with_o petty_a treason_n or_o felony_n or_o as_o accessary_n thereunto_o be_v commit_v upon_o suspicion_n only_o whereupon_o they_o be_v bailable_a or_o not_o according_a as_o the_o circumstance_n make_v out_o that_o suspicion_n be_v more_o or_o less_o weighty_a which_o be_v best_a know_v to_o the_o justice_n of_o peace_n that_o commit_v the_o person_n and_o have_v the_o examination_n before_o they_o or_o to_o other_o justice_n of_o the_o peace_n in_o the_o county_n 2._o be_v it_o therefore_o enact_v that_o where_o any_o person_n shall_v appear_v to_o be_v commit_v by_o any_o judge_n or_o justice_n of_o the_o peace_n and_o charge_v as_o accessary_a before_o the_o fact_n to_o any_o petty_a treason_n or_o felony_n or_o upon_o suspicion_n thereof_o or_o with_o suspicion_n of_o petty_a treason_n or_o felony_n which_o pettytreason_n or_o felony_n shall_v be_v plain_o &_o special_o express_v in_o the_o warrant_n of_o commitment_n that_o such_o person_n shall_v not_o be_v remove_v or_o bail_v by_o virtue_n of_o this_o act_n or_o in_o any_o other_o manner_n than_o they_o may_v have_v be_v before_o the_o make_n of_o this_o act._n the_o comment_n there_o be_v three_o thing_n which_o the_o law_n of_o england_n which_o be_v a_o law_n of_o mercy_n principal_o regard_v and_o take_v care_n of_o viz._n life_n liberty_n and_o estate_n next_o to_o a_o man_n life_n the_o near_a thing_n that_o concern_v he_o be_v freedom_n of_o his_o person_n for_o indeed_o what_o be_v imprisonment_n but_o a_o kind_n of_o civil_a death_n therefore_o say_v fortescue_n cap._n 42._o angliae_fw-la jura_n in_fw-la omni_fw-la casu_fw-la libercati_fw-la daunt_v favorem_fw-la the_o law_n of_o england_n do_v in_o all_o case_n favour_v liberty_n touch_v commitment_n and_o what_o be_v require_v to_o make_v a_o legal_a mittimus_fw-la see_v before_o pag._n 27._o the_o writ_n of_o habeas_fw-la corpus_fw-la be_v a_o remedy_n give_v by_o the_o common_a law_n for_o such_o as_o be_v unjust_o detain_v
in_o custody_n to_o procure_v their_o liberty_n but_o before_o this_o statute_n be_v render_v far_o less_o useful_a than_o it_o ought_v to_o be_v partly_o by_o the_o judge_n pretend_v a_o power_n to_o grant_v or_o deny_v the_o say_v write_v at_o their_o pleasure_n in_o many_o case_n and_o especial_o by_o the_o ill_a practice_n of_o sheriff_n and_o gaoler_n by_o put_v the_o prisoner_n to_o the_o charge_n and_o trouble_v of_o a_o alias_o and_o plury_n that_o be_v a_o second_o and_o three_o writ_n before_o they_o will_v obey_v the_o first_o for_o there_o be_v no_o penalty_n till_o the_o three_o and_o then_o at_o last_o the_o judge_n will_v ofttimes_o allege_v that_o they_o can_v not_o take_v bail_n because_o the_o party_n be_v a_o prisoner_n of_o state_n etc._n etc._n therefore_o to_o remedy_n all_o those_o mischief_n this_o most_o wholesome_a law_n be_v provide_v which_o we_o shall_v brief_o endeavour_v to_o divide_v into_o its_o several_a branch_n and_o explain_v it_o to_o the_o mean_a capacity_n since_o no_o man_n be_v sure_a but_o one_o time_n or_o other_o he_o may_v have_v occasion_n to_o make_v use_n of_o it_o this_o act_n concern_v either_o first_o person_n commit_v for_o some_o other_o criminal_a or_o supposedcriminal_a matter_n beside_o treason_n or_o felony_n and_o these_o be_v to_o have_v a_o habeas_fw-la corpus_fw-la immediate_o 2_o such_o who_o in_o their_o mittimus_fw-la be_v charge_v with_o treason_n or_o felony_n &_o these_o shall_v have_v the_o benefit_n of_o the_o say_v write_v after_o the_o time_n herein_o limit_v one_a if_o any_o gaoler_n or_o underkeeper_n shall_v not_o deliver_v a_o truecopy_n of_o the_o mittimus_fw-la within_o 6_o hour_n after_o the_o prisoner_n demand_v it_o the_o head-gaoler_n or_o keeper_n forfeit_v to_o the_o prisoner_n for_o the_o first_o offence_n 100_o for_o the_o second_o offence_n 200l_n and_o lose_v his_o place_n nor_o be_v there_o any_o fee_n to_o be_v pay_v for_o the_o same_o the_o turn-key_n have_v be_v it_o seem_v some_o pretension_n and_o ill_a practice_n to_o hold_v they_o district_n that_o therein_o they_o may_v detain_v man_n prisoner_n against_o law_n and_o not_o admit_v any_o writ_n to_o enlarge_v they_o for_o remedy_n whereof_o it_o be_v thus_o enact_v anno_fw-la 13._o rich._n secundi_fw-la item_n it_o be_v ordain_v and_o assent_v that_o the_o king_n castle_n and_o gaol_n may_v be_v easy_o apprehend_v by_o the_o mean_a capacity_n and_o as_o the_o law_n provide_v thus_o for_o our_o liberty_n so_o it_o take_v care_n that_o those_o that_o be_v in_o custody_n shall_v not_o be_v abuse_v or_o oppress_v to_o which_o purpose_n i_o shall_v here_o insert_v so_o much_o as_o be_v material_a &_o necessary_a to_o be_v know_v by_o all_o person_n who_o be_v so_o unhappy_a as_o to_o be_v prisoner_n out_o of_o the_o statute_n of_o the_o 22d_o and_o 23d_o car._n 2._o cap._n 20._o the_o word_n whereof_o be_v as_o follow_v whereas_o person_n that_o be_v under_o arrest_n or_o commit_v but_o provide_v for_o their_o be_v discharge_v though_o convict_v upon_o their_o come_n to_o church_n and_o that_o it_o mean_n and_o intend_v none_o but_o jesuit_n and_o popish_a priest_n and_o other_o popish_a recusant_n appear_v manifest_o not_o only_o in_o the_o title_n but_o in_o the_o first_o section_n of_o the_o act_n itself_o and_o so_o throughout_o the_o title_n be_v a_o act_n for_o the_o due_a execution_n of_o the_o statute_n against_o jesuit_n seminary_n priest_n recusant_n the_o 2_o former_a word_n include_v the_o romish_a clergy_n the_o latter_a the_o laiety_n etc._n etc._n and_o begin_v thus_o for_o the_o better_a and_o more_o due_a execution_n of_o the_o statute_n heretofore_o make_v against_o who_o as_o well_v against_o jesuit_n seminary_n priest_n and_o other_o suchlike_a priest_n that_o be_v other_o popish_a priest_n though_o not_o breed_v up_o in_o the_o serminary_n as_o also_o against_o all_o manner_n of_o recusant_n that_o be_v papist_n though_o not_o in_o order_n be_v it_o enact_v etc._n etc._n that_o all_o &_o every_o the_o statute_n heretofore_o make_v against_o jesuit_n seminary_a priest_n and_o other_o priest_n deacon_n and_o religion_n and_o ecclesiastical_a person_n whatsoever_o make_v ordain_v or_o profess_v or_o to_o be_v make_v by_o any_o authority_n or_o jurisdiction_n derive_v challenge_v or_o pretend_v from_o the_o see_v of_o act_n all_o along_o be_v only_o to_o reinforce_v the_o rest_n of_o the_o act_n against_o popish_a recusant_n and_o for_o that_o as_o
