to_o any_o person_n or_o capable_a of_o any_o legacy_n or_o deéd_v of_o gift_n or_o to_o bear_v any_o office_n within_o the_o realm_n and_o shall_v lose_v and_o forfeit_v all_o his_o good_n and_o chattel_n and_o shall_v forfeit_v all_o his_o land_n tenement_n and_o hereditament_n rent_n annuity_n office_n and_o estate_n of_o fréehold_n for_o and_o during_o his_o natural_a life_n aforesaid_a of_o the_o two_o part_n of_o his_o land_n the_o question_n be_v whether_o after_o his_o death_n they_o may_v have_v be_v seize_v by_o force_n of_o this_o statute_n of_o 29._o for_o the_o arrear_n of_o the_o penalty_n incur_v in_o his_o life_n time_n for_o that_o the_o seizure_n here_o give_v be_v mere_o in_o nature_n of_o a_o nomine_fw-la poenae_fw-la or_o penalty_n inflict_v for_o his_o contempt_n in_o not_o pay_v the_o 20_o l_o per_fw-la month_n and_o shall_v not_o have_v go_v in_o satisfaction_n of_o the_o debt_n but_o the_o queen_n shall_v have_v hold_v the_o land_n till_o the_o 20_o l._n per_fw-la month_n be_v otherwise_o pay_v and_o satisfy_v and_o when_o this_o penalty_n of_o seizure_n be_v not_o execute_v in_o the_o recusants_n life_n time_n by_o his_o death_n the_o contempt_n be_v satisfy_n of_o the_o king_n of_o the_o arrear_n of_o the_o 20_o l._n per_fw-la month_n and_o the_o profit_n of_o the_o land_n shall_v go_v towards_o the_o payment_n and_o satisfaction_n thereof_o so_o the_o statute_n appoint_v he_o or_o his_o removal_n from_o thence_o contrary_a to_o the_o statute_n or_o his_o not_o present_v himself_o and_o deliver_v his_o true_a name_n as_o aforesaid_a either_o case_n the_o person_n so_o offend_v shall_v be_v adjudge_v a_o felon_n and_o shall_v suffer_v and_o lose_v as_o in_o case_n of_o felony_n without_o benefit_n of_o clergy_n and_o within_o such_o time_n etc._n etc._n and_o from_o thence_o depart_v depart_v when_o and_o whence_o the_o offender_n must_v depart_v the_o offender_n be_v strict_o tie_v to_o depart_v from_o the_o same_o haven_n assign_v he_o and_o within_o the_o time_n appoint_v he_o by_o the_o justice_n of_o peace_n or_o coroner_n so_o that_o if_o he_o depart_v the_o realm_n from_o any_o other_o haven_n or_o port_n or_o over_o stay_v his_o time_n and_o depart_v afterward_o yet_o he_o be_v a_o felon_n within_o this_o act._n or_o return_v or_o come_v again_o into_o any_o her_o majesty_n realm_n or_o dominion_n a_o offender_n within_o this_o act_n abjure_v in_o form_n aforesaid_a and_o depart_v this_o realm_n and_o afterward_o go_v into_o ireland_n without_o licence_n return_v return_v and_o then_o return_v into_o the_o first_o year_n of_o the_o reign_n of_o our_o late_a sovereign_a lady_n queen_n elizabeth_n before_o the_o archbishop_n or_o bishop_n of_o the_o diocese_n that_o in_o every_o such_o case_n upon_o his_o conformity_n of_o all_o and_o singular_a the_o penalty_n tail_n judgement_n against_o tenant_n in_o tail_n charge_n and_o encumbrance_n if_o judgement_n be_v have_v at_o the_o king_n suit_n against_o a_o recusant_n tenant_n in_o tail_n for_o recusancy_n this_o be_v a_o charge_n and_o encumbrance_n within_o this_o statute_n of_o which_o the_o heir_n in_o tail_n shall_v not_o be_v discharge_v unless_o he_o conform_v but_o must_v satisfy_v all_o the_o arrear_n incur_v in_o the_o life_n time_n of_o his_o ancestor_n for_o it_o be_v a_o debt_n to_o the_o king_n upon_o a_o judgement_n the_o entail_v land_n be_v liable_a thereto_o by_o the_o statute_n of_o 33_o h._n 8._o cap._n 39_o 39_o stat._n 33_o h._n 8._o 39_o but_o these_o two_o clause_n discharge_v the_o arrear_n of_o the_o twenty_o pound_n per_fw-la month_n incur_v in_o the_o recusants_n life_n time_n upon_o the_o conformity_n of_o the_o heir_n in_o such_o case_n only_o where_o the_o two_o part_n of_o the_o recusants_n land_n be_v not_o seize_v before_o his_o death_n time_n seizure_n in_o the_o recusants_n life_n time_n for_o if_o they_o be_v seize_v in_o his_o life_n time_n and_o continue_v so_o till_o his_o death_n neither_o his_o fee-simple_n land_n nor_o his_o entail_v land_n if_o a_o judgement_n be_v have_v against_o he_o for_o his_o recusancy_n at_o the_o king_n suit_n shall_v be_v discharge_v three_o part_n thereof_o shall_v not_o be_v extend_v or_o seize_v by_o the_o king_n majesty_n his_o heir_n or_o successor_n for_o not-payment_n of_o the_o say_v twenty_o pound_n payable_a for_o each_o month_n forfeit_v or_o lose_v by_o any_o such_o recusant_n satisfy_v and_o after_o his_o death_n shall_v remain_v in_o the_o king_n hand_n until_o the_o arrear_n be_v satisfy_v and_o where_o any_o of_o 29_o eliz._n cap._n 6._o be_v alter_v for_o whereas_o by_o 29._o the_o queen_n may_v for_o nonpayment_n of_o the_o forfeiture_n have_v seize_v two_o part_n of_o a_o convict_a recusant_n land_n nomine_fw-la poenae_fw-la and_o as_o a_o gage_n or_o penalty_n until_o the_o twenty_o pound_n per_fw-la month_n have_v be_v pay_v and_o yet_o the_o profit_n shall_v not_o have_v go_v towards_o the_o king_n use_n shall_v go_v towards_o satisfaction_n thereof_o and_o when_o the_o forfeiture_n be_v pay_v out_o of_o the_o profit_n the_o recusant_n shall_v have_v his_o land_n again_o unless_o in_o statute_n of_o 3_o car._n 1._o cap._n 2._o 2._o stat._n 3_o car._n 1._o 2._o be_v make_v to_o supply_v that_o defect_n return_v stat._n sect._n 6._o they_o who_o be_v in_o seminary_n etc._n etc._n shall_v return_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n bear_v within_o this_o realm_n or_o any_o the_o king_n majesty_n dominion_n be_v at_o this_o present_a in_o any_o college_n seminary_n house_n or_o place_n in_o any_o part_n beyond_o the_o sea_n to_o the_o end_n to_o be_v instruct_v or_o strengthen_v in_o the_o popish_a religion_n which_o shall_v not_o make_v return_n into_o this_o realm_n or_o some_o of_o his_o majesty_n dominion_n within_o one_o year_n next_o come_v after_o the_o end_n of_o this_o session_n of_o parliament_n and_o submit_v himself_o as_o be_v aforesaid_a shall_v be_v in_o respect_n of_o himself_o only_o and_o not_o to_o or_o in_o respect_n of_o any_o of_o his_o heir_n or_o posterity_n utter_o disable_v and_o uncapable_a to_o inherit_v have_v or_o enjoy_v any_o manor_n land_n tenement_n hereditament_n good_n chattel_n debt_n or_o other_o thing_n aforesaid_a within_o this_o realm_n or_o any_o other_o incapacity_n as_o be_v before_o mention_v and_o be_v it_o further_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n that_o no_o woman_n etc._n stat._n sect._n 8._o no_o woman_n or_o child_n shall_v pass_v over_o the_o sea_n without_o licence_n except_o etc._n etc._n nor_o any_o child_n under_o the_o age_n of_o one_o and_o twenty_o year_n except_o sailor_n or_o ship-boy_n or_o eliz._n 1._o be_v lawful_o convict_v as_o a_o popish_a recusant_n that_o be_v upon_o indictment_n at_o the_o king_n suit_n or_o a_o popular_a action_n or_o information_n on_o the_o statute_n of_o 23_o eliz._n 1._o or_o a_o action_n of_o debt_n at_o the_o king_n suit_n alone_o according_a to_o the_o statute_n of_o 35_o eliz._n 1._o 1._o 35_o eliz._n 1._o in_o which_o two_o last_o case_n the_o former_a law_n be_v somewhat_o alter_v by_o this_o statute_n for_o by_o the_o former_a law_n if_o a_o person_n have_v be_v convict_v of_o recusancy_n any_o other_o way_n then_o by_o indictment_n no_o more_o can_v have_v be_v demand_v either_o by_o the_o king_n or_o informer_n then_o for_o the_o month_n mention_v in_o the_o information_n or_o count_n and_o the_o penalty_n shall_v not_o have_v run_v on_o in_o such_o case_n for_o that_o the_o statute_n of_o 29_o eliz._n 6._o and_o 3_o jac._n 4._o 4._o 29_o eliz._n 6._o 3_o jac._n 4._o which_o appropriate_a the_o penalty_n to_o the_o king_n after_o conviction_n intend_v no_o other_o conviction_n then_o by_o indictment_n as_o have_v be_v there_o say_v seem_v baron_n and_o seem_v but_o by_o this_o statute_n if_o a_o popular_a action_n or_o information_n or_o a_o action_n of_o debt_n etc._n etc._n at_o the_o king_n suit_n alone_o be_v bring_v against_o the_o husband_n and_o wife_n for_o the_o recusancy_n of_o the_o wife_n and_o judgement_n be_v have_v against_o they_o the_o husband_n shall_v not_o only_o pay_v for_o the_o time_n contain_v in_o the_o information_n or_o count_n but_o the_o wife_n shall_v be_v imprison_v ever_o afterward_o unless_o she_o conform_v or_o the_o husband_n pay_v ten_o pound_n per_fw-la month_n or_o yield_v the_o three_o part_n of_o his_o land_n to_o the_o king_n and_o yet_o this_o statute_n do_v not_o after_o such_o conviction_n of_o the_o wife_n in_o a_o popular_a suit_n away_o suit_n upon_o former_a statute_n not_o take_v away_o or_o action_n of_o debt_n etc._n etc._n at_o the_o king_n suit_n take_v away_o the_o popular_a action_n or_o information_n from_o the_o informer_n or_o the_o action_n of_o debt_n etc._n etc._n from_o the_o king_n for_o the_o time_n to_o come_v but_o that_o they_o may_v be_v bring_v against_o the_o husband_n and_o wife_n for_o the_o recusancy_n of_o the_o wife_n for_o any_o month_n or_o month_n wherein_o she_o be_v absent_a from_o church_n after_o such_o conviction_n for_o this_o statute_n and_o 23_o eliz._n 1._o and_o 35_o eliz._n 1._o 1_o stat._n 23_o eliz._n 1_o 35_o eliz._n 1_o be_v all_o affirmative_a law_n and_o may_v well_o stand_v together_o so_o that_o any_o of_o the_o three_o remedy_n give_v by_o these_o statute_n may_v be_v pursue_v this_o statute_n not_o abrogate_a any_o former_a law_n but_o only_o provide_v another_o way_n of_o punishment_n for_o the_o wife_n after_o she_o be_v once_o convict_v howbeit_o she_o shall_v not_o be_v punish_v by_o any_o more_o than_o one_o of_o these_o three_o way_n co._n 11._o 63_o 64._o &_o roll_n 1._o 94._o doctor_n foster_n case_n cro._n pasch_fw-mi 17_o jac._n 529._o parker_n versus_fw-la curson_n and_o therefore_o if_o the_o king_n bring_v a_o action_n of_o debt_n etc._n etc._n informer_n have_v recover_v or_o for_o his_o not_o yield_v the_o three_o of_o his_o land_n to_o the_o king_n and_o the_o reason_n be_v for_o that_o when_o the_o husband_n stand_v charge_v with_o the_o penalty_n of_o twenty_o pound_n per_fw-la month_n for_o the_o absence_n of_o the_o wife_n the_o intent_n of_o the_o act_n be_v satisfy_v in_o respect_n of_o those_o month_n of_o her_o absence_n for_o which_o he_o stand_v so_o charge_v for_o if_o he_o pay_v not_o the_o twenty_o pound_n per_fw-la month_n so_o recover_v the_o king_n or_o informer_n have_v the_o ordinary_a remedy_n after_o judgement_n by_o process_n of_o capias_fw-la against_o they_o both_o both_o and_o the_o intent_n of_o the_o act_n be_v no_o more_o then_o that_o the_o husband_n shall_v pay_v for_o the_o recusancy_n of_o his_o must_v remain_v in_o prison_n until_o the_o husband_n pay_v the_o ten_o pound_n for_o every_o month_n or_o yield_v the_o three_o of_o his_o land_n to_o the_o king_n or_o the_o wife_n conform_v three_o or_o if_o the_o husband_n yield_v the_o three_o so_o if_o the_o husband_n yield_v the_o three_o of_o his_o land_n to_o save_v his_o wife_n imprisonment_n he_o be_v already_o punish_v by_o this_o act_n seal_n for_o the_o time_n be_v or_o before_o such_o person_n or_o person_n as_o by_o your_o highness_n your_o heir_n or_o successor_n shall_v be_v name_v and_o appoint_v to_o accept_v or_o receive_v the_o same_o and_o that_o also_o all_o and_o every_o person_n and_o person_n take_v order_n university_n he_o that_o take_v order_n he_o that_o take_v degree_n in_o any_o university_n and_o all_o and_o every_o other_o person_n and_o person_n which_o shall_v be_v promote_v or_o prefer_v to_o any_o degree_n of_o learning_n in_o any_o university_n within_o this_o your_o realm_n or_o dominion_n before_o he_o shall_v receive_v or_o take_v any_o such_o order_n or_o be_v prefer_v to_o any_o such_o degree_n of_o learning_n shall_v make_v take_v and_o receive_v the_o say_a oath_n by_o this_o act_n set_v forth_o and_o declare_v as_o be_v aforesaid_a before_o his_o or_o their_o ordinary_n commissary_n chancellor_n or_o vicechancellor_n or_o their_o sufficient_a deputy_n in_o the_o say_a university_n provide_v always_o oath_n he_o that_o have_v a_o estate_n of_o inheritance_n in_o a_o temporal_a office_n first_o refuse_v and_o then_o take_v the_o oath_n and_o that_o it_o may_v be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n have_v any_o estate_n of_o inheritance_n in_o any_o temporal_a office_n or_o office_n shall_v hereafter_o obstinate_o one_o whole_a year_n without_o bail_n or_o mainprize_n and_o that_o also_o all_o and_o every_o the_o benefice_n prebend_n and_o other_o ecclesiastical_a promotion_n and_o dignity_n whatsoever_o of_o danger_n penalty_n and_o forfeiture_n ordain_v and_o provide_v by_o the_o statute_n of_o provision_n and_o praemunire_n make_v in_o the_o sixteenth_o year_n of_o the_o reign_n of_o king_n richard_n the_o second_o offence_n the_o forfeiture_n for_o the_o three_o offence_n and_o if_o any_o such_o offender_n or_o offender_n at_o any_o time_n after_o the_o say_v second_o conviction_n and_o aforesaid_a seminary_n stat._n sect._n 5._o send_v relief_n to_o any_o jesuit_n priest_n or_o other_o person_n abide_v in_o a_o seminary_n if_o any_o person_n under_o her_o majesty_n subjection_n or_o obedience_n shall_v at_o any_o time_n after_o the_o end_n of_o the_o say_v forty_o day_n by_o way_n of_o exchange_n or_o by_o any_o other_o shift_n way_n or_o mean_n whatsoever_o witting_o and_o willing_o either_o direct_o or_o indirect_o convey_v deliver_v or_o send_v or_o cause_n or_o procure_v to_o be_v convey_v or_o deliver_v to_o be_v send_v over_o the_o sea_n or_o out_o of_o this_o to_o or_o for_o the_o maintenance_n or_o relief_n of_o any_o college_n of_o jesuit_n or_o seminary_n already_o erect_v or_o ordain_v or_o hereafter_o to_o be_v erect_v or_o ordain_v in_o any_o the_o part_n beyond_o the_o sea_n or_o out_o of_o this_o realm_n in_o any_o foreign_a part_n or_o of_o any_o person_n then_o be_v of_o or_o in_o any_o the_o same_o college_n or_o seminary_n and_o not_o return_v into_o this_o realm_n with_o submission_n as_o in_o this_o act_n be_v express_v and_o tontinue_v in_o the_o same_o realm_n that_o then_o every_o such_o person_n so_o offend_v for_o the_o same_o offence_n shall_v incur_v the_o danger_n and_o penalty_n of_o praemunire_n mention_v in_o the_o statute_n of_o praemunire_n make_v in_o the_o sixteenth_o year_n of_o the_o reign_n of_o king_n richard_n the_o second_o convey_v deliver_v etc._n convey_v or_o deliver_v relief_n to_o a_o jesuit_n etc._n etc._n so_o that_o he_o who_o be_v bare_o a_o messenger_n or_o instrument_n to_o convey_v seminary_n not_o to_o what_o person_n this_o extend_v to_o what_o not_o this_o clause_n extend_v not_o to_o every_o person_n bring_v up_o in_o such_o college_n or_o seminary_n as_o wingate_n tit_n offence_n to_o be_v commit_v or_o do_v against_o the_o tenor_n of_o this_o act_n shall_v and_o may_v be_v inquire_v of_o hear_v and_o determine_v as_o well_o in_o the_o court_n common_o call_v the_o kings-bench_n in_o the_o county_n where_o the_o same_o court_n shall_v for_o the_o time_n be_v as_o also_o in_o any_o other_o county_n within_o this_o realm_n or_o any_o other_o her_o highness_n dominion_n where_o the_o offence_n be_v or_o shall_v be_v commit_v or_o where_o the_o offender_n shall_v be_v apprehend_v and_o take_v etc._n transport_v of_o jesuit_n priest_n etc._n etc._n provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o and_o to_o every_o owner_n and_o master_n of_o any_o ship_n bark_n or_o boat_n receive_v such_o order_n and_o how_o long_o he_o have_v remain_v in_o this_o realm_n or_o in_o any_o other_o her_o highness_n dominion_n be_v under_o her_o obedience_n law_n stat._n sect._n 7._o a_o jesuit_n or_o priest_n submit_v himself_o &_o take_v the_o oath_n and_o obey_v the_o law_n provide_v also_o that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o in_o any_o wise_a extend_v to_o any_o such_o jesuit_n seminary_n priest_n or_o other_o such_o priest_n deacon_n or_o religious_a or_o ecclesiastical_a person_n as_o be_v before_o mention_v as_o shall_v at_o any_o time_n within_o the_o say_v forty_o day_n or_o within_o threé_o day_n after_o that_o he_o shall_v hereafter_o come_v into_o this_o realm_n or_o any_o other_o her_o highness_n dominion_n submit_v himself_o to_o some_o archbishop_n or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v or_o land_n and_o do_v thereupon_o true_o and_o sincere_o before_o the_o same_o archbishop_n bishop_n or_o such_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o in_o anno_fw-la primo_fw-la and_o by_o write_v under_o his_o hand_n confess_v and_o acknowledge_v and_o from_o thenceforth_o continue_v his_o due_a obedience_n unto_o her_o highness_n law_n statute_n and_o ordinance_n make_v and_o provide_v or_o to_o be_v may_v be_v indict_v as_o a_o traitor_n for_o come_v into_o the_o realm_n as_o if_o he_o have_v never_o make_v any_o such_o submission_n and_o acknowledgement_n unto_o her_o highness_n law_n that_o be_v successor_n where_o king_n or_o queen_n include_v successor_n the_o law_n of_o she_o and_o her_o successor_n and_o not_o only_o those_o which_o be_v make_v in_o she_o own_o time_n but_o such_o
