or_o make_v by_o the_o authority_n of_o this_o present_a parliament_n shall_v be_v accept_v deem_v interpret_v or_o adjudge_v at_o any_o time_n hereafter_o to_o be_v any_o error_n heresy_n schism_n or_o schismatical_a opinion_n any_o order_n decreé_n sentence_n constitution_n or_o law_n whatsoever_o the_o same_o be_v to_o the_o contrary_a notwithstanding_o heresy_n what_o thing_n the_o hereafter_o shall_v be_v order_v judge_v or_o determine_v to_o be_v heresy_n by_o the_o high_a court_n of_o parliament_n of_o this_o realm_n with_o the_o assent_n of_o the_o clergy_n in_o their_o convocation_n any_o thing_n in_o this_o act_n contain_v to_o the_o contrary_a notwithstanding_o witness_n none_o shall_v be_v indict_v or_o arraign_v but_o by_o witness_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v hereafter_o indict_v or_o arraign_v for_o any_o of_o the_o offence_n make_v ordain_v revive_v or_o adjudge_v by_o this_o act_n unless_o there_o be_v two_o sufficient_a witness_n or_o more_o to_o testify_v and_o declare_v the_o say_v offence_n whereof_o he_o shall_v be_v indict_v or_o arraign_v and_o that_o the_o say_v witness_n or_o so_o many_o of_o they_o as_o shall_v be_v live_v and_o within_o this_o realm_n at_o the_o time_n of_o arraignment_n of_o such_o person_n so_o indict_v shall_v be_v bring_v judge_n de_fw-fr legate_n by_o the_o authority_n legantine_n of_o the_o late_a cardinal_n poole_n by_o reason_n of_o a_o foreign_a usurp_a power_n and_o authority_n against_o richard_n chetwood_n esq_n and_o agnes_n his_o wife_n rome_n chetwoods_n appeal_n to_o the_o court_n of_o rome_n by_o the_o name_n of_o agnes_n woodhull_n at_o the_o suit_n of_o charles_n tyrrel_n gent._n in_o a_o cause_n of_o matrimony_n solemnize_v betweén_n the_o say_v richard_n and_o agnes_n as_o by_o the_o same_o pretend_a sentence_n more_o plain_o do_v appear_v from_o which_o sentence_n the_o say_a richard_n and_o agnes_n have_v appeal_v to_o the_o court_n of_o rome_n which_o appeal_n do_v there_o remain_v and_o yet_o be_v not_o determine_v may_v it_o therefore_o please_v your_o highness_n that_o it_o may_v be_v enact_v by_o the_o authority_n aforesaid_a that_o if_o sentence_n in_o the_o say_a appeal_n shall_v happen_v to_o be_v give_v at_o the_o say_a court_n of_o rome_n for_o and_o in_o the_o behalf_n of_o the_o say_v richard_n and_o agnes_n for_o the_o reverse_v of_o the_o say_v pretence_a sentence_n before_o the_o end_n of_o threéscore_a day_n next_o after_o the_o end_n of_o this_o be_v give_v shall_v be_v judge_v to_o be_v good_a and_o effectual_a in_o the_o law_n to_o all_o intent_n and_o purpose_n any_o law_n custom_n usage_n canon_n constitution_n or_o any_o other_o matter_n hold_v in_o the_o five_o and_o six_o year_n of_o our_o say_a late_o sovereign_a lord_n king_n edward_n the_o six_o entitle_v a_o act_n for_o the_o uniformity_n of_o common_a prayer_n and_o administration_n of_o the_o sacrament_n the_o which_o be_v repeal_v and_o take_v away_o by_o act_n of_o parliament_n in_o the_o first_o year_n of_o the_o reign_n of_o our_o late_a sovereign_a lady_n queen_n mary_n to_o the_o great_a decay_n of_o the_o due_a honour_n of_o god_n and_o discomfort_v to_o the_o professor_n of_o the_o truth_n of_o christ_n religion_n be_v it_o therefore_o enact_v by_o the_o authority_n of_o this_o present_a parliament_n that_o the_o say_a estatute_n of_o repeal_n force_n a_o repeal_n of_o the_o statute_n of_o 1_o m._n 2._o and_o the_o book_n of_o common_a prayer_n shall_v be_v in_o force_n and_o every_o thing_n therein_o contain_v only_o concern_v the_o say_a book_n and_o the_o service_n administration_n of_o the_o sacrament_n rite_n and_o ceremony_n contain_v or_o appoint_v in_o or_o by_o the_o say_a book_n shall_v be_v void_a and_o of_o none_o effect_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v and_o that_o the_o say_a book_n with_o the_o order_n of_o service_n and_o of_o the_o administration_n of_o sacrament_n rite_n and_o ceremony_n with_o the_o alteration_n and_o addition_n therein_o add_v and_o appoint_v by_o this_o estatute_n shall_v stand_v and_o be_v from_o and_o after_o the_o say_a feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n in_o full_a force_n and_o effect_n according_a to_o the_o tenor_n and_o effect_n of_o this_o estatute_n any_o thing_n in_o the_o aforesaid_a estatute_n of_o repeal_n to_o the_o contrary_a notwithstanding_o use_v stat._n sect._n 2._o the_o book_n of_o common_a prayer_n shall_v be_v use_v and_o further_o be_v it_o enact_v by_o the_o queen_n highness_n with_o the_o assent_n of_o the_o lord_n and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o all_o and_o singular_a minister_n in_o any_o cathedral_n or_o parish_n church_n or_o other_o place_n within_o this_o realm_n of_o england_n wales_n and_o the_o march_n of_o the_o same_o or_o other_o the_o queen_n dominion_n shall_v from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v be_v bind_v to_o say_v and_o use_v the_o matin_n evensong_n celebration_n of_o the_o lord_n supper_n and_o administration_n of_o each_o of_o the_o sacrament_n and_o all_o the_o common_a and_o open_a prayer_n 6._o the_o alteration_n of_o the_o book_n set_v forth_o 5_o &_o 6_o ed._n 6._o in_o such_o order_n and_o form_n as_o be_v mention_v in_o the_o say_a book_n so_o authorize_v by_o parliament_n in_o the_o say_v five_o and_o six_o year_n of_o the_o reign_n of_o king_n edward_n the_o six_o with_o one_o alteration_n or_o addition_n of_o certain_a lesson_n to_o be_v use_v on_o every_o sunday_n in_o the_o year_n and_o the_o form_n of_o the_o litany_n alter_v and_o correct_v and_o two_o sentence_n only_o add_v in_o the_o delivery_n of_o the_o sacrament_n to_o the_o communicant_n and_o none_o other_o or_o otherwise_o prayer_n the_o forfeiture_n of_o those_o which_o use_v any_o other_o service_n than_o the_o book_n of_o common_a prayer_n and_o that_o if_o any_o manner_n of_o parson_n vicar_n or_o other_o whatsoever_o minister_n that_o ought_v or_o shall_v sing_v or_o say_v common_a prayer_n mention_v in_o the_o say_a book_n or_o minister_v the_o sacrament_n from_o and_o after_o the_o feast_n of_o the_o nativity_n of_o saint_n john_n baptist_n next_o come_v refuse_v to_o use_v the_o say_v common_a prayer_n or_o to_o administer_v the_o sacrament_n in_o such_o cathedral_n or_o parish_n church_n or_o other_o place_n as_o he_o shall_v use_v to_o minister_v the_o same_o in_o such_o order_n and_o form_n as_o they_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n or_o shall_v wilful_o or_o obstinate_o stand_v in_o the_o same_o use_v any_o other_o rite_n ceremony_n order_n form_n or_o manner_n of_o celebrate_v the_o lord_n supper_n open_o or_o privy_o or_o matin_n evensong_n administration_n of_o the_o sacrament_n or_o other_o open_a prayer_n then_o be_v mention_v and_o set_v forth_o in_o the_o say_a book_n open_a prayer_n in_o and_o throughout_o this_o act_n be_v mean_v that_o prayer_n which_o be_v for_o other_o to_o come_v unto_o or_o hear_v either_o in_o common_a church_n prayer_n the_o penalty_n for_o deprave_v the_o book_n of_o common_a prayer_n or_o private_a chapel_n or_o oratory_n common_o call_v the_o service_n of_o the_o church_n or_o shall_v preach_v declare_v or_o speak_v any_o thing_n in_o the_o derogation_n or_o deprave_v of_o the_o say_a book_n or_o any_o thing_n therein_o contain_v or_o of_o any_o part_n thereof_o and_o shall_v be_v thereof_o lawful_o convict_v according_a to_o the_o law_n of_o this_o dominicam_fw-la &_o dictae_fw-la coenae_fw-la orationes_fw-la etc._n etc._n and_o if_o he_o be_v indict_v upon_o this_o statute_n with_o the_o addition_n of_o clericus_fw-la that_o word_n imply_v he_o to_o be_v a_o priest_n or_o minister_n within_o the_o meaning_n thereof_o dyer_n 3_o eliz._n 203._o note_v that_o by_o the_o statute_n of_o 14_o car._n 2._o 2._o stat._n 14_o car._n 2._o this_o and_o all_o other_o law_n which_o be_v then_o in_o force_n for_o the_o uniformity_n of_o prayer_n and_o administration_n of_o the_o sacrament_n within_o the_o realm_n of_o england_n be_v now_o applicable_a to_o the_o book_n of_o common_a prayer_n prayer_n book_n of_o common_a prayer_n authorize_v by_o that_o act_n of_o 14_o car._n and_o be_v to_o be_v put_v in_o ure_n with_o relation_n to_o the_o say_a book_n wilful_o or_o obstinate_o stand_v in_o the_o same_o these_o word_n wilful_o or_o obstinate_o stand_v in_o the_o same_o seem_v to_o restrain_v the_o law_n to_o such_o other_o prayer_n as_o be_v use_v in_o hindrance_n of_o or_o opposition_n to_o the_o common_a prayer_n or_o after_o admonition_n or_o warning_n to_o the_o contrary_a pulpit_n prayer_n in_o the_o pulpit_n and_o therefore_o the_o prayer_n use_v in_o the_o pulpit_n before_o sermon_n seem_v not_o to_o be_v within_o the_o meaning_n of_o this_o law_n nor_o to_o be_v forbid_v by_o it_o because_o general_o tolerate_v by_o those_o in_o authority_n and_o so_o not_o obstinate_o use_v and_o be_v those_o word_n want_v although_o the_o word_n of_o the_o statute_n be_v general_a any_o other_o form_n or_o open_a prayer_n yet_o they_o ought_v to_o have_v a_o particular_a construction_n according_a to_o reason_n and_o the_o intent_n of_o the_o maker_n of_o the_o law_n viz._n that_o no_o minister_n shall_v use_v any_o other_o form_n to_o the_o hindrance_n of_o or_o in_o opposition_n to_o this_o for_o a_o penal_a law_n shall_v not_o always_o be_v construe_v according_a to_o the_o word_n of_o it_o but_o according_a to_o the_o intent_n of_o the_o maker_n of_o it_o plowden_n 18._o fogassa_n case_n ib._n 465_o 466_o 467._o eyston_n versus_fw-la studd_n ibib._n 109_o 110._o fulmerston_n versus_fw-la steward_n and_o the_o id_fw-la sensisse_fw-la quod_fw-la ratione_fw-la careat_fw-la etiamsi_fw-la verborum_fw-la generalitas_fw-la aliter_fw-la suadeat_fw-la co._n 4._o inst_z 330_o 331._o offence_n stat._n sect._n 3_o the_o penalty_n for_o the_o second_o offence_n and_o if_o any_o such_o person_n once_o convict_v of_o any_o offence_n concern_v the_o premise_n shall_v after_o this_o first_o conviction_n eftsoons_o offend_v and_o be_v thereof_o in_o form_n aforesaid_a lawful_o convict_v that_o then_o the_o same_o person_n shall_v for_o his_o second_o offence_n suffer_v imprisonment_n by_o the_o space_n of_o convict_v the_o three_o time_n shall_v be_v deprive_v ipso_fw-la facto_fw-la of_o all_o his_o spiritual_a promotion_n and_o also_o shall_v suffer_v imprisonment_n during_o his_o life_n not_o where_o shall_v be_v require_v of_o he_o who_o confess_v or_o deni_v not_o himself_o to_o be_v a_o recusant_n or_o that_o he_o have_v not_o receive_v the_o sacrament_n where_o recusant_n can_v be_v understand_v in_o any_o other_o sense_n then_o of_o he_o who_o forbear_v to_o come_v to_o church_n a_o information_n or_o indictment_n against_o a_o popish_a recusant_n recusant_n information_n or_o clear_a yearly_a value_n value_n clear_a yearly_a value_n of_o twenty_o mark_n above_o all_o charge_n a_o rent-charge_n of_o 40_o l._n per_fw-la annum_fw-la be_v issue_v out_o of_o land_n worth_a 100_o l._n per_fw-la annum_fw-la a_o popish_a recusant_n liable_a to_o be_v confine_v by_o this_o statute_n purchase_v for_o his_o life_n or_o in_o fee_n parcel_n of_o the_o land_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n over_z and_o above_o what_o his_o proportion_n of_o the_o say_a rent-charge_n come_v to_o this_o be_v a_o estate_n of_o the_o clear_a yearly_a value_n of_o twenty_o mark_n within_o the_o meaning_n of_o this_o act_n and_o shall_v free_v he_o from_o abjuration_n for_o although_o in_o strictness_n of_o law_n his_o estate_n be_v not_o clear_o so_o much_o above_o all_o charge_n for_o that_o it_o be_v chargeable_a with_o a_o yearly_a rent_n of_o forty_o pound_n yet_o in_o equity_n he_o shall_v pay_v no_o more_o than_o his_o proportion_n of_o it_o which_o the_o land_n he_o purchase_v will_v discharge_v and_o yet_o yield_v twenty_o mark_n per_fw-la annum_fw-la clear_o beside_o or_o good_n and_o chattel_n this_o statute_n be_v in_o the_o disjunctive_a land_n or_o good_n a_o estate_n partly_o of_o land_n together_o good_n and_o land_n not_o to_o be_v value_v together_o and_o partly_o of_o good_n will_v not_o satisfy_v the_o intent_n thereof_o and_o therefore_o if_o a_o popish_a recusant_n who_o offend_v against_o this_o act_n have_v fifteen_o mark_n per_fw-la annum_fw-la clear_o in_o land_n and_o be_v worth_a thirty_o pound_n in_o good_n although_o this_o take_v together_o be_v in_o truth_n a_o estate_n of_o more_o value_n than_o be_v here_o require_v yet_o it_o shall_v not_o free_v he_o from_o abjuration_n for_o the_o statute_n do_v not_o warrant_v any_o valuation_n of_o the_o land_n and_o good_n together_o so_o as_o to_o supply_v the_o defect_n of_o the_o yearly_a value_n of_o the_o land_n by_o the_o good_n or_o the_o defect_n of_o the_o value_n of_o the_o good_n by_o the_o land_n and_o therefore_o the_o recusant_n must_v have_v such_o a_o estate_n in_o the_o one_o or_o the_o other_o as_o will_v answer_v the_o statute_n and_o this_o be_v not_o like_o the_o case_n of_o juror_n upon_o the_o statute_n of_o 2_o h._n 5._o 3._o stat._n 2_o h._n 5._o 3._o cap._n 3._o where_o it_o be_v say_v that_o the_o juror_n shall_v have_v land_n of_o the_o clear_a yearly_a value_n of_o forty_o shilling_n if_o the_o debt_n or_o damage_n declare_v amount_v to_o forty_o mark_n in_o which_o case_n although_o it_o be_v in_o the_o disjunctive_a debt_n or_o damage_n yet_o it_o have_v be_v adjudge_v that_o where_o the_o debt_n and_o damage_n both_o amount_v to_o forty_o mark_n it_o be_v sufficient_a and_o the_o juror_n must_v have_v forty_o shilling_n per_fw-la annum_fw-la co._n 1._o inst_z 272._o for_o in_o that_o case_n the_o word_n or_o be_v cumulative_a and_o debt_n or_o damage_n both_v amount_v to_o different_a nature_n one_o real_a the_o other_o personal_a and_o can_v be_v regular_o reduce_v under_o one_o and_o the_o same_o head_n and_o therefore_o shall_v not_o be_v value_v together_o unless_o the_o act_n have_v express_o appoint_v such_o a_o valuation_n but_o yet_o if_o a_o popish_a recusant_n have_v a_o lease_n for_o year_n may_v but_o lease_n for_o year_n and_o personal_a good_n may_v and_o personal_a good_n and_o both_o do_v amount_v in_o value_n to_o above_o forty_o pound_n he_o shall_v be_v out_o of_o the_o danger_n of_o abjuration_n for_o although_o the_o lease_n be_v in_o the_o realty_n and_o the_o good_n be_v personal_a yet_o they_o shall_v in_o this_o case_n be_v value_v together_o for_o that_o by_o this_o copulative_a and_o the_o statute_n express_o so_o appoint_v without_o distinguish_v between_o the_o value_v of_o either_o but_o make_v it_o sufficient_a if_o both_o of_o they_o be_v of_o that_o value_n money_o secure_v upon_o a_o mortgage_n mortgage_n mortgage_n of_o land_n be_v within_o the_o meaning_n of_o these_o word_n good_n and_o chattel_n and_o if_o the_o popish_a recusant_n have_v above_o forty_o pound_n owe_v to_o he_o upon_o such_o mortgage_n he_o can_v be_v require_v to_o abjure_v within_o three_o month_n next_o after_o such_o person_n shall_v be_v apprehend_v or_o take_v wingate_n in_o abridge_n this_o clause_n tit_n crown_n numb_a 80._o clear_o mistake_v the_o meaning_n of_o it_o for_o he_o say_v that_o a_o popish_a recusant_n who_o estate_n be_v under_o value_n must_v make_v the_o submission_n prescribe_v by_o this_o
