the_o cause_n and_o by_o the_o record_n in_o the_o first-fruits-office_n that_o the_o say_a tithe_n or_o ten_o of_o lead_n oar_n have_v be_v time_n out_o of_o mind_n pay_v and_o by_o that_o record_n it_o appear_v that_o the_o vicarage_n of_o wirksworth_n be_v value_v in_o the_o king_n book_n at_o above_o 40_o pound_n 30_o pound_n thereof_o be_v only_o for_o the_o say_a tithe_n of_o lead-oar_n until_o it_o be_v reverse_v that_o then_o the_o complainant_n shall_v be_v settle_v in_o the_o possession_n of_o those_o tithe_n till_o that_o time_n and_o restore_v to_o the_o arrearage_n the_o possession_n be_v take_v away_o since_o the_o reference_n but_o if_o the_o say_a decree_n shall_v not_o in_o his_o lordship_n judgement_n be_v extend_v to_o any_o other_o but_o such_o as_o against_o who_o process_n be_v pray_v that_o then_o the_o lord_n keeper_n shall_v direct_v a_o course_n for_o the_o sinal_a determination_n of_o that_o question_n as_o by_o that_o say_a decree_n order_n of_o reference_n and_o certificate_n all_o on_o record_n in_o chancery_n and_o also_o by_o the_o bill_n and_o proceed_n in_o parliament_n to_o which_o the_o complainant_n refer_v himself_o at_o large_a of_o state_n so_o that_o diverse_a minister_n parson_n and_o vicar_n within_o the_o say_a county_n who_o have_v a_o great_a part_n of_o their_o maintenance_n out_o of_o the_o say_v ten_o of_o tithe_n or_o 10_o of_o lead-oar_n as_o aforesaid_a the_o king_n refer_v the_o consideration_n of_o this_o to_o the_o archbishop_n of_o canterbury_n the_o king_n refer_v it_o to_o some_o lord_n and_o to_o the_o lord_n high_a treasurer_n afterward_o lord_n privy_a seal_n with_o special_a direction_n that_o upon_o due_a examination_n of_o the_o cause_n they_o shall_v take_v effectual_a order_n for_o the_o petitioner_n relief_n and_o to_o certify_v what_o course_n may_v be_v take_v to_o put_v they_o in_o possession_n according_a to_o which_o reference_n their_o lordship_n have_v hear_v the_o say_a be_v make_v appear_v if_o it_o be_v examine_v the_o miner_n in_o these_o last_o trial_n swear_v for_o their_o own_o interest_n against_o the_o payment_n of_o this_o tithe_n in_o that_o parish_n where_o the_o suit_n be_v and_o then_o upon_o the_o verdict_n pass_v against_o it_o there_o deny_v it_o in_o 3_o or_o 4_o of_o the_o neighbour_a parish_n also_o where_o till_o that_o time_n it_o have_v be_v constant_o pay_v or_o compound_v for_o so_o that_o though_o the_o issue_n in_o these_o last_o trial_n be_v contrary_a to_o the_o former_a establishment_n than_o not_o understand_v by_o the_o plaintiff_n make_v local_a and_o particular_a yet_o the_o consequence_n and_o effect_n of_o the_o verdict_n of_o those_o issue_n be_v contrary_a to_o both_o law_n and_o equity_n make_v general_a and_o universal_a by_o denial_n of_o this_o tithe_n in_o neighbour_a parish_n object_n 5_o the_o petitioner_n have_v glebe-land_n and_o other_o tyth_n and_o profit_n of_o their_o benefice_n annum_fw-la clear_a profit_n of_o our_o benefice_n other_o of_o we_o not_o 70_o l._n and_o none_o of_o we_o we_o believe_v have_v 100_o l._n per_fw-la annum_fw-la except_o one_o who_o have_v 2_o mediety_n of_o the_o same_o parish_n which_o former_o when_o the_o tithe_n of_o lead-oar_n be_v pay_v in_o that_o parish_n do_v maintain_v 2_o several_a minister_n and_o their_o family_n and_o now_o though_o both_o mediety_n be_v conjoin_v they_o hardly_o exceed_v 100_o l._n per_fw-la annum_fw-la but_o the_o opponent_n of_o this_o duty_n of_o tyth-oar_n be_v always_o ready_a to_o overvalue_n the_o poor_a clergy_n benefice_n and_o of_o late_a to_o over-tax_a they_o also_o some_o of_o they_o be_v tax_v at_o a_o high_a value_n than_o when_o their_o predecessor_n receive_v this_o tithe_n of_o lead_n oar._n in_o a_o suit_n against_o the_o late_a rector_n of_o matlock_n the_o defendant_n swear_v in_o their_o answer_n that_o that_o rectory_n be_v worth_a above_o 100_o l._n per_fw-la annum_fw-la in_o tyth_n and_o rectorial_n deuce_n over_o and_o beside_o the_o pretend_a duty_n of_o tyth-oar_n some_o person_n examine_v as_o witness_n in_o that_o suit_n swear_v that_o rectory_n to_o be_v worth_a 100_o l._n per_fw-la annum_fw-la beside_o or_o without_o the_o tithe_n of_o lead-oar_n and_o the_o desendents_n solicitor_n in_o that_o cause_n instruct_v their_o council_n to_o affirm_v it_o worth_a sometime_o 120_o l._n and_o sometime_o 140_o l._n per_fw-la annum_fw-la without_o tithe_n oar_n and_o yet_o to_o show_v the_o falsehood_n of_o all_o these_o assirmation_n the_o present_a incumbent_n of_o that_o parish_n can_v never_o yet_o let_n or_o lease_n out_o his_o benefice_n for_o 70_o l._n per_fw-la annum_fw-la and_o he_o have_v diverse_a time_n prosser_v to_o let_v it_o for_o 60_o l._n per_fw-la annum_fw-la however_o all_o these_o objection_n will_v be_v of_o more_o force_n if_o they_o have_v any_o at_o all_o against_o diverse_a nobleman_n gentleman_n and_o other_o proprietor_n of_o tithe_n in_o the_o say_a county_n who_o have_v many_o thousand_o per_fw-la annum_fw-la to_o live_v upon_o and_o yet_o have_v a_o just_a right_n and_o title_n to_o this_o tithe_n receive_v more_o yearly_a revenue_n out_o of_o it_o than_o any_o or_o all_o the_o poor_a clergy_n petitioner_n be_v likely_a to_o do_v but_o against_o those_o great_a person_n these_o objection_n be_v never_o make_v it_o may_v be_v further_o add_v here_o that_o the_o petitioner_n praedial_a tithe_n of_o corn_n hay_o or_o grass_n be_v yearly_o hinder_v and_o decrease_v by_o the_o multiply_a of_o grove_n or_o mine_n in_o their_o parish_n which_o spoil_v the_o land_n and_o make_v it_o barren_a and_o last_o the_o chief_a proposer_n of_o this_o objection_n who_o be_v the_o rich_a owner_n and_o maintainer_n of_o mine_n have_v get_v great_a estate_n out_o of_o the_o mine_n of_o more_o yearly_a value_n than_o any_o of_o the_o petitioner_n benefice_n amount_v unto_o in_o the_o whole_a profit_n
