by_o which_o all_o ordinary_a case_n be_v to_o be_v determine_v and_o which_o be_v the_o settle_a measure_n of_o the_o obedience_n we_o owe_v to_o governor_n such_o a_o case_n be_v that_o in_o poland_n when_o henry_n of_o valois_n in_o haste_n and_o with_o secrecy_n leave_v the_o throne_n vacant_a a_o case_n extraordinary_a and_o which_o they_o have_v no_o law_n to_o govern_v they_o in_o but_o they_o have_v that_o which_o be_v a_o law_n to_o law_n necessity_n and_o the_o preservation_n of_o the_o nation_n that_o soon_o teach_v they_o what_o be_v to_o be_v do_v this_o bring_v i_o to_o consider_v 3._o who_o shall_v be_v the_o judge_n that_o be_v either_o who_o shall_v judge_n when_o the_o public_a good_a be_v invade_v and_o when_o the_o law_n custom_n and_o constitution_n be_v violate_v or_o who_o shall_v judge_n what_o be_v fit_a to_o the_o do_v in_o such_o a_o case_n by_o way_n of_o remedy_n as_o to_o the_o former_a the_o case_n before_o we_o be_v suppose_v to_o be_v notorious_a and_o what_o have_v a_o evident_a tendency_n to_o the_o destruction_n of_o the_o government_n of_o which_o some_o thing_n be_v of_o that_o nature_n as_o they_o be_v destructive_a of_o government_n wherever_o they_o be_v as_o the_o desertion_n of_o a_o kingdom_n or_o the_o natural_a incapacity_n of_o the_o governor_n by_o lunacy_n etc._n etc._n other_o thing_n there_o be_v which_o be_v destructive_a of_o the_o national_a constitution_n and_o such_o among_o we_o have_v be_v think_v to_o be_v a_o absolute_a and_o universal_a power_n of_o dispense_n with_o the_o law_n now_o when_o the_o case_n be_v notorious_a this_o author_n may_v as_o well_o have_v ask_v who_o shall_v be_v the_o judge_n whether_o the_o bank_n be_v break_v down_o in_o a_o inundation_n or_o whether_o there_o be_v a_o breach_n in_o the_o wall_n when_o they_o see_v the_o enemy_n press_v through_o it_o or_o the_o city_n in_o the_o power_n of_o the_o enemy_n when_o they_o see_v the_o fortification_n of_o it_o dismantle_v but_o who_o shall_v be_v the_o judge_n that_o be_v again_o by_o way_n of_o remedy_n here_o our_o author_n thus_o put_v the_o case_n either_o that_o must_v be_v the_o supreme_a governor_n or_o some_o other_o man_n or_o body_n of_o man_n or_o the_o mobile_n the_o former_a he_o choose_v for_o himself_o the_o second_o he_o argue_v out_o of_o the_o way_n and_o the_o three_o he_o give_v to_o his_o adversary_n for_o thus_o he_o conclude_v after_o all_o the_o matter_n come_v to_o the_o mobile_n and_o every_o man_n must_v judge_n for_o himself_o and_o have_v not_o we_o extreme_o mend_v the_o matter_n by_o put_v it_o into_o the_o power_n of_o every_o subject_a to_o depose_v his_o king_n or_o at_o least_o to_o endeavour_v it_o to_o his_o utmost_a in_o case_n he_o apprehend_v it_o will_v be_v for_o the_o public_a good_a p._n 9_o as_o to_o the_o first_o of_o these_o the_o supreme_a governor_n the_o case_n we_o be_v upon_o immediate_o concern_v himself_o and_o then_o either_o there_o must_v be_v no_o judge_n or_o he_o can_v be_v the_o judg._n for_o suppose_v the_o controversy_n be_v about_o the_o succession_n and_o title_n suppose_v about_o a_o incapacity_n a_o desertion_n and_o vacancy_n suppose_v it_o be_v about_o the_o violation_n and_o destruction_n of_o the_o government_n and_o constitution_n design_v by_o he_o or_o the_o nature_n and_o obligation_n of_o the_o oath_n to_o he_o this_o be_v not_o only_o to_o make_v he_o a_o personal_a judge_n in_o his_o own_o case_n which_o the_o law_n permit_v net_n in_o suit_n of_o law_n betwixt_o prince_n and_o subject_a but_o to_o set_v he_o above_o himself_o and_o in_o our_o author_n phrase_n to_o set_v a_o supreme_a above_o a_o supreme_a and_o then_o the_o question_n shall_v be_v put_v not_o who_o be_v the_o judge_n but_o whether_o there_o be_v any_o judge_n but_o i_o ready_o grant_v that_o the_o supreme_a governor_n have_v no_o supreme_a and_o whatever_o have_v be_v do_v in_o a_o case_n extraordinary_a do_v no_o more_o make_v a_o convention_n or_o parliament_n judge_n proper_o so_o call_v than_o that_o the_o parliament_n be_v equal_a to_o the_o king_n because_o he_o can_v make_v no_o law_n without_o they_o as_o for_o the_o case_n of_o the_o people_n our_o author_n write_v as_o if_o he_o have_v never_o read_v his_o adversary_n who_o after_o he_o have_v resolve_v the_o point_n into_o the_o common_a good_a say_v i_o do_v not_o hereby_o go_v about_o to_o set_v up_o the_o power_n of_o the_o people_n over_o king_n which_o be_v in_o effect_n to_o overthrow_v monarchy_n for_o then_o the_o whole_a sovereignty_n will_v lie_v in_o the_o people_n and_o king_n will_v be_v but_o their_o servant_n p._n 18._o and_o therefore_o there_o be_v the_o three_o case_n remain_v which_o be_v that_o of_o a_o body_n of_o m●n_z and_o thus_o the_o question_n be_v put_v in_o the_o discourse_n whether_o the_o law_n of_o our_o nation_n do_v not_o bind_v we_o to_o allegiance_n to_o a_o king_n and_o queen_n in_o actual_a possession_n of_o the_o throne_n by_o consent_n of_o the_o three_o estate_n of_o the_o realm_n and_o whether_o such_o a_o oath_n may_v not_o lawful_o be_v take_v notwithstanding_o any_o former_a oath_n p._n 8._o this_o he_o undertake_v to_o prove_v p._n 13._o as_o that_o be_v no_o other_o than_o the_o consent_n of_o the_o people_n who_o true_a representative_n they_o be_v as_o he_o show_v to_o this_o our_o author_n have_v nothing_o to_o say_v but_o the_o inquirer_n that_o he_o may_v seem_v to_o say_v somewhat_o take_v what_o serve_v his_o turn_n and_o leave_v out_o the_o rest_n to_o use_v his_o own_o word_n for_o this_o adversary_n have_v say_v p._n 18._o if_o there_o be_v a_o rule_n the_o general_a consent_n of_o the_o people_n join_v with_o the_o common_a good_a seem_v to_o have_v be_v that_o which_o our_o ancestor_n pretend_v to_o he_o present_o run_v out_o upon_o this_o in_o a_o vehement_a expostulation_n where_o or_o how_o can_v all_o the_o people_n meet_v as_o if_o the_o author_n he_o oppose_v think_v of_o no_o less_o than_o the_o number_n of_o the_o people_n from_o dan_n to_o beersheba_n or_o as_o if_o there_o be_v no_o way_n of_o take_v the_o general_n consent_v but_o by_o a_o universal_a assemble_v he_o that_o quote_v what_o be_v just_a before_o and_o after_o can_v not_o miss_v the_o explication_n there_o give_v the_o consent_n of_o the_o people_n that_o be_v the_o three_o estate_n of_o the_o realm_n etc._n etc._n p._n 19_o and_o elsewhere_o i_o may_v think_v here_o of_o close_v the_o discourse_n upon_o public_a good_a when_o he_o himself_o grow_v weary_a of_o it_o but_o to_o give_v a_o answer_n to_o what_o remain_v it_o be_v fit_a with_o he_o to_o return_v to_o it_o the_o author_n of_o the_o discourse_n towards_o the_o beginning_n treat_v of_o the_o nature_n and_o measure_n of_o the_o obligation_n of_o political_a oath_n show_v 1._o that_o the_o obligation_n be_v not_o bare_o from_o the_o oath_n but_o from_o somewhat_o antecedent_n to_o it_o p._n 4._o 2._o that_o the_o public_a good_a be_v that_o antecedent_n the_o main_a end_n chief_o concern_v in_o the_o obligation_n and_o the_o obligation_n to_o magistrate_n be_v to_o be_v in_o subordination_n to_o that_o end_n p._n 5._o 3._o that_o a_o antecedent_n and_o superior_a obligation_n void_v that_o which_o be_v subsequent_a and_o inferior_a when_o they_o contradict_v each_o other_o so_o that_o if_o a_o oath_n to_o the_o person_n be_v true_o inconsistent_a with_o the_o welfare_n of_o the_o people_n the_o obligation_n can_v continue_v that_o this_o be_v so_o in_o other_o case_n he_o show_v there_o be_v no_o relation_n of_o mankind_n one_o to_o another_o but_o there_o be_v some_o good_a antecedent_n which_o be_v the_o just_a measure_n of_o that_o obligation_n they_o stand_v in_o to_o each_o other_o thus_o he_o describe_v it_o to_o be_v between_o parent_n and_o child_n 1._o on_o the_o child_n part_n to_o parent_n insomuch_o that_o if_o a_o vow_n to_o god_n which_o be_v as_o solemn_a a_o thing_n as_o a_o oath_n hinder_v that_o good_a which_o child_n be_v bind_v to_o do_v to_o parent_n it_o cease_v to_o oblige_v as_o our_o saviour_n declare_v to_o this_o our_o author_n reply_v his_o comparison_n of_o a_o vow_n and_o a_o oath_n be_v nothing_o to_o the_o purpose_n for_o whoever_o think_v that_o either_o a_o oath_n or_o a_o vow_n bind_v a_o man_n contrary_n to_o his_o real_a duty_n the_o sin_n in_o such_o a_o case_n be_v in_o make_v they_o not_o in_o break_v they_o p._n 13._o i_o answer_v the_o instance_n be_v to_o the_o purpose_n for_o if_o the_o procure_n and_o preserve_v the_o public_a good_a be_v a_o duty_n and_o what_o a_o person_n have_v vow_v or_o swear_v be_v destructive_a of_o it_o then_o the_o oath_n can_v oblige_v no_o more_o
than_o a_o vow_v not_o to_o feed_v or_o maintain_v a_o parent_n and_o the_o jurant_fw-la be_v discharge_v of_o the_o obligation_n and_o whereas_o he_o say_v the_o sin_n be_v in_o make_v they_o etc._n etc._n that_o be_v true_a where_o the_o matter_n be_v unlawful_a in_o itself_o as_o when_o the_o jew_n bind_v themselves_o to_o kill_v st._n paul_n but_o the_o case_n may_v happen_v so_o that_o it_o may_v be_v not_o only_o lawful_a but_o a_o duty_n to_o break_v that_o vow_n or_o oath_n which_o be_v lawful_a in_o its_o own_o nature_n or_o rather_o the_o obligation_n come_v to_o cease_v because_o by_o change_n of_o circumstance_n or_o of_o the_o original_a reason_n of_o that_o oath_n that_o which_o be_v lawful_a may_v become_v unlawful_a thus_o it_o be_v in_o thing_n sacred_a and_o dedicate_v to_o the_o service_n of_o god_n and_o which_o can_v not_o be_v alienate_v from_o it_o without_o sacrilege_n and_o yet_o it_o be_v lawful_a to_o apply_v they_o otherwise_o in_o case_n of_o necessity_n as_o our_o saviour_n case_n of_o the_o shewbread_n prove_v and_o so_o it_o may_v happen_v in_o the_o case_n before_o we_o when_o that_o which_o be_v before_o for_o the_o public_a good_a and_o which_o it_o be_v lawful_a to_o swear_v to_o maintain_v may_v afterward_o come_v to_o be_v plain_o destructive_a of_o it_o and_o so_o the_o same_o reason_n that_o there_o be_v for_o swear_v to_o maintain_v it_o may_v be_v for_o the_o set_n it_o aside_o the_o want_n of_o this_o consideration_n lead_v this_o author_n into_o a_o mistake_n when_o he_o say_v let_v our_o author_n speak_v out_o and_o tell_v i_o that_o take_v a_o oath_n of_o allegiance_n to_o a_o lawful_a prince_n be_v contrary_a to_o my_o duty_n and_o then_o etc._n etc._n for_o it_o may_v be_v lawful_a and_o his_o duty_n to_o take_v a_o oath_n to_o a_o lawful_a prince_n but_o it_o follow_v not_o that_o no_o case_n can_v ever_o happen_v in_o which_o the_o obligation_n of_o such_o a_o oath_n cease_v it_o be_v lawful_a for_o jaddus_n the_o highpriest_n and_o the_o rest_n of_o the_o jew_n to_o swear_v allegiance_n to_o darius_n as_o long_o as_o he_o live_v and_o yet_o when_o alexander_n come_v with_o a_o powerful_a army_n against_o they_o and_o darius_n be_v in_o no_o capacity_n of_o defend_v they_o it_o be_v lawful_a and_o as_o they_o think_v their_o duty_n for_o the_o preservation_n of_o their_o country_n and_o themselves_o to_o go_v out_o to_o meet_v he_o and_o to_o transfer_v their_o allegiance_n to_o he_o and_o certain_o they_o think_v themselves_o discharge_v from_o their_o former_a oath_n to_o the_o one_o when_o they_o take_v it_o to_o the_o other_o so_o true_a be_v that_o which_o the_o author_n of_o the_o discourse_n observe_v that_o the_o resolution_n of_o conscience_n in_o this_o case_n do_v not_o depend_v upon_o the_o will_n and_o pleasure_n of_o the_o person_n to_o who_o the_o former_a oath_n be_v make_v but_o upon_o the_o ground_n on_o which_o it_o be_v make_v and_o from_o which_o it_o have_v its_o force_n to_o oblige_v and_o if_o those_o cease_v the_o obligation_n of_o the_o oath_n cease_v together_o with_o they_o p._n 13._o 2._o it_o be_v so_o on_o the_o parent_n part_v to_o child_n as_o the_o same_o author_n show_v so_o that_o if_o parent_n instead_o of_o regard_v the_o good_a of_o their_o child_n do_v open_o design_v their_o ruin_n none_o will_v say_v but_o that_o they_o be_v bind_v to_o take_v care_n of_o their_o own_o welfare_n etc._n etc._n to_o this_o our_o author_n reply_v 1._o i_o know_v not_o what_o a_o madman_n may_v do_v but_o none_o will_v suppose_v that_o a_o parent_n in_o his_o right_a wit_n will_v do_v thus_o as_o it_o be_v both_o unnatural_a and_o unreasonable_a to_o think_v that_o a_o king_n shall_v contrive_v the_o destruction_n of_o his_o subject_n without_o who_o he_o have_v none_o to_o reign_v over_o or_o assist_v he_o this_o i_o grant_v be_v unnatural_a and_o unreasonable_a in_o itself_o but_o not_o unreasonable_a to_o think_v for_o the_o world_n too_o often_o find_v that_o the_o passion_n and_o lust_n and_o interest_n of_o man_n make_v they_o do_v thing_n unreasonable_a and_o unnatural_a and_o our_o saviour_n tell_v we_o how_o far_o the_o hatred_n person_n have_v to_o the_o true_a religion_n may_v transport_v they_o when_o the_o father_n shall_v betray_v and_o deliver_v their_o child_n to_o death_n and_o if_o it_o be_v so_o on_o the_o part_n of_o a_o natural_a it_o may_v be_v as_o well_o suppose_v on_o the_o part_n of_o a_o political_a parent_n that_o he_o say_v be_v unreasonable_a to_o suppose_v because_o a_o king_n by_o the_o destruction_n of_o his_o subject_n leave_v himself_o none_o to_o reign_v over_o or_o assist_v he_o but_o whoever_o be_v so_o mad_a as_o to_o mean_v this_o when_o he_o put_v the_o case_n of_o a_o prince_n destroy_v his_o nation_n for_o than_o he_o must_v come_v to_o do_v it_o with_o his_o own_o hand_n and_o his_o nation_n must_v in_o caligula_n way_n have_v little_a more_o than_o one_o neck_n to_o serve_v his_o barbarity_n but_o they_o thereby_o mean_v his_o design_n to_o destroy_v the_o government_n and_o to_o destroy_v those_o that_o will_v not_o comply_v with_o or_o oppose_v such_o a_o design_n he_o choose_v rather_o to_o have_v no_o subject_n than_o what_o shall_v not_o be_v his_o slave_n or_o in_o the_o modish_a way_n of_o a_o neighbour_a prince_n that_o will_v not_o be_v of_o the_o same_o religion_n with_o himself_o 2._o he_o say_v the_o author_n shall_v have_v tell_v we_o that_o the_o child_n in_o such_o a_o case_n may_v have_v take_v away_o all_o the_o father_n subsistence_n and_o do_v their_o utmost_a endeavour_n to_o starve_v he_o or_o cut_v his_o throat_n and_o no_o doubt_n but_o this_o have_v be_v a_o excellent_a comment_n on_o the_o five_o commandment_n but_o why_o shall_v that_o author_n be_v oblige_v thus_o to_o have_v tell_v we_o for_o suppose_v the_o father_n will_v alienate_v the_o estate_n from_o his_o child_n which_o be_v entail_v upon_o they_o and_o design_n to_o adopt_v a_o stranger_n into_o that_o relation_n and_o substitute_v he_o in_o their_o place_n suppose_v again_o that_o a_o father_n have_v several_a tenant_n that_o hold_v of_o he_o by_o ancient_a tenor_n and_o by_o which_o tenor_n and_o perform_v the_o condition_n belong_v to_o they_o their_o land_n be_v as_o much_o their_o propriety_n as_o the_o land_n of_o inheritance_n be_v their_o lord_n and_o that_o he_o notwithstanding_o seek_v to_o destroy_v their_o tenor_n because_o they_o oppose_v he_o in_o his_o design_n against_o his_o child_n or_o in_o that_o absolute_a power_n over_o they_o which_o he_o aim_v at_o suppose_v again_o that_o rather_o than_o not_o compass_v his_o design_n he_o seek_v the_o destruction_n of_o his_o child_n and_o of_o the_o tenant_n that_o adhere_v to_o they_o for_o their_o own_o mutual_a preservation_n and_o security_n be_v there_o no_o mean_a to_o be_v find_v but_o either_o to_o let_v the_o father_n out_o and_o starve_v his_o child_n or_o that_o the_o child_n must_v take_v away_o all_o the_o father_n be_v subsistance_n and_o do_v their_o utmost_a to_o starve_v he_o no_o mean_a but_o to_o let_v the_o father_n cut_v the_o throat_n of_o his_o child_n or_o that_o the_o child_n must_v cut_v the_o throat_n of_o their_o father_n and_o may_v not_o a_o son_n withdraw_v from_o his_o parent_n immediate_a care_n as_o the_o discourse_n say_v and_o forsake_v his_o house_n when_o he_o can_v stay_v there_o but_o upon_o the_o hard_a term_n of_o be_v destroy_v or_o of_o resign_v up_o the_o title_n of_o his_o inheritance_n to_o a_o supposititious_a heir_n or_o may_v not_o the_o son_n take_v possession_n of_o his_o father_n house_n and_o the_o estate_n of_o inheritance_n which_o the_o father_n abandon_v rather_o than_o he_o will_v oblige_v himself_o to_o continue_v the_o estate_n in_o his_o family_n and_o suffer_v the_o tenant_n to_o hold_v their_o land_n by_o any_o other_o tenure_n than_o that_o of_o during_o pleasure_n may_v he_o not_o i_o say_v then_o enter_v upon_o the_o estate_n rather_o than_o suffer_v the_o house_n to_o fall_v and_o the_o land_n to_o be_v waste_v and_o the_o tenant_n undo_v for_o want_n of_o a_o supervisor_n and_o possessor_n and_o may_v he_o not_o keep_v the_o possession_n against_o his_o parent_n in_o his_o own_o his_o family_n and_o tenant_n right_o when_o he_o come_v with_o a_o arm_a force_n of_o rappery_n to_o enslave_v his_o child_n and_o tenant_n and_o exercise_v a_o absolute_a power_n over_o they_o or_o else_o destroy_v they_o and_o may_v not_o all_o this_o be_v do_v and_o the_o five_o commandment_n stand_v in_o its_o full_a force_n if_o not_o we_o must_v burn_v our_o law-book_n and_o take_v new_a measure_n from_o these_o gentleman_n that_o despise_v and_o reproaeh_a the_o common_a
their_o separation_n with_o the_o minister_n upon_o who_o no_o such_o obligation_n be_v lay_v as_o on_o the_o minister_n so_o that_o though_o the_o nonswearing_a clergy_n may_v lawful_o separate_v
