positive_a law_n and_o to_o other_o because_o it_o be_v not_o the_o duty_n of_o the_o subject_n allegiance_n but_o what_o be_v positive_a or_o in_o esse_fw-la the_o other_o be_v not_o the_o duty_n of_o tâ—e_v subject_a neither_o be_v it_o any_o allegiance_n at_o all_o until_o by_o parliament_n it_o be_v so_o enjoin_v but_o test_n in_o the_o interim_n in_o nubes_fw-la or_o in_o consideration_n of_o law_n therefore_o the_o llegall_a positive_a allegiance_n viz_o that_o which_o be_v due_a by_o the_o positive_a law_n â—â—ely_o be_v intend_v by_o this_o statute_n if_o it_o be_v take_v in_o the_o other_o sense_n in_o this_o statute_n as_o it_o be_v plain_o otherwise_o nota._n nota._n yet_o it_o will_v not_o advantage_v the_o other_o part_n before_o all_o statute_n pen_v in_o such_o general_a word_n as_o this_o be_v intend_v only_o the_o legal_a positive_a allegiance_n as_o before_o but_o bring_v they_o a_o little_a near_o to_o the_o parliament_n and_o their_o power_n and_o authority_n which_o they_o so_o much_o decline_v what_o shall_v we_o then_o say_v unto_o army_n of_o man_n thus_o illegal_o raise_v by_o the_o king_n viz._n dircte_o against_o all_o these_o positive_a law_n former_o remember_v can_v we_o in_o law_n or_o conscience_n aid_n or_o assist_v they_o by_o law_n we_o can_v as_o you_o see_v then_o sure_o we_o can_v in_o conscience_n scripture_n humane_a law_n enjoin_v to_o be_v observe_v by_o scripture_n the_o law_n of_o this_o land_n bind_v the_o conscience_n to_o obedience_n and_o the_o observance_n of_o these_o humane_a law_n be_v so_o often_o in_o the_o holy_a word_n of_o god_n command_v and_o for_o this_o reason_n as_o i_o conceive_v these_o force_n thus_o raise_v authority_n rebel_n and_o traitor_n not_o raise_v by_o lawful_a authority_n impeachment_n but_o sure_o this_o statute_n will_v not_o aid_v he_o for_o it_o be_v apparent_a by_o the_o proviso_n of_o this_o statute_n proviso_n proviso_n explanation_n of_o the_o proviso_n that_o there_o be_v a_o decline_a from_o the_o duty_n of_o their_o allegiance_n although_o they_o follow_v the_o king_n person_n in_o his_o war_n otherwise_o the_o proviso_n be_v mere_o idle_a but_o to_o explain_v it_o yet_o â—urther_o law_n proviso_n relate_v always_o to_o the_o body_n of_o the_o act_n in_o the_o judgement_n of_o the_o law_n the_o proviso_n relate_v to_o the_o body_n of_o the_o act_n the_o body_n of_o the_o act_n be_v only_o to_o exempt_v those_o that_o attend_v the_o king_n person_n in_o the_o war_n and_o do_v he_o true_a and_o faithful_a service_n for_o the_o defence_n of_o his_o person_n and_o the_o land_n act._n service_n do_v unto_o the_o king_n in_o defence_n of_o the_o land_n be_v the_o legal_a positive_a allegiance_n within_o this_o act._n here_o you_o see_v allegiance_n be_v mean_v in_o the_o proviso_n viz._n the_o service_n do_v unto_o the_o king_n in_o defence_n of_o the_o realm_n provide_v that_o none_o shall_v take_v benefit_n of_o this_o act_n that_o shall_v decline_v from_o the_o duty_n of_o he_o or_o their_o allegiance_n that_o be_v to_o say_v that_o shall_v not_o do_v true_a and_o faithful_a service_n unâ—o_o the_o king_n and_o the_o land_n as_o be_v mention_v in_o the_o act_n and_o the_o word_n none_n in_o the_o proviso_n be_v plain_a law_n none_n relate_v to_o the_o body_n of_o the_o act._n no_o traitor_n by_o law_n can_v have_v any_o benefit_n of_o law_n viz_o none_o that_o shall_v attend_v his_o person_n in_o the_o war_n shall_v take_v benefit_n of_o this_o act_n if_o he_o shall_v decline_v from_o the_o duty_n of_o his_o allegiance_n and_o in_o this_o sense_n it_o must_v be_v take_v and_o in_o no_o other_o for_o future_a crime_n it_o can_v extend_v unto_o other_o then_o mention_v in_o this_o act_n since_o by_o law_n they_o be_v make_v uncapable_a of_o the_o benefit_n of_o any_o law_n if_o transgressor_n of_o the_o law_n frustra_fw-la legis_fw-la auxilium_fw-la implorat_fw-la explanatory_n this_o proviso_n but_o explanatory_n qui_fw-la in_o legem_fw-la committit_fw-la and_o therefore_o this_o proviso_n idle_a if_o so_o understand_v unless_o you_o will_v tax_v a_o parliament_n to_o be_v misconusant_fw-mi of_o the_o law_n further_o this_o proviso_n as_o it_o seem_v to_o i_o be_v but_o explanatory_n of_o the_o act_n and_o be_v not_o absolute_o necessary_a to_o be_v insert_v politic_a this_o allegiance_n upon_o this_o 〈◊〉_d have_v relation_n only_o to_o the_o positive_a law_n vi._n ante_fw-la the_o subject_n allegiance_n unto_o the_o natural_a capacity_n of_o the_o king_n in_o respect_n of_o the_o say_v more_o the_o meaning_n of_o this_o law_n be_v very_o well_o deliver_v by_o the_o parliament_n in_o their_o declaration_n concern_v hull_n here_o i_o may_v touch_v and_o that_o not_o extravigant_o upon_o the_o allegiance_n royal_a unto_o what_o capacity_n of_o the_o king_n it_o be_v due_a you_o see_v a_o man_n may_v decline_v from_o the_o duty_n of_o his_o allegiance_n and_o yet_o follow_v the_o king_n person_n therefore_o the_o allegiance_n be_v not_o due_a unto_o the_o natural_a person_n of_o the_o king_n only_o but_o it_o be_v due_a unto_o the_o natural_a in_o respect_n of_o the_o politic_a capacity_n and_o that_o you_o see_v be_v the_o judgement_n of_o this_o parliament_n the_o subject_n allegiance_n may_v be_v decline_v and_o yet_o the_o natural_a person_n of_o the_o king_n attend_v and_o withal_o note_n that_o in_o these_o time_n this_o be_v declaim_v against_o as_o a_o jesuitical_a distinction_n and_o yet_o the_o judgement_n of_o a_o parliament_n object_n but_o it_o be_v further_o urge_v that_o the_o penalty_n of_o this_o law_n be_v remit_v and_o pardon_v by_o the_o king_n sol._n i_o answer_v that_o the_o king_n pardon_n avail_v not_o here_o withal_o of_o simony_n if_o the_o king_n present_v the_o same_o person_n simonaical_o to_o the_o same_o benefice_n and_o withal_o in_o his_o presentation_n there_o be_v a_o special_a non_fw-fr obstante_fw-la be_v rebel_n and_o not_o subject_n if_o we_o shall_v discredit_v the_o protestation_n yea_o the_o oath_n of_o our_o prince_n i_o answer_v sol._n the_o judgement_n of_o a_o parliament_n be_v otherwise_o he_o may_v err_v his_o command_n may_v be_v illegal_a and_o the_o judge_n be_v not_o to_o regard_v any_o protestation_n that_o be_v otherwise_o but_o to_o execute_v the_o law_n we_o be_v good_a subject_n notwithstanding_o this_o false_a aspersion_n law_n the_o king_n may_v raise_v army_n of_o man_n contrary_a to_o law_n for_o the_o second_o particular_a he_o may_v raise_v army_n of_o man_n against_o law_n that_o you_o see_v plain_o for_o if_o he_o send_v this_o message_n to_o obstruct_v the_o course_n of_o justice_n by_o number_n of_o arm_a man_n be_v not_o these_o man_n illegal_o arm_v for_o it_o appear_v they_o come_v to_o oppose_v the_o law_n a_o great_a offence_n by_o these_o law_n evident_a enough_o here_o likewise_o appear_v the_o truth_n of_o that_o stature_n of_o 11_o h._n 7_o afore_o name_v so_o much_o misinterpret_v by_o evil_a counsel_n about_o his_o majesty_n such_o counsel_n by_o which_o his_o majesty_n be_v seduce_v in_o his_o heart_n and_o mislead_v of_o of_o what_o counsel_n the_o law_n take_v notice_n of_o of_o which_o counsel_n the_o law_n take_v no_o notice_n at_o all_o whilst_o the_o wisdom_n of_o the_o great_a counsel_n of_o the_o king_n and_o kingdom_n so_o by_o law_n deem_v and_o determine_v even_o in_o the_o interpretation_n of_o this_o law_n and_o many_o other_o be_v neglect_v and_o not_o regard_v for_o these_o number_n of_o arm_a man_n come_v with_o the_o king_n seal_v to_o stay_v justice_n yea_o though_o the_o king_n be_v attend_v by_o they_o in_o arm_n be_v capital_a offender_n and_o traitor_n and_o so_o to_o be_v certain_o pronounce_v if_o they_o shall_v forcible_o attempt_v to_o execute_v this_o regal_a command_n though_o the_o king_n person_n be_v attend_v by_o they_o what_o speak_v then_o the_o act_n of_o 11_o h._n 7._o but_o what_o former_a statute_n have_v say_v the_o allegiance_n of_o the_o subject_n may_v be_v decline_v and_o yet_o the_o king_n person_n follow_v in_o the_o war_n for_o the_o regal_a war_n may_v be_v unjust_a upon_o all_o these_o statute_n and_o so_o it_o be_v clear_a to_o any_o rational_a man_n i_o be_o sorry_a to_o unfold_v these_o hide_a and_o secret_a mystery_n of_o the_o law_n thus_o far_o for_o i_o do_v unfeigned_o honour_v the_o king_n but_o amicus_fw-la socrates_n &_o anicus_fw-la plato_n sed_fw-la magis_fw-la amica_fw-la veritas_fw-la for_o the_o three_o particular_a that_o the_o judge_n be_v to_o suppress_v this_o illegal_a power_n i_o need_v not_o much_o trouble_n you_o withal_o for_o otherwise_o the_o word_n of_o these_o statute_n be_v idle_a and_o illusory_a law_n regal_a force_n not_o warrant_v by_o law_n be_v clear_o to_o be_v suppress_v by_o these_o law_n how_o can_v the_o judge_n proceed_v to_o judgement_n if_o these_o man_n that_o come_v to_o stay_v the_o course_n of_o justice_n be_v not_o hinder_v in_o the_o execution_n of_o this_o illegal_a command_n the_o sense_n of_o the_o law_n to_o be_v thus_o upon_o these_o statute_n he_o that_o run_v may_v read_v i_o intend_v no_o more_o but_o by_o way_n of_o supposion_n but_o in_o respect_n that_o application_n be_v necessary_a in_o these_o distract_a time_n nota._n application_n &_o nota._n and_o useful_a in_o all_o discourse_n in_o regard_n that_o our_o opposite_n will_v say_v and_o clamour_n too_o that_o none_o of_o these_o law_n be_v in_o question_n there_o be_v no_o violation_n of_o they_o therefore_o you_o shall_v see_v that_o in_o our_o unhappy_a time_n all_o these_o afore_o recite_v particular_n be_v verify_v the_o king_n do_v err_v in_o his_o judgement_n his_o command_n be_v contrary_a to_o law_n witness_v the_o king_n command_v to_o apprehend_v the_o member_n of_o the_o house_n of_o commons_o contrary_a to_o their_o law_n and_o privilege_n and_o to_o try_v they_o upon_o remember_v and_o that_o statute_n be_v not_o in_o force_n as_o you_o may_v perceive_v in_o this_o treatise_n former_o what_o need_v i_o say_v more_o nota._n nota._n commission_n have_v be_v send_v under_o the_o great_a seal_n to_o array_n the_o city_n of_o london_n and_o other_o place_n of_o this_o kingdom_n to_o take_v up_o arm_n against_o the_o judge_n of_o that_o high_a court_n of_o parliament_n to_o hinder_v justice_n and_o judgement_n as_o these_o statute_n afore_o mention_n shall_v not_o these_o judge_n proceed_v to_o do_v right_a
