law_n shall_v be_v allow_v and_o be_v it_o further_o enact_v that_o if_o any_o person_n or_o person_n within_o this_o province_n and_o dependency_n not_o be_v thereunto_o due_o liseâ—ced_v shall_v at_o any_o time_n hereafter_o presume_v to_o sell_v by_o retail_n the_o liquor_n aforesaid_a that_o be_v to_o say_v less_o quantity_n at_o one_o time_n than_o fifteen_o gallon_n the_o person_n so_o offend_v shall_v forfeit_v and_o pay_v the_o sum_n of_o five_o pound_n for_o every_o such_o offence_n be_v thereof_o convict_v by_o the_o oath_n of_o two_o or_o more_o substantial_a evidence_n to_o be_v sue_v and_o employ_v for_o in_o such_o manner_n and_o proportion_n as_o be_v last_o aforesaid_a and_o be_v it_o further_o enact_v that_o all_o master_n and_o commander_n of_o ship_n sloop_n boat_n or_o any_o other_o vessel_n belong_v to_o this_o province_n and_o its_o dependency_n shall_v repair_v to_o the_o say_a customhouse_n or_o other_o place_n or_o place_n that_o shall_v be_v appoint_v for_o that_o purpose_n and_o there_o enter_v into_o bond_n of_o one_o hundred_o pound_n that_o they_o shall_v not_o direct_o or_o indirect_o take_v on_o board_n or_o carry_v away_o out_o of_o this_o province_n and_o dependency_n any_o of_o the_o aforesaid_a good_n or_o merchandize_n without_o pay_v such_o custom_n and_o duty_n as_o be_v before_o express_v provide_v also_o that_o all_o indian_a trader_n throughout_o the_o whole_a province_n and_o dependency_n do_v pay_v for_o the_o value_n of_o each_o hundred_o pound_n prime_a cost_n they_o so_o traffic_n with_o the_o indian_n the_o sum_n of_o ten_o pound_n money_n aforesaid_a always_o provide_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o good_n merchandise_n wine_n rum_o brandy_n and_o other_o distil_a liquor_n for_o which_o the_o duty_n in_o this_o act_n mention_v be_v pay_v or_o secure_v to_o be_v pay_v at_o the_o importation_n be_v export_v out_o of_o this_o province_n within_o six_o month_n after_o their_o importation_n than_o the_o moiety_n or_o one_o half_a of_o the_o aforesaid_a duty_n in_o this_o act_n mention_v shall_v be_v return_v for_o as_o much_o as_o shall_v be_v so_o export_v the_o exporter_n make_v oath_n in_o the_o custom_n house_n that_o the_o whole_a duty_n have_v be_v whole_o pay_v for_o the_o say_a wine_n and_o liquor_n at_o the_o importation_n and_o that_o there_o have_v be_v no_o fraud_n or_o mixture_n use_v to_o increase_v the_o say_a liquor_n to_o be_v export_v and_o that_o thereupon_o he_o bring_v a_o certificate_n from_o the_o surveyor_n or_o searcher_n that_o the_o say_a wine_n or_o liquor_n be_v according_o ship_v any_o thing_n contain_v here_o unto_o the_o contrary_a in_o any_o way_n notwithstanding_o provide_v always_o that_o this_o act_n and_o all_o thing_n therein_o contain_v shall_v only_o continue_v and_o remain_v in_o force_n for_o the_o time_n and_o space_n of_o two_o year_n next_z and_o after_o the_o publication_n thereof_o and_o no_o long_o any_o thing_n contain_v herein_o to_o the_o contrary_a in_o any_o way_n notwithstanding_o a_o act_n to_o enable_v his_o excellency_n to_o defray_v his_o extraordinary_a expense_n and_o to_o indemnify_v the_o collector_n and_o receiver_n general_n for_o the_o receipt_n of_o several_a sum_n of_o money_n on_o pretence_n of_o custom_n and_o duty_n the_o representative_n convene_v in_o general_a assembly_n be_v very_o sensible_a that_o the_o great_a confusion_n and_o many_o disorder_n that_o be_v in_o the_o province_n on_o your_o excellency_n arrival_n must_v needs_o occasion_n unto_o your_o excellency_n a_o extraordinary_a and_o great_a expense_n and_o they_o be_v likewise_o well_o assure_v of_o the_o good_a affection_n your_o excellency_n have_v for_o the_o inhabitant_n of_o this_o province_n and_o for_o the_o great_a care_n your_o excellency_n have_v take_v for_o the_o conserve_n the_o peace_n thereof_o and_o forasmuch_o as_o their_o majesty_n collector_n and_o receiver_n general_n have_v since_o the_o 29_o of_o january_n exclusive_a last_o pass_v receive_v from_o the_o inhabitant_n of_o this_o province_n several_a sum_n of_o money_n for_o duty_n custom_n and_o other_o imposition_n former_o accustom_v to_o be_v take_v but_o not_o warrantable_a by_o the_o law_n for_o the_o removal_n of_o the_o many_o controversy_n and_o dispute_n that_o may_v arise_v hereby_o and_o also_o for_o the_o better_a defray_v the_o extraordinary_a expense_n your_o excellency_n have_v be_v at_o do_v pray_v that_o it_o say_a excellency_n when_o he_o shall_v be_v thereunto_o require_v all_o and_o every_o of_o the_o say_a sum_n and_o sum_n of_o money_n so_o by_o he_o receive_v within_o and_o during_o the_o time_n plaint_n or_o information_n wherein_o no_o essoyn_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v and_o also_o all_o such_o good_n as_o shall_v be_v land_a without_o entry_n make_v as_o aforesaid_a shall_v be_v in_o like_a manner_n forfeit_v one_o three_o unto_o their_o majesty_n one_o three_o to_o be_v governor_n and_o one_o three_o to_o the_o informer_n to_o be_v sue_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o master_n of_o ship_n or_o vessel_n that_o be_v within_o this_o province_n and_o do_v not_o belong_v unto_o the_o same_o or_o any_o part_n thereof_o and_o bind_v to_o any_o port_n within_o or_o without_o this_o province_n shall_v before_o they_o take_v any_o merchandise_n above_o express_v come_v to_o such_o place_n or_o place_n as_o shall_v be_v appoint_v for_o the_o collect_v the_o rate_n and_o duty_n establish_v by_o this_o act_n and_o there_o make_v entry_n and_o report_n of_o their_o design_n and_o enter_v into_o bond_n to_o the_o value_n of_o one_o thousand_o pound_n currant_n money_n of_o new_a york_n with_o sufficient_a surety_n that_o they_o shall_v not_o take_v on_o board_n direct_o or_o indirect_o any_o good_n or_o merchandise_n afore_o recite_v and_o express_v without_o such_o permit_v or_o certificate_n from_o the_o collector_n or_o any_o have_a authority_n under_o he_o for_o the_o same_o and_o if_o they_o do_v take_v on_o board_n any_o good_n or_o merchandise_n afore_o recite_v and_o express_v contrary_a to_o the_o true_a intent_n and_o meaning_n o_o f_o this_o act_n than_o they_o shall_v forfeit_v their_o say_a bond_n to_o be_v sue_v within_o three_o month_n after_o such_o fact_n commit_v or_o otherwise_o to_o be_v void_a and_o of_o no_o force_n and_o virtue_n and_o all_o master_n of_o ship_n sloop_n boat_n or_o any_o other_o vessel_n belong_v to_o this_o province_n and_o its_o dependency_n shall_v once_o in_o the_o year_n repair_v to_o the_o customhouse_n merchandise_n without_o make_v entry_n thereof_o or_o pay_v the_o rate_n and_o duty_n aforesaid_a than_o the_o say_a bond_n shall_v be_v forfeit_v and_o for_o the_o due_a and_o orderly_o collect_v of_o all_o duty_n of_o excise_n hereby_o give_v and_o grant_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o retailer_n of_o wine_n rum_o brandy_n or_o any_o other_o from_o liquor_n within_o this_o province_n or_o dependency_n shall_v upon_o their_o purchase_n and_o receipt_n of_o all_o such_o liquor_n or_o liquor_n before_o express_v and_o exciseable_a come_v to_o the_o office_n or_o office_n of_o the_o excise_n and_o there_o or_o with_o he_o make_v entry_n of_o all_o such_o liquor_n or_o liquor_n as_o they_o shall_v buy_v or_o receive_v and_o pay_v such_o duty_n as_o be_v hereby_o appoint_v within_o twenty_o four_o hour_n or_o at_o such_o convenient_a time_n as_o the_o officer_n of_o the_o excise_n shall_v appoint_v and_o on_o default_n thereof_o all_o such_o liquor_n as_o shall_v be_v find_v in_o any_o retailers_n house_n or_o warehouse_n cellar_n or_o other_o place_n belong_v unto_o he_o within_o this_o province_n or_o dependency_n and_o have_v not_o be_v due_o enter_v and_o pay_v the_o duty_n and_o excise_n as_o aforesaid_a then_o and_o in_o such_o case_n upon_o the_o testimony_n of_o two_o evidence_n before_o any_o justice_n of_o the_o peace_n within_o this_o province_n and_o dependency_n the_o say_a retailer_n or_o retailer_n so_o offend_v in_o the_o premise_n shall_v forfeit_v all_o such_o liquor_n and_o three_o time_n the_o value_n thereof_o one_o three_o to_o their_o majesty_n one_o three_o to_o the_o governor_n and_o one_o three_o to_o the_o informer_n who_o shall_v prosecute_v the_o same_o before_o any_o justice_n of_o the_o peace_n throughout_o this_o province_n and_o dependency_n who_o be_v hereby_o authorize_v and_o impower_v to_o hear_v and_o determine_v the_o same_o and_o if_o need_v be_v to_o issue_v out_o their_o warrant_n for_o the_o seize_v and_o condemn_v of_o all_o such_o liquor_n forfeit_v as_o aforesaid_a and_o for_o commit_v to_o goal_n all_o such_o retailer_n of_o liquor_n who_o have_v not_o enter_v and_o pay_v the_o duty_n of_o excise_n in_o manner_n aforesaid_a there_o to_o remain_v without_o bail_n or_o mainprize_n until_o they_o shall_v satisfy_v and_o make_v payment_n of_o three_o time_n the_o value_n of_o such_o liquor_n seize_v and_o forfeit_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n within_o this_o province_n and_o dependency_n not_o be_v due_o lisence_v shall_v at_o any_o time_n hereafter_o presume_v to_o sell_v by_o retail_n any_o the_o liquor_n aforesaid_a that_o be_v to_o say_v a_o less_o quantity_n at_o one_o time_n than_o five_o gallon_n the_o person_n so_o offend_v shall_v forfeit_v and_o pay_v the_o sum_n of_o five_o pound_n currant_n money_n aforesaid_a for_o every_o such_o offence_n be_v thereof_o convict_v by_o the_o oath_n of_o two_o or_o more_o evidence_n to_o be_v sue_v as_o aforesaid_a before_o any_o justice_n of_o the_o peace_n throughout_o the_o province_n and_o to_o be_v employ_v in_o such_o manner_n and_o proportion_n as_o aforesaid_a always_o provide_v and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o no_o retailer_n of_o liquor_n under_o five_o gallon_n or_o any_o other_o that_o sell_v any_o liquor_n or_o strong_a liquor_n shall_v take_v any_o such_o liquor_n into_o their_o house_n cellar_n or_o warehouse_n or_o into_o any_o other_o place_n belong_v unto_o they_o in_o new-york_n and_o albany_n but_o by_o the_o hand_n of_o the_o swear_a porter_n under_o the_o penalty_n aforesaid_a to_o be_v sue_v and_o recover_v for_o the_o use_v aforesaid_a in_o manner_n and_o form_n as_o aforesaid_a always_o provide_v and_o it_o be_v hereby_o understand_v that_o there_o shall_v no_o duty_n be_v pay_v nor_o forfeiture_n upon_o any_o good_n or_o merchandise_n that_o be_v not_o land_v within_o this_o province_n and_o dependency_n always_o provide_v that_o all_o merchant_n qualify_v to_o trade_n by_o the_o act_n of_o navigation_n and_o regulate_v the_o plantation_n trade_n come_v into_o this_o province_n or_o any_o part_n thereof_o be_v well_o and_o honest_o treat_v and_o demean_v for_o such_o thing_n as_o by_o this_o act_n be_v grant_v without_o oppression_n to_o be_v do_v to_o they_o pay_v the_o duty_n aforesaid_a a_o act_n for_o the_o establish_n court_n of_o judicature_n for_o the_o ease_n and_o benefit_n of_o each_o respective_a city_n town_n and_o county_n within_o this_o province_n whereas_o the_o act_n for_o settle_v court_n of_o judicature_n within_o this_o province_n do_v expire_v by_o its_o own_o limitation_n in_o april_n next_o and_o whereas_o the_o orderly_a regulation_n and_o the_o establishment_n of_o court_n of_o justice_n throughout_o this_o province_n as_o well_o in_o respect_n of_o time_n as_o place_n do_v tend_v very_o much_o to_o the_o honour_n and_o dignity_n of_o the_o crown_n as_o well_o as_o to_o the_o ease_n and_o benefit_n of_o the_o subject_a be_v it_o therefore_o enact_v by_o the_o governor_n and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o every_o justice_n of_o the_o peace_n that_o reside_v within_o any_o town_n or_o county_n within_o this_o province_n be_v hereby_o full_o impower_v and_o authorize_v to_o have_v cognizance_n of_o all_o cause_n case_n of_o debt_n and_o trespass_n to_o the_o value_n of_o forty_o shilling_n or_o under_o which_o causos_n and_o case_n shall_v be_v hear_v try_v and_o final_o city_n of_o new-york_n who_o be_v only_o exempt_v from_o public_a service_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n whatsoever_o or_o body_n politic_a or_o corporate_a other_o than_o the_o post_n master_n general_n aforesaid_a shall_v presume_v to_o carry_v re-carry_a or_o deliver_v letter_n for_o hire_n other_o than_o as_o before_o except_v or_o to_o set_v up_o or_o employ_v any_o foot-post_n horse-post_n or_o packet_n boat_n whatsoever_o for_o the_o carry_v convey_v and_o recarrying_a of_o any_o letter_n or_o pacquâ—ts_n by_o information_n wherein_o no_o essoyn_n protection_n or_o wager_n of_o law_n shall_v be_v admit_v one_o half_a of_o the_o say_a forfeiture_n to_o the_o governor_n and_o the_o other_o half_a to_o the_o postmaster_n general_n who_o shall_v sue_v and_o prosecute_v the_o same_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o letter_n and_o pacquet_n that_o by_o any_o master_n of_o any_o ship_n or_o vessel_n or_o any_o of_o his_o company_n or_o any_o passenger_n therein_o shall_v or_o may_v be_v bring_v to_o this_o port_n of_o new-york_n other_o than_o such_o letter_n as_o be_v before_o except_v shall_v by_o such_o master_n passenger_n or_o other_o person_n be_v forthwith_o deliver_v unto_o the_o postmaster_n of_o new-york_n for_o the_o time_n be_v or_o unto_o his_o servant_n or_o servant_n and_o by_o he_o or_o they_o to_o be_v deliver_v according_a to_o the_o several_a and_o respective_a direction_n of_o the_o same_o provide_v that_o no_o letter_n go_v up_o or_o come_v down_o hudson_n river_n &_o go_v to_o or_o from_o long-island_n shall_v be_v carry_v to_o the_o post-office_n any_o thing_n herein_o contain_v to_o the_o contrary_a hereof_o notwithstanding_o provide_v always_o that_o nothing_o herein_o mention_v shall_v be_v in_o force_n long_o than_o three_o year_n next_o and_o after_o the_o publication_n hereof_o any_o thing_n to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o satisfy_n and_o pay_v the_o debt_n of_o the_o government_n the_o representative_n convene_v in_o general_a assembly_n be_v willing_a that_o all_o such_o as_o have_v advance_v money_n for_o the_o support_n of_o the_o government_n shall_v be_v well_o and_o true_o pay_v and_o satisfy_v and_o for_o that_o purpose_n shall_v be_v levy_v and_o collect_v and_o be_v only_o appropriate_v and_o apply_v to_o the_o payment_n of_o such_o debt_n due_a for_o the_o support_n of_o the_o government_n aforesaid_a and_o the_o say_a rate_n and_o duty_n herein_o aftermentioned_a hereby_o authorize_v to_o be_v levy_v and_o collect_v shall_v be_v quarterly_o pay_v to_o such_o person_n or_o person_n who_o be_v now_o the_o present_a creditor_n &_o have_v advance_v their_o money_n as_o aforesaid_a their_o executor_n administrator_n or_o assign_v in_o two_o year_n from_o the_o publication_n hereof_o in_o eight_o money_n of_o new-york_n for_o every_o gallon_n of_o rum_o brandy_n and_o other_o distil_a liquor_n and_o the_o rate_n and_o duty_n of_o thirty_o shilling_n for_o every_o pipe_n of_o wine_n and_o five_o shilling_n for_o every_o hogshead_n of_o malossos_n and_o so_o in_o proportion_n for_o any_o great_a and_o lesser_a quantity_n that_o shall_v be_v import_v into_o this_o province_n and_o dependency_n from_o and_o after_o the_o publication_n hereof_o and_o also_o the_o rate_n and_o duty_n of_o two_o per_fw-la cent._n prime_a cost_n upon_o all_o other_o good_n of_o the_o growth_n production_n or_o manufacture_n of_o europe_n that_o shall_v from_o and_o after_o the_o publication_n hereof_o be_v import_v as_o aforesaid_a and_o also_o the_o rate_n and_o duty_n of_o six_o per_fw-la cent._n prime_a cost_n of_o the_o good_n and_o merchandise_n of_o the_o growth_n production_n &_o manufacture_n of_o europe_n that_o shall_v from_o and_o after_o the_o publication_n hereof_o be_v import_v into_o this_o province_n and_o dependency_n from_o any_o other_o part_n or_o place_n than_o their_o majesty_n kingdom_n of_o england_n dominion_n of_o wales_n and_o town_n of_o berwick_n upon_o tweed_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesad_a that_o the_o several_a rate_n and_o duty_n hereby_o impose_v on_o the_o liquor_n and_o merchandise_n
aforesaid_a shall_v be_v raise_v levy_v collect_v recover_v and_o pay_v unto_o their_o majesty_n collector_n and_o receiver_n general_n for_o the_o time_n be_v during_o the_o term_n before_o mention_v and_o in_o the_o same_o manner_n and_o form_n and_o by_o such_o rule_n allowance_n way_n and_o mean_n and_o under_o such_o penalty_n fine_n and_o forfeiture_n as_o be_v mention_v express_v and_o direct_v in_o and_o by_o one_o act_n of_o general_n assembly_n make_v in_o this_o present_a session_n of_o assembly_n entitle_v a_o act_n for_o establish_v a_o revenue_n to_o defray_v the_o public_a and_o necessary_a charge_n of_o the_o province_n and_o forasmuch_o as_o it_o be_v manifest_a that_o there_o be_v several_a sum_n of_o money_n collect_v and_o receive_v by_o sundry_a person_n and_o not_o pay_v unto_o their_o majesty_n receiver_n general_n and_o also_o that_o there_o be_v several_a person_n that_o continue_v and_o remain_v indebt_v for_o the_o several_a duty_n and_o imposition_n and_o excise_n upon_o liquor_n which_o be_v former_o establish_v by_o the_o late_a government_n for_o defray_v the_o public_a charge_n thereof_o and_o that_o it_o be_v most_o reasonable_a and_o just_a that_o all_o the_o arrear_n of_o the_o same_o shall_v be_v raise_v levy_a collect_v answer_v and_o pay_v unto_o their_o majesty_n receiver_n general_n for_o and_o towards_o the_o debt_n aforesaid_a be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o person_n or_o person_n who_o have_v receive_v any_o sum_n or_o sum_n from_o any_o of_o their_o majesty_n subject_n within_o this_o province_n or_o under_o pretence_n of_o any_o duty_n imposition_n or_o excise_n former_o establish_v by_o the_o late_a government_n from_o the_o 11_o day_n of_o august_n in_o the_o year_n of_o our_o lord_n 1688._o until_o the_o 20_o day_n of_o march_n in_o the_o year_n of_o our_o lord_n 1691._o and_o likewise_o all_o and_o every_o person_n and_o person_n that_o be_v in_o arrear_n for_o any_o of_o the_o duty_n imposition_n or_o excise_n as_o aforesaid_a shall_v within_o four_o calendar_n month_n after_o the_o publication_n hereof_o come_v unto_o their_o majesty_n receiver_n general_n at_o new-york_n and_o there_o account_v with_o he_o for_o all_o and_o every_o sum_n or_o sum_n of_o money_n so_o collect_v and_o receive_v by_o they_o and_o every_o of_o they_o and_o also_o for_o what_o they_o be_v in_o arrear_n for_o any_o of_o the_o duty_n imposition_n or_o excise_n as_o aforesaid_a and_o pay_v the_o same_o unto_o he_o without_o any_o further_a delay_n and_o if_o any_o person_n or_o person_n shall_v refuse_v or_o neglect_v upon_o summons_n of_o their_o majesty_n receiver_n general_n to_o account_v &_o pay_v the_o sum_n of_o money_n find_v due_a in_o arrear_n as_o aforesaid_a it_o shall_v then_o be_v lawful_a for_o their_o majesty_n receiver_n general_n who_o be_v hereby_o authorize_v to_o do_v the_o same_o to_o issue_v out_o his_o warrant_n under_o his_o hand_n and_o seal_n to_o make_v distress_n upon_o the_o good_n and_o chattel_n of_o such_o person_n or_o person_n that_o shall_v be_v find_v indebt_v or_o in_o arrear_n as_o aforesaid_a and_o the_o same_o to_o expose_v to_o sale_n by_o public_a outcry_n and_o the_o produce_v thereof_o to_o take_v until_o he_o be_v satisfy_v for_o the_o sum_n of_o money_n due_a and_o in_o arrear_n as_o aforesaid_a all_o which_o sum_n &_o sum_n of_o money_n so_o receive_v by_o he_o shall_v be_v pay_v and_o employ_v to_o the_o use_v aforesaid_a and_o to_o no_o other_o use_n intent_n or_o purpose_n whatsoever_o and_o all_o the_o act_n and_o ordinance_n make_v by_o the_o late_a governor_n and_o council_n for_o and_o concern_v any_o of_o the_o duty_n imposition_n and_o excise_n aforesaid_a shall_v remain_v and_o continue_v in_o full_a force_n and_o virtue_n until_o all_o the_o say_a sum_n of_o money_n &_o arrear_n due_a thereupon_o be_v full_o pay_v and_o satisfy_v according_a to_o the_o tenor_n of_o this_o act_n any_o thing_n contain_v herein_o or_o in_o any_o other_o act_n to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o provide_v that_o all_o merchant_n and_o other_o who_o be_v to_o pay_v the_o additional_a rate_n and_o duty_n hereby_o establish_v shall_v have_v the_o time_n of_o three_o month_n after_o their_o respective_a entry_n make_v for_o the_o duty_n aforesaid_a for_o the_o payment_n of_o the_o rate_n and_o duty_n aforesaid_a any_o thing_n contain_v to_o the_o contrary_a hereof_o notwithstanding_o act_n pass_v in_o the_o five_o he_o with_o such_o further_a allowance_n for_o his_o pain_n as_o the_o say_a justice_n or_o any_o of_o they_o shall_v judge_v reasonable_a and_o if_o the_o say_a justice_n or_o justice_n shall_v neglect_v to_o issue_v the_o say_a warrant_n he_o or_o they_o respective_o shall_v forfeit_v five_o pound_v currant_n money_n aforesaid_a and_o if_o the_o say_a constable_n or_o any_o of_o they_o under_o the_o degree_n of_o a_o captain_n shall_v be_v to_o the_o respective_a captain_n to_o defray_v the_o charge_n of_o their_o company_n or_o troop_n and_o to_o be_v livy_v before_o the_o next_o exercise_v day_n by_o distress_n and_o sail_n of_o the_o offender_n good_n by_o the_o captain_n warrant_v to_o the_o sergeant_n or_o corporal_n and_o if_o no_o distress_n be_v find_v the_o other_o shall_v contrary_a to_o the_o rule_n above_o prescribe_v break_v bulk_n or_o land_n any_o goâ—dâ—_n or_o merchandise_n whatsoever_o before_o he_o or_o they_o make_v such_o a_o report_n or_o province_n shall_v before_o they_o take_v in_o any_o merchandise_n above_o express_v come_v to_o such_o place_n or_o place_n as_o shall_v be_v appoint_v for_o the_o collect_v the_o rate_n establish_v by_o this_o act_n and_o there_o make_v entry_n and_o report_n of_o their_o design_n and_o enter_v into_o bond_n to_o the_o value_n of_o one_o thousand_o pound_n with_o sufficient_a surety_n that_o he_o or_o they_o shall_v not_o take_v on_o bâ—ard_n direct_o or_o indirect_o without_o such_o permiâ—_n or_o cortestâ—â—â—e_n from_o the_o collector_n or_o some_o one_o have_v authority_n under_o he_o for_o the_o same_o and_o if_o he_o or_o they_o do_v take_v on_o board_n any_o good_n or_o merchandise_n contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o law_n than_o he_o or_o they_o shall_v forfeit_v he_o or_o their_o say_a bond_n to_o be_v sue_v for_o within_o three_o month_n after_o such_o fact_n commit_v oâ—_n otherwise_o to_o be_v void_a and_o of_o none_o effect_n and_o also_o for_o the_o due_a and_o orderly_a collection_n of_o the_o excise_n above_o grant_v be_v it_o hereby_o enact_v by_o the_o authority_n aforesaid_a that_o all_o retailer_n of_o wine_n rum_o brandy_n or_o any_o other_o strong_a liquor_n within_o this_o province_n shall_v upon_o their_o purchase_n and_o receipt_n of_o all_o such_o liquor_n or_o liquor_n before_o express_v or_o exciseable_a come_v to_o the_o office_n or_o officer_n of_o the_o excise_n and_o there_o or_o with_o he_o make_v entry_n of_o all_o such_o liquor_n or_o liquor_n as_o they_o shall_v buy_v and_o receive_v and_o pay_v such_o duty_n as_o be_v hereby_o appoint_v within_o four_o and_o twenty_o hour_n or_o as_o soon_o as_o may_v be_v without_o great_a inconveniency_n provide_v a_o officer_n for_o that_o purpose_n be_v establish_v in_o each_o town_n throughout_o the_o province_n and_o on_o default_n thereof_o all_o such_o liquor_n as_o shall_v be_v find_v in_o any_o retailers_n house_n within_o this_o province_n or_o dependency_n as_o have_v not_o be_v due_o enter_v and_o pay_v the_o rate_n above_o express_v then_o and_o in_o such_o case_n on_o the_o testimony_n of_o two_o or_o more_o substantial_a witness_n the_o say_a retailer_n oâ—_n retâ—llers_n so_o offend_v in_o the_o premise_n shall_v forfeit_v such_o liquor_n and_o in_o case_n the_o value_n thereof_o shall_v be_v under_o the_o sum_n of_o five_o pound_n currant_n money_n aforesaid_a shall_v likewise_o and_o beyond_o forfeit_n pay_v the_o trible_a value_n of_o such_o liquor_n one_o half_a to_o the_o informer_n and_o the_o other_o half_a the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v forthwith_o upon_o the_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freehold_n of_o the_o respective_a place_n for_o the_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o refuse_v to_o take_v oath_n as_o aforesaid_a or_o shall_v in_o any_o way_n deny_v neglect_n or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v refuse_v or_o neglect_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v or_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_v of_o any_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n or_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o detray_n of_o the_o public_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o safe_a of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o neglect_n and_o not_o at_o any_o time_n thereafter_o any_o thing_n herein_o contain_v to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a collector_n of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v the_o liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforemention_v in_o silver_n money_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o currant_n market_n price_n in_o silver_n money_n at_o new-york_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o regulate_v the_o building_n street_n lane_n wharff_n dock_n and_o ally_n of_o the_o city_n of_o new-york_n whereas_o the_o city_n of_o new-york_n and_o metropolis_n of_o this_o province_n be_v chief_o erect_v by_o the_o inhabitant_n thereof_o for_o the_o propagate_a and_o encouragement_n of_o trade_n and_o commerce_n and_o for_o the_o good_a benefit_n
the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a say_v that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respestive_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o be_v or_o they_o shall_v make_v fine_a or_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o whereas_o there_o have_v be_v great_a neglect_n in_o the_o justice_n of_o the_o peace_n collector_n and_o assessor_n who_o have_v delay_v execute_v their_o respective_a duty_n according_a to_o the_o true_a intent_n and_o meaning_n of_o the_o former_a act_n make_v in_o several_a session_n of_o this_o present_a assembly_n for_o the_o prevention_n of_o the_o like_a for_o the_o future_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v neglect_n or_o delay_n to_o have_v their_o respective_a quota_fw-la or_o proportion_n of_o man_n at_o the_o city_n of_o new-york_n or_o at_o the_o city_n of_o albany_n on_z or_o before_o the_o 20_o day_n of_o may_n now_o next_o ensue_v pursuant_n to_o the_o warrant_v direct_v to_o they_o from_o the_o commander_n in_o chief_a as_o aforesaid_a and_o also_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v delay_n or_o neglect_v to_o make_v payment_n of_o the_o several_a respective_a sum_n or_o proportion_n of_o money_n by_o they_o respective_o to_o be_v pay_v as_o aforesaid_a at_o the_o time_n and_o place_n above_o mention_v and_o appoint_v that_o then_o and_o for_o every_o day_n after_o the_o say_a day_n aforementioned_a and_o appoint_v for_o the_o payment_n thereof_o or_o until_o the_o whole_a sum_n and_o proportion_n of_o each_o respective_a city_n and_o county_n shall_v be_v full_o pay_v and_o satisfy_v such_o city_n and_o county_n or_o county_n that_o shall_v be_v defective_a therein_o shall_v each_o and_o every_o of_o they_o forfeit_v and_o pay_v for_o the_o intent_n aforesaid_a the_o far_a sum_n of_o five_o pound_n â—urrant_n money_n aforesaid_a for_o each_o day_n default_n or_o neglect_v of_o have_v their_o quota_fw-la of_o man_n or_o payment_n of_o their_o respective_a proportion_n at_o the_o time_n appoint_v and_o for_o the_o enable_v the_o commander_n in_o chief_a to_o borrow_v money_n or_o to_o agree_v for_o provision_n for_o the_o maintain_n of_o the_o two_o company_n aforesaid_a that_o the_o purpose_n of_o this_o act_n may_v be_v true_o attend_v and_o execute_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n or_o person_n to_o advance_v &_o lend_v to_o the_o commander_n in_o chief_a etc._n etc._n upon_o the_o credit_n of_o this_o act_n any_o sum_n or_o sum_n of_o money_n not_o exceed_v the_o sum_n of_o 700_o l._n and_o to_o have_v and_o receive_v for_o the_o forbearance_n of_o all_o such_o money_n as_o shall_v be_v lend_v interest_n not_o exceed_v the_o rate_n of_o ten_o per_fw-la cent._n per_fw-la annum_fw-la and_o to_o the_o end_n that_o all_o money_n and_o provision_n which_o shall_v be_v so_o lend_v unto_o the_o commander_n in_o chief_a etc._n etc._n may_v be_v well_o and_o sufficient_o secure_v out_o of_o the_o money_n arise_v and_o payable_a by_o this_o act_n with_o the_o interest_n for_o the_o same_o not_o exceed_v ten_o per_n cent._n per_fw-la annum_fw-la as_o aforesaid_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o their_o majesty_n collector_n and_o receiver_n general_n for_o the_o time_n be_v shall_v separate_v and_o keep_v apart_o all_o the_o money_n arise_v by_o the_o rate_n &_o proportion_n hereby_o grant_v as_o the_o same_o shall_v arise_v and_o be_v pay_v unto_o he_o by_o the_o receiver_n or_o collector_n of_o the_o same_o or_o by_o any_o other_o person_n whatsoever_o
sixty_o pound_n currant_n money_n of_o this_o province_n be_v lay_v assess_v raise_v and_o levy_v upon_o all_o and_o every_o the_o inhabitant_n resident_n and_o freeholder_n of_o and_o in_o this_o province_n for_o the_o pay_v and_o maintain_v of_o the_o say_v two_o hundred_o and_o twenty_o man_n and_o their_o proper_a officer_n together_o with_o the_o incidental_a charge_n that_o shall_v arise_v thereon_o for_o seven_o kalendary_a month_n as_o aforesaid_a and_o for_o no_o other_o use_n intent_n or_o purpose_n whatsoever_o to_o be_v lay_v assess_v raise_v levy_v and_o pay_v to_o maintain_v two_o man_n be_v their_o quota_fw-la and_o proportion_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a assess_n raise_v &_o pay_v the_o sum_n of_o two_o thousand_o eight_o hundred_o and_o sixty_o pound_n aforesaid_a the_o mayor_n and_o alderman_n in_o the_o city_n of_o new-york_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a and_o respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o mention_v according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o &_o seal_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o hops_n apple_n pear_n cider_n firewood_n plank_n board_n pleltry_n beaver_n sheep_n wool_n onion_n dress_v and_o undress_v dear_a skin_n honey_n bee_n wax_v bay_a wax_n indian_a corn_n wheat_n barley_n rye_n rease_n or_o any_o other_o sort_n of_o grand_fw-mi or_o any_o other_o thing_n of_o the_o growth_n and_o production_n of_o our_o neighbour_a colony_n and_o plantation_n in_o america_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o there_o he_o also_o give_v and_o grant_v unto_o their_o say_a majesty_n for_o the_o intent_n aforesaid_a upon_o all_o merchandise_n common_o call_v by_o the_o name_n of_o indian_a good_n as_o duffil_n stroads_n blanket_n plain_n half_a thick_n woolen_n stocking_n white_a ozenburgs_n kettles_n hatchet_n ho's_z red_a lead_n vermilion_n cotten_n red_a kersey_n knife_n indian_a haberdashery_n and_o other_o indian_a good_n the_o sum_n of_o five_o pound_n currant_n money_n aforesaid_a for_o every_o hundred_o pound_v province_n and_o dependency_n to_o trade_n or_o traffic_n the_o master_n mate_z or_o purser_n shall_v come_v to_o such_o place_n or_o place_n as_o shall_v be_v appoint_v by_o the_o governor_n for_o the_o time_n be_v and_o there_o make_v report_n of_o all_o such_o parcel_n or_o parcel_n of_o merchandise_n and_o other_o thing_n that_o he_o or_o they_o have_v on_o board_v the_o say_a ship_n or_o city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a and_o respective_a city_n town_n manor_n and_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_n of_o the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o rate_n of_o â—ne_a penny_n per_fw-la pound_n as_o aforesaid_a as_o to_o the_o say_a mayor_n and_o aldermâ—n_n and_o justice_n of_o the_o peace_n shall_v seâ—m_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n and_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n and_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n and_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o the_o assess_v their_o respective_a manor_n and_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n and_o jurisdiction_n as_o shall_v neglect_v and_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n and_o county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o impartial_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n and_o collector_n shall_v deny_v neglect_n or_o unequal_o or_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n aforementioned_a asse_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v &_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o make_v fine_a and_o ransom_n to_o their_o majesty_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o ratify_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o justice_n of_o the_o peace_n for_o the_o city_n or_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattle_n return_v the_o overplus_a if_o any_o every_o article_n and_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v deny_v neglect_n refuse_v or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v or_o execute_v and_o shall_v thereof_o be_v convict_v before_o his_o excellency_n the_o governor_n and_o captain_n general_n and_o council_n or_o before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a and_o imprisonment_n as_o by_o the_o direction_n of_o the_o say_a governor_n and_o captain_n general_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n clause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a and_o imprisonment_n as_o by_o the_o discretion_n of_o the_o say_a governor_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o prosecute_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n clause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v be_v nonsuited_a or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o verdict_n to_o pass_v against_o he_o the_o defendant_n or_o defendant_n shall_v recover_v treble_a cost_v for_o which_o they_o shall_v have_v the_o like_a remedy_n as_o in_o case_n where_o cost_v by_o the_o law_n be_v give_v to_o defendant_n provide_v always_o that_o no_o major_n alderman_n or_o justice_n of_o the_o peace_n shall_v be_v trouble_v sue_v prosecute_v or_o molest_v for_o any_o omission_n offence_n or_o neglect_v by_o virtue_n of_o this_o act_n but_o within_o the_o space_n of_o one_o year_n after_o such_o omission_n offence_n or_o neglect_v and_o not_o at_o any_o time_n hereafter_o any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a collector_n of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforesaid_a in_o currant_n money_n at_o new-york_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o rate_n and_o price_n hereafter_o specify_v and_o express_v to_o wit_n good_a merchantable_a pork_n at_o the_o rate_n of_o fifty_o shilling_n per_fw-la barrel_n the_o barrel_n well_o repacked_a by_o the_o swear_a packer_n at_o new-york_n and_o the_o barrel_n contain_v thirty_o one_o gallon_n and_o half_a winchester_z measure_n at_o least_o beef_n at_o the_o rate_n of_o thirty_o two_o shilling_n and_o six_o penny_n per_fw-la barrel_n well_o repackt_v by_o the_o swear_a packer_n of_o new-york_n aforesaid_a the_o barrel_n to_o contain_v thirty_o one_o gallon_n and_o a_o half_a winchester-measure_n at_o least_o good_a merchantable_a winter_n wheat_n at_o four_o shilling_n per_fw-la bushel_n try_v tallow_n at_o four_o penny_n half_a penny_n per_fw-la pound_n provide_v always_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o it_o shall_v so_o happen_v that_o his_o excellency_n pursuant_n to_o the_o limitation_n aforesaid_a can_v not_o effect_v to_o raise_v so_o many_o volunteer_n in_o manner_n aforesaid_a but_o that_o for_o the_o intent_n aforesaid_a his_o excellency_n shall_v be_v constrain_v to_o make_v proportionable_a detachment_n in_o the_o respective_a city_n and_o county_n within_o this_o province_n to_o complete_a the_o number_n of_o the_o force_n as_o aforesaid_a than_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o there_o shall_v only_o be_v allow_v &_o pay_v unto_o such_o person_n or_o person_n so_o detach_v as_o aforesaid_a for_o the_o service_n aforesaid_a the_o sum_n of_o eight_o penny_n per_fw-la diem_fw-la for_o each_o person_n so_o employ_v as_o aforesaid_a and_o no_o
