empower_v if_o they_o think_v fit_a to_o nominate_v and_o appoint_v one_o or_o more_o able_a and_o sufficient_a person_n within_o the_o bound_n and_o limit_n of_o such_o town_n to_o be_v collector_n of_o the_o money_n due_a to_o their_o majesty_n by_o this_o act_n for_o who_o pay_v unto_o the_o treasurer_n his_o deputy_n or_o deputy_n such_o money_n as_o they_o shall_v be_v charge_v withal_o the_o town_n by_o who_o they_o be_v so_o employ_v shall_v be_v answerable_a and_o it_o be_v further_o enact_v that_o if_o any_o constable_n or_o collector_n shall_v be_v remiss_a and_o negligent_a of_o his_o duty_n in_o not_o levy_v and_o pay_v unto_o the_o treasurer_n his_o deputy_n or_o deputy_n such_o sum_n and_o sum_n of_o money_n as_o from_o time_n to_o time_n he_o shall_v have_v receive_v and_o as_o aught_o by_o he_o to_o have_v be_v pay_v within_o the_o respective_a time_n set_v and_o limit_v by_o the_o warrant_n or_o estreat_n to_o he_o commit_v pursuant_n to_o the_o act_n of_o upon_o demand_n make_v by_o the_o constable_n or_o collector_n of_o the_o town_n place_n or_o precinct_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o constable_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v distrein_o constable_n or_o collector_n power_n to_o distrein_o and_o require_v for_o and_o keep_v the_o say_a distress_n or_o distress_n to_o be_v immediate_o restore_v to_o the_o owner_n and_o if_o any_o person_n or_o person_n assess_v as_o aforesaid_a shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_v thereof_o where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o person_n or_o person_n any_o such_o and_o sum_n of_o money_n not_o exceed_v five_o thousand_o pound_n upon_o the_o credit_n of_o this_o act_n and_o to_o make_v over_o and_o give_v for_o security_n unto_o the_o person_n and_o person_n so_o lend_v the_o one_o three_o part_n of_o the_o money_n grant_v and_o to_o be_v collect_v by_o virtue_n of_o the_o same_o for_o the_o repayment_n of_o the_o money_n that_o shall_v be_v lend_v with_o interest_n for_o forbearance_n after_o the_o rate_n of_o seven_o per_n cent_z per_fw-la annum_fw-la the_o say_a interest_n money_n to_o be_v pay_v at_o the_o end_n of_o every_a three_o month_n until_o repayment_n of_o the_o principal_a and_o whereas_o much_o of_o the_o arrear_n of_o the_o rate_n and_o assessment_n which_o be_v grant_v as_o a_o fund_z for_o the_o bill_n of_o credit_n emit_v by_o the_o late_a government_n of_o the_o massachusetts_n coleny_n have_v be_v and_o be_v daily_o bring_v in_o to_o their_o majesty_n treasury_n of_o this_o their_o province_n payment_n bill_n of_o credit_n make_v carrant_v in_o public_a payment_n and_o employ_v in_o payment_n or_o the_o public_a debt_n thereof_o there_o be_v but_o few_o of_o those_o bill_n now_o stand_v out_o except_o what_o be_v borrow_v by_o the_o present_a government_n it_o be_v therefore_o enact_v that_o all_o the_o say_a bill_n as_o well_o those_o not_o endors't_n as_o other_o shall_v be_v receive_v in_o payment_n of_o all_o tax_n or_o assessment_n and_o other_o public_a payment_n whatsoever_o at_o five_o pound_n per_fw-la centum_fw-la advance_v any_o act_n or_o law_n to_o the_o contrary_a notwithstanding_o and_o that_o those_o that_o have_v lend_v their_o bill_n to_o the_o treasury_n shall_v have_v the_o same_o allowance_n of_o five_o pound_n per_fw-la centum_fw-la for_o so_o much_o as_o shall_v be_v repay_v they_o by_o discount_n bona_fw-la fide_fw-la on_o their_o own_o account_n with_o the_o treasurer_n for_o rate_n impost_n or_o excise_n a_o act_n for_o the_o better_a secure_v the_o liberty_n of_o the_o subject_a and_o for_o prevention_n of_o illegal_a imprisonment_n for_o the_o speedy_a relief_n of_o all_o person_n imprison_v for_o criminal_a or_o suppose_a criminal_a matter_n in_o such_o case_n where_o by_o law_n they_o be_v bailable_a be_v it_o enact_v by_o the_o governor_n council_n and_o representative_n in_o general_a assembly_n convene_v and_o it_o be_v enact_v by_o the_o authority_n of_o the_o same_o that_o whensoever_o any_o person_n or_o person_n shall_v bring_v any_o habeas_fw-la corpus_fw-la direct_v unto_o any_o sheriff_n or_o sheriff_n goaler_n minister_n or_o other_o person_n whatsoever_o for_o any_o person_n in_o he_o or_o their_o custody_n and_o the_o say_a writ_n shall_v be_v serve_v upon_o the_o say_a officer_n or_o leave_v at_o the_o goal_n or_o prison_n with_o any_o of_o the_o under-officer_n etc._n writ_n of_o habeas_fw-la corpus_fw-la within_o
pain_n of_o forfeit_v the_o sum_n of_o forty_o shilling_n for_o every_o such_o offence_n upon_o due_a conviction_n thereof_o gamester_n penalty_n on_o gamester_n the_o say_v fine_a to_o be_v dispose_v of_o as_o aforesaid_a and_o every_o person_n convict_v of_o play_v as_o aforesaid_a in_o any_o such_o house_n or_o dependence_n thereof_o shall_v forfeit_v the_o sum_n of_o six_o shilling_n and_o eight_o penny_n to_o be_v dispose_v of_o as_o aforesaid_a and_o further_o it_o be_v enact_v by_o the_o authority_n aforesaid_a licence_n penalty_n for_o refuse_v to_o give_v evidence_n against_o person_n sell_v without_o licence_n that_o any_o person_n due_o summon_v to_o give_v in_o evidence_n respect_v the_o breach_n of_o this_o act_n in_o any_o of_o the_o branch_n thereof_o other_o than_o the_o party_n himself_o his_o child_n or_o servant_n that_o shall_v refuse_v to_o give_v in_o upon_o his_o oath_n when_o so_o require_v what_o he_o know_v relate_v to_o the_o premise_n shall_v forfeit_v forty_o shilling_n to_o the_o use_n of_o the_o poor_a of_o the_o town_n as_o aforesaid_a and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o justice_n of_o the_o peace_n in_o the_o county_n where_o he_o dwell_v act_n one_o justice_n may_v hear_v &_o determine_v all_o offence_n against_o this_o act_n as_o well_o as_o the_o justice_n in_o quarter_n session_n be_v hereby_o respective_o empower_v to_o hear_v and_o determine_v all_o offence_n against_o this_o act_n and_o may_v commit_v the_o offender_n to_o prison_n until_o he_o pay_v the_o say_v hogshead_n and_o so_o proportionable_o for_o great_a or_o lesser_a quantity_n and_o that_o there_o be_v pay_v by_o those_o that_o sell_v any_o of_o the_o say_a wine_n by_o retail_n the_o sum_n of_o council_n and_o representative_n in_o general_a court_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o oath_n in_o say_a act_n mention_v and_o thereby_o appoint_v to_o be_v take_v in_o stead_n of_o the_o oath_n of_o allegiance_n and_o supremacy_n oath_n all_o male_a person_n of_o 18_o year_n and_o upward_o to_o take_v the_o oath_n and_o each_o of_o they_o be_v and_o shall_v be_v forthwith_o administer_v and_o give_v unto_o all_o male_a person_n of_o the_o age_n of_o eighteen_o year_n or_o above_o inhabit_v or_o reside_v in_o any_o town_n or_o place_n within_o this_o province_n that_o have_v not_o already_o take_v the_o same_o and_o shall_v make_v it_o so_o appear_v by_o his_o excellency_n the_o governor_n or_o the_o lieutenant_n or_o deputy_n governor_n down_o to_o the_o say_a person_n or_o person_n so_o tend_v the_o say_a oath_n or_o either_o of_o they_o such_o sum_n of_o money_n not_o exceed_v forty_o shilling_n as_o the_o say_a person_n or_o for_o each_o hundred_o pound_n in_o value_n and_o so_o proportionable_o and_o where_o any_o fermer_n or_o occupier_n of_o house_n or_o land_n lie_v within_o any_o town_n or_o precinct_n shall_v be_v regulate_v and_o perfect_v as_o aforesaid_a and_o sign_v by_o the_o select_a man_n and_o town_n commissioner_n shall_v be_v deliver_v unto_o the_o commissioner_n for_o such_o county_n and_o by_o they_o bring_v to_o boston_n upon_o the_o first_o wednesday_n in_o march_n next_o where_o the_o commissioner_n for_o each_o county_n or_o the_o major_a part_n of_o they_o then_o and_o there_o meet_v shall_v be_v a_o committee_n to_o take_v a_o account_n of_o the_o sum_n total_a of_o each_o list_n and_o if_o the_o whole_a shall_v not_o amount_v to_o the_o sum_n of_o thirty_o thousand_o pound_n include_v the_o sum_n already_o return_v unto_o the_o treasurer_n for_o which_o his_o warrant_n be_v go_v forth_o then_o the_o say_a committee_n be_v hereby_o empower_v to_o make_v a_o further_a
