liquor_n in_o any_o part_n of_o this_o island_n shall_v pay_v for_o the_o say_a licence_n and_o every_o year_n for_o renew_v of_o the_o same_o the_o sum_n of_o five_o pound_n currant_n money_n to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n and_o whosoever_o shall_v presume_v to_o sell_v by_o retail_n any_o of_o the_o strong_a liquor_n as_o aforesaid_a without_o such_o licence_n have_v and_o obtain_v as_o aforesaid_a shall_v forfeit_v for_o every_o such_o offence_n the_o sum_n of_o ten_o pound_n currant_n money_n of_o this_o island_n and_o it_o be_v hereby_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o any_o new_a settler_n or_o comer_n shall_v import_v into_o this_o island_n any_o rum_o sugar_n tobacco_n indigo_n cocoa_n ginger_n or_o cotton_n by_o himself_o or_o any_o other_o person_n or_o person_n for_o he_o or_o their_o better_a conveniency_n in_o settle_v and_o plant_v and_o shall_v not_o only_o declare_v such_o he_o or_o their_o intention_n upon_o oath_n before_o the_o collector_n who_o be_v hereby_o impower_v to_o administer_v the_o same_o at_o the_o time_n of_o importation_n but_o shall_v likewise_o make_v the_o same_o appear_v within_o three_o month_n after_o he_o or_o their_o arrival_n by_o some_o visible_a effect_n which_o he_o or_o they_o shall_v show_v in_o order_n to_o it_o that_o then_o the_o same_o be_v sufficient_o make_v know_v and_o appear_v to_o the_o say_a collector_n or_o receiver_n the_o say_a good_n shall_v not_o be_v chargeable_a with_o any_o duty_n or_o custom_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o the_o say_v new_a comer_n to_o enjoy_v the_o aforesaid_a privilege_n for_o three_o month_n after_o their_o arrival_n provide_v also_o that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o master_n or_o merchant_n of_o any_o ship_n or_o vessel_n to_o land_n or_o put_v on_o shore_n any_o of_o the_o say_a good_n without_o be_v further_o liable_a to_o pay_v any_o duty_n or_o custom_n for_o any_o part_n or_o parcel_n thereof_o more_o than_o what_o he_o shall_v sell_v or_o dispose_v of_o within_o this_o island_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o as_o well_o his_o majesty_n quitrent_n arise_v from_o land_n grant_v or_o to_o be_v grant_v within_o this_o island_n and_o every_o part_n and_o parcel_n thereof_o as_o also_o all_o and_o every_o part_n of_o the_o revenue_n hereby_o grant_v or_o which_o hereafter_o shall_v grow_v due_a by_o virtue_n of_o this_o act_n or_o any_o thing_n herein_o contain_v shall_v be_v apply_v and_o appropriate_v and_o be_v hereby_o appropriate_v to_o the_o support_n of_o the_o government_n of_o this_o his_o majesty_n island_n and_o the_o contingent_a charge_n thereof_o and_o to_o no_o other_o use_n intent_n or_o purpose_n whatsoever_o and_o that_o his_o majesty_n fort_n and_o fortification_n within_o this_o island_n may_v for_o the_o future_a be_v keep_v in_o better_a repair_n and_o if_o his_o majesty_n in_o his_o great_a wisdom_n shall_v think_v convenient_a other_o new_a one_o may_v be_v build_v be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o sum_n of_o one_o thousand_o pound_n per_fw-la annum_fw-la arise_v as_o aforesaid_a be_v during_o the_o term_n of_o seven_o year_n annual_o pay_v and_o appropriate_v unto_o the_o repair_v building_n and_o rebuilding_n of_o his_o majesty_n fort_n and_o fortification_n within_o this_o island_n and_o to_o no_o other_o use_n intent_n and_o purpose_n whatsoever_o and_o the_o same_o be_v hereby_o appropriate_v according_o and_o it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o collector_n or_o receiver-general_n of_o this_o island_n for_o the_o time_n be_v or_o he_o that_o shall_v officiate_v in_o his_o room_n or_o stead_n shall_v annual_o during_o the_o term_n aforesaid_a out_o of_o the_o money_n receive_v by_o virtue_n of_o this_o act_n charge_v down_o the_o say_v one_o thousand_o pound_n so_o as_o aforesaid_a appropriate_v to_o the_o particular_a account_n of_o the_o fortification_n and_o shall_v keep_v a_o distinct_a book_n of_o account_n for_o the_o same_o which_o book_n of_o account_n shall_v be_v free_a and_o open_a at_o all_o office-hour_n for_o any_o person_n to_o view_v the_o same_o without_o pay_v any_o manner_n of_o fee_n therefore_o and_o that_o the_o say_a receiver-general_n or_o his_o deputy_n shall_v when_z and_o as_o often_o as_o thereunto_o require_v by_o the_o governor_n council_n or_o assembly_n when_o sit_v or_o to_o any_o committee_n by_o they_o or_o either_o of_o they_o to_o be_v appoint_v give_v in_o upon_o oath_n which_o oath_n they_o be_v hereby_o empower_v to_o administer_v a_o just_a and_o true_a account_n of_o the_o particular_a disbursement_n out_o of_o the_o thousand_o pound_n per_fw-la annum_fw-la so_o appropriate_v as_o aforesaid_a and_o that_o the_o say_a receiver-general_n shall_v with_o good_a and_o sufficient_a security_n such_o as_o shall_v be_v approve_v of_o by_o the_o governor_n and_o a_o quorum_fw-la of_o the_o council_n enter_v into_o bond_n in_o the_o penalty_n of_o five_o thousand_o pound_n which_o bond_n shall_v lie_v in_o the_o secretary_n office_n to_o be_v sue_v in_o manner_n and_o form_n as_o be_v direct_v in_o a_o act_n require_v all_o master_n of_o ship_n and_o vessel_n to_o give_v security_n in_o the_o secretary_n office_n under_o the_o condition_n hereafter_o express_v that_o be_v to_o say_v the_o condition_n of_o this_o obligation_n be_v such_o that_o if_o the_o above_o bind_v a.b._n collector_n or_o receiver-general_n shall_v well_o and_o true_o account_v for_o as_o often_o as_o he_o shall_v be_v thereunto_o require_v by_o the_o governor_n for_o the_o time_n be_v and_o a_o quorum_fw-la of_o the_o council_n or_o a_o committee_n of_o the_o assembly_n all_o and_o every_o such_o sum_n and_o sum_n of_o money_n which_o either_o have_v or_o shall_v come_v to_o his_o hand_n either_o by_o virtue_n of_o a_o act_n entitle_v a_o act_n for_o raise_v a_o public_a impost_n make_v at_o a_o assembly_n hold_v by_o prorogation_n the_o four_o day_n of_o october_n in_o the_o thirty_o three_o tear_n of_o his_o majesty_n four_o year_n of_o his_o majesty_n reign_n that_o now_o be_v or_o any_o other_o act_n or_o act_n whatsoever_o as_o also_o well_o and_o true_o to_o pay_v the_o sum_n of_o one_o thousand_o pound_n yearly_a and_o every_o year_n for_o and_o during_o the_o time_n the_o aforesaid_a act_n make_v in_o the_o thirty_o four_o year_n of_o the_o king_n reign_n entitle_v a_o act_n for_o raise_v a_o public_a impost_n shall_v be_v in_o force_n by_o warrant_n of_o the_o governor_n with_o the_o advice_n and_o consent_n of_o a_o quorum_fw-la of_o the_o council_n for_o and_o towards_o the_o repair_v bar_n to_o the_o right_n and_o title_n of_o his_o majesty_n his_o heir_n and_o successor_n and_o to_o the_o end_v his_o majesty_n grant_n may_v not_o be_v hinder_v delay_v or_o obstruct_v the_o keeper_n of_o the_o seal_n or_o chancellor_n for_o the_o time_n be_v shall_v and_o be_v hereby_o oblige_v the_o next_o tuesday_n before_o each_o grand_a court_n to_o cause_v all_o such_o grant_n and_o his_o heir_n or_o successor_n upon_o survey_v make_v or_o to_o be_v make_v be_v for_o ever_o good_a to_o the_o patentee_n and_o to_o those_o to_o who_o the_o right_a of_o the_o patentee_n shall_v come_v for_o all_o land_n comprise_v within_o the_o survey_n or_o bound_n any_o misnomer_n misbound_v or_o mistake_v of_o quantity_n or_o other_o error_n notwithstanding_o against_o his_o majesty_n his_o heir_n and_o successor_n or_o any_o other_o person_n or_o person_n claim_v under_o he_o or_o they_o for_o ever_o and_o that_o all_o such_o grant_n shall_v be_v take_v as_o strong_o against_o his_o majesty_n his_o heir_n and_o successor_n as_o the_o grant_n of_o any_o other_o person_n or_o person_n shall_v or_o ought_v to_o be_v take_v against_o he_o or_o they_o or_o his_o or_o their_o of_o his_o majesty_n justice_n of_o the_o peace_n upon_o which_o re-survey_a a_o confirmation_n of_o the_o former_a grant_n shall_v issue_v under_o the_o seal_n of_o this_o island_n recite_v the_o error_n and_o reserve_v for_o the_o future_a the_o same_o rent_n mention_v in_o the_o say_a grant_n according_a to_o the_o just_a quantity_n find_v by_o such_o re-survey_a for_o which_o confirmation_n the_o chancellor_n shall_v receive_v ten_o shilling_n and_o the_o clerk_n of_o the_o patent_n eight_o shilling_n and_o no_o more_o to_o be_v pay_v as_o all_o other_o charge_n of_o the_o say_v re-survey_a by_o the_o party_n require_v the_o same_o but_o no_o retrospect_n shall_v be_v have_v to_o what_o rent_n ought_v to_o have_v be_v pay_v be_v the_o quantity_n more_o or_o less_o any_o bound_n of_o the_o land_n grant_v any_o law_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o and_o whereas_o there_o have_v be_v uncertainty_n and_o dispute_n in_o the_o payment_n of_o his_o majesty_n quitrent_n reserve_v in_o the_o patent_n former_o grant_v by_o reason_n of_o the_o word_n manure_v and_o plant_v and_o whereas_o his_o say_a majesty_n have_v be_v and_o now_o be_v gracious_o please_v that_o whatsoever_o shall_v arise_v from_o the_o quitrent_n shall_v be_v apply_v towards_o the_o support_n of_o the_o government_n and_o defray_v the_o contingent_a charge_n of_o this_o island_n in_o consideration_n whereof_o and_o to_o ascertain_v the_o same_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o every_o parcel_n or_o parcel_n of_o land_n of_o what_o nature_n and_o quality_n soever_o grant_v and_o patent_v before_o the_o twenty_o five_o day_n of_o june_n one_o thousand_o six_o hundred_o seventy_o and_o one_o shall_v for_o arrear_n and_o grow_a rent_n pay_v for_o every_o thirty_o acre_n annual_o the_o sum_n of_o one_o shilling_n and_o so_o proportionable_o for_o every_o parcel_n under_o one_o hundred_o acre_n and_o for_o every_o hundred_o acre_n two_o shilling_n six_o penny_n and_o proportionable_o for_o a_o great_a quantity_n and_o for_o all_o land_n of_o what_o quality_n soever_o from_o the_o aforesaid_a time_n to_o the_o twelve_o day_n of_o march_n one_o thousand_o six_o hundred_o seventy_o and_o four_o shall_v pay_v one_o half_a penny_n per_fw-la acre_n and_o so_o proportionable_o for_o a_o great_a quantity_n and_o for_o foot-land_n one_o half_a penny_n per_fw-la foot_n for_o two_o side_n of_o the_o square_n add_v together_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n as_o a_o aforesaid_a that_o the_o receiver_n of_o the_o quitrent_n or_o his_o lawful_a deputy_n shall_v twice_o every_o year_n to_o say_v after_o each_o feast_n of_o st._n michael_n the_o archangel_n and_o of_o the_o annunciation_n of_o the_o bless_a virgin_n mary_n keep_v a_o office_n in_o the_o town_n of_o st._n jago_n de_fw-fr la_fw-fr vega_n in_o the_o parish_n of_o st._n catharines_n and_o in_o the_o town_n of_o port_n royal_a during_o the_o space_n of_o one_o month_n at_o each_o place_n and_o then_o and_o there_o to_o receive_v the_o quitrent_n from_o the_o person_n concern_v which_o say_v office_n he_o shall_v attend_v from_o the_o hour_n of_o eight_o to_o eleven_o before_o noon_n and_o from_o the_o hour_n of_o two_o to_o five_o in_o the_o afternoon_n and_o upon_o receipt_n of_o his_o majesty_n quitrent_n thereof_o to_o acquit_v and_o discharge_v all_o person_n on_o the_o penalty_n of_o five_o pound_n sterling_a which_o say_v penalty_n shall_v be_v the_o one_o half_a to_o his_o majesty_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o enact_v by_o the_o authority_n of_o the_o same_o that_o all_o manner_n of_o debt_n trespass_n and_o other_o matter_n not_o exceed_v the_o value_n of_o forty_o shilling_n wherein_o the_o tithe_n of_o land_n be_v not_o concern_v shall_v and_o may_v be_v hear_v adjudge_v and_o determine_v by_o any_o of_o his_o majesty_n justice_n of_o the_o peace_n of_o this_o island_n within_o their_o respective_a precinct_n without_o appeal_n which_o say_v justice_n be_v hereby_o require_v upon_o complaint_n make_v to_o grant_v a_o warrant_n or_o summons_n against_o the_o person_n complain_v of_o thereby_o or_o person_n who_o do_v or_o shall_v utter_v or_o sell_v by_o way_n of_o retail_n madera_n wines_n or_o brandy_n and_o shall_v presume_v by_o any_o mean_n direct_o or_o indirect_o to_o take_v or_o receive_v above_o the_o rate_n hereafter_o mention_v for_o the_o aforesaid_a liquor_n viz._n for_o madera_n wine_n sifteen_fw-mi penny_n the_o quart_n and_o brandy_n two_o shilling_n and_o six_o penny_n the_o quart_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n shall_v forfeit_v the_o sum_n of_o forty_o shilling_n for_o every_o such_o offence_n to_o be_v levy_v by_o warrant_n from_o any_o of_o his_o majesty_n justice_n of_o the_o peace_n of_o the_o precinct_n where_o the_o fault_n be_v commit_v on_o the_o good_n and_o chattel_n of_o any_o person_n or_o person_n of_o the_o use_n of_o one_o of_o his_o limb_n as_o have_v sufficient_o be_v make_v appear_v to_o we_o to_o the_o end_n therefore_o that_o all_o person_n of_o the_o like_a quality_n and_o forwardness_n to_o serve_v the_o country_n may_v for_o the_o future_a receive_v due_a encouragement_n be_v it_o therefore_o enact_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o say_v nicholas_n scarlet_n shall_v in_o compensation_n of_o the_o say_a loss_n and_o damage_n have_v and_o receive_v out_o of_o his_o majesty_n public_a revenue_n a_o yearly_o salary_n of_o ten_o pound_n during_o his_o residence_n in_o this_o island_n which_o say_v sum_n of_o money_n be_v hereby_o appoint_v to_o be_v pay_v by_o the_o receiver_n for_o the_o time_n be_v out_o of_o the_o treasury_n when_o demand_v upon_o penalty_n of_o twenty_o pound_n the_o one_o half_a to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o party_n aggrieve_v to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n where_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v majesty_n royal_a proclamation_n several_a of_o his_o subject_n have_v and_o do_v continual_o go_v off_o from_o this_o his_o majesty_n island_n of_o jamaica_n into_o foreign_a prince_n service_n and_o jurisdiction_n shall_v be_v inquire_v try_v hear_v determine_a and_o judge_v within_o this_o island_n in_o such_o like_a form_n as_o if_o such_o offence_n have_v be_v commit_v in_o and_o upon_o the_o land_n and_o to_o that_o end_n and_o purpose_n commission_n shall_v be_v have_v under_o the_o king_n great_a seal_n of_o this_o island_n direct_v to_o the_o judge_n or_o judge_n of_o the_o admiralty_n of_o this_o island_n for_o the_o time_n be_v and_o to_o such_o other_o substantial_a person_n as_o by_o his_o majesty_n governor_n or_o commander_n in_o chief_a of_o this_o island_n for_o the_o time_n be_v appoint_v by_o commission_n under_o the_o great_a seal_n of_o england_n by_o virtue_n of_o a_o statute_n make_v in_o the_o twenty_o eight_o year_n of_o the_o reign_n of_o king_n henry_n the_o eight_o be_v impower_v to_o do_v and_o execute_v within_o the_o kingdom_n of_o england_n and_o that_o the_o say_v offender_n which_o be_v or_o shall_v be_v apprehend_v in_o or_o bring_v prisoner_n to_o this_o island_n shall_v be_v liable_a to_o such_o order_n process_n judgement_n and_o execution_n by_o virtue_n of_o such_o commission_n to_o be_v ground_v upon_o this_o act_n as_o may_v be_v award_v or_o give_v against_o they_o if_o they_o be_v proceed_v against_o within_o the_o realm_n of_o england_n by_o virtue_n of_o any_o commission_n ground_v upon_o the_o say_a statute_n and_o all_o trial_n heretofore_o have_v against_o such_o criminal_a or_o criminal_n before_o any_o judge_n or_o judge_n by_o virtue_n of_o such_o commission_n or_o authority_n at_o any_o time_n heretofore_o grant_v and_o all_o proceed_n thereupon_o be_v hereby_o ratify_v confirm_v and_o adjudge_v lawful_a and_o all_o such_o judge_n with_o all_o and_o every_o the_o inferior_a officer_n that_o have_v act_v thereby_o be_v hereby_o indemnify_v to_o all_o intent_n and_o purpose_n whatsoever_o and_o in_o case_n they_o or_o any_o of_o they_o shall_v at_o any_o time_n hereafter_o be_v sue_v vex_v molest_a or_o trouble_v for_o any_o such_o their_o proceed_n as_o aforesaid_a he_o or_o they_o so_o sue_v vex_v or_o molest_v shall_v plead_v the_o general_n issue_n and_o give_v this_o act_n in_o evidence_n any_o law_n statute_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o and_o every_o person_n or_o person_n that_o shall_v any_o way_n know_o entertain_v harbour_n conceal_v trade_n or_o hold_v any_o correspondence_n by_o letter_n or_o otherwise_o with_o any_o person_n or_o person_n that_o shall_v be_v deem_v or_o adjudge_v to_o be_v privateer_n pirate_n or_o other_o offender_n within_o the_o construction_n of_o this_o act_n and_o that_o shall_v not_o ready_o endeavour_v to_o the_o best_a of_o his_o or_o their_o power_n to_o apprehend_v or_o cause_n to_o be_v apprehend_v such_o offender_n or_o offender_n shall_v be_v liable_a to_o be_v prosecute_v as_o accessary_n and_o confederate_n and_o to_o suffer_v such_o pain_n and_o penalty_n as_o in_o such_o case_n by_o law_n be_v provide_v and_o for_o the_o better_a and_o more_o effectual_a execution_n of_o this_o act_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o commission-officer_n in_o their_o several_a precinct_n within_o this_o island_n be_v hereby_o require_v and_o empower_v upon_o his_o or_o their_o knowledge_n or_o notice_n give_v that_o any_o privateer_n pirate_n or_o other_o person_n suspect_v to_o be_v upon_o any_o unlawful_a design_n be_v in_o any_o place_n within_o their_o respective_a precinct_n to_o raise_v and_o levy_v such_o a_o number_n of_o well_o arm_a man_n as_o he_o or_o they_o shall_v think_v needful_a for_o the_o seize_v apprehend_v and_o carry_v to_o gaol_n all_o and_o every_o such_o person_n or_o person_n and_o in_o case_n of_o any_o resistance_n or_o refusal_n to_o yield_v obedience_n to_o his_o majesty_n authority_n it_o shall_v be_v lawful_a this_o island_n by_o bill_n plaint_n or_o information_n wherein_o no_o essoign_n wager_n of_o law_n or_o protection_n shall_v be_v allow_v one_o moiety_n thereof_o to_o be_v to_o our_o sovereign_a reasonable_a charge_n repair_v to_o the_o office_n of_o enrolment_n and_o there_o make_v such_o acknowledgement_n as_o aforesaid_a he_o she_o or_o they_o so_o refuse_v shall_v for_o every_o such_o offence_n forfeit_a and_o pay_v unto_o the_o party_n or_o party_n aggrieve_v the_o sum_n of_o fifty_o pound_n currant_n money_n of_o this_o island_n to_o be_v recover_v in_o any_o of_o his_o majesty_n be_v and_o shall_v be_v make_v to_o demand_v and_o receive_v for_o every_o deed_n of_o the_o value_n of_o twenty_o pound_n or_o more_o ten_o shilling_n and_o for_o every_o deed_n under_o the_o value_n of_o twenty_o pound_n five_o shilling_n and_o no_o more_o under_o the_o penalty_n of_o twenty_o pound_n the_o one_o half_a to_o be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o informer_n to_o be_v recover_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o enrolment_n shall_v and_o may_v take_v and_o receive_v for_o enrol_v and_o copy_v a_o ordinary_a deed_n grant_v or_o patent_n for_o one_o or_o more_o parcel_n of_o land_n or_o any_o deed_n or_o conveyance_n not_o exceed_v the_o length_n of_o such_o patent_n five_o shilling_n for_o every_o deed_n exceed_v the_o length_n aforesaid_a eight_o penny_n per_fw-la sheet_n account_v twenty_o line_n to_o a_o sheet_n and_o eight_o word_n to_o a_o line_n for_o every_o short_a write_v not_o exceed_v the_o length_n aforesaid_a twelve_o penny_n for_o record_v every_o plot_n one_o shilling_n and_o three_o penny_n for_o search_v the_o record_n twelve_o penny_n and_o for_o acknowledge_v satisfaction_n in_o the_o margin_n of_o a_o mortgage_n record_v one_o shilling_n and_o three_o penny_n and_o no_o more_o under_o the_o penalty_n of_o ten_o pound_n to_o the_o use_v and_o to_o be_v recover_v as_o aforesaid_a and_o be_v it_o likewise_o enact_v by_o the_o authority_n aforesaid_a that_o all_o patent_n already_o grant_v and_o not_o enrol_v shall_v be_v enrol_v in_o the_o office_n of_o enrolment_n within_o six_o month_n and_o all_o patent_n hereafter_o to_o be_v grant_v shall_v be_v enrol_v within_o six_o month_n after_o the_o seal_v such_o patent_n which_o enrolment_n as_o likewise_o all_o such_o as_o be_v already_o there_o enrol_v shall_v be_v good_a and_o valid_a in_o the_o law_n notwithstanding_o any_o clause_n insert_v in_o the_o say_a patent_n direct_v the_o contrary_a and_o whereas_o it_o be_v most_o manifest_a that_o the_o estate_n of_o several_a orphan_n have_v be_v preserve_v and_o vast_o improve_v by_o be_v during_o their_o minority_n lease_v out_o by_o their_o guardian_n and_o whereas_o it_o may_v be_v disputable_a whether_o such_o lease_n be_v warrant_v by_o the_o law_n of_o england_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o all_o lease_n heretofore_o make_v or_o grant_v or_o that_o hereafter_o shall_v be_v make_v or_o grant_v of_o the_o estate_n of_o any_o orphan_n by_o the_o respective_a guardian_n for_o any_o term_n of_o year_n not_o exceed_v the_o minority_n of_o such_o respective_a orphan_n shall_v be_v good_a and_o valid_a in_o the_o law_n any_o law_n custom_n or_o usage_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o provide_v always_o that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o extend_v to_o contradict_v or_o alter_v any_o power_n give_v or_o to_o be_v give_v by_o the_o parent_n to_o any_o guardian_n or_o to_o give_v liberty_n for_o the_o future_a to_o any_o guardian_n to_o lease_n out_o the_o estate_n of_o any_o heiress_n for_o any_o long_a term_n or_o time_n than_o till_o she_o shall_v complete_a the_o age_n of_o fourteen_o year_n be_v it_o likewise_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o the_o enrolment_n or_o whosoever_o shall_v execute_v the_o say_a office_n for_o the_o time_n be_v do_v find_v two_o sufficient_a surety_n with_o himself_o to_o become_v bind_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n in_o a_o bond_n of_o the_o penalty_n of_o two_o thousand_o pound_n for_o the_o true_a and_o faithful_a execution_n of_o the_o say_a office_n and_o for_o keep_v of_o the_o same_o in_o the_o town_n of_o st._n jago_n de_fw-fr la_fw-fr vega_n as_o be_v herein_o before_o declare_v and_o not_o elsewhere_o which_o say_v be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o of_o his_o majesty_n court_n of_o record_n within_o this_o island_n wherein_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v the_o defendant_n one_o moiety_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o moiety_n to_o he_o or_o they_o that_o shall_v prosecute_v the_o same_o a_o act_n for_o the_o ferry_n between_o st._n catharines_n and_o st._n andrews_n whereas_o william_n parker_n of_o the_o parish_n of_o st._n andrews_n esquire_n have_v at_o his_o particular_a charge_n find_v out_o and_o make_v a_o very_a convenient_a way_n between_o the_o salt_n and_o fresh_a river_n in_o the_o parish_n of_o st._n andrews_n and_o st._n catharines_n which_o will_v be_v of_o great_a use_n and_o advantage_n to_o recover_v and_o receive_v as_o a_o duty_n and_o toll_n for_o the_o transport_v of_o any_o person_n over_o the_o say_a ferry_n seven_o penny_n half_a penny_n for_o every_o horse_n and_o man_n fifteen_o penny_n for_o every_o grow_v beast_n that_o have_v no_o rider_n seven_o penny_n half_a penny_n for_o every_o sheep_n calf_n or_o hog_n six_o penny_n and_o that_o the_o say_v william_n parker_n his_o heir_n and_o assign_v may_v and_o shall_v erect_v a_o tavern_n or_o victualling-house_n near_o the_o say_a ferry_n and_o shall_v not_o be_v compel_v to_o renew_v or_o pay_v any_o licence_n money_n for_o the_o same_o provide_v always_o that_o if_o the_o say_v william_n parker_n or_o his_o assign_v shall_v not_o finish_v and_o complete_a the_o say_a way_n and_o passage_n within_o twelve_o month_n from_o and_o after_o the_o make_n of_o this_o act_n and_o that_o in_o all_o place_n it_o be_v not_o less_o than_o eight_o foot_n broad_a and_o that_o the_o same_o be_v always_o keep_v in_o good_a and_o sufficient_a repair_n that_o the_o aforesaid_a limitation_n of_o the_o rate_n which_o shall_v be_v pay_v by_o virtue_n of_o this_o act_n or_o any_o letter_n patent_n grant_v for_o the_o same_o shall_v cease_v determine_v and_o be_v utter_o void_a and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o other_o person_n whatsoever_o presume_v to_o erect_v
justice_n of_o the_o peace_n without_o give_v notice_n to_o the_o captain_n of_o the_o say_a fort_n or_o whosoever_o shall_v command_v in_o chief_a therein_o in_o his_o absence_n which_o say_v notice_n shall_v be_v sufficient_a leave_n to_o pass_v the_o say_a fort_n without_o any_o further_a charge_n or_o trouble_v whatsoever_o unless_o the_o say_a captain_n or_o other_o his_o subordinate_a officer_n have_v reasonable_a cause_n to_o suspect_v the_o person_n so_o desire_v leave_n to_o have_v some_o evil_a design_n in_o go_v off_o with_o or_o carry_v off_o any_o person_n contrary_a to_o the_o say_a patent_n and_o that_o the_o value_n of_o the_o say_v escheat_v estate_n as_o it_o be_v apprise_v at_o shall_v be_v secure_v to_o be_v pay_v unto_o the_o treasury_n of_o this_o island_n after_o the_o expiration_n of_o three_o year_n from_o the_o date_n of_o the_o patent_n if_o no_o heir_n in_o the_o mean_a time_n shall_v obtain_v the_o same_o by_o such_o person_n or_o person_n to_o who_o the_o governor_n or_o commander_n in_o chief_a as_o aforesaid_a shall_v by_o patent_n under_o the_o broad_a seal_n of_o this_o island_n grant_v the_o same_o and_o that_o the_o treasurer_n or_o receiver_n be_v hereby_o require_v to_o pay_v or_o cause_n to_o be_v pay_v the_o sum_n or_o sum_n of_o money_n the_o say_v escheat_v estate_n be_v value_v at_o out_o of_o the_o treasury_n unto_o or_o for_o the_o use_v of_o such_o heir_n who_o shall_v claim_v the_o same_o and_o approve_v himself_o to_o be_v heir_n before_o any_o other_o payment_n whatsoever_o which_o proof_n of_o the_o heir_n

or_o rhenish_a wine_n three_o pound_n every_o gallon_n of_o brandy_n one_o shilling_n every_o gallon_n of_o english_a spirit_n three_o penny_n every_o tun_n of_o beer_n or_o cider_n eight_o shilling_n every_o tun_n of_o mom_o or_o metheglin_n forty_o shilling_n for_o every_o hundred_o pound_n of_o white_a sugar_n ten_o shilling_n for_o every_o hundred_o pound_n of_o muscovado_n or_o pameel_n merchant_n or_o other_o person_n import_v any_o wine_n or_o other_o liquor_n into_o this_o island_n shall_v be_v thereunto_o require_v by_o the_o collector_n within_o twenty_o day_n after_o landing_n make_v up_o account_n and_o give_v bond_n in_o the_o penalty_n of_o double_a the_o value_n the_o same_o shall_v amount_v unto_o and_o upon_o such_o account_n so_o to_o be_v make_v up_o and_o bond_n not_o have_v full_a seven_o inch_n or_o above_o leave_v therein_o and_o every_o butt_n or_o pipe_v not_o above_o nine_o inch_n shall_v be_v account_v for_o out_v and_o the_o merchant_n or_o importer_n to_o pay_v no_o custom_n for_o the_o same_o and_o in_o case_n of_o difference_n that_o may_v arise_v between_o the_o importer_n or_o master_n of_o the_o vessel_n touch_v leakage_n on_o board_n and_o for_o wine_n or_o liquor_n that_o shall_v happen_v to_o sour_a within_o the_o aforesaid_a twenty_o day_n the_o person_n or_o person_n so_o aggrieve_v shall_v have_v a_o warrant_n of_o survey_n from_o the_o naval_a officer_n who_o be_v hereby_o impower_v and_o require_v to_o grant_v the_o same_o and_o that_o return_v of_o such_o warrant_n to_o be_v grant_v as_o aforesaid_a shall_v be_v make_v upon_o oath_n to_o the_o say_v naval_a officer_n and_o by_o he_o remit_v to_o the_o collector_n office_n in_o order_n to_o the_o make_v up_o their_o account_n with_o the_o collector_n and_o better_o prove_v their_o damage_n by_o ill_a stowage_n or_o otherwise_o and_o in_o case_n any_o such_o merchant_n or_o importer_n shall_v be_v thereunto_o require_v as_o aforesaid_a refuse_v to_o make_v up_o his_o accompto_n and_o give_v bond_n as_o aforesaid_a he_o shall_v lose_v the_o benefit_n of_o the_o ten_o per_n cent_z for_o leakage_n and_o the_o time_n give_v for_o the_o payment_n of_o the_o money_n and_o if_o the_o receiver_n shall_v be_v force_v to_o sue_v for_o the_o same_o and_o do_v recover_v the_o defendant_n shall_v pay_v treble_a damage_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o at_o the_o entry_n of_o any_o ship_n or_o vessel_n in_o the_o naval_a office_n it_o shall_v appear_v by_o the_o master_n report_n or_o otherwise_o that_o he_o have_v import_v any_o madera_n wine_n he_o the_o say_a master_n or_o the_o boatswain_n shall_v take_v the_o follow_a oath_n which_o the_o say_v naval_a officer_n be_v hereby_o impower_v to_o administer_v i_o a._n b._n do_v swear_v that_o the_o wine_n by_o i_o import_v be_v take_v on_o board_n at_o the_o island_n of_o madera_n and_o that_o i_o do_v not_o direct_o or_o indirect_o know_v but_o that_o the_o say_v wine_n be_v of_o the_o say_a island_n without_o any_o mixture_n of_o the_o wine_n of_o the_o growth_n of_o any_o of_o the_o western_a island_n so_o help_v i_o god_n and_o if_o the_o say_a master_n or_o boatswain_n shall_v resuse_v to_o take_v the_o abovesaid_a oath_n that_o then_o the_o say_a wine_n so_o import_v shall_v be_v deem_v and_o take_v to_o be_v wine_n of_o the_o growth_n of_o the_o western_a island_n and_o shall_v pay_v custom_n according_o and_o it_o be_v further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o all_o or_o any_o of_o the_o aforesaid_a liquor_n or_o good_n liable_a to_o the_o duty_n aforesaid_a be_v land_a and_o afterward_o export_v within_o twelve_o month_n after_o the_o importation_n thereof_o that_o the_o collector_n or_o receiver_n shall_v discompt_v or_o repay_v unto_o the_o owner_n or_o their_o assign_v half_o the_o custom_n of_o the_o say_a liquor_n and_o good_n according_a to_o the_o rate_n before_o mention_v which_o the_o collector_n or_o receiver_n be_v to_o repay_v or_o count_n on_o the_o penalty_n of_o double_a the_o sum_n for_o every_o such_o refusal_n to_o the_o party_n aggrieve_v and_o it_o be_v likewise_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o all_o ship_n and_o vessel_n come_v from_o any_o place_n to_o the_o northward_o of_o the_o tropic_a of_o cancer_n to_o trade_n within_o this_o island_n shall_v respective_o pay_v for_o every_o tun_n such_o ship_n or_o vessel_n shall_v contain_v and_o for_o every_o time_n they_o arrive_v one_o pound_n of_o good_a and_o new_a gunpowder_n and_o also_o all_o ship_n and_o vessel_n trade_v any_o way_n to_o the_o southward_n of_o the_o tropic_a of_o cancer_n shall_v respective_o pay_v for_o every_o tun_n such_o ship_n or_o vessel_n shall_v contain_v one_o pound_n of_o good_a and_o new_a gunpowder_n once_o every_o year_n and_o no_o more_o the_o same_o to_o be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o the_o public_a use_n of_o this_o his_o majesty_n island_n and_o it_o it_o be_v likewise_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o collector_n or_o receiver_n appoint_v for_o the_o receipt_n of_o such_o gunpowder_n shall_v receive_v the_o same_o in_o specie_fw-la and_o not_o presume_v in_o lieu_n thereof_o to_o receive_v money_n or_o any_o other_o consideration_n whatsoever_o upon_o penalty_n of_o twenty_o pound_n currant_n money_n for_o every_o such_o offence_n and_o it_o be_v likewise_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o master_n or_o commander_n of_o any_o ship_n or_o ship_n merchant_n factor_n purser_n mariner_n or_o any_o other_o person_n whatsoever_o without_o the_o presence_n of_o the_o collector_n or_o some_o person_n appoint_v by_o he_o or_o notice_n give_v he_o or_o before_o his_o or_o their_o regular_a entry_n make_v with_o the_o say_a collector_n or_o payment_n of_o the_o duty_n or_o security_n give_v by_o bond_n as_o aforesaid_a shall_v after_o sunset_n and_o before_o sunrising_n put_v on_o shoar_n or_o put_v into_o any_o boat_n or_o vessel_n in_o order_n to_o land_v any_o of_o the_o liquor_n or_o any_o good_n contain_v or_o mention_v in_o this_o act_n with_o a_o intent_n to_o defraud_v his_o majesty_n of_o his_o custom_n for_o the_o same_o the_o say_a liquor_n and_o good_n shall_v be_v forfeit_v two_o three_o part_n to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o three_o part_n to_o the_o informer_n or_o seizer_n be_v it_o the_o receiver_n his_o agent_n or_o any_o other_o person_n whatsoever_o the_o same_o to_o be_v recover_v by_o bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n within_o this_o island_n any_o thing_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o all_o manner_n of_o person_n be_v hereby_o require_v to_o be_v aid_v and_o assist_v to_o the_o receiver_n his_o agent_n the_o informer_n discoverer_n and_o seizer_n of_o such_o liquor_n or_o good_n so_o land_a or_o unlade_v contrary_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n and_o it_o be_v hereby_o further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o receiver_n his_o agent_n the_o informer_n or_o discoverer_n by_o virtue_n of_o a_o warrant_n from_o the_o commander_n in_o chief_a or_o any_o of_o his_o majesty_n justice_n of_o the_o peace_n to_o that_o purpose_n first_o obtain_v with_o one_o constable_n or_o more_o to_o search_v according_a to_o law_n all_o manner_n of_o house_n cellar_n warehouse_n and_o shop_n for_o such_o liquor_n and_o good_n as_o they_o or_o any_o of_o they_o shall_v be_v inform_v be_v carry_v there_o to_o be_v conceal_v in_o prejudice_n to_o the_o true_a meaning_n of_o this_o act_n and_o such_o liquor_n and_o good_n so_o find_v shall_v be_v forfeit_v and_o condemn_v in_o manner_n and_o form_n before_o mention_v provide_v that_o the_o search_v be_v make_v within_o three_o day_n after_o information_n and_o it_o be_v likewise_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o during_o the_o continuation_n of_o this_o act_n the_o collector_n or_o his_o deputy_n give_v his_o or_o their_o attendance_n at_o his_o office_n
