death_n be_v object_v against_o it_o be_v propose_v to_o his_o highness_n that_o the_o earl_n shall_v be_v stab_v but_o this_o manner_n likewise_o not_o be_v think_v proper_a his_o highness_n have_v conclude_v and_o order_v his_o throat_n to_o be_v cut_v and_o his_o highness_n have_v promise_v to_o be_v there_o when_o it_o be_v do_v about_o three_o day_n after_o this_o viz._n about_o six_o day_n before_o the_o earl_n death_n some_o of_o the_o aforesaid_a person_n meet_v again_o at_o she_o say_v master_n house_n where_o she_o hear_v they_o declare_v to_o this_o effect_n that_o they_o have_v resolve_v the_o earl_n throat_n shall_v be_v cut_v but_o they_o will_v give_v it_o out_o that_o he_o have_v do_v it_o himself_o and_o if_o any_o shall_v deny_v it_o they_o will_v take_v they_o up_o and_o punish_v they_o for_o it_o this_o informant_n be_v hereupon_o much_o trouble_v in_o her_o mind_n and_o willing_a to_o prevent_v if_o possible_a this_o intend_a mischief_n do_v hereupon_o advise_v with_o one_o mr._n billinger_n who_o before_o that_o time_n have_v be_v her_o master_n but_o the_o say_a mr._n billinger_n tell_v she_o to_o this_o effect_n that_o if_o she_o value_v her_o life_n she_o shall_v not_o discover_v it_o to_o any_o for_o the_o papist_n then_o carry_v all_o before_o they_o she_o be_v ruin_v if_o she_o do_v wherefore_o she_o do_v not_o before_o my_o lord_n death_n to_o her_o remembrance_n discover_v it_o to_o any_o other_o unless_o she_o may_v to_o mrs._n billinger_n in_o which_o she_o can_v be_v positive_a but_o the_o day_n of_o my_o lord_n death_n about_o two_o or_o three_o of_o the_o clock_n the_o same_o day_n some_o of_o the_o aforesaid_a consult_v come_v to_o her_o say_a master_n holmes_n house_n one_o leap_v about_o the_o room_n as_o extreme_o overjoy_v and_o strike_v the_o say_a mr._n holmes_n on_o the_o back_n and_o cry_v the_o feat_n be_v do_v or_o we_o have_v do_v the_o feat_n and_o further_o say_v he_o can_v not_o but_o laugh_v to_o think_v how_o like_o a_o fool_n the_o earl_n of_o essex_n look_v when_o they_o come_v to_o cut_v his_o throat_n she_o further_o say_v that_o about_o five_o year_n since_o live_v with_o mr._n rowdon_n of_o the_o old-exchange_n she_o be_v willing_a to_o discover_v what_o she_o have_v as_o before_o hear_v to_o her_o say_a master_n and_o mistress_n and_o daughter_n but_o her_o say_a master_n rowden_n be_v not_o free_a to_o hear_v all_o she_o can_v say_v with_o relation_n hereunto_o but_o advise_v she_o to_o hold_v her_o peace_n for_o by_o such_o her_o discourse_n she_o may_v ruin_v he_o and_o all_o his_o family_n this_o be_v further_a confirm_v by_o the_o oath_n of_o mr._n rowden_n mrs._n rowden_n and_o mrs._n mary_n rowden_n and_o mrs._n rowden_n do_v further_o depose_v to_o this_o effect_n viz._n that_o the_o say_v dorothy_n smith_n have_v some_o year_n since_o with_o great_a concern_v declare_v that_o she_o do_v hope_n to_o live_v to_o see_v the_o day_n wherein_o she_o may_v full_o testify_v her_o knowledge_n herein_o and_o this_o she_o will_v do_v when_o she_o may_v without_o danger_n mr._n adam_n and_o his_o wife_n have_v depose_v to_o this_o effect_n that_o november_n last_o be_v two_o year_n this_o dorothy_n live_v with_o they_o as_o their_o servant_n and_o in_o tear_n have_v often_o declare_v she_o overhear_v the_o papist_n consult_v of_o my_o lord_n of_o essex_n murder_n several_a day_n before_o his_o death_n and_o by_o who_o order_n the_o earl_n be_v to_o be_v murder_v but_o these_o informant_n know_v the_o danger_n of_o such_o discourse_n the_o late_a king_n james_n be_v then_o in_o so_o great_a power_n do_v advise_v she_o for_o her_o own_o safety_n and_o the_o safety_n of_o those_o she_o live_v with_o not_o thus_o to_o discourse_v but_o the_o say_v dorothy_n in_o tear_n do_v usual_o answer_v that_o it_o lay_v upon_o her_o mind_n night_n and_o day_n and_o she_o can_v not_o be_v quiet_a in_o her_o thought_n that_o the_o earl_n of_o essex_n shall_v be_v false_o charge_v with_o cut_v his_o own_o throat_n when_o she_o have_v hear_v the_o papist_n resolution_n to_o cut_v it_o themselves_o and_o after_o own_o they_o have_v do_v it_o and_o if_o ever_o she_o may_v with_o safety_n testify_v the_o truth_n herein_o she_o will_v and_o do_v hope_v those_o man_n that_o do_v it_o may_v suffer_v for_o it_o richard_n may_n depose_v to_o this_o effect_n that_o to_o the_o best_a of_o this_o informant_n remembrance_n before_o the_o death_n of_o king_n charles_n the_o second_o observe_v dorothy_n smith_n to_o be_v very_o melancholy_a he_o desire_v to_o know_v the_o cause_n upon_o which_o she_o say_v that_o somewhat_o which_o she_o know_v with_o relation_n to_o the_o death_n of_o the_o late_a earl_n of_o essex_n be_v the_o cause_n of_o her_o trouble_n and_o it_o be_v not_o safe_a for_o she_o to_o reveal_v it_o to_o any_o upon_o which_o this_o informant_n advise_v she_o then_o to_o be_v silent_a in_o the_o matter_n but_o about_o the_o begin_n of_o february_n after_o our_o now_o king_n come_n find_v it_o safe_a for_o the_o say_v dorothy_n smith_n herein_o to_o declare_v her_o knowledge_n this_o informant_n go_v to_o the_o say_v dorothy_n smith_n and_o tell_v she_o she_o may_v now_o safe_o speak_v what_o she_o know_v as_o to_o my_o lord_n death_n upon_o which_o the_o say_a dorothy_n smith_n tell_v this_o informant_a how_o she_o have_v hear_v the_o papist_n several_a day_n before_o my_o lord_n death_n declare_v how_o the_o earl_n throat_n be_v to_o be_v cut_v and_o by_o who_o order_v with_o several_a particular_n in_o relation_n thereunto_o upon_o which_o this_o informant_n discover_v this_o to_o mr._n william_n tornay_n who_o thereupon_o tell_v this_o informant_a he_o will_v reveal_v this_o to_o mr._n braddon_n then_o upon_o the_o prosecution_n of_o my_o lord_n murder_n and_o some_o short_a time_n after_o mr._n tornay_n tell_v this_o informant_a that_o he_o have_v therewith_o acquaint_v mr._n braddon_n and_o desire_v this_o informant_a with_o the_o say_v dorothy_n smith_n to_o meet_v the_o say_a mr._n braddon_n and_o the_o say_a mr._n tornay_n such_o a_o time_n at_o the_o cross-keys_n in_o watlinstreet_n where_o they_o meet_v according_o but_o when_o mr._n braddon_n have_v be_v particular_o inform_v herein_o by_o the_o say_v dorothy_n smith_n the_o say_a mr._n braddon_n declare_v that_o unless_o the_o say_v dorothy_n can_v make_v it_o appear_v that_o she_o have_v long_o since_o reveal_v this_o he_o will_v esteem_v it_o as_o a_o new-made_a story_n and_o a_o lye_n upon_o which_o the_o say_a dorothy_n mention_v the_o name_n of_o several_a to_o who_o she_o declare_v she_o have_v long_o since_o reveal_v it_o but_o by_o all_o be_v enjoin_v to_o secrecy_n mr._n william_n tourney_n have_v likewise_o depose_v what_o herein_o relate_v to_o he_o and_o i_o be_o ready_a to_o depose_v that_o i_o never_o hear_v of_o this_o dorothy_n smith_n till_o mr._n tourney_n about_o february_n last_o be_v twelve_o month_n inform_v i_o of_o she_o and_o i_o never_o to_o my_o remembrance_n see_v the_o say_a dorothy_n smith_n till_o the_o say_a mr._n may_n have_v as_o before_o bring_v she_o to_o the_o cross-keys_n in_o watlinstreet_n where_o i_o first_o discourse_v she_o in_o the_o presence_n of_o mr._n may_n mr._n tourney_n and_o another_o here_o be_v five_o or_o six_o witness_n prove_v the_o very_a substance_n of_o this_o evidence_n reveal_v some_o year_n since_o when_o it_o be_v little_o less_o than_o death_n to_o discourse_v it_o which_o clear_o prove_v it_o be_v not_o a_o new-made_a story_n and_o strong_o argue_v the_o truth_n of_o the_o relation_n for_o it_o can_v hardly_o be_v suppose_v that_o this_o woman_n shall_v often_o under_o the_o great_a concern_v and_o danger_n imaginable_a declare_v any_o thing_n of_o this_o nature_n unless_o the_o relation_n be_v real_o true_a because_o she_o can_v rational_o then_o propose_v no_o advantage_n by_o this_o invention_n but_o be_v still_o tell_v and_o convince_v of_o the_o danger_n wherefore_o it_o be_v rational_a to_o suppose_v that_o only_o the_o power_n of_o truth_n move_v she_o to_o declare_v what_o she_o so_o often_o in_o tear_n relate_v but_o as_o a_o further_a argument_n of_o the_o truth_n of_o this_o deposition_n i_o shall_v brief_o relate_v what_o information_n have_v be_v take_v in_o contradiction_n to_o this_o relation_n and_o how_o these_o information_n have_v be_v detect_v as_o false_a in_o every_o particular_a which_o corroborate_v the_o truth_n of_o the_o accusation_n for_o as_o a_o true_a defence_n detect_v and_o frustrate_v a_o false_a charge_n so_o a_o false_a defence_n be_v discover_v to_o be_v such_o as_o strong_o strengthen_v a_o true_a one_o the_o deposition_n in_o opposition_n to_o smith_n evidence_n be_v dorothy_n hewits_n a_o most_o violent_a papist_n who_o the_o 9th_o
be_v as_o high_a as_o his_o throat_n may_v have_v be_v in_o that_o posture_n but_o there_o be_v no_o blood_n a_o foot_n high_o than_o the_o floar_n therefore_o he_o can_v not_o cut_v his_o throat_n either_o stand_v or_o kneel_v neither_o can_v it_o be_v suppose_v to_o be_v do_v lie_v along_o for_o then_o the_o wound_n beginning_n at_o the_o left_a side_n and_o his_o lordship_n be_v right-handed_n and_o end_v at_o the_o right_n the_o razor_n will_v have_v lie_v on_o the_o right_n whereas_o the_o razor_n lie_v on_o the_o left-side_n of_o the_o body_n but_o lest_o the_o circumstance_n of_o the_o body_n as_o first_o pretend_v to_o be_v find_v may_v prove_v a_o detection_n of_o this_o villainy_n care_n be_v take_v that_o before_o the_o coroner_n jury_n see_v the_o body_n the_o body_n shall_v be_v strip_v and_o the_o clothes_n carry_v away_o and_o the_o room_n and_o closet_n wash_v so_o that_o the_o body_n may_v appear_v as_o naked_a of_o its_o first_o circumstance_n as_o it_o be_v of_o its_o clothes_n this_o particular_a be_v so_o notorious_o irregular_a or_o rather_o criminal_a in_o some_o degree_n that_o all_o man_n know_v the_o law_n require_v the_o contrary_a for_o by_o the_o first_o posture_n of_o the_o body_n with_o the_o circumstance_n of_o the_o clothes_n etc._n etc._n great_a light_n may_v be_v give_v to_o the_o true_a manner_n of_o his_o death_n but_o that_o in_o this_o case_n be_v not_o to_o be_v discover_v and_o therefore_o such_o practice_n be_v necessary_a my_o lord_n clothes_n be_v not_o only_o carry_v way_n but_o when_o demand_v by_o the_o jury_n as_o what_o may_v be_v serviceable_a in_o their_o inquisition_n the_o coroner_n be_v upon_o this_o question_n immediate_o call_v into_o the_o next_o room_n and_o return_v tell_v the_o jury_n it_o be_v the_o body_n and_o not_o the_o clothes_n they_o be_v to_o sit_v upon_o the_o body_n be_v there_o and_o that_o be_v sufficient_a it_o be_v a_o unhappiness_n the_o coroner_n have_v forget_v as_o he_o swear_v who_o those_o be_v which_o be_v in_o the_o next_o room_n whilst_o the_o jury_n sit_v and_o to_o who_o whilst_o they_o sit_v he_o do_v several_a time_n go_v but_o have_v the_o jury_n see_v the_o clothes_n upon_o the_o body_n in_o its_o first_o posture_n these_o will_v of_o themselves_o have_v convince_v they_o that_o my_o lord_n of_o essex_n be_v murder_v for_o how_o can_v there_o be_v a_o print_n of_o a_o bloody_a foot_n upon_o my_o lord_n and_o yet_o none_o as_o they_o pretend_v have_v be_v in_o the_o closet_n with_o he_o or_o how_o can_v his_o lordship_n with_o such_o a_o instrument_n as_o the_o razor_n cut_v twice_o through_o the_o neck_n of_o his_o cravat_fw-la for_o alice_n carter_n and_o mary_n johnson_n who_o together_o with_o major_a webster_n strip_v the_o body_n have_v declare_v as_o have_v be_v depose_v the_o neck_n of_o my_o lord_n be_v cravat_fw-la be_v cut_v in_o three_o piece_n the_o circumstance_n of_o the_o pretend_a instrument_n of_o death_n give_v strong_a suspicion_n of_o the_o murder_n for_o the_o pretend_a instrument_n of_o the_o self-murder_n be_v a_o french_a razor_n about_o four_o inch_n and_o a_o quarter_n in_o its_o blade_n and_o have_v no_o spill_v or_o tongue_n at_o the_o end_n as_o you_o may_v perceive_v by_o the_o figure_n thereof_o in_o the_o cut._n wherefore_o this_o razor_n in_o its_o use_n must_v be_v hold_v by_o the_o very_a blade_n and_o not_o less_o than_o two_o inch_n of_o that_o can_v well_o suffice_v to_o be_v hold_v in_o his_o hand_n for_o that_o strength_n and_o steadiness_n the_o cut_v twice_o through_o the_o cravat_fw-la and_o afterward_o so_o deep_a in_o the_o neck_n require_v and_o then_o the_o wound_n if_o make_v at_o once_o will_v not_o have_v be_v above_o two_o inch_n and_o a_o quarter_n deep_a no_o more_o of_o the_o blade_n be_v outside_n the_o hand_n which_o length_n can_v not_o at_o once_o possible_o make_v a_o wound_n above_o three_o inch_n in_o depth_n i_o do_v suppose_v none_o do_v believe_v his_o lordship_n cut_v twice_o to_o effect_v it_o the_o largeness_n of_o the_o wound_n at_o first_o do_v make_v very_o ingenious_a physician_n and_o surgeon_n say_v that_o they_o suppose_v it_o impossible_a for_o any_o man_n to_o cut_v his_o throat_n according_a as_o the_o two_o surgeon_n upon_o my_o lord_n body_n depose_v the_o wound_n be_v such_o both_o jugular_n and_o artery_n quite_o divide_v and_o cut_v to_o the_o very_a vertebres_fw-fr of_o the_o neck_n now_o in_o cut_v the_o first_o jugular_a artery_n there_o will_v immediate_o have_v issue_v such_o a_o quantity_n of_o blood_n and_o spirit_n as_o will_v have_v soon_o incapacitate_v he_o from_o divide_v the_o second_o and_o though_o as_o ingenious_a a_o anatomist_n as_o most_o in_o england_n before_o their_o lordship_n will_v not_o say_v that_o he_o think_v it_o impossible_a his_o lordship_n shall_v so_o cut_v his_o throat_n yet_o he_o do_v confess_v that_o he_o never_o see_v or_o hear_v of_o any_o before_o who_o cut_v through_o both_o jugular_n and_o artery_n to_o the_o neck-bone_n as_o my_o lord_n be_v be_v cut_v this_o gentleman_n for_o some_o year_n have_v be_v physician_n to_o bedlam_n he_o may_v be_v suppose_v to_o have_v as_o many_o instance_n of_o self-violence_n as_o any_o physician_n in_o england_n and_o of_o all_o man_n none_o do_v it_o with_o that_o goodwill_n and_o vigour_n as_o the_o distract_v do_v and_o therefore_o shall_v make_v the_o deep_a and_o large_a wound_n but_o i_o think_v i_o need_v not_o insist_v in_o this_o case_n upon_o such_o argument_n consider_v what_o be_v before_o say_v to_o be_v prove_v now_o to_o proceed_v with_o the_o jury_n these_o gentleman_n have_v they_o not_o be_v hurry_v into_o their_o inquisition_n as_o you_o will_v hereafter_o find_v they_o be_v by_o the_o body_n as_o it_o be_v leave_v naked_a upon_o a_o strict_a view_n may_v well_o have_v be_v satisfy_v his_o lordship_n fall_v not_o a_o self-sacrifice_n for_o it_o be_v prove_v there_o be_v five_o cut_n in_o his_o right_a hand_n viz._n shillingsford_n viz._n mr._n shillingsford_n one_o almost_a on_o the_o top_n of_o the_o forefinger_n and_o another_o upon_o the_o same_o near_o the_o hand_n perk_n hand_n turner_n and_o perk_n one_o upon_o the_o four_o finger_n and_o another_o upon_o the_o little-finger_n and_o body_n and_o mr._n sherwood_n the_o surgeon_n upon_o the_o body_n a_o five_o about_o two_o inch_n long_o in_o the_o very_a palm_n of_o the_o right-hand_a can_v it_o be_v suppose_v that_o his_o lordship_n make_v these_o wound_n and_o that_o upon_o his_o right-hand_n for_o trial_n how_o sharp_a the_o razor_n be_v and_o how_o well_o it_o will_v perform_v what_o he_o design_v to_o execute_v these_o cut_n can_v be_v suppose_v to_o be_v make_v by_o hold_v the_o razor_n no_o these_o be_v previous_a to_o that_o direful_a cut_n and_o the_o effect_n of_o his_o struggle_v with_o those_o bloody_a man_n when_o he_o so_o often_o cry_v out_o murder_n murder_n murder_n as_o he_o then_o use_v his_o tongue_n to_o discover_v so_o do_v he_o likewise_o his_o hand_n to_o prevent_v that_o treacherous_a wound_n he_o perceive_v design_v for_o his_o destruction_n and_o in_o thus_o strive_v to_o put_v off_o the_o instrument_n of_o death_n do_v his_o right_a hand_n receive_v these_o several_a wound_n mr._n fisher_n one_o of_o the_o coroner_n jury_n have_v depose_v to_o this_o effect_n that_o he_o ask_v bomeny_n whether_o his_o lord_n be_v not_o esteem_v a_o good_a man_n for_o such_o he_o have_v hear_v he_o represent_v bomeny_n answer_v as_o good_a a_o man_n as_o live_v upon_o which_o fisher_n say_v then_o it_o be_v very_o strange_a so_o good_a a_o man_n shall_v be_v guilty_a of_o so_o bad_a a_o action_n for_o nothing_o can_v be_v worse_o than_o self-murder_n whereupon_o major_a hawley_n tell_v fisher_n whoever_o think_v that_o action_n unlike_o his_o lordship_n do_v not_o know_v my_o lord_n of_o essex_n for_o every_o one_o that_o be_v but_o well_o acquaint_v with_o the_o earl_n know_v it_o be_v his_o lordship_n fix_a principle_n that_o any_o man_n may_v cut_v his_o own_o throat_n or_o otherwise_o destroy_v himself_o to_o avoid_v a_o dishonourable_a and_o infamous_a death_n and_o therefore_o this_o be_v like_o my_o lord_n of_o essex_n avow_a principle_n fisher_n believe_v this_o to_o be_v true_a be_v the_o more_o easy_o incline_v to_o believe_v that_o his_o lordship_n have_v follow_v such_o his_o own_o fix_a principle_n but_o when_o major_a hawley_n be_v question_v for_o this_o suggestion_n to_o the_o jury_n he_o positive_o deny_v it_o and_o for_o answer_n say_v that_o he_o be_v not_o nigh_o the_o victualling-house_n in_o the_o tower_n all_o the_o time_n the_o jury_n be_v there_o consider_v of_o their_o inquisition_n and_o as_o for_o the_o principle_n he_o can_v not_o say_v it_o for_o he_o
total_a subversion_n of_o our_o law_n and_o whilst_o in_o show_n they_o seem_v to_o maintain_v the_o protestant_a church_n they_o be_v secret_o contrive_v its_o total_a destruction_n by_o wrest_v
