honour_n and_o conscience_n sake_n in_o a_o matter_n that_o concern_v both_o so_o near_o but_o it_o shall_v be_v our_o endeavour_n to_o carry_v ourselves_o with_o our_o best_a respect_n to_o your_o lordship_n and_o withal_o content_a and_o satisfaction_n to_o the_o honourable_a house_n of_o commons_o and_o because_o your_o lordship_n mention_v the_o matter_n of_o fact_n one_o thing_n i_o dare_v be_v bold_a to_o say_v that_o all_o the_o time_n of_o this_o noble_a lord_n defence_n he_o do_v not_o so_o much_o as_o crave_v any_o one_o of_o our_o opinion_n yea_o or_o acquaint_v we_o with_o any_o thing_n that_o tend_v that_o way_n and_o for_o the_o matter_n of_o law_n those_o statute_n cite_v by_o himself_o be_v none_o of_o our_o stock_n but_o take_v up_o at_o his_o own_o adventure_n nor_o do_v i_o speak_v this_o to_o derogate_v from_o the_o pertinency_n of_o those_o statute_n for_o they_o shall_v be_v the_o subject_n of_o my_o discourse_n but_o that_o the_o nobleman_n be_v not_o disappoint_v of_o your_o right_a conception_n and_o his_o own_o due_a praise_n my_o lord_n it_o be_v your_o pleasure_n we_o meddle_v not_o with_o matter_n of_o fact_n and_o indeed_o we_o need_v not_o meddle_v at_o all_o with_o it_o because_o we_o hope_v it_o be_v already_o do_v and_o that_o sufficient_o to_o our_o hand_n yet_o the_o matter_n of_o law_n do_v so_o natural_o arise_v out_o of_o the_o matter_n of_o fact_n that_o of_o necessity_n under_o your_o lordship_n favour_n we_o must_v somewhat_o grate_v on_o this_o if_o we_o speak_v of_o that_o nor_o do_v i_o conceive_v it_o possible_a for_o we_o to_o speak_v advantageous_o enough_o for_o the_o lord_n strafford_n just_a defence_n unless_o the_o whole_a matter_n of_o fact_n be_v determine_v either_o as_o prove_v or_o not_o prove_v or_o at_o least_o some_o state_n of_o question_n agree_v upon_o where_o we_o may_v fix_v and_o settle_v our_o agreement_n and_o therefore_o it_o be_v my_o lord_n that_o i_o have_v choose_v not_o at_o all_o to_o touch_v the_o matter_n of_o law_n until_o your_o lordship_n shall_v be_v please_v to_o chalk_n i_o out_o a_o way_n unless_o it_o be_v to_o clear_v your_o judgement_n in_o one_o statute_n only_o viz._n 25._o ed._n 3._o because_o when_o the_o same_o be_v allege_v by_o the_o lord_n strafford_n in_o his_o own_o defence_n that_o not_o be_v convict_v of_o the_o letter_n thereof_o he_o can_v not_o be_v convict_v of_o treason_n i_o remember_v the_o salvo_n of_o that_o statute_n be_v much_o insist_v upon_o by_o those_o from_o the_o house_n of_o commons_o as_o much_o conduce_v to_o their_o own_o of_o the_o king_n his_o queen_n their_o child_n kill_v the_o chancellor_n or_o the_o judge_n upon_o the_o bench_n embase_v the_o king_n coin_n or_o counterfeit_v the_o broad-seale_n etc._n etc._n he_o shall_v be_v convict_v and_o punish_v as_o a_o traitor_n that_o the_o lord_n strafford_n come_v within_o the_o letter_n of_o this_o statute_n be_v not_o so_o much_o as_o once_o allege_v nor_o indeed_o it_o can_v be_v with_o any_o reason_n all_o that_o can_v be_v say_v be_v that_o by_o relation_n or_o by_o argument_n a_o minore_fw-la admajus_fw-la he_o may_v be_v draw_v thither_o yet_o that_o this_o can_v be_v i_o humble_o offer_v these_o consideration_n first_o this_o be_v a_o declarative_a law_n and_o such_o be_v not_o to_o be_v take_v by_o way_n of_o consequence_n equity_n or_o construction_n but_o by_o the_o letter_n only_o otherwise_o they_o shall_v imply_v a_o contradiction_n to_o themselves_o and_o be_v no_o more_o declarative-lawe_n but_o law_n of_o construction_n or_o constitutive_a second_o this_o be_v a_o poenall_a law_n and_o such_o if_o our_o ground_n hitherto_o unquestioned_a hold_v good_a can_v admit_v of_o no_o construction_n or_o inference_n for_o poenalty_n be_v to_o persuade_v the_o keep_n of_o know_a law_n not_o of_o law_n conjectural_a ambiguous_a and_o by_o consequence_n which_o perhaps_o the_o most_o learned_a may_v not_o in_o their_o dispute_n question_v
