always_o to_o the_o say_a chancellor_n etc._n etc._n the_o fee_n accustomable_o take_v for_o execute_v the_o say_a jurisdiction_n and_o that_o in_o all_o such_o patent_n the_o bishop_n shall_v keep_v in_o his_o own_o hand_n the_o power_n of_o institution_n unto_o benefice_n as_o also_o of_o give_v licenses_fw-la to_o preach_v or_o keep_v school_n and_o further_o that_o no_o dean_n and_o chapter_n confirm_v any_o patent_n of_o any_o chancellor_n commissary_n or_o official_o place_n wherein_o the_o say_v condition_n be_v not_o express_v sub_fw-la poena_fw-la suspensionis_fw-la to_o the_o dean_n or_o his_o locum_fw-la tenens_fw-la if_o he_o pass_v the_o act_n in_o his_o absence_n and_o to_o every_o canon_n or_o prebendary_a vote_v to_o the_o confirmation_n of_o the_o say_a act_n to_o be_v inflict_v by_o the_o archbishop_n of_o the_o province_n and_o further_o the_o holy_a synod_n do_v decree_n and_o ordain_v that_o no_o reward_n shall_v be_v take_v for_o any_o chancellor_n commissary_n or_o official_o place_n under_o the_o heavy_a censure_n of_o the_o church_n xii_o chancellor_n alone_o not_o to_o censure_v any_o of_o the_o clergy_n in_o sundry_a case_n that_o no_o chancellor_n commissary_n or_o official_a unless_o he_o be_v in_o holy_a order_n shall_v proceed_v to_o suspension_n or_o any_o high_a censure_n against_o any_o of_o the_o clergy_n in_o any_o criminal_a cause_n other_o than_o neglect_v of_o appearance_n upon_o legal_a cite_n but_o that_o all_o such_o cause_n shall_v be_v hear_v by_o the_o bishop_n in_o person_n or_o with_o the_o assistance_n of_o his_o chancellor_n or_o commissary_n or_o if_o the_o bishop_n occasion_n will_v not_o permit_v then_o by_o his_o chancellor_n or_o commissary_n and_o two_o grave_n dignify_v or_o benefice_a minister_n of_o the_o diocese_n to_o be_v assign_v by_o the_o bishop_n under_o his_o episcopal_a seal_n who_o shall_v hear_v and_o censure_v the_o say_a cause_n in_o the_o consistory_n xiii_o excommunication_n and_o absolution_n not_o to_o be_v pronounce_v but_o by_o a_o priest_n that_o no_o excommunication_n or_o absolution_n shall_v be_v good_a or_o valid_a in_o law_n except_o they_o be_v pronounce_v either_o by_o the_o bishop_n in_o person_n or_o by_o some_o other_o in_o holy_a order_n have_v ecclesiastical_a jurisdiction_n or_o by_o some_o grave_a minister_n benefice_v in_o the_o diocese_n be_v a_o master_n of_o art_n at_o least_o and_o appoint_v by_o the_o bishop_n and_o the_o priest_n name_n pronounce_v such_o sentence_n of_o excommunication_n or_o absolution_n to_o be_v express_v in_o the_o instrument_n issue_v under_o seal_n out_o of_o the_o court._n and_o that_o no_o such_o minister_n shall_v pronounce_v any_o sentence_n of_o absolution_n but_o in_o open_a consistory_n or_o at_o the_o least_o in_o a_o church_n or_o chappel_n the_o penitent_a humble_o crave_v and_o take_v absolution_n upon_o his_o knee_n and_o have_v first_o take_v the_o oath_n de_fw-fr parendo_fw-la juri_fw-la &_o stando_fw-la mandatis_fw-la ecclesiae_fw-la and_o that_o no_o parson_n vicar_n or_o curate_n sub_fw-la poena_fw-la suspensionis_fw-la shall_v declare_v any_o of_o he_o or_o their_o parishioner_n to_o be_v excommunicate_a or_o shall_v admit_v any_o of_o they_o so_o excommunicate_v into_o the_o church_n and_o there_o declare_v they_o to_o be_v absolve_v except_o they_o first_o receive_v such_o excommunication_n and_o absolution_n under_o the_o seal_n of_o the_o ecclesiastical_a judge_n from_o who_o it_o come_v fourteen_o concern_v commutation_n and_o the_o dispose_n of_o they_o that_o no_o chancellor_n commissary_n or_o official_a shall_v have_v power_n to_o commute_v any_o penance_n in_o whole_a or_o in_o part_n but_o either_o together_o with_o the_o bishop_n in_o person_n or_o with_o his_o privity_n in_o writing_n or_o if_o by_o himself_o there_o he_o shall_v give_v up_o a_o full_a and_o just_a account_n of_o all_o such_o commutation_n once_o every_o year_n at_o michaelmas_n to_o the_o bishop_n who_o shall_v with_o his_o chancellor_n see_v that_o all_o such_o money_n be_v dispose_v of_o to_o charitable_a and_o public_a use_n according_a to_o law_n and_o if_o any_o chancellor_n or_o other_o have_v jurisdiction_n as_o aforesaid_a shall_v not_o make_v such_o a_o just_a account_n to_o the_o bishop_n and_o be_v find_v guilty_a of_o it_o he_o shall_v be_v suspend_v from_o all_o exercise_n of_o his_o jurisdiction_n for_o the_o space_n of_o one_o whole_a year_n always_o provide_v that_o if_o the_o crime_n be_v public_o complain_v of_o and_o do_v appear_v notorious_a that_o then_o the_o office_n shall_v signify_v to_o the_o place_n from_o whence_o the_o complaint_n come_v that_o the_o delinquent_n have_v satisfy_v the_o church_n for_o his_o offence_n and_o the_o minister_n shall_v signify_v it_o as_o he_o shall_v be_v direct_v save_v always_o to_o all_o chancellor_n and_o other_o ecclesiastical_a officer_n their_o due_a and_o accustomable_a fee_n if_o he_o or_o they_o be_v not_o so_o suspend_v as_o aforesaid_a xv._o touch_v concurrent_a jurisdiction_n that_o in_o such_o place_n wherein_o there_o be_v concurrent_a jurisdiction_n no_o executor_n be_v cite_v into_o any_o court_n or_o office_n for_o the_o space_n of_o ten_o day_n after_o the_o death_n of_o the_o testator_n and_o that_o as_o well_o every_o apparitor_n herein_o as_o every_o register_n or_o clarek_n that_o give_v or_o carry_v out_o any_o citation_n or_o process_n to_o such_o intent_n before_o that_o the_o say_v ten_o day_n be_v expire_v shall_v for_o the_o first_o offence_n herein_o be_v suspend_v from_o the_o execution_n of_o his_o office_n for_o the_o space_n of_o three_o month_n and_o for_o the_o second_o offence_n in_o this_o kind_n be_v and_o stand_v excommunicate_v ipso_fw-la facto_fw-la not_o to_o be_v restore_v but_o by_o the_o metropolitan_a of_o the_o province_n or_o his_o lawful_a surrogate_v and_o that_o yet_o nevertheless_o it_o be_v lawful_a for_o any_o executor_n to_o prove_v such_o will_n when_o they_o think_v good_a within_o the_o say_v ten_o day_n before_o any_o ecclesiastical_a judge_n respective_o to_o who_o jurisdiction_n the_o same_o may_v or_o do_v appertain_v xvi_o concern_v licenses_fw-la to_o marry_n whereas_o divers_a licenses_fw-la to_o marry_n be_v grant_v by_o ordinary_n in_o who_o jurisdiction_n neither_o of_o the_o party_n desire_v such_o licence_n be_v resident_a to_o the_o prejudice_n of_o the_o archiepiscopal_a prorogative_n to_o who_o only_o the_o power_n of_o grant_v such_o licenses_fw-la to_o party_n of_o any_o jurisdiction_n per_fw-la totam_fw-la provinciam_fw-la by_o law_n belong_v and_o for_o other_o great_a inconvenience_n thereupon_o ensue_v it_o be_v therefore_o decree_v that_o no_o licence_n of_o marriage_n shall_v be_v grant_v by_o any_o ordinary_a to_o any_o party_n unless_o one_o of_o the_o say_a party_n have_v be_v commorant_n in_o the_o jurisdiction_n of_o the_o say_v ordinary_a for_o the_o space_n of_o one_o whole_a month_n immediate_o before_o the_o say_a licence_n be_v desire_v and_o if_o any_o ordinary_a shall_v offend_v herein_o and_o be_v sufficient_o evince_v thereof_o in_o any_o of_o the_o lord_n archbishop_n court_n he_o shall_v be_v liable_a to_o such_o censure_n as_o the_o lord_n archbishop_n shall_v think_v fit_a to_o inflict_v and_o we_o further_o decree_v that_o one_o of_o the_o condition_n in_o the_o bond_n of_o security_n give_v by_o the_o party_n take_v such_o licence_n shall_v be_v that_o the_o say_v party_n or_o one_o of_o they_o have_v or_o have_v be_v a_o month_n commorant_n in_o the_o say_a jurisdiction_n immediate_o before_o the_o say_a licence_n grant_v and_o the_o synod_n decree_n that_o whatsoever_o be_v order_v in_o these_o six_o last_o canon_n concern_v the_o jurisdiction_n of_o bishop_n their_o chancellor_n and_o commissary_n shall_v so_o far_o as_o by_o law_n be_v appliable_a be_v in_o force_n concern_v all_o dean_n dean_n and_o chapter_n collegiate_n church_n archdeacon_n and_o all_o in_o holy_a order_n have_v exempt_a or_o peculiar_a jurisdiction_n and_o their_o several_a officer_n respective_o xvii_o against_o vexatious_a citation_n and_o that_o this_o synod_n may_v prevent_v all_o grievance_n which_o may_v fall_v upon_o the_o people_n by_o citation_n into_o ecclesiastical_a court_n upon_o pretence_n only_o of_o the_o breach_n of_o law_n without_o either_o presentment_n or_o any_o other_o just_a ground_n this_o present_a synod_n decree_n that_o for_o all_o time_n to_o come_v no_o such_o citation_n ground_v only_o as_o aforesaid_a shall_v issue_v out_o of_o any_o ecclesiastical_a court_n except_o the_o say_a citation_n be_v send_v forth_o under_o the_o hand_n and_o seal_v of_o the_o chancellor_n commissary_n archdeacon_n or_o other_o competent_a judge_n of_o the_o say_a court_n within_o thirty_o day_n after_o the_o fault_n commit_v and_o return_v thereof_o to_o be_v make_v
