peer_n 2._o and_o further_o that_o every_o peer_n who_o shall_v be_v convict_v of_o any_o offence_n against_o this_o act_n after_o such_o conviction_n be_v disable_v during_o his_o life_n to_o sit_v in_o parliament_n unless_o his_o majesty_n shall_v gracious_o be_v please_v to_o pardon_v he_o 3_o and_o if_o his_o majesty_n shall_v grant_v his_o pardon_n to_o any_o peer_n of_o this_o realm_n or_o commoner_n convict_v of_o any_o offence_n against_o this_o act_n after_o such_o pardon_v grant_v the_o peer_n or_o commoner_n so_o pardon_v shall_v be_v restore_v to_o all_o intent_n and_o purpose_n statute_n 13._o eliz._n here_o refer_v unto_o during_o the_o life_n of_o that_o queen_n in_o imitation_n whereof_o this_o present_a act_n be_v make_v to_o remain_v in_o force_n during_o only_o the_o life_n of_o our_o present_a sovereign_a king_n charles_n the_o second_o and_o the_o reason_n for_o make_v this_o temporary_a law_n be_v assign_v in_o the_o preamble_n this_o statute_n make_v three_o sort_n of_o offence_n some_o high_a treason_n some_o that_o disable_v and_o in_o capacitate_v from_o hold_v any_o place_n or_o office_n and_o some_o that_o be_v punishable_a by_o praemunire_n as_o to_o the_o first_o it_o be_v hereby_o declare_v to_o be_v high_a treason_n during_o the_o life_n of_o his_o present_a majesty_n 1._o within_o or_o without_o the_o realm_n to_o compass_v or_o in_o tend_v the_o death_n destruction_n maim_v wound_v imprisonment_n or_o restraint_n of_o the_o king_n 2._o or_o to_o deprive_v or_o depose_v he_o or_o levy_v war_n against_o he_o within_o the_o realm_n or_o without_o to_o stir_v up_o foreigner_n to_o invade_v the_o realm_n if_o such_o compassing_n or_o intention_n be_v express_v utter_v or_o declare_v by_o any_o print_n write_v preach_a or_o the_o person_n of_o his_o majesty_n or_o the_o establish_a government_n whoever_o be_v legal_o convict_v of_o any_o of_o these_o crime_n shall_v be_v disable_v to_o hold_v any_o place_n office_n or_o promotion_n ecclesiastical_a civil_a or_o military_a and_o beside_o be_v liable_a to_o such_o punishment_n as_o by_o the_o common_a law_n or_o statute_n may_v be_v inflict_v as_o to_o the_o three_o to_o declare_v publish_v or_o affirm_v first_o that_o the_o old_a long_a parliament_n of_o 40_o be_v not_o dissolve_v or_o aught_o to_o be_v in_o be_v second_o that_o there_o lie_v any_o obligation_n their_o land_n and_o tenement_n good_n and_o chattel_n forfeit_v to_o the_o king_n and_o their_o body_n to_o be_v seize_v etc._n etc._n but_o in_o this_o act_n of_o the_o 13_o caroli_n there_o be_v these_o proviso_n 1._o as_o for_o the_o two_o last_o sort_n of_o offence_n that_o be_v not_o treason_n none_o shall_v be_v prosecute_v but_o by_o order_n of_o the_o king_n under_o his_o sign_n manual_n or_o of_o the_o privy_a council_n 2._o as_o for_o the_o crime_n make_v treason_n none_o shall_v be_v indict_v or_o convict_v unless_o they_o be_v accuse_v by_o two_o lawful_a and_o credible_a witness_n touch_v the_o addition_n of_o the_o word_n credible_a to_o lawful_a which_o be_v here_o again_o repeat_v we_o have_v speak_v before_o but_o must_v here_o further_o observe_v 1._o that_o by_o these_o express_a word_n this_o statute_n provide_v that_o no_o man_n shall_v be_v indict_v that_o be_v have_v a_o bill_n find_v against_o he_o upon_o this_o statute_n for_o treason_n unless_o he_o indict_v upon_o this_o statute_n a_o special_a right_n and_o direction_n from_o the_o act_n itself_o to_o examine_v and_o be_v well_o satisfy_v in_o the_o credibility_n of_o the_o witness_n which_o if_o due_o consider_v will_v perhaps_o much_o mitigate_v the_o clamour_n late_o raise_v against_o some_o juries_n for_o their_o return_v some_o bill_n before_o they_o ignoramus_n though_o the_o matter_n therein_o be_v roundly_o swear_v unto_o by_o legal_a but_o probable_o in_o their_o esteem_n and_o judgement_n as_o they_o be_v upon_o their_o oath_n not_o sufficient_o credible_a witness_n presumption_n that_o more_o may_v come_v in_o against_o he_o before_o he_o be_v bring_v to_o trial_n for_o the_o word_n be_v unless_o he_o be_v thereof_o accuse_v by_o the_o testimony_n and_o deposition_n of_o two_o lawful_a and_o credible_a witness_n which_o witness_n at_o his_o arraignment_n shall_v be_v bring_v before_o he_o face_n to_o face_n etc._n etc._n so_o that_o it_o be_v evident_o intend_v the_o original_a accusation_n before_o the_o justice_n or_o magistrate_n that_o shall_v commit_v the_o person_n must_v be_v by_o two_o such_o witness_n and_o that_o the_o same_o three_o month_n after_o such_o prosecution_n so_o that_o if_o in_o either_o of_o these_o respect_v the_o time_n be_v elapse_v the_o grand_a jury_n ought_v not_o to_o find_v the_o bill_n 4._o provide_v this_o act_n shall_v not_o infringe_v the_o privilege_n or_o freedom_n of_o debate_n in_o either_o of_o the_o house_n of_o parliament_n or_o any_o committee_n of_o they_o 5._o that_o a_o peer_n
shall_v be_v try_v for_o any_o offence_n against_o this_o act_n by_o his_o peer_n but_o if_o convict_a shall_v be_v disable_v to_o sit_v in_o parliament_n during_o life_n and_o thus_o much_o for_o what_o be_v treason_n at_o this_o day_n by_o the_o statute_n of_o 1_o and_o 2_o phil._n and_o mar._n cap_n 10._o all_o trial_n for_o treason_n shall_v be_v only_o according_a to_o the_o course_n of_o by_o the_o neck_n to_o be_v cut_v down_o be_v yet_o alive_a his_o privy_a member_n cut_v off_o his_o bowel_n rip_v up_o take_v out_o and_o burn_v before_o his_o face_n his_o headsevered_a from_o his_o body_n his_o body_n divide_v into_o four_o quarter_n which_o be_v to_o be_v dispose_v of_o as_o the_o king_n shall_v order_v but_o for_o counterfeit_v coin_n only_o draw_v and_o hang_v and_o in_o both_o case_n for_o a_o woman_n for_o modesty_n sake_n it_o be_v only_o that_o she_o shall_v be_v burn_v the_o reason_n or_o signification_n of_o this_o horrid_a judgement_n on_o a_o man_n for_o they_o be_v only_o behead_v but_o if_o a_o person_n be_v attaint_v of_o murder_n or_o any_o other_o felony_n if_o he_o be_v behead_v it_o be_v no_o execution_n of_o the_o judgement_n because_o there_o the_o judgement_n always_o be_v that_o he_o be_v hang_v till_o he_o be_v dead_a which_o can_v be_v alter_v so_o that_o have_v count_n cunning_a smark_n late_o be_v convict_v and_o condemn_v for_o the_o murder_n of_o esquire_n thynn_n all_o his_o guiny_n or_o his_o friend_n can_v not_o have_v preserve_v he_o from_o the_o gallow_n unless_o they_o can_v have_v get_v a_o entire_a pardon_n any_o person_n be_v indict_v for_o treason_n may_v challenge_v that_o be_v except_o against_o or_o refuse_v five_o and_o thirty_o juror_n peremptory_o that_o be_v for_o his_o pleasure_n or_o for_o reason_n
