upon_o some_o pretend_a story_n at_o his_o own_o house_n whereof_o kelly_n give_v the_o witness_n notice_n at_o night_n they_o lodge_v he_o in_o a_o house_n at_o st._n clement_n and_o about_o seven_o a_o clock_n green_n call_v the_o witness_n out_o of_o his_o own_o house_n in_o princes-street_n to_o semerset-house_n that_o about_o eight_o or_o nine_o a_o clock_n hill_n come_v before_o up_o the_o and_o desire_v he_o to_o come_v and_o try_v whether_o he_o can_v pacify_v they_o he_o be_v very_o unwilling_a but_o be_v entreat_v he_o go_v down_o till_o he_o come_v to_o the_o bottom_n of_o the_o rail_n and_o then_o green_a twist_a his_o handkerchief_n and_o throw_v it_o about_o his_o neck_n and_o throw_v he_o behind_o the_o rail_n and_o there_o throttle_v he_o and_o punch_v he_o and_o girald_n a_o priest_n as_o also_o be_v kelly_n will_v have_v thrust_v his_o sword_n through_o he_o but_o the_o rest_n will_v not_o permit_v he_o for_o fear_v it_o shall_v discover_v they_o by_o the_o blood_n that_o about_o a_o quarter_n of_o a_o hour_n after_o the_o witness_n come_v down_o and_o find_v he_o be_v not_o quite_o dead_a and_o than_o green_n wring_v his_o neck_n quite_o round_o that_o he_o watch_v the_o water-gate_n and_o berry_n the_o stair_n while_o the_o murder_n be_v a_o do_v but_o these_o circumstance_n they_o all_o tell_v he_o afterward_o that_o when_o he_o come_v to_o they_o there_o be_v hill_n green_n girald_n and_o kelly_n about_o the_o body_n and_o berry_n come_v to_o they_o from_o the_o stair_n and_o they_o six_o help_v to_o carry_v the_o body_n into_o hill_n chamber_n in_o dr._n godwin_n house_n where_o it_o lay_v till_o monday_n night_n something_o be_v throw_v over_o it_o and_o then_o it_o be_v remove_v into_o somersethouse_n and_o hill_n show_v it_o he_o with_o a_o darklanthorn_n girald_n hill_n and_o kelly_n be_v then_o in_o the_o room_n on_o tuesday_n night_n it_o be_v remove_v back_o again_o towards_o hill_n chamber_n but_o somebody_o be_v there_o they_o lay_v it_o in_o a_o room_n just_o over_o against_o suppose_v to_o belong_v to_o sir_n john_n arundel_n lodging_n there_o it_o lay_v till_o wednesday_n night_n about_o nine_o a_o clock_n when_o they_o remove_v it_o into_o the_o room_n where_o it_o first_o lie_v and_o the_o witness_v come_v just_a as_o they_o be_v remove_v it_o they_o be_v affright_v and_o run_v away_o but_o he_o speak_v berry_n come_v back_o again_o and_o get_v the_o body_n up_o into_o the_o room_n and_o about_o twelve_o a_o clock_n they_o carry_v it_o away_o in_o a_o sedan_n which_o hill_n bring_v that_o the_o witness_n and_o girald_n carry_v the_o sedan_n green_n and_o kelly_n go_v before_o and_o berry_n open_v the_o gate_n at_o a_o hem_o that_o they_o carry_v he_o into_o covent-garden_n and_o then_o green_a and_o kelly_n to_o long-acre_n and_o then_o they_o again_o to_o soe-hoe_a church_n where_o hill_n meet_v they_o with_o a_o horse_n on_o which_o they_o set_v the_o body_n astride_v force_v open_a his_o leg_n and_o hill_n hold_v he_o up_o and_o so_o leave_v the_o sedan_n in_o one_o of_o the_o new_a house_n there_o till_o they_o come_v back_o again_o green_n hill_n girald_n and_o kelly_n go_v away_o with_o he_o and_o as_o they_o tell_v the_o witness_n next_o morning_n they_o have_v run_v he_o through_o with_o his_o own_o sword_n throw_v he_o into_o a_o ditch_n and_o lay_v his_o look_v to_o their_o office_n never_o interpose_v at_o all_o and_o if_o he_o have_v true_o he_o shall_v have_v bid_v the_o lord-mayor_n have_v look_v to_o his_o office_n the_o management_n of_o the_o hall_n at_o election_n have_v always_o be_v judge_v in_o his_o time_n the_o right_a of_o the_o sheriff_n then_o mr._n holt_n urge_v for_o the_o defendant_n that_o this_o assembly_n upon_o such_o a_o supposition_n of_o the_o sheriff_n right_o can_v not_o be_v make_v a_o riot_n so_o long_o as_o no_o extravagance_n be_v commit_v and_o mr._n wallop_v speak_v to_o the_o same_o purpose_n and_o then_o mr._n deputy_n sibley_n depose_v that_o he_o have_v be_v on_o the_o livery_n every_o since_o 1639_o and_o that_o he_o never_o remember_v any_o lord-mayor_n to_o interpose_v in_o election_n till_o here_o of_o late_a it_o be_v always_o leave_v to_o the_o sheriff_n as_o belong_v of_o right_n to_o they_o and_o mr._n winstanley_n swear_v that_o the_o poll_n in_o sir_n robert_n clayton_n time_n be_v manage_v by_o the_o sheriff_n then_o mr._n jackson_n depose_v only_o that_o the_o crowd_n be_v so_o great_a he_o can_v scarce_o see_v one_o way_n or_o other_o but_o mr._n roe_n depose_v that_o he_o than_o see_v a_o matter_n of_o a_o hundred_o with_o their_o hat_n upon_o stick_n cry_v damn_v the_o whig_n say_v the_o work_n be_v do_v to_o stop_v the_o poll._n whence_o the_o defendant_n counsel_v infer_v that_o if_o there_o be_v any_o rudeness_n those_o very_a people_n that_o come_v with_o the_o lord-mayor_n be_v the_o cause_n of_o it_o after_o this_o mr._n attorney_n general_n call_v sir_n simon_n lewis_n and_o sir_n jonathan_n raymond_n who_o be_v sheriff_n when_o sir_n robert_n clayton_n be_v lord_n mayor_n and_o they_o both_o depose_v that_o they_o take_v the_o lord_n mayor_n direction_n and_o that_o he_o do_v adjourn_v the_o court_n and_o they_o only_o appoint_v from_o day_n to_o day_n till_o the_o pole_n be_v end_v sir_n james_n smith_n who_o be_v sheriff_n the_o year_n after_o sir_n robert_n clayton_n depose_v that_o he_o never_o hear_v it_o question_v but_o that_o the_o lord_n mayor_n have_v the_o right_a of_o adjourn_v and_o then_o mr._n common-sergeant_n relate_v the_o whole_a passage_n and_o depose_v that_o sir_n robert_n clayton_n do_v adjourn_v the_o court_n himself_o after_o which_o mr._n williams_n urge_v particular_o in_o defence_n of_o the_o lord_n grey_n that_o he_o be_v there_o only_o accidental_o come_v to_o sir_n william_n gulston_n with_o who_o he_o be_v treat_v about_o sell_v the_o manor_n of_o corsfield_n in_o essex_n one_o mr._n ireton_n who_o treat_v for_o he_o depose_v that_o there_o be_v such_o a_o treat_v on_o foot_n and_o that_o he_o hear_v of_o a_o appointment_n to_o meet_v again_o and_o sir_n thomas_n armstrong_n depose_v that_o he_o see_v sir_n william_n and_o my_o lord_n together_o that_o night_n about_o eight_o a_o clock_n after_o which_o the_o counsel_n for_o the_o defendant_n urge_v that_o the_o case_n be_v so_o probable_a their_o insist_v upon_o it_o will_v not_o make_v it_o a_o riot_n and_o that_o the_o assembly_n be_v not_o continue_v in_o a_o tumultuous_a manner_n but_o with_o a_o good_a intent_n and_o it_o can_v not_o be_v a_o riot_n unless_o there_o be_v a_o evil_a intention_n to_o do_v some_o mischief_n instantce_v in_o the_o case_n of_o sir_n robert_n atkins_n then_o mr._n attorney_n general_n sum_v up_o the_o evidence_n assert_v that_o assembly_n to_o be_v unlawful_a after_o the_o adjournment_n of_o the_o lord-mayor_n and_o a_o be_v present_a therein_o and_o countenance_v it_o be_v enough_o to_o make_v they_o guilty_a of_o the_o riot_n the_o lord_n chief_a justice_n sum_v up_o much_o to_o the_o same_o purpose_n and_o then_o the_o jury_n withdraw_v for_o some_o time_n bring_v in_o all_o the_o defendant_n guilty_a of_o the_o trespass_n
next_o design_n be_v to_o be_v on_o novemb_n the_o 17_o but_o the_o country_n not_o be_v then_o in_o a_o readiness_n the_o earl_n of_o shaftsbury_n upon_o hear_v it_o go_v away_o for_o holland_n that_o after_o this_o they_o all_o begin_v to_o lie_v under_o a_o sense_n that_o they_o have_v go_v so_o far_o and_o communicate_v it_o to_o so_o many_o that_o it_o be_v unsafe_a to_o make_v a_o retreat_n and_o for_o the_o carry_v it_o on_o think_v it_o necessary_a there_o shall_v be_v some_o general_a council_n that_o shall_v take_v upon_o they_o the_o care_n of_o the_o whole_a whereupon_o they_o erect_v the_o council_n of_o six_o which_o consist_v of_o the_o duke_n of_o monmouth_n earl_n of_o essex_n lord_n russel_n mr._n hambden_n jun._n col._n sidney_n and_o himself_o that_o these_o meet_v at_o mr._n hambden_n house_n about_o the_o middle_n of_o january_n last_o and_o there_o the_o particular_n offer_v to_o their_o consideration_n whereto_o they_o be_v to_o bring_v their_o advice_n be_v whether_o the_o insurrection_n be_v most_o proper_a to_o be_v begin_v in_o london_n or_o in_o the_o country_n or_o both_o in_o a_o instant_a what_o country_n and_o town_n be_v fit_a and_o most_o dispose_v to_o action_n what_o arm_n be_v necessary_a to_o be_v get_v and_o how_o to_o be_v dispose_v how_o to_o raise_v a_o common_a bank_n of_o 25_o or_o 30000_o l._n to_o answer_v all_o occasion_n and_o last_o how_o to_o draw_v scotland_n to_o consent_v with_o they_o it_o be_v think_v necessary_a that_o all_o diversion_n shall_v be_v give_v that_o about_o ten_o day_n after_o the_o same_o person_n meet_v again_o at_o the_o lord_n russel_n where_o it_o be_v resolve_v to_o send_v into_o scotland_n to_o invite_v some_o person_n hither_o who_o can_v give_v the_o best_a account_n of_o the_o state_n thereof_o viz._n sir_n john_n cockram_n the_o lord_n melvil_n and_o sir_n hugh_n campbel_n and_o that_o in_o discourse_n it_o be_v refer_v to_o col._n sidney_n to_o take_v care_n of_o that_o business_n who_o afterward_o tell_v he_o he_o have_v send_v aaron_z smith_n and_o give_v he_o 60_o guiny_n for_o his_o journey_n that_o to_o avoid_v observation_n they_o conclude_v not_o to_o meet_v till_o the_o return_n of_o this_o messenger_n and_o he_o go_v in_o the_o mean_a time_n to_o his_o estate_n in_o essex_n and_o thence_o to_o the_o bath_n he_o know_v nothing_o more_o only_o when_o he_o come_v back_o he_o be_v inform_v smith_n be_v come_v back_o and_o sir_n john_n cockram_n with_o he_o that_o he_o be_v sure_o the_o lord_n russel_n be_v present_a at_o these_o prisoner_n insist_v that_o most_o he_o have_v say_v be_v only_a hearsay_n and_o the_o two_o time_n they_o meet_v be_v not_o upon_o any_o form_a design_n but_o to_o talk_v of_o news_n and_o they_o be_v delight_v to_o hear_v the_o lord_n howard_n talk_v be_v full_a of_o discourse_n of_o a_o voluble_a tongue_n and_o talk_v well_o and_o that_o he_o never_o see_v any_o of_o the_o scotch_a gentleman_n only_o the_o lord_n melvil_n but_o never_o upon_o this_o account_n here_o the_o attorney_n general_n urge_v that_o aaron_n smith_n do_v go_v into_o scotland_n and_o that_o campbel_n he_o go_v for_o be_v take_v which_o mr._n atterbury_n swear_v that_o he_o be_v then_o in_o his_o custody_n and_o that_o he_o have_v be_v by_o his_o own_o confession_n four_o day_n in_o london_n before_o he_o be_v take_v then_o mr._n west_n depose_v that_o he_o never_o have_v any_o conversation_n with_o the_o prisoner_n only_o he_o have_v hear_v mr._n ferguson_n and_o col._n rumsey_n say_v that_o the_o lord_n russel_n in_o the_o insurrection_n in_o november_n intend_v to_o take_v his_o post_n in_o the_o west_n where_o mr._n trenchard_n have_v fail_v they_o and_o that_o they_o most_o depend_v upon_o he_o because_o he_o be_v look_v upon_o as_o a_o person_n of_o great_a sobriety_n but_o this_o be_v all_o but_o hear-say_n the_o court_n will_v not_o admit_v it_o as_o evidence_n the_o king_n counsel_n therefore_o leave_v the_o evidence_n here_o and_o call_v on_o the_o prisoner_n to_o make_v his_o defence_n who_o to_o all_o this_o make_a answer_n that_o he_o can_v not_o but_o think_v himself_o mighty_a unfortunate_a to_o stand_v there_o charge_v with_o so_o high_a a_o crime_n and_o that_o intermix_v with_o the_o horrid_a practice_n and_o speech_n of_o other_o people_n the_o king_n counsel_n
