the viij Betweene I. T. and E. M. Citizens Haberdashers of London on the one partie And I. B. and R. I. of the same City Grocers on the other party Witnesseth that whereas at the day of making hereof it is accorded couenanted concluded agreed between the said parties and either of the same parties by himselfe for his own part couenanteth granteth and bindeth himself to the other that they and either of them shall jointly as partners occupie together aswell in buying and selling of al maner goods wares and marchandizes as by factorship alienation exchange and otherwise aswell beyond the sea as on this side that is to say from the day of making hereof vnto the end and terme of v. yeares then next following fully to bee complet and ended During which time or terme either of the said parties shal be iust faithfull and true to other in buying and selling and otherwise as is aforesayd And all such lucre profit and increase gaine aduantage and winning as shall come and grow in buying selling any goods wares or marchandizes and otherwise during the said terme shal be equally parted and diuided between the said parties that is to say either of them to haue his iust and true portion or part of the gaines aforesaid And at all times within the said terme when it shall please either of the said parties to giue admonition or warning to other then either of them to make the other a iust true reckoning and account of the buying selling of all maner wares goods marchandizes and otherwise as is aforesaid and of the increase and aduantage that shall come and grow of the same And also it is couenanted and agreed betweene the said parties that if either of the said parties at any time within the said terme happen to loose by debts casualtie or otherwise any part or parcell of the occupying in buying selling of any goods wares and marchandizes and otherwise in maner and forme as is aforesaid so that it bee not by negligence colour or fained pretence and that immediatly proued that the same losse be borne equally between either of the said parties And also it is couenanted concluded and agreed betweene the said parties and either of themselues and for his owne part promiseth couenanteth and graunteth to the other that if any of them within the sayd terme which at this present time are not espoused happen hereafter to espouse and marry a wife that then forthwith it shall bee at the will and pleasure of the other whether the partie so espoused or maried shall any longer continue as partner according to the tenor forme aboue rehearsed And also it is agreed that if either of the parties happen as God defend at any time within the said terme to die then the executors or administrators of the goods chattels of the partie so deceased shall truely without any couine or guile make a iust and true accompt and ready paiment and deliuery of all such increases and gaines as then shall bee remaining to the other liuing And moreouer it is couenanted and agreed betweene the said parties that if either of them be foūd vntrue in his receiuing or accompt contrary to the true meaning of this present Indenture to the value of xx s. sterling then the same partie so found defectiue to forfeit and pay to the other an C. pounds sterling without any delay according to the tenour and true meaning of this present Indenture And to all and singuler couenants promises conditions and payments aforesaid on either partie to bee truely without couin or fraud obserued fulfilled and kept in maner and forme as is aforesaid either partie for him his executors bindeth himselfe to the other in the summe of three hundreth pounds sterling well and truely to be paid by these presents In witnes whereof the parties aforesaid to these Indentures interchangeably haue set to their seales Giuen the day and yere abouesaid ¶ An Indenture for a Prentice HEe Indentura testatur quod G. S. the son of I. S. of new Sarum in the Countie of Wilshire marchant hath put himselfe apprentice with W. Webbe of New Sarum aforesaid in the countie of Wilshire tailor and after the maner of an apprentice with him to dwell from the feast of Christmas next comming after the date hereof vnto the end and terme of viij yeres then next ensuing and fully to be complete By all which said terme the said T. apprentice to the said W. as his Master well and faithfully shall serue his secrets shall keepe his commaundements lawfull and honest euery where shall do no fornication in the house of his

that the said Ordinarie shall institute and induct the said Sir Iohn Parson of the said parish Church and Parsonage Whereupon it is couenanted concluded and fully agreed betweene the said parties either of them couenanteth and graunteth to and with the other of them by this Indenture in manner and forme following that is to wit the said Sir Iohn for him and his executors conenanteth and graunteth to and with the said sir Simond by these presents that the same sir Iohn at such time as hee shall be lawfully instituted and inducted Parson of the said parish Church and Parsonage shall make or cause to be made to the said sir Simond such a good sure sufficient and a lawfull bond as shall be reasonably aduised or deuised by the said sir Simond or his learned counsel for the assurance suertie and sure payment of an annuable pension of vij pounds of good lawfull money of England to be paid to the said sir Simon or his assignes vpon the Font stone in the body of the Cathedrall Church of S. Paul in London at two termes of the yeare that is to wit on the day of All Saints betweene the houres of nine eleuen of the clocke before noone of the same day three pounds ten shillings and on the day of Pentecost betweene nine and eleuen of the clocke beforenoone of the same day three pounds and ten shillings and so from yeare to yeare one after an other then next and immediatly following during the naturall life of the said sir Simond the first terme of payment thereof to begin on the day of All Saints now next comming And also that the said sir Iohn and his executors at all and euery time and times hereafter shall cleerely acquite and discharge and saue harmelesse the sayd sir Simond and his executors and euery of them aswell against the King our Soueraigne Lord as against all and euery other person or persons of and for all maner of dismes subsidies taxes and tallages and all other charges whatsoeuer they bee beeing due to be paid and borne out for the said benefice And moreouer the sayd Sir Iohn couenanteth and graunteth to and with the sayd sir Simond by these presents that the same Sir Iohn within xiiij dayes next and immediatly after that hee shall bee so instituted and inducted shall by his deed sufficient in the law clearely remit and release vnto the said sir Simond all and all maner actions suits quarrels debts debates accompts trespasses iniuries demaunds whatsoeuer they be which against the said sir Simond and his executors euer hee hath had or hereafter shall now haue aswell by reason of dilapidations of the said Church Parsonage as by any other reason or cause from the beginning of the world vnto the day of the date of the said Letters of acquitance And furthermore the sayd sir Iohn for him and his executors couenanteth and granteth to and with the said Sir Simond by these presents that he the same Sir Iohn or his assignes before the feast of all Saints now next comming shall deliuer or cause to bee deliuered to the sayd Sir Simond or his assignes a good sure sufficient and a lawfull decree vnder the seale of the said Ordinarie whereby or wherewith the sayd Parish Church shall stand and bee sufficiently charged and bound for the assurance and sure paiment of the said yearely pension of vij l. to be paid to the said Sir S. or his assignes during the life naturall of the sayd sir S. after the forme abouesaid And also the said sir Iohn couenanteth and graunteth by these presents that in case one Th. H. Esq one of the Patrons of the said benefite his heires or assignes doe not feale the presentation whereby the said sir Iohn should bee presented Patron of the said Parish Church parsonage that then the said Sir Simond shall bee restored againe to his said benefice without any let gainsaying or interruption of the said sir Iohn or any other person or persons by or for him the foresaid resignation or any other couenant aboue specified to the contrary in any wise notwithstanding And the said sir Simond for him his executors will and graunteth by these presents that if the said sir Iohn well and truely performe obserue and keepe all and euery the couenants graunts promises and paiments abouesaid which on his part are to be performed obserued fulfilled and kept in manner and forme aboue rehearsed That then an obligation of the date of these presents wherein the said sir Iohn and one William Browne of the parish of saint Dominicke in the said County of Cornwall yeoman be iointly holden bounden to the said sir Simond in CC. Markes sterling shall be voide and had for nought or else it shall stand in full strength and vertue In witnesse whereof the said parties to these Indentures interchangeably haue set to their seales Giuen the day and yeare aboue writen ¶ An Indenture where the executor of the second leasee graunteth ouer his estate with a stocke THis Indenture made betweene Agnes Iohnson of London widdow late the wife and executrix of the Testament and last will of William I. while he liued Citizen Haberdasher of London on the one partie and William H. Citizen and Haberdasher of London on the other partie Witnesseth that where W. Kellot c. by his Indenture dated c. demised graunted and let to ferme to I. Harison citizen while he liued Mercer of London which wise and execurrix one W. T. citizen and Mercer of London hath maried all that his tenement with shops sellers sollers and other the appurtenances set and being in B. in the parish of saint Martins next to Ludgate of London late being two tenements and the which the said Iohn H. sometime held and occupied To haue and to hold to the said I. his executors and assignes from the feast of the Natiuitie of Saint Iohn the Baptist last before the date of the said Indenture vnto the end and terme of twentie yeares then next ensuing and fully to be complet and fulfilled Yeelding and paying therefore yearely to the said W. his heires assignes sixe poundes sterling at foure termes in the yeare in the Citie of London vsually by euen porcions together with diuers other couenants articles and clauses in the said Indenture expressed as by the same Indenture at large may appeare And where also the said William T. by his Indenture dated the x. day of Ianuary in the xxiij yeare of the Raigne of our soueraigne Lord king Henry the eight bargained graunted and sold to the said W.I. his executors and assignes all his estate interest and terme of yeares that then were due and for to come to of and in the premisses by force whereof the said William I. entred into the said tenements and other the premisses and was thereof possessed accordingly for the terme aforesaid and so dyed thereof possessed It is now bargained couenanted condiscended
Canons and their successors during the said terme Also the said A. couenanteth and granteth for him c. to make payment at and within the sayd Colledge of the said yerely rent of lxxx poūds equally at the termes of paiment before specified to the hands of the Treasorers of the said Colledge at his owne proper costes charges without allowance taking for the same during the sayd terme And the said Deane Canons for them their successors do couenant and graunt by these presents that the acquitances made sealed signed by the Treasorers of the said Colledge or by eyther of them to the said A. or to his executors or his assignes for the payment of the same yearely rent or any part or parcell thereof in maner and forme before mentioned shall be a good sure and sufficient warrant and discharge vnto the said A. his executors and assignes and to his or their deputie or deputies for the payment thereof And if it happen that the said yearely rent of lxxx li. be behind vnpaid in part or in all after any feast of payment before specified by the space of ten weekes that then it shall be lawfull to the said Deane c. in the said Manors and Lordships and into all and singuler the premisses with their appurtenāces to enter to distrain the distres there so taken to driue lead cary away them to withhold and keepe vntill the said yerely rent euery part thereof with tharrerages if any be vnto the said Deane c. be fully satisfied contented paid And if it happen the said yerely rent of lxxx li. to be behind vnpaid in part or in all after any of the feasts of payment before mentioned by the space of iii. moneths that then it shal be lawful vnto the said Deane Canons to their successors into all singuler the premisses their appurtenances in euery parcel thereof to reenter them to haue againe repossesse as in their former state and the said A. his executors assignes from thence vtterly to expell and amoue for euermore This Indenture or any thing therein contained to the contrary in any wise notwithstanding And the said Deane Canons couenanten granten for them their successors to with the said A. his executors or assignes that if the said A. his executors or assignes shall happen at any time hereafter to be euicted or dispossessed of any of the premisses or any part or parcell thereof without couin or fraud on the part of the said A. his executors c. that then the said rent of lxxx li. sterling shal be apportioned diminished accordingly after such rate portion as the quality and value of the said lands and tenements rents hereditaments and other dueties parcell of the premisses so euicted or taken from the possession or occupation of the said A. his executors or assignes shall amount or arise vnto And that it shall be lawfull vnto the said A. his executors or assignes to defaulk so much of his rent at euery of the said paiments This Indenture c. notwithstanding Also furthermore the said Deane and Canons couenanten and graunten for them c. to do cause suffer to be done all and singuler such thing and things act acts as shall be at any time or times hereafter deuised or aduised by the counsel learned of the said A. D. his executors or assigns by what waies or meanes soeuer it be for the further assurance and full perfit suerty of all and singuler the premisses and euery part and parcell thereof if this graunt and lease be not lawfull perfit and sufficient to be had and made vnto the said A. D. his executors or assignes for all the whole terme and interest aboue specified or for any part or parcell thereof in maner and forme aforesaid vpon conuenient notice request thereof giuen made vnto the said Deane Canons or to any of their successors by the said A. his executors or assignes at the costs in the law of the said A. his executors or assignes And the said A. couenanteth graunteth to and with the said Deane c. to find house lodging meat stable hay and prouender for the horses of the said Deane Canons other comming with him or them in progresse once in the yeare by the space of two dayes and two nights the sayd Deane and Canons and their successors paying reasonably for onely meate and drinke so prouided during the terme aforesaid And further the said A. couenanteth granteth for him c. that he his executors and assignes shall at the end and terme of euery xij yeres during the said terme deliuer or cause to be deliuered vnto the said Deane c. the Court Rolles well and truely ingrossed in parchment at his their costes and charges of such courts as shall be kept in the said manors of T and C. during any of the sayd xij yeres And also at the end of euery such xij yeres he the said A. his executors or assignes shall as neere as they can deliuer or cause to be deliuered to the said Deane c. in maner before rehearsed a true Terrar of all the lands tenements rents and seruices being parcell or any wise appertayning to the said manors And the said Deane Canons couenanten and graunten for them c. that they shall deliuer or cause to be deliuered to the said A. c. at such times as they shal be therevnto required one or two of their most true terrars wherby the said A. his executors or assignes may the better come to knowledge of all the said lands tenements rents and seruices appertayning to the said manors And the said Deane and Canons and their successors all the said manors or Lordships and all other the premisses before letten with all and singuler their appurtenances except before excepted vnto the said A. his executors and assignes for the said yearely rent in maner and forme before declared against all people shall warrant and defend during the said terme by these presents And also where the said A. standeth bounden vnto the said Deane Canons and their successors by their deed obligatory bearing date of these presents in the summe of one hundred pounds sterling the said Deane and Canons couenanten graunten for them and their successors to and with the said A. his executors administrators or assignes that if the said A. his executors administrators or assignes do well truely obserue performe fulfill and keepe all singuler such couenants graunts promises articles and agreements comprised in this Indenture which on the one part and behalfe of the said A. his executors administrators or assignes ought to be obserued performed fulfilled kept that then the said deed obligatory to be void and of none effect or else to stand in his full strength and vertue In witnesse whereof to the one part of these Indentures with
sue for the same binding the seller that he shall not giue any quitance to the partie to the danger of the buyer c. THe condition of this obligation is such that whereas the within bounden E. F. made and ordained the within named C.D. his his especial good and lawfull Atturney to aske leuy c. to the vse profite and commoditie of the sayd E.F. of one G. H. citizen of London Grocer xx li. sterling in which the said G. H. by his Obligation thereof made standeth bound to the said C.D. as in a certaine letter of Atturney by the said C. to the aboue named E. F. thereof giuen more euidently appeareth If the said C. D from the date of this present Obligation do not call againe reuoke or disanul the foresaid letter of Atturney nor any maner sale plee or action by the foresaid E. F. in the name of the fore rehersed A. against the aboue written G. H. or his executors in anie court hereafter to be commenced or depending or by any other meanes withstand let or interrupt the title of the same E. of and to the sayd summe of xx li. nor giue vnto the said G. H nor to his executors any maner quitāce discharge or releas of or vpon the said summe or any part or portion of the same that then this present obligation c. ¶ A condition for to keepe the Peace and to be of good abearing THe Condition of this Obligation is such that if the within bounden Sunon and Elizabeth his wife do keepe the peace against al the Kings liege people and especially against A.B.C.D. c. beare himself honestly duly both in his words and deeds against the said A B. c. nor slander them nor any of thē of or vpon any such matters touching the death of I M. or the sure about the trial of the same wherein the said A. B. c. by the kings Laws ecclesiasticall temporall is clerely declared innocent That then c. ¶ A condition to warrant the sale of a Ship THe Condition of this Obligation is such that where the within bounden A. B. sold vnto the within named C. D. a certaine Ship called the Mary of Calice all maner of battaile instruments furniments and apparel of the same ship with the appurtenances for a certaine summe of money betweene them accorded as in a bill of sale therof made plainly doth appeare If the said C.D. wel and peaceable may haue holde enioy possesse to him his heires and assignes al the said ship battel instrum̄ts apparel appurtenāces aforesaid without contradiction let or disturbance of any person or persons by reasō of any claime or interest in the same before the date of these p̄sents had or made according to the tenour and effect of the said Indenture that then c. ¶ A Condition to cause a man to seale an Obligation by a certaine day THe condition c. that if the within bounden I. C. before the feast of N. next comming after the date hereof cause W.C. of the towne of B. to be bound by his writing obligatorie sufficient in the law and with his seale sealed vnto the within named T. in x. li. sterling to be paied the x. day of August c. And also before the same feast cause the said W. to deliuer the same obligation clerely for his deed duety in the Towne of B. vnto I. R. of H. clother to the vse of the said C. that then this present obligation c. ¶ A Condition to deliuer Oyles by a day limitted THe condition of this obligation is such that if the within bounden I. at any time before the feast of S. Mihael tharchangel next cōming after the date within written deliuer or cause to be deliuered in the City of London to W. R. within named or to his certaine Atturney heires or executors x. tunnes of oyle of Ciuile good sweet and marchandable full and well bound accordingly that then this present obligation c. ¶ A Condition to make an estate to an other by a certaine day THe condition of this obligation is such that if the within bounden A. before the feast of Easter next comming make vnto the within named R. and to such other persons as the sayd R. shall thereunto name assigne to haue and to hold to them their heires assignes a good sure sufficient lawful estate of and in all those lands tenements c. by deedes euidences sufficient in the law or by fine or recouery if need shall require or by any other sure and lawfull meanes as shall be aduised by the learned counsel of the said Richard his heires and assignes that then c. ¶ A Condition to saue a man harmeles that is bound for an other man by Recognisance THe condition of this obligation is such that where the within named A. B. C. D. at the special instance petition request of the within bounden N.D. and for his debt by a certain obligation of recognisance made before W. F. Recorder of the citie of L. and I.K. Knight Alderman of Londō the x. day c. stand boūd vnto the chamber of London in the summe of xx li. sterling by the way of recognisance as in the obligatiō plainly appeareth If the said N. D. his heires executors and assignes pay vnto the said chamberer all the foresaid summe of xx li. and also saue and keepe harmlesse the aboue named A. B. c. from all manner indemnities costes and charges of for and concerning the said obligation of recognisance and all other things concerning the same that then c ¶ A Condition to pay a Rent accordingly to an Indenture of a Lease THe condition of c. That where the within bounden A. B. hath lately taken in farme for the terme of 6. yeres of the within named C.D. one tenemēt set lying in the towne of W. c. for the rēt of xl s. yerely to be paid as in a paire of indentures thereof made whose date is c. plainely appeareth If the sayd A. B. his executors well and truely pay or cause to be paid to the sayd C. D. his heires and assignes the foresaid yerely rent of xl s. at the daies and termes accustomed according to the tenour and effect of the said Indentures c. That then c. ¶ A Condition vpon an Indenture of sale to make good the summe THe condition of this obligation is such that where the within bounden I. S. the day of the date within written for the summe of xx li. sterling bargained sold and deliuered to the within named T. P. diuers goods plate and iewels in a certaine Indenture comprehended bearing date c. vnder a condition in the same Indenture specified If the said I. S. make default of paiment in the said Indenture mentioned and comprised and then if all the foresaid goods plate and iewels indifferently prised be found of lesse value than xx markes
and agreed betweene the said parties by this Indenture in maner and forme following that is to wit The said Agnes I. by the vertue and authoritie of execution of the Testament and last Will of the said William I. her late husband hath bargained graunted and sold and by these presents cleerely bargaineth graunteth and selleth to the foresaid William H. all that right interest estate and terme of yeares which be yet due and for to come of and in the said tenement sometime two tenements by vertue of the foresaid Indentures or either of them And also the said Agnes the day of making of these presents hath deliuered into the hands and custodie of the said William H. for a stocke in ware ready money the summe of fortie pounds sterling To haue and to hold occupie and enioy the said tenement with the appurtenances and stocke of fortie pound and all the interests estates and termes of yeares that be yet due and for to come to of and in the said tenement to the said W. H. his executors and assignes from the day of the date of these presents vnto the feast of the Natiuitie of S. Iohn Baptist which shall bee in the yeare of our Lord. M. fiue hundred fortie fiue that is to say to the full end and accomplishment of as many yeares of the said terme as be yet to come mentioned in the said former and first Indenture of lease And for and in confideration of the bargaine graunt and sale aforesaid and for the vsage of the said stocke The said William H. couanteth and graunteth to and with the said Agnes by these presents that hee the same William his executors and assignes shall yearely during the said yeares yet to come well and truely content and pay and cause to bee contented and paid to the said Agnes her executors or assignes twentie Markes starling at foure termes of the yere that is to wit at the feast of Saint Michael the Archangell the Natiuitie of our Lord God the Annunciation of our Lady and the Natiuitie of S. Iohn the Bap. or within the moneth next insuing euery of the said feasts by euen portions Also the said W.H. couenanteth and granteth to and with the said Agnes by these presents that he his executors and assignes shall at the said feast of the Natiuitie of S. Iohn the Baptist which shall bee in the yere of our Lord God one thousand fiue hundred fortie sixe wel truely repay or cause to be repayed to the said Agnes her executors or assignes the said whole stocke of xl pounds sterling And the said W. H. couenanteth and graunteth by these presents to and with the said Agnes that he the same W. his executors or assignes shall beare and pay the said yearely rent of sixe pound and also performe and keepe all and euery articles couenants and charges which the said Iohn H. by the foresaid former Indenture or lease standeth bounden to performe and keepe And if it fortune any of the said yerely payments of twenty Markes to be behind vnpaid in part or in all ouer and after any terme of payment thereof abouesaid that it ought to be paid by the space of one Moneth if it be lawfully asked that then it shall bee lawfull to the said Agnes her executors or assignes in and vpon the said tenement and stocke wholy to reenter And the same as in her former estate to haue againe retaine and repossesse and the said W.H. his executors and assignes thereof and therefrom vtterly to expell amoue and put out This Indenture or any thing in the same contayned to the contrarie notwithstanding Furthermore it is couenanted and agreed betweene the said parties by these presents that the said Agnes at al times at her comming to London in her widowhood shall haue her lodging and libertie of the Chamber with the chimney ouer the hall of the said tenement with free entry and issue into and from the same without any let or contradiction of the said W.H. his executors or assignes during the foresaid yeares yet to come Moreouer the said Agnes couenanteth and graunteth to and with the said Willam H. by these presents that the same William his executors and assignes for and vnder the couenants graunts charges and payments abouesaid and in manner and forme aboue expressed shall peaceably and quietly haue hold occupie and inioy the said tenement and other the premisses without any maner interruption let or expulsion of the said Agnes her executors or assignes or of any other person or persons In witnesse whereof the said parties to these Indentures interchangeably haue set to their seales Giuen the twenty day of May c. ¶ A Supplication for a forfait to the King our Soueraigne Lord. MEekly sheweth vnto your Highnesse your humble seruants H. K and P. C. pages of your most honorable Chamber That whereas I. S. of N. in the Countie of N. yeoman and R. C. of the same Towne and Countie yeoman came before the Iustices of your peace within your said Countie and vndertooke by Recognusance before them that one W.M. of N. in the same Countie yeoman should not onely personally appeare before N. N. Knight and his fellowes Iustices of Peace of your said Countie at a generall Session then next to bee holden at Winchester within your said Countie the Thursday next after the feast of the Epiphanie of our Lord the xxxviij yere of your most noble Raigne but also that he should in the meane season keepe the peace against all your liege people and namely against I. B. widow either of them in the sum of ten pounds and the same W. M. vndertooke in likewise for him in the summe of twentie Markes like as in the said Recognisance more plainely appeareth at which day the said W. M. made default and appeared not by reason whereof the said I. C. and R. W. haue lost and forfaited vnto your highnesse either of them the summe of ten pound and the said W. M. twentie Markes Wherefore may it please your highnesse in consideration of the true and faithfull seruice which your said seruants daily do vnto your highnesse and during their liues intend to doe to giue and graunt vnto them all the sayd forfaiture forfaited as is abouesaid and thereupon to haue such and as many of your writings for the leuying of the same as in that case is accustomed And they shall euer pray to God for the preseruation of your most noble grace ¶ A priuie seale to the Treasorer and Chamberlain of the Exchequer for the same HEnry the eight c.
