quarter-session_n of_o the_o parish_n where_o the_o same_o way_n be_v as_o well_o under_o his_o own_o as_o the_o hand_n of_o the_o juror_n by_o who_o oath_n the_o same_o as_o lay_v out_o to_o the_o end_n the_o same_o may_v be_v there_o file_v or_o record_v and_o after_o know_v for_o a_o public_a highway_n and_o if_o the_o say_a surveyor_n shall_v neglect_v his_o duty_n therein_o he_o shall_v forfeit_v twenty_o pound_n and_o be_v it_o further_o enact_v that_o every_o vestry_n with_o consent_n of_o the_o justice_n may_v agree_v for_o two_o year_n with_o particular_a person_n for_o their_o part_n and_o proportion_n of_o the_o way_n by_o they_o to_o be_v clear_v as_o also_o with_o the_o surveyor_n what_o part_n of_o the_o parish_n they_o shall_v look_v after_o and_o such_o agreement_n shall_v discharge_v the_o party_n from_o other_o duty_n than_o what_o be_v agree_v for_o as_o also_o the_o surveyor_n from_o look_v after_o any_o other_o part_n than_o what_o be_v allot_v he_o and_o such_o justice_n and_o vestry-man_n be_v to_o record_v all_o their_o do_n touch_v the_o way_n in_o the_o vestry-book_n which_o record_v in_o all_o place_n shall_v be_v deem_v good_a evidence_n and_o the_o say_a surveyor_n may_v respective_o issue_v their_o warrant_n to_o the_o constable_n or_o tything-man_n to_o warn_v in_o worker_n or_o to_o levy_v money_n according_a to_o the_o tax_n or_o rate_v make_v as_o aforesaid_a and_o whosoever_o shall_v fail_v to_o send_v in_o his_o proportion_n of_o worker_n with_o such_o tool_n as_o shall_v be_v convenient_a shall_v for_o every_o head_n pay_v three_o shilling_n per_fw-la day_n upon_o conviction_n to_o be_v recover_v before_o any_o justice_n of_o the_o peace_n by_o the_o surveyor_n and_o if_o any_o justice_n neglect_v his_o duty_n touch_v the_o premise_n or_o any_o part_n thereof_o he_o shall_v forfeit_v ten_o pound_n and_o every_o vestry-man_n surveyor_n constable_n tythingman_n juror_n or_o clerk_n of_o the_o vestry_n who_o shall_v neglect_v he_o or_o their_o duty_n where_o no_o penalty_n be_v before_o set_v shall_v respective_o forfeit_v five_o pound_n for_o each_o offence_n all_o which_o say_v forfeiture_n shall_v be_v to_o the_o use_v of_o the_o highway_n and_o if_o not_o exceed_v forty_o shilling_n to_o be_v recover_v by_o action_n of_o debt_n before_o any_o justice_n of_o the_o peace_n if_o above_o forty_o shilling_n in_o any_o court_n of_o record_n where_o no_o essoign_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v a_o act_n appoint_v the_o price_n of_o meat_n be_v it_o enact_v and_o ordain_v by_o presume_v to_o ask_v demand_n and_o receive_v for_o fresh_a beef_n mutton_n or_o goat_n any_o more_o great_a or_o high_a rate_n or_o price_n than_o hereafter_o be_v mention_v viz._n for_o fresh_a beef_n or_o goat_n four_o penny_n per_fw-la pound_n and_o mutton_n six_o penny_n to_o be_v weigh_v without_o the_o head_n entrail_n or_o foot_n and_o that_o the_o suet_n be_v sell_v at_o no_o high_a rate_n than_o the_o meat_n aforesaid_a under_o penalty_n of_o forfeit_v twenty_o pound_n currant_n money_n of_o this_o island_n for_o every_o time_n they_o shall_v take_v ask_v or_o receive_v any_o high_a price_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o sell_v any_o beef_n mutton_n or_o goat_n by_o weight_n he_o or_o they_o for_o every_o such_o offence_n shall_v forfeit_v twenty_o pound_n currant_n money_n of_o this_o island_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o any_o person_n whatsoever_o that_o shall_v destroy_v any_o turtle_n nest_n or_o take_v away_o any_o of_o the_o egg_n thereof_o upon_o any_o bay_n or_o place_n within_o this_o island_n where_o the_o turtle_n shall_v lay_v shall_v forfeit_v forty_o shilling_n currant_n money_n of_o this_o island_n or_o receive_v so_o many_o lash_n on_o the_o bare_a back_o as_o any_o justice_n shall_v order_n not_o exceed_v nine_o and_o thirty_o for_o every_o such_o offence_n the_o one_o three_o part_n of_o all_o the_o aforesaid_a penal_a sum_n of_o money_n shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o one_o three_o to_o the_o churchwarden_n for_o the_o use_v of_o the_o parish_n the_o other_o three_o to_o the_o informer_n to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n by_o bill_n plaint_n or_o information_n in_o which_o no_o essoign_n wager_n of_o law_n or_o protection_n shall_v be_v allow_v an_z act_z angainst_a blasphemy_n and_o for_o prevent_v disorder_n in_o alehouse_n tavern_n and_o victualling-house_n be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o no_o person_n or_o person_n whatsoever_o in_o this_o island_n be_v enable_v to_o have_v and_o receive_v any_o licence_n or_o licenses_fw-la from_o the_o governor_n for_o the_o time_n be_v to_o retail_n any_o strong_a liquor_n unless_o they_o bring_v yearly_o certificate_n under_o the_o hand_n of_o two_o of_o the_o justice_n of_o the_o peace_n live_v in_o the_o same_o precinct_n where_o the_o say_a person_n keep_v or_o intend_v to_o set_v up_o his_o house_n of_o entertainment_n and_o have_v also_o give_v good_a security_n in_o the_o secretary_n office_n of_o one_o hundred_o pound_n that_o he_o shall_v suffer_v no_o disorder_n to_o be_v commit_v in_o his_o levy_v by_o distress_n by_o warrant_n from_o any_o justice_n of_o the_o peace_n within_o this_o island_n and_o whosoever_o shall_v by_o public_a and_o open_a profaneness_n or_o blasphemy_n dishonour_v almighty_a god_n and_o be_v thereof_o due_o convict_v in_o the_o supreme_a court_n of_o judicature_n shall_v be_v fine_v twenty_o pound_n currant_n money_n of_o this_o island_n or_o more_o at_o the_o punishment_n as_o the_o judge_n shall_v think_v meet_a loss_n of_o life_n and_o limb_n only_o except_v and_o it_o be_v further_o enact_v that_o if_o any_o of_o the_o say_a person_n so_o have_v receive_v licenses_fw-la as_o aforesaid_a shall_v keep_v or_o suffer_v any_o common_a game_n in_o their_o house_n they_o shall_v forfeit_v ten_o pound_n currant_n money_n of_o this_o island_n and_o whosoever_o shall_v by_o false_a dice_n or_o other_o fraud_n or_o deceit_n win_v any_o money_n or_o other_o thing_n shall_v forfeit_v treble_a the_o value_n thereof_o be_v convict_v by_o verdict_n confession_n or_o otherwise_o and_o that_o no_o sum_n exceed_v forty_o shilling_n win_v at_o any_o game_n or_o bet_v on_o the_o side_n of_o any_o shall_v be_v recoverable_a and_o all_o bond_n contract_n and_o security_n whatsoever_o for_o above_o the_o sum_n aforesaid_a win_v as_o aforesaid_a shall_v be_v void_a provide_v nevertheless_o that_o nothing_o herein_o contain_v shall_v be_v shall_v pay_v unto_o he_o the_o full_a sum_n of_o what_o he_o have_v so_o pay_v for_o they_o with_o two_o shilling_n six_o penny_n per_fw-la pound_n for_o lay_v out_o the_o money_n and_o so_o proportionable_o and_o also_o six_o penny_n for_o every_o twenty_o four_o hour_n the_o say_a runaway_n have_v be_v in_o his_o custody_n and_o if_o the_o say_a marshal_n shall_v suffer_v any_o runaway_n so_o bring_v to_o he_o to_o escape_v before_o he_o be_v due_o deliver_v to_o his_o master_n or_o mistress_n or_o his_o or_o her_o assign_v that_o then_o the_o say_a marshal_n shall_v pay_v unto_o the_o master_n or_o mistress_n of_o the_o say_a runaway_n so_o much_o as_o he_o shall_v be_v condemn_v in_o by_o the_o verdict_n of_o a_o jury_n at_o common_a law_n also_o any_o one_o may_v take_v up_o any_o suspect_a person_n and_o carry_v he_o or_o she_o to_o any_o justice_n to_o be_v examine_v that_o the_o captain_n or_o any_o other_o commission-officer_n shall_v at_o the_o head_n of_o every_o their_o respective_a company_n and_o troop_n publish_v or_o cause_n to_o be_v publish_v this_o present_a act_n once_o every_o twelve_o month_n under_o the_o penalty_n of_o five_o pound_n and_o know_v broad_a path_n within_o this_o island_n lead_v to_o church_n and_o market_n and_o for_o lay_v out_o new_a highway_n and_o turn_v old_a highway_n where_o it_o shall_v be_v needful_a be_v it_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o vestry_n of_o each_o parish_n or_o the_o major_a part_n of_o they_o shall_v on_o every_o three_o monday_n in_o january_n before_o noon_n at_o their_o parish_n church_n or_o other_o convenient_a place_n choose_v four_o or_o more_o freeholder_n each_o seize_v of_o at_o least_o thirty_o acre_n freehold_n in_o right_n of_o himself_o or_o wife_n to_o be_v surveyor_n for_o the_o year_n ensue_v if_o the_o vestry_n neglect_v each_o person_n absent_a or_o negligent_a shall_v forfeit_v forty_o shilling_n and_o the_o justice_n at_o their_o next_o session_n be_v inform_v thereof_o shall_v appoint_v four_o or_o more_o such_o surveyor_n as_o aforesaid_a every_o person_n so_o choose_v or_o appoint_v shall_v within_o ten_o day_n due_a notice_n be_v give_v he_o by_o the_o clerk_n of_o the_o vestry_n procure_v himself_o to_o be_v swear_v before_o some_o justice_n in_o the_o say_a parish_n diligent_o and_o faithful_o to_o perform_v the_o say_a office_n for_o the_o year_n ensue_v and_o give_v a_o just_a account_n to_o the_o justice_n and_o vestry_n if_o require_v of_o what_o he_o shall_v receive_v pay_v or_o do_v by_o virtue_n of_o his_o office_n on_o penalty_n of_o ten_o pound_n sterling_a that_o of_o the_o defect_n want_n and_o alteration_n needful_a in_o the_o same_o to_o the_o end_n as_o they_o be_v hereby_o empower_v the_o say_a justice_n and_o vestry_n may_v lay_v a_o tax_n of_o such_o money_n labour_n or_o other_o thing_n as_o to_o they_o shall_v seem_v convenient_a and_o necessary_a which_o if_o the_o justice_n and_o vestry_n shall_v not_o do_v before_o the_o last_o day_n of_o february_n in_o each_o year_n than_o the_o say_a surveyor_n shall_v make_v such_o tax_n in_o write_v which_o be_v confirm_v by_o any_o two_o justice_n in_o the_o say_a parish_n shall_v stand_v good_a till_o some_o complaint_n be_v make_v at_o the_o quarter-session_n in_o that_o parish_n and_o the_o justice_n then_o and_o there_o to_o confirm_v or_o alter_v the_o same_o without_o appeal_n from_o thence_o that_o the_o highway_n be_v sixty_o foot_n wide_a in_o stand_v wood_n forty_o foot_n where_o the_o wood_n be_v only_o on_o one_o side_n and_o twenty_o four_o foot_n in_o open_a ground_n and_o that_o the_o surveyor_n have_v power_n to_o cut_v down_o dig_v up_o or_o remove_v as_o well_o all_o sort_n of_o tree_n bush_n prickle_n fence_n rail_n gate_n or_o enclosure_n or_o other_o thing_n or_o thing_n as_o may_v any_o way_n straighten_v hurt_n hinder_v or_o incommode_v the_o highway_n as_o also_o to_o dig_v for_o stone_n or_o gravel_n clay_n marle_n sand_n or_o earth_n in_o any_o land_n not_o plant_v or_o enclose_v as_o yard_n or_o garden_n to_o a_o house_n or_o to_o press_v any_o cart_n carriage_n workman_n or_o other_o thing_n fit_a to_o be_v employ_v in_o the_o highway_n for_o such_o reasonable_a satisfaction_n to_o the_o party_n concern_v as_o such_o surveyor_n can_v agree_v for_o and_o in_o case_n of_o disagreement_n such_o as_o the_o next_o or_o any_o justice_n in_o the_o parish_n shall_v appoint_v provide_v nevertheless_o that_o where_o gate_n be_v or_o shall_v be_v erect_v of_o at_o least_o ten_o foot_n between_o post_n and_o post_n or_o the_o highway_n straighten_v by_o enclosure_n on_o both_o side_n but_o the_o way_n so_o well_o keep_v by_o causey-way_n or_o otherwise_o that_o two_o carriage_n may_v meet_v and_o pass_v each_o other_o and_o the_o ground_n as_o firm_a as_o be_v necessary_a than_o the_o say_a surveyor_n shall_v forbear_v to_o pull_v down_o or_o remove_v such_o gate_n or_o fence_n any_o thing_n herein_o seem_v to_o the_o contrary_a notwithstanding_o but_o if_o any_o person_n shall_v again_o erect_v or_o cause_v any_o nuisance_n in_o the_o highway_n which_o be_v by_o the_o surveyor_n remove_v for_o such_o offence_n he_o or_o they_o shall_v forfeit_v five_o pound_n and_o in_o case_n where_o a_o new_a path_n or_o road_n be_v want_v or_o where_o old_a way_n may_v with_o more_o conveniency_n be_v turn_v or_o alter_v or_o where_o to_o some_o plantation_n or_o plantation_n no_o highway_n be_v yet_o lay_v out_o to_o lead_v they_o into_o the_o high_a road_n which_o go_v towards_o the_o market_n or_o church_n or_o to_o any_o convenient_a harbour_n or_o landing-place_n fit_v for_o receive_v a_o shoar_n or_o ship_n off_o any_o good_n upon_o notice_n thereof_o give_v to_o any_o justice_n of_o the_o peace_n he_o shall_v on_o request_n issue_v his_o warrant_n to_o the_o next_o constable_n in_o the_o say_a parish_n to_o summon_v a_o jury_n to_o meet_v at_o some_o convenient_a place_n and_o day_n therein_o to_o to_o the_o contrary_a notwithstanding_o a_o act_n for_o register_n of_o deed_n and_o patent_n be_v it_o enact_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o a_o deed_n in_o due_a form_n of_o law_n make_v and_o within_o three_o month_n after_o the_o date_n thereof_o acknowledge_v by_o the_o party_n or_o party_n that_o grant_v the_o same_o or_o prove_v by_o the_o oath_n of_o one_o sufficient_a witness_n or_o more_o before_o the_o governor_n or_o some_o one_o of_o the_o judge_n of_o the_o court_n of_o this_o island_n and_o the_o same_o record_v at_o length_n in_o the_o office_n of_o enrolment_n which_o say_v office_n shall_v always_o be_v keep_v at_o st._n jago_n de_fw-fr la_fw-fr vega_n within_o the_o say_v three_o month_n shall_v be_v valid_a to_o pass_v the_o same_o without_o livery_n seize_v attornment_n or_o any_o other_o act_n or_o ceremony_n in_o the_o law_n whatsoever_o and_o that_o no_o deed_n hereafter_o make_v without_o such_o acknowledgement_n or_o proof_n and_o enrolment_n shall_v be_v sufficient_a to_o pass_v away_o any_o freehold_n or_o inheritance_n or_o to_o grant_v any_o lease_n for_o above_o the_o space_n of_o three_o year_n provide_v nevertheless_o that_o any_o old_a deed_n or_o conveyance_n heretofore_o make_v for_o land_n or_o house_n and_o omit_v to_o be_v record_v upon_o be_v acknowledge_v or_o prove_v and_o at_o any_o time_n after_o the_o make_n hereof_o record_v in_o the_o say_a office_n of_o enrolment_n shall_v be_v effectual_o valid_a and_o of_o force_n but_o if_o it_o shall_v happen_v that_o any_o second_o bill_n of_o sale_n or_o conveyance_n for_o a_o valuable_a consideration_n be_v make_v by_o the_o say_a vendor_n or_o his_o heir_n for_o the_o same_o land_n or_o house_n or_o any_o part_n thereof_o and_o the_o same_o be_v due_o execute_v and_o record_v than_o it_o be_v hereby_o declare_v that_o the_o last_v vendee_fw-mi shall_v have_v and_o enjoy_v the_o say_a land_n or_o house_n any_o thing_n in_o this_o proviso_n or_o otherwise_o to_o the_o contrary_a notwithstanding_o and_o if_o any_o vendee_fw-mi have_v omit_v to_o execute_v and_o enrol_v his_o deed_n within_o the_o time_n as_o aforesaid_a but_o shall_v at_o any_o time_n afterward_o have_v do_v the_o same_o no_o second_o sale_n be_v make_v by_o the_o first_o vendor_n his_o heir_n or_o executor_n the_o same_o shall_v nevertheless_o be_v good_a to_o the_o say_v vendee_fw-mi his_o heir_n and_o executor_n and_o a_o perpetual_a bar_n against_o the_o first_o vendor_n his_o heir_n and_o executor_n any_o thing_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o deed_n and_o conveyance_n grant_v and_o make_v out_o of_o this_o island_n and_o remit_v hither_o be_v prove_v before_o the_o governor_n or_o any_o of_o the_o judge_n of_o the_o court_n of_o common-plea_n as_o aforesaid_a and_o all_o those_o deed_n and_o conveyance_n where_o any_o grant_a or_o conveyancer_n shall_v personal_o appear_v in_o his_o majesty_n court_n hold_v before_o the_o lord_n mayor_n and_o alderman_n of_o the_o city_n of_o london_n for_o the_o time_n be_v and_o shall_v then_o and_o there_o own_o and_o acknowledge_v such_o deed_n grant_v or_o conveyance_n to_o be_v his_o act_n and_o deed_n and_o a_o attest_v thereof_o be_v make_v under_o the_o seal_n of_o the_o mayorality_n of_o the_o say_a city_n and_o the_o same_o be_v record_v in_o shall_v stand_v good_a and_o effectual_a in_o the_o law_n to_o all_o intent_n and_o purpose_n whatsoever_o and_o it_o be_v hereby_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o any_o mortgage_n of_o any_o land_n tenement_n real_a or_o personal_a estate_n whatsoever_o within_o this_o his_o majesty_n island_n have_v receive_v full_a satisfaction_n and_o payment_n of_o all_o such_o sum_n and_o sum_n of_o money_n as_o be_v real_o due_a to_o he_o by_o such_o mortgage_n shall_v at_o the_o request_n of_o the_o mortgager_n enter_v satisfaction_n upon_o the_o margin_n lie_v provide_v also_o that_o the_o several_a fine_n forfeiture_n and_o penalty_n before_o mention_v in_o this_o act_n and_o not_o declare_v where_o they_o shall_v be_v recover_v and_o how_o dispose_v of_o be_v one_o three_o to_o our_o sovereign_a lord_n the_o king_n his_o heir_n &_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n &_o contingent_a charge_n thereof_o one_o three_o to_o the_o churchwarden_n for_o the_o use_n of_o the_o respective_a parish_n and_o one_o three_o to_o the_o informer_n to_o be_v recover_v by_o action_n of_o debt_n in_o any_o court_n of_o record_n within_o this_o island_n where_o no_o essoin_n protection_n or_o wager_n of_o law_n shall_v be_v allow_v any_o law_n custom_n or_o usage_n to_o the_o contrary_a that_o all_o and_o every_o person_n or_o person_n that_o shall_v receive_v or_o entertain_v any_o seaman_n or_o seamen_n belong_v to_o any_o trade_n ship_n or_o vessel_n ride_v in_o any_o harbour_n of_o this_o island_n after_o the_o ship_n bell_n ring_v to_o set_v watch_n at_o eight_o of_o the_o clock_n at_o night_n every_o such_o person_n or_o person_n receive_v or_o entertain_v of_o every_o such_o seaman_n as_o aforesaid_a shall_v forfeit_v for_o the_o entertainment_n of_o every_o such_o seaman_n the_o sum_n of_o forty_o shilling_n one_o half_a to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n be_v or_o shall_v be_v commit_v and_o the_o other_o half_a to_o the_o master_n or_o commander_n that_o shall_v prosecute_v for_o the_o same_o to_o be_v recover_v by_o a_o or_o any_o two_o of_o they_o shall_v every_o year_n issue_n out_o their_o warrant_n to_o the_o constable_n and_o tything-man_n to_o summon_v the_o freeholder_n of_o that_o parish_n together_o on_o the_o second_o tuesday_n in_o january_n for_o the_o choose_v of_o ten_o vestry-man_n and_o two_o churchwarden_n such_o as_o shall_v conform_v to_o the_o church_n of_o england_n and_o if_o they_o then_o in_o their_o default_n the_o say_a justice_n shall_v within_o ten_o day_n after_o the_o say_v second_o tuesday_n in_o january_n or_o any_o day_n after_o as_o to_o they_o shall_v seem_v convenient_a lay_v a_o reasonable_a tax_n on_o the_o say_a parish_n for_o the_o maintenance_n of_o the_o minister_n and_o poor_a and_o for_o erect_v convenient_a church_n and_o repair_v such_o as_o be_v already_o make_v and_o make_v convenient_a seat_n in_o they_o and_o if_o the_o say_a justice_n and_o vestry-man_n shall_v neglect_v their_o duty_n herein_o they_o shall_v respective_o forfeit_v five_o pound_n currant_n money_n of_o this_o island_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o such_o of_o the_o justice_n &_o vestryman_n that_o shall_v not_o be_v present_a at_o the_o time_n t_v to_o make_v the_o say_a tax_n and_o thereof_o be_v convict_v by_o a_o certificate_n under_o the_o hand_n of_o such_o as_o do_v appear_v and_o have_v no_o sufficient_a excuse_n for_o the_o same_o shall_v respective_o forfeit_v five_o pound_n currant_n money_n of_o this_o island_n and_o a_o roll_n of_o the_o say_a tax_n so_o make_v shall_v be_v deliver_v into_o the_o hand_n of_o the_o respective_a constable_n of_o the_o say_a purish_n with_o a_o warrant_n under_o the_o same_o sign_v by_o any_o two_o justice_n of_o the_o peace_n impower_v he_o or_o they_o to_o levy_v the_o say_a tax_n and_o upon_o refusal_n to_o distrain_v and_o sell_v by_o public_a outcry_n and_o pay_v the_o same_o into_o the_o hand_n of_o the_o churchwarden_n retain_v to_o himself_o twelvepence_n per_fw-la pound_n for_o levy_v thereof_o and_o if_o any_o person_n shall_v refuse_v to_o pay_v what_o he_o be_v so_o assess_v and_o the_o say_a constable_n money_n of_o this_o island_n and_o if_o the_o say_a constable_n or_o any_o of_o they_o fail_v of_o their_o duty_n herein_o they_o shall_v respective_o forfeit_v five_o pound_n currant_n money_n of_o this_o island_n and_o the_o churchwarden_n so_o choose_v shall_v undertake_v the_o say_a office_n and_o receive_v and_o keep_v a_o good_a account_n of_o the_o money_n or_o good_n levy_v by_o virtue_n of_o this_o act_n and_o the_o same_o issue_n by_o order_n from_o the_o say_a justice_n and_o vestry-man_n of_o the_o parish_n for_o the_o purpose_n and_o intent_n aforesaid_a and_o the_o churchwarden_n shall_v as_o often_o as_o thereunto_o require_v yield_v and_o give_v a_o just_a and_o true_a account_n unto_o the_o justice_n and_o vestry-man_n of_o all_o their_o receipt_n and_o disbursement_n and_o in_o case_n the_o say_a churchwarden_n or_o any_o of_o they_o shall_v neglect_v their_o duty_n herein_o they_o shall_v respective_o forfeit_v five_o pound_n currant_n money_n of_o this_o island_n for_o every_o refusal_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o respective_a justice_n of_o the_o parish_n of_o st._n dorothy_n and_o st._n thomas_n in_o the_o vale_n or_o any_o two_o of_o they_o shall_v every_o year_n issue_n out_o their_o warrant_n to_o the_o constable_n and_o tything-man_n to_o summons_n in_o the_o freeholder_n of_o the_o say_a parish_n the_o second_o tuesday_n in_o february_n for_o the_o choose_v of_o ten_o vestry-man_n and_o two_o churchwarden_n as_o aforesaid_a and_o that_o the_o say_v and_o that_o whatsoever_o rate_n or_o rate_n have_v be_v already_o assess_v by_o the_o justice_n and_o vestry-man_n of_o the_o parish_n of_o st._n dorothy_n upon_o their_o parishioner_n or_o any_o other_o person_n or_o person_n have_v land_n good_n or_o stock_n within_o the_o say_a parish_n be_v hereby_o ratify_v confirm_v and_o declare_v lawful_a any_o clause_n in_o this_o act_n seem_v to_o the_o contrary_a notwithstanding_o a_o roll_n of_o any_o tax_n so_o make_v shall_v be_v deliver_v into_o the_o hand_n of_o the_o respective_a constable_n of_o each_o parish_n with_o a_o warrant_n under_o the_o same_o sign_v by_o any_o two_o of_o the_o justice_n

his_o heir_n or_o successor_n upon_o survey_v make_v or_o to_o be_v make_v be_v for_o ever_o good_a to_o the_o patentee_n and_o to_o those_o to_o who_o the_o right_a of_o the_o patentee_n shall_v come_v for_o all_o land_n comprise_v within_o the_o survey_n or_o bound_n any_o misnomer_n misbound_v or_o mistake_v of_o quantity_n or_o other_o error_n notwithstanding_o against_o his_o majesty_n his_o heir_n and_o successor_n or_o any_o other_o person_n or_o person_n claim_v under_o he_o or_o they_o for_o ever_o and_o that_o all_o such_o grant_n shall_v be_v take_v as_o strong_o against_o his_o majesty_n his_o heir_n and_o successor_n as_o the_o grant_n of_o any_o other_o person_n or_o person_n shall_v or_o ought_v to_o be_v take_v against_o he_o or_o they_o or_o his_o or_o their_o the_o judge_n before_o who_o the_o same_o shall_v happen_v shall_v adjudge_v the_o real_a run_n and_o mark_v line_n which_o be_v prove_v before_o they_o to_o be_v run_v and_o mark_v to_o be_v the_o bound_n of_o the_o land_n grant_v any_o law_n custom_n or_o usage_n to_o the_o contrary_a notwithstanding_o and_o whereas_o there_o have_v be_v uncertainty_n and_o dispute_n in_o the_o payment_n of_o his_o majesty_n quitrent_n reserve_v in_o the_o patent_n former_o grant_v by_o reason_n of_o the_o word_n manure_v and_o plant_v and_o whereas_o his_o say_a majesty_n have_v be_v and_o now_o be_v gracious_o please_v that_o whatsoever_o shall_v arise_v from_o the_o quitrent_n shall_v be_v apply_v towards_o the_o support_n of_o the_o government_n and_o defray_v the_o contingent_a charge_n of_o this_o island_n in_o consideration_n whereof_o and_o to_o ascertain_v the_o same_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o every_o parcel_n or_o parcel_n of_o land_n of_o what_o nature_n and_o quality_n soever_o grant_v and_o patent_v before_o the_o twenty_o five_o day_n of_o june_n one_o thousand_o six_o hundred_o seventy_o and_o one_o shall_v for_o arrear_n and_o grow_a rent_n pay_v for_o every_o thirty_o acre_n annual_o the_o sum_n of_o one_o shilling_n and_o so_o proportionable_o for_o every_o parcel_n under_o one_o hundred_o acre_n and_o for_o every_o hundred_o acre_n two_o shilling_n six_o penny_n and_o proportionable_o for_o a_o great_a quantity_n and_o for_o all_o land_n of_o what_o quality_n soever_o from_o the_o aforesaid_a time_n to_o the_o twelve_o day_n of_o march_n one_o thousand_o six_o hundred_o seventy_o and_o four_o shall_v pay_v one_o half_a penny_n per_fw-la acre_n and_o so_o proportionable_o for_o a_o great_a quantity_n and_o certain_a establish_a quitrent_n and_o acknowledgement_n to_o his_o majesty_n his_o heir_n and_o successor_n for_o ever_o any_o law_n custom_n or_o usage_n or_o any_o thing_n contain_v in_o the_o say_a patent_n to_o the_o contrary_a notwithstanding_o and_o for_o the_o more_o speedy_a and_o easy_a collect_v of_o the_o say_a quitrent_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o receiver_n of_o the_o quitrent_n or_o his_o lawful_a deputy_n shall_v twice_o every_o year_n to_o say_v after_o each_o feast_n of_o st._n michael_n the_o archangel_n and_o of_o the_o annunciation_n of_o the_o bless_a virgin_n mary_n keep_v a_o office_n in_o the_o town_n of_o st._n jago_n de_fw-fr la_fw-fr vega_n in_o the_o parish_n of_o st._n catharines_n and_o in_o the_o town_n of_o port_n royal_a during_o the_o space_n of_o one_o month_n at_o each_o place_n and_o then_o and_o there_o to_o receive_v the_o quitrent_n from_o the_o person_n concern_v which_o say_v office_n he_o shall_v attend_v from_o the_o hour_n of_o eight_o to_o eleven_o before_o noon_n and_o from_o the_o hour_n of_o two_o to_o five_o in_o the_o afternoon_n and_o upon_o receipt_n of_o his_o majesty_n quitrent_n thereof_o to_o acquit_v and_o discharge_v all_o person_n on_o the_o penalty_n of_o five_o pound_n sterling_a which_o say_v penalty_n shall_v be_v the_o one_o half_a to_o his_o majesty_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o informer_n to_o be_v recover_v in_o any_o court_n of_o record_n within_o this_o island_n wherein_o no_o wager_n of_o law_n essoign_n protection_n or_o injunction_n shall_v be_v allow_v a_o act_n for_o prevent_v damage_n in_o plantation_n preserve_v of_o cattle_n and_o regulate_v hunting_n be_v it_o enact_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n of_o the_o same_o that_o all_o plantation_n bound_v in_o savanna_n highway_n watering-place_n and_o all_o pasture_n make_v out_o of_o wood-land_n shall_v make_v sufficient_a fence_n which_o sufficient_a fence_n shall_v be_v judge_v by_o oath_n of_o three_o freeholders_n before_n any_o one_o of_o his_o majesty_n justice_n of_o the_o peace_n which_o say_v freeholders_n shall_v be_v choose_v one_o by_o the_o
party_n grieve_v the_o other_o by_o the_o owner_n of_o the_o cattle_n and_o the_o other_o by_o the_o justice_n of_o the_o peace_n and_o if_o either_o of_o they_o do_v not_o appear_v or_o refuse_v to_o make_v their_o choice_n that_o then_o in_o such_o case_n the_o say_a justice_n shall_v name_v two_o and_o what_o damage_n shall_v be_v do_v by_o any_o stock_n in_o any_o plantation_n so_o fence_v as_o aforesaid_a the_o say_a damage_n to_o be_v appraise_v upon_o the_o oath_n of_o the_o say_v three_o freeholders_n and_o the_o owner_n of_o the_o say_a stock_n shall_v pay_v double_a the_o say_a damage_n so_o commit_v or_o do_v by_o their_o cattle_n proof_n be_v make_v appear_v by_o the_o oath_n of_o one_o or_o more_o to_o be_v recover_v before_o any_o justice_n of_o the_o peace_n if_o not_o exceed_v forty_o shilling_n if_o above_o in_o any_o court_n of_o record_n by_o action_n of_o debt_n and_o it_o be_v further_o enact_v and_o provide_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n whatsoever_o shall_v kill_v or_o destroy_v any_o cattle_n horse_n mare_n mule_n or_o asinego_fw-it but_o he_o she_o or_o they_o who_o shall_v kill_v or_o destroy_v any_o of_o the_o aforementioned_a stock_n shall_v forfeit_v for_o each_o they_o shall_v kill_v or_o destroy_v the_o sum_n of_o fifteen_o pound_n currant_n money_n to_o be_v recover_v by_o action_n of_o debt_n in_o any_o court_n of_o record_n within_o this_o island_n by_o the_o owner_n or_o proprietor_n of_o the_o say_a beast_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o owner_n of_o neat_a cattle_n shall_v keep_v one_o white_a man_n at_o each_o respective_a pen_n and_o at_o all_o pen_n whereunto_o belong_v above_o two_o hundred_o cattle_n the_o owner_n of_o such_o pen_n shall_v keep_v two_o white_a man_n upon_o pain_n of_o forfeit_v ten_o pound_n for_o every_o white_a man_n that_o shall_v be_v want_v as_o before_o for_o the_o space_n of_o three_o month_n to_o be_v recover_v in_o any_o court_n of_o record_n by_o action_n of_o debt_n the_o one_o half_a to_o the_o parish_n for_o the_o use_v of_o the_o poor_a the_o other_o moiety_n to_o the_o informer_n or_o he_o that_o sue_v for_o the_o same_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o person_n and_o owner_n of_o cattle_n that_o shall_v fail_v to_o pen_v their_o cattle_n once_o in_o three_o night_n at_o the_o lâ—â—st_n that_o all_o such_o cattle_n do_v damage_n shall_v pay_v double_a the_o damage_n to_o be_v recover_v as_o aforesaid_a and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o stray_n of_o any_o sort_n of_o cattle_n where_o ever_o they_o shall_v be_v find_v and_o take_v up_o shall_v belong_v to_o the_o proprietor_n of_o the_o ground_n where_o they_o be_v accustom_v to_o feed_v provide_v the_o say_a proprietor_n cause_v the_o say_a stray_n or_o stray_v to_o be_v cry_v by_o the_o common_a cryer_n three_o distinct_a court_n day_n in_o the_o court_n of_o the_o say_a precinct_n describe_v all_o the_o mark_n of_o the_o say_a stray_n with_o the_o age_n and_o kind_a and_o further_o that_o the_o say_v proprietor_n do_v turn_v loose_a again_o the_o say_a stray_n to_o continue_v in_o the_o same_o feed_a ground_n where_o the_o same_o be_v accustom_v to_o feed_v and_o tie_v a_o with_o about_o the_o neck_n of_o the_o say_a stray_n which_o shall_v be_v a_o common_a mark_n for_o stray_n and_o in_o that_o manner_n to_o continue_v one_o whole_a year_n from_o the_o first_o take_v up_o or_o pen_v of_o the_o same_o provide_v further_o that_o if_o in_o the_o mean_a time_n no_o person_n shall_v challenge_v or_o claim_v the_o same_o that_o then_o the_o property_n of_o all_o such_o stray_v remain_v to_o the_o proprietor_n of_o the_o ground_n as_o before_o they_o give_v satisfaction_n for_o take_v up_o the_o say_a stray_n provide_v always_o that_o this_o act_n extend_v not_o to_o any_o ear-marked_n or_o burnt-marked_n beast_n horse_n mare_n colt_n or_o any_o other_o sort_n of_o cattle_n but_o all_o such_o shall_v belong_v to_o the_o owner_n or_o proprietor_n of_o the_o same_o if_o claim_v at_o any_o time_n after_o the_o expiration_n of_o the_o year_n it_o be_v further_a enact_v by_o the_o authority_n aforesaid_a that_o the_o clerk_n of_o each_o respective_a court_n of_o record_n in_o this_o island_n be_v hereby_o empower_v to_o make_v entry_n and_o toll_n any_o sort_n of_o cattle_n that_o shall_v be_v sell_v from_o one_o person_n to_o another_o take_z as_o near_o description_n of_o the_o several_a mark_n natural_a or_o otherwise_o as_o can_v be_v and_o vouch_v by_o two_o sufficient_a person_n know_v to_o the_o clerk_n which_o entry_n or_o toll_n shall_v be_v good_a against_o any_o former_a sale_n or_o bargain_n or_o any_o other_o title_n whatsoever_o except_o in_o all_o such_o case_n where_o the_o provost_z marshal_z or_o his_o deputy_n have_v levy_v the_o same_o by_o execution_n and_o the_o clerk_n of_o the_o say_a court_n shall_v take_v twelve_o penny_n for_o each_o such_o entry_n and_o for_o keep_v a_o record_n of_o the_o same_o and_o no_o more_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n whatsoever_o shall_v presume_v to_o carry_v any_o fire_n or_o smoke_n tobacco_n in_o any_o savanna_n or_o plantation_n or_o highway_n whatsoever_o under_o the_o penalty_n of_o ten_o shilling_n for_o each_o time_n they_o shall_v so_o offend_v and_o be_v further_a liable_a to_o pay_v all_o damage_n that_o shall_v accrue_v to_o any_o person_n or_o person_n by_o mean_n of_o the_o same_o to_o be_v recover_v if_o not_o exceed_v forty_o shilling_n before_o any_o justice_n of_o the_o peace_n if_o exceed_v forty_o shilling_n by_o action_n of_o debt_n in_o any_o court_n of_o record_n within_o this_o island_n and_o if_o the_o person_n so_o offend_v be_v not_o able_a to_o make_v satisfaction_n than_o the_o say_a person_n shall_v be_v whip_v for_o every_o such_o offence_n at_o the_o discretion_n of_o any_o one_o justice_n of_o the_o peace_n provide_v that_o this_o clause_n extend_v not_o to_o owner_n of_o land_n to_o carry_v fire_n in_o their_o own_o plantation_n or_o burn_v their_o own_o savanna_n yet_o to_o be_v liable_a as_o before_o if_o thereby_o they_o injure_v or_o burn_v any_o other_o person_n savanna_n or_o plantation_n and_o that_o all_o penalty_n for_o carry_v of_o fire_n shall_v belong_v to_o the_o person_n that_o sue_v for_o the_o same_o and_o whereas_o it_o be_v find_v by_o experience_n that_o several_a common_a driver_n of_o cattle_n or_o horse-catcher_n do_v frequent_o ride_v and_o drive_v gang_v of_o mare_n and_o other_o cattle_n from_o off_o their_o own_o feed_v ground_n or_o pasture_n whereby_o those_o that_o be_v big_a cast_v their_o young_a and_o young_a one_o be_v often_o separate_v from_o their_o dam_n and_o do_v likewise_o often_o deface_v the_o mark_n of_o such_o cattle_n and_o horse_n or_o new_o mark_v they_o for_o themselves_o or_o other_o with_o wrong_a mark_n to_o the_o great_a damage_n of_o all_o such_o proprietor_n for_o prevention_n whereof_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n whatsoever_o shall_v hereafter_o presume_v to_o drive_v or_o ride_v in_o any_o savanna_n as_o a_o common_a horse-catcher_n after_o any_o horse_n or_o mare_n without_o have_v first_o give_v security_n for_o their_o honesty_n and_o obtain_v leave_n from_o the_o proprietor_n or_o proprietor_n of_o such_o savanna_n or_o the_o major_a part_n of_o they_o under_o the_o penalty_n of_o twenty_o pound_n to_o be_v recover_v as_o aforesaid_a one_o three_o part_n whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n of_o the_o same_o one_o three_o part_n to_o the_o proprietor_n or_o proprietor_n of_o such_o savanna_n where_o the_o offence_n shall_v be_v commit_v the_o remain_a three_o to_o the_o informer_n or_o he_o that_o shall_v sue_v for_o the_o same_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o such_o common_a driver_n or_o horse-catcher_n or_o any_o other_o person_n employ_v by_o or_o for_o he_o or_o they_o shall_v presume_v to_o sell_v or_o barter_n any_o horse_n mare_n or_o colt_n or_o other_o cattle_n but_o such_o as_o he_o shall_v bring_v two_o sufficient_a freeholders_n of_o the_o place_n where_o he_o do_v inhabit_v or_o other_o good_a sufficient_a evidence_n to_o vouch_v before_o the_o clerk_n of_o some_o court_n of_o record_n within_o the_o precinct_n where_o they_o shall_v be_v sell_v or_o barter_v as_o aforesaid_a that_o he_o breed_v they_o or_o otherwise_o come_v lawful_o possess_v of_o they_o
settler_n in_o particular_a who_o have_v expend_v great_a sum_n of_o money_n in_o plant_v thereabouts_o for_o prevention_n of_o so_o great_a and_o grow_a a_o mischief_n be_v it_o therefore_o enact_v and_o ordain_v by_o the_o governor_n council_n and_o assembly_n and_o it_o be_v hereby_o enact_v and_o ordain_v by_o the_o authority_n of_o the_o same_o that_o the_o governor_n or_o commander_n in_o chief_a for_o the_o time_n be_v do_v issue_n out_o a_o commission_n in_o the_o nature_n of_o a_o commission_n of_o sewer_n under_o the_o broad_a seal_n of_o this_o island_n thereby_o constitute_v and_o appoint_v twelve_o good_a and_o sufficient_a freeholder_n such_o as_o the_o governor_n or_o commander_n in_o chief_a as_o aforesaid_a with_o the_o major_a part_n of_o the_o council_n shall_v think_v fit_a to_o nominate_v and_o choose_v out_o of_o the_o parish_n of_o st._n catherines_n and_o st._n andrews_n whereof_o five_o shall_v be_v a_o quorum_fw-la and_o one_o of_o which_o five_o shall_v be_v a_o justice_n of_o the_o quorum_fw-la thereby_o give_v and_o grant_v unto_o they_o or_o any_o five_o or_o more_o of_o they_o full_a power_n and_o authority_n to_o assess_v lay_v and_o receive_v a_o reasonable_a tax_n upon_o the_o land_n or_o negro_n or_o upon_o both_o as_o to_o the_o say_a commissioner_n or_o to_o any_o sieve_n or_o more_o of_o they_o shall_v seem_v just_a and_o convenient_a of_o all_o person_n whatsoever_o who_o have_v any_o land_n bound_v any_o way_n upon_o the_o say_a river_n or_o upon_o whosoever_o shall_v receive_v advantage_n by_o clear_v the_o say_a river_n towards_o the_o clear_n the_o old_a channel_n or_o by_o turn_v the_o present_a course_n of_o it_o some_o other_o way_n as_o upon_o a_o due_a survey_n of_o the_o premise_n shall_v seem_v most_o necessary_a and_o which_o may_v be_v do_v with_o the_o least_o charge_n or_o prejudice_n to_o any_o person_n and_o that_o the_o limit_n of_o the_o say_a commission_n to_o tax_n be_v and_o extend_v upon_o all_o the_o land_n bound_v on_o both_o side_n of_o the_o river_n from_o the_o plantation_n of_o henry_n molesworth_n esq_n common_o call_v cow-park_n unto_o the_o mouth_n of_o the_o say_a river_n where_o it_o fall_v into_o the_o sea_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o such_o person_n as_o shall_v be_v name_v a_o commissioner_n in_o the_o say_a commission_n after_o he_o have_v knowledge_n thereof_o shall_v take_v his_o corporal_a oath_n to_o lay_v a_o reasonable_a tax_n upon_o all_o the_o land_n or_o negro_n or_o upon_o both_o as_o aforesaid_a and_o that_o he_o will_v to_o the_o best_a of_o his_o skill_n and_o knowledge_n execute_v the_o say_a commission_n which_o oath_n shall_v be_v take_v before_o the_o governor_n or_o commander_n in_o chief_a or_o before_o who_o by_o the_o king_n write_v of_o dedimus_fw-la potestatem_fw-la he_o shall_v appoint_v or_o before_o the_o justice_n of_o the_o peace_n in_o the_o quarter_n session_n of_o the_o precinct_n where_o any_o of_o the_o say_a commissioner_n shall_v reside_v and_o whosoever_o of_o the_o say_a commissioner_n shall_v refuse_v to_o take_v the_o say_a oath_n shall_v forfeit_v the_o sum_n of_o five_o pound_n and_o further_o that_o whosoever_o shall_v wilful_o fall_v any_o tree_n or_o cast_v or_o suffer_v to_o be_v cast_v the_o same_o as_o also_o any_o pane_n trash_n or_o other_o rubbish_n whatsoever_o into_o the_o say_a river_n or_o into_o any_o other_o river_n or_o gully_n that_o shall_v come_v into_o the_o same_o whereby_o the_o say_v stop_v shall_v be_v any_o wise_a increase_v shall_v forfeit_v for_o every_o such_o offence_n the_o like_a sum_n of_o five_o pound_n both_o which_o forfeiture_n shall_v be_v one_o three_o part_n to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o two_o three_o to_o whosoever_o shall_v sue_v for_o the_o same_o towards_o the_o expense_n of_o prevent_v the_o overflow_n of_o the_o say_a river_n or_o towards_o the_o cut_n of_o a_o new_a channel_n as_o aforesaid_a and_o that_o each_o of_o the_o say_a commissioner_n that_o shall_v meet_v and_o sit_v as_o aforesaid_a shall_v for_o each_o day_n they_o so_o sit_v receive_v towards_o their_o expense_n five_o shilling_n per_fw-la diem_fw-la out_o of_o the_o say_a money_n to_o be_v levy_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a commissioner_n unto_o who_o the_o commission_n as_o aforesaid_a shall_v be_v direct_v or_o any_o five_o or_o more_o of_o they_o by_o virtue_n of_o the_o say_a commission_n and_o of_o this_o present_a act_n shall_v have_v full_a power_n and_o authority_n to_o see_v survey_v and_o view_v the_o say_a land_n as_o do_v use_n to_o be_v o'reflow_v or_o any_o part_n of_o they_o and_o all_o the_o say_a land_n and_o negro_n or_o their_o several_a owner_n who_o possess_v any_o land_n or_o negro_n within_o the_o bound_n and_o limit_n aforesaid_a to_o tax_n rate_v assess_v and_o charge_v with_o such_o sum_n and_o sum_n of_o money_n as_o well_o for_o the_o present_a clear_n of_o the_o old_a channel_n of_o the_o say_a river_n or_o for_o the_o make_v a_o new_a if_o it_o shall_v be_v find_v necessary_a as_o also_o for_o the_o keep_n of_o it_o clear_v after_o it_o shall_v be_v cleanse_v or_o turn_v another_o way_n and_o that_o the_o say_v commissioner_n or_o any_o five_o or_o more_o of_o they_o shall_v and_o may_v make_v and_o appoint_v diligent_a and_o able_a surveyor_n collector_n and_o overseer_n and_o such_o other_o officer_n as_o they_o shall_v think_v fit_a to_o survey_v and_o oversee_v and_o to_o levy_v receive_v and_o lay_v out_o the_o money_n to_o be_v levy_v and_o expend_v in_o and_o abour_v the_o premise_n and_o to_o do_v and_o execute_v whatsoever_o shall_v be_v needful_a and_o expedient_a to_o be_v do_v therein_o according_a to_o the_o direction_n and_o order_n which_o shall_v from_o time_n to_o time_n be_v prescribe_v by_o the_o say_a commissioner_n or_o any_o five_o or_o more_o of_o they_o and_o to_o allow_v they_o for_o their_o pain_n what_o shall_v be_v think_v reasonable_a and_o also_o that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a commissioner_n or_o any_o five_o or_o more_o of_o they_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o command_v the_o take_n of_o any_o cart_n wain_n or_o negro_n of_o any_o person_n within_o the_o bound_n and_o limit_n of_o the_o say_a commission_n to_o help_v towards_o the_o clear_n and_o remove_v the_o premise_n or_o towards_o the_o make_v a_o new_a channel_n provide_v always_o that_o the_o owner_n of_o such_o cart_n wane_v or_o negro_n be_v not_o then_o make_v sugar_n and_o that_o they_o take_v not_o above_o five_o negro_n for_o a_o week_n out_o of_o a_o plantation_n and_o a_o wain_n or_o cart_n for_o the_o same_o time_n and_o that_o the_o owner_n of_o such_o cart_n wane_v or_o negro_n that_o shall_v be_v so_o employ_v be_v allow_v out_o of_o their_o respective_a tax_n what_o shall_v be_v think_v reasonable_a for_o the_o hire_n of_o they_o by_o the_o say_a commissioner_n as_o aforesaid_a and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a commissioner_n or_o any_o five_o or_o more_o of_o they_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o give_v authority_n to_o any_o person_n or_o person_n to_o levy_v the_o say_a sum_n of_o money_n by_o they_o from_o time_n to_o time_n to_o be_v assess_v upon_o the_o person_n land_n or_o negro_n or_o upon_o all_o or_o any_o of_o they_o as_o aforesaid_a by_o distress_n and_o sale_n of_o the_o good_n of_o such_o person_n or_o person_n that_o shall_v not_o pay_v or_o refuse_v to_o pay_v the_o same_o and_o the_o overplus_n of_o the_o value_n rise_v upon_o such_o sale_n shall_v return_v to_o the_o owner_n of_o the_o same_o and_o in_o default_n of_o such_o distress_n to_o be_v take_v and_o sell_v it_o shall_v and_o may_v be_v lawful_a for_o such_o collector_n as_o shall_v be_v appoint_v by_o the_o say_a commissioner_n or_o any_o five_o or_o more_o of_o they_o to_o sue_v the_o factor_n or_o attorney_n of_o such_o person_n or_o person_n as_o have_v land_n lie_v within_o the_o limit_n aforesaid_a and_o that_o all_o constable_n marshal_n and_o tything-man_n be_v aid_v and_o assist_v in_o the_o levy_n all_o such_o tax_n as_o shall_v be_v assess_v and_o levy_v as_o aforesaid_a and_o that_o they_o receive_v twelve_o penny_n in_o the_o pound_n for_o levy_v the_o same_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n or_o suit_n shall_v be_v bring_v against_o
island_n and_o the_o contingent_a charge_n thereof_o one_o three_o to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v and_o the_o other_o part_n to_o he_o or_o they_o that_o shall_v sue_v for_o the_o same_o in_o any_o of_o the_o court_n of_o record_n within_o this_o island_n and_o that_o no_o minister_n presume_v to_o marry_v any_o person_n who_o bane_n have_v not_o be_v publish_v three_o time_n in_o their_o parish_n church_n or_o have_v a_o licence_n from_o the_o governor_n or_o commander_n in_o chief_a for_o the_o time_n be_v authorise_v he_o thereunto_o under_o the_o like_a penalty_n and_o to_o the_o same_o use_n to_o be_v recover_v as_o aforesaid_a or_o twelve_o month_n imprisonment_n provide_v always_o and_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o no_o ecclesiastical_a law_n or_o jurisdiction_n shall_v have_v power_n to_o enforce_v confirm_v or_o establish_v any_o penal_a mulct_n or_o punishment_n in_o any_o notwithstanding_o that_o whosoever_o shall_v for_o base_a lucre_n by_o any_o way_n or_o mean_n coin_n falsify_v impair_v diminish_v seal_n wash_v clip_v file_n or_o lighten_v any_o of_o the_o money_n of_o his_o majesty_n subject_n of_o this_o island_n for_o remedy_n whereof_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o goldsmith_n or_o worker_n in_o gold_n or_o silver_n within_o this_o island_n from_o and_o after_o the_o first_o day_n of_o august_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o eighty_o and_o one_o shall_v work_v sell_v exchange_n or_o cause_n to_o be_v wrought_v sell_v or_o exchange_v any_o plate_n or_o other_o goldsmith_n ware_n of_o gold_n less_o in_o fineness_n than_o twenty_o two_o carrat_n and_o that_o from_o the_o time_n aforesaid_a no_o goldsmith_n or_o worker_n in_o gold_n or_o silver_n shall_v make_v sell_v or_o exchange_n in_o any_o place_n within_o this_o island_n any_o plate_n or_o goldsmith_n ware_n of_o silver_n less_o in_o fineness_n than_o that_o of_o eleven_o ounce_n two_o penny_n weight_n and_o that_o no_o goldsmith_n or_o worker_n in_o gold_n or_o silver_n shall_v presume_v to_o put_v to_o sale_n exchange_n or_o sell_v any_o plate_n of_o goldsmith_n work_n of_o gold_n or_o silver_n before_o he_o have_v set_v his_o own_o mark_n to_o so_o much_o thereof_o as_o may_v convenient_o bear_v the_o same_o upon_o pain_n of_o forfeit_v the_o value_n of_o the_o thing_n so_o sell_v or_o exchange_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o whatsoever_o goldsmith_n or_o worker_n in_o gold_n or_o silver_n as_o aforesaid_a from_o and_o after_o the_o say_v first_o day_n of_o august_n shall_v presume_v to_o sell_v or_o exchange_v any_o gold_n or_o silver_n ware_n of_o less_o fineness_n than_o aforesaid_a for_o every_o such_o first_o offence_n shall_v forfeit_v treble_a the_o value_n of_o the_o say_a ware_n so_o sell_v or_o exchange_v one_o half_a whereof_o shall_v be_v to_o our_o sovereign_a lord_n the_o king_n his_o heir_n and_o successor_n for_o and_o towards_o the_o support_n of_o the_o government_n of_o this_o island_n and_o the_o contingent_a charge_n thereof_o and_o the_o other_o half_a to_o the_o party_n aggrieve_v to_o be_v recover_v in_o manner_n and_o form_n aforesaid_a and_o whosoever_o in_o the_o vale_n and_o st._n john_n sue_v as_o former_o in_o the_o supreme_a court_n for_o any_o sum_n whatsoever_o until_o they_o shall_v have_v petty_a court_n erect_v in_o their_o own_o parish_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o in_o all_o and_o every_o the_o inferior_a court_n within_o this_o island_n upon_o summons_n due_o serve_v and_o the_o defendant_n not_o appear_v judgement_n shall_v go_v by_o default_n in_o the_o same_o manner_n and_o form_n as_o in_o the_o supreme_a court_n provide_v always_o that_o it_o be_v the_o true_a intent_n and_o meaning_n of_o this_o act_n that_o as_o well_o in_o the_o supreme_a court_n as_o any_o other_o the_o inferior_a court_n within_o this_o island_n the_o provost_n marshal_n or_o his_o lawful_a deputy_n shall_v appear_v in_o open_a court_n and_o there_o depose_v upon_o oath_n that_o the_o party_n or_o party_n against_o who_o judgement_n shall_v go_v by_o default_n have_v be_v legal_o summon_v fourteen_o day_n before_o the_o say_a court_n any_o thing_n in_o this_o act_n or_o any_o other_o to_o the_o contrary_a at_o the_o next_o court_n to_o show_v cause_n why_o the_o say_a money_n good_n chattel_n or_o debt_n or_o so_o much_o thereof_o as_o will_v satisfy_v the_o say_a debt_n then_o demand_v shall_v not_o be_v deliver_v to_o the_o plaintiff_n at_o which_o day_n if_o the_o say_a possessor_n or_o debtor_n be_v they_o attorney_n wife_n servant_n or_o other_o person_n as_o aforesaid_a be_v convict_v by_o confession_n verdict_n or_o otherwise_o that_o the_o say_v money_n good_n chattel_n or_o debt_n do_v proper_o belong_v to_o the_o person_n so_o go_v off_o this_o island_n or_o otherwise_o absent_v himself_o as_o aforesaid_a and_o if_o the_o plaintiff_n before_o or_o after_o due_a proof_n make_v do_v solemn_o swear_v in_o open_a court_n that_o his_o debt_n be_v true_a and_o that_o direct_o or_o or_o debt_n shall_v be_v dissolve_v and_o proceed_n have_v according_a to_o the_o custom_n of_o the_o common_a law_n but_o if_o the_o possessor_n or_o owner_n of_o such_o money_n good_n chattel_n or_o debt_n be_v they_o attorney_n wife_n servant_n or_o other_o person_n as_o aforesaid_a shall_v after_o attachment_n so_o lay_v on_o they_o in_o the_o respective_a hand_n dispose_v of_o the_o say_a shall_v and_o may_v be_v lawful_a for_o the_o say_a justice_n of_o the_o peace_n to_o issue_v out_o a_o warrant_n of_o attachment_n to_o be_v levy_v by_o the_o constable_n in_o manner_n and_o form_n as_o be_v before_o prescribe_v to_o the_o provost-marshal_n for_o the_o execution_n of_o the_o writ_n and_o to_o be_v immediate_o determine_v by_o the_o say_a justice_n any_o clause_n in_o this_o all_o summons_n as_o well_o from_o the_o supreme_a court_n as_o all_o other_o the_o inferior_a court_n within_o this_o island_n port-royal_a only_o except_v shall_v be_v deliver_v to_o the_o party_n foreign_a attachment_n at_o the_o supreme_a court_n and_o warrant_n of_o arrest_n be_v serve_v at_o any_o time_n as_o heretofore_o and_o that_o no_o execution_n shall_v be_v take_v out_o serve_v or_o execute_v until_o twenty_o eight_o day_n be_v full_o expire_v after_o judgement_n except_o at_o port-royal_a where_o execution_n shall_v issue_v ten_o day_n after_o judgement_n obtain_v and_o that_o no_o negro_n horse_n or_o any_o manner_n of_o utensil_n belong_v to_o a_o plantation_n brick_n or_o pot-work_n nor_o any_o other_o negro_n whatsoever_o from_o and_o after_o the_o make_n hereof_o shall_v be_v take_v in_o execution_n where_o the_o party_n against_o who_o the_o execution_n be_v obtain_v shall_v offer_v good_n for_o satisfaction_n of_o the_o debt_n and_o cost_v of_o suit_n and_o power_n and_o liberty_n to_o make_v contract_n bargain_n for_o and_o sell_v the_o good_n so_o take_v in_o execution_n the_o defendant_n first_o acquaint_v the_o marshal_n who_o levy_v the_o execution_n upon_o the_o good_n with_o such_o bargain_n or_o contract_n to_o the_o end_n the_o marshal_n may_v deliver_v the_o same_o and_o receive_v the_o produce_v thereof_o according_a to_o his_o precept_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o defendant_n after_o his_o good_n shall_v be_v so_o take_v in_o execution_n as_o aforesaid_a shall_v delay_v or_o neglect_v sell_v or_o dispose_n of_o the_o good_n until_o ten_o day_n before_o the_o next_o ensue_a court_n that_o then_o and_o in_o all_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o the_o marshal_n to_o take_v the_o say_v good_n and_o chattel_n of_o the_o defendant_n and_o the_o same_o to_o sell_v by_o public_a outcry_n and_o it_o be_v further_o enact_v by_o tho_o authority_n aforesaid_a that_o where_o no_o such_o good_n as_o aforesaid_a shall_v be_v show_v and_o offer_v to_o the_o provost-marshal_n so_o that_o the_o negro_n working-cattel_n or_o necessary_a utensil_n must_v be_v take_v in_o execution_n that_o then_o and_o in_o all_o such_o case_n the_o say_v negro_n horse_n or_o utensil_n shall_v not_o be_v remove_v but_o remain_v still_o in_o the_o defendant_n possession_n and_o that_o
the_o several_a liquor_n and_o good_n aforesaid_a import_v into_o this_o island_n by_o way_n of_o merchandise_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o merchant_n or_o other_o person_n import_v any_o wine_n or_o other_o liquor_n into_o this_o island_n shall_v be_v thereunto_o require_v by_o the_o collector_n within_o twenty_o day_n after_o landing_n make_v up_o account_n and_o give_v bond_n in_o the_o penalty_n of_o double_a the_o value_n the_o same_o shall_v amount_v unto_o and_o upon_o such_o account_n so_o to_o be_v make_v up_o and_o bond_n give_v as_o aforesaid_a shall_v be_v allow_v after_o the_o rate_n of_o ten_o per_n cent_z for_o leakage_n and_o shall_v have_v time_n for_o payment_n thereof_o as_o be_v hereafter_o mention_v that_o be_v to_o say_v from_o the_o end_n and_o expiration_n of_o the_o first_o two_o month_n from_o the_o make_n up_o such_o account_n to_o pay_v one_o three_o part_n thereof_o and_o another_o three_o part_n at_o the_o end_n of_o the_o four_o month_n and_o the_o remainder_n at_o the_o end_n of_o the_o six_o month_n and_o that_o every_o hogshead_n of_o wine_n or_o other_o liquor_n that_o shall_v not_o have_v full_a seven_o inch_n or_o above_o leave_v therein_o and_o every_o butt_n or_o pipe_v not_o above_o nine_o inch_n shall_v be_v account_v for_o out_v and_o the_o merchant_n or_o importer_n to_o pay_v no_o custom_n for_o the_o same_o and_o in_o case_n of_o difference_n that_o may_v arise_v between_o the_o importer_n or_o master_n of_o the_o vessel_n touch_v leakage_n on_o board_n and_o for_o wine_n or_o liquor_n that_o shall_v happen_v to_o sour_a within_o the_o aforesaid_a twenty_o day_n the_o person_n or_o person_n so_o aggrieve_v shall_v have_v a_o warrant_n of_o survey_n from_o the_o naval_a officer_n who_o be_v hereby_o impower_v and_o require_v to_o grant_v the_o same_o and_o that_o return_v of_o such_o warrant_n to_o be_v grant_v as_o aforesaid_a shall_v be_v make_v upon_o oath_n to_o the_o say_v naval_a officer_n and_o by_o he_o remit_v to_o the_o collector_n office_n in_o order_n to_o the_o make_v up_o their_o account_n with_o the_o collector_n and_o better_o prove_v their_o damage_n by_o ill_a stowage_n or_o otherwise_o and_o in_o case_n any_o such_o merchant_n or_o importer_n shall_v be_v thereunto_o require_v as_o aforesaid_a refuse_v to_o make_v up_o his_o accompto_n and_o give_v bond_n as_o aforesaid_a he_o shall_v lose_v the_o benefit_n of_o the_o ten_o per_n cent_z for_o leakage_n and_o the_o time_n give_v for_o the_o payment_n of_o the_o money_n and_o if_o the_o receiver_n shall_v be_v force_v to_o sue_v for_o the_o same_o and_o do_v recover_v the_o defendant_n shall_v pay_v treble_a damage_n and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o at_o the_o entry_n of_o any_o ship_n or_o vessel_n in_o the_o naval_a office_n it_o shall_v appear_v by_o the_o master_n report_n or_o otherwise_o that_o he_o have_v import_v any_o madera_n wine_n he_o the_o say_a master_n or_o the_o boatswain_n shall_v take_v the_o follow_a oath_n which_o the_o say_v naval_a officer_n be_v hereby_o impower_v to_o administer_v i_o a._n b._n do_v swear_v that_o the_o wine_n by_o i_o import_v be_v take_v on_o board_n at_o the_o island_n of_o madera_n and_o that_o i_o do_v not_o direct_o or_o indirect_o know_v but_o that_o the_o say_v wine_n be_v of_o the_o say_a island_n without_o any_o mixture_n of_o the_o wine_n of_o the_o growth_n of_o any_o of_o the_o western_a island_n so_o help_v i_o god_n and_o if_o the_o say_a master_n or_o boatswain_n shall_v resuse_v to_o take_v the_o abovesaid_a oath_n that_o then_o the_o say_a wine_n so_o import_v shall_v be_v deem_v and_o take_v to_o be_v wine_n of_o the_o growth_n of_o the_o western_a island_n and_o shall_v pay_v custom_n according_o and_o it_o be_v further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o all_o or_o any_o of_o the_o aforesaid_a liquor_n or_o good_n liable_a to_o the_o duty_n aforesaid_a be_v land_a and_o afterward_o export_v within_o twelve_o month_n after_o the_o importation_n thereof_o that_o the_o before_o mention_v which_o the_o collector_n or_o receiver_n be_v to_o repay_v or_o count_n on_o the_o penalty_n of_o double_a the_o sum_n for_o every_o such_o refusal_n to_o the_o party_n aggrieve_v and_o it_o be_v likewise_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o all_o ship_n and_o vessel_n come_v from_o any_o place_n to_o the_o northward_o of_o the_o tropic_a of_o cancer_n to_o trade_n within_o this_o island_n shall_v respective_o pay_v for_o every_o tun_n such_o ship_n or_o vessel_n shall_v contain_v and_o for_o every_o time_n they_o arrive_v
