enrol_v and_o have_v the_o same_o allow_v by_o the_o court_n of_o king's-bench_n shall_v be_v compel_v to_o plead_v the_o same_o to_o any_o inquisition_n return_v by_o any_o coroner_n and_o if_o any_o corporation_n lord_n of_o manor_n or_o other_o have_v or_o shall_v have_v such_o grant_n from_o the_o crown_n for_o felon_n good_n deodand_n and_o other_o forfeiture_n they_o shall_v not_o be_v pound_n 5_o l._n 12_o s._n upon_o every_o 100_o weight_n of_o cacao_n nut_n contain_v as_o aforesaid_a 8_o l._n 8_o s._n upon_o every_o pound_n weight_n of_o tea_n 5_o s._n and_o upon_o every_o pound_n weight_n of_o chocolate_a 5_o s._n and_o so_o proportionable_o iii_o if_o any_o of_o the_o say_a commodity_n shall_v be_v unshipt_v or_o lay_v on_o land_n the_o duty_n not_o pay_v or_o lawful_o tender_v to_o the_o collector_n or_o his_o deputy_n with_o the_o consent_n and_o agreement_n of_o the_o comtroller_n and_o surveyor_n there_o nor_o agree_v with_o for_o the_o same_o in_o the_o custom-house_n they_o shall_v be_v forfeit_v the_o one_o moiety_n to_o their_o majesty_n the_o other_o to_o the_o informer_n this_o act_n to_o continue_v for_o five_o year_n and_o no_o long_o reside_v in_o dublin_n or_o within_o thirty_o mile_n thereof_o in_o hillary-term_n next_o in_o the_o court_n of_o chancery_n or_o king_n bench_n there_o between_z 9_o and_o 12_o in_o the_o forenoon_n and_o all_o the_o say_a person_n inhabit_v at_o a_o great_a distance_n at_o the_o general_a quarter-session_n where_o they_o reside_v between_o 9_o and_o 12_o before_o the_o 25_o of_o july_n next_o no_o benefit_n from_o this_o law_n v._n nothing_o herein_o contain_v shall_v exempt_v any_o person_n from_o pay_v tithe_n or_o other_o parochial_a duty_n to_o the_o church_n or_o minister_n nor_o next_o justice_n of_o peace_n by_o two_o witness_n or_o upon_o certificate_n under_o hand_n of_o the_o commissary_n of_o the_o muster_n or_o chief_a magistrate_n as_o aforesaid_a make_v to_o such_o justice_n shall_v be_v commit_v to_o the_o house_n of_o correction_n for_o ten_o day_n and_o have_v his_o ear_n cut_v off_o by_o the_o gaoler_n or_o keeper_n thereof_o if_o any_o person_n lend_v a_o horse_n to_o be_v muster_v not_o belong_v to_o the_o troop_n such_o horse_n shall_v be_v forfeit_v to_o the_o informer_n if_o it_o belong_v to_o the_o person_n lend_v if_o not_o the_o lender_n shall_v into_o one_o of_o their_o majesty_n warehouse_n there_o to_o remain_v till_o judgement_n pass_v according_a to_o this_o act_n nor_o shall_v any_o person_n whatsoever_o relate_v to_o the_o custom_n trust_n xiii_o any_o person_n by_o writ_n of_o assistance_n under_o the_o seal_n of_o the_o exchequer_n may_v take_v a_o constable_n or_o other_o public_a officer_n and_o in_o the_o daytime_n enter_v into_o any_o house_n shop_n cellar_n warehouse_n etc._n etc._n and_o in_o case_n of_o resistance_n may_v break_v open_a door_n trunk_n or_o other_o package_n to_o seize_v and_o bring_v to_o their_o majesty_n warehouse_n any_o of_o the_o say_a commodity_n fourteen_o the_o attorney_n general_n and_o other_o person_n seize_v and_o prosecute_n as_o aforesaid_a may_v use_v such_o method_n and_o course_n of_o proceed_v as_o may_v be_v use_v about_o the_o seize_v try_v and_o prosecute_n any_o good_n or_o commodity_n for_o nonpayment_n of_o custom_n or_o other_o duty_n or_o any_o person_n for_o offend_v against_o the_o law_n relate_v to_o custom_n and_o person_n prosecute_v for_o any_o thing_n do_v about_o the_o put_v
employ_v to_o no_o other_o use_n and_o all_o the_o order_n or_o warrant_n for_o the_o disposal_n thereof_o contrary_a to_o the_o intent_n of_o this_o act_n to_o be_v void_a xi_o the_o provision_n hereby_o make_v for_o the_o payment_n of_o the_o say_a interest-money_n for_o ever_o shall_v be_v in_o full_a satisfaction_n of_o the_o debt_n and_o interest_n thereof_o due_a to_o the_o say_a orphan_n and_o creditor_n and_o they_o be_v to_o acknowledge_v satisfaction_n of_o their_o respective_a debt_n according_a to_o the_o usual_a custom_n pay_v such_o fee_n to_o the_o officer_n concern_v as_o the_o mayor_n and_o court_n of_o alderman_n shall_v appoint_v not_o exceed_v thirteen_o shilling_n and_o four_o penny_n for_o every_o thousand_o pound_n fe_n the_o city_n hereby_o discharge_v book_n to_o be_v keep_v of_o the_o receipt_n and_o disbursement_n access_n thereto_o gratis_o from_o 9_o to_o 12_o in_o the_o forenoon_n the_o receipt_n and_o payment_n to_o be_v yearly_o audit_v the_o auditor_n fe_n and_o the_o city_n and_o their_o successor_n be_v hereby_o acquit_v of_o the_o same_o xii_o the_o chamberlain_n shall_v provide_v or_o keep_v one_o or_o more_o book_n or_o book_n same_o between_o the_o hour_n of_o nine_o and_o twelve_o in_o the_o forenoon_n without_o any_o fee_n or_o reward_n and_o the_o receipt_n and_o payment_n of_o all_o the_o money_n aforesaid_a shall_v be_v audit_v yearly_o upon_o oath_n before_o one_o of_o the_o auditor_n of_o the_o impress_v which_o oath_n the_o say_a auditor_n be_v hereby_o require_v to_o administer_v between_o michaelmas_n day_n and_o saint_n thomas_n the_o apostle_n and_o for_o every_o thousand_o pound_n the_o account_n shall_v amount_v to_o the_o auditor_n shall_v receive_v of_o the_o chamberlain_n twenty_o shilling_n and_o that_o will_v sue_v for_o the_o same_o in_o any_o of_o their_o majesty_n court_n of_o record_n fourteen_o the_o chamberlain_n and_o common_a sergeant_n of_o the_o city_n upon_o request_n shall_v give_v unto_o every_o of_o the_o say_a orphan_n and_o creditor_n and_o their_o respective_a executor_n administrator_n or_o assign_v assign_v liberty_n of_o assign_v a_o bill_n or_o note_n in_o write_v of_o the_o principal_a debt_n or_o interest_n owe_v to_o they_o and_o any_o person_n to_o who_o any_o money_n be_v payable_a by_o this_o act_n may_v by_o write_v under_o his_o hand_n and_o seal_n transfer_v his_o right_n and_o interest_n therein_o to_o be_v register_v in_o a_o book_n to_o be_v keep_v by_o the_o mayor_n and_o court_n of_o alderman_n and_o the_o note_n or_o bill_n of_o the_o say_a debt_n be_v deliver_v up_o to_o the_o officer_n appoint_v by_o the_o court_n of_o alderman_n for_o that_o purpose_n he_o shall_v give_v his_o note_n or_o bill_n in_o write_v of_o the_o debt_n so_o assign_v to_o the_o party_n to_o who_o such_o assignment_n be_v make_v and_o such_o assignee_n shall_v be_v entitle_v to_o the_o benefit_n thereof_o and_o may_v assign_v toties_fw-la query_n irrevocable_a assignment_n irrevocable_a and_o it_o shall_v not_o be_v in_o the_o power_n of_o such_o person_n who_o have_v make_v such_o assignment_n to_o release_v or_o discharge_v the_o same_o or_o the_o money_n thereby_o assign_v xv._o chamber_n orphan_n not_o compellable_n to_o bring_v in_o their_o money_n to_o the_o chamber_n no_o person_n shall_v be_v oblige_v or_o compel_v by_o virtue_n of_o any_o custom_n within_o the_o say_a city_n or_o by_o order_n or_o process_n of_o the_o court_n of_o orphan_n to_o pay_v into_o the_o chamber_n any_o sum_n of_o money_n or_o personal_a estate_n due_a or_o to_o be_v due_a or_o belong_v to_o a_o orphan_n of_o any_o freeman_n any_o law_n or_o usage_n enforce_v the_o same_o notwithstanding_o but_o this_o not_o to_o be_v construe_v to_o extend_v to_o impeach_v or_o prevent_v process_n upon_o any_o recognizance_n already_o give_v according_a to_o the_o custom_n xvi_o default_n the_o city_n answerable_a for_o their_o officer_n default_n if_o the_o corporation_n of_o the_o city_n or_o any_o of_o their_o officer_n or_o other_o person_n by_o colour_n of_o any_o warrant_n or_o authority_n from_o they_o misapply_v or_o convert_v to_o their_o own_o use_n any_o of_o the_o sum_n hereby_o appropriate_v the_o corporation_n shall_v be_v answerable_a for_o the_o same_o out_o of_o their_o revenue_n in_o any_o action_n to_o be_v bring_v by_o any_o of_o the_o say_a orphan_n or_o creditor_n the_o sum_n recover_v to_o be_v to_o the_o use_v aforesaid_a and_o the_o cost_v to_o the_o party_n sue_v the_o amerciament_n city_n fine_n on_o such_o suit_n to_o the_o use_n of_o the_o city_n fine_n and_o distress_n upon_o the_o corporation_n upon_o the_o account_n of_o such_o suit_n to_o be_v to_o the_o use_v aforesaid_a and_o not_o to_o be_v pardon_v or_o acquit_v by_o their_o majesty_n xvii_o provide_v on_o application_n make_v to_o the_o mayor_n and_o court_n of_o alderman_n by_o the_o executor_n or_o administrator_n of_o the_o father_n of_o such_o orphan_n to_o pay_v in_o or_o lodge_v any_o sum_n of_o money_n of_o such_o orphan_n in_o the_o say_a chamber_n and_o to_o have_v the_o benefit_n of_o the_o say_a provision_n hereby_o make_v it_o shall_v be_v lawful_a for_o the_o say_a mayor_n and_o alderman_n to_o pay_v off_o the_o like_a sum_n to_o such_o person_n entitle_v to_o the_o say_v yearly_a payment_n as_o aforesaid_a as_o they_o think_v fit_a not_o be_v orphan_n under_o the_o age_n of_o twenty_o one_o year_n of_o age_n and_o give_v three_o month_n notice_n to_o or_o for_o the_o person_n so_o to_o be_v pay_v off_o at_o the_o end_n of_o which_o three_o month_n upon_o payment_n or_o tender_a of_o the_o say_a money_n due_a for_o principal_n and_o interest_n to_o or_o for_o the_o person_n to_o who_o such_o notice_n shall_v be_v give_v according_a to_o the_o provision_n hereby_o make_v at_o the_o office_n of_o the_o say_a chamberlain_n in_o guildhall_n that_o from_o thenceforth_o the_o annual_a sum_n of_o money_n payable_a to_o such_o person_n to_o who_o such_o notice_n payment_n or_o tender_a shall_v be_v make_v shall_v cease_v and_o determine_v and_o the_o same_o shall_v become_v due_a the_o provision_n hereby_o make_v shall_v remain_v a_o perpetual_a fond_a for_o the_o benefit_n of_o the_o orphan_n of_o the_o say_a city_n successive_o xviii_o parliament_n debt_n mortgage_v redeemable_a upon_o payment_n of_o principal_a and_o interest_n provide_v it_o be_v within_o 3_o year_n after_o this_o session_n of_o parliament_n if_o any_o such_o debt_n due_a to_o any_o of_o the_o say_a orphan_n have_v at_o any_o time_n before_o the_o say_v 25_o day_n of_o december_n be_v mortgage_v or_o covenant_v to_o be_v so_o they_o be_v redeemable_a and_o shall_v be_v redeem_v upon_o and_o solicitor_n what_o they_o judge_v may_v be_v reasonable_a and_o that_o to_o be_v allow_v in_o the_o account_n of_o the_o say_a revenue_n and_o if_o they_o demand_v or_o receive_v more_o than_o shall_v be_v so_o adjudge_v due_a to_o they_o they_o shall_v forfeit_v treble_a the_o sum_n receive_v to_o be_v recover_v with_o cost_v of_o suit_n by_o such_o person_n as_o will_v sue_v for_o the_o same_o in_o any_o of_o their_o majesty_n court_n of_o record_n at_o westminster_n xx._n except_v new-river_n water_n thames_n water_n and_o shadwel_n water-work_n except_v this_o act_n shall_v not_o the_o mayor_n and_o court_n of_o alderman_n to_o retain_v and_o apply_v and_o the_o chamberlain_n to_o issue_n and_o pay_v towards_o the_o necessary_a expense_n and_o charge_n of_o the_o city_n any_o sum_n not_o exceed_v in_o the_o whole_a the_o sum_n of_o two_o thousand_o pound_n yearly_a out_o of_o the_o money_n hereby_o appoint_v to_o the_o use_n of_o the_o orphan_n and_o creditor_n but_o in_o case_n after_o the_o deduction_n and_o allowance_n of_o the_o say_v two_o thousand_o pound_n during_o the_o seven_o year_n there_o shall_v not_o be_v raise_v and_o pay_v to_o the_o orphan_n and_o creditor_n out_o of_o the_o residue_n of_o the_o profit_n of_o the_o aforesaid_a several_a provision_n and_o fond_n so_o much_o money_n as_o will_v full_o satisfy_v all_o the_o say_a orphan_n and_o creditor_n interest_n for_o all_o their_o several_a and_o respective_a debt_n after_o the_o rate_n of_o four_o pound_n per_fw-la cent._n per_fw-la annum_fw-la during_o the_o whole_a seven_o year_n that_o then_o the_o city_n shall_v repay_v into_o the_o hand_n of_o the_o chamberlain_n within_o seven_o year_n after_o the_o expiration_n of_o the_o say_a term_n fourteen_o thousand_o pound_n or_o so_o much_o thereof_o as_o they_o shall_v have_v make_v use_n of_o by_o two_o thousand_o pound_n per_fw-la annum_fw-la or_o such_o less_o yearly_a sum_n as_o shall_v be_v proportionable_a to_o what_o or_o belief_n at_o or_o upon_o the_o 28_o day_n of_o november_n anno_fw-la dom._n 1690._o ii_o and_o in_o case_n any_o sheriff_n oath_n penalty_n for_o refuse_v the_o oath_n jailer_n or_o keeper_n contributor_n in_o the_o say_a act_n mention_v and_o all_o the_o rate_n and_o duty_n by_o the_o say_a act_n grant_v over_o and_o beside_o so_o much_o as_o shall_v bear_v proportion_n at_o the_o rate_n by_o the_o say_a act_n for_o all_o money_n so_o advance_v by_o he_o and_o pay_v from_o the_o respective_a day_n of_o payment_n unto_o the_o 24_o of_o june_n as_o aforesaid_a interest_n at_o the_o rate_n of_o 10_o l._n per_fw-la cent._n per_fw-la annum_fw-la ii_o majesty_n money_n payable_a to_o any_o person_n by_o this_o act_n to_o be_v free_a from_o duty_n surplus_n to_o be_v to_o the_o use_n of_o their_o majesty_n any_o money_n payable_a to_o any_o person_n or_o person_n by_o virtue_n of_o this_o act_n shall_v not_o be_v chargeable_a with_o any_o rate_n duty_n or_o imposition_n whatsoever_o and_o in_o case_n there_o shall_v be_v any_o surplus_n or_o remainder_n of_o the_o money_n arise_v by_o the_o say_a rate_n and_o duty_n of_o excise_n at_o the_o end_n of_o any_o year_n during_o the_o term_n of_o ninety_o and_o nine_o year_n grant_v therein_o by_o the_o say_v former_a act_n after_o make_v all_o the_o payment_n which_o by_o this_o or_o the_o say_v former_a act_n be_v appoint_v to_o be_v pay_v within_o the_o same_o year_n or_o reserve_v money_n for_o the_o same_o such_o surplus_n or_o remainder_n shall_v be_v to_o the_o use_n of_o their_o majesty_n their_o heir_n and_o successor_n iii_o produce_v upon_o demand_v of_o their_o share_n a_o certificate_n of_o the_o life_n of_o the_o nominee_n shall_v be_v produce_v every_o contributor_n upon_o this_o or_o the_o former_a act_n his_o or_o her_o executor_n administrator_n or_o assign_v upon_o their_o demand_v any_o half-year_o or_o quarterly_a payment_n of_o their_o respective_a share_n of_o either_o of_o the_o of_o a_o false_a oath_n certificate_n penalty_n of_o forge_v a_o certificate_n or_o forge_v any_o certificate_n touch_v the_o premise_n and_o be_v thereof_o lawful_o convict_v he_o shall_v incur_v the_o pain_n and_o penalty_n to_o be_v inflict_v upon_o person_n who_o commit_v wilful_a perjury_n or_o forgery_n and_o in_o case_n any_o nominee_n shall_v at_o the_o time_n of_o such_o demand_n be_v resident_a in_o scotland_n or_o beyond_o the_o sea_n and_o any_o one_o or_o more_o of_o the_o baron_n of_o the_o exchequer_n for_o the_o time_n be_v shall_v certify_v that_o upon_o proof_n to_o he_o and_o every_o the_o officer_n and_o other_o person_n in_o the_o recite_v act_n mention_v as_o be_v in_o the_o say_a act_n appoint_v and_o enact_v in_o case_n of_o divert_v or_o misapply_v any_o part_n xxvi_o act._n infant_n a_o nominee_n and_o contributor_n within_o this_o act._n any_o guardian_n or_o trustee_n of_o any_o infant_n may_v advance_v and_o pay_v the_o sum_n of_o 100_o l._n of_o the_o money_n of_o such_o infant_n upon_o the_o respective_a term_n and_o recompense_n herein_o mention_v and_o if_o it_o be_v upon_o a_o annuity_n for_o life_n he_o shall_v within_o the_o time_n before_o appoint_v for_o the_o name_n of_o life_n name_v the_o say_a infant_n to_o be_v a_o nominee_n and_o such_o infant_n upon_o payment_n of_o the_o sum_n shall_v become_v a_o contributor_n within_o the_o meaning_n of_o this_o act_n and_o be_v entitle_v to_o have_v and_o receive_v a_o proportion_n discharge_v guardian_n discharge_v as_o any_o other_o contributor_n and_o the_o say_a guardian_n and_o trustee_n as_o to_o the_o say_a sum_n of_o 100_o l._n so_o advance_v be_v hereby_o discharge_v xxvii_o nominee_n contributor_n demand_v money_n shall_v produce_v a_o certificate_n of_o the_o life_n of_o the_o nominee_n every_o contributor_n upon_o the_o term_n of_o have_v a_o annuity_n for_o one_o two_o or_o three_o life_n his_o or_o her_o executor_n administrator_n and_o assign_v upon_o demand_v any_o payment_n unless_o the_o nominee_n or_o nominees_n or_o one_o of_o they_o appear_v in_o person_n at_o the_o say_a receipt_n shall_v produce_v a_o certificate_n of_o the_o life_n of_o
