better_a assess_n raise_v and_o rate_v the_o sum_n of_o two_o thousand_o pound_n aforesaid_a the_o mayor_n and_o alderman_n within_o the_o city_n of_o new-york_n the_o mayor_n and_o alderman_n of_o the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v forthwith_o upon_o the_o publication_n hereof_o assemble_v and_o meet_v together_o at_o the_o court-house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n and_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_v the_o pubick_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o mention_v according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o reasonable_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n aldermen_z and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freehold_n of_o the_o respective_a place_n for_o the_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o refuse_v to_o take_v oath_n as_o aforesaid_a or_o shall_v in_o any_o way_n deny_v neglect_n or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v refuse_v or_o neglect_v to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o shall_v make_v fine_a and_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o abovesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v of_o within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v or_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_v of_o any_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_n of_o such_o good_n and_o chattel_n to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v if_o any_o such_o overplus_n shall_v happen_v to_o be_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorise_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o article_n and_o clause_n therein_o be_v true_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o
alderman_n within_o the_o city_n of_o albany_n with_o the_o justice_n of_o the_o peace_n for_o the_o city_n and_o county_n of_o albany_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n or_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o detray_n of_o the_o public_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o mention_v according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n alderman_n and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o safe_a of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o therein_o bedue_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n cause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v be_v nonsuit_v or_o forbear_v further_a prosecution_n or_o suffer_v discontinuance_n or_o verdict_n to_o pass_v against_o he_o the_o defendant_n or_o defendor_n shall_v have_v trible_a cost_v for_o which_o they_o shall_v have_v like_o liberty_n as_o in_o case_n where_o cost_v by_o law_n be_v give_v to_o defendant_n provide_v always_o that_o no_o mayor_n aldermen_z or_o justice_n of_o the_o peace_n shall_v be_v trouble_v sue_v prosecute_v or_o molest_v for_o any_o omission_n offence_n or_o neglect_v by_o virtue_n of_o this_o act_n but_o within_o the_o space_n of_o one_o year_n after_o such_o omission_n offence_n or_o neglect_n and_o not_o at_o any_o time_n thereafter_o any_o thing_n herein_o contain_v to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o several_a collector_n of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v the_o liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforemention_v in_o silver_n money_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o currant_n market_n price_n in_o silver_n money_n at_o new-york_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o regulate_v the_o building_n street_n lane_n wharff_n dock_n and_o ally_n of_o the_o city_n of_o new-york_n whereas_o the_o city_n of_o new-york_n and_o metropolis_n of_o this_o province_n be_v chief_o erect_v by_o the_o inhabitant_n thereof_o for_o the_o propagate_a and_o encouragement_n of_o trade_n and_o commerce_n and_o for_o the_o good_a benefit_n
and_o welfare_n of_o their_o majesty_n subject_n inhabit_v within_o this_o province_n and_o forasmuch_o as_o it_o be_v very_o necessary_a for_o traffic_n and_o commerce_n that_o building_n street_n lane_n wharff_n dock_n and_o ally_n of_o the_o say_a city_n be_v convenient_o regulate_v with_o uniformity_n for_o the_o accommodation_n of_o habitation_n ship_n trade_n and_o commerce_n and_o that_o all_o impediment_n and_o obstruction_n that_o may_v retard_v so_o necessary_a a_o work_n may_v be_v remove_v be_v it_o enact_v by_o the_o commander_n in_o chief_a and_o council_n and_o representative_n meet_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o mayor_n aldermen_z and_o common-council_n of_o the_o say_a city_n shall_v and_o may_v at_o their_o will_n and_o pleasure_n elect_v nominate_v or_o appoint_v one_o or_o more_o discreet_a and_o intelligent_a person_n or_o person_n to_o be_v the_o surveyor_n or_o supervisor_n of_o their_o building_n street_n lane_n wharff_n dock_n and_o ally_n and_o to_o see_v that_o the_o building_n street_n lane_n wharff_n dock_n and_o ally_n of_o the_o say_a city_n be_v convenient_o regulate_v with_o uniformity_n for_o the_o accommodation_n of_o habitation_n ship_n trade_n and_o commerce_n according_a to_o such_o rule_n and_o order_n of_o building_n and_o lay_v out_o of_o street_n lane_n wharff_n dock_n and_o ally_n as_o shall_v be_v establish_v by_o the_o mayor_n aldermen_z and_o common-council_n of_o the_o say_a city_n who_o be_v hereby_o authorize_v and_o impower_v to_o make_v such_o rule_n and_o order_n for_o the_o better_a regulation_n uniformity_n and_o gracefulness_n of_o such_o new-building_n as_o shall_v be_v erect_v for_o habitation_n and_o also_o of_o such_o street_n lane_n wharff_n dock_n and_o alles_n as_o shall_v be_v find_v convenient_a for_o the_o good_a of_o the_o inhabitant_n and_o it_o shall_v be_v lawful_a for_o the_o mayor_n aldermen_z and_o common-council_n or_o for_o the_o mayor_n and_o alderman_n in_o their_o court_n to_o administer_v a_o oath_n upon_o the_o holy_a evangelist_n unto_o the_o surveyor_n or_o supervisor_n of_o the_o true_a and_o impartial_a execution_n of_o their_o office_n in_o that_o behalf_n and_o whereas_o in_o the_o lay_n out_o of_o the_o new_a lot_n for_o building_n some_o controversy_n may_v arise_v by_o a_o lot_n or_o lot_n of_o ground_n which_o if_o build_v upon_o will_v be_v very_o incommodious_a and_o prejudicial_a to_o one_o of_o the_o principal_a street_n of_o this_o city_n and_o hurtful_a to_o the_o trade_n and_o health_n of_o the_o inhabitant_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o the_o mayor_n aldermen_z and_o common-council_n of_o the_o say_a city_n for_o the_o time_n be_v in_o common-council_n assemble_v shall_v and_o may_v and_o be_v hereby_o impower_v and_o require_v to_o obstruct_v any_o building_n or_o building_n that_o may_v narrow_a the_o say_a street_n or_o any_o other_o street_n within_o the_o say_a city_n and_o the_o say_a mayor_n aldermen_z and_o common_a council_n shall_v and_o may_v by_o virtue_n of_o this_o present_a act_n continue_v the_o say_a street_n common_o call_v the_o broad_a street_n according_a to_o its_o present_a dimension_n and_o if_o in_o the_o do_v thereof_o or_o in_o the_o lay_n out_o for_o the_o future_a any_o street_n lane_n wharff_n dock_n or_o ally_n and_o they_o do_v take_v any_o person_n ground_n they_o be_v to_o give_v notice_n to_o the_o owner_n or_o party_n interest_v in_o the_o ground_n to_o be_v so_o take_v for_o the_o intent_n as_o aforesaid_a and_o to_o the_o end_n that_o reasonable_a satisfaction_n may_v be_v give_v for_o all_o such_o ground_n as_o shall_v be_v take_v and_o employ_v for_o the_o use_v aforesaid_a the_o commander_n in_o chief_a and_o council_n may_v assess_v the_o value_n of_o the_o lot_n now_o in_o controversy_n and_o for_o other_o ground_n the_o mayor_n aldermen_z and_o common-council_n shall_v and_o may_v treat_v and_o agree_v with_o the_o owner_n and_o other_o interest_v therein_o and_o if_o there_o be_v any_o person_n that_o shall_v refuse_v to_o treat_v in_o manner_n aforesaid_a that_o in_o such_o case_n the_o mayor_n and_o alderman_n in_o their_o court_n be_v hereby_o authorize_v by_o virtue_n of_o this_o act_n to_o issue_v out_o a_o warrant_n or_o warrant_n to_o the_o sheriff_n of_o the_o say_a city_n who_o be_v hereby_o require_v to_o impannel_n &_o return_v a_o jury_n before_o the_o say_a court_n of_o mayor_n and_o alderman_n which_o jury_n upon_o their_o oath_n to_o be_v administer_v by_o the_o say_a court_n be_v to_o inquire_v and_o assess_v such_o damage_n and_o recompense_n as_o they_o shall_v judge_v fit_a to_o be_v award_v to_o the_o owner_n and_o other_o interest_v according_a to_o their_o several_a and_o respective_a interest_n and_o estate_n of_o any_o such_o ground_n or_o any_o part_n thereof_o for_o their_o respective_a interest_n and_o estate_n in_o the_o same_o as_o by_o the_o say_a mayor_n aldermen_z and_o common_a council_n shall_v be_v adjudge_v fit_a to_o be_v convert_v to_o the_o purpose_n aforesaid_a and_o such_o verdict_n of_o the_o jury_n and_o judgement_n of_o the_o say_a court_n of_o mayor_n and_o alderman_n thereupon_o and_o the_o payment_n of_o the_o say_a sum_n and_o sum_n of_o money_n so_o award_v or_o adjudge_v to_o the_o owner_n or_o other_o have_v estate_n or_o interest_n or_o tender_a or_o refusal_n thereof_o shall_v be_v bind_v to_o all_o intent_n and_o purpose_n against_o the_o say_a party_n their_o heir_n executor_n administrator_n and_o assign_v and_o all_o other_o claim_v any_o title_n and_o interest_n to_o the_o say_a ground_n and_o shall_v be_v a_o full_a authority_n to_o the_o say_a mayor_n aldermen_z and_o common_a council_n to_o cause_v the_o say_a ground_n to_o be_v convert_v and_o use_v for_o the_o purpose_n aforesaid_a any_o thing_n contrary_a herein_o or_o in_o any_o other_o law_n to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o fora_fw-la smuch_o as_o the_o filth_n and_o soil_n of_o the_o say_a city_n lie_v in_o the_o public_a street_n thereof_o do_v often_o prove_v a_o common_a nuisance_n unto_o the_o inhabitant_n and_o trader_n to_o and_o from_o the_o say_a city_n and_o very_o prejudicial_a to_o and_o the_o o_o der_fw-mi and_o manner_n of_o pave_v and_o pitch_v the_o street_n lane_n and_o ally_n of_o the_o say_a city_n shall_v be_v design_v and_o set_v out_o by_o the_o mayor_n aldermen_z and_o common_a council_n of_o the_o say_a city_n together_o with_o the_o say_a surveyor_n or_o supervisor_n appoint_v in_o manner_n aforesaid_a and_o when_o they_o assemble_v shall_v have_v power_n and_o authority_n to_o order_n and_o direct_v the_o make_n of_o vault_n drain_v and_o sever_v or_o to_o cut_v into_o any_o drain_n or_o sever_n already_o make_v and_o for_o the_o alteze_a enlarge_a amend_v cleanse_v and_o scour_v of_o vault_n sink_n or_o common_a sever_v and_o for_o the_o better_a effect_v thereof_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a mayor_n aldermen_z and_o common_a council_n together_o with_o the_o surveyor_n and_o supervisor_n at_o their_o say_a meeting_n to_o impose_v any_o reasonable_a tax_n upon_o all_o house_n within_o the_o say_a city_n in_o proportion_n to_o the_o benefit_n they_o shall_v receive_v thereby_o for_o and_o towards_o the_o make_n cut_a alter_a enlarge_a amend_v cleanse_v and_o scour_v all_o and_o singular_a the_o say_a vault_n drain_v sever_v pavement_n and_o pitch_v aforesaid_a and_o in_o default_n of_o payment_n of_o the_o say_a sum_n to_o be_v charge_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a mayor_n and_o alderman_n etc._n etc._n so_o authorize_v as_o aforesaid_a by_o order_n or_o warrant_n under_o their_o hand_n and_o seal_n to_o levy_v the_o say_a sum_n and_o sum_n of_o money_n so_o assess_v by_o distress_n and_o sale_n of_o the_o good_n of_o the_o party_n chargeable_a therewith_o and_o refuse_v or_o neglect_v to_o pay_v the_o same_o render_v the_o overplus_n if_o any_o be_v always_o provide_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o nothing_o herein_o contain_v shall_v be_v construe_v to_o change_v alter_v shorten_v lengthen_v narrow_a or_o enlarge_v any_o of_o the_o street_n ally_n and_o lane_n within_o this_o city_n as_o they_o be_v now_o lay_v out_o and_o remain_v at_o the_o publication_n hereof_o nor_o to_o break_v through_o any_o person_n ground_n now_o in_o fence_n or_o enclose_v or_o to_o take_v away_o any_o person_n house_n or_o habitation_n any_o thing_n herein_o contain_v to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o act_n pass_v in_o the_o
three_o session_n of_o the_o general_n assembly_n begin_v in_o the_o city_n of_o new-york_n april_n 19_o 1692._o a_o act_n for_o the_o raise_v two_o hundred_o man_n with_o their_o proper_a officer_n for_o the_o secure_n and_o reinforce_a of_o albany_n in_o the_o fronteer_n of_o this_o province_n whereas_o the_o force_n late_o raise_v for_o the_o reinforce_a and_o secure_v the_o fronteer_n at_o albany_n be_v not_o to_o continue_v in_o that_o service_n any_o long_a than_o the_o first_o of_o may_n next_o ensue_v and_o forasmuch_o as_o it_o be_v still_o absolute_o necessary_a for_o the_o safety_n of_o all_o their_o majesty_n neighbour_a colony_n and_o plantation_n as_o well_o for_o the_o security_n of_o this_o province_n that_o there_o be_v and_o remain_v at_o that_o place_n sufficieut_n force_v for_o the_o defence_n thereof_o and_o whereas_o the_o present_a state_n &_o condition_n of_o this_o province_n be_v such_o that_o they_o be_v not_o able_a at_o this_o time_n to_o make_v sufficient_a provision_n of_o man_n and_o money_n for_o the_o reinforce_a of_o that_o place_n as_o be_v true_o necessary_a for_o the_o maintain_v such_o a_o considerable_a post_n which_o be_v the_o only_a bull-work_n of_o defence_n for_o all_o their_o majesty_n neighbour_a colony_n and_o plantation_n in_o this_o main_a of_o america_n yet_o that_o the_o say_a place_n may_v not_o be_v desert_v nor_o the_o indian_n who_o have_v be_v so_o constant_a to_o we_o discourage_v be_v it_o therefore_o enact_v by_o the_o commander_n in_o chief_a and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o the_o commander_n in_o chief_a do_v issue_n out_o his_o warrant_n to_o the_o chief_a military_a officer_n in_o the_o respective_a city_n and_o county_n under-named_n for_o the_o raise_n of_o 200_o man_n arm_v as_o the_o law_n direct_v with_o their_o proper_a officer_n in_o such_o proportion_n hereafter_o mention_v to_o consist_v and_o make_v two_o distinct_a company_n of_o fuzileer_n for_o the_o reinforeement_n and_o security_n of_o the_o fronteer_n of_o this_o province_n in_o the_o county_n of_o albany_n aforesaid_a which_o shall_v continue_v and_o remain_v in_o the_o say_a county_n of_o albany_n for_o the_o defence_n and_o security_n thereof_o for_o the_o term_n and_o space_n of_o five_o month_n to_o commence_v on_o the_o first_o day_n of_o may_n next_o and_o to_o end_n and_o terminate_v on_o the_o first_o day_n of_o october_n then_o follow_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o in_o pursuance_n of_o such_o warrant_n or_o warrant_n to_o be_v by_o the_o commander_n in_o chief_a issue_v out_o to_o the_o chief_a military_a officer_n of_o each_o respective_a city_n and_o county_n or_o counties_n as_o aforesaid_a shall_v be_v warn_v to_o appear_v in_o arm_n in_o order_n to_o the_o raise_v the_o 200_o man_n aforesaid_a shall_v neglect_v delay_n or_o refuse_v to_o appear_v or_o otherwise_o absent_v he_o or_o themselves_o shall_v forfeit_v the_o sum_n of_o five_o pound_n currant_n money_n to_o be_v levy_v by_o distress_n by_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o justice_n of_o the_o peace_n within_o this_o province_n on_o the_o good_n and_o chattel_n of_o every_o such_o person_n or_o person_n so_o offend_v as_o aforesaid_a upon_o a_o certificate_n of_o such_o default_n from_o the_o captain_n or_o chief_a officer_n of_o such_o company_n in_o or_o to_o which_o the_o say_a offender_n shall_v be_v list_v or_o belong_v under_o his_o hand_n &_o seal_n which_o say_v sum_n of_o 5_o l._n shall_v be_v employ_v for_o the_o encouragement_n and_o raise_v the_o quota_fw-la certificate_n and_o by_o such_o warrant_n as_o aforesaid_a shall_v becommit_v to_o the_o common_a goal_n of_o the_o same_o city_n or_o county_n or_o counties_n there_o to_o remain_v without_o bail_n currant_n money_n of_o this_o province_n be_v lay_v assess_v raise_v and_o levy_v upon_o all_o and_o every_o the_o inhabitant_n resident_n and_o freeholder_n of_o and_o in_o this_o province_n for_o the_o pay_v and_o maintain_v of_o the_o say_v two_o hundred_o man_n and_o their_o proper_a officer_n for_o five_o month_n as_o aforesaid_a and_o for_o no_o other_o use_n intent_n or_o purpose_n whatsoever_o to_o be_v lay_v assess_v raise_v levy_v and_o pay_v to_o their_o majesty_n collector_n and_o receiver_n general_n for_o the_o time_n be_v at_o their_o majesty_n custom-house_n in_o the_o pay_v and_o maintain_v 40_o man_n be_v their_o quota_fw-la and_o proportion_n as_o aforesaid_a for_o king_n county_n 210_o l._n for_o the_o pay_v and_o maintain_v 28_o man_n be_v their_o quota_fw-la and_o proportion_n as_o aforesaid_a for_o queen_n county_n 225_o l._n for_o the_o pay_v &_o maintain_v 30_o man_n etc._n etc._n for_o the_o county_n of_o orange_n 15_o l._n for_o the_o pay_v and_o maintain_v two_o man_n be_v their_o quota_fw-la and_o proportion_n as_o aforesaid_a and_o also_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o such_o sum_n or_o sum_n of_o money_n of_o the_o several_a sum_n of_o 2500_o l._n late_o raise_v by_o the_o act_n of_o general_n assembly_n for_o the_o pay_v and_o defray_v of_o the_o charge_n of_o 250_o fuzileer_n with_o their_o officer_n raise_v for_o the_o secure_n and_o defence_n of_o albany_n which_o shall_v and_o do_v remain_v undisposed_a of_o and_o not_o employ_v for_o the_o use_v aforesaid_a shall_v be_v lay_v out_o and_o apply_v towards_o the_o defray_a the_o incidental_a charge_n or_o expense_n which_o shall_v or_o may_v happen_v or_o be_v occasion_v by_o the_o raise_n transport_v and_o maintain_v of_o the_o two_o hundred_o fuzileer_n with_o their_o proper_a officer_n before_o in_o this_o act_n mention_v and_o express_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a assess_n raise_v &_o pay_v the_o sum_n of_o one_o thousand_o five_o hundred_o pound_n aforesaid_a the_o mayor_n and_o alderman_n in_o the_o city_n of_o new-york_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n or_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_n of_o the_o public_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o mention_v according_a to_o
the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a say_v that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respestive_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o be_v or_o they_o shall_v make_v fine_a or_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a and_o genuine_a sense_n and_o intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v lawful_o convict_v before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o whereas_o there_o have_v be_v great_a neglect_n in_o the_o justice_n of_o the_o peace_n collector_n and_o assessor_n who_o have_v delay_v execute_v their_o respective_a duty_n according_a to_o the_o true_a intent_n and_o meaning_n of_o the_o former_a act_n make_v in_o several_a session_n of_o this_o present_a assembly_n for_o the_o prevention_n of_o the_o like_a for_o the_o future_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v neglect_n or_o delay_n to_o have_v their_o respective_a quota_fw-la or_o proportion_n of_o man_n at_o the_o city_n of_o new-york_n or_o at_o the_o city_n of_o albany_n on_z or_o before_o the_o 20_o day_n of_o may_n now_o next_o ensue_v pursuant_n to_o the_o warrant_v direct_v to_o they_o from_o the_o commander_n in_o chief_a as_o aforesaid_a and_o also_o if_o any_o of_o the_o respective_a city_n and_o county_n aforesaid_a shall_v refuse_v delay_n or_o neglect_v to_o make_v payment_n of_o the_o several_a respective_a sum_n or_o proportion_n of_o money_n by_o they_o respective_o to_o be_v pay_v as_o aforesaid_a at_o the_o time_n and_o place_n above_o mention_v and_o appoint_v that_o then_o and_o for_o every_o day_n after_o the_o say_a day_n aforementioned_a and_o appoint_v for_o the_o payment_n thereof_o or_o until_o the_o whole_a sum_n and_o proportion_n of_o each_o respective_a city_n and_o county_n shall_v be_v full_o pay_v and_o satisfy_v such_o city_n and_o county_n or_o county_n that_o shall_v be_v defective_a therein_o shall_v each_o and_o every_o of_o they_o forfeit_v and_o pay_v for_o the_o intent_n aforesaid_a the_o far_a sum_n of_o five_o pound_n â—urrant_n money_n aforesaid_a for_o each_o day_n default_n or_o neglect_v of_o have_v their_o quota_fw-la of_o man_n or_o payment_n of_o their_o respective_a proportion_n at_o the_o time_n appoint_v and_o for_o the_o enable_v the_o commander_n in_o chief_a to_o borrow_v money_n or_o to_o agree_v for_o provision_n for_o the_o maintain_n of_o the_o two_o company_n aforesaid_a that_o the_o purpose_n of_o this_o act_n may_v be_v true_o attend_v and_o execute_v be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a for_o any_o person_n or_o person_n to_o advance_v &_o lend_v to_o the_o commander_n in_o chief_a etc._n etc._n upon_o the_o credit_n of_o this_o act_n any_o sum_n or_o sum_n of_o money_n not_o exceed_v the_o sum_n of_o 700_o l._n and_o to_o have_v and_o receive_v for_o the_o forbearance_n of_o all_o such_o money_n as_o shall_v be_v lend_v interest_n not_o exceed_v the_o rate_n of_o ten_o per_fw-la cent._n per_fw-la annum_fw-la and_o to_o the_o end_n that_o all_o money_n and_o provision_n which_o shall_v be_v so_o lend_v unto_o the_o commander_n in_o chief_a etc._n etc._n may_v be_v well_o and_o sufficient_o secure_v out_o of_o the_o money_n arise_v and_o payable_a by_o this_o act_n with_o the_o interest_n for_o the_o same_o not_o exceed_v ten_o per_n cent._n per_fw-la annum_fw-la as_o aforesaid_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o their_o majesty_n collector_n and_o receiver_n general_n for_o the_o time_n be_v shall_v separate_v and_o keep_v apart_o all_o the_o money_n arise_v by_o the_o rate_n &_o proportion_n hereby_o grant_v as_o the_o same_o shall_v arise_v and_o be_v pay_v unto_o he_o by_o the_o receiver_n or_o collector_n of_o the_o same_o or_o by_o any_o other_o person_n whatsoever_o
keep_v a_o perfect_a and_o distinct_a account_n as_o the_o same_o shall_v come_v in_o which_o sum_n or_o sum_n of_o money_n so_o by_o he_o receive_v as_o aforesaid_a shall_v not_o be_v separate_v or_o pay_v unto_o any_o other_o person_n or_o person_n whatsoever_o but_o unto_o such_o as_o shall_v lend_v any_o money_n to_o the_o commander_n in_o chief_a etc._n etc._n upon_o the_o credit_n of_o this_o act_n who_o shall_v immediate_o have_v a_o warrant_n and_o a_o order_n for_o the_o repayment_n bear_v the_o same_o date_n in_o which_o he_o pay_v his_o money_n wherein_o shall_v likewise_o be_v contain_v the_o interest_n for_o forbearance_n and_o that_o all_o order_n for_o re-payment_n shall_v be_v register_v in_o course_n according_a to_o the_o date_n of_o the_o warrant_n respective_o without_o preference_n of_o one_o before_o another_o and_o that_o all_o and_o every_o person_n or_o person_n shall_v be_v pay_v in_o course_n according_a as_o their_o order_n shall_v stand_v register_v or_o enter_v and_o that_o the_o money_n to_o come_v in_o by_o this_o act_n shall_v be_v in_o the_o same_o order_n liable_a to_o the_o satisfaction_n of_o the_o say_v respective_a party_n their_o executor_n administrator_n or_o assign_v successive_o without_o preference_n of_o one_o before_o another_o and_o not_o otherwise_o and_o not_o to_o be_v divertible_a to_o any_o oâ—her_a use_n intent_n or_o purpose_n whatsoever_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n cause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a of_o each_o respective_a city_n and_o county_n as_o aforesaid_a shall_v have_v the_o liberty_n to_o pay_v the_o several_a and_o respective_a sum_n assess_v as_o aforesaid_a at_o the_o day_n aforemention_v in_o silver_n money_n or_o for_o want_v thereof_o in_o good_a sufficient_a and_o merchantable_a provision_n at_o the_o currant_n market_n price_n in_o silver_n money_n at_o new-york_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o destroy_n of_o wolf_n be_v it_o enact_v by_o the_o commander_n in_o chief_a and_o council_n and_o representative_n couven_v in_o general_a assembly_n and_o by_o the_o authority_n of_o the_o same_o that_o for_o the_o destroy_n of_o wolf_n who_o have_v late_o increase_v very_o much_o to_o the_o great_a discouragement_n of_o pasturage_n and_o increase_v of_o sheep_n and_o cattle_n that_o whatsoever_o christian_n shall_v kill_v a_o grow_v wolf_n upon_o long-island_n or_o staten-island_n he_o shall_v have_v for_o each_o wolf_n that_o shall_v be_v kill_v twenty_o shilling_n to_o be_v pay_v out_o of_o the_o public_a treasury_n of_o each_o respective_a county_n where_o the_o wolf_n shall_v be_v kill_v and_o for_o a_o wolf_n whelp_n above_o half_a a_o year_n old_a there_o shall_v be_v pay_v as_o aforesaid_a ten_o shilling_n and_o whatsoever_o indian_a shall_v in_o like_a manner_n kill_v any_o wolf_n shall_v have_v for_o his_o reward_n one_o matchcoat_n or_o twelve_o shilling_n and_o for_o a_o wolf_n whelp_n five_o shilling_n to_o be_v pay_v he_o as_o august_n annoque_fw-la dom._n 1692._o in_o the_o four_o year_n of_o their_o majesty_n reign_n king_n william_n and_o queen_n mary_n under_o the_o government_n of_o his_o excellency_n benjamin_n eletcher_n esq_n captain_n general_n and_o governor_n in_o chief_a in_o and_o over_o their_o majesty_n province_n of_o new-york_n and_o territory_n thereon_o depend_v in_o america_n a_o act_n for_o of_o suffolk_n forty_o five_o effective_a man_n for_o the_o county_n of_o orange_n two_o effective_a man_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o of_o the_o respective_a military_a officer_n in_o the_o respective_a county_n aforesaid_a shall_v after_o the_o receipt_n of_o the_o warrant_n from_o the_o captain_n general_n in_o manner_n aforesaid_a fail_v neglect_n refuse_v or_o delay_n to_o execute_v the_o say_a warrant_n according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v for_o such_o their_o failure_n or_o neglect_v refusal_n or_o delay_n answer_v the_o same_o before_o the_o captain_n general_n or_o such_o other_o officer_n as_o he_o shall_v appoint_v and_o there_o suffer_v such_o mulet_n pain_n and_o maintain_v two_o man_n be_v their_o quota_fw-la and_o proportion_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a assess_n raise_v &_o pay_v the_o sum_n of_o two_o thousand_o eight_o hundred_o and_o sixty_o pound_n aforesaid_a the_o mayor_n and_o alderman_n in_o the_o city_n of_o new-york_n for_o the_o time_n be_v and_o the_o justice_n of_o the_o peace_n for_o the_o time_n be_v for_o the_o several_a and_o respective_a county_n aforesaid_a for_o the_o several_a county_n respective_o for_o the_o which_o they_o shall_v be_v justice_n of_o the_o peace_n do_v within_o forty_o day_n after_o the_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v upon_o among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a respective_a city_n town_n manor_n or_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_v the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v or_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o before_o mention_v according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n aldermen_z and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n or_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n or_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n &_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o assess_v of_o their_o respective_a manor_n or_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n in_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n or_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o and_o be_v it_o furhe_a enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o and_o true_o equal_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n rendents_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n before_o mention_v assess_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o of_o their_o majesty_n justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v and_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o shall_v make_v fine_a or_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satisfy_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n &_o seal_n of_o any_o of_o the_o justice_n for_o the_o city_n and_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattel_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o article_n and_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a intent_n thereof_o shall_v deny_v refuse_v neglect_n or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o or_o every_o or_o any_o of_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v convict_v before_o his_o excellency_n the_o captain_n general_n and_o council_n or_o before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a or_o imprisonment_n as_o by_o the_o discretion_n of_o the_o say_a governor_n and_o captain_n general_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v
it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o busâ—el_n try_v tallow_n at_o four_o penny_n half_a penny_n per_fw-la pound_n a_o act_n for_o the_o raise_n and_o pay_v of_o eighty_o man_n in_o ulster_n and_o duchess_n county_n to_o be_v employ_v for_o the_o reinforce_a and_o security_n of_o albany_n from_o the_o 15_o day_n of_o december_n next_o to_o the_o first_o of_o march_n than_o next_o ensue_v whereas_o it_o be_v convenient_a that_o expense_n for_o the_o defence_n of_o this_o their_o province_n and_o dominion_n against_o the_o design_n and_o invasion_n of_o the_o common_a enemy_n and_o find_v it_o also_o necessary_a that_o in_o this_o time_n of_o so_o great_a and_o eminent_a danger_n that_o their_o majesty_n government_n over_o this_o province_n shall_v be_v honourable_o support_v and_o maintain_v they_o in_o most_o thankful_a acknowledgement_n of_o their_o majesty_n tender_a care_n of_o the_o welfare_n of_o their_o subject_n in_o this_o province_n have_v cheerful_o and_o unanimous_o for_o the_o purpose_n aforesaid_a give_a and_o grant_v and_o do_v hereby_o give_v and_o grant_v to_o their_o majesty_n the_o several_a rate_n and_o duty_n of_o excise_n herein_o after_o mention_v and_o do_v most_o humble_o same_o nor_o that_o the_o say_a governor_n or_o ruler_n shall_v not_o hold_v their_o respective_a fair_n over_o the_o due_a time_n hereby_o limit_v upon_o pain_n of_o forfeit_v the_o keep_n of_o the_o and_o alderman_n &_o the_o proprietor_n of_o the_o manor_n of_o ranslaerswick_n of_o their_o respective_a city_n and_o manor_n for_o the_o time_n be_v shall_v always_o be_v pursuant_n to_o the_o direction_n of_o their_o respective_a charter_n and_o grant_n the_o only_a ruler_n or_o governor_n of_o the_o aforementioned_a fair_n to_o be_v hold_v in_o their_o respective_a city_n and_o manor_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o way_n notwithstanding_o a_o act_n for_o the_o supervise_v intestates_fw-la estate_n and_o regulate_v the_o probate_n of_o of_o have_v good_a &_o sufficient_a person_n in_o each_o respective_a county_n throughout_o the_o province_n for_o the_o due_a and_o regular_a enquiry_n after_o the_o same_o be_v it_o therefore_o enact_v by_o the_o governor_n and_o council_n and_o representative_n convene_v in_o general_a assembly_n and_o it_o be_v hereby_o enact_v by_o the_o authority_n of_o the_o same_o that_o on_o or_o before_o the_o 25_o day_n of_o march_n next_o in_o the_o year_n of_o our_o lord_n 1693._o there_o shall_v be_v elect_v or_o appoint_v in_o each_o respective_a town_n throughout_o the_o county_n within_o this_o province_n two_o able_a and_o sufficient_a freeholders_n who_o shall_v upon_o the_o death_n of_o any_o person_n or_o person_n in_o their_o respective_a town_n repair_v unto_o the_o house_n place_n or_o habitation_n where_o the_o decease_a do_v reside_v within_o forty_o eight_o hour_n after_o the_o interment_n of_o the_o say_v decease_v and_o there_o make_v enquiry_n if_o the_o decease_a make_v any_o will_n or_o have_v any_o real_a or_o personal_a estate_n not_o devise_v by_o he_o at_o the_o time_n of_o he_o or_o their_o death_n and_o if_o upon_o enquiry_n that_o he_o make_v no_o will_n but_o die_v intestate_a then_o and_o in_o such_o case_n it_o shall_v be_v lawful_a for_o such_o person_n or_o person_n elect_v or_o appoint_v in_o each_o respective_a town_n as_o aforesaid_a to_o make_v strict_a and_o diligent_a search_n and_o enquiry_n into_o all_o the_o real_a and_o personal_a estate_n that_o the_o say_v intestate_a die_v possess_v of_o and_o the_o same_o to_o inventory_n and_o bring_v or_o cause_n to_o be_v bring_v unto_o such_o person_n or_o person_n in_o the_o county_n where_o such_o intestate_a die_v who_o shall_v by_o the_o governor_n for_o the_o time_n be_v be_v delegated_a on_o purpose_n for_o supervise_v intestates_fw-la estate_n etc._n etc._n in_o each_o respective_a county_n throughout_o the_o province_n and_o the_o same_o with_o he_o file_v declare_v upon_o their_o oath_n that_o the_o say_a inventory_n do_v contain_v a_o true_a and_o perfect_a account_n of_o the_o say_v intestates_fw-la estate_n that_o have_v come_v unto_o their_o knowledge_n whereupon_o the_o person_n or_o person_n so_o delegated_a as_o aforesaid_a shall_v issue_v out_o his_o or_o their_o worrant_n to_o two_o good_a and_o sufficient_a freeholders_n inhabit_v within_o the_o town_n where_o the_o intestate_a dye_v for_o the_o appraisment_n of_o the_o good_n &_o chattel_n leave_v by_o the_o intestate_a and_o inventory_v as_o aforesaid_a and_o upon_o the_o return_v thereof_o to_o he_o he_o shall_v cause_v the_o same_o to_o be_v secure_v or_o sell_v for_o the_o most_o of_o their_o value_n and_o the_o produce_v thereof_o to_o remain_v in_o his_o hand_n or_o put_v out_o into_o good_a and_o sufficient_a hand_n who_o shall_v be_v able_a to_o produce_v the_o same_o again_o when_o the_o next_o of_o kin_n shall_v appear_v in_o right_a to_o claim_v the_o same_o and_o if_o the_o say_v intestate_a at_o the_o time_n of_o his_o death_n do_v leave_v a_o wife_n and_o child_n behind_o he_o then_z and_z in_o such_o case_n the_o wife_n shall_v only_o have_v the_o right_n of_o administration_n upon_o the_o say_v intestates_fw-la estate_n as_o the_o law_n do_v direct_v and_o not_o otherwise_o but_o if_o the_o say_v intestate_a do_v leave_v only_a orphan_n behind_o he_o and_o have_v no_o relation_n or_o kindred_n who_o will_v administer_v upon_o the_o say_v intestates_fw-la estate_n than_o the_o superviser_n of_o each_o respective_a county_n delegated_a as_o aforesaid_a shall_v only_o have_v the_o administration_n and_o care_n of_o the_o say_v intestates_fw-la estate_n and_o the_o same_o shall_v secure_v as_o aforesaid_a for_o the_o use_n benefit_n and_o
shall_v be_v justice_n of_o the_o peace_n do_v within_o six_o month_n after_o publication_n hereof_o assemble_v and_o meet_v together_o in_o the_o court_n house_n for_o the_o several_a respective_a city_n and_o county_n or_o such_o other_o place_n or_o place_n as_o they_o shall_v agree_v among_o themselves_o and_o shall_v there_o order_v that_o the_o assessor_n and_o collector_n for_o the_o several_a and_o respective_a city_n town_n manor_n and_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_n of_o the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o rate_n of_o â—ne_a penny_n per_fw-la pound_n as_o aforesaid_a as_o to_o the_o say_a mayor_n and_o aldermâ—n_n and_o justice_n of_o the_o peace_n shall_v seâ—m_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n and_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n and_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n and_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n and_o collector_n for_o the_o assess_v their_o respective_a manor_n and_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n and_o jurisdiction_n as_o shall_v neglect_v and_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a mayor_n alderman_n and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n and_o county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o impartial_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n and_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n and_o collector_n shall_v deny_v neglect_n or_o unequal_o or_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n aforementioned_a asse_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v &_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o make_v fine_a and_o ransom_n to_o their_o majesty_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o ratify_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o justice_n of_o the_o peace_n for_o the_o city_n or_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattle_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorise_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o article_n and_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v deny_v neglect_n refuse_v or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v or_o execute_v and_o shall_v thereof_o be_v convict_v before_o his_o excellency_n the_o governor_n and_o captain_n general_n and_o council_n or_o before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a and_o imprisonment_n as_o by_o the_o direction_n of_o the_o say_a governor_n and_o captain_n general_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o present_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n clause_n or_o thing_n do_v or_o act_v in_o respective_a city_n town_n manor_n and_o liberty_n within_o their_o several_a jurisdiction_n for_o the_o assess_n collect_v and_o receive_v of_o the_o public_a rate_n for_o the_o defray_v the_o public_a and_o necessary_a charge_n of_o each_o respective_a city_n and_o county_n aforesaid_a be_v the_o assessor_n and_o collector_n for_o the_o assess_n collect_v and_o receive_v the_o sum_n or_o sum_n of_o money_n herein_o beforementioned_a according_a to_o the_o proportion_n before_o express_v as_o to_o the_o say_a mayor_n and_o alder-man_n and_o justice_n shall_v seem_v meet_a and_o reasonable_a and_o forasmuch_o as_o there_o be_v several_a manor_n and_o jurisdiction_n within_o the_o respective_a county_n aforesaid_a who_o neglect_n and_o do_v not_o elect_v annual_o or_o once_o every_o year_n assessor_n and_o collector_n whereby_o the_o intent_n of_o this_o act_n may_v be_v frustrate_v be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o respective_a manor_n and_o jurisdiction_n within_o the_o several_a county_n aforesaid_a shall_v refuse_v or_o neglect_v to_o elect_v assessor_n &_o collector_n for_o the_o assess_n of_o their_o respective_a manor_n and_o jurisdiction_n and_o for_o the_o collect_v the_o same_o according_a to_o the_o intent_n and_o direction_n of_o this_o act_n then_o and_o in_o such_o case_n the_o justice_n of_o the_o peace_n of_o the_o county_n where_o such_o manor_n or_o jurisdiction_n be_v be_v hereby_o impower_v and_o authorize_v to_o nominate_v and_o appoint_v assessor_n and_o collector_n for_o such_o manor_n and_o jurisdiction_n as_o shall_v neglect_v or_o refuse_v as_o aforesaid_a which_o assessor_n and_o collector_n shall_v to_o all_o intent_n and_o purpose_n observe_v the_o direction_n of_o this_o act_n any_o thing_n contain_v herein_o to_o the_o contrary_a hereof_o in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o
say_a mayor_n aldermen_z and_o justice_n of_o the_o peace_n for_o the_o respective_a city_n and_o county_n manor_n and_o jurisdiction_n have_v and_o shall_v have_v power_n and_o authority_n by_o virtue_n of_o this_o act_n each_o of_o they_o by_o himself_o to_o administer_v a_o oath_n to_o the_o say_a assessor_n well_o true_o equal_o and_o impartial_o and_o in_o due_a proportion_n as_o it_o shall_v appear_v to_o they_o according_a to_o their_o best_a understanding_n to_o assess_v and_o rate_v the_o inhabitant_n resident_n &_o freeholders_n of_o the_o respective_a place_n for_o which_o they_o shall_v be_v choose_v assessor_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n who_o shall_v be_v choose_v assessor_n or_o collector_n shall_v deny_v neglect_n or_o unequal_o or_o partial_o assess_v or_o refuse_v to_o make_v such_o assessment_n as_o by_o this_o act_n be_v require_v or_o shall_v deny_v neglect_n or_o refuse_v to_o collect_v any_o sum_n or_o sum_n of_o money_n in_o form_n aforementioned_a asse_v that_o then_o and_o in_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o any_o two_o justice_n of_o the_o peace_n of_o the_o city_n and_o county_n where_o such_o offender_n shall_v happen_v to_o dwell_v or_o reside_v &_o who_o by_o virtue_n of_o this_o act_n be_v require_v and_o impower_v to_o do_v the_o same_o by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o assessor_n or_o assessor_n collector_n or_o collector_n so_o deny_v neglect_v or_o unequal_o and_o partial_o assess_v or_o refuse_v to_o collect_v as_o aforesaid_a to_o the_o common_a goal_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o or_o they_o make_v fine_a and_o ransom_n to_o their_o majesty_n for_o such_o contempt_n as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n of_o what_o degree_n or_o quality_n soever_o he_o or_o they_o be_v within_o this_o province_n who_o shall_v be_v assess_v or_o rate_v any_o sum_n or_o sum_n of_o money_n by_o virtue_n of_o this_o act_n to_o be_v raise_v and_o levy_v shall_v deny_v refuse_v or_o delay_n to_o pay_v and_o satify_v the_o same_o that_o then_o it_o shall_v and_o may_v be_v lawful_a for_o any_o such_o collector_n by_o virtue_n of_o a_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o justice_n of_o the_o peace_n for_o the_o city_n or_o county_n where_o such_o offender_n shall_v dwell_v or_o reside_v who_o by_o virtue_n of_o this_o act_n be_v require_v and_o authorize_v to_o grant_v and_o issue_n forth_o such_o warrant_n to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o such_o person_n or_o person_n good_n and_o chattle_n return_v the_o overplus_a if_o any_o be_v to_o the_o owner_n the_o sum_n assess_v and_o charge_n of_o distress_n and_o sale_n be_v first_o deduct_v and_o that_o where_o any_o of_o the_o good_n and_o chattel_n shall_v be_v distrain_v for_o any_o of_o the_o assessment_n and_o rate_n aforesaid_a and_o the_o owner_n of_o the_o say_a good_n shall_v not_o within_o five_o day_n next_o after_o such_o distress_n take_v and_o notice_n thereof_o with_o the_o cause_n of_o such_o take_v leave_v at_o the_o house_n or_o other_o most_o know_a place_n where_o the_o distress_n be_v make_v come_v and_o pay_v to_o the_o collector_n and_o receiver_n of_o the_o assessment_n aforesaid_a that_o then_o after_o such_o distress_n and_o notice_n as_o aforesaid_a and_o expiration_n of_o the_o say_v five_o day_n the_o collector_n or_o person_n distrain_v shall_v and_o may_v cause_v the_o good_n and_o chattel_n so_o distrain_v to_o be_v appraise_v by_o two_o swear_a appraiser_n to_o appraise_v the_o same_o true_o according_a to_o the_o best_a of_o their_o understanding_n and_o after_o such_o appraisement_n shall_v and_o may_v lawful_o carry_v and_o drive_v the_o say_v good_n and_o chattel_n so_o distrain_v into_o any_o county_n or_o town_n throughout_o the_o province_n and_o the_o say_v good_n and_o chattel_n shall_v and_o may_v there_o lawful_o sell_v for_o the_o best_a price_n can_v be_v get_v for_o the_o same_o towards_o satisfaction_n of_o the_o rate_n aforesaid_a and_o of_o the_o charge_n of_o such_o distress_n appraisement_n and_o sale_n give_v the_o overplus_a to_o the_o owner_n and_o also_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o mayor_n alderman_n or_o justice_n of_o the_o peace_n within_o this_o province_n who_o be_v hereby_o require_v impower_v and_o authorize_v to_o take_v effectual_a care_n that_o this_o act_n and_o every_o article_n and_o clause_n therein_o be_v due_o execute_v according_a to_o the_o true_a intent_n and_o meaning_n thereof_o shall_v deny_v neglect_n refuse_v or_o delay_n to_o do_v perform_v fulfil_v and_o execute_v all_o and_o every_o or_o any_o the_o duty_n power_n and_o authority_n by_o this_o act_n require_v and_o impower_v by_o he_o or_o they_o to_o be_v do_v perform_v fullfil_v and_o execute_v and_o shall_v thereof_o be_v convict_v before_o the_o governor_n and_o council_n or_o before_o any_o of_o their_o majesty_n court_n of_o record_n within_o this_o province_n he_o or_o they_o shall_v suffer_v such_o pain_n by_o fine_a and_o imprisonment_n as_o by_o the_o discretion_n of_o the_o say_a governor_n and_o council_n and_o the_o justice_n of_o the_o say_a court_n shall_v be_v adjudge_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o action_n bill_n plaint_n or_o information_n shall_v be_v bring_v move_v or_o prosecute_v at_o any_o time_n hereafter_o against_o any_o person_n or_o person_n for_o any_o matter_n clause_n or_o thing_n do_v or_o act_v in_o pursuance_n or_o execution_n of_o this_o act_n such_o person_n or_o person_n so_o sue_v or_o prosecute_v in_o any_o court_n whatsoever_o shall_v and_o may_v plead_v the_o general_a issue_n not_o guilty_a and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n and_o if_o the_o plaintiff_n or_o prosecutor_n shall_v be_v nonsuited_a or_o forbear_v further_a prosecution_n or_o
