authority_n thereof_o that_o if_o the_o creditor_n refuse_v or_o omit_v to_o demand_v and_o receive_v his_o tobacco_n by_o the_o last_o of_o january_n that_o then_o it_o shall_v be_v lawful_a for_o the_o debtor_n at_o any_o time_n between_o that_o and_o the_o twenty_o of_o february_n to_o address_v himself_o to_o the_o two_o next_o convenient_a justice_n of_o the_o peace_n who_o be_v hereby_o this_o general_a assembly_n and_o by_o the_o authority_n thereof_o that_o the_o several_a fort_n and_o garrison_n be_v dismantle_v and_o the_o force_n officer_n and_o soldier_n therein_o and_o in_o each_o of_o they_o disband_v some_o time_n between_o this_o and_o the_o 30_o day_n of_o this_o instant_a december_n and_o that_o each_o officer_n and_o soldier_n by_o the_o time_n aforesaid_a do_v actual_o deliver_v up_o his_o horse_n arm_n and_o furniture_n to_o the_o respective_a owner_n of_o they_o and_o forasmuch_o as_o it_o may_v be_v dangerous_a and_o of_o evil_a consequence_n to_o leave_v the_o frontier_n of_o the_o country_n and_o head_n of_o the_o aforesaid_a river_n altogether_o ungarded_a it_o be_v hereby_o enact_v that_o twenty_o man_n well_o furnish_v with_o horse_n and_o all_o other_o accoutrement_n be_v raise_v and_o list_v in_o each_o of_o the_o county_n of_o henrico_n new-kent_n rappahannack_n and_o stafford_n stafford_n twenty_o man_n well_o furnish_v with_o horse_n shall_v be_v raise_v in_o each_o county_n viz._n of_o henrico_n new-kent_n reppahanuack_n and_o stafford_n of_o such_o housekeeper_n belong_v to_o the_o say_a county_n as_o shall_v voluntary_o offer_v themselves_o for_o this_o service_n and_o for_o want_v of_o such_o or_o so_o many_o housekeeper_n that_o then_o the_o say_a number_n shall_v be_v make_v up_o of_o such_o freeman_n as_o shall_v willing_o offer_v themselves_o and_o give_v security_n to_o the_o militia-officer_n of_o that_o county_n to_o perform_v all_o service_n and_o other_o thing_n as_o by_o this_o act_n be_v enjoin_v they_o but_o in_o case_n such_o twenty_o man_n qualify_v as_o aforesaid_a shall_v not_o be_v find_v in_o each_o of_o the_o say_a county_n than_o it_o shall_v and_o may_v be_v lawful_a for_o the_o militia-officer_n of_o the_o say_a county_n to_o impress_v such_o and_o so_o many_o man_n furnish_v as_o aforesaid_a as_o shall_v be_v want_v to_o complete_a the_o number_n require_v by_o this_o act_n and_o his_o excellency_n the_o governor_n general_n or_o in_o his_o absence_n the_o right_n honourable_a the_o lieutenant_n or_o deputy_n governor_n be_v hereby_o desire_v to_o make_v choice_n of_o and_o commissionate_a some_o fit_a and_o able_a person_n in_o each_o of_o the_o aforesaid_a county_n who_o be_v a_o housekeeper_n therein_o to_o command_v lead_v train_z conduct_v and_o exercise_v the_o say_v twenty_o soldier_n to_o be_v raise_v in_o the_o say_a county_n of_o which_o he_o shall_v be_v appoint_v and_o commissionated_a by_o his_o excellency_n the_o governor_n general_n the_o lieutenant_n or_o deputy_n governor_n as_o be_v aforesaid_a and_o it_o be_v further_o enact_v that_o the_o chief_a officer_n of_o the_o militia_n in_o each_o of_o the_o say_v respective_a county_n shall_v make_v choice_n of_o the_o most_o able_a and_o fit_a person_n out_o of_o such_o twenty_o man_n as_o to_o they_o shall_v seem_v most_o fit_a and_o convenient_a to_o be_v corporal_n of_o the_o say_a troop_n of_o that_o county_n who_o in_o the_o absence_n of_o the_o captain_n of_o the_o troop_n occasion_v by_o sickness_n or_o otherwise_o be_v to_o lead_v train_n command_n and_o exercise_n the_o say_a troop_n or_o company_n of_o twenty_o man_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o pay_n of_o each_o officer_n and_o soldier_n shall_v be_v as_o follow_v to_o the_o captain_n of_o each_o troop_n find_v himself_o horse_n arm_n ammunition_n and_o provision_n eight_o thousand_o pound_n of_o tobacco_n with_o cask_n out_o of_o the_o public_a levy_n for_o one_o whole_a year_n and_o so_o after_o that_o rate_n for_o a_o short_a or_o long_a time_n annum_fw-la the_o captain_n of_o each_o such_o troop_n consist_v of_o 20_o man_n shall_v have_v 8000_o l._n of_o tobacco_n and_o cask_n per_fw-la annum_fw-la to_o the_o corporal_n of_o each_o troop_n three_o thousand_o pound_n of_o tobacco_n with_o cask_n as_o aforesaid_a for_o one_o whole_a year_n and_o so_o after_o that_o rate_n for_o a_o long_o or_o short_a time_n to_o each_o soldier_n find_v himself_o horse_n arm_n furniture_n provision_n ammunition_n and_o other_o necessary_n as_o aforesaid_a two_o thousand_o pound_n of_o tobacco_n in_o cask_n as_o aforesaid_a and_o so_o after_o that_o rate_n pay_v corporal_n and_o private_a soldier_n pay_v for_o a_o long_o or_o short_a time_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o each_o captain_n or_o in_o his_o absence_n his_o corporal_n shall_v once_o every_o month_n muster_n train_n exercise_n instruct_v and_o discipline_n the_o troop_n or_o soldier_n under_o his_o command_n month._n the_o say_v troop_n shall_v be_v train_v and_o exercise_v once_o a_o month._n on_o pain_n to_o forfeit_v five_o hundred_o pound_n of_o tobacco_n in_o cask_n for_o every_o time_n he_o shall_v neglect_v such_o muster_n or_o exercise_n unless_o occasion_v by_o sickness_n and_o that_o every_o captain_n or_o in_o his_o absence_n occasion_v by_o sickness_n his_o corporal_n shall_v at_o the_o lest_o once_o in_o every_o fourteen_o day_n range_v and_o scout_v serve_v and_o shall_v once_o in_o every_o 14._o day_n range_v &_o scout_n about_o the_o frontier_n of_o the_o county_n for_o which_o they_o serve_v about_o the_o frontier_n of_o the_o county_n for_o which_o they_o serve_v and_o in_o such_o other_o place_n as_o shall_v be_v most_o likely_a for_o the_o discovery_n of_o the_o enemy_n under_o pain_n of_o forfeit_v for_o
if_o after_o the_o proportion_v the_o tythable_n of_o each_o or_o any_o county_n into_o forty_n and_o less_o number_n shall_v remain_v such_o tythable_n shall_v be_v assess_v by_o the_o justice_n proportionable_o to_o the_o rest_n to_o help_v to_o defray_v the_o whole_a charge_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v that_o whensoever_o it_o shall_v happen_v that_o any_o one_o or_o more_o such_o soldier_n or_o soldier_n so_o fit_v out_o as_o aforesaid_a shall_v die_v or_o become_v unable_a or_o unfit_a for_o service_n or_o if_o such_o horse_n send_v to_o such_o service_n as_o aforesaid_a room_n horse_n die_v or_o be_v kill_v or_o disable_v in_o service_n the_o justices_z and_o militia-officer_n may_v impress_v other_o in_o their_o room_n shall_v happen_v to_o die_v be_v kill_v lose_v or_o disable_v for_o service_n or_o if_o any_o arm_n so_o fit_v and_o send_v out_o shall_v be_v lose_v break_a spoil_v or_o become_v unserviceable_a and_o that_o the_o forty_o tythable_n to_o who_o they_o or_o any_o of_o they_o appertain_v shall_v be_v delinquent_a in_o fit_v and_o send_v out_o other_o in_o their_o stead_n that_o then_o in_o such_o case_n the_o respective_a justice_n and_o militia-officer_n shall_v impress_v and_o be_v hereby_o impower_v to_o impress_v other_o in_o their_o room_n but_o if_o such_o horse_n shall_v die_v or_o be_v kill_v in_o the_o country_n service_n and_o good_a certificate_n be_v make_v thereof_o by_o the_o commander_n in_o chief_a of_o the_o garrison_n to_o which_o he_o belong_v to_o the_o assembly_n or_o that_o such_o arm_n as_o be_v lose_v and_o break_v be_v lose_v &_o break_v in_o the_o service_n &_o not_o by_o neglect_n or_o fault_n of_o the_o soldier_n to_o who_o they_o belong_v and_o then_o such_o horse_n or_o arm_n shall_v be_v pay_v for_o by_o the_o public_a according_a to_o the_o certificate_n of_o the_o chief_a commander_n but_o in_o case_n any_o soldier_n shall_v wilful_o or_o careless_o spoil_v his_o horse_n or_o kill_v or_o lose_v he_o or_o spoil_v lose_v or_o imbezil_v his_o arm_n in_o such_o case_n such_o soldier_n shall_v be_v liable_a buy_v or_o impress_v by_o the_o commander_n in_o chief_a of_o each_o garrison_n to_o the_o value_n of_o five_o pound_n sterling_a ot_fw-mi thereabouts_o not_o exceed_v the_o say_a sum_n for_o the_o use_n of_o the_o garrison_n and_o the_o payment_n thereof_o such_o captain_n draw_v a_o note_n upon_o the_o next_o collector_n of_o two_o shilling_n per_fw-la hogshead_n to_o be_v by_o he_o pay_v that_o a_o corporal_n pay_v and_o a_o trumpeter_n pay_v be_v fifty_o pound_n of_o tobacco_n per_fw-la month_n over_o and_o above_o a_o private_a soldier_n pay_v which_o overplus_n pay_v of_o fifty_o per_fw-la month_n together_o with_o other_o officer_n pay_v before_o mention_v shall_v be_v pay_v and_o defray_v by_o the_o public_a and_o whereas_o divers_a county_n who_o be_v to_o send_v provision_n etc._n etc._n to_o the_o respective_a garrison_n lie_v far_o remote_a from_o the_o say_a garrison_n it_o be_v hereby_o enact_v that_o the_o justice_n and_o militia-officer_n of_o such_o county_n take_v care_n to_o send_v up_o their_o provision_n and_o ammunition_n with_o the_o best_a convenience_n and_o great_a security_n which_o charge_n shall_v be_v pay_v for_o and_o defray_v by_o
