receive_v and_o disburse_v for_o the_o immediate_a use_n and_o relief_n of_o the_o poor_a in_o the_o say_a hospital_n provide_v that_o no_o tenant_n that_o hold_v or_o enjoy_v any_o land_n or_o house_n by_o lease_n land_n tenant_n to_o be_v assess_v for_o the_o over_o value_n of_o their_o land_n or_o any_o other_o grant_v from_o any_o of_o the_o say_a hospital_n do_v claim_n and_o enjoy_v any_o freedom_n exemption_n or_o advantage_n by_o this_o act_n but_o that_o all_o the_o house_n and_o land_n which_o they_o so_o hold_v shall_v be_v rate_v and_o assess_v for_o so_o much_o as_o they_o be_v yearly_a worth_n over_o and_o above_o the_o rent_n reserve_v and_o payable_a to_o the_o say_a hospital_n provide_v also_o london_n london_n that_o where_o any_o person_n inhabit_v within_o the_o city_n of_o london_n have_v his_o dwell_a house_n in_o one_o of_o the_o parish_n or_o ward_n therein_o and_o have_v any_o good_n ware_n or_o merchandise_n in_o one_o or_o more_o of_o the_o other_o parish_n or_o ward_n within_o the_o same_o that_o then_o such_o person_n shall_v be_v charge_v tax_v and_o assess_v for_o such_o his_o good_n or_o merchandise_n in_o the_o parish_n or_o ward_n where_o he_o dwell_v and_o not_o elsewhere_o in_o the_o say_a city_n provide_v nevertheless_o that_o no_o clause_n or_o proviso_n in_o this_o act_n shall_v extend_v to_o the_o lessen_v or_o abatement_n of_o the_o full_a sum_n by_o this_o act_n appoint_v to_o be_v tax_v levy_v and_o pay_v act._n there_o shall_v be_v no_o abatement_n of_o the_o full_a sum_n in_o this_o act._n but_o that_o the_o same_o be_v full_o assess_v tax_v levy_v collect_v and_o pay_v in_o the_o several_a and_o respective_a county_n city_n and_o town_n aforesaid_a in_o such_o manner_n and_o form_n and_o to_o such_o use_n as_o herein_o before_o mention_v and_o declare_v and_o that_o the_o several_a and_o respective_a commissioner_n treasurer_n the_o commissioner_n to_o give_v account_n to_o the_o lord_n treasurer_n and_o every_o of_o they_o shall_v from_o time_n to_o time_n give_v a_o true_a and_o perfect_a account_n of_o all_o their_o do_n and_o proceed_n in_o the_o execution_n of_o this_o act_n to_o the_o say_a lord_n treasurer_n or_o to_o other_o such_o person_n as_o his_o majesty_n shall_v appoint_v provide_v always_o and_o be_v it_o hereby_o enact_v and_o declare_v pound-rate_n assess_v by_o a_o county_n city_n and_o burrough_n town_n and_o place_n mention_v in_o this_o act_n according_a to_o the_o most_o just_a and_o usual_a way_n of_o rate_n hold_v and_o practise_v in_o such_o county_n city_n burrough_n town_n and_o place_n respective_o any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o contain_v in_o any_o wise_n notwithstanding_o provide_v always_o that_o nothing_o in_o this_o act_n contain_v shall_v be_v construe_v to_o alter_v change_n determine_v tenant_n contract_n and_o covenant_n between_o landlord_n and_o tenant_n or_o make_v void_a any_o contract_n covenant_n or_o agréement_n whatsoever_o between_o the_o landlord_n and_o tenant_n touch_v the_o payment_n of_o tax_n or_o assessment_n any_o thing_n herein_o before_o mention_v to_o the_o contrary_a notwithstanding_o provide_v always_o and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a former_o all_o place_n and_o division_n to_o be_v rate_v as_o former_o that_o the_o payment_n of_o the_o whole_a sum_n due_a for_o their_o hundred_o or_o division_n respective_o at_o each_o time_n of_o payment_n aforesaid_a several_a acquittance_n under_o their_o hand_n and_o seal_n without_o take_v any_o thing_n for_o the_o same_o which_o say_v acquittance_n of_o the_o head-collectors_a shall_v be_v a_o full_a and_o perfect_a discharge_n to_o the_o subcollector_n and_o the_o say_a acquittance_n of_o the_o receiver-general_n shall_v be_v a_o sufficient_a discharge_n to_o the_o head-collectors_a and_o
their_o duty_n in_o execution_n of_o this_o act._n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n shall_v wilful_o neglect_v or_o refuse_v to_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_v respective_a commissioner_n or_o any_o three_o or_o more_o of_o they_o have_v hereby_o power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v their_o duty_n such_o fine_a or_o fine_n as_o to_o they_o shall_v be_v think_v fit_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o and_o their_o good_n provide_v that_o no_o fine_a to_o be_v impose_v by_o any_o of_o the_o say_a commissioner_n shall_v for_o any_o one_o offence_n exceed_v the_o sum_n of_o twenty_o pound_n and_o that_o all_o fine_n that_o shall_v be_v impose_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o respective_a receivers-general_n and_o by_o they_o to_o the_o receipt_n of_o his_o majesty_n exchequer_n same_o collector_n and_o subcollector_n receive_v money_n and_o not_o pay_v the_o same_o and_o it_o be_v further_o enact_v and_o declare_v that_o if_o any_o collector_n or_o sub-collector_n that_o shall_v by_o virtue_n of_o this_o act_n be_v appoint_v for_o the_o receipt_n of_o any_o sum_n or_o sum_n of_o money_n thereby_o to_o be_v assess_v shall_v neglect_v or_o refuse_v to_o pay_v any_o sum_n or_o sum_n of_o money_n which_o shall_v by_o he_o be_v receive_v as_o aforesaid_a and_o not_o pay_v the_o same_o as_o in_o and_o by_o this_o act_n be_v direct_v and_o shall_v detain_v in_o his_o or_o their_o hand_n any_o money_n receive_v by_o they_o or_o any_o of_o they_o and_o not_o pay_v the_o same_o as_o by_o this_o act_n be_v direct_v the_o commissioner_n of_o each_o county_n city_n or_o town_n respective_o or_o any_o two_o or_o more_o of_o they_o in_o their_o respective_a division_n be_v hereby_o authorize_v and_o empower_v to_o imprison_v the_o person_n and_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o collector_n or_o sub-collector_n to_o they_o respective_o belong_v or_o which_o shall_v descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o their_o heir_n executor_n or_o administrator_n several_a and_o respective_a commissioner_n or_o any_o two_o of_o they_o within_o their_o division_n and_o hundred_o shall_v and_o be_v hereby_o require_v to_o call_v before_o they_o the_o chief_a collector_n and_o subcollector_n within_o each_o respective_a division_n and_o hundred_o to_o examine_v and_o assure_v themselves_o of_o the_o full_a and_o whole_a payment_n of_o the_o particular_a sum_n and_o sum_n of_o money_n charge_v upon_o the_o say_a division_n hundred_o and_o every_o parish_n and_o place_n therein_o and_o of_o the_o due_a return_n of_o the_o same_o into_o the_o hand_n of_o the_o receivers-general_n of_o the_o say_a county_n city_n town_n and_o place_n respective_o and_o by_o such_o receiver-general_n to_o the_o receipt_n of_o his_o majesty_n exchequer_n to_o the_o be_v hereby_o to_o cause_v the_o same_o to_o be_v forthwith_o levy_v and_o pay_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n vote_n commissioner_n concern_v in_o any_o controversy_n to_o withdraw_v and_o not_o vote_n and_o it_o be_v hereby_o enact_v and_o declare_v that_o in_o case_n any_o controversy_n arise_v concern_v the_o say_a assessment_n or_o the_o divide_n apportion_v or_o payment_n thereof_o which_o concern_v any_o of_o the_o commissioner_n by_o this_o act_n appoint_v that_o the_o commissioner_n so_o concern_v in_o the_o say_a controversy_n shall_v have_v no_o voice_n but_o shall_v withdraw_v at_o the_o time_n of_o the_o debate_n of_o any_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n rent_n no_o exemption_n of_o any_o privilege_a place_n or_o person_n fee-farm_n rent_n and_o be_v it_o hereby_o enact_v and_o declare_v that_o no_o privilege_a place_n or_o person_n body_n politic_a or_o corporate_a within_o the_o county_n city_n and_o town_n aforesaid_a shall_v be_v exempt_v from_o the_o say_a assessment_n and_o tax_n and_o that_o they_o and_o every_o of_o they_o and_o also_o all_o fée-farm_n rent_n and_o all_o other_o manner_n of_o rent_n payment_n sum_n of_o money_n and_o annuity_n issue_v out_o of_o any_o land_n within_o city_n or_o county_n shall_v be_v liable_a towards_o the_o payment_n of_o every_o sum_n by_o this_o act_n to_o be_v tax_v and_o levy_v and_o all_o the_o tenant_n of_o every_o fée-farm_n rent_n other_o rent_n sum_n of_o money_n or_o annuity_n aforesaid_a be_v hereby_o direct_v and_o authorise_v to_o pay_v they_o proportionable_o according_a to_o the_o rate_n and_o assessment_n by_o this_o act_n appoint_v and_o direct_v and_o all_o such_o tenant_n shall_v be_v hereby_o save_v and_o keep_v harmless_a by_o authority_n of_o this_o act_n from_o any_o further_a payment_n of_o such_o portion_n of_o any_o such_o rent_n rent_n sum_n or_o annuity_n justice_n of_o peace_n in_o their_o quarter-session_n of_o the_o say_a city_n of_o westminster_n and_o the_o liberty_n thereof_o or_o the_o justice_n of_o the_o respective_a county_n of_o middlesex_n ascertain_v such_o competent_a sum_n and_o sum_n of_o money_n for_o the_o purpose_n aforesaid_a not_o exceed_a one_o year_n rate_v from_o time_n to_o time_n usual_o set_v upon_o any_o person_n for_o or_o towards_o the_o relief_n of_o the_o poor_a and_o the_o same_o to_o proportion_n out_o upon_o the_o several_a ward_n precinct_n counties_n division_n hundred_o and_o parish_n as_o they_o shall_v think_v fit_a and_o thereupon_o the_o alderman_n deputy_n and_o common-council-man_n of_o every_o ward_n in_o the_o city_n of_o london_n and_o burgess_n and_o justice_n of_o the_o peace_n of_o the_o city_n of_o westminster_n and_o the_o liberty_n thereof_o and_o justice_n of_o the_o peace_n of_o the_o say_a county_n of_o middlesex_n and_o surrey_n shall_v have_v power_n and_o authority_n and_o be_v hereby_o require_v equal_o and_o indifferent_o according_a to_o the_o proportion_n appoint_v as_o aforesaid_a for_o the_o several_a ward_n precinct_n city_n and_o parish_n as_o aforesaid_a to_o tax_v and_o rate_v the_o several_a inhabitant_n within_o the_o say_v respective_a ward_n precinct_n and_o parish_n as_o well_o within_o liberty_n as_o without_o with_o which_o tax_n if_o any_o person_n or_o person_n find_v he_o or_o themselves_o aggrieve_v suppose_v the_o same_o to_o be_v unequal_a he_o or_o they_o shall_v and_o may_v make_v their_o complaint_n know_v to_o the_o justice_n of_o the_o peace_n at_o the_o next_o open_a session_n who_o shall_v take_v such_o final_a order_n therein_o as_o in_o like_a case_n be_v already_o by_o the_o law_n provide_v and_o it_o be_v further_o enact_v by_o the_o authority_n aforesaid_a that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o any_o alderman_n of_o the_o city_n of_o london_n or_o his_o deputy_n or_o the_o burgess_n and_o justice_n of_o peace_n of_o the_o city_n of_o westminster_n and_o the_o liberty_n thereof_o or_o any_o two_o or_o more_o of_o they_o or_o any_o two_o justice_n of_o peace_n of_o the_o respective_a county_n of_o middlesex_n and_o surrey_n by_o their_o warrant_n under_o their_o hand_n and_o seal_n to_o authorise_v the_o churchwarden_n or_o overséer_v for_o the_o poor_a within_o the_o place_n and_o parish_n aforesaid_a to_o demand_v gather_v and_o receive_v of_o every_o person_n and_o person_n such_o sum_n and_o sum_n of_o money_n as_o shall_v be_v assess_v upon_o they_o by_o virtue_n of_o the_o taxation_n and_o contribution_n aforesaid_a and_o for_o default_n of_o payment_n within_o ten_o day_n after_o demand_v thereof_o make_v or_o notice_n in_o write_v leave_v at_o the_o dwellinghouse_n or_o lodging_n of_o every_o person_n so_o assess_v to_o levy_v the_o same_o by_o distress_n and_o sale_n of_o the_o good_n of_o every_o such_o person_n and_o after_o satisfaction_n make_v to_o restore_v the_o surplusage_n to_o the_o party_n so_o distrain_v pay_v stock_n former_o in_o london_n for_o relief_n of_o the_o poor_a how_o to_o be_v pay_v and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o all_o stock_n raise_v for_o the_o relief_n and_o employment_n of_o the_o poor_a in_o the_o city_n of_o london_n and_o liberties_n thereof_o which_o be_v in_o the_o hand_n of_o a_o corporation_n heretofore_o appoint_v in_o the_o say_a city_n for_o that_o service_n or_o in_o the_o hand_n of_o any_o other_o person_n or_o person_n whatsoever_o before_o the_o nine_o and_o twenty_o day_n of_o september_n which_o be_v in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o and_o sixty_o common_o call_v the_o feast_n of_o st._n michael_n the_o archangel_n or_o at_o any_o time_n since_o together_o with_o all_o the_o arrear_n of_o money_n former_o allot_v for_o that_o service_n or_o legacy_n give_v to_o the_o same_o end_n shall_v be_v payable_a to_o the_o treasurer_n of_o the_o corporation_n or_o corporation_n

always_o that_o if_o any_o person_n have_v several_a mansion-house_n or_o place_n of_o residence_n certificate_n person_n double_o charge_v may_v be_v discharge_v upon_o certificate_n shall_v be_v double_o charge_v by_o virtue_n of_o this_o act_n that_o upon_o certificate_n make_v by_o two_o or_o more_o of_o the_o commissioner_n for_o the_o county_n city_n or_o place_n which_o certificate_n the_o say_a commissioner_n be_v require_v to_o give_v without_o delay_n fee_n or_o reward_n of_o his_o or_o their_o last_o personal_a residence_n under_o their_o hand_n and_o seal_n of_o the_o sum_n or_o sum_n there_o charge_v upon_o he_o or_o they_o and_o in_o what_o capacity_n or_o respect_n he_o or_o they_o be_v so_o charge_v and_o upon_o oath_n make_v of_o such_o certificate_n before_o the_o commissioner_n to_o who_o such_o certificate_n shall_v be_v tender_v which_o oath_n the_o say_a commissioner_n be_v hereby_o authorize_v to_o administer_v then_o the_o person_n and_o person_n so_o county_n where_o such_o person_n dwell_v or_o be_v resident_a at_o any_o time_n within_o six_o month_n next_o ensue_v after_o such_o tax_n make_v every_o person_n that_o shall_v so_o escape_v from_o the_o say_a taxation_n and_o payment_n shall_v be_v charge_v penalty_n penalty_n upon_o proof_n thereof_o at_o the_o double_a value_n of_o so_o much_o as_o he_o shall_v or_o ought_v to_o have_v be_v shall_v be_v within_o any_o county_n or_o place_n within_o their_o respective_a limit_n or_o the_o major_a part_n of_o they_o another_o commissioner_n to_o tax_v one_o another_o shall_v tax_n and_o assess_v every_o other_o commissioner_n join_v with_o they_o and_o the_o commissioner_n within_o their_o division_n shall_v assess_v every_o assessor_n within_o their_o division_n and_o as_o well_o all_o sum_n upon_o every_o the_o say_a commissioner_n and_o assessor_n as_o the_o assessment_n make_v and_o present_v by_o the_o presenter_n as_o aforesaid_a shall_v be_v write_v estreat_v levy_v and_o gather_v as_o it_o shall_v and_o ought_v to_o have_v be_v as_o if_o the_o say_a commissioner_n have_v not_o be_v name_v commissioner_n provide_v always_o and_o it_o be_v hereby_o declare_v decry_v decry_v that_o the_o several_a rate_n and_o tax_n to_o which_o the_o lord_n and_o péer_v of_o this_o realm_n shall_v be_v liable_a by_o virtue_n of_o this_o act_n shall_v be_v receive_v by_o a_o collector_n to_o be_v nominate_v by_o the_o péer_v which_o say_v collector_n shall_v cause_v the_o same_o to_o be_v pay_v into_o his_o majesty_n receipt_n of_o exchequer_n at_o westminster_n upon_o or_o before_o the_o aforesaid_a thirty_o day_n of_o april_n provide_v that_o this_o act_n shall_v not_o extend_v to_o the_o inhabitant_n of_o scotland_n ireland_n guernsey_n scotland_n ireland_n jersey_n guernsey_n jersey_n or_o guernsey_n for_o or_o concern_v any_o such_o personal_a estate_n as_o aforesaid_a which_o they_o or_o any_o other_o to_o their_o use_n have_v within_o the_o place_n aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o respective_a treasurer_n of_o his_o majesty_n navy_n and_o ordnance_n be_v hereby_o authorize_v and_o require_v to_o take_v and_o retain_v unto_o themselves_o navy_n allowance_n to_o the_o treasurer_n of_o the_o navy_n and_o such_o as_o shall_v be_v respective_o employ_v by_o and_o under_o they_o one_o penny_n in_o the_o pound_n and_o no_o more_o out_o of_o the_o money_n raise_v by_o virtue_n of_o this_o act_n and_o pay_v unto_o and_o issue_v out_o by_o they_o to_o any_o person_n or_o person_n in_o pursuance_n thereof_o to_o be_v allow_v unto_o they_o in_o their_o respective_a account_n and_o be_v it_o further_o enact_v that_o if_o any_o assessor_n collector_n receiver_n or_o other_o person_n appoint_v by_o the_o commissioner_n shall_v wilful_o neglect_v or_o refuse_v to_o perform_v his_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_v respective_a commissioner_n duty_n assessor_n collector_n or_o receiver_n neglect_v their_o duty_n or_o any_o three_o or_o more_o of_o they_o may_v and_o shall_v by_o virtue_n of_o this_o act_n impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v their_o duty_n any_o fine_a not_o exceed_a the_o sum_n of_o twenty_o pound_n for_o any_o one_o offence_n the_o same_o to_o be_v levy_v and_o certify_v as_o aforesaid_a into_o his_o majesty_n court_n of_o exchequer_n penalty_n penalty_n and_o charge_v upon_o the_o respective_a receiver-general_a among_o the_o rest_n of_o the_o rate_n aforesaid_a and_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o may_v or_o shall_v from_o time_n to_o time_n call_v for_o and_o require_v a_o account_n from_o the_o respective_a receiver-general_a of_o all_o the_o money_n receive_v by_o he_o of_o the_o say_v head-collectors_a and_o of_o the_o payment_n thereof_o into_o his_o majesty_n receipt_n of_o exchequer_n according_a to_o the_o direction_n of_o this_o act_n and_o in_o case_n of_o any_o failer_z in_o the_o premise_n the_o say_v commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v hereby_o require_v to_o cause_v the_o same_o to_o be_v forthwith_o levy_v and_o pay_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n and_o in_o case_n of_o any_o controversy_n arise_v between_o the_o say_a commissioner_n concern_v the_o say_a rate_n or_o assessment_n the_o commissioner_n that_o shall_v be_v concern_v therein_o shall_v have_v no_o voice_n but_o shall_v withdraw_v during_o the_o debate_n of_o such_o controversy_n until_o it_o be_v determine_v by_o the_o rest_n of_o the_o commissioner_n and_o all_o question_n and_o difference_n that_o shall_v arise_v touch_v any_o of_o the_o say_a rate_n tax_n assessment_n or_o levy_n shall_v be_v hear_v and_o final_o determine_v by_o two_o or_o more_o of_o the_o commissioner_n upon_o complaint_n thereof_o to_o they_o make_v by_o any_o person_n or_o person_n thereby_o grieve_v without_o further_a trouble_n or_o suit_n in_o law_n determine_v controversy_n and_o question_n about_o the_o rate_n how_o to_o be_v determine_v and_o the_o say_v receiver-general_a shall_v give_v acquittance_n gratis_o to_o the_o say_v head-collectors_a for_o all_o money_n of_o they_o receive_v and_o the_o say_v head-collectors_a shall_v also_o give_v acquittance_n gratis_o to_o the_o subcollector_n for_o all_o such_o
shall_v or_o may_v repair_v to_o view_v the_o same_o and_o thereout_o to_o take_v copy_n of_o all_o such_o judgement_n and_o determination_n as_o shall_v relate_v to_o he_o her_z and_o they_o and_o that_o none_o of_o the_o say_a justice_n and_o baron_n shall_v take_v any_o fee_n or_o reward_v whatsoever_o direct_o or_o indirect_o for_o any_o thing_n to_o be_v do_v by_o they_o by_o virtue_n or_o colour_n of_o this_o present_a act._n officer_n officer_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o for_o a_o reward_n of_o the_o officer_n to_o be_v employ_v herein_o fe_n a_o table_n of_o fe_n the_o say_a justice_n and_o baron_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a be_v hereby_o enable_v to_o order_n and_o direct_v a_o table_n of_o such_o reasonable_a fee_n to_o be_v make_v as_o may_v carry_v on_o and_o effect_v the_o purport_n and_o intent_n of_o this_o act._n this_o act_n to_o continue_v till_o the_o last_o day_n of_o december_n which_o shall_v be_v in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o eight_o act._n the_o continuance_n of_o this_o act._n and_o no_o long_o decree_n proviso_n touch_v the_o renew_n and_o reverse_v order_n or_o decree_n provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o where_o any_o such_o order_n or_o decree_n as_o aforesaid_a shall_v be_v make_v by_o a_o lesser_a number_n of_o justice_n and_o baron_n then_o seven_o it_o shall_v be_v lawful_a for_o any_o person_n aggrieve_v by_o such_o order_n or_o decree_n to_o present_v his_o exception_n to_o the_o same_o in_o writing_n within_o seven_o day_n next_o after_o such_o order_n or_o decree_n make_v to_o the_o chief_a justice_n and_o chief_a baron_n for_o the_o time_n be_v or_o any_o two_o of_o they_o who_o shall_v forthwith_o communicate_v the_o same_o to_o the_o rest_n of_o the_o say_a justice_n and_o baron_n who_o be_v hereby_o require_v to_o hear_v the_o party_n and_o examine_v and_o consider_v the_o say_v exception_n and_o if_o any_o seven_o or_o more_o of_o they_o shall_v subscribe_v thereunto_o that_o they_o find_v probable_a cause_n of_o deliver_v to_o review_v the_o say_v former_a order_n or_o decree_n and_o thereupon_o to_o reverse_v confirm_v enlarge_v diminish_v or_o otherwise_o alter_v any_o such_o order_n or_o decree_n as_o in_o their_o wisdom_n they_o shall_v think_v fit_a any_o thing_n herein_o contain_v notwithstanding_o cap._n iii_o for_o rebuilding_n the_o city_n of_o london_n forasmuch_o as_o the_o city_n of_o london_n be_v the_o imperial_a seat_n of_o his_o majesty_n kingdom_n and_o renown_v for_o trade_n and_o commerce_n throughout_o the_o world_n by_o reason_n of_o a_o most_o dreadful_a fire_n late_o happen_v therein_o be_v for_o the_o most_o part_n thereof_o burn_v down_o and_o destroy_v within_o the_o compass_n of_o a_o few_o day_n and_o now_o lie_v bury_v in_o its_o own_o ruin_n for_o the_o speedy_a restauration_n whereof_o and_o for_o the_o better_a regulation_n uniformity_n and_o gracefulness_n of_o such_o new_a building_n as_o shall_v be_v erect_v for_o habitation_n in_o order_n thereunto_o and_o to_o the_o end_n that_o great_a and_o outrageous_a fire_n through_o the_o blessing_n of_o almighty_a god_n so_o far_o forth_o as_o humane_a providence_n with_o submission_n to_o the_o divine_a pleasure_n can_v foresee_v may_v be_v reasonable_o prevent_v or_o obviate_v for_o the_o time_n to_o come_v both_o by_o the_o matter_n and_o form_n of_o such_o building_n and_o further_o to_o the_o intent_n that_o all_o encouragement_n and_o expedition_n may_v be_v give_v unto_o and_o all_o impediment_n and_o obstruction_n that_o may_v retard_v or_o protract_v the_o undertake_n or_o carry_v on_o a_o work_n so_o necessary_a and_o of_o so_o great_a honour_n and_o importance_n to_o his_o majesty_n and_o this_o kingdom_n and_o to_o the_o rest_n of_o his_o majesty_n kingdom_n and_o dominion_n may_v be_v remove_v be_v it_o therefore_o enact_v by_o the_o king_n most_o excellent_a majesty_n by_o and_o with_o the_o advice_n and_o consent_n of_o the_o lord_n spiritual_a and_o temporal_a and_o commons_o in_o this_o present_a parliament_n assemble_v and_o by_o the_o authority_n of_o the_o same_o that_o the_o rule_n and_o direction_n hereafter_o in_o this_o act_n prescribe_v be_v due_o observe_v by_o all_o person_n therein_o concern_v and_o first_o that_o no_o building_n or_o house_n for_o habitation_n whatsoever_o building_n rule_n and_o direction_n to_o be_v observe_v in_o building_n be_v hereafter_o erect_v within_o the_o limit_n of_o the_o say_a city_n and_o liberty_n thereof_o but_o such_o as_o shall_v be_v pursuant_n to_o such_o rule_n and_o order_n of_o building_n and_o with_o such_o material_n as_o be_v herein_o after_o particular_o appoint_v and_o according_a to_o such_o scantlings_n as_o be_v set_v down_o and_o prescribe_v in_o a_o table_n in_o this_o present_a act_n hereafter_o specify_v and_o if_o any_o person_n or_o person_n shall_v presume_v to_o build_v contrary_a thereunto_o and_o be_v convict_v of_o the_o same_o by_o the_o oath_n of_o two_o or_o more_o credible_a witness_n to_o be_v take_v before_o the_o lord_n mayor_n for_o the_o time_n be_v or_o any_o two_o or_o more_o of_o the_o justice_n of_o the_o peace_n for_o the_o say_a city_n penalty_n penalty_n who_o be_v hereby_o empower_v to_o administer_v the_o same_o oath_n that_o then_o and_o in_o such_o case_n the_o say_a house_n so_o irregular_o build_v as_o aforesaid_a shall_v be_v deem_v as_o a_o common_a nuisance_n and_o the_o builder_n and_o levier_n thereof_o shall_v enter_v into_o a_o recognizance_n in_o such_o sum_n as_o the_o say_a mayor_n and_o justice_n respective_o in_o their_o discretion_n shall_v appoint_v for_o abatement_n and_o demolish_n the_o same_o in_o convenient_a time_n or_o otherwise_o to_o amend_v the_o same_o according_a to_o such_o rule_n and_o order_n as_o aforesaid_a and_o in_o default_n of_o enter_v into_o such_o recognizance_n the_o offender_n shall_v be_v commit_v to_o the_o common_a gaol_n of_o the_o say_a city_n there_o to_o remain_v without_o bail_n or_o mainprize_n till_o he_o shall_v have_v abate_v or_o demolish_v or_o otherwise_o amend_v the_o same_o or_o else_o such_o irregular_a house_n shall_v or_o may_v be_v demolish_v or_o abate_v by_o order_n of_o the_o court_n of_o alderman_n and_o that_o the_o say_v irregular_a building_n may_v be_v the_o better_o prevent_v or_o more_o effectual_o discover_v building_n prevention_n of_o irregular_a building_n be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o lord_n mayor_n aldermen_z and_o common-council_n of_o the_o say_a city_n shall_v and_o may_v at_o their_o will_n and_o pleasure_n elect_v nominate_v and_o appoint_v one_o or_o more_o discreet_a and_o intelligent_a person_n or_o person_n in_o the_o art_n of_o building_n to_o be_v the_o surveyor_n or_o supervisor_n to_o see_v the_o say_v rule_n and_o scantlings_n well_o and_o true_o observe_v and_o that_o it_o shall_v be_v lawful_a for_o the_o say_a mayor_n aldermen_z and_o common_a council_n or_o for_o the_o mayor_n and_o alderman_n in_o their_o court_n of_o alderman_n to_o administer_v to_o all_o the_o say_a surveyor_n or_o supervisor_n a_o oath_n upon_o the_o holy_a evangelist_n for_o the_o true_a and_o impartial_a execution_n of_o their_o office_n in_o that_o behalf_n and_o to_o appoint_v the_o several_a precinct_n which_o shall_v be_v under_o their_o several_a survey_v and_o to_o the_o end_n that_o all_o builder_n may_v the_o better_a know_v how_o to_o provide_v and_o fit_v their_o material_n for_o their_o several_a building_n be_v it_o enact_v that_o there_o shall_v be_v only_o four_o sort_n of_o building_n only_o there_o shall_v be_v four_o sort_n of_o building_n only_o and_o no_o more_o and_o that_o all_o manner_n of_o house_n so_o to_o be_v erect_v shall_v be_v of_o one_o of_o those_o four_o sort_n of_o building_n and_o no_o other_o that_o be_v to_o say_v the_o first_o and_o least_o sort_n of_o house_n front_v by-lane_n the_o second_o sort_n of_o house_n front_v street_n and_o lane_n of_o note_n the_o three_o sort_n of_o house_n front_v high_a and_o principal_a street_n the_o four_o and_o large_a sort_n of_o mansion-house_n for_o citizen_n or_o other_o person_n of_o extraordinary_a quality_n not_o front_v either_o of_o the_o three_o former_a way_n and_o the_o roof_n of_o each_o of_o the_o first_o three_o sort_n of_o house_n respective_o shall_v be_v vniform_a and_o for_o avoid_v any_o uncertainty_n to_o the_o builder_n or_o other_o herein_o be_v it_o further_o enact_v etc._n power_n of_o the_o lord_n mayor_z aldermen_z and_o common_a council_n to_o declare_v street_n
wall_n or_o before_o any_o nobleman_n house_n building_n or_o wall_n or_o before_o any_o other_o public_a house_n building_n or_o place_n whatsoever_o respective_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o from_o and_o after_o the_o first_o day_n of_o may_n weekly_o no_o barrel_n timber_n coach_n or_o other_o thing_n to_o be_v see_v or_o mend_v in_o the_o street_n the_o penalty_n the_o duty_n of_o the_o scavenger_n &_o raker_n weekly_o one_o thousand_o six_o hundred_o sixty_o and_o two_o no_o person_n or_o person_n shall_v hoop_n wash_n or_o cleanse_v any_o pipe_n barrel_n or_o other_o cask_n or_o vessel_n in_o any_o the_o street_n lane_n or_o open_a passage_n aforesaid_a nor_o shall_v set_v out_o empty_a coach_n to_o make_v or_o mend_v or_o rough_a timber_n or_o stone_n to_o be_v saw_v or_o wrought_v in_o the_o street_n on_o the_o penalty_n of_o twenty_o shilling_n for_o every_o offence_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o raker_n scavenger_n or_o other_o officer_n thereunto_o appoint_v every_o day_n in_o the_o wéek_v except_a sunday_n and_o other_o holiday_n shall_v bring_v or_o cause_n to_o be_v bring_v cart_n dung-pot_n or_o other_o fit_a carriage_n into_o all_o street_n and_o place_n within_o their_o respective_a ward_n parish_n charge_n and_o division_n where_o such_o cart_n or_o carriage_n can_v pass_v and_o at_o or_o before_o their_o approach_n by_o a_o bell_n horn_n clapper_n or_o otherwise_o shall_v make_v distinct_a and_o loud_a noise_n and_o give_v notice_n to_o the_o inhabitant_n of_o their_o come_n and_o make_v the_o like_a noise_n and_o give_v the_o like_a notice_n in_o every_o court_n alley_n or_o place_n into_o which_o the_o say_a cart_n can_v pass_v and_o abide_v and_o stay_v there_o a_o convenient_a time_n in_o such_o sort_n that_o all_o person_n concern_v may_v bring_v forth_o their_o respective_a ash_n dust_n dirt_n filth_n and_o soil_v to_o the_o respective_a cart_n or_o carriage_n so_o stay_v as_o aforesaid_a all_o which_o the_o say_a raker_n scavenger_n or_o other_o officer_n aforesaid_a shall_v daily_o carry_v or_o cause_n to_o be_v carry_v away_o upon_o pain_n to_o forfeit_v forty_o shilling_n for_o every_o offence_n or_o neglect_n respective_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o the_o open_a street_n householder_n all_o open_a street_n to_o be_v pave_v and_o so_o keep_v by_o the_o several_a householder_n lane_n and_o alley_n within_o the_o say_a city_n and_o place_n aforesaid_a except_v only_o the_o new_a pave_v of_o such_o street_n and_o place_n for_o which_o any_o of_o the_o inhabitant_n have_v contribute_v and_o pay_v their_o respective_a proportion_n to_o the_o commissioner_n before_o name_v according_a to_o the_o rate_v aforesaid_a shall_v be_v forthwith_o sufficient_o repair_v or_o pave_v and_o from_o time_n to_o time_n hereafter_o maintain_v and_o keep_v sufficient_o repair_v or_o pave_v at_o the_o cost_n and_o charge_n of_o the_o householder_n in_o the_o same_o street_n lane_n and_o alley_n respective_o in_o manner_n follow_v that_o be_v to_o say_v every_o of_o the_o say_a householder_n to_o repair_v and_o pave_v and_o to_o keep_v repair_v and_o pave_v the_o street_n lane_n or_o alley_n before_o his_o house_n and_o so_o far_o as_o his_o house_n wall_n or_o building_n extend_v unto_o the_o channel_n or_o middle_a of_o the_o same_o street_n lane_n or_o alley_n upon_o pain_n to_o forfeit_v twenty_o shilling_n for_o every_o perch_n or_o rod_n and_o after_o that_o rate_n for_o a_o great_a or_o lesser_a quantity_n for_o every_o default_n pave_v the_o penalty_n for_o not_o pave_v and_o of_o twenty_o shilling_n a_o wéek_v for_o every_o wéek_v after_o until_o the_o same_o shall_v be_v sufficient_o pave_v and_o amend_v provide_v always_o that_o such_o ancient_a street_n lane_n and_o alley_n within_o the_o say_a city_n southwark_n proviso_n for_o the_o borough_n of_o southwark_n or_o either_o of_o they_o the_o suburb_n and_o liberty_n thereof_o and_o borough_n of_o southwark_n as_o by_o custom_n and_o usage_n have_v be_v repair_v and_o pave_v in_o other_o manner_n shall_v be_v hereafter_o repair_v pave_v and_o maintain_v in_o such_o sort_n and_o manner_n and_o by_o such_o person_n and_o person_n as_o have_v heretofore_o use_v to_o repair_v pave_v and_o maintain_v the_o same_o under_o the_o penalty_n aforesaid_a any_o thing_n in_o this_o act_n contain_v to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a lady-day_n candle_n or_o light_n to_o be_v hang_v out_o every_o night_n from_o michaelmas_n to_o lady-day_n that_o every_o householder_n within_o the_o say_a city_n the_o suburb_n and_o liberty_n thereof_o and_o in_o all_o other_o the_o place_n aforesaid_a who_o house_n adjoin_v unto_o and_o be_v next_o the_o street_n from_o michaelmas_n until_o our_o lady-day_n yearly_a shall_v every_o night_n set_v or_o hang_v out_o candle_n or_o light_n in_o lantern_n or_o otherwise_o in_o some_o part_n of_o his_o house_n next_o the_o street_n to_o enlighten_v the_o same_o for_o passenger_n from_o such_o time_n as_o it_o shall_v grow_v dark_a until_o nine_o of_o the_o clock_n in_o the_o evening_n upon_o pain_n to_o forfeit_v the_o sum_n of_o one_o shilling_n for_o every_o default_n act._n who_o may_v convict_v person_n offend_v and_o upon_o view_n or_o otherwise_o levy_v the_o penalty_n by_o this_o act._n and_o for_o the_o more_o speedy_a reformation_n and_o punishment_n of_o all_o and_o every_o the_o offence_n aforesaid_a be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o one_o of_o his_o majesty_n justice_n of_o either_o bench_n and_o baron_n of_o his_o exchequer_n and_o every_o justice_n of_o peace_n of_o the_o say_a city_n of_o london_n and_o westminster_n and_o place_n aforesaid_a within_o their_o several_a limit_n respective_o shall_v have_v power_n and_o authority_n upon_o his_o own_o knowledge_n or_o view_v confession_n of_o the_o party_n or_o proof_n of_o one_o credible_a witness_n upon_o oath_n before_o he_o which_o oath_n by_o virtue_n of_o this_o act_n such_o justice_n shall_v have_v power_n to_o administer_v to_o convict_v any_o person_n or_o person_n of_o any_o the_o offence_n aforesaid_a whereby_o such_o person_n or_o person_n so_o convict_v shall_v incur_v the_o penalty_n and_o forfeiture_n aforesaid_a one_o moiety_n whereof_o shall_v be_v dispose_v and_o employ_v for_o and_o towards_o the_o reparation_n pave_v and_o cleanse_v of_o the_o street_n or_o place_n where_o the_o offence_n shall_v be_v commit_v and_o as_o much_o or_o all_o of_o the_o other_o moiety_n as_o the_o justice_n shall_v think_v fit_a for_o he_o or_o they_o that_o shall_v discover_v and_o prosecute_v the_o same_o in_o case_n the_o say_a conviction_n be_v by_o such_o discovery_n and_o prosecution_n and_o if_o the_o conviction_n be_v by_o the_o view_n or_o knowledge_n of_o such_o justice_n than_o the_o say_v whole_a penalty_n to_o go_v and_o be_v employ_v for_o and_o towards_o the_o repair_n pave_v and_o cleanse_v of_o the_o say_a street_n or_o place_n and_o shall_v be_v levy_v by_o distress_n and_o sale_n of_o the_o good_n and_o chattel_n of_o the_o offender_n by_o warrant_n under_o the_o hand_n and_o seal_v of_o any_o such_o justice_n to_o be_v direct_v to_o the_o constable_n or_o any_o other_o officer_n of_o the_o same_o parish_n render_v the_o surplusage_n to_o the_o party_n and_o in_o default_n of_o distress_n or_o not_o payment_n of_o the_o say_a penalty_n within_o six_o day_n after_o demand_v thereof_o or_o notice_n in_o writing_n leave_v at_o the_o house_n or_o dwell_v place_n of_o the_o offender_n by_o the_o say_a constable_n or_o any_o other_o officer_n the_o say_a offender_n not_o be_v a_o péer_n of_o this_o
