liberty_n of_o conscience_n assert_v and_o vindicated_n by_o a_o learned_a country-gentleman_n humble_o offer_v to_o the_o consideration_n of_o the_o lord_n and_o commons_z in_o this_o present_a parliament_n london_n print_v for_o jonathan_n robinson_n at_o the_o golden_a lion_n in_o st._n paul's-church-yard_n 1689._o the_o preface_n courteous_a reader_n my_o purpose_n in_o the_o follow_a treatise_n be_v not_o to_o satisfy_v all_o the_o question_n which_o may_v be_v put_v as_o what_o if_o any_o one_o shall_v preach_v in_o the_o pulpit_n in_o terminis_fw-la that_o jesus_n be_v not_o the_o christ_n or_o against_o the_o resurrection_n of_o the_o dead_a or_o any_o other_o article_n of_o our_o faith_n which_o all_o who_o call_v themselves_o christian_n do_v acknowledge_v or_o affront_v the_o minister_n at_o the_o communion_n and_o pull_v the_o cloth_n and_o utensil_n off_o the_o table_n such_o thing_n by_o the_o place_n and_o manner_n of_o do_v they_o may_v be_v reduce_v to_o moral_a impiety_n and_o punish_v as_o crime_n against_o natural_a light._n but_o my_o business_n be_v to_o assert_v a_o just_a liberty_n in_o such_o controversial_a thing_n of_o religion_n as_o they_o who_o have_v forsake_v the_o church_n of_o rome_n do_v differ_v in_o and_o have_v as_o they_o suppose_v some_o able_a and_o learned_a sober_a and_o godly_a man_n of_o their_o persuasion_n suppose_v that_o in_o the_o mean_a time_n they_o behave_v themselves_o peaceable_o and_o live_v without_o any_o civil_a injury_n for_o my_o own_o part_n i_o be_o so_o sar_n from_o think_v that_o any_o of_o these_o sect_n ought_v to_o be_v punish_v that_o i_o believe_v they_o may_v communicate_v each_o with_o other_o notwithstanding_o any_o opinion_n in_o religion_n which_o they_o hold_v if_o that_o be_v all_o have_v they_o but_o charity_n enough_o to_o bear_v with_o and_o forbear_v one_o the_o other_o for_o he_o who_o believe_v that_o jesus_n be_v the_o christ_n be_v bear_v of_o god_n 1_o john_n 5._o 1._o and_o be_v build_v upon_o the_o rock_n matth._n 16._o 16_o 18._o although_o i_o will_v not_o deny_v but_o i_o shall_v prefer_v a_o pure_a church_n before_o a_o less_o pure_a and_o perhaps_o one_o that_o be_v not_o of_o my_o own_o persuasion_n before_o one_o that_o be_v for_o other_o cause_n but_o i_o can_v communicate_v with_o any_o church_n which_o will_v require_v i_o to_o subscribe_v to_o or_o by_o my_o practice_n and_o gesture_n to_o justify_v any_o the_o least_o thing_n which_o i_o judge_v to_o be_v unlawful_a or_o else_o i_o shall_v not_o communicate_v for_o example_n the_o baptism_n of_o infant_n be_v not_o so_o material_a a_o thing_n either_o way_n as_o that_o man_n shall_v break_v communion_n upon_o it_o for_o there_o be_v for_o it_o neither_o precept_n nor_o precedent_n on_o the_o other_o side_n it_o be_v not_o forbid_v but_o if_o he_o who_o think_v it_o unlawful_a to_o baptize_v his_o infant_n shall_v not_o communicate_v except_o he_o do_v he_o can_v lawful_o communicate_v and_o the_o schism_n be_v on_o their_o part_n who_o will_v force_v it_o as_o a_o necessary_a condition_n of_o communion_n for_o they_o cause_v division_n rom._n 16._o 17._o i_o think_v there_o be_v in_o our_o church_n other_o who_o deserve_v toleration_n less_o than_o any_o dissenter_n who_o i_o know_v as_o notorious_a prophaner_n of_o the_o lord_n day_n haunter_n of_o alehouse_n at_o unseasonable_a time_n of_o the_o night_n or_o when_o according_a to_o their_o conscience_n they_o shall_v be_v at_o church_n and_o other_o debauch_a person_n who_o we_o hear_v daily_o in_o the_o street_n curse_v and_o swear_v bid_v god_n to_o damn_v themselves_o and_o other_o now_o that_o they_o be_v gross_o mistake_v who_o tolerate_v such_o person_n as_o these_o that_o offend_v against_o their_o own_o conscience_n and_o yet_o severe_o punish_v dissenter_n in_o matter_n of_o mere_a religion_n will_v be_v sufficient_o prove_v in_o the_o follow_a discourse_n g._n c._n of_o liberty_n of_o conscience_n qvi_fw-fr bene_fw-la distinguit_fw-la bene_fw-la docet_fw-la it_o will_v therefore_o be_v requisite_a to_o premise_v a_o word_n or_o two_o for_o distinction_n sake_n and_o first_o we_o need_v not_o trouble_v ourselves_o to_o define_v conscience_n logical_o but_o take_v that_o word_n gross_o and_o as_o it_o be_v vulgar_o understand_v we_o mean_v by_o conscience_n any_o man_n persuasion_n of_o what_o he_o be_v to_o believe_v and_o practice_v which_o may_v be_v of_o two_o sort_n 1._o either_o first_o of_o such_o thing_n as_o may_v be_v know_v by_o the_o common_a light_n of_o nature_n or_o 2._o such_o thing_n as_o be_v know_v only_o by_o divine_a revelation_n and_o these_o be_v of_o two_o sort_n 1_o sy_n such_o as_o concern_v the_o reveal_v will_n of_o god_n under_o the_o old_a testament_n which_o be_v call_v the_o law_n or_o 2_o dly_a the_o reveal_v will_n of_o god_n under_o the_o new_a testament_n which_o be_v call_v the_o gospel_n and_o second_o by_o liberty_n we_o mean_v a_o immunity_n from_o punishment_n and_o that_o be_v either_o 1._o divine_a viz._n the_o just_a judgement_n of_o god._n 2._o humane_a and_o those_o be_v twofolde_a 1._o civil_a and_o temporal_a punishment_n by_o loss_n of_o life_n limb_n or_o estate_n etc._n etc._n 2._o ecclesiastical_a by_o the_o admonition_n and_o spiritual_a censure_n of_o the_o church_n these_o thing_n be_v premise_v the_o truth_n concern_v liberty_n of_o conscience_n will_v be_v clear_v by_o the_o proof_n of_o the_o follow_a proposition_n i._n first_o then_o if_o the_o conscience_n be_v erroneous_a by_o any_o great_a fault_n against_o the_o common_a light_n of_o nature_n we_o can_v assert_v any_o freedom_n to_o it_o for_o god_n will_v punish_v it_o and_o the_o king_n will_v punish_v it_o and_o so_o shall_v the_o church_n too_o by_o her_o spiritual_a censure_n and_o the_o great_a the_o error_n be_v as_o to_o the_o clearness_n of_o the_o light_n against_o which_o it_o be_v commit_v or_o as_o to_o the_o mischief_n and_o malignity_n of_o it_o the_o more_o punishable_a it_o be_v for_o else_o we_o shall_v introduce_v a_o liberty_n for_o profess_a atheism_n blasphemy_n murder_n adultery_n theft_n etc._n etc._n for_o catiline_n and_o ravilliack_n etc._n etc._n for_o punishment_n in_o such_o case_n may_v be_v proper_a and_o more_o likely_a to_o amend_v the_o delinquent_n and_o save_v the_o community_n from_o such_o mischief_n as_o such_o error_n tend_v to_o bring_v upon_o it_o yet_o do_v not_o good_a magistrate_n write_v all_o their_o law_n in_o blood_n but_o decree_v capital_a punishment_n only_o against_o capital_a offender_n and_o especial_o for_o such_o offence_n as_o be_v against_o the_o second_o table_n which_o magistrate_n be_v better_a able_a to_o judge_n of_o and_o strike_v at_o the_o root_n and_o be_v of_o civil_a society_n as_o murder_n parricide_n etc._n etc._n i_o mention_v gross_a error_n in_o the_o proposition_n for_o as_o aquinas_n say_v in_o his_o sum_n all_o fault_n against_o natural_a light_n belong_v not_o to_o the_o cognizance_n of_o the_o civil_a magistrate_n who_o be_v a_o public_a person_n but_o be_v to_o be_v correct_v by_o economic_n and_o ethic_n so_o for_o the_o most_o part_n the_o fault_n of_o child_n be_v to_o be_v correct_v by_o their_o parent_n beside_o some_o gross_a error_n may_v be_v except_v as_o they_o may_v be_v circumstantiate_v or_o overrule_v by_o education_n and_o religion_n therefore_o the_o christian_n do_v not_o persecute_v the_o heathen_n as_o the_o heathen_n persecute_v they_o although_o the_o idolatry_n of_o the_o heathen_n be_v contrary_a to_o common_a light_n nor_o do_v the_o protestant_n persecute_v the_o papist_n as_o the_o papist_n persecute_v the_o protestant_n though_o some_o of_o the_o error_n of_o the_o papist_n as_o transubstantiation_n be_v gross_o against_o the_o common_a light_n of_o reason_n and_o sense_n itself_o but_o more_o tolerable_a as_o error_n mere_o than_o pay_v peterpence_n to_o the_o pope_n be_v in_o civil_a government_n ii_o prop._n such_o jew_n as_o live_v in_o the_o time_n of_o the_o old_a testament_n be_v not_o to_o have_v the_o liberty_n of_o their_o conscience_n as_o to_o humane_a punishment_n though_o a_o great_a part_n of_o that_o law_n consist_v only_o of_o the_o reveal_v will_n of_o god_n for_o god_n will_n be_v likewise_o reveal_v that_o they_o shall_v be_v punish_v now_o these_o ordinance_n unto_o which_o the_o jew_n be_v bind_v be_v most_o concern_v the_o outward_a man_n and_o very_o clear_o reveal_v beside_o the_o jew_n have_v their_o urim_n and_o thummim_n their_o priest_n and_o prophet_n who_o god_n according_a to_o his_o promise_n deut._n 18._o 18._o raise_v up_o from_o time_n to_o time_n for_o their_o direction_n who_o the_o people_n be_v bind_v to_o hear_v under_o penalty_n of_o excision_n neither_o be_v the_o stranger_n that_o dwell_v in_o the_o land_n and_o be_v but_o proselyte_n of_o the_o gate_n to_o be_v tolerate_v in_o
which_o some_o say_v of_o force_v the_o external_a not_o internal_a act_n of_o faith_n i_o shall_v speak_v to_o that_o afterward_o v._o my_o five_o argument_n be_v draw_v ab_fw-la axiomate_fw-la viz._n from_o that_o receive_a axiom_n dominium_fw-la non_fw-la fundatur_fw-la in_o gratiâ_fw-la that_o dominion_n be_v not_o found_v in_o grace_n which_o i_o know_v to_o be_v chief_a understand_v of_o sovereignty_n but_o there_o be_v a_o gradual_a parity_n of_o the_o reason_n upon_o which_o that_o axiom_n be_v found_v which_o may_v be_v reciprocal_o apply_v to_o subject_n for_o pagan_n though_o they_o canno●_n be_v lawful_a dispenser_n of_o the_o mystery_n of_o christ_n nor_o heir_n of_o the_o kingdom_n of_o heaven_n yet_o they_o may_v be_v lawful_a king_n and_o lawful_a subject_n lawful_a husband_n lawful_a master_n and_o lawful_a possessor_n of_o their_o life_n liberty_n and_o estate_n christian_n religion_n do_v not_o allow_v servant_n to_o deny_v obedience_n to_o their_o master_n according_a to_o the_o flesh_n except_o they_o may_v be_v make_v free_a nor_o master_n to_o turn_v away_o their_o servant_n contrary_a to_o their_o covenant_n nor_o ought_v christian_a magistrate_n to_o deny_v protection_n to_o who_o it_o be_v due_a though_o they_o be_v not_o christian_n and_o perhaps_o be_v due_a before_o either_o of_o they_o be_v christian_a what_o may_v a_o good_a moral_a heathen_a say_v if_o your_o christianity_n stir_v you_o up_o either_o to_o tyrannize_v or_o to_o rebel_v sore_a cause_n of_o mere_a religion_n malo_fw-la venusinam_fw-la quam_fw-la te_fw-la cornelia_n mater_fw-la si_fw-la cum_fw-la magnis_fw-la virtutibus_fw-la affers_fw-la grande_n supercilium_fw-la indeed_o error_n in_o religion_n may_v have_v such_o intolerable_a injury_n mix_v with_o they_o as_o may_v excuse_v if_o not_o free_a both_o the_o one_o and_o the_o other_o but_o i_o speak_v of_o mere_o religious_a error_n it_o be_v true_a wicked_a man_n want_v the_o blessing_n of_o god_n to_o they_o upon_o what_o they_o possess_v they_o have_v not_o a_o sanctify_a use_n of_o thing_n but_o they_o have_v a_o lawful_a title_n and_o it_o be_v as_o much_o theft_n to_o steal_v from_o they_o as_o the_o best_a godly_a man_n in_o the_o world._n and_o therefore_o heresy_n can_v be_v no_o sufficient_a ground_n to_o dispossess_v any_o man_n of_o what_o he_o have_v for_o that_o can_v only_o denominate_v a_o man_n not_o godly_a or_o gracious_a or_o to_o be_v no_o excellent_a person_n but_o man_n be_v not_o to_o be_v punish_v by_o the_o civil_a sword_n because_o they_o be_v not_o excellent_a person_n it_o be_v general_o think_v that_o sovereign_a authority_n be_v it_o as_o absolute_a as_o it_o will_v be_v found_v at_o least_o in_o implicit_a pact_n or_o trust_n which_o be_v necessary_a in_o all_o nation_n before_o christianity_n come_v into_o the_o world_n and_o when_o it_o do_v it_o be_v not_o in_o the_o christian_a power_n to_o betrust_v that_o nor_o be_v it_o likely_a that_o the_o community_n will_v trust_v their_o temporal_a right_n with_o the_o contingent_a opinion_n of_o their_o governor_n and_o therefore_o that_o bloody_a persecute_v opinion_n must_v needs_o itself_o be_v a_o heresy_n with_o moral_a impiety_n mix_v with_o it_o and_o intolerable_a as_o be_v at_o inlet_n to_o thievery_n and_o tyranny_n on_o the_o one_o hand_n and_o rebellion_n on_o the_o other_o and_o we_o see_v by_o experience_n that_o the_o principal_a hyperaspists_n and_o defender_n of_o the_o bloody_a tenent_n i_o mean_v the_o papist_n do_v not_o stick_v to_o rebel_v against_o to_o depose_v and_o murder_v heretical_a prince_n mere_o for_o religion_n as_o they_o be_v encourage_v to_o do_v by_o the_o decree_n of_o their_o pope_n and_o council_n by_o which_o whither_o king_n or_o subject_n they_o be_v bind_v the_o one_o to_o persecute_v the_o other_o to_o rebel_v in_o case_n of_o heresy_n though_o no_o civil_a injury_n be_v offer_v whatsoever_o oath_n they_o may_v have_v take_v here_o it_o may_v be_v object_v that_o what_o persecutor_n do_v now_o be_v according_a to_o law._n i_o answer_v no_o humane_a authority_n can_v just_o make_v such_o act_n of_o sequestration_n or_o confiscation_n or_o impose_v fine_n much_o less_o such_o unreasonable_a fine_n as_o they_o be_v wont_n to_o do_v for_o thing_n mere_o religious_a what_o be_v that_o else_o but_o to_o establish_v iniquity_n by_o a_o law_n then_o they_o say_v they_o do_v not_o force_v man_n to_o embrace_v the_o faith_n but_o punish_v relapser_n i_o answer_v that_o man_n be_v force_v into_o opinion_n by_o law_n and_o fear_n of_o punishment_n or_o be_v surprise_v by_o education_n and_o custom_n before_o they_o be_v able_a or_o fit_a to_o judge_n or_o be_v deceive_v by_o the_o plausible_a reason_n of_o able_a man_n without_o hear_v what_o other_o man_n can_v say_v to_o the_o contrary_n and_o then_o if_o any_o man_n be_v to_o be_v free_a from_o punishment_n before_o he_o turn_v he_o ought_v to_o be_v as_o free_a to_o return_v except_o some_o sufficient_a cause_n in_o nature_n or_o reason_n can_v be_v show_v to_o dissolve_v his_o right_n in_o the_o one_o case_n more_o than_o in_o the_o other_o to_o relapse_n indeed_o for_o any_o by_o or_o worldly_a end_n be_v a_o great_a sin_n in_o the_o sight_n of_o god_n and_o fit_a for_o he_o to_o judge_n of_o who_o judgement_n be_v according_a to_o truth_n there_o be_v a_o great_a many_o thing_n both_o in_o doctrine_n and_o discipline_n for_o which_o some_o be_v very_o zealous_a but_o the_o great_a part_n do_v so_o little_o understand_v or_o apply_v their_o mind_n to_o understand_v that_o they_o may_v turn_v and_o return_v ten_o time_n over_o for_o what_o they_o know_v and_o yet_o the_o zealot_n will_v engage_v they_o to_o be_v of_o their_o side_n as_o for_o the_o great_a persecutor_n their_o talk_n of_o relapse_n be_v but_o a_o pretence_n for_o they_o persecute_v all_o of_o all_o sort_n again_o it_o may_v be_v object_v that_o now_o the_o minister_n ecclesiastical_a preferment_n may_v be_v endanger_v by_o heretical_a doctrine_n which_o preferment_n be_v settle_v by_o law._n i_o answer_v that_o that_o settlement_n can_v be_v good_a so_o far_o as_o it_o abridge_v any_o man_n or_o deprive_v he_o of_o that_o right_n which_o be_v vest_v in_o he_o by_o the_o law_n of_o nature_n which_o be_v for_o the_o parishioner_n to_o have_v his_o freedom_n in_o matter_n of_o religion_n as_o well_o as_o the_o rector_n of_o the_o parish_n who_o turn_v a_o just_a reward_n into_o oppression_n and_o bribery_n when_o he_o use_v it_o to_o another_o man_n wrong_n what_o ever_o declamation_n or_o defamation_n such_o man_n may_v make_v for_o their_o own_o end_n i_o answer_v further_o that_o the_o minister_n spiritual_a title_n be_v found_v in_o grace_n viz._n for_o a_o certain_a spiritual_a use_n which_o when_o the_o office_n prove_v needless_a or_o vain_a the_o title_n fall_v of_o itself_o because_o the_o foundation_n be_v sink_v away_o from_o it_o now_o though_o in_o the_o present_a objection_n we_o suppose_v the_o office_n well_o found_v and_o terminate_v in_o a_o good_a use_n yet_o in_o those_o office_n which_o be_v not_o essential_a to_o civil_a government_n in_o order_n to_o the_o temporal_a weal_n of_o the_o public_a but_o found_v in_o grace_n for_o spiritual_a end_n the_o usefulness_n whereof_o be_v best_a judge_v by_o such_o as_o be_v spiritual_a the_o right_o be_v likewise_o best_a judge_v by_o they_o also_o and_o to_o be_v repute_v but_o as_o doubtful_a and_o disputable_a as_o to_o other_o and_o consequent_o it_o can_v be_v a_o offence_n so_o great_a and_o of_o the_o same_o nature_n to_o deny_v that_o right_n to_o oppose_v it_o or_o undermine_v it_o as_o it_o be_v to_o oppose_v civil_a natural_a right_n which_o be_v all_o the_o world_n over_o unquestionable_a especial_o when_o that_o religious_a right_n be_v but_o remote_o endanger_v and_o not_o by_o patent_n or_o commission_n only_o and_o before_o they_o enter_v upon_o their_o office_n be_v bind_v to_o declare_v that_o they_o do_v not_o hold_v their_o jurisdiction_n in_o that_o latitude_n church_n may_v be_v bring_v into_o a_o common_a stock_n and_o more_o equal_o distribute_v as_o they_o in_o their_o wisdom_n shall_v think_v fit_a the_o petitioner_n in_o the_o mean_a time_n pay_v their_o duty_n till_o such_o determination_n of_o the_o

they_o and_o shame_v they_o so_o much_o and_o this_o temporize_a and_o turn_v mere_o for_o lucre_n sake_n and_o to_o save_v themselves_o make_v religion_n very_o ridiculous_a and_o weaken_v the_o repute_n and_o authority_n of_o the_o professor_n as_o but_o atheist_n and_o man_n of_o no_o real_a religion_n as_o true_o the_o atheist_n have_v the_o advantage_n of_o all_o man_n in_o this_o with_o all_o time_n and_o party_n yea_o and_o under_o the_o disguise_n of_o religion_n help_v to_o make_v all_o true_a religion_n odious_a by_o persecute_v man_n as_o heretic_n and_o schismatic_n not_o because_o they_o have_v no_o religion_n but_o because_o they_o have_v as_o they_o think_v too_o much_o and_o be_v religious_a in_o good_a earnest_n and_o then_o these_o man_n applaud_v themselves_o and_o think_v they_o have_v get_v a_o great_a argument_n for_o their_o atheism_n when_o they_o see_v other_o man_n make_v religion_n but_o a_o dance_n after_o the_o pipe_n of_o the_o the_o several_a party_n to_o bandy_v against_o one_o another_o and_o against_o the_o government_n which_o will_v make_v work_n enough_o for_o the_o wise_a man_n in_o the_o world_n to_o know_v how_o to_o govern_v such_o unruly_a people_n who_o be_v always_o strive_v to_o get_v the_o civil_a sword_n into_o their_o hand_n not_o for_o common_a defence_n but_o to_o oppress_v their_o antagonist_n
