to_o the_o premise_n contain_v in_o their_o mittimus_fw-la therefore_o the_o court_n ought_v to_o take_v judicial_a cognizance_n thereof_o that_o be_v of_o the_o charge_n contain_v in_o the_o say_v their_o delieverance_n by_o due_a course_n of_o law_n which_o be_v mention_v in_o the_o warrant_n of_o commitment_n but_o not_o in_o this_o pretend_a warrant_n for_o detention_n the_o justice_n who_o commit_v the_o prisoner_n have_v no_o legal_a jurisdiction_n over_o they_o thus_o by_o himself_o to_o interpose_v to_o fasten_v they_o they_o be_v thrust_v out_o of_o his_o hand_n by_o their_o commitment_n and_o thereby_o refer_v to_o the_o
quarter-session_n for_o their_o discharge_n thereupon_o by_o due_a order_n of_o law_n interruption_n on_o the_o read_n the_o three_o exception_n in_o this_o objection_n viz._n r._n if_o a_o man_n owe_v twenty_o man_n money_n the_o first_o that_o arrest_v he_o lay_v he_o into_o goal_n but_o the_o other_o may_v lay_v their_o action_n upon_o he_o for_o all_o that_o or_o if_o a_o man_n rob_v in_o several_a place_n and_o be_v lay_v into_o goal_n for_o one_o robbery_n and_o there_o come_v a_o hue-and-cry_a after_o he_o for_o another_o shall_v be_v go_v free_a of_o that_o because_o he_o be_v arrest_v already_o g.w._n that_o be_v not_o our_o case_n there_o be_v no_o parity_n between_o they_o we_o be_v not_o commit_v to_o goal_n on_o any_o such_o account_n as_o upon_o any_o action_n of_o debt_n robbery_n etc._n etc._n nor_o be_v we_o chargeable_a with_o any_o new_a matter_n or_o crime_n when_o the_o second_o warrant_n be_v write_v more_o than_o when_o our_o mittimus_fw-la be_v write_v and_o we_o first_o commit_v to_o prison_n pray_v let_v i_o read_v on_o the_o matter_n be_v further_o clear_v exception_n 4_o four_o the_o second_o warrant_n be_v contradictory_n to_o the_o first_o in_o that_o it_o admit_v of_o no_o bail_n nor_o mainprize_n for_o the_o prisoner_n which_o the_o first_o admit_v of_o in_o these_o word_n viz._n be_v require_v to_o find_v surety_n for_o their_o respective_a appearance_n at_o the_o next_o general_n session_n whereas_o the_o prisoner_n be_v no_o more_o criminal_a when_o the_o second_o warrant_n be_v make_v than_o when_o the_o first_o be_v make_v be_v then_o in_o hold_n upon_o their_o commitment_n exception_n 5._o five_o the_o prisoner_n be_v not_o convent_v nor_o have_v in_o examination_n before_o the_o justice_n when_o the_o second_o warrant_n be_v make_v to_o answer_v for_o themselves_o as_o they_o ought_v judicial_o to_o have_v be_v if_o he_o have_v any_o new_a matter_n unbailable_a against_o they_o or_o any_o matter_n of_o such_o high_a and_o criminable_a nature_n when_o he_o make_v the_o second_o which_o he_o have_v not_o when_o he_o make_v the_o first_o as_o to_o render_v they_o uncapable_a of_o bail_n therefore_o his_o second_o warrant_n be_v illegal_a and_o extrajudicial_a and_o the_o court_n be_v bind_v to_o take_v notice_n of_o it_o after_o the_o five_o exception_n the_o recorder_n again_o interrupt_v viz._n r._n while_o i_o have_v to_o do_v here_o i_o will_v not_o suffer_v myself_o to_o be_v thus_o reflect_v upon_o it_o be_v a_o dishonour_n to_o the_o court._n court_n how_o many_o more_o have_v you_o to_o read_v g.w._n but_o a_o very_a few_o i_o shall_v quick_o have_v do_v you_o may_v call_v for_o any_o of_o they_o to_o be_v read_v over_o again_o when_o i_o have_v do_v court_n you_o may_v go_v on_o go_v on_o exception_n 6._o six_o if_o it_o be_v object_v that_o the_o prisoner_n refuse_v to_o take_v and_o pronounce_v the_o oath_n of_o obedience_n to_o the_o king_n be_v due_o require_v by_o justice_n bacon_n that_o be_v a_o apparent_a mistake_n if_o the_o warrant_n of_o their_o commitment_n be_v of_o credit_n it_o shall_v be_v evidence_n in_o that_o it_o admit_v of_o bail_n as_o before_o which_o the_o refusal_n of_o the_o say_a oath_n be_v so_o require_v admit_v not_o of_o but_o the_o prisoner_n be_v not_o commit_v on_o that_o account_n and_o therefore_o the_o second_o or_o aforesaid_a to_o take_v the_o say_a oath_n according_a to_o the_o tenor_n and_o plain_a express_a word_n of_o the_o statute_n provide_v in_o that_o case_n they_o not_o be_v under_o those_o circumstance_n and_o cause_n which_o the_o law_n provide_v and_o limit_n as_o precedent_n to_o one_o justice_n his_o be_v authorize_v to_o require_v it_o see_v 3_o jac._n c._n 4._o and_o 7_o jac._n
