against_o judgement_n and_o evident_a reason_n from_o both_o common_a law_n and_o statute_n law_n why_o judgement_n shall_v not_o be_v pass_v against_o he_o in_o this_o case_n 1._o from_o the_o manner_n of_o his_o be_v take_v and_o imprison_v and_o prosecute_v to_o trial_n without_o due_a process_n of_o law_n which_o be_v hold_v for_o error_n and_o against_o justice_n by_o the_o law_n 2._o itself_o by_o which_o he_o be_v try_v and_o judge_v which_o law_n be_v prove_v to_o be_v contrary_a to_o the_o law_n of_o god_n and_o therefore_o the_o judgement_n of_o that_o law_n ought_v to_o have_v be_v arrest_v and_o now_o last_o of_o all_o in_o brief_a judgement_n ought_v not_o to_o have_v pass_v against_o he_o 5._o because_o in_o common_a reason_n and_o equity_n justice_n can_v condemn_v a_o man_n to_o any_o personal_a suffering_n for_o the_o exercise_n of_o his_o conscience_n to_o god-ward_n in_o the_o practice_n of_o be_v assemble_v together_o only_o in_o and_o for_o the_o reason_n and_o equity_n among_o man_n can_v with_o any_o face_n of_o justice_n condemn_v any_o person_n to_o any_o suffering_n in_o such_o a_o case_n inasmuch_o as_o such_o suppose_a offence_n for_o so_o meet_v together_o be_v not_o any_o offence_n against_o any_o man_n but_o against_o god_n only_o if_o it_o be_v real_o a_o offence_n and_o that_o because_o of_o ignorance_n or_o error_n in_o the_o spiritual_a court_n to_o be_v hear_v and_o judge_v by_o their_o spiritual_a officer_n and_o judge_n thus_o it_o be_v in_o time_n pass_v in_o our_o nation_n as_o judge_v by_o the_o ruler_n in_o ancient_a day_n reasonable_a and_o just_a thus_o to_o do_v and_o here_o fall_v out_o a_o like_a case_n a_o person_n take_v and_o accuse_v and_o bring_v to_o trial_n as_o a_o offender_n for_o and_o such_o person_n by_o warrant_n under_o his_o hand_n and_o not_o rude_a soldier_n in_o such_o a_o war_n like_o posture_n and_o therefore_o his_o be_v apprehend_v by_o these_o person_n that_o have_v witness_v against_o he_o in_o the_o capacity_n of_o soldier_n still_o make_v it_o appear_v they_o be_v not_o competent_a witness_n in_o this_o case_n against_o he_o for_o they_o be_v a_o party_n and_o violater_n of_o the_o law_n themselves_o etc._n etc._n here_o again_o the_o court_n interrupt_v he_o and_o the_o judge_n tell_v he_o that_o their_o evidence_n be_v good_a enough_o and_o that_o if_o they_o have_v wrong_v he_o he_o have_v his_o liberty_n of_o the_o law_n against_o they_o and_o may_v do_v what_o he_o will_v in_o that_o case_n but_o their_o evidence_n the_o jury_n may_v take_v to_o which_o be_v reply_v again_o by_o the_o prisoner_n that_o if_o their_o evidence_n be_v take_v and_o he_o thereupon_o bring_v in_o guilty_a and_o so_o condemn_v and_o upon_o that_o cast_n into_o close_a prison_n there_o remain_v how_o shall_v he_o be_v capable_a to_o help_v himself_o in_o any_o prosecution_n of_o the_o say_a man_n if_o he_o have_v a_o purpose_n thereunto_o and_o also_o the_o judgement_n of_o the_o court_n against_o he_o upon_o their_o evidence_n will_v justify_v they_o in_o what_o violence_n they_o have_v do_v against_o he_o and_o therefore_o now_o only_o be_v the_o time_n for_o he_o to_o except_v against_o the_o insufficiency_n of_o the_o man_n and_o their_o evidence_n or_o else_o never_o and_o therefore_o he_o desire_v the_o court_n and_o jury_n to_o consider_v the_o matter_n well_o ere_o they_o determine_v it_o and_o also_o affirm_v that_o he_o have_v law_n and_o reason_n and_o truth_n of_o his_o side_n and_o if_o they_o bring_v he_o in_o guilty_a it_o be_v not_o just_o do_v here_o again_o the_o judge_n interupt_v and_o say_v he_o be_v not_o to_o be_v suffer_v to_o prate_v in_o that_o manner_n at_o the_o bar_n and_o cry_v take_v he_o away_o we_o will_v not_o hear_v he_o and_o he_o will_v delude_v all_o the_o people_n and_o he_o shall_v not_o over-rule_v the_o court_n etc._n etc._n and_o hereupon_o he_o be_v take_v by_o force_n from_o the_o bar_n and_o then_o he_o cry_v out_o he_o shall_v appeal_v to_o the_o mayor_n of_o london_n for_o fair_a deal_n in_o his_o trial_n and_o will_v not_o the_o court_n hear_v will_v they_o not_o hear_v i_o in_o defence_n of_o truth_n whereupon_o the_o mayor_n stand_v up_o and_o call_v to_o e._n burrough_n and_o desire_v he_o to_o speak_v moderate_o and_o not_o offend_v the_o court_n to_o which_o he_o make_v answer_v he_o be_v never_o yet_o repute_v a_o immoderate_a person_n and_o he_o speak_v as_o moderate_o as_o his_o cause_n will_v permit_v and_o desire_v not_o to_o offend_v any_o now_o the_o reason_n of_o the_o court_n be_v offend_v be_v at_o the_o manner_n of_o the_o prisoner_n discourse_n which_o be_v with_o a_o force_n over_o they_o undaunted_o and_o confident_o and_o so_o bold_o as_o if_o he_o have_v not_o be_v in_o the_o capacity_n of_o a_o prisoner_n at_o a_o bar_n and_o sometime_o act_v with_o his_o hand_n stretch_v out_o and_o his_o arm_n abroad_o appeal_n to_o the_o whole_a people_n to_o justify_v the_o truth_n of_o what_o he_o speak_v and_o it_o be_v suppose_v that_o for_o such_o cause_n the_o judge_n and_o court_n take_v offence_n at_o he_o for_o they_o say_v often_o he_o be_v peremptory_a and_o such_o like_a but_o after_o a_o little_a stop_n the_o prisoner_n begin_v to_o speak_v to_o the_o matter_n again_o still_o urge_v the_o court_n and_o jury_n that_o the_o witness_n be_v altogether_o insufficient_a person_n and_o tell_v they_o he_o will_v once_o more_o lay_v it_o before_o they_o and_o then_o leave_v it_o to_o their_o consideration_n then_o the_o judge_n interrupt_v and_o say_v on_o this_o wise_a tell_v the_o prisoner_n that_o he_o have_v nothing_o to_o say_v but_o to_o these_o two_o thing_n first_o whether_o he_o can_v prove_v by_o witness_n upon_o oath_n that_o he_o be_v at_o any_o other_o place_n that_o day_n and_o time_n mention_v in_o the_o indictment_n if_o he_o can_v do_v this_o his_o witness_n shall_v be_v hear_v or_o second_o if_o he_o be_v at_o that_o meeting_n then_o to_o show_v some_o lawful_a warrant_n by_o the_o authority_n of_o the_o land_n for_o his_o so_o be_v if_o he_o can_v do_v either_o of_o these_o it_o will_v be_v hear_v and_o may_v avail_v he_o else_o he_o have_v nothing_o to_o say_v and_o the_o court_n will_v hear_v no_o other_o matter_n to_o which_o e._n burrough_n reply_v he_o shall_v now_o cease_v his_o plea_n of_o the_o insufficiency_n of_o the_o witness_n and_o leave_v what_o he_o have_v say_v to_o the_o jury_n and_o commit_v it_o to_o their_o conscience_n and_o also_o shall_v now_o proceed_v to_o the_o matter_n contain_v in_o the_o indictment_n for_o he_o have_v not_o yet_o speak_v to_o that_o and_o he_o have_v much_o to_o say_v to_o show_v the_o falcity_n of_o almost_o every_o line_n in_o it_o and_o he_o have_v a_o copy_n of_o it_o there_o in_o his_o hand_n for_o that_o purpose_n to_o plead_v to_o it_o and_o first_o of_o all_o he_o shall_v move_v this_o to_o the_o jury_n as_o to_o state_n the_o point_n direct_o to_o they_o whereupon_o the_o issue_n of_o the_o case_n lie_v as_o thus_o the_o case_n to_o be_v seek_v into_o and_o determine_v by_o the_o jury_n be_v not_o say_v he_o whether_o i_o be_v at_o a_o meeting_n at_o all_o but_o whether_o i_o be_v at_o such_o a_o meeting_n for_o which_o i_o now_o stand_v indict_v that_o be_v to_o say_v such_o a_o tumultuous_a riotous_a meeting_n by_o force_n of_o arm_n etc._n etc._n this_o be_v the_o point_n determinable_a for_o say_v he_o i_o confess_v in_o my_o judgement_n i_o own_o this_o practice_n of_o meet_v together_o for_o the_o worship_n of_o god_n and_o i_o myself_o have_v be_v at_o hundred_o of_o such_o meeting_n to_o which_o richard_n brown_n quick_o reply_v so_o shall_v you_o never_o be_v at_o any_o more_o but_o say_v the_o prisoner_n i_o never_o be_v in_o all_o my_o day_n at_o any_o such_o meeting_n as_o be_v mention_v in_o the_o indictment_n and_o for_o which_o i_o be_o now_o upon_o my_o trial_n and_o therefore_o say_v he_o i_o desire_v that_o the_o jury_n will_v observe_v this_o very_a thing_n and_o in_o conscience_n upon_o their_o oath_n judge_v upon_o this_o point_n whether_o they_o find_v not_o whether_o i_o be_v at_o a_o meeting_n but_o whether_o i_o be_v at_o such_o a_o meeting_n for_o which_o i_o now_o stand_v upon_o my_o trial_n specify_v in_o my_o indictment_n and_o this_o i_o shall_v leave_v with_o the_o jury_n say_v the_o prisoner_n to_o which_o the_o judge_n reply_v that_o he_o have_v say_v late_o he_o know_v not_o the_o point_n of_o the_o law_n but_o now_o he_o have_v find_v out_o a_o strange_a point_n but_o it_o shall_v do_v he_o no_o good_a for_o the_o issue_n lie_v not_o there_o but_o if_o he_o be_v at_o a_o meeting_n it_o be_v sufficient_a and_o richard_n brown_a also_o say_v the_o same_o and_o therefore_o say_v the_o judge_n if_o you_o have_v any_o thing_n as_o to_o the_o two_o particular_n i_o have_v mention_v you_o shall_v be_v hear_v but_o nothing_o else_o will_v we_o hear_v after_o a_o little_a stop_n e._n burrough_n speak_v again_o to_o the_o court_n and_o tell_v they_o that_o this_o common_a law_n which_o they_o have_v say_v be_v not_o write_v but_o lay_v in_o the_o breast_n of_o the_o judge_n this_o be_v say_v both_o then_o and_o the_o session_n before_o he_o be_v not_o well_o know_v in_o neither_o the_o extent_n of_o it_o nor_o the_o penalty_n of_o it_o but_o the_o parliament_n have_v late_o make_v a_o law_n in_o particular_a on_o purpose_n against_o
meeting_n and_o it_o may_v be_v suppose_v that_o their_o intent_n be_v by_o that_o law_n to_o abate_v the_o force_n of_o all_o other_o law_n which_o may_v any_o way_n take_v hold_v upon_o any_o for_o meet_v together_o and_o the_o occasion_n of_o that_o law_n late_o make_v be_v on_o this_o wise_a the_o king_n at_o and_o since_o his_o late_a come_n into_o the_o land_n have_v make_v divers_a promise_n to_o we_o for_o the_o toleration_n and_o allowance_n of_o liberty_n of_o conscience_n which_o promise_v they_o may_v expect_v the_o fulfil_n of_o here_o the_o judge_n again_o interrupt_v and_o tell_v he_o he_o shall_v not_o be_v permit_v to_o speak_v on_o that_o wise_a nor_o to_o over-rule_v the_o court_n and_o they_o can_v have_v no_o long_o patience_n and_o he_o speak_v somewhat_o to_o the_o jury_n tell_v they_o they_o have_v hear_v the_o witness_n against_o the_o prisoner_n and_o they_o may_v proceed_v and_o cry_v take_v he_o away_o gaoler_n which_o according_o be_v do_v and_o they_o pull_v and_o hale_v he_o by_o force_n from_o the_o bar_n though_o the_o prisoner_n keep_v on_o speak_v and_o desire_v that_o the_o court_n will_v hear_v he_o yet_o a_o little_a further_o for_o he_o have_v not_o do_v and_o he_o shall_v offer_v both_o law_n and_o reason_n against_o the_o indictment_n and_o he_o suppose_v it_o be_v his_o right_n by_o the_o law_n to_o speak_v the_o last_o word_n to_o the_o jury_n in_o the_o mean_a time_n of_o this_o discourse_n the_o keeper_n be_v hale_v of_o he_o from_o the_o bar_n and_o it_o be_v a_o hard_a matter_n say_v he_o not_o to_o be_v permit_v to_o speak_v for_o himself_o in_o his_o cause_n now_o when_o his_o liberty_n be_v at_o the_o stake_n and_o his_o life_n too_o it_o may_v be_v for_o alderman_n brown_n have_v threaten_v he_o so_o and_o so_o as_o they_o have_v hear_v and_o he_o know_v not_o but_o that_o it_o be_v to_o destroy_v he_o and_o therefore_o of_o right_n he_o claim_v liberty_n to_o plead_v his_o cause_n to_o the_o jury_n who_o be_v his_o only_a judge_n in_o matter_n of_o fact_n and_o not_o the_o court_n at_o which_o the_o court_n seem_v offend_v but_o by_o this_o time_n the_o prisoner_n be_v hale_v quite_o away_o from_o the_o court_n and_o set_v by_o and_o not_o suffer_v to_o speak_v one_o word_n more_o to_o they_o in_o defence_n of_o his_o cause_n then_o next_o of_o all_o be_v set_v to_o the_o bar_n some_o person_n more_o of_o they_o people_n call_v anabaptist_n and_o their_o indictment_n be_v read_v to_o the_o jury_n and_o a_o person_n be_v call_v to_o evidence_n against_o they_o who_o testify_v upon_o oath_n that_o the_o person_n there_o prisoner_n at_o the_o bar_n be_v at_o such_o a_o day_n and_o in_o such_o a_o place_n meet_v together_o and_o he_o be_v one_o of_o the_o party_n send_v to_o apprehend_v they_o which_o according_o be_v do_v and_o these_o be_v the_o very_a person_n and_o this_o be_v the_o sum_n of_o the_o evidence_n give_v against_o they_o then_o they_o be_v ask_v one_o by_o one_o what_o they_o have_v to_o say_v for_o themselves_o to_o which_o one_o of_o they_o answer_v he_o have_v little_a to_o say_v but_o what_o have_v be_v say_v by_o the_o person_n last_o at_o their_o cause_n shall_v appear_v to_o be_v in_o the_o trial_n another_o of_o they_o answer_v as_o for_o meet_v together_o to_o worship_n god_n it_o be_v his_o judgement_n so_o to_o do_v yet_o their_o meeting_n be_v peaceable_a and_o not_o unlawful_a nor_o tumultuous_a and_o to_o this_o purpose_n most_o of_o they_o answer_v only_o one_o person_n tell_v the_o court_n he_o confess_v he_o be_v at_o their_o peaceable_a meeting_n and_o it_o be_v his_o judgement_n and_o conscience_n to_o meet_v together_o among_o his_o friend_n separate_v from_o that_o public_a way_n of_o idolatrous_a worship_n set_v up_o at_o which_o word_n the_o court_n take_v great_a notice_n and_o be_v much_o offend_v and_o alderman_n brown_n cry_v to_o the_o gaoler_n take_v he_o away_o and_o lay_v he_o up_o for_o he_o which_o according_o be_v do_v and_o he_o send_v into_o the_o goal_n again_o this_o be_v the_o substance_n of_o what_o be_v remember_v concern_v they_o only_o they_o plead_v much_o there_o be_v but_o
