vicarage_n of_o wirksworth_n be_v value_v at_o above_o 40_o l._n per_fw-la annum_fw-la in_o the_o kings-book_n 30_o l._n thereof_o be_v only_o for_o the_o say_a tyth_n of_o lead-oar_n but_o the_o only_a question_n be_v concern_v the_o recompense_n which_o the_o plaintiff_n and_o his_o predecessor_n have_v use_v to_o allow_v to_o the_o miner_n for_o cleanse_v and_o wash_v the_o say_v ten_o dish_n debate_n about_o the_o recompense_n for_o wash_v the_o ten_o dish_n where_o it_o be_v prove_v by_o the_o plaintisss_a witness_n the_o constant_a course_n and_o usage_n have_v be_v to_o allow_v only_o a_o penny_n for_o wash_v and_o cleanse_v the_o say_v ten_o dish_n on_o the_o other_o side_n it_o be_v prove_v that_o some_o of_o the_o plaintiff_n predecessor_n have_v allow_v sometime_o to_o the_o miner_n when_o their_o work_n fall_v in_o hard_a and_o rocky_a ground_n and_o in_o place_n much_o annoy_v with_o water_n a_o great_a proportion_n viz._n sometime_o four_o penny_n the_o dish_n and_o it_o be_v allege_v on_o the_o defendant_n part_n that_o the_o cleanse_n of_o a_o dish_n be_v worth_a eight_o penny_n and_o therefore_o it_o be_v against_o reason_n to_o enforce_v the_o poor_a miner_n to_o do_v it_o for_o a_o penny_n nevertheless_o his_o lordship_n be_v well_o satisfy_v notwithstanding_o any_o thing_n object_v by_o the_o say_a defendant_n council_n to_o the_o contrary_a that_o the_o say_v complainant_a aught_o to_o be_v pay_v his_o tithe_n of_o lead-oar_n and_o that_o the_o most_o constant_a custom_n have_v be_v to_o allow_v but_o a_o penny_n for_o cleanse_v it_o and_o that_o the_o say_v miner_n of_o the_o parish_n of_o wirksworth_n ought_v to_o be_v in_o the_o same_o state_n and_o condition_n as_o other_o the_o miner_n in_o the_o high-peak_n be_v the_o miner_n in_o the_o wapontake_n of_o wirksworth_n ought_v to_o be_v in_o the_o same_o condition_n with_o those_o in_o the_o high-peak_a against_o who_o a_o decree_n have_v be_v make_v in_o this_o court_n and_o trial_n at_o law_n upon_o the_o point_n of_o custom_n for_o payment_n of_o tithe_n or_o ten_o of_o lead-oar_n as_o aforesaid_a nevertheless_o his_o lordship_n consider_v that_o the_o alteration_n of_o time_n may_v beget_v great_a inequality_n and_o disproportion_n in_o the_o say_a payment_n for_o although_o in_o ancient_a time_n the_o foresay_a rate_n of_o a_o penny_n may_v be_v a_o competent_a recompense_n for_o the_o labour_n of_o wash_v the_o say_v 10_o dish_n yet_o in_o these_o time_n it_o may_v be_v otherwise_o and_o consider_v that_o whatever_o the_o plaintiff_n right_a in_o that_o behalf_n be_v in_o law_n according_a to_o the_o strict_a custom_n yet_o he_o can_v not_o expect_v that_o a_o court_n of_o equity_n shall_v decree_v the_o say_a custom_n in_o such_o a_o point_n as_o may_v tend_v to_o the_o undo_n of_o the_o poor_a miner_n therefore_o his_o lordship_n think_v sit_v without_o prejudice_n to_o the_o plaintiff_n right_o or_o to_o the_o aforesaid_a the_o recompense_n for_o wash_v the_o tithe_n but_o without_o prejudice_n of_o the_o general_a custom_n and_o as_o touch_v the_o allowance_n to_o be_v make_v by_o the_o complainant_n and_o his_o successor_n for_o wash_v dress_v and_o cleanse_v every_o 10_o dish_n albeit_o his_o lordship_n do_v not_o intend_v to_o alter_v or_o control_v the_o ancient_a custom_n in_o that_o behalf_n yet_o in_o regard_n it_o tend_v to_o settle_v peace_n and_o quietness_n hereafter_o and_o for_o other_o reason_n before_o express_v and_o because_o the_o council_n on_o both_o side_n can_v not_o agree_v about_o it_o therefore_o his_o lordship_n for_o his_o full_a satisfaction_n therein_o and_o that_o a_o moderate_a consideration_n may_v be_v have_v thereof_o if_o the_o matter_n so_o require_v but_o without_o prejudice_n of_o the_o general_n custom_n former_o hold_v and_o use_v in_o that_o behalf_n think_v fit_a and_o do_v order_n that_o a_o commission_n be_v award_v to_o sir_n henry_n willoughby_n knt._n and_o baronet_n sir_n henry_n lee_n sir_n henry_n agard_n and_o john_n bullock_n esq_n or_o any_o 3_o or_o 2_o of_o they_o to_o consider_v and_o examine_v whether_o a_o penny_n a_o dish_n be_v a_o sufficient_a recompense_n for_o wash_v and_o cleanse_v every_o 10_o dish_n one_o with_o another_o give_v they_o power_n to_o view_v all_o sort_n of_o oar_n and_o to_o examine_v witness_n about_o this_o matter_n if_o need_v be_v and_o upon_o return_n of_o the_o say_a commission_n and_o certificate_n from_o his_o lordship_n will_v give_v further_a order_n
say_a miner_n do_v all_o submit_v and_o continue_v some_o year_n to_o pay_v this_o tithe_n to_o the_o complainant_n but_o find_v no_o order_n precedâ—â—â—_n the_o say_a injunction_n and_o decree_n to_o warrant_v the_o decree_n against_o the_o miner_n in_o general_n 5_o and_o last_o record_n of_o the_o first_o fruit_n office_n of_o this_o tithe_n he_o find_v by_o the_o proof_n publish_v in_o the_o cause_n and_o by_o the_o record_n in_o the_o first-fruits-office_n that_o the_o say_a tithe_n or_o ten_o of_o lead_n oar_n have_v be_v time_n out_o of_o mind_n pay_v and_o by_o that_o record_n it_o appear_v that_o the_o vicarage_n of_o wirksworth_n be_v value_v in_o the_o king_n book_n at_o above_o 40_o pound_n 30_o pound_n thereof_o be_v only_o for_o the_o say_a tithe_n of_o lead-oar_n and_o therefore_o his_o opinion_n be_v that_o if_o in_o the_o lord-keeper_n judgement_n the_o decree_n as_o then_o draw_v up_o aught_o to_o extend_v to_o all_o the_o miner_n in_o the_o say_a parish_n until_o it_o be_v reverse_v that_o then_o the_o complainant_n shall_v be_v settle_v in_o the_o possession_n of_o those_o tithe_n till_o that_o time_n and_o restore_v to_o the_o arrearage_n the_o possession_n be_v take_v away_o since_o the_o reference_n but_o if_o the_o say_a decree_n shall_v not_o in_o his_o lordship_n judgement_n be_v extend_v to_o any_o other_o but_o such_o as_o against_o who_o process_n be_v pray_v that_o then_o the_o lord_n keeper_n shall_v direct_v a_o course_n for_o the_o sinal_a determination_n of_o that_o question_n as_o by_o that_o say_a decree_n order_n of_o reference_n and_o certificate_n all_o on_o record_n in_o chancery_n and_o also_o by_o the_o bill_n and_o proceed_n in_o parliament_n to_o which_o the_o complainant_n refer_v himself_o at_o large_a appeareth_z upon_o this_o certificate_n of_o the_o attorney_n general_n the_o complainant_n pray_v that_o his_o decree_n before_o have_v may_v extend_v to_o all_o the_o miner_n in_o that_o parish_n but_o in_o regard_n the_o decree_n aforesaid_a be_v not_o make_v upon_o a_o judicial_a hear_v a_o order_n obtain_v for_o a_o new_a suit_n in_o chancery_n but_o by_o consent_n the_o court_n direct_v and_o order_v that_o it_o shall_v only_o stand_v in_o force_n against_o such_o as_o consent_v to_o it_o but_o yet_o further_o order_v that_o mr._n christopher_n fulwood_n of_o council_n with_o the_o miner_n shall_v within_o a_o fortnight_n after_o entrance_n of_o that_o order_n upon_o notice_n give_v nominate_v four_o miner_n to_o be_v defendant_n to_o a_o new_a bill_n to_o be_v exhibit_v against_o they_o by_o the_o complainant_n and_o what_o order_n or_o decree_n shall_v be_v make_v against_o they_o four_o the_o rest_n of_o the_o miner_n in_o that_o parish_n shall_v be_v bind_v by_o it_o in_o pursuance_n of_o which_o order_n counsellor_n fulwood_n name_v the_o four_o defendant_n first_o mention_v in_o the_o begin_n of_o this_o decree_n viz._n ephraim_n fern_n richard_n wigley_n the_o say_a tithe_n of_o lead-oar_n be_v a_o personal_a tithe_n and_o sometime_o that_o the_o say_v complainant_a aught_o to_o take_v his_o say_a tithe_n or_o ten_o part_n undress_v as_o it_o be_v draw_v up_o out_o of_o the_o lead-mine_n or_o grove_n in_o which_o they_o get_v the_o same_o whereas_o in_o truth_n the_o say_a tithe_n or_o ten_o part_n of_o all_o the_o lead-oar_n get_v within_o the_o say_a parish_n have_v all_o the_o time_n whereof_o the_o memory_n of_o man_n be_v not_o to_o the_o contrary_a be_v pay_v and_o of_o right_a aught_o to_o be_v pay_v by_o custom_n and_o say_a tithe_n or_o ten_o of_o lead_n oar_n for_o the_o time_n be_v have_v likewise_o by_o all_o the_o time_n aforesaid_a receive_v every_o ten_o dish_n or_o measure_n of_o lead_n oar_n from_o the_o miner_n or_o getter_n of_o the_o same_o and_o they_o have_v always_o receive_v every_o the_o say_v ten_o dish_n be_v dress_v and_o cleanse_v from_o the_o earth_n and_o rubbish_n at_o and_o by_o the_o proper_a cost_v and_o charge_n and_o labour_n of_o the_o miner_n the_o proprietor_n and_o owner_n of_o the_o say_a tithe_n or_o ten_o dish_n allow_v one_o penny_n unto_o the_o miner_n for_o the_o dress_n wash_a and_o cleanse_v of_o every_o say_v ten_o dish_n in_o which_o manner_n the_o say_a tithe_n or_o ten_o part_n of_o lead-oar_n have_v be_v pay_v as_o aforesaid_a time_n beyond_o the_o memory_n of_o man_n and_o so_o of_o right_a aught_o to_o be_v pay_v which_o say_v custom_n for_o payment_n of_o the_o say_a tithe_n custom_n the_o same_o in_o all_o parish_n or_o ten_o of_o lead-oar_n within_o all_o parish_n of_o the_o say_a county_n of_o derby_n where_o the_o same_o have_v be_v get_v have_v be_v confirm_v entitle_v approve_v and_o establish_v by_o the_o say_v several_a verdict_n decree_n certificate_n order_n and_o other_o proceed_n former_o set_v forth_o and_o express_v and_o the_o say_v customary_a duty_n have_v be_v so_o pay_v in_o manner_n as_o aforesaid_a to_o the_o a_o groat_n which_o opposition_n and_o combination_n be_v contrary_a to_o all_o equity_n and_o good_a conscience_n and_o will_v tend_v to_o the_o great_a loss_n and_o disinherison_n of_o the_o say_a terbyshire_n where_o lead_v there_fw-mi be_v dig_v and_o as_o such_o have_v be_v try_v and_o adjudge_v at_o common_a law_n upon_o general_a issue_n and_o evidence_n for_o avoid_v multiplicity_n of_o suit_n for_o if_o the_o issue_n and_o evidence_n have_v not_o be_v general_n but_o local_a and_o particular_a as_o of_o late_a year_n have_v be_v attempt_v there_o must_v have_v ensue_v as_o many_o
