A35931 The royalist's defence vindicating the King's proceedings in the late warre made against him, clearly discovering, how and by what impostures the incendiaries of these distractions have subverted the knowne law of the land, the Protestant religion, and reduced the people to an unparallel'd slavery. majesty_n and_o the_o kingdom_n as_o they_o be_v in_o many_o if_o not_o in_o all_o case_n and_o say_v they_o if_o his_o majesty_n shall_v be_v judge_n he_o shall_v be_v judge_n out_o of_o his_o court_n and_o against_o his_o high_a court_n which_o he_o never_o be_v but_o the_o parliament_n shall_v only_o judge_v without_o his_o personal_a assent_n which_o as_o a_o court_n of_o judicature_n it_o always_o do_v and_o all_o other_o court_n as_o well_o as_o it_o and_o say_v they_o if_o the_o king_n be_v for_o the_o kingdom_n and_o not_o the_o kingdom_n for_o the_o king_n and_o if_o the_o kingdom_n best_o know_v what_o be_v for_o its_o own_o good_a and_o preservation_n and_o the_o parliament_n be_v the_o representative_a body_n of_o the_o kingdom_n it_o be_v say_v they_o easy_a to_o judge_v who_o in_o this_o case_n shall_v be_v judge_n but_o say_v they_o it_o it_o not_o so_o easy_a to_o understand_v what_o be_v the_o danger_n of_o unsettle_v by_o this_o mean_v the_o security_n of_o all_o man_n estate_n be_v this_o danger_n say_v they_o keep_v of_o we_o by_o his_o majesty_n single_a vote_n and_o all_o man_n estate_n without_o security_n and_o expose_v to_o a_o arbitrary_a power_n because_o in_o all_o court_n of_o justice_n and_o in_o the_o court_n of_o parlialiament_n and_o that_o without_o any_o appeal_n from_o it_o man_n estate_n and_o interest_n be_v judge_v without_o his_o majesty_n personal_a assent_n but_o say_v they_o we_o do_v not_o say_v this_o as_o if_o the_o royal_a assent_n be_v not_o requisite_a in_o the_o pass_n of_o law_n nor_o do_v nor_o ever_o do_v we_o say_v that_o because_o his_o majesty_n be_v bind_v to_o give_v his_o consent_n to_o good_a law_n present_v to_o he_o by_o his_o people_n in_o parliament_n that_o therefore_o they_o shall_v be_v law_n without_o his_o consent_n or_o at_o all_o obligatory_a save_v only_o for_o the_o necessary_a preservation_n of_o the_o kingdom_n whilst_o that_o necessity_n last_v and_o such_o consent_n can_v be_v obtain_v answer_n here_o with_o much_o art_n and_o cunning_a it_o be_v endeavour_v to_o mislead_v the_o people_n and_o for_o that_o purpose_n the_o true_a question_n be_v decline_v and_o other_o question_n raise_v which_o at_o the_o first_o sight_n may_v to_o the_o vulgar_a seem_v plausible_a when_o a_o difference_n happen_v say_v the_o member_n between_o the_o king_n and_o the_o house_n and_o thus_o in_o a_o thing_n which_o concern_v the_o safety_n of_o the_o kingdom_n it_o must_v not_o rest_v undetermined_a therefore_o say_v they_o either_o the_o king_n must_v be_v judge_n against_o the_o house_n or_o the_o house_n must_v be_v judge_n against_o the_o king_n and_o conclude_v for_o themselves_o but_o the_o case_n be_v right_o state_v and_o the_o constitution_n of_o the_o realm_n due_o consider_v every_o rational_a man_n will_v conclude_v that_o this_o power_n be_v grant_v the_o member_n all_o the_o rest_n of_o the_o people_n of_o england_n be_v of_o a_o free_a subject_n become_v absolute_a slave_n which_o be_v thus_o this_o nation_n be_v govern_v by_o a_o know_a law_n which_o have_v its_o prescribe_a rule_n therefore_o as_o before_o i_o say_v it_o may_v be_v necessary_a in_o some_o thing_n to_o alter_v the_o old_a and_o make_v new_a law_n and_o that_o be_v so_o some_o know_a person_n must_v judge_v when_o necessity_n require_v such_o a_o change_n and_o consequent_o until_o those_o person_n have_v so_o judge_v it_o all_o the_o people_n ought_v to_o conclude_v there_o be_v no_o need_n to_o alter_v the_o law_n and_o by_o the_o law_n of_o england_n as_o before_o be_v say_v the_o king_n and_o the_o two_o house_n be_v that_o judge_n no_o major_a part_n it_o be_v all_o joint_o who_o have_v that_o power_n as_o if_o a._n seize_v of_o land_n upon_o his_o marriage_n be_v tie_v not_o to_o sell_v without_o the_o consent_n of_o b._n and_o c._n in_o this_o case_n a._n b._n or_o c._n may_v negative_o hinder_v the_o sale_n but_o it_o be_v absurd_a to_o conclude_v thereupon_o that_o a._n b._n or_o c._n or_o any_o two_o of_o they_o have_v power_n to_o sell_v but_o most_o injurious_a it_o be_v upon_o that_o ground_n to_o give_v power_n to_o b._n and_o c._n to_o sell_v the_o land_n of_o a._n without_o his_o personal_a consent_n so_o in_o this_o case_n the_o king_n of_o england_n have_v debar_v themselves_o from_o make_v or_o change_v the_o law_n without_o assent_n of_o the_o two_o house_n whereby_o the_o king_n the_o lord_n house_n or_o the_o commons_o house_n have_v power_n negative_o to_o hinder_v the_o make_n of_o any_o new_a difference_n be_v no_o less_o then_o between_o the_o have_v and_o not_o have_v a_o know_a law_n the_o one_o import_v the_o settlement_n of_o a_o know_a law_n and_o preserve_v it_o and_o the_o other_o introduce_v a_o arbitrary_a government_n for_o example_n if_o the_o king_n have_v power_n to_o make_v what_o law_n he_o think_v fit_a he_o may_v at_o pleasure_n bereave_v the_o subject_a of_o life_n and_o confiscate_v their_o estate_n but_o now_o have_v a_o know_a law_n and_o thereby_o protect_v in_o our_o person_n and_o estate_n the_o king_n have_v a_o negative_a voice_n to_o hinder_v the_o change_n of_o that_o law_n there_o ensue_v no_o such_o evil_a consequence_n and_o the_o same_o hold_v with_o the_o member_n the_o lord_n house_n and_o the_o commons_o house_n have_v each_o of_o they_o a_o negative_a voice_n to_o hinder_v the_o change_n of_o the_o law_n or_o make_v a_o new_a law_n do_v not_o lessen_v the_o people_n protection_n of_o their_o person_n nor_o alter_v the_o property_n of_o their_o estate_n the_o know_v and_o settle_a law_n still_o preserve_v both_o but_o admit_v one_o or_o both_o house_n without_o the_o king_n to_o make_v what_o law_n they_o please_v it_o follow_v be_v then_o the_o law_n so_o that_o to_o give_v this_o power_n to_o the_o king_n alone_o or_o to_o one_o or_o both_o house_n without_o the_o king_n the_o consequence_n be_v equal_o evil_a if_o the_o king_n have_v it_o both_o law_n and_o parliament_n be_v destroy_v if_o the_o member_n monarchy_n the_o parliament_n and_o the_o law_n itself_o be_v total_o abolish_v and_o if_o the_o king_n by_o have_v this_o power_n of_o a_o negative_a voice_n be_v judge_n in_o his_o own_o cause_n the_o member_n have_v that_o authority_n be_v so_o too_o but_o that_o be_v a_o mere_a fiction_n neither_o king_n nor_o member_n by_o have_v a_o negatie_a voice_n in_o parliament_n be_v judge_n in_o their_o own_o cause_n but_o all_o that_o be_v to_o say_v the_o king_n and_o the_o house_n be_v joint_o judge_n when_o it_o be_v fit_a to_o make_v a_o new_a law_n or_o change_v the_o old_a and_o so_o long_o as_o they_o extend_v not_o beyond_o the_o power_n of_o a_o negative_a voice_n the_o member_n of_o the_o two_o house_n be_v person_n indifferent_a between_o the_o king_n and_o the_o people_n and_o so_o be_v the_o king_n indifferent_a between_o the_o member_n and_o the_o people_n for_o example_n if_o the_o king_n propound_v a_o law_n to_o take_v away_o the_o life_n of_o his_o subject_n to_o tax_v they_o with_o payment_n of_o money_n not_o warrant_v by_o the_o know_a law_n or_o otherwise_o to_o enlarge_v his_o prerogative_n the_o member_n may_v assent_v thereunto_o and_o so_o make_v it_o a_o law_n or_o refuse_v it_o and_o herein_o they_o be_v indifferent_a between_o king_n and_o people_n for_o the_o benefit_n of_o those_o law_n thus_o propound_v accrue_v not_o to_o they_o and_o so_o it_o be_v if_o either_o or_o both_o house_n propound_v a_o law_n to_o the_o king_n whereby_o they_o will_v assume_v to_o themselves_o the_o absolute_a power_n of_o government_n to_o put_v to_o death_n who_o they_o please_v to_o tax_v or_o impose_v upon_o the_o people_n to_o confiscate_v their_o estate_n to_o their_o own_o use_n the_o king_n be_v a_o person_n indifferent_a between_o the_o member_n and_o the_o people_n to_o judge_n whether_o to_o pass_v it_o or_o not_o but_o when_o the_o member_n without_o the_o king_n assume_v power_n to_o make_v law_n the_o dispute_n between_o the_o king_n and_o the_o people_n be_v end_v the_o business_n be_v then_o immediate_o and_o total_o between_o the_o member_n and_o the_o people_n therefore_o by_o exclude_v the_o king_n from_o his_o negative_a voice_n the_o member_n have_v make_v themselves_o judge_n in_o their_o own_o case_n by_o our_o woeful_a experience_n we_o now_o find_v there_o
of_o the_o member_n to_o have_v power_n to_o make_v a_o law_n it_o be_v all_o one_o as_o to_o have_v that_o authority_n without_o ask_v they_o the_o question_n the_o member_n upon_o broach_v such_o a_o doctrine_n for_o the_o king_n will_v call_v it_o tyranny_n they_o may_v &_o just_o too_o in_o that_o case_n account_v themselves_o but_o cipher_n and_o the_o like_a reason_n hold_v via_fw-la
