a_o certificate_n there_o of_o in_o write_v under_o his_o hand_n and_o seal_n to_o the_o same_o prisoner_n to_o be_v serve_v upon_o such_o person_n or_o person_n he_o or_o her_o executor_n or_o administrator_n or_o to_o be_v leave_v at_o the_o place_n of_o the_o usual_a abode_n of_o such_o person_n or_o person_n at_o who_o suit_n the_o prisoner_n stand_v charge_v and_o imprison_v thereby_o they_o for_o the_o same_o in_o any_o wise_a provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a tha●_n when_o such_o prisoner_n or_o prisoner_n for_o debt_n shall_v have_v legal_o take_v the_o say_a oath_n in_o this_o act_n propose_v to_o be_v take_v and_o shall_v have_v due_o summon_v he_o or_o their_o creditor_n or_o creditor_n and_o after_o the_o say_v forty_o day_n time_n if_o the_o say_a creditor_n or_o creditor_n shall_v make_v no_o discovery_n of_o he_o she_o or_o their_o estate_n nor_o disprove_v nor_o detect_v the_o say_a prisoner_n or_o prisoner_n of_o forswear_n themselves_o that_o then_o if_o such_o creditor_n or_o creditor_n will_v not_o be_v satisfy_v therewith_o that_o the_o say_a prisoner_n or_o prisoner_n may_v be_v set_v at_o liberty_n or_o will_v insist_v to_o have_v the_o say_a prisoner_n continue_v in_o goal_n that_o then_o the_o say_a creditor_n or_o creditor_n shall_v at_o his_o and_o their_o own_o proper_a cost_v and_o charge_n action_n of_o escape_n or_o other_o suit_n bring_v or_o to_o be_v bring_v against_o any_o sheriff_n goaler_n or_o keeper_n of_o any_o such_o prison_n or_o other_o officer_n or_o person_n for_o any_o thing_n do_v in_o obedience_n to_o this_o act_n it_o shall_v and_o may_v be_v lawful_a to_o and_o forsuch_v sheriff_n goaler_n or_o keeper_n of_o prison_n or_o other_o officer_n or_o person_n to_o plead_v the_o general_n issue_n and_o give_v this_o act_n in_o evidence_n which_o shall_v be_v a_o good_a and_o sufficient_a discharge_n and_o shall_v save_v harmless_a every_o such_o sheriff_n goaler_n or_o keeper_n of_o prison_n plead_v the_o same_o and_o if_o the_o plaintiff_n in_o any_o such_o action_n shall_v be_v nonsuited_a or_o verdict_n pass_v against_o he_o the_o defendant_n shall_v have_v double_a cost_v to_o be_v tax_v by_o the_o court_n where_o such_o action_n shall_v be_v bring_v provide_v always_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o notwithstanding_o the_o discharge_v of_o the_o person_n of_o such_o prisoner_n as_o aforesaid_a upon_o take_v the_o oath_n aforesaid_a all_o and_o every_o judgement_n have_v and_o take_v
