quod_fw-la vide_fw-la postea_fw-la licence_n stat._n sect._n 6._o none_o shall_v send_v his_o child_n or_o other_o beyond_o the_o sea_n without_o licence_n and_o be_v it_o further_o enact_v by_o the_o himself_o to_o some_o archbishop_n or_o bishop_n of_o this_o realm_n or_o to_o some_o justice_n of_o peace_n within_o the_o county_n where_o he_o shall_v arrive_v or_o land_n and_o do_v thereupon_o true_o and_o sincere_o before_o the_o same_o archbishop_n bishop_n or_o such_o justice_n of_o peace_n take_v the_o say_a oath_n set_v forth_o in_o anno_fw-la primo_fw-la and_o by_o write_v under_o the_o particular_a cause_n of_o the_o say_a licence_n and_o the_o time_n how_o long_o the_o say_a party_n license_v shall_v be_v absent_a in_o travel_v attend_v and_o return_v it_o shall_v and_o may_v thereupon_o be_v lawful_a for_o every_o such_o person_n so_o licence_v to_o go_v and_o travel_v about_o such_o their_o necessary_a business_n and_o for_o such_o time_n only_o for_o their_o travel_n attend_v and_o return_v as_o shall_v be_v comprise_v in_o the_o say_a licence_n the_o say_a party_n so_o licence_v first_o take_v his_o corporal_a oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n and_o that_o he_o shall_v not_o make_v any_o causeless_a stay_n and_o that_o all_o and_o every_o licence_n hereafter_o to_o be_v make_v in_o this_o behalf_n contrary_a to_o the_o tenor_n effect_n and_o true_a meaning_n of_o this_o statute_n shall_v be_v utter_o void_a frustrate_a and_o of_o none_o effect_n any_o thing_n in_o the_o say_v former_a act_n or_o in_o this_o act_n recusant_n not_o convict_v who_o have_v no_o certain_a place_n of_o abode_n as_o of_o the_o popish_a recusant_n convict_v and_o the_o benefit_n of_o have_v licence_n from_o the_o king_n or_o three_o privy_a counsellor_n by_o force_n of_o this_o act_n be_v intend_v as_o well_o to_o the_o one_o as_o the_o other_o although_o the_o convict_a only_o be_v mention_v in_o the_o recital_n and_o this_o virtue_n of_o the_o say_a statute_n that_o be_v the_o statute_n of_o 35_o eliz._n now_o it_o can_v be_v presume_v that_o the_o maker_n of_o the_o law_n intend_v any_o difference_n between_o the_o person_n to_o be_v licence_v by_o the_o king_n or_o privy_a counsellor_n and_o the_o person_n to_o be_v license_v by_o the_o justice_n of_o peace_n the_o only_a difference_n be_v in_o the_o manner_n of_o grant_v the_o licence_n the_o power_n give_v to_o the_o king_n or_o privy_a counsellor_n be_v more_o absolute_a and_o not_o under_o such_o precaution_n as_o be_v that_o which_o be_v give_v to_o the_o justice_n of_o peace_n for_o the_o king_n or_o privy_a counsellor_n may_v grant_v a_o licence_n to_o the_o recusant_n to_o travel_v without_o any_o particular_a cause_n show_v in_o the_o licence_n or_o the_o assent_n of_o any_o other_o person_n and_o without_o any_o oath_n to_o be_v make_v by_o the_o recusant_n which_o the_o justice_n of_o peace_n can_v do_v and_o there_o be_v no_o reason_n to_o think_v that_o the_o power_n here_o give_v to_o the_o king_n or_o privy_a counsellor_n which_o in_o all_o other_o particular_n be_v so_o much_o more_o absolute_a and_o extensive_a then_o that_o give_v to_o the_o justice_n of_o peace_n shall_v be_v yet_o less_o extensive_a as_o to_o the_o person_n to_o be_v license_v second_o it_o be_v absurd_a to_o think_v that_o the_o maker_n of_o the_o law_n intend_v to_o confer_v a_o great_a privilege_n upon_o the_o recusant_n convict_v who_o offence_n appear_v upon_o record_n then_o to_o such_o as_o be_v not_o convict_v et_fw-la ealis_fw-la hand_n and_o seal_n of_o all_o five_o reside_v within_o the_o say_a county_n or_o liberty_n county_n residence_n in_o the_o county_n these_o word_n seem_v to_o refer_v as_o well_o to_o the_o bishop_n and_o lieutenant_n as_o to_o the_o deputy_n lieutenant_n so_o that_o if_o a_o bishop_n diocese_n extend_v into_o divers_a county_n and_o he_o reside_v in_o one_o of_o they_o his_o assent_n can_v be_v good_a only_o for_o the_o popish_a recusant_n of_o that_o county_n where_o he_o reside_v and_o not_o for_o those_o of_o any_o other_o part_n of_o his_o diocese_n so_o if_o a_o lieutenant_n reside_v out_o of_o the_o county_n whereof_o he_o be_v lieutenant_n his_o assent_n to_o such_o licence_n be_v void_a and_o that_o these_o word_n reside_v within_o the_o say_a county_n or_o liberty_n can_v be_v restrain_v to_o the_o deputy_n lieutenant_n only_o appear_v by_o those_o next_o beforego_n viz._n of_o the_o same_o county_n which_o clear_o relate_v to_o the_o lieutenant_n as_o well_o as_o to_o the_o deputy_n lieutenant_n and_o by_o consequence_n so_o must_v the_o word_n immediate_o subsequent_a viz._n reside_v and_o as_o to_o the_o bishop_n the_o inconvenience_n be_v the_o same_o as_o in_o the_o case_n of_o the_o lieutenant_n for_o by_o their_o remoteness_n they_o be_v disable_v to_o judge_v of_o the_o condition_n and_o behaviour_n of_o the_o recusant_n to_o be_v license_v and_o of_o the_o circumstance_n wherein_o he_o stand_v and_o whether_o such_o licence_n may_v be_v grant_v to_o he_o without_o hazard_n of_o the_o public_a safety_n which_o seem_v to_o be_v the_o reason_n of_o this_o restriction_n to_o the_o county_n or_o liberty_n where_o the_o party_n who_o be_v to_o assent_n reside_v and_o hold_v as_o well_o in_o the_o case_n of_o the_o bishop_n or_o lieutenant_n as_o of_o any_o deputy_n lieutenant_n reside_v out_o of_o the_o county_n licence_n particular_a cause_n of_o the_o licence_n the_o particular_a cause_n of_o the_o say_a licence_n in_o maxfields_n case_n b._n r._n another_o exception_n to_o the_o licence_n grant_v by_o the_o four_o justice_n be_v that_o it_o be_v say_v to_o be_v grant_v for_o certain_a urgent_a cause_n but_o no_o particular_a cause_n the_o popish_a recusant_n have_v urgent_a or_o necessary_a occasion_n or_o business_n answer_v only_o the_o former_a part_n of_o this_o proviso_n which_o give_v the_o four_o justice_n power_n to_o licence_n he_o if_o he_o have_v necessary_a occasion_n or_o business_n to_o travel_v out_o of_o the_o compass_n of_o five_o mile_n but_o withal_o it_o ought_v to_o be_v mention_v in_o the_o licence_n particular_o what_o that_o occasion_n or_o business_n be_v which_o be_v the_o cause_n of_o the_o licence_n for_o so_o this_o act_n here_o express_o appoint_v and_o therefore_o that_o form_n of_o a_o licence_n for_o the_o recusant_n to_o travel_v which_o dalton_n v._o cap._n 124._o tit_n licence_n have_v set_v down_o wherein_o no_o other_o cause_o be_v mention_v but_o urgent_a and_o necessary_a recusant_n to_o take_v before_o he_o can_v be_v license_v to_o travel_v and_o that_o be_v the_o oath_n of_o allegiance_n prescribe_v by_o the_o stat._n of_o 3_o jac._n cap._n 4._o 4._o stat._n 3_o jac._n 4._o for_o it_o be_v there_o say_v that_o in_o a_o information_n bring_v against_o the_o recusant_n for_o travel_v out_o of_o the_o compass_n of_o five_o mile_n the_o defendant_n plead_v a_o oath_n of_o allegiance_n yet_o quaere_fw-la of_o this_o and_o by_o what_o law_n the_o omit_v to_o take_v that_o oath_n make_v the_o licence_n void_a but_o i_o rather_o think_v it_o to_o be_v a_o mistake_n and_o that_o such_o a_o exception_n may_v be_v move_v but_o the_o plea_n not_o disallow_v for_o that_o reason_n oath_n one_o justice_n may_v give_v the_o recusant_n his_o oath_n before_o the_o say_v four_o justice_n of_o the_o peace_n or_o any_o of_o they_o mr._n shepherd_n think_v that_o no_o less_o than_o two_o of_o the_o four_o justice_n of_o peace_n can_v minister_v this_o oath_n to_o the_o recusant_n sure_a guide_n cap._n 14._o sect._n 5._o but_o i_o take_v it_o to_o be_v clear_a that_o any_o one_o of_o the_o four_o justice_n may_v minister_v the_o oath_n in_o this_o case_n and_o there_o be_v a_o great_a difference_n between_o any_o justice_n for_o that_o denote_v the_o plural_a number_n as_o in_o the_o subsequent_a clause_n about_o armour_n where_o any_o justice_n may_v imprison_v the_o offender_n that_o be_v any_o two_o justice_n or_o more_o and_o any_o of_o the_o justice_n as_o here_o which_o denote_v the_o singular_a number_n and_o the_o follow_a word_n who_o shall_v have_v authority_n by_o virtue_n of_o this_o act_n to_o minister_v the_o same_o may_v be_v well_o enough_o apply_v to_o any_o one_o justice_n of_o peace_n that_o he_o have_v true_o inform_v they_o of_o the_o cause_n of_o his_o journey_n true_a averment_n that_o the_o cause_n be_v true_a if_o a_o information_n be_v bring_v against_o a_o popish_a recusant_n for_o travel_v out_o of_o his_o his_o licence_n be_v true_a and_o real_a vide_fw-la moor_n 836._o c._n 1127._o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a function_n stat._n sect._n 9_o a_o recusant_n disable_v to_o execute_v certain_a office_n and_o function_n that_o no_o recusant_n convict_v shall_v at_o any_o time_n after_o the_o end_n of_o this_o session_n of_o parliament_n practise_v the_o common_a law_n of_o this_o realm_n as_o a_o chancellor_n clerk_z attorney_n or_o solicitor_n in_o the_o same_o nor_o shall_v practice_v the_o civil_a law_n as_o advocate_n or_o proctor_n nor_o practice_v physic_n nor_o exercise_n or_o use_v the_o trade_n or_o art_n of_o a_o apothecary_n nor_o shall_v be_v judge_n minister_n clerk_n or_o steward_n of_o or_o in_o any_o court_n or_o keep_v any_o court_n nor_o shall_v be_v register_n or_o town_n clerk_n or_o other_o minister_n or_o officer_n in_o any_o court_n nor_o shall_v bear_v any_o office_n or_o charge_n as_o captain_n lieutenant_z popular_a suit_n which_o conviction_n render_v the_o recusant_n disable_v to_o all_o intent_n as_o a_o excommunicant_a person_n and_o therefore_o he_o be_v a_o party_n to_o it_o by_o the_o same_o rule_n shall_v not_o take_v advantage_n of_o it_o in_o disability_n of_o the_o recusant_n in_o any_o action_n bring_v by_o the_o recusant_n against_o he_o but_o yet_o notwithstanding_o i_o conceive_v party_n be_v actual_o excommunicate_v by_o he_o and_o if_o the_o bishop_n shall_v be_v bar_v to_o plead_v and_o take_v advantage_n of_o such_o excommunication_n because_o he_o be_v a_o party_n thereunto_o it_o will_v follow_v that_o the_o person_n who_o sue_v in_o the_o spiritual_a court_n and_o at_o who_o instance_n the_o person_n sue_v be_v excommunicate_v shall_v be_v bar_v likewise_o to_o take_v advantage_n of_o such_o disability_n in_o the_o plaintiff_n at_o law_n for_o he_o be_v a_o party_n to_o the_o excommunication_n for_o that_o he_o be_v a_o party_n to_o the_o suit_n upon_o which_o the_o excommunication_n be_v original_o found_v but_o the_o contrary_a to_o this_o be_v strong_o imply_v in_o 14_o h._n 4._o 14._o where_o the_o case_n be_v a._n be_v excommunicate_v in_o a_o suit_n depend_v between_o he_o and_o b._n and_o afterward_o a._n sue_v b._n upon_o the_o statute_n of_o praemunire_n who_o plead_v this_o excommunication_n in_o disability_n of_o the_o plaintiff_n the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o this_o branch_n seem_v not_o to_o extend_v to_o all_o forfeiture_n for_o recusancy_n for_o the_o power_n here_o give_v the_o lord_n treasurer_n not_o to_o what_o case_n of_o conviction_n this_o clause_n extend_v and_o to_o what_o not_o etc._n etc._n be_v only_o in_o relation_n to_o those_o forfeiture_n which_o be_v by_o this_o therefore_o if_o a_o man_n never_o come_v to_o church_n yet_o he_o be_v no_o offender_n within_o this_o act_n unless_o he_o advise_o or_o purposely_o move_v or_o persuade_v another_o to_o deny_v or_o impugn_v the_o king_n authority_n in_o cause_n ecclesiastical_a or_o to_o that_o end_n or_o purpose_n advise_o and_o malicious_o move_v or_o persuade_v some_o other_o to_o forbear_v to_o come_v to_o church_n or_o receive_v the_o communion_n or_o to_o be_v present_a at_o conventicle_n etc._n etc._n or_o he_o himself_o be_v present_a at_o such_o conventicle_n etc._n etc._n and_o on_o the_o other_o hand_n if_o a_o man_n move_v or_o persuade_v any_o other_o to_o deny_v or_o impugn_v the_o king_n authority_n in_o cause_n ecclesiastical_a or_o to_o forbear_v to_o come_v to_o church_n or_o receive_v
