council-board_n to_o show_v that_o he_o do_v not_o fly_v from_o justice_n but_o to_o the_o supreme_a fountain_n thereof_o for_o relief_n against_o the_o high_a oppression_n that_o perhaps_o ever_o be_v put_v upon_o a_o innocent_a subject_n he_o exhibit_v his_o second_o petition_n of_o appeal_n 82._o feb._n 82._o relate_v to_o his_o illegal_a imprisonment_n therein_o acknowledge_v his_o have_v be_v among_o other_o thing_n pray_v that_o all_o three_o cause_n may_v be_v hear_v together_o at_o council-board_n that_o the_o appellant_n witness_n may_v be_v examine_v before_o their_o be_v send_v refer_v to_o the_o say_a lord_n committee_n who_o lordship_n order_v all_o three_o cause_n to_o be_v hear_v the_o 2d_o of_o october_n follow_v 83_o aug._n 17._o 83_o octob._n 2._o 83_o the_o cause_n upon_o the_o first_o appeal_n relate_v to_o the_o 150._o l._n fine_a be_v hear_v all_o the_o allegation_n of_o the_o petition_n make_v clear_a and_o sir_n richard_n answer_n confute_v by_o his_o own_o witness_n and_o the_o commit_v satisfy_v that_o he_o have_v not_o proceed_v regular_o in_o set_v the_o fine_a himself_o without_o the_o concurrence_n and_o against_o the_o consent_n of_o the_o whole_a also_o upon_o hear_v the_o testimony_n of_o several_a of_o the_o most_o eminent_a planter_n the_o lord_n committee_n declare_v they_o be_v full_o satisfy_v that_o the_o fine_a be_v irregular_o impose_v and_o be_v proceed_v on_o to_o hear_v the_o two_o latter_a appeal_n but_o sir_n richard_n and_o his_o council_n allege_v that_o they_o be_v not_o ready_a nor_o can_v be_v for_o such_o hear_n hear_v their_o lordship_n be_v prevail_v with_o to_o give_v he_o five_o month_n long_o for_o prepare_v such_o evidence_n as_o be_v necessary_a with_o liberty_n himself_o to_o go_v over_o and_o not_o be_v destroy_v in_o his_o absence_n who_o advice_n be_v to_o proceed_v against_o he_o at_o common_a law_n upon_o a_o action_n of_o trover_n for_o his_o ship_n and_o of_o false_a imprisonment_n for_o commit_v he_o to_o the_o provost_n morshal_n and_o keep_v he_o five_o week_n there_o assure_v he_o that_o whenever_o the_o say_v appeal_n shall_v come_v to_o be_v hear_v at_o council-board_n proceed_v at_o law_n for_o the_o same_o and_o take_v off_o sir_n henry_n morgan_n protection_n whereupon_o hanson_n petition_v his_o late_a majesty_n in_o council_n 83._o octob._n 26._o 83._o and_o for_o the_o reason_n therein_o contain_v pray_v first_o leave_v to_o proceed_v against_o the_o say_a sir_n richard_n at_o common_a law_n upon_o the_o say_a action_n offer_v to_o stay_v six_o month_n before_o come_v to_o a_o trial_n that_o sir_n richard_n may_v have_v his_o witness_n so_o as_o he_o will_v give_v bail_n before_o his_o go_v over_o 2._o that_o a_o commission_n may_v be_v issue_v the_o only_a way_n to_o make_v a_o inlet_n to_o all_o perjury_n a_o thing_n of_o dangerous_a consequence_n be_v irregular_o set_v but_o desire_v to_o hear_v the_o whole_a matter_n again_o and_o to_o have_v a_o new_a examination_n thereof_o and_o that_o five_o month_n time_n may_v be_v give_v to_o transmit_v such_o record_n proof_n and_o information_n as_o shall_v be_v necessary_a thereto_o 2._o that_o sir_n richard_n with_o the_o council_n there_o may_v cause_v all_o necessary_a proof_n to_o be_v take_v upon_o oath_n on_o either_o side_n and_o transmit_v over_o 3._o that_o in_o the_o mean_a time_n the_o 150_o l._n remain_v where_o it_o then_o be_v and_o all_o three_o cause_n to_o be_v hear_v together_o 4._o that_o hanna_n perfect_a his_o examination_n within_o one_o month_n so_o as_o hanson_n give_v he_o a_o full_a and_o final_a release_n from_o all_o damage_n that_o may_v arise_v to_o he_o by_o answer_v any_o interrogation_n that_o shall_v be_v put_v to_o he_o which_o report_n be_v confirm_v that_o day_n but_o hanson_n before_o he_o hear_v thereof_o on_o the_o send_v a_o letter_n to_o sir_n richard_n to_o acquaint_v he_o with_o his_o resolution_n of_o proceed_v against_o he_o at_o common_a law_n for_o his_o false_a imprisonment_n 83._o nou._n 8._o 83._o and_o the_o ship_n he_o take_v from_o he_o write_v he_o the_o name_n of_o his_o attorney_n and_o desire_v a_o appearance_n and_o bail_n without_o further_a trouble_n or_o charge_n 83._o nou._n 14._o 83._o sir_n richard_z petition_v his_o majesty_n in_o council_n a_o copy_n whereof_o be_v order_v to_o hanson_n and_o he_o require_v to_o answer_v the_o same_o on_o the_o 16_o of_o that_o month._n hanson_n put_v in_o his_o answer_n thereto_o 83._o nou._n 16._o 83._o and_o thereby_o confute_v all_o the_o scandalous_a matter_n therein_o contain_v submit_v his_o case_n whole_o to_o his_o late_a majesty_n royal_a consideration_n and_o pray_v first_o liberty_n to_o proceed_v at_o law_n as_o aforesaid_a 2._o that_o a_o commission_n may_v issue_v to_o empower_v indifferent_a person_n to_o examine_v witness_n in_o barbadoes_n as_o before_o he_o have_v pray_v if_o any_o new_a evidence_n shall_v be_v richard_n go_v over_o to_o which_o answer_n he_o annex_v several_a article_n of_o high_a misdemeanour_n against_o sir_n richard_n on_o behalf_n of_o the_o inhabitant_n of_o the_o island_n on_o read_v whereof_o first_o it_o be_v order_v that_o it_o shall_v be_v leave_v to_o hansons_n choice_n whether_o he_o will_v proceed_v at_o come_v law_n or_o attend_v the_o determination_n of_o his_o appeal_n at_o that_o board_n 2._o that_o unless_o hanson_n release_v sir_n richard_n from_o all_o further_a prosecution_n at_o common_a law_n upon_o the_o matter_n of_o the_o say_v appeal_n before_o the_o 21_o of_o that_o month_n the_o two_o latter_a appeal_n shall_v stand_v dismiss_v 3._o that_o mr._n attorney_n general_n and_o mr._n graham_n on_o his_o majesty_n behalf_n shall_v take_v effectual_a care_n to_o assist_v sir_n richard_n in_o the_o suit_v prosecute_v against_o he_o by_o hanson_n 83._o nou._n 21._o 83._o hanson_n put_v in_o his_o answer_n to_o that_o order_n and_o therein_o set_v forth_o first_o that_o he_o never_o doubt_v his_o majesty_n and_o that_o most_o honourable_a board_n justice_n 2._o neither_o do_v or_o will_v he_o wave_v the_o same_o 3._o that_o he_o will_v always_o submit_v any_o cause_n of_o he_o to_o his_o majesty_n royal_a determination_n so_o as_o the_o same_o can_v proper_o come_v before_o he_o in_o judgement_n and_o will_v have_v wait_v the_o five_o month_n aforesaid_a and_o the_o hear_n of_o the_o cause_n before_o any_o proceed_n at_o law_n but_o that_o first_o sir_n richard_z and_o the_o council_n in_o barbadoes_n be_v not_o only_o appoint_v to_o examine_v his_o own_o but_o hansons_n witness_n also_o and_o that_o not_o only_o in_o the_o first_o but_o the_o two_o latter_a appeal_n both_o which_o concern_v sir_n richard_n alone_o a_o thing_n without_o precedent_n and_o of_o dangerous_a consequence_n to_o be_v lead_v in_o example_n and_o will_v prove_v fatal_a to_o hanson_n in_o deprive_v he_o of_o his_o witness_n testimony_n for_o that_o none_o of_o they_o will_v dare_v to_o come_v before_o sir_n richard_n to_o be_v examine_v and_o no_o other_o person_n dare_v take_v their_o affidavit_n against_o their_o governor_n unless_o appoint_v thereto_o 2._o because_o the_o order_n aforesaid_a which_o seem_v to_o leave_v hanson_n to_o his_o election_n be_v so_o pen_v as_o that_o it_o take_v away_o from_o he_o that_o freedom_n and_o oblige_v he_o to_o proceed_v at_o law_n in_o as_o much_o as_o he_o be_v thereby_o oblige_v immediate_o to_o release_v sir_n richard_n if_o he_o intend_v to_o abide_v the_o hear_n of_o that_o board_n which_o if_o he_o shall_v do_v and_o the_o council_n upon_o hear_v shall_v as_o they_o have_v in_o the_o aforesaid_a case_n of_o mingham_n declare_v they_o can_v not_o assess_v damage_n therefore_o leave_v he_o to_o law_n for_o the_o same_o then_o will_v such_o release_n be_v plead_v in_o bar_n to_o his_o declaration_n which_o he_o can_v not_o conceive_v be_v design_v by_o the_o lord_n of_o the_o council_n no_o more_o than_o they_o will_v order_v mr._n attorney_n general_n and_o mr._n graham_n on_o his_o majesty_n behalf_n to_o defend_v sir_n richard_n against_o hansons_n suit_n which_o be_v civil_a cause_n arise_v by_o matter_n between_o he_o and_o sir_n richard_n and_o his_o majesty_n no_o way_n concern_v therein_o as_o a_o party_n and_o yet_o even_o that_o be_v order_v also_o but_o the_o say_v hanson_n do_v then_o offer_v in_o his_o say_a answer_n first_o to_o refer_v all_o the_o matter_n in_o difference_n between_o he_o and_o sir_n richard_n to_o any_o person_n of_o honour_n or_o know_a honesty_n even_o to_o the_o near_a relation_n and_o best_a friend_n sir_n richard_n have_v or_o 2._o to_o take_v what_o sir_n richards_n own_o council_n and_o solicitor_n have_v offer_v he_o after_o the_o first_o hear_v about_o the_o fine_a though_o not_o a_o five_o part_n of_o his_o damage_n rather_o than_o to_o have_v any_o further_o contest_v or_o trouble_v 3._o to_o stay_v all_o proceed_n at_o law_n till_o the_o hear_v appoint_v shall_v be_v over_o so_o as_o he_o may_v not_o for_o the_o reason_n beforementioned_a be_v oblige_v to_o release_n sir_n richard_n and_o so_o as_o 4._o two_o indifferent_a person_n on_o either_o side_n may_v be_v appoint_v to_o examine_v both_o party_n witness_n fair_o and_o impartial_o if_o any_o such_o new_a witness_n shall_v be_v admit_v to_o examination_n and_o so_o as_o all_o proceed_n upon_o the_o master_n of_o the_o ship_n be_v bond_n that_o bring_v he_o over_o may_v be_v stay_v till_o after_o such_o reflection_n upon_o the_o say_v hanson_n on_o read_v whereof_o it_o be_v order_v that_o he_o shall_v be_v at_o liberty_n to_o proceed_v on_o his_o voyage_n to_o barbadoes_n notwithstanding_o the_o general_a article_n exhibit_v against_o he_o which_o article_n and_o answer_v thereto_o be_v refer_v to_o the_o lord_n committee_n aforesaid_a hanson_n by_o petition_n 83._o dec._n 19_o 83._o humble_o john_n witham_n have_v make_v colonel_n edwin_n steed_n chief_a baron_n of_o his_o majesty_n
court_n of_o exchequer_n for_o try_v the_o cause_n upon_o the_o aforesaid_a capt._n richard_n young_n 2000_o l_o bond_n to_o which_o court_n richard_n seawell_n esq_n his_o majesty_n attorney_n general_n 4._o jan._n 19_o 83_o 4._o come_v and_o exhibit_v three_o several_a information_n one_o against_o young_a the_o other_o two_o against_o each_o of_o his_o surety_n matthew_n haviland_n and_o commit_v some_o day_n before_o by_o warrant_n from_o sir_n richard_n for_o divulge_v the_o content_n of_o a_o letter_n send_v to_o he_o by_o john_n cresset_n of_o london_n solicitor_n in_o which_o sir_n richard_n be_v traduce_v and_o some_o lord_n of_o the_o king_n most_o honourable_a privy_a council_n unfit_o mention_v and_o expose_v to_o the_o malicious_a censure_n of_o the_o disaffect_v in_o 83_o 4._o and_o have_v till_o the_o thursday_n follow_v give_v for_o that_o purpose_n they_o all_o three_o plead_v several_o 4._o feb._n 6._o 83_o 4._o they_o protest_v against_o the_o information_n add_v that_o the_o matter_n therein_o contain_v be_v not_o sufficient_o set_v forth_o and_o deny_v that_o they_o be_v guilty_a of_o any_o contempt_n against_o the_o king_n or_o breach_n of_o his_o law_n in_o manner_n and_o form_n as_o in_o the_o information_n be_v set_v forth_o but_o for_o further_a plea_n 1._o they_o say_v that_o upon_o the_o construction_n of_o the_o law_n it_o be_v evident_a officer_n be_v impower_v to_o take_v any_o such_o bond_n with_o such_o condition_n endorse_v as_o he_o pretend_v be_v forfeit_v to_o the_o king_n 11._o they_o aver_v that_o if_o the_o information_n shall_v be_v rule_v right_o to_o lie_v than_o judgmeet_n will_v be_v enter_v for_o 2000_o l._n and_o no_o relief_n against_o the_o entire_a penalty_n to_o be_v have_v though_o the_o damage_n design_v
