other_o his_o act_n upon_o his_o own_o occasion_n and_o as_o a_o private_a person_n write_v of_o himself_o in_o the_o singular_a number_n as_o other_o private_a man_n do_v yet_o for_o as_o much_o as_o in_o his_o public_a and_o politic_a capacity_n and_o as_o a_o bishop_n in_o the_o church_n of_o england_n he_o stand_v in_o the_o eye_n of_o the_o law_n as_o a_o corporation_n the_o king_n not_o only_o allow_v he_o act_v in_o that_o capacity_n to_o write_v of_o himself_o in_o the_o plural_a number_n but_o in_o all_o writ_n direct_v to_o he_o as_o bishop_n as_o in_o presentation_n and_o the_o like_a bespeak_v he_o in_o the_o plural_a number_n vestrae_fw-la diocesis_n vobis_fw-la praesentamus_fw-la etc._n etc._n the_o bishop_n then_o be_v a_o corporation_n and_o that_o by_o the_o king_n authority_n as_o all_o other_o corporation_n whether_o simple_a or_o aggregate_v whether_o by_o charter_n or_o prescription_n be_v it_o be_v meet_v he_o shall_v hold_v his_o court_n and_o proceed_v therein_o in_o the_o same_o manner_n and_o form_n where_o there_o be_v no_o apparent_a reason_n to_o the_o contrary_a as_o other_o corporation_n do_v and_o therefore_o as_o it_o will_v be_v a_o high_a presumption_n for_o the_o chancellor_n and_o scholar_n of_o one_o of_o the_o university_n be_v a_o corporation_n to_o who_o the_o king_n by_o his_o charter_n have_v grant_v a_o court_n or_o for_o the_o major_a and_o alderman_n of_o a_o city_n for_o the_o same_o reason_n to_o issue_v writ_n or_o do_v other_o act_n in_o their_o court_n in_o the_o king_n name_n not_o have_v any_o authority_n from_o the_o king_n or_o his_o grant_n or_o from_o the_o law_n and_o custom_n of_o england_n so_o to_o do_v so_o doubtless_o it_o will_v for_o the_o same_o reason_n be_v esteem_v a_o presumption_n no_o less_o intolerable_a for_o the_o bishop_n to_o use_v the_o king_n name_n in_o their_o process_n and_o judicial_a act_n not_o have_v any_o sufficient_a legal_a warrant_n or_o authority_n for_o so_o do_v ix_o which_o if_o it_o be_v due_o consider_v will_v induce_v any_o reasonable_a man_n to_o believe_v and_o confess_v that_o this_o manner_n of_o proceed_v in_o their_o own_o name_n use_v by_o the_o bishop_n in_o their_o court_n be_v so_o far_o from_o trench_v upon_o the_o regal_a power_n and_o authority_n which_o be_v the_o crime_n charge_v upon_o it_o by_o the_o objector_n that_o the_o contrary_a usage_n unless_o it_o be_v enjoin_v by_o some_o law_n of_o the_o land_n as_o it_o be_v in_o the_o reign_n of_o king_n edward_n the_o six_o may_v far_o more_o just_o be_v charge_v therewithal_o for_o the_o true_a reason_n of_o use_v the_o king_n name_n in_o any_o court_n be_v not_o thereby_o to_o acknowledge_v the_o emanation_n of_o the_o power_n or_o jurisdiction_n of_o that_o court_n from_o or_o the_o subordination_n of_o that_o power_n unto_o the_o king_n power_n or_o authority_n as_o the_o objector_n seem_v to_o suppose_v but_o rather_o to_o show_v the_o same_o court_n to_o be_v one_o of_o the_o king_n own_o immediate_a court_n wherein_o the_o king_n himself_o be_v suppose_v in_o the_o construction_n of_o the_o law_n either_o by_o his_o personal_a or_o virtual_a power_n to_o be_v present_a and_o the_o not_o use_v of_o the_o king_n name_n in_o other_o court_n do_v not_o infer_v as_o if_o the_o judge_n of_o the_o say_a court_n do_v not_o act_v by_o the_o king_n authority_n for_o who_o can_v imagine_v that_o they_o who_o hold_v a_o court_n by_o virtue_n of_o the_o king_n grant_v only_o shall_v pretend_v to_o act_v by_o any_o other_o than_o his_o authority_n but_o only_a that_o they_o be_v no_o immediate_a representative_n of_o the_o king_n person_n in_o such_o their_o jurisdiction_n nor_o have_v consequent_o any_o allowance_n from_o he_o to_o use_v his_o name_n in_o the_o exercise_n or_o execution_n thereof_o x._o second_o there_o be_v another_o observable_a difference_n in_o this_o point_n between_o the_o king_n common-law-court_n such_o as_o be_v most_o of_o those_o aforementioned_a and_o those_o court_n that_o proceed_v according_a to_o the_o way_n of_o the_o civil_a law_n if_o the_o king_n appoint_v a_o constable_n or_o earle-marshal_n or_o admiral_n of_o england_n for_o as_o much_o as_o all_o trial_n in_o the_o marshal_n court_n common_o call_v the_o court_n of_o honour_n and_o in_o the_o admiralty_n be_v according_a to_o the_o civil_a law_n all_o process_n therefore_o sentence_n and_o act_n in_o those_o court_n go_v in_o the_o name_n of_o the_o constable_n earle-marshal_n or_o admiral_n and_o not_o in_o the_o king_n name_n which_o manner_n of_o proceed_v constant_o use_v in_o those_o court_n since_o no_o man_n hitherto_o have_v be_v find_v to_o interpret_v as_o any_o diminution_n at_o all_o or_o disacknowledgement_n of_o the_o king_n sovereignty_n over_o the_o say_a court_n it_o be_v not_o possible_a the_o same_o manner_n of_o proceed_v in_o the_o ecclesiastical_a court_n shall_v be_v so_o confident_o charge_v with_o so_o heinous_a a_o crime_n do_v not_o the_o intervention_n of_o some_o wicked_a lust_n or_o other_o prevail_v with_o man_n of_o corrupt_a mind_n to_o become_v partial_a judge_n of_o evil_a thought_n especial_o consider_v that_o xi_o three_o there_o be_v yet_o a_o more_o special_a and_o peculiar_a reason_n to_o be_v give_v in_o the_o behalf_n of_o the_o bishop_n for_o not_o use_v the_o king_n name_n in_o their_o process_n etc._n etc._n in_o the_o ecclesiastical_a court_n then_o can_v be_v give_v for_o the_o judge_n of_o any_o other_o the_o abovementioned_a court_v either_o of_o the_o common_a or_o civil_a law_n in_o the_o say_a respect_n arise_v as_o have_v be_v already_o in_o part_n touch_v from_o the_o different_a nature_n of_o their_o several_a respective_a jurisdiction_n which_o be_v that_o the_o summons_n and_o other_o proceed_n and_o act_n in_o the_o ecclesiastical_a court_n be_v for_o the_o most_o part_n in_o order_n to_o the_o ecclesiastical_a censure_n and_o sentence_n of_o excommunication_n etc._n etc._n the_o pass_v of_o which_o sentence_n and_o other_o of_o like_a kind_n be_v a_o part_n of_o the_o power_n of_o the_o key_n which_o our_o lord_n jesus_n christ_n think_v fit_a to_o leave_v in_o the_o hand_n of_o his_o apostle_n and_o their_o successor_n and_o not_o in_o the_o hand_n of_o layman_n the_o king_n of_o england_n never_o challenge_v to_o the_o regulate_v and_o order_v of_o that_o power_n in_o sundry_a circumstance_n concern_v the_o outward_a exercise_n thereof_o in_o foro_fw-la externo_fw-la the_o godly_a king_n of_o england_n have_v
