this_o writ_n although_o he_o be_v take_v and_o detain_v in_o prison_n as_o if_o he_o be_v take_v by_o the_o death_n of_o a_o man_n or_o if_o he_o be_v take_v by_o the_o commandment_n of_o the_o king_n justice_n and_o mention_n not_o chief_a justice_n which_o i_o believe_v be_v to_o be_v intend_v not_o of_o the_o chief_a of_o the_o court_n of_o judicature_n but_o of_o the_o chief_a justice_n of_o england_n for_o there_o be_v such_o a_o one_o in_o those_o day_n thus_o my_o lord_n you_o see_v the_o opinion_n of_o master_n fitzherbert_n in_o this_o case_n the_o next_o thing_n that_o i_o will_v show_v your_o lordship_n be_v the_o opinion_n of_o master_n stamford_n in_o his_o plea_n of_o the_o crown_n fol._n 72._o where_o he_o set_v down_o the_o statute_n of_o westminster_n primo_fw-la and_o then_o he_o add_v that_o by_o this_o appear_v in_o four_o case_n at_o the_o common_a law_n a_o man_n be_v not_o replevisable_v in_o those_o that_o be_v take_v for_o the_o death_n of_o a_o man_n their_o judgement_n be_v weak_a the_o next_o thing_n i_o shall_v offer_v unto_o your_o lordship_n be_v this_o that_o i_o can_v show_v with_o so_o great_a authority_n as_o i_o have_v do_v the_o rest_n because_o i_o have_v not_o the_o thing_n itself_o by_o i_o but_o i_o will_v put_v it_o to_o your_o lordship_n memory_n i_o presume_v you_o may_v well_o remember_v it_o it_o be_v the_o resolution_n of_o all_o the_o judge_n which_o be_v give_v in_o the_o four_o and_o thirty_o of_o queen_n elizabeth_n it_o fall_v out_o upon_o a_o unhappy_a occasion_n which_o be_v thus_o the_o judge_n they_o be_v more_o than_o be_v now_o this_o my_o lord_n be_v the_o resolution_n of_o all_o the_o judge_n and_o baron_n of_o the_o exchequer_n and_o not_o by_o some_o great_a one_o now_o i_o will_v apply_v myself_o to_o that_o which_o have_v be_v enforce_v by_o the_o council_n on_o the_o other_o side_n which_o be_v the_o reason_n that_o the_o subject_n have_v interest_n in_o this_o case_n my_o lord_n i_o do_v acknowledge_v it_o but_o i_o must_v say_v that_o the_o sovereign_n have_v great_a interest_n in_o it_o too_o and_o sure_o i_o be_o that_o the_o first_o stone_n of_o sovereignty_n be_v no_o as_o here_o it_o be_v upon_o this_o return_n whether_o we_o ought_v to_o deliver_v he_o by_o bail_n or_o to_o remaund_v he_o back_o again_o wherein_o you_o must_v know_v this_o which_o your_o have_v be_v positive_a now_o there_o follow_v that_o this_o be_v signify_v to_o they_o by_o the_o lord_n of_o the_o council_n this_o be_v return_v to_o ascertain_v the_o court_n that_o he_o return_v the_o cause_n true_o and_o to_o show_v we_o that_o we_o shall_v not_o doubt_v the_o verity_n of_o this_o return_n &_o not_o to_o show_v to_o we_o that_o he_o have_v no_o knowledge_n of_o the_o cause_n but_o by_o the_o signification_n of_o the_o lord_n of_o the_o council_n according_a to_o that_o case_n of_o the_o bishop_n of_o norwich_n touch_v the_o excommunication_n he_o must_v testify_v his_o of_o the_o king_n and_o whether_o this_o be_v good_a in_o law_n or_o no_o that_o be_v the_o question_n to_o this_o purpose_n if_o you_o remember_v this_o point_n i_o say_v you_o do_v not_o cite_v any_o book_n or_o case_n in_o print_n but_o many_o precedent_n which_o i_o confess_v be_v as_o strong_a as_o any_o book_n case_n for_o book_n case_n i_o confess_v be_v take_v and_o select_v out_o of_o entire_o so_o that_o the_o court_n may_v adjudge_v of_o they_o now_o the_o precedent_n you_o urge_v they_o to_o be_v so_o many_o and_o so_o full_o to_o the_o point_n that_o we_o may_v thereby_o see_v that_o it_o be_v good_a to_o hear_v what_o can_v be_v say_v on_o both_o side_n and_o for_o to_o hear_v all_o and_o view_v the_o record_n themselves_o and_o therefore_o we_o require_v you_o to_o bring_v the_o record_n to_o we_o and_o you_o do_v so_o and_o you_o bring_v we_o more_o than_o you_o mention_v here_o and_o we_o have_v peruse_v they_o all_o that_o thereby_o we_o may_v see_v whether_o the_o court_n be_v faithful_o deal_v withal_o or_o no_o for_o though_o counsellor_n may_v urge_v a_o book_n for_o their_o own_o advantage_n yet_o it_o be_v the_o duty_n of_o the_o court_n to_o see_v
