the_o plaintiff_n or_o his_o attorney_n nor_o have_v above_o one_o plaint_n for_o one_o cause_n in_o pain_n of_o 40_o s._n to_o be_v divide_v betwixt_o the_o king_n and_o the_o prosecutor_n l._n a_o justice_n of_o peace_n may_v proceed_v as_o in_o case_n of_o felony_n xv._o the_o commissioner_n or_o captain_n that_o license_v any_o person_n retain_v and_o assume_v another_o for_o gain_n or_o which_o give_v to_o any_o licence_n to_o depart_v without_o warrant_n from_o the_o commander_n shall_v forfeit_v 20_o l._n to_o the_o king_n for_o every_o person_n so_o let_v go_v xvi_o the_o lieutenant-general_n or_o other_o officer_n that_o receive_v more_o wage_n for_o soldier_n then_o there_o be_v cause_n and_o do_v not_o every_o month_n by_o a_o note_n in_o writing_n acquaint_v the_o treasurer_n of_o the_o army_n with_o every_o soldier_n be_v entry_n into_o pay_n death_n or_o departure_n shall_v forfeit_v 5_o l._n to_o the_o king_n suffer_v one_o month_n be_v imprisonment_n and_o lose_v his_o place_n xvii_o none_o but_o the_o commander_n shall_v license_v any_o in_o pain_n of_o imprisonment_n both_o of_o the_o licenser_n and_o license_v at_o the_o discretion_n of_o the_o say_a commander_n xviii_o the_o lieutenant-general_n shall_v command_v this_o act_n to_o be_v proclaim_v in_o the_o army_n once_o every_o month_n and_o every_o governor_n in_o his_o fortress_n once_o every_o three_o month_n xix_o every_o person_n which_o shall_v inform_v the_o lieutenant_n of_o any_o of_o these_o offence_n shall_v have_v a_o month_n pay_v belong_v to_o he_o that_o be_v faulty_a xx._n this_o act_n shall_v not_o prohibit_v officer_n to_o retain_v yearly_o 6_o s._n 8_o d._n for_o the_o coat_n of_o a_o yeoman_n and_o 12_o s._n 4_o d._n for_o the_o coat_n of_o a_o gentleman_n neither_o shall_v it_o be_v prejudicial_a unto_o they_o when_o the_o lack_n of_o soldier_n be_v not_o through_o their_o default_n nor_o when_o they_o have_v under_o they_o a_o retinue_n of_o soldier_n or_o for_o nonpayment_n of_o the_o king_n wage_n to_o their_o household-servant_n neither_o shall_v it_o extend_v to_o prohibit_v relief_n of_o tenant_n or_o friend_n towards_o service_n in_o war_n or_o the_o detain_v of_o soldier_n wage_n upon_o lawful_a cause_n ☞_o xxi_o stat._n 43_o e._n 3._o the_o more_o part_n of_o the_o justice_n of_o p._n yearly_a in_o their_o easter-sess_n have_v power_n to_o charge_v every_o parish_n towards_o a_o weekly_a relief_n of_o maim_a soldier_n and_o mariner_n so_o that_o no_o parish_n pay_v weekly_o above_o 10_o d._n nor_o under_o 2_o d._n nor_o any_o county_n which_o consist_v of_o above_o 50_o parish_n pay_v above_o 6_o d._n one_o parish_n with_o another_o which_o sum_n so_o tax_v shall_v be_v assess_v in_o every_o parish_n by_o the_o parishioner_n or_o in_o their_o default_n by_o the_o churchwarden_n and_o constable_n or_o in_o their_o default_n by_o the_o next_o justice_n or_o justice_n of_o peace_n xxii_o the_o constable_n and_o churchwarden_n of_o every_o parish_n have_v power_n to_o levy_v the_o tax_n of_o every_o person_n refuse_v to_o pay_v it_o by_o distress_n and_o sale_n and_o in_o their_o default_n the_o say_a justice_n or_o justice_n next_o adjoin_v xxiii_o the_o tax_n be_v thus_o levy_v the_o constable_n and_o churchwarden_n shall_v deliver_v it_o quarterly_o ten_o day_n before_o every_o quarter-sess_n he_o be_v bear_v or_o where_o he_o last_o dwell_v by_o the_o space_n of_o three_o year_n at_o his_o election_n but_o if_o he_o be_v not_o able_a to_o travel_v then_o to_o the_o treasurer_n of_o the_o county_n where_o he_o land_n xxviii_o he_o shall_v bring_v to_o any_o of_o the_o treasurer_n aforesaid_a a_o certificate_n under_o the_o hand_n and_o seal_n of_o the_o chief_a commander_n or_o of_o the_o captain_n under_o who_o he_o serve_v contain_v the_o particular_n of_o his_o hurt_n and_o service_n which_o certificate_n shall_v be_v also_o allow_v by_o the_o muster-master_n or_o the_o be_v do_v upon_o the_o bare_a certificate_n of_o the_o commander_n and_o captain_n although_o they_o have_v not_o as_o yet_o obtain_v any_o allowance_n thereof_o from_o the_o say_a muster-master_n or_o receiver_n general_a of_o the_o muster-roll_n xxxi_o the_o treasurer_n shall_v register_v their_o receipt_n and_o disbursment_n and_o enter_v the_o name_n of_o the_o party_n relieve_v and_o rest_n may_v levy_v by_o distress_n and_o sale_n of_o good_n xxxiii_o a_o soldier_n or_o mariner_n that_o beg_v or_o counterfeit_v a_o certificate_n shall_v suffer_v punishment_n as_o a_o common_a rogue_n and_o shall_v lose_v his_o pension_n if_o he_o have_v any_o xxxiv_o the_o surplusage_n of_o this_o contribution_n shall_v be_v employ_v by_o the_o more_o part_n of_o the_o justice_n in_o session_n upon_o charitable_a use_n according_a to_o the_o statute_n make_v for_o relief_n of_o the_o poor_a and_o punishment_n of_o rogue_n xxxv_o in_o corporation_n the_o justice_n there_o shall_v put_v this_o act_n in_o execution_n and_o not_o the_o justice_n of_o the_o county_n and_o shall_v be_v liable_a to_o fine_n as_o well_o as_o other_o justice_n if_o they_o misuse_v their_o power_n therein_o and_o shall_v appoint_v a_o collector_n of_o this_o tax_n which_o shall_v have_v the_o power_n and_o be_v subject_a to_o the_o penalty_n limit_v by_o this_o act_n to_o high-constable_n of_o the_o county_n xxxvi_o the_o forfeiture_n accrue_v by_o this_o act_n shall_v be_v employ_v as_o the_o surplusage_n abovesaid_a or_o otherwise_o keep_v in_o augmentation_n of_o the_o stock_n as_o the_o more_o part_n of_o the_o justice_n in_o session_n shall_v direct_v xxxvii_o when_o out_o of_o the_o county_n where_o the_o party_n be_v press_v a_o fit_a pension_n can_v be_v satisfy_v it_o shall_v be_v supply_v by_o the_o county_n where_o he_o be_v bear_v or_o where_o he_o last_o dwell_v by_o the_o space_n of_o 3_o year_n xxxviii_o this_o act_n shall_v not_o prohibit_v the_o city_n of_o london_n to_o make_v a_o tax_n if_o need_v require_v differ_v from_o that_o above_o limit_v so_o that_o no_o parish_n pay_v above_o 3_o s._n weekly_o nor_o above_o or_o under_o 12_o d._n weekly_a unto_o which_o he_o be_v to_o pass_v and_o the_o time_n limit_v for_o his_o passage_n may_v in_o the_o direct_a way_n home_o and_o within_o the_o time_n so_o limit_v for_o his_o passage_n ask_v and_o and_o of_o peace_n in_o their_o session_n have_v power_n to_o proceed_v against_o these_o offender_n as_o in_o case_n of_o felony_n without_o clergy_n unless_o some_o sufficient_a man_n allow_v by_o the_o justice_n will_v enter_v into_o recognisance_n of_o 10_o l._n to_o the_o queen_n to_o retain_v the_o offender_n for_o one_o whole_a year_n and_o to_o bring_v he_o to_o the_o next_o session_n of_o peace_n and_o goal-delivery_n after_o the_o year_n end_v and_o if_o he_o within_o the_o year_n depart_v that_o service_n without_o licence_n he_o shall_v afterward_o suffer_v as_o a_o felon_n without_o clergy_n xviii_o soldier_n and_o mariner_n which_o fall_v sick_a in_o their_o passage_n home_o shall_v be_v excuse_v though_o they_o exceed_v the_o time_n limit_v in_o their_o testimonial_a so_o that_o they_o perform_v this_o act_n in_o convenient_a time_n after_o their_o recovery_n xix_o if_o when_o they_o come_v home_o they_o can_v get_v work_n the_o two_o next_o justice_n upon_o engine_n in_o pain_n of_o 10_o l._n xx._n the_o abovesaid_a forfeiture_n shall_v be_v divide_v betwixt_o the_o king_n and_o the_o prosecutor_n xxi_o justice_n of_o peace_n within_o every_o county_n to_o the_o king_n the_o other_o to_o he_o that_o shall_v sue_v for_o the_o same_o xxiv_o the_o king_n may_v grant_v commission_n to_o two_o or_o more_o person_n who_o may_v license_v and_o authorise_v the_o sell_n of_o wine_n by_o retail_n according_a to_o the_o rule_n and_o direction_n in_o this_o act_n and_o not_o otherwise_o xxv_o such_o person_n commissionated_a shall_v be_v call_v the_o king_n agent_n for_o grant_v wine_n licenses_n and_o may_v grant_v licenses_n not_o exceed_v 21_o year_n if_o the_o party_n license_v so_o long_o live_v under_o a_o rent_n yearly_a but_o no_o fine_a to_o be_v pay_v xxvi_o licenses_n shall_v be_v grant_v only_o â—â—_o such_o person_n as_o use_v the_o trade_n of_o sell_v wine_n by_o retail_n or_o to_o the_o landlord_n of_o the_o house_n and_o may_v not_o be_v assign_v nor_o shall_v indempnifie_v any_o against_o the_o penalty_n of_o this_o act_n save_o the_o first_o taker_n xxvii_o they_o may_v appoint_v officer_n for_o manage_v that_o service_n so_o as_o their_o salary_n exceed_v not_o 6_o d._n in_o the_o pound_n of_o the_o yearly_a revenue_n arisiâ—â—â—_n 〈◊〉_d xxviii_o the_o say_a revenue_n shall_v be_v pay_v into_o the_o exchequer_n and_o not_o to_o be_v charge_v with_o any_o gift_n or_o pension_n and_o the_o agent_n shall_v every_o michaelmas_n term_n return_v into_o the_o exchequer_n what_o licenses_n they_o have_v grant_v and_o the_o rent_n reserve_v and_o pay_v and_o the_o arrear_n to_o the_o end_n process_n may_v issue_v for_o the_o same_o xxix_o proviso_n not_o to_o extend_v to_o prejudice_v any_o privilege_n of_o the_o two_o university_n nor_o to_o prejudice_n the_o privilege_n of_o the_o society_n of_o vintner_n london_n nor_o any_o other_o town_n corporate_a nor_o the_o burrow_n of_o st._n alboas_n in_o their_o privilege_n grant_v by_o letter_n patent_n of_o queen_n elizabeth_n for_o maintenance_n of_o the_o free-school_n there_o xxx_o no_o officer_n appoint_v by_o the_o king_n for_o this_o service_n shall_v receive_v any_o fee_n or_o reward_n for_o the_o same_o other_o then_o 5_o s._n for_o a_o licence_n 4_o d._n for_o a_o acquittance_n and_o 6_o d._n for_o a_o bond_n upon_o pain_n of_o 10_o l._n one_o moiety_n to_o the_o king_n the_o other_o to_o the_o person_n that_o will_v sue_v for_o the_o same_o xxxi_o none_o shall_v abuse_v or_o mix_v any_o wine_n with_o any_o other_o ingredient_n upon_o pain_n of_o forfeiture_n of_o 100_o l._n by_o every_o merchant_n wine-cooper_n or_o other_o sell_v wine_n in_o gross_a and_o 40_o l._n by_o every_o person_n sell_v wine_n by_o retail_n for_o such_o mix_n corrupt_a or_o abuse_v of_o wine_n the_o one_o moiety_n to_o the_o king_n the_o other_o moiety_n to_o the_o person_n that_o shall_v sue_v for_o the_o same_o xxxii_o no_o canary_n wine_n muskadel_n or_o alicant_n shall_v be_v sell_v within_o england_n wales_n or_o berwick_n by_o retail_n for_o above_o 18_o d._n the_o quart_n no_o gascoigne_n or_o french_a wine_n for_o above_o 8_o d._n the_o quart_n no_o rhenish_a wine_n for_o above_o 12_o d._n the_o quart_n and_o so_o proportionable_o for_o more_o or_o less_o quantity_n upon_o pain_n of_o 5_o l._n forfeiture_n for_o every_o statute_n quart_n etc._n etc._n or_o other_o measure_n sell_v for_o more_o the_o one_o moiety_n to_o the_o king_n the_o other_o moiety_n to_o he_o that_o shall_v sue_v for_o the_o same_o xxxiii_o provide_v the_o lord_n chancellor_n etc._n etc._n may_v set_v the_o price_n of_o wine_n yearly_a or_o alter_v the_o same_o and_o in_o default_n of_o such_o set_n of_o prize_n the_o rate_n set_v by_o this_o act_n to_o continue_v under_o the_o penalty_n recoverable_a as_o aforesaid_a xxxiv_o see_v post-office_n numb_a 4._o witness_n i._o stat._n 12._o e._n 2.2_o when_o a_o deed_n or_o other_o writing_n be_v deny_v in_o court_n wherein_o witness_n be_v name_v process_n shall_v be_v award_v to_o cause_v they_o to_o appear_v and_o if_o they_o come_v not_o at_o the_o great_a distress_n return_v or_o the_o return_n be_v that_o they_o have_v nothing_o or_o that_o they_o can_v be_v find_v yet_o the_o enquest_n shall_v proceed_v but_o if_o the_o witness_n appear_v at_o the_o great_a distress_n and_o the_o enquest_n for_o some_o cause_n remain_v untaken_v the_o witness_n shall_v have_v like_o day_n give_v as_o be_v assign_v for_o the_o take_n of_o the_o enquest_n when_o if_o they_o appear_v not_o the_o issue_n first_o return_v upon_o they_o shall_v be_v forfeit_a and_o the_o take_n of_o the_o enquest_n shall_v not_o be_v defer_v because_o of_o their_o
