A76365 A plea for the commonalty of London, or, A vindication of their rights (which hath been long with-holden from them) in the choice of sundry city officers. As also, a justification of the power of the Court of Common-councell, in the making of acts, or by-laws, for the good and profit of the citizens, notwithstanding the negative votes of the Lord Major and aldermen. Being fully proved by severall charters granted to this City, by sundry royall kings of England, confirmed by Act of Parliament, and by records witnessing the particulars in the practise of them. / In a speech delivered in Common-councell, on Munday the 24th of February, 1644. By John Bellamie. Bellamie, John, d. 1654. 1645 (1645) Wing B1816; Thomason E1174_3; ESTC R208882 15,067 36

a_o plea_n for_o the_o commonalty_n of_o london_n or_o a_o vindication_n of_o their_o right_n which_o have_v be_v long_o withheld_a from_o they_o in_o the_o choice_n of_o sundry_a city_n officer_n alderman_n and_o the_o rest_n of_o the_o common-council_n of_o the_o city_n of_o london_n right_o honourable_a right_o worshipful_a that_o which_o late_o i_o present_v in_o a_o speech_n unto_o your_o ear_n i_o now_o presume_v in_o this_o little_a manual_a to_o put_v into_o your_o hand_n it_o neither_o than_o be_v nor_o now_o be_v any_o conceit_n i_o have_v or_o have_v of_o my_o own_o ability_n for_o i_o know_v myself_o the_o unmeet_a because_o the_o unabl_a of_o many_o other_o that_o put_v i_o upon_o this_o task_n but_o that_o duty_n and_o service_n which_o i_o owe_v unto_o this_o court_n and_o in_o it_o unto_o all_o the_o commonalty_n of_o this_o city_n make_v i_o to_o adventure_v myself_o in_o the_o presence_n of_o your_o lordship_n and_o the_o worthy_a alderman_n to_o enter_v the_o list_n and_o to_o put_v in_o this_o plea_n for_o the_o defence_n of_o our_o liberty_n and_o vindicate_v of_o our_o right_n and_o due_n and_o as_o sometime_o it_o fall_v out_o in_o a_o case_n of_o danger_n when_o the_o loss_n of_o all_o lie_v at_o stake_n that_o the_o forwardness_n of_o a_o young_a and_o unexperienced_a soldier_n who_o perhaps_o be_v also_o more_o hardy_a than_o wary_a yet_o love_v his_o country_n liberty_n adventure_n to_o begin_v the_o onset_n and_o thereby_o provoke_v and_o stir_v up_o courage_n in_o the_o more_o grave_a and_o able_a commander_n to_o follow_v on_o in_o hope_n of_o victory_n so_o if_o now_o by_o my_o example_n i_o may_v but_o encourage_v some_o of_o you_o who_o be_v also_o with_o i_o member_n of_o this_o council_n and_o which_o i_o know_v be_v far_o more_o able_a than_o myself_o to_o improve_v your_o part_n and_o ability_n for_o the_o common_a good_a in_o use_v your_o best_a endeavour_n in_o this_o court_n for_o the_o plead_n of_o our_o cause_n and_o thereby_o the_o regain_n of_o those_o right_n and_o liberty_n which_o by_o the_o charter_n of_o our_o city_n do_v belong_v unto_o we_o i_o shall_v then_o be_v in_o good_a hope_n that_o by_o the_o evidence_n of_o truth_n and_o reason_n all_o our_o privilege_n and_o immunity_n will_v be_v as_o free_o so_o also_o love_o and_o consent_o grant_v to_o we_o which_o be_v and_o ever_o shall_v be_v the_o earnest_a desire_n and_o endeavour_v of_o he_o who_o be_v and_o ever_o will_v be_v your_o lordship_n and_o this_o city_n servant_n for_o the_o public_a welfare_n of_o it_o john_n bellamy_n the_o proem_n upon_o the_o 16_o of_o january_n last_o i_o make_v a_o humble_a motion_n in_o the_o common-council_n to_o the_o lord_n major_n and_o alderman_n that_o one_o special_a mean_n which_o i_o have_v oft_o observe_v to_o obstruct_v the_o good_a proceed_n of_o that_o court_n may_v be_v remove_v viz._n his_o lordship_n cause_v the_o sword_n to_o be_v take_v up_o and_o then_o go_v away_o and_o so_o dissolve_v the_o court_n without_o the_o consent_n yea_o against_o the_o desire_n of_o the_o major_a part_n the_o remedy_n i_o propose_v for_o the_o redress_n of_o this_o grievance_n be_v this_o that_o by_o the_o power_n of_o this_o council_n there_o may_v be_v a_o law_n establish_v that_o the_o court_n may_v not_o at_o any_o time_n be_v dissolve_v or_o adjourn_v without_o the_o consent_n of_o the_o major_a part_n both_o of_o alderman_n and_o commons_o in_o common-counsel_n assemble_v the_o ground_n upon_o which_o i_o take_v the_o humble_a boldness_n to_o make_v that_o so_o necessary_a a_o motion_n be_v from_o the_o example_n of_o that_o never_o too_o much_o to_o be_v admire_v wisdom_n and_o prudence_n of_o those_o noble_a peer_n and_o sage_n of_o this_o kingdom_n the_o lord_n and_o commons_o now_o assemble_v in_o this_o present_a parliament_n who_o see_v the_o sad_a effect_n almost_o to_o the_o ruin_n of_o this_o nation_n that_o fall_v out_o by_o reason_n of_o the_o sudden_a break_v up_o of_o parliament_n do_v thereupon_o address_v themselves_o with_o one_o consent_n unto_o his_o majesty_n that_o he_o will_v be_v please_v to_o pass_v a_o act_n that_o this_o parliament_n may_v not_o be_v dissolve_v prorogue_v or_o adjourn_v without_o the_o consent_n of_o both_o house_n of_o parliament_n first_o have_v and_o obtain_v thereunto_o as_o i_o can_v not_o in_o my_o judgement_n find_v out_o a_o fair_a copy_n to_o write_v after_o in_o this_o my_o motion_n for_o the_o city_n safety_n than_o that_o unparallelled_a practice_n of_o those_o lord_n and_o commons_o for_o the_o kingdom_n security_n so_o neither_o can_v i_o present_v a_o better_a pattern_n than_o our_o royal_a sovereign_n nor_o in_o all_o his_o action_n since_o the_o diadem_n of_o this_o kingdom_n adorn_v his_o kingly_a head_n can_v i_o find_v out_o one_o which_o in_o after_o age_n will_v bespeak_v he_o more_o true_o royal_a than_o this_o his_o so_o ready_o grant_v that_o their_o so_o just_a a_o desire_n i_o also_o upon_o the_o 24_o of_o january_n prosecute_v this_o my_o motion_n with_o some_o pressive_a argument_n hope_v thereby_o to_o prevail_v and_o they_o be_v such_o as_o i_o find_v make_v ready_a to_o my_o hand_n by_o the_o most_o solid_a and_o able_a judgement_n that_o this_o nation_n have_v viz._n the_o argument_n which_o the_o lord_n and_o commons_o in_o parliament_n lay_v down_o before_o his_o majesty_n and_o which_o wrought_v his_o royal_a consent_n you_o may_v find_v they_o in_o the_o preface_n before_o the_o act_n for_o the_o continuance_n of_o this_o present_a parliament_n all_o that_o be_v i_o therein_o be_v only_o the_o paralel_n of_o the_o condition_n of_o the_o kingdom_n for_o which_o they_o be_v make_v with_o the_o condition_n of_o the_o city_n to_o which_o i_o bring_v they_o and_o apply_v they_o to_o the_o present_a case_n in_o hand_n and_o let_v we_o but_o change_v the_o term_n of_o the_o kingdom_n into_o city_n and_o parliament_n into_o common-council_n which_o be_v as_o it_o be_v a_o city-parliament_n and_o then_o they_o will_v almost_o in_o every_o thing_n as_o full_o agree_v with_o our_o condition_n as_o with_o the_o condition_n of_o the_o kingdom_n for_o which_o they_o be_v frame_v the_o particular_n i_o principal_o insist_v upon_o be_v these_o three_o 1._o the_o raise_n of_o money_n for_o the_o kingdom_n city_n occasion_n 2._o the_o repayment_n of_o those_o money_n so_o raise_v by_o the_o parliament_n common-council_n 3._o the_o redress_n of_o the_o public_a grievance_n of_o the_o kingdom_n city_n now_o as_o the_o parliament_n can_v not_o so_o the_o common-council_n can_v so_o full_o with_o power_n and_o credit_n either_o raise_v or_o pay_v such_o money_n as_o they_o shall_v have_v occasion_n to_o use_v for_o the_o service_n of_o the_o kingdom_n city_n nor_o remove_v the_o public_a grievance_n of_o the_o kingdom_n city_n without_o the_o power_n of_o continue_v together_o and_o of_o not_o be_v dissolve_v till_o they_o have_v full_o effect_v that_o which_o in_o these_o or_o any_o the_o like_a particular_n shall_v come_v under_o their_o debate_n or_o consideration_n but_o see_v that_o neither_o so_o fair_a a_o prcedent_a nor_o so_o forceable_a argument_n can_v then_o prevail_v as_o be_v desire_v i_o thereupon_o endeavour_v first_o by_o the_o charter_n of_o our_o city_n second_o by_o record_n witness_v our_o power_n in_o the_o practice_n of_o it_o and_o three_o by_o equity_n and_o reason_n to_o prove_v our_o right_n and_o due_n as_o in_o this_o follow_a plea_n i_o have_v lay_v they_o down_o and_o therein_o have_v make_v our_o claim_n a_o plea_n for_o the_o commonalty_n of_o london_n or_o a_o speech_n deliver_v in_o common-council_n on_o monday_n the_o 24_o of_o february_n 1644._o my_o lord_n master_n recorder_n have_v full_o and_o faithful_o report_v the_o truth_n in_o show_v the_o little_a success_n or_o good_a that_o after_o three_o day_n debate_n have_v be_v do_v in_o that_o committee_n which_o be_v appoint_v to_o state_n the_o question_n in_o controversy_n between_o the_o alderman_n
