payable_a for_o and_o in_o respect_n of_o any_o composition_n for_o the_o same_o excise_n 12_o car._n 2._o cap._n 23._o rate_n of_o the_o excise_n be_v it_o therefore_o enact_v by_o the_o authority_n aforesaid_a that_o there_o shall_v be_v pay_v unto_o the_o king_n majesty_n his_o heir_n and_o successor_n for_o ever_o hereafter_o in_o recompense_n as_o aforesaid_a the_o several_a rate_n imposition_n duty_n and_o charge_n herein_o after_o express_v and_o in_o manner_n and_o form_n follow_v that_o be_v to_o say_v for_o every_o barrel_n of_o beer_n or_o ale_n above_o six_o shilling_n the_o barrel_n brew_v by_o the_o common_a brewer_n or_o any_o other_o person_n or_o person_n who_o do_v or_o shall_v sell_v or_o tap_v out_o beer_n or_o ale_n public_o or_o private_o to_o be_v pay_v by_o the_o common_a brewer_n or_o by_o such_o other_o person_n or_o person_n respective_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n one_o shilling_n three_o penny_n xv._o d._n for_o every_o barrel_n of_o six_o shilling_n beer_n or_o ale_n or_o under_o brew_v by_o the_o common_a brewer_n or_o any_o other_o person_n or_o person_n who_o do_v or_o shall_v sell_v or_o tap_v out_o such_o beer_n or_o ale_n public_o or_o private_o to_o be_v pay_v by_o the_o say_v common_a brewer_n or_o by_o such_o other_o person_n or_o person_n respective_o as_o aforesaid_a and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n three_o penny_n iij._o d._n for_o all_o cider_n and_o perry_n make_v and_o sell_v by_o retail_n upon_o every_o hogshead_n to_o be_v pay_v by_o the_o retayler_n thereof_o and_o so_o proportionable_o for_o a_o great_a or_o lesser_a measure_n one_o shilling_n three_o penny_n xv._o d._n for_o all_o metheglin_n or_o mead_n sell_v whether_o by_o retail_n or_o otherwise_o to_o be_v pay_v by_o the_o maker_n thereof_o upon_o every_o gallon_n one_o halfpenny_n ob._n for_o every_o barrel_n of_o beer_n common_o call_v vinegar-beer_n brew_v by_o any_o common_a brewer_n in_o any_o common_a brewhouse_n six_o penny_n vi._n d._n for_o every_o gallon_n of_o strong-water_n or_o aquavitae_n make_v and_o sell_v to_o be_v pay_v by_o the_o maker_n thereof_o one_o penny_n i_o d._n for_o every_o barrel_n of_o beer_n or_o ale_n import_v from_o beyond_o the_o sea_n three_o shilling_n iij._o s._n for_o every_o tun_n of_o cider_n or_o perry_n import_v from_o beyond_o the_o sea_n and_o so_o proportionable_o for_o a_o great_a or_o lesser_a quantity_n five_o shilling_n v._o s._n for_o every_o gallon_n of_o spirit_n make_v of_o any_o kind_n of_o wine_n or_o cider_n import_v two_o penny_n ij_o d._n for_o every_o gallon_n of_o strong-water_n perfect_o make_v import_v from_o beyond_o the_o sea_n four_o penny_n iiij_o d._n for_o every_o gallon_n of_o coffee_n make_v and_o sell_v to_o be_v pay_v by_o the_o maker_n four_o penny_n iiij_o d._n for_o every_o gallon_n of_o chocolatte_n sherbet_n and_o tea_n make_v and_o sell_v to_o be_v pay_v by_o the_o maker_n thereof_o eight_o penny_n viij_o d._n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o several_a rate_n land_v rate_n of_o excise_n upon_o foreign_a liquor_n import_v to_o be_v pay_v in_o money_n before_o land_v duty_n and_o charge_n of_o excise_n or_o new_a impost_n above_o mention_v hereby_o set_v or_o impose_v upon_o all_o and_o every_o the_o say_v foreign_a liquor_n which_o shall_v be_v import_v or_o bring_v into_o all_o or_o any_o the_o port_n of_o this_o kingdom_n and_o dominion_n thereof_o aforesaid_a from_o and_o after_o the_o five_o and_o twenty_o day_n of_o december_n next_o shall_v be_v from_o time_n to_o time_n satisfy_v and_o pay_v by_o the_o merchant_n or_o merchant_n importer_n or_o importer_n of_o the_o same_o in_o ready_a money_n upon_o his_o or_o their_o entry_n or_o entry_n make_v and_o before_o the_o land_n thereof_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a etc._n entry_n to_o be_v make_v at_o the_o office_n of_o excise_n by_o common_a brewer_n innkeeper_n etc._n etc._n that_o all_o common_a brewer_n of_o béer_n and_o ale_n shall_v once_o in_o every_o wéek_v and_o all_o inn-kéepers_a alehouse-kéepers_a victualler_n and_o other_o retayler_n of_o béer_n ale_n cider_n perry_n metheglin_n or_o strong-water_n brew_v make_v or_o retail_v the_o same_o shall_v once_o in_o every_o month_n make_v true_a and_o particular_a entry_n at_o the_o office_n of_o excise_n within_o the_o limit_n of_o which_o the_o say_a commodity_n and_o manufacture_n be_v make_v of_o all_o béer_n ale_n perry_n cider_n metheglin_n strong-water_n or_o other_o the_o liquor_n aforesaid_a which_o they_o or_o any_o of_o they_o shall_v brew_n make_v or_o retail_n in_o that_o wéek_v and_o month_n respective_o as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o such_o common_a brewer_n entry_n the_o penalty_n for_o not_o make_v entry_n who_o do_v not_o once_o a_o wéek_v make_v due_a and_o particular_a entry_n shall_v forfeit_v ten_o pound_n and_o that_o every_o such_o inn-kéepe_a who_o do_v not_o make_v true_a and_o particular_a entry_n once_o a_o month_n shall_v forfeit_v five_o pound_n and_o that_o every_o alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o do_v not_o once_o a_o month_n make_v due_a and_o particular_a entry_n shall_v forfeit_v twenty_o shilling_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o common_a brewer_n pay_v the_o penalty_n for_o not_o pay_v who_o shall_v not_o pay_v and_o clear_v off_o
within_o a_o wéek_v after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n and_o that_o every_o inn-kéepe_a alehouse-kéepe_a victualler_n or_o other_o retailer_n who_o shall_v not_o pay_v and_o clear_v off_o within_o a_o month_n after_o he_o make_v his_o entry_n or_o aught_o to_o have_v make_v his_o entry_n as_o aforesaid_a shall_v pay_v double_a the_o value_n of_o the_o duty_n the_o say_v respective_a forfeiture_n to_o be_v levy_v upon_o their_o good_n and_o chattel_n in_o such_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v ordain_v and_o direct_v provide_v that_o no_o such_o person_n as_o aforesaid_a shall_v be_v compel_v by_o the_o commissioner_n or_o sub-commissioner_n of_o excise_n make_v in_o what_o place_n entry_n shall_v be_v make_v to_o travel_v for_o the_o make_n of_o the_o say_a entry_n or_o payment_n of_o the_o say_a duty_n or_o other_o cause_n whatsoever_o touch_v or_o concern_v the_o same_o if_o he_o live_v in_o a_o market_n town_n out_o of_o the_o say_a town_n if_o he_o live_v out_o of_o a_o market_n town_n then_o to_o no_o other_o place_n then_o to_o the_o next_o market_n town_n to_o his_o habitation_n in_o the_o same_o county_n on_o the_o market_n day_n gager_n the_o power_n of_o the_o commiss_n oner_n to_o appoint_v gager_n the_o power_n of_o the_o gager_n and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n who_o shall_v be_v appoint_v by_o his_o majesty_n for_o put_v this_o act_n in_o execution_n and_o their_o sub-commissioner_n in_o their_o respective_a circuit_n and_o division_n shall_v hereby_o have_v power_n to_o constitute_v under_o their_o hand_n and_o seal_n such_o and_o so_o many_o gager_n as_o they_o shall_v find_v needful_a which_o gager_n and_o every_o of_o they_o shall_v at_o all_o time_n as_o well_o by_o night_n as_o by_o day_n and_o if_o by_o night_n then_o in_o the_o presence_n of_o a_o constable_n or_o other_o lawful_a officer_n be_v permit_v upon_o their_o request_n to_o enter_v the_o house_n brewhouse_n distilling-house_n and_o all_o other_o house_n and_o place_n whatsoever_o belong_v to_o or_o use_v by_o any_o brewer_n inn-kéepe_a victualler_n or_o other_o retailer_n of_o béer_n brew_v or_o make_v the_o same_o as_o aforesaid_a or_o by_o any_o distiller_n of_o strong-water_n or_o retailer_n of_o other_o the_o liquor_n aforesaid_a and_o to_o gage_n all_o copper_n fat_n be_v and_o vessel_n in_o the_o same_o and_o to_o take_v a_o account_n of_o béer_o ale_n word_n perry_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a in_o the_o say_a house_n place_n and_o vessel_n from_o time_n to_o time_n brew_v or_o make_v and_o distil_v and_o thereof_o to_o make_v return_n or_o report_n in_o write_v to_o the_o say_a commissioner_n or_o sub-commissioner_n of_o excise_n under_o who_o office_n and_o limit_n such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a do_v dwell_v and_o inhabit_v leave_v a_o true_a copy_n of_o such_o return_n in_o write_v under_o his_o hand_n with_o such_o brewer_n retailer_n distiller_n or_o maker_n of_o the_o liquor_n aforesaid_a and_o such_o report_n or_o return_v of_o the_o say_a gager_n shall_v be_v a_o charge_n upon_o the_o say_a brewer_n maker_n and_o retailer_n respective_o and_o if_o any_o such_o common_a brewer_n maker_n or_o retailer_n shall_v refuse_v to_o permit_v any_o such_o gager_n or_o gagers_n to_o enter_v his_o brewhouse_n or_o any_o other_o place_n aforemention_v or_o to_o gage_n or_o take_v account_n of_o his_o brewing-vessel_n or_o any_o such_o béer_n ale_n word_n perry_n cider_n strong-water_n aquavite_n metheglin_n or_o other_o the_o liquor_n aforesaid_a such_o brewer_n retailer_n or_o distiller_n shall_v be_v forthwith_o forbid_v by_o the_o say_v gager_n or_o gagers_n to_o sell_v carry_v out_o or_o deliver_v to_o any_o of_o his_o customer_n any_o béer_n ale_n strong-water_n aquavite_n or_o other_o the_o liquor_n aforesaid_a and_o if_o any_o such_o brewer_n excise_n penalty_n for_o sell_v etc._n etc._n not_o have_v clear_v the_o excise_n retailer_n or_o distiller_n of_o any_o the_o liquor_n aforesaid_a after_o such_o warning_n give_v shall_v sell_v carry_v or_o deliver_v out_o the_o same_o or_o any_o part_n thereof_o not_o have_v pay_v and_o clear_v the_o duty_n of_o excise_n such_o person_n and_o person_n shall_v beside_o the_o forfeiture_n of_o double_a the_o value_n forfeit_v and_o lose_v the_o sum_n of_o ten_o pound_n as_o aforesaid_a for_o every_o offence_n to_o be_v levy_v and_o recover_v upon_o his_o or_o their_o good_n and_o chattel_n in_o manner_n and_o form_n as_o hereafter_o in_o this_o act_n be_v provide_v gager_n proportion_n to_o be_v observe_v in_o return_n of_o gager_n and_o for_o the_o avoid_n of_o all_o incertainty_n and_o dispute_v touch_v the_o return_n make_v or_o to_o be_v make_v by_o the_o gager_n of_o any_o béer_n or_o ale_n so_o brew_v as_o aforesaid_a be_v it_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o every_o six_o and_o thirty_o gallon_n of_o béer_o take_v by_o the_o gage_n according_a to_o the_o standard_n of_o the_o ale-quart_n four_o whereof_o shall_v make_v the_o gallon_n remain_v in_o the_o custody_n of_o the_o chamberlain_n of_o his_o majesty_n exchequer_n shall_v be_v reckon_v account_v and_o return_v by_o the_o gager_n for_o a_o barrel_n of_o béer_o and_o every_o two_o and_o thirty_o gallon_n of_o ale_n take_v by_o the_o gage_n according_a to_o the_o same_o standard_n shall_v be_v in_o like_a manner_n reckon_v account_v and_o return_v for_o a_o barrel_n of_o ale_n and_o all_o other_o the_o liquor_n aforesaid_a according_a to_o the_o wine-gallon_n prize_n brewer_n and_o retailer_n to_o observe_v the_o usual_a rate_n and_o prize_n provide_v always_o and_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o brewer_n or_o retailer_n of_o béer_n and_o ale_n shall_v take_v any_o more_o in_o the_o price_n thereof_o upon_o sale_n of_o the_o same_o then_o according_a to_o the_o usual_a rate_n and_o price_n save_v that_o every_o common_a brewer_n shall_v and_o may_v take_v and_o receive_v of_o all_o and_o every_o person_n and_o person_n to_o who_o he_o shall_v sell_v and_o deliver_v any_o béer_n or_o ale_n the_o excise_n thereupon_o due_a as_o aforesaid_a over_o and_o above_o the_o usual_a rate_n and_o prize_n entry_n encouragement_n to_o brewer_n to_o make_v true_a entry_n and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o for_o the_o better_a encouragement_n of_o all_o common_a brewer_n or_o maker_n of_o béer_n or_o ale_n to_o make_v due_a entry_n and_o payment_n thereof_o according_a as_o by_o this_o act_n be_v appoint_v the_o say_v common_a brewer_n not_o sell_v the_o same_o by_o retail_n for_o and_o in_o consideration_n of_o waste_n by_o filling_n and_o leakage_n of_o their_o béer_n and_o ale_n shall_v have_v and_o be_v allow_v out_o of_o the_o say_v return_v make_v by_o the_o gager_n leakage_n allowance_n for_o waste_n and_o leakage_n the_o several_a allowance_n and_o abatement_n hereafter_o mention_v that_o be_v to_o say_v upon_o every_o three_o and_o twenty_o barrel_n of_o beer_n whether_o strong_a or_o small_a return_v by_o the_o say_a gager_n three_o barrel_n and_o upon_o every_o two_o and_o twenty_o barrel_n of_o ale_n whether_o strong_a or_o small_a return_v by_o the_o gager_n two_o barrel_n which_o say_v allowance_n and_o abatement_n the_o say_v commissioner_n to_o be_v appoint_v as_o aforesaid_a and_o their_o sub-commissioner_n be_v hereby_o authorize_v to_o allow_v and_o make_v according_o entry_n forfeiture_n for_o make_v false_a entry_n provide_v always_o that_o where_o any_o common_a brewer_n shall_v witting_o or_o willing_o make_v a_o false_a entry_n and_o be_v convict_v for_o the_o same_o before_o the_o commissioner_n to_o be_v appoint_v as_o aforesaid_a or_o any_o two_o of_o they_o or_o before_o such_o other_o person_n or_o person_n as_o be_v hereafter_o by_o this_o act_n appoint_v in_o that_o case_n such_o brewer_n or_o brewer_n shall_v forfeit_v and_o lose_v over_o and_o beside_o the_o penalty_n before_o mention_v the_o say_a allowance_n so_o to_o be_v make_v for_o six_o month_n then_o next_o ensue_v retailer_n no_o beer_n etc._n etc._n to_o be_v deliver_v by_o the_o brewer_n until_o the_o excise_n be_v pay_v by_o the_o retailer_n and_o be_v it_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a that_o no_o béer_n or_o ale_n shall_v be_v deliver_v in_o by_o such_o brewer_n or_o maker_n thereof_o to_o any_o victualler_n or_o any_o retailer_n thereof_o until_o the_o rate_n which_o by_o such_o victualler_n or_o retailer_n be_v to_o be_v pay_v over_o and_o above_o the_o price_n of_o the_o say_v béer_o or_o ale_n for_o or_o in_o respect_n
warden_n and_o fifteen_o assistant_n shall_v be_v choose_v upon_o the_o same_o day_n yearly_a within_o the_o city_n of_o norwich_n or_o county_n of_o norfolk_n in_o some_o public_a place_n by_o the_o master-weaver_n or_o the_o great_a part_n of_o they_o present_a of_o the_o county_n of_o norfolk_n and_o the_o say_a warden_n respective_o shall_v within_o fourtéen_v day_n after_o they_o shall_v be_v so_o choose_v or_o elect_v and_o notice_n thereof_o give_v take_v the_o oath_n ensue_v to_o be_v administer_v by_o the_o mayor_n of_o the_o say_a city_n for_o the_o time_n be_v or_o his_o deputy_n and_o the_o steward_n of_o the_o duchy_n of_o lancaster_n within_o the_o the_o say_a county_n for_o the_o time_n be_v if_o it_o shall_v happen_v the_o say_a steward_n shall_v be_v there_o present_a or_o else_o before_o the_o say_a mayor_n or_o his_o deputy_n only_o which_o oath_n they_o and_o every_o of_o they_o be_v hereby_o authorize_v and_o require_v from_o time_n to_o time_n to_o of_o they_o within_o the_o time_n aforesaid_a shall_v take_v the_o like_a oath_n before_o such_o person_n or_o person_n before_o who_o the_o warden_n shall_v be_v swear_v for_o the_o execution_n of_o that_o office_n of_o a_o assistant_n and_o that_o if_o it_o shall_v happen_v that_o any_o of_o the_o say_a warden_n who_o shall_v be_v so_o choose_v shall_v refuse_v to_o take_v the_o say_a oath_n or_o after_o he_o be_v swear_v shall_v die_v before_o the_o end_n of_o the_o year_n that_o then_o from_o time_n to_o time_n so_o often_o as_o need_n shall_v be_v it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o master-weaver_n of_o the_o say_a city_n county_n of_o the_o city_n of_o norwich_n and_o county_n of_o norfolk_n respective_o as_o the_o cause_n shall_v require_v to_o choose_v other_o warden_n or_o warden_n in_o the_o place_n of_o he_o or_o they_o so_o die_v or_o refuse_v who_o shall_v be_v swear_v in_o such_o manner_n as_o aforesaid_a execution_n the_o power_n in_o this_o act_n for_o regulation_n of_o trade_n to_o be_v put_v in_o execution_n and_o for_o the_o regulation_n and_o good_a government_n of_o the_o say_a trade_n and_o manufacture_n the_o say_a warden_n and_o assistant_n or_o any_o thirtéen_n of_o they_o whereof_z seven_z to_o be_v warden_n shall_v and_o may_v from_o time_n to_o time_n meet_v and_o consult_v together_o for_o the_o good_a and_o benefit_n of_o the_o say_a trade_n and_o manufacture_n and_o for_o due_a execution_n of_o the_o power_n and_o authority_n give_v by_o this_o act_n so_o often_o as_o to_o they_o shall_v seem_v expedient_a or_o when_o it_o shall_v be_v desire_v by_o eight_o or_o more_o of_o the_o say_a assistant_n at_o the_o place_n call_v weaver_n hall_n in_o the_o say_a city_n order_n power_n to_o make_v by-law_n and_o order_n or_o at_o such_o other_o place_n as_o they_o shall_v think_v fit_a and_o that_o any_o thirtéen_n or_o more_o of_o the_o say_a warden_n and_o assistant_n whereof_o seven_o at_o the_o least_o to_o be_v warden_n shall_v have_v and_o hereby_o have_v power_n and_o authority_n from_o time_n to_o time_n so_o often_o as_o need_n shall_v require_v to_o make_v and_o ordain_v by-law_n rule_n and_o ordinance_n for_o and_o concern_v the_o regulation_n of_o the_o lay_v worsted-stuffs_a and_o other_o stuff_v now_o make_v and_o which_o hereafter_o shall_v be_v make_v within_o the_o say_a city_n and_o county_n of_o the_o city_n of_o norwich_n and_o county_n of_o norfolk_n and_o in_o either_o of_o they_o both_o in_o length_n breadth_n and_o goodness_n and_o of_o such_o other_o particular_n as_o shall_v by_o the_o say_a warden_n and_o assistant_n so_o meet_v or_o the_o great_a number_n of_o they_o from_o time_n to_o time_n be_v adjudge_v requisite_a for_o the_o better_a regulate_v the_o say_a trade_n and_o manufacture_n and_o the_o artificer_n of_o the_o same_o in_o the_o due_a execution_n of_o this_o act_n and_o to_o make_v seal_n from_o time_n to_o time_n for_o the_o seal_n of_o the_o same_o stuff_n which_o by-law_n rule_n and_o ordinance_n be_v ratify_v and_o confirm_v by_o the_o mayor_n and_o two_o justice_n of_o the_o peace_n of_o the_o say_a city_n and_o county_n of_o norwich_n for_o the_o time_n be_v and_o three_o other_o justice_n of_o peace_n of_o the_o say_a county_n of_o norfolk_n whereof_z one_o to_o be_v of_o the_o quorum_fw-la shall_v be_v publish_v four_o time_n in_o the_o year_n at_o the_o least_o yearly_o to_o be_v publish_v at_o four_o assembly_n to_o be_v hold_v yearly_o at_o four_o public_a assembly_n for_o the_o say_a trade_n and_o manufacture_n and_o shall_v be_v obey_v and_o keep_v by_o the_o several_a person_n within_o and_o under_o the_o say_a regulation_n order_n the_o penalty_n upon_o offender_n against_o such_o by-law_n and_o order_n and_o the_o say_a warden_n and_o assistant_n shall_v have_v and_o hereby_o have_v power_n to_o impose_v a_o fine_a or_o penalty_n upon_o any_o person_n or_o person_n under_o such_o regulation_n as_o shall_v not_o conform_v to_o such_o rule_n order_n and_o ordinance_n so_o make_v and_o to_o be_v make_v and_o confirm_v as_o aforesaid_a provide_v that_o the_o say_v fine_a or_o penalty_n upon_o any_o person_n for_o not_o conform_v as_o aforesaid_a shall_v not_o excee_v the_o sum_n of_o ten_o shilling_n for_o any_o one_o offence_n norfolk_n notice_n of_o meeting_n by_o the_o city_n of_o norwich_n to_o be_v give_v to_o the_o warden_n of_o the_o county_n of_o norfolk_n and_o it_o be_v further_o enact_v that_o the_o warden_n and_o assistant_n of_o the_o say_a city_n and_o county_n of_o the_o city_n of_o norwich_n shall_v from_o time_n to_o time_n give_v personal_a notice_n unto_o the_o warden_n of_o the_o say_a county_n of_o norfolk_n or_o two_o of_o they_o at_o the_o least_o of_o the_o sealing-hall_n fourtéen_a day_n at_o the_o least_o before_o they_o shall_v procee_v to_o the_o make_v the_o same_o to_o the_o end_n that_o such_o of_o the_o say_a country_n weaver_n as_o be_v therein_o concern_v may_v be_v there_o present_a and_o for_o the_o better_a regulation_n and_o carry_v on_o the_o work_n aforesaid_a and_o for_o avoid_v of_o all_o fraud_n and_o deceit_n therein_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o yarn_v call_v worsted_n yarns_n and_o such_o other_o yarn_v as_o be_v common_o use_v by_o the_o worsted_n weaver_n shall_v be_v make_v without_o fraud_n make_v yarn_v call_v worsted_n yarn_v how_o to_o be_v make_v and_o shall_v be_v réele_v on_o a_o réel_n of_o a_o full_a yard_n about_o and_o every_o réel-staff_n shall_v contain_v fourtéen_v lea_n and_o every_o lea_n forty_o thread_n twelve_o of_o which_o réel-staff_n shall_v make_v a_o dozen_o and_o twelve_o of_o those_o dozen_o shall_v make_v a_o gross_a and_o in_o case_n any_o person_n or_o person_n shall_v sell_v or_o expose_v to_o sale_n any_o of_o the_o say_a yarn_n make_v and_o réele_v in_o any_o other_o manner_n than_o as_o be_v aforesaid_a that_o then_o every_o such_o person_n or_o person_n shall_v forfeit_v the_o moiety_n of_o the_o value_n of_o the_o say_a yarn_n to_o the_o use_n of_o the_o say_a trade_n and_o manufacture_n after_o charge_n of_o suit_n and_o of_o prosecution_n first_o deduct_v out_o of_o the_o same_o which_o forfeiture_n shall_v be_v recover_v by_o action_n of_o debt_n bill_n plaint_n indictment_n or_o information_n in_o any_o of_o the_o king_n majesty_n court_n of_o record_n wherein_o no_o wager_n of_o law_n essoyn_n or_o protection_n shall_v be_v allow_v for_o the_o defendant_n market_n view_n and_o search_v to_o be_v make_v of_o manufacture_n in_o fair_n and_o market_n and_o that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o warden_n and_o assistant_n of_o the_o say_a trade_n and_o manufacture_n or_o any_o two_o of_o they_o from_o time_n to_o time_n to_o view_n and_o search_v in_o all_o fair_n and_o market_n and_o other_o public_a place_n of_o sale_n of_o yarn_n within_o the_o say_a city_n of_o norwich_n and_o county_n of_o the_o same_o and_o county_n of_o norfolk_n and_o either_o of_o they_o all_o yarn_n which_o be_v there_o expose_v to_o sale_n and_o such_o of_o the_o say_a yarn_n as_o they_o shall_v find_v defective_a contrary_a to_o the_o rule_n herein_o
be_v lawful_a for_o the_o say_a commissioner_n for_o the_o time_n be_v or_o any_o seven_o or_o more_o of_o they_o from_o time_n to_o time_n and_o at_o all_o time_n to_o assess_v tax_n or_o sum_n of_o money_n upon_o the_o say_v ninety_o five_o thousand_o acre_n for_o the_o raise_n money_n for_o draining_n the_o same_o again_o in_o such_o proportion_n as_o they_o or_o any_o seven_o or_o more_o of_o they_o shall_v think_v fit_a together_o with_o a_o penalty_n for_o not_o pay_v the_o say_a tax_n the_o say_a penalty_n not_o exceed_a a_o three_o part_n of_o such_o tax_n penalty_n how_o land_n may_v be_v sell_v for_o nonpayment_n of_o tax_n or_o penalty_n and_o for_o default_n of_o payment_n of_o the_o say_a tax_n or_o sum_n of_o money_n and_o penalty_n be_v it_o enact_v that_o the_o lot_n and_o share_v of_o such_o participant_a or_o adventurer_n of_o and_o within_o the_o say_v ninety_o five_o thousand_o acre_n as_o shall_v be_v in_o arrear_n for_o the_o say_a tax_n sum_n of_o money_n or_o penalty_n and_o unpaid_a by_o the_o space_n of_o two_o month_n next_o after_o the_o day_n appoint_v for_o payment_n by_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o or_o so_o much_o thereof_o as_o they_o shall_v think_v fit_a shall_v be_v sequester_v by_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o for_o or_o towards_o the_o payment_n of_o such_o tax_n sum_n of_o money_n or_o penalty_n so_o in_o arrear_n restore_v the_o overplus_n of_o the_o money_n for_o which_o such_o lot_n or_o share_v or_o any_o part_n thereof_o shall_v be_v sequester_v if_o any_o be_v which_o sequestration_n shall_v be_v make_v in_o write_v under_o the_o hand_n and_o seal_n of_o the_o say_a commissioner_n for_o the_o time_n be_v or_o any_o seven_o or_o more_o of_o they_o provide_v always_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o in_o case_n the_o say_a governor_n bailiff_n and_o corporation_n constitute_v by_o this_o act_n shall_v neglect_v or_o refuse_v to_o pay_v such_o tax_n or_o tax_n and_o penalty_n sum_n or_o sum_n of_o money_n as_o shall_v from_o time_n to_o time_n hereafter_o be_v tax_v and_o impose_v by_o the_o say_a commissioner_n before_o name_v or_o to_o be_v name_v by_o virtue_n of_o this_o act_n or_o any_o seven_o or_o more_o of_o they_o pursuant_n to_o the_o power_n give_v they_o by_o this_o act_n whereupon_o the_o good_n and_o chattel_n of_o any_o person_n or_o person_n his_o or_o their_o tenant_n or_o tenant_n of_o and_o in_o the_o say_v ninety_o five_o thousand_o acre_n or_o any_o part_n thereof_o shall_v be_v distrain_v or_o sell_v or_o he_o or_o their_o land_n sequester_v for_o the_o payment_n thereof_o or_o that_o such_o person_n or_o person_n his_o or_o their_o tenant_n or_o tenant_n shall_v thereupon_o pay_v the_o say_a tax_n and_o tax_n and_o penalty_n so_o assess_v and_o impose_v as_o aforesaid_a that_o then_o the_o say_a governor_n bailiff_n and_o corporation_n immediate_o from_o and_o after_o notice_n to_o he_o or_o they_o give_v thereof_o shall_v assess_v and_o tax_v the_o whole_a ninety_o five_o thousand_o acre_n for_o the_o satisfaction_n and_o payment_n of_o the_o tax_n tax_n and_o penalty_n sum_n and_o sum_n of_o money_n and_o all_o damage_n that_o such_o person_n or_o person_n his_o or_o their_o tenant_n or_o tenant_n have_v or_o have_v pay_v bear_v or_o sustain_v as_o aforesaid_a and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o the_o say_a governor_n bailiff_n and_o corporation_n shall_v not_o within_o six_o month_n next_o after_o demand_v make_v by_o such_o person_n or_o person_n his_o and_o their_o heir_n executor_n and_o administrator_n who_o own_o or_o tenant_n or_o tenant_n good_n and_o chattel_n shall_v be_v distrain_v or_o sell_v or_o land_n sequester_v as_o aforesaid_a pay_v and_o satisfy_v unto_o he_o or_o they_o such_o sum_n and_o sum_n of_o money_n and_o damage_n as_o he_o or_o they_o and_o his_o and_o their_o respective_a tenant_n or_o tenant_n have_v respective_o pay_v bear_v and_o sustain_v that_o then_o and_o from_o thenceforth_o such_o person_n and_o person_n his_o and_o their_o heir_n and_o assign_v shall_v and_o may_v bring_v he_o and_o their_o action_n or_o action_n of_o debt_n in_o any_o of_o the_o king_n majesty_n court_n at_o westminster_n against_o the_o say_a governor_n bailiff_n and_o corporation_n for_o the_o recovery_n thereof_o and_o by_o virtue_n of_o this_o act_n shall_v recover_v the_o same_o and_o be_v allow_v cost_v of_o suit_n expend_v therein_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o commissioner_n so_o constitute_v or_o to_o be_v hereafter_o constitute_v as_o aforesaid_a or_o any_o seven_o or_o more_o of_o they_o for_o the_o better_a execution_n of_o the_o power_n hereby_o give_v shall_v &_o may_v inform_v themselves_o by_o examine_v witness_n upon_o oath_n which_o hereby_o they_o or_o any_o seven_o or_o more_o of_o they_o shall_v have_v power_n to_o administer_v due_a execution_n of_o all_o every_o or_o any_o the_o power_n or_o authority_n hereby_o give_v they_o &_o for_o the_o do_v justice_n therein_o according_o oath_n the_o commissioner_n to_o take_v a_o oath_n provide_v always_o that_o the_o say_a commissioner_n and_o every_o of_o they_o before_o he_o or_o they_o take_v upon_o he_o or_o they_o the_o execution_n of_o any_o the_o power_n or_o authority_n hereby_o give_v they_o other_o than_o the_o administer_a the_o oath_n follow_v to_o one_o another_o which_o they_o shall_v have_v authority_n by_o this_o present_a act_n to_o administer_v to_o one_o another_o shall_v take_v the_o oath_n follow_v viz._n i_o a._n b._n shall_v and_o will_v without_o favour_n or_o affection_n hatred_n or_o malice_n true_o and_o impartial_o according_a to_o the_o best_a of_o my_o skill_n and_o knowledge_n execute_v and_o perform_v all_o and_o every_o the_o power_n and_o authority_n establish_v by_o this_o act_n of_o parliament_n which_o oath_n any_o one_o of_o the_o say_a commissioner_n be_v hereby_o authorize_v to_o administer_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o judgement_n order_n decree_n determination_n alteration_n change_n restauration_n and_o other_o act_n do_v by_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a or_o of_o any_o seven_o or_o more_o of_o they_o respective_o pursuant_n to_o the_o power_n and_o authority_n by_o this_o act_n give_v shall_v be_v final_a and_o that_o the_o first_o time_n and_o place_n of_o their_o meeting_n shall_v be_v at_o or_o before_o the_o two_o and_o twenty_o day_n of_o september_n in_o the_o year_n of_o our_o lord_n one_o thousand_o six_o hundred_o sixty_o and_o three_o at_o ely_n and_o that_o afterward_o the_o usual_a place_n where_o the_o say_v commissioner_n shall_v sit_v to_o hear_v order_n sit_v the_o place_n where_o the_o commissioner_n shall_v sit_v and_o determine_v the_o matter_n to_o they_o refer_v by_o this_o act_n shall_v from_o the_o 29_o of_o september_n to_o the_o 26_o day_n of_o march_n in_o every_o year_n be_v at_o the_o town_n of_o huntingdon_n and_o from_o the_o 25_o day_n of_o march_n till_o the_o 30_o day_n of_o september_n in_o every_o year_n be_v at_o ely_n unless_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a or_o any_o seven_o or_o more_o of_o they_o shall_v appoint_v some_o other_o place_n or_o place_n be_v a_o market_n town_n or_o town_n and_o the_o say_a commissioner_n or_o any_o seven_o or_o more_o of_o they_o shall_v by_o warrant_n under_o their_o hand_n and_o seal_n declare_v the_o place_n and_o time_n of_o their_o after-méeting_n which_o warrant_n shall_v be_v publish_v in_o the_o open_a market_n of_o such_o respective_a place_n where_o they_o last_o sit_v between_o the_o hour_n of_o twelve_o &_o two_o upon_o some_o market_n day_n one_o month_n at_o the_o least_o before_o the_o say_a time_n or_o time_n of_o meeting_n to_o the_o end_n all_o person_n concern_v may_v have_v sufficient_a time_n and_o notice_n to_o make_v their_o appearance_n before_o they_o upon_o any_o cause_n of_o complaint_n or_o other_o occasion_n and_o shall_v have_v power_n and_o authority_n by_o warrant_n under_o the_o hand_n and_o seal_n of_o any_o seven_o or_o more_o of_o they_o to_o summon_v party_n and_o witness_n to_o appear_v before_o they_o provide_v that_o none_o of_o the_o say_a commissioner_n hereby_o constitute_v or_o hereafter_o to_o be_v constitute_v as_o aforesaid_a shall_v vote_n or_o give_v his_o judgement_n or_o determination_n in_o any_o matter_n or_o thing_n which_o concern_v the_o division_n and_o bound_n of_o the_o county_n of_o or_o for_o which_o he_o be_v appoint_v commissioner_n provide_v also_o that_o no_o person_n who_o
this_o act_n in_o the_o exercise_n of_o religion_n differ_v from_o the_o rite_n of_o the_o church_n of_o england_n then_o every_o such_o keeper_n of_o a_o gaol_n or_o house_n of_o correction_n shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o pound_n to_o be_v levy_v raise_v and_o dispose_a by_o such_o person_n penalty_n the_o penalty_n and_o in_o such_o manner_n as_o the_o penalty_n for_o the_o first_o and_o second_o offence_n against_o this_o act_n be_v to_o be_v levy_v raise_v and_o dispose_a provide_v always_o that_o no_o person_n shall_v be_v punish_v for_o any_o offence_n against_o this_o act_n prosecute_v within_o what_o time_n offender_n must_v be_v prosecute_v unless_o such_o offender_n be_v prosecute_v for_o the_o same_o within_o three_o month_n after_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o provide_v also_o and_o be_v it_o enact_v punish_v marry_a woman_n how_o to_o be_v punish_v that_o judgement_n of_o transportation_n shall_v not_o be_v give_v against_o any_o feme-covert_a unless_o her_o husband_n be_v at_o the_o same_o time_n under_o the_o like_a judgement_n and_o not_o discharge_v by_o the_o payment_n of_o money_n as_o aforesaid_a but_o that_o instead_o thereof_o she_o shall_v by_o the_o respective_a court_n be_v commit_v to_o the_o goal_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_a twelve_o month_n unless_o her_o husband_n shall_v pay_v down_o such_o sum_n not_o exceed_a forty_o pound_n to_o redéem_v she_o from_o imprisonment_n as_o shall_v be_v impose_v by_o the_o say_a court_n the_o say_a sum_n to_o be_v dispose_v by_o such_o person_n and_o in_o such_o manner_n as_o the_o penalty_n for_o the_o first_o and_o second_o offence_n against_o this_o act_n be_v to_o be_v dispose_v provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n of_o the_o peace_n conventicle_n how_o justice_n of_o the_o peace_n may_v enter_v into_o house_n suspect_v for_o conventicle_n and_o chief_a magistrate_n respective_o impower_v as_o aforesaid_a to_o put_v this_o act_n in_o execution_n shall_v and_o may_v with_o what_o aid_n force_n and_o assistance_n they_o shall_v think_v fit_a for_o the_o better_a execution_n of_o this_o act_n after_o refusal_n or_o denial_n enter_v into_o any_o house_n or_o other_o place_n where_o they_o shall_v be_v inform_v and_o such_o conventicle_n as_o aforesaid_a be_v or_o shall_v be_v hold_v provide_v that_o no_o dwellinghouse_n of_o any_o péer_n of_o this_o realm_n peer_n the_o house_n of_o peer_n whilst_o he_o or_o his_o wife_n shall_v be_v there_o resident_a shall_v be_v search_v by_o virtue_n of_o this_o act_n but_o by_o immediate_a warrant_n from_o his_o majesty_n under_o his_o sign_n manual_n or_o in_o the_o presence_n of_o the_o lieutenant_n or_o one_o of_o the_o deputy-lieutenant_n or_o two_o justice_n of_o the_o peace_n whereof_o one_o to_o be_v of_o the_o quorum_fw-la of_o the_o same_o county_n or_o ride_v nor_o shall_v any_o other_o dwellinghouse_n of_o any_o péer_n or_o other_o person_n whatsoever_o be_v enter_v into_o with_o force_n by_o virtue_n of_o this_o act_n but_o in_o the_o presence_n of_o one_o justice_n of_o the_o peace_n or_o chief_a magistrate_n respective_o except_o within_o the_o city_n of_o london_n where_o it_o shall_v be_v lawful_a for_o any_o such_o other_o dwellinghouse_n to_o be_v enter_v into_o as_o aforesaid_a in_o the_o presence_n of_o one_o justice_n of_o the_o peace_n alderman_n deputy-alderman_n or_o any_o one_o commissioner_n of_o the_o lieutenancy_n for_o the_o city_n of_o london_n provide_v also_o and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a correction_n what_o person_n may_v be_v not_o commit_v to_o the_o house_n of_o correction_n that_o no_o person_n shall_v by_o virtue_n of_o this_o act_n be_v commit_v to_o the_o house_n of_o correction_n that_o shall_v satisfy_v the_o say_a justice_n of_o the_o peace_n or_o chief_a magistrate_n respective_o that_o he_o or_o she_o and_o in_o case_n of_o a_o feme-covert_a that_o her_o husband_n have_v a_o estate_n of_o frée-hold_a or_o copyhold_n to_o the_o value_n of_o five_o pound_n per_fw-la annum_fw-la or_o personal_a estate_n to_o the_o value_n of_o fifty_o pound_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o and_o in_o regard_n a_o certain_a sect_n call_v quaker_n and_o other_o sectary_n 1._o person_n serve_v with_o process_n refuse_v to_o take_v a_o oath_n 14_o car._n 2._o cap._n 1._o be_v find_v not_o only_o to_o offend_v in_o the_o matter_n provide_v against_o by_o this_o act_n but_o also_o to_o obstruct_v the_o proceed_v of_o justice_n by_o their_o obstinate_a refusal_n to_o take_v oath_n lawful_o tender_v unto_o they_o in_o the_o ordinary_a course_n of_o law_n therefore_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n be_v due_o and_o legal_o serve_v with_o process_n or_o other_o summons_n to_o appear_v in_o any_o court_n of_o record_n except_o courts-léet_a as_o a_o witness_n or_o return_v to_o serve_v of_o any_o jury_n or_o order_v to_o be_v examine_v upon_o interrogatory_n or_o be_v present_a in_o court_n shall_v refuse_v to_o take_v any_o judicial_a oath_n legal_o tender_v to_o he_o by_o the_o judge_n or_o judge_n of_o the_o same_o court_n have_v no_o legal_a plea_n to_o justify_v or_o excuse_v the_o refusal_n of_o the_o same_o oath_n or_o if_o any_o person_n or_o person_n be_v due_o serve_v with_o process_n to_o answer_v any_o bill_n exhibit_v against_o he_o or_o they_o in_o any_o court_n of_o equity_n or_o any_o suit_n in_o any_o court_n ecclesiastical_a shall_v refuse_v to_o answer_v such_o bill_n or_o suit_n upon_o his_o or_o their_o corporal_a oath_n in_o case_n where_o the_o law_n require_v such_o answer_n to_o be_v put_v in_o upon_o oath_n or_o be_v summon_v to_o be_v a_o witness_n in_o any_o such_o court_n or_o order_v to_o be_v examine_v upon_o interrogatory_n shall_v for_o any_o cause_n or_o reason_n not_o allow_v by_o law_n refuse_v to_o take_v such_o oath_n as_o in_o such_o case_n be_v require_v by_o law_n that_o then_o and_o in_o such_o case_n the_o several_a and_o respective_a court_n wherein_o such_o refusal_n shall_v be_v make_v shall_v be_v penalty_n the_o penalty_n and_o be_v hereby_o enable_v to_o record_n enter_v or_o register_v such_o refusal_n which_o record_n or_o entry_n shall_v be_v and_o be_v hereby_o make_v a_o conviction_n of_o such_o offence_n and_o all_o and_o every_o person_n and_o person_n so_o as_o aforesaid_a offend_n shall_v for_o every_o such_o offence_n incur_v the_o judgement_n and_o punishment_n of_o transportation_n in_o such_o manner_n as_o be_v appoint_v by_o this_o act_n for_o other_o offence_n provide_v always_o that_o if_o any_o the_o person_n or_o person_n aforesaid_a shall_v come_v into_o such_o court_n acquit_v how_o such_o person_n may_v be_v acquit_v and_o take_v he_o or_o their_o oath_n in_o these_o word_n i_o do_v swear_v that_o i_o do_v not_o hold_v the_o take_n of_o a_o oath_n to_o be_v unlawful_a nor_o refuse_v to_o take_v aâ—_n oath_n on_o that_o account_n which_o oath_n the_o respective_a court_n and_o court_n aforesaid_a be_v hereby_o authorize_v and_o require_v forthwith_o to_o tender_a administer_v and_o register_v before_o the_o entry_n of_o the_o conviction_n aforesaid_a or_o shall_v take_v such_o oath_n before_o some_o justice_n of_o the_o peace_n who_o christ-church_n without_o the_o consent_n of_o the_o lord_n bishop_n of_o sarum_n the_o mayor_n and_o recorder_n of_o the_o say_a city_n for_o the_o time_n be_v and_o the_o three_o ancient_a alderman_n of_o the_o say_a city_n or_o three_o of_o they_o first_o have_v and_o obtain_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a haven_n river_n channel_n commissioner_n the_o river_n havens_n etc._n etc._n to_o be_v under_o the_o survey_n of_o the_o undertaker_n and_o commissioner_n trench_n and_o all_o wear_v wharf_n sash_n lock_n turnpike_n person_n shall_v brew_v and_o sell_v by_o retail_v any_o small_a quantity_n of_o béer_n or_o ale_n in_o any_o fair_a within_o this_o realm_n fair_n proviso_n for_o beer_n and_o ale_n sell_v in_o fair_n or_o dominion_n aforesaid_a who_o be_v not_o otherwise_o any_o common_a or_o usual_a brewer_n or_o retailer_n thereof_o and_o shall_v before_o any_o such_o sell_v and_o retail_v thereof_o city_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o as_o may_v be_v for_o the_o great_a benefit_n and_o advantage_n of_o the_o say_a receipt_n so_o as_o the_o same_o excee_v not_o the_o term_n of_o three_o year_n and_o be_v it_o further_o enact_v that_o every_o such_o contract_n bargain_n and_o agreement_n of_o the_o lord_n treasurer_n or_o commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a on_o behalf_n of_o his_o majesty_n on_o the_o one_o part_n and_o the_o person_n or_o person_n farm_v on_o the_o other_o part_n shall_v be_v good_a and_o effectual_a in_o law_n to_o all_o intent_n and_o purpose_n provide_v always_o to_o the_o end_n the_o aforesaid_a duty_n may_v be_v pay_v with_o most_o ease_n to_o the_o people_n county_n person_n to_o be_v approve_v by_o the_o justice_n of_o the_o peace_n etc._n etc._n within_o six_o month_n to_o have_v the_o refusal_n of_o contract_n for_o the_o excise_n in_o these_o respective_a county_n it_o be_v hereby_o further_o enact_v that_o the_o lord_n treasurer_n commissioner_n of_o the_o treasury_n or_o other_o person_n aforesaid_a shall_v not_o within_o six_o month_n after_o the_o commencement_n of_o this_o act_n treat_v conclude_v or_o agree_v with_o any_o person_n or_o person_n touch_v the_o farm_n of_o this_o duty_n upon_o béer_n and_o ale_n in_o any_o the_o respective_a county_n or_o place_n of_o this_o realm_n or_o dominion_n thereof_o other_o then_o with_o such_o person_n or_o person_n as_o by_o the_o justice_n of_o peace_n of_o the_o say_a county_n or_o place_n or_o the_o major_a part_n of_o they_o at_o their_o public_a quarter_n session_n shall_v be_v nominate_v and_o appoint_v in_o that_o behalf_n which_o person_n or_o person_n be_v to_o have_v the_o first_o refusal_n of_o any_o such_o farm_n respective_o and_o may_v take_v the_o same_o any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o provide_v that_o the_o say_a duty_n shall_v not_o be_v let_v to_o any_o person_n or_o person_n then_o to_o the_o person_n or_o person_n recommend_v by_o the_o justice_n under_o the_o rate_n that_o it_o shall_v be_v tender_v to_o and_o refuse_v by_o such_o person_n or_o person_n so_o recommend_v and_o be_v it_o further_o enact_v and_o ordain_v by_o the_o authority_n aforesaid_a determine_v forfeiture_n and_o offence_n within_o this_o act_n how_o to_o be_v determine_v that_o all_o forfeiture_n and_o offence_n make_v do_v and_o commit_v against_o this_o act_n or_o any_o clause_n or_o article_n therein_o contain_v shall_v be_v hear_v adjudge_v and_o determine_v by_o such_o person_n or_o person_n and_o in_o such_o manner_n and_o form_n as_o hereafter_o in_o and_o by_o this_o act_n be_v direct_v and_o appoint_v that_o be_v to_o say_v all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o the_o immediate_a limit_n of_o the_o chief_a office_n in_o london_n shall_v be_v hear_v london_n london_n adjudge_v and_o determine_v by_o the_o say_v chief_a commissioner_n and_o governor_n of_o excise_n appoint_v by_o his_o majesty_n or_o the_o major_a part_n of_o they_o or_o by_o the_o commissioner_n for_o appeal_n and_o regulate_v of_o this_o duty_n or_o the_o major_a part_n of_o they_o in_o case_n of_o appeal_n and_o not_o otherwise_o kingdom_n county_n city_n etc._n etc._n within_o this_o kingdom_n and_o all_o such_o forfeiture_n and_o offence_n make_v and_o commit_v within_o all_o or_o any_o other_o the_o county_n city_n town_n or_o place_n within_o this_o kingdom_n or_o dominion_n thereof_o shall_v be_v hear_v and_o determine_v by_o any_o two_o or_o more_o of_o the_o justice_n of_o the_o peace_n reside_v near_o to_o the_o place_n where_o such_o forfeiture_n shall_v be_v make_v or_o offence_n commit_v justice_n neglect_v of_o the_o justice_n and_o in_o case_n of_o neglect_n or_o refusal_n of_o such_o justice_n of_o the_o peace_n by_o the_o space_n of_o fourtéen_a day_n next_o after_o complaint_n make_v and_o notice_n thereof_o give_v to_o the_o offender_n than_o the_o sub-commissioner_n or_o the_o major_a part_n appoint_v for_o any_o such_o city_n county_n town_n or_o place_n shall_v and_o be_v hereby_o impower_v to_o hear_v and_o determine_v the_o same_o and_o if_o the_o party_n find_v himself_o aggrieve_v by_o the_o judgement_n give_v by_o the_o say_a sub-commissioner_n he_o shall_v and_o may_v appeal_v to_o the_o justice_n of_o the_o peace_n at_o the_o next_o quarter_n session_n who_o be_v hereby_o impower_v and_o authorise_v to_o hear_v and_o determine_v the_o same_o who_o judgement_n therein_o shall_v be_v final_a which_o say_v commissioner_n for_o appeal_n and_o regulate_v of_o this_o duty_n and_o the_o chief_a commissioner_n for_o excise_n and_o all_o justice_n of_o peace_n and_o sub-commissioner_n aforesaid_a respective_o be_v hereby_o authorise_v and_o strict_o enjoin_v and_o require_v upon_o any_o complaint_n or_o information_n exhibit_v and_o bring_v of_o any_o such_o forfeiture_n make_v or_o offence_n commit_v contrary_a to_o this_o act_n to_o summon_v the_o party_n accuse_v and_o upon_o his_o appearance_n or_o contempt_n to_o procee_v to_o the_o examination_n of_o the_o matter_n of_o fact_n and_o upon_o due_a proof_n make_v thereof_o either_o by_o the_o voluntary_a confession_n of_o the_o party_n or_o by_o the_o oath_n of_o one_o or_o more_o credible_a witness_n which_o oath_n they_o or_o any_o two_o or_o more_o of_o they_o have_v hereby_o power_n to_o administer_v to_o give_v judgement_n or_o sentence_n forfeiture_n levy_v the_o forfeiture_n according_a as_o in_o and_o by_o this_o act_n be_v before_o ordain_v and_o direct_v and_o to_o award_v and_o issue_n out_o warrant_v under_o their_o hand_n for_o the_o levy_n of_o such_o forfeiture_n penalty_n and_o fine_n as_o by_o this_o act_n be_v impose_v for_o any_o such_o offence_n commit_v upon_o the_o good_n and_o chattel_n of_o the_o offender_n and_o to_o cause_n sale_n to_o be_v make_v of_o the_o say_a good_n and_o chattel_n if_o they_o shall_v not_o be_v redeem_v within_o fourtéen_a day_n render_v to_o the_o party_n the_o overplus_n if_o any_o be_v and_o for_o want_v of_o sufficient_a distress_n to_o imprison_v the_o party_n
offend_v till_o satisfaction_n be_v make_v forfeiture_n power_n to_o mitigate_v the_o forfeiture_n provide_v nevertheless_o that_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_v respective_a justice_n of_o peace_n commissioner_n for_o excise_n or_o any_o two_o of_o they_o or_o their_o sub-commissioner_n respective_o from_o time_n to_o time_n where_o they_o shall_v see_v cause_n to_o mitigate_v compound_n or_o lessen_v such_o forfeiture_n penalty_n or_o fine_a as_o in_o their_o discretion_n they_o shall_v think_v fit_a and_o that_o every_o such_o mitigation_n and_o payment_n thereupon_o according_o make_v shall_v be_v a_o sufficient_a discharge_n of_o the_o say_a penalty_n and_o forfeiture_n to_o the_o person_n so_o offend_v so_o as_o by_o such_o mitigation_n the_o same_o be_v not_o make_v less_o than_o double_a the_o value_n of_o the_o duty_n of_o excise_n which_o shall_v or_o ought_v to_o have_v be_v pay_v beside_o the_o reasonable_a cost_n and_o charge_n of_o such_o officer_n or_o officer_n or_o other_o as_o be_v employ_v therein_o to_o be_v to_o they_o allow_v by_o the_o say_a justice_n any_o thing_n in_o this_o act_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o employ_v how_o the_o forfeiture_n shall_v be_v employ_v and_o it_o be_v hereby_o further_o enact_v and_o ordain_v that_o all_o fine_n forfeiture_n and_o penalty_n ordain_v by_o the_o authority_n aforesaid_a and_o it_o be_v hereby_o enact_v that_o one_o principal_a head-office_n shall_v be_v erect_v and_o continue_v in_o the_o city_n of_o london_n or_o within_o ten_o mile_n thereof_o from_o time_n to_o time_n as_o long_o as_o his_o majesty_n shall_v think_v fit_a for_o this_o duty_n unto_o which_o all_o other_o office_n for_o the_o same_o within_o england_n and_o wales_n and_o the_o town_n and_o port_n of_o berwick_n shall_v be_v subordinate_a and_o accountable_a which_o say_v office_n shall_v be_v manage_v by_o such_o officer_n as_o shall_v be_v appoint_v by_o the_o king_n majesty_n as_o aforesaid_a who_o or_o any_o two_o of_o they_o be_v hereby_o appoint_v and_o constitute_v commissioner_n and_o governor_n for_o the_o management_n of_o his_o majesty_n receipt_n of_o the_o excise_n and_o to_o sit_v in_o some_o convenient_a place_n in_o the_o city_n of_o london_n or_o within_o ten_o mile_n thereof_o from_o time_n to_o time_n as_o long_o as_o his_o majesty_n shall_v think_v fit_a and_o be_v it_o enact_v by_o the_o authority_n aforesaid_a that_o no_o person_n or_o person_n shall_v be_v capable_a of_o intermeddle_v with_o any_o office_n or_o employment_n relate_v to_o the_o excise_n until_o he_o or_o they_o shall_v before_o two_o or_o more_o justice_n of_o peace_n in_o the_o county_n where_o his_o or_o their_o employment_n shall_v be_v or_o before_o one_o of_o the_o baron_n of_o the_o exchequer_n take_v the_o oath_n of_o allegiance_n and_o supremacy_n which_o oath_n they_o have_v hereby_o power_n to_o administer_v together_o and_o shall_v from_o time_n to_o time_n true_a account_n make_v and_o deliver_v to_o such_o person_n and_o person_n as_o his_o majesty_n shall_v appoint_v to_o receive_v the_o same_o and_o shall_v take_v no_o fee_n or_o reward_n for_o the_o execution_n of_o the_o say_a office_n from_o any_o other_o person_n than_o from_o his_o majesty_n or_o those_o who_o his_o majesty_n shall_v appoint_v in_o that_o behalf_n office_n london_n westminster_n etc._n etc._n to_o be_v under_o the_o management_n of_o the_o chief_a office_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o every_o such_o justice_n of_o peace_n shall_v certify_v the_o take_n of_o such_o oath_n to_o the_o next_o quarter-session_n there_o to_o be_v record_v and_o it_o be_v further_o enact_v that_o all_o part_n of_o the_o city_n of_o london_n and_o westminster_n with_o the_o burrow_n of_o southwark_n and_o the_o several_a suburb_n thereof_o and_o parish_n within_o the_o wéek_o bill_n of_o mortality_n shall_v be_v under_o the_o immediate_a care_n inspection_n and_o management_n of_o the_o say_a head-office_n and_o such_o and_o so_o many_o subordinate_a commissioner_n majesty_n all_o kingdom_n of_o england_n dominion_n of_o wales_n and_o port_n of_o berwick_n as_o from_o time_n to_o time_n his_o majesty_n his_o heir_n and_o successor_n shall_v think_v fit_a and_o it_o be_v hereby_o further_o enact_v that_o the_o say_a office_n of_o excise_n in_o all_o place_n where_o it_o shall_v be_v appoint_v shall_v be_v keep_v open_a from_o eight_o of_o the_o clock_n in_o the_o morning_n open_a time_n in_o which_o the_o office_n shall_v be_v keep_v open_a till_o twelve_o of_o the_o clock_n at_o noon_n and_o from_o two_o of_o the_o clock_n in_o the_o afternoon_n till_o five_o of_o the_o clock_n in_o the_o afternoon_n for_o the_o due_a execution_n and_o performance_n of_o all_o and_o every_o the_o matter_n and_o thing_n in_o this_o act_n appoint_v and_o require_v and_o it_o be_v further_a hereby_o enact_v that_o the_o say_v chief_a commissioner_n of_o excise_n or_o the_o major_a part_n of_o they_o shall_v from_o time_n to_o time_n issue_n forth_o and_o pay_v such_o sum_n and_o sum_n of_o money_n as_o shall_v from_o time_n to_o time_n be_v receive_v collect_v or_o levy_v by_o virtue_n of_o this_o act_n into_o his_o majesty_n receipt_n of_o exchequer_n statute_n the_o general_a â—â—â—ue_n pleadable_a in_o any_o action_n upon_o this_o statute_n provide_v always_o and_o be_v it_o enact_v that_o if_o any_o person_n or_o person_n shall_v at_o any_o time_n be_v sue_v or_o prosecute_v for_o any_o thing_n by_o he_o or_o they_o do_v or_o execute_v in_o pursuance_n of_o this_o act_n he_o or_o they_o shall_v and_o may_v plead_v the_o general_a issue_n and_o give_v this_o act_n in_o evidence_n for_o his_o defence_n and_o if_o upon_o the_o trial_n a_o verdict_n shall_v pass_v for_o the_o defendant_n or_o defendant_n or_o the_o plaintiff_n or_o plaintiff_n be_v thereupon_o any_o such_o writ_n or_o writ_n or_o allowance_n thereof_o notwithstanding_o pardon_n proviso_n as_o to_o the_o act_n of_o general_n pardon_n provide_v that_o this_o act_n or_o any_o thing_n therein_o contain_v shall_v not_o extend_v or_o be_v construe_v to_o extend_v in_o any_o matter_n to_o weaken_v or_o invalidate_v one_o act_n of_o this_o present_a parliament_n entitle_v a_o act_n of_o free_a and_o general_a pardon_n indemnity_n and_o oblivion_n but_o that_o every_o clause_n article_n matter_n and_o thing_n therein_o mention_v and_o comprise_v shall_v notwithstanding_o refuse_v to_o be_v pay_v the_o place_n for_o collect_v of_o the_o say_a toll_n to_o be_v for_o the_o county_n of_o hertford_n at_o wades-mill_n and_o for_o the_o county_n of_o cambridge_n at_o caxton_n within_o the_o say_a county_n of_o cambridge_n and_o for_o the_o county_n of_o huntingdon_n at_o stilton_n in_o the_o say_a county_n of_o huntingdon_n and_o at_o no_o other_o place_n or_o sustain_v by_o keep_v of_o such_o distress_n of_o all_o which_o money_n so_o to_o be_v receive_v surveyor_n the_o toll_n receive_v to_o be_v account_v for_o and_o pay_v to_o the_o surveyor_n the_o say_a collector_n or_o receiver_n of_o toll_n so_o to_o be_v appoint_v in_o the_o several_a county_n shall_v from_o time_n to_o time_n render_v true_a account_n and_o shall_v pay_v the_o money_n so_o by_o they_o receive_v unto_o the_o say_a surveyor_n of_o their_o several_a and_o respective_a county_n or_o to_o any_o three_o or_o more_o of_o they_o or_o unto_o such_o treasurer_n as_o they_o shall_v appoint_v when_o and_o as_o often_o as_o they_o shall_v be_v thereunto_o require_v by_o the_o say_a surveyor_n or_o any_o three_o or_o more_o of_o they_o by_o they_o to_o be_v lay_v out_o and_o expend_v for_o and_o towards_o the_o necessary_a repair_v and_o amend_v of_o the_o several_a place_n aforemention_v and_o not_o elsewhere_o within_o their_o say_a several_a and_o respective_a county_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o surveyor_n receive_v to_o who_o the_o say_v surveyor_n shall_v account_v for_o money_n receive_v and_o every_o of_o they_o in_o their_o several_a and_o respective_a county_n at_o the_o quarter-session_n of_o the_o peace_n for_o the_o say_a county_n to_o be_v hold_v next_o after_o easter_n in_o every_o year_n shall_v make_v and_o yield_v up_o unto_o the_o justice_n of_o the_o peace_n there_o to_o be_v assemble_v a_o perfect_a account_n in_o write_v under_o their_o hand_n of_o all_o the_o money_n which_o they_o or_o any_o of_o they_o shall_v have_v receive_v from_o the_o say_a collector_n or_o receiver_n of_o toll_n in_o their_o say_a county_n and_o likewise_o of_o all_o their_o disbursment_n in_o and_o about_o the_o say_a highway_n or_o otherwise_o by_o reason_n of_o their_o office_n and_o in_o case_n of_o any_o overplus_n of_o money_n so_o receive_v remain_v in_o their_o hand_n shall_v pay_v the_o same_o to_o the_o surveyor_n to_o be_v choose_v for_o the_o year_n ensue_v or_o to_o the_o treasurer_n or_o receiver_n by_o they_o to_o be_v appoint_v to_o be_v disburse_v and_o lay_v out_o in_o the_o several_a place_n aforesaid_a within_o such_o county_n wherein_o the_o overplus_n do_v remain_v and_o not_o elsewhere_o in_o the_o year_n ensue_v which_o say_v justice_n to_o who_o such_o account_n shall_v be_v give_v shall_v out_o of_o the_o benefit_n of_o the_o say_a toll_n make_v such_o allowance_n unto_o the_o say_a surveyor_n for_o and_o in_o consideration_n of_o their_o care_n and_o pain_n take_v in_o the_o execution_n of_o their_o say_a office_n as_o to_o they_o shall_v seem_v good_a and_o in_o case_n the_o collector_n or_o receiver_n of_o the_o aforesaid_a toll_n for_o the_o respective_a county_n so_o to_o be_v pay_v as_o aforesaid_a shall_v not_o upon_o request_n due_o pay_v the_o same_o unto_o the_o say_a surveyor_n of_o the_o say_a county_n for_o the_o time_n be_v or_o the_o treasurer_n or_o receiver_n by_o they_o appoint_v or_o in_o case_n the_o say_a surveyor_n or_o any_o of_o they_o shall_v not_o make_v such_o account_n and_o payment_n as_o aforesaid_a that_o then_o the_o say_a justice_n for_o the_o several_a and_o respective_a county_n at_o any_o quarter-session_n of_o the_o peace_n to_o be_v hold_v for_o the_o say_a county_n in_o case_n of_o such_o default_n of_o account_n or_o payment_n shall_v and_o may_v make_v enquiry_n concern_v such_o default_n as_o well_o by_o the_o confession_n of_o the_o party_n themselves_o as_o by_o testimony_n of_o two_o or_o more_o credible_a witness_n upon_o oath_n and_o in_o case_n of_o such_o default_n to_o be_v find_v and_o adjudge_v by_o the_o say_a justice_n in_o their_o say_a respective_a county_n either_o in_o their_o say_a receiver_n or_o collector_n of_o the_o say_a toll_n or_o in_o their_o say_a surveyor_n or_o any_o of_o they_o the_o say_v justice_n upon_o such_o their_o conviction_n shall_v commit_v the_o party_n or_o party_n so_o convict_v to_o the_o common_a gaol_n for_o the_o say_a county_n there_o to_o remain_v without_o bail_n or_o mainprize_n until_o he_o or_o they_o shall_v have_v make_v a_o true_a and_o perfect_a account_n and_o payment_n as_o aforesaid_a and_o forasmuch_o as_o the_o money_n so_o to_o be_v collect_v by_o such_o receipt_n of_o the_o say_a toll_n will_v not_o at_o present_a raise_v such_o a_o stock_n or_o sum_n of_o money_n as_o may_v be_v sufficient_a for_o the_o speedy_a repair_v of_o the_o premise_n in_o the_o say_v several_a county_n of_o hertford_n cambridge_n and_o huntingdon_n it_o be_v hereby_o further_o enact_v money_n how_o the_o toll_n profit_n may_v he_o engage_v for_o advance_v of_o money_n and_o the_o say_a surveyor_n be_v hereby_o enable_v by_o and_o with_o the_o like_a consent_n of_o the_o say_a justice_n for_o their_o several_a and_o respective_a county_n without_o further_a licence_n several_o to_o engage_v the_o profit_n arise_v of_o their_o say_a toll_n in_o their_o several_a county_n for_o such_o sum_n or_o sum_n of_o money_n by_o they_o to_o be_v borrow_v for_o that_o purpose_n and_o by_o indenture_n under_o the_o hand_n and_o seal_n of_o the_o say_v respective_a surveyor_n for_o the_o time_n be_v to_o transfer_v the_o say_a profit_n of_o the_o say_a toll_n and_o to_o grant_v and_o convey_v the_o same_o for_o any_o time_n or_o term_n not_o exceed_a nine_o year_n unto_o any_o person_n or_o person_n that_o shall_v or_o will_v upon_o that_o security_n advance_v any_o present_a sum_n or_o sum_n of_o money_n for_o and_o towards_o the_o present_a repair_v and_o amend_v of_o the_o say_a highway_n in_o the_o respective_a place_n and_o county_n aforesaid_a for_o the_o repayment_n of_o such_o principal_a sum_n or_o sum_n of_o money_n so_o lend_v with_o interest_n for_o the_o same_o or_o in_o case_n such_o sum_n or_o sum_n of_o money_n can_v be_v borrow_v upon_o the_o security_n aforesaid_a for_o the_o repair_n of_o the_o say_a way_n that_o then_o it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o the_o say_a justice_n in_o their_o say_a several_a and_o respective_a county_n parish_n in_o what_o case_n a_o rate_n may_v be_v mâ—de_v upon_o the_o several_a parish_n at_o their_o several_a quarter-session_n when_o they_o shall_v see_v cause_n to_o make_v a_o rate_v not_o to_o extend_v to_o any_o other_o county_n but_o their_o own_o nor_o to_o repair_v any_o other_o than_o the_o place_n aforesaid_a in_o that_o particular_a county_n where_o
such_o rate_n be_v make_v whereby_o they_o shall_v have_v power_n for_o their_o several_a county_n to_o raise_v upon_o the_o parish_n that_o lie_v in_o or_o near_o the_o say_a road_n and_o so_o will_v have_v a_o benefit_n therefrom_o such_o sum_n or_o sum_n of_o money_n as_o they_o shall_v see_v fit_a and_o convenient_a for_o the_o speedy_a effect_n of_o the_o say_v repair_v before_o mention_v which_o say_v sum_n and_o sum_n so_o to_o be_v rate_v as_o aforesaid_a shall_v be_v pay_v to_o the_o surveyor_n for_o the_o respective_a county_n where_o such_o rate_n be_v make_v or_o to_o their_o receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o shall_v seem_v meet_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o or_o their_o good_n render_v to_o the_o party_n so_o distrain_v the_o overplus_n if_o any_o shall_v be_v dispose_v fine_n and_o forfeiture_n upon_o this_o act_n how_o to_o be_v pay_v and_o dispose_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o all_o fine_n or_o forfeiture_n to_o be_v impose_v or_o incur_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n for_o the_o time_n be_v or_o any_o three_o of_o they_o or_o the_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o person_n so_o choose_v shall_v and_o be_v hereby_o require_v upon_o notice_n thereof_o to_o he_o or_o they_o give_v under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n by_o who_o he_o or_o they_o shall_v be_v so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n and_o to_o execute_v the_o same_o in_o such_o manner_n and_o under_o such_o and_o the_o like_a penalty_n as_o if_o he_o or_o they_o have_v be_v choose_v by_o the_o justice_n at_o their_o session_n of_o the_o peace_n in_o manner_n as_o aforesaid_a issue_n suit_n upon_o this_o act_n shall_v be_v lay_v in_o the_o proper_a county_n and_o the_o defendant_n may_v plead_v the_o general_a issue_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o suit_n shall_v be_v commence_v against_o any_o person_n for_o any_o thing_n do_v in_o pursuance_n of_o this_o present_a act_n that_o in_o every_o such_o case_n the_o action_n shall_v be_v lay_v in_o the_o say_v respective_a county_n where_o the_o cause_n do_v arise_v and_o not_o elsewhere_o and_o the_o defendant_n in_o such_o action_n so_o to_o be_v bring_v may_v plead_v the_o general_a issue_n and_o give_v this_o act_n and_o the_o special_a matter_n in_o evidence_n at_o any_o trial_n to_o be_v have_v thereupon_o and_o that_o the_o same_o be_v do_v in_o pursuance_n and_o by_o authority_n of_o the_o say_a act_n and_o if_o it_o shall_v so_o appear_v to_o be_v do_v and_o that_o such_o action_n shall_v be_v bring_v in_o any_o other_o county_n that_o then_o the_o jury_n shall_v find_v for_o the_o defendant_n and_o upon_o such_o verdict_n or_o if_o the_o plaintiff_n shall_v be_v nonsuit_v or_o discontinue_v his_o action_n after_o the_o defendant_n shall_v have_v appear_v or_o if_o upon_o demurrer_n judgement_n shall_v be_v give_v against_o the_o plaintiff_n the_o say_a defendant_n shall_v have_v and_o recover_v his_o double_a cost_v cost_v double_o cost_v and_o have_v the_o like_a remedy_n for_o the_o same_o as_o any_o defendant_n have_v in_o any_o other_o case_n by_o law_n day_n toll_n not_o to_o be_v pay_v twice_o in_o the_o same_o day_n provide_v always_o that_o no_o person_n or_o person_n have_v occasion_n to_o pass_v any_o place_n where_o the_o toll_n be_v take_v and_o return_v the_o same_o day_n with_o the_o same_o horse_n coach_n wagon_n or_o other_o carriage_n or_o with_o cattle_n shall_v be_v compel_v in_o the_o same_o day_n to_o pay_v the_o say_a toll_n a_o second_o time_n any_o thing_n in_o this_o act_n to_o the_o contrary_a notwithstanding_o provide_v also_o that_o all_o and_o every_o person_n and_o person_n who_o by_o law_n be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a shall_v still_o remain_v so_o chargeable_a any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o toll_n the_o continuance_n of_o this_o act_n for_o 11._o year_n only_o proviso_n for_o exempt_n certain_a person_n and_o thing_n from_o pay_v any_o toll_n provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o any_o further_a time_n or_o be_v of_o force_v any_o long_a than_o the_o term_n of_o eleven_o year_n to_o be_v account_v from_o the_o pass_n of_o this_o act_n any_o thing_n in_o this_o act_n to_o the_o
