levy_v or_o recover_v by_o warrant_n under_o the_o hand_n and_o seal_n of_o the_o respective_a lieutenant_n and_o deputy-lieutenant_n or_o any_o three_o or_o more_o of_o they_o upon_o the_o good_n and_o chattel_n of_o the_o offender_n and_o by_o sale_n of_o the_o same_o render_v the_o party_n the_o overplus_n if_o any_o be_v and_o if_o sufficient_a of_o the_o good_n and_o chattel_n of_o such_o shall_v commit_v every_o such_o offender_n so_o convict_v as_o aforesaid_a to_o the_o gaol_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n for_o any_o time_n not_o exceed_a the_o space_n of_o three_o month_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a five_o pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v shall_v fine_a the_o say_a offender_n at_o for_o his_o or_o her_o say_a offence_n which_o money_n shall_v be_v pay_v to_o the_o churchwarden_n for_o the_o relief_n of_o the_o poor_a of_o the_o parish_n where_o such_o offender_n do_v last_o inhabit_v and_o be_v it_o penalty_n of_o imprisonment_n in_o the_o gaol_n or_o house_n of_o correction_n for_o any_o time_n not_o exceed_a six_o month_n without_o bail_n or_o mainprize_n unless_o such_o offender_n shall_v pay_v down_o to_o the_o say_a justice_n or_o chief_a magistrate_n such_o sum_n of_o money_n not_o exceed_a ten_n pound_n as_o the_o say_a justice_n or_o chief_a magistrate_n who_o be_v thereunto_o the_o next_o general_n quarter_n session_n assizes_n gaol-delivery_n great_a session_n or_o sit_v of_o any_o commission_n of_o oyer_n and_o terminer_n in_o the_o respective_a county_n limit_v headborough_n or_o tythingman_n of_o the_o respective_a place_n where_o the_o estate_n real_a or_o personal_a of_o such_o offender_n so_o to_o be_v transport_v shall_v happen_v to_o be_v command_v they_o thereby_o to_o sequester_n into_o their_o hand_n the_o profit_n of_o the_o land_n and_o to_o distrain_v and_o sell_v the_o good_n of_o the_o offender_n so_o to_o be_v transport_v for_o the_o reimburse_n of_o the_o say_a sheriff_n all_o such_o reasonable_a charge_n as_o he_o shall_v be_v at_o and_o shall_v be_v allow_v he_o by_o the_o say_v respective_a court_n for_o such_o convey_v and_o embarque_a of_o such_o offender_n so_o to_o be_v transport_v render_v to_o the_o party_n or_o he_o or_o her_o assign_v the_o overplus_n of_o the_o same_o if_o any_o be_v unless_o such_o offender_n or_o some_o other_o on_o the_o behalf_n of_o such_o offender_n so_o to_o be_v transport_v shall_v give_v the_o sheriff_n such_o security_n as_o he_o shall_v approve_v of_o for_o the_o pay_v all_o the_o say_a charge_n unto_o he_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a transport_v how_o seditious_a sectary_n convict_v may_v be_v transport_v that_o in_o default_n of_o defray_v such_o charge_n by_o the_o party_n so_o to_o be_v transport_v or_o some_o other_o in_o their_o behalf_n or_o in_o default_n of_o security_n give_v to_o the_o sheriff_n as_o aforesaid_a it_o shall_v and_o may_v be_v lawful_a for_o every_o such_o sheriff_n to_o contract_n with_o any_o master_n of_o a_o ship_n merchant_n or_o other_o person_n for_o the_o transport_v of_o such_o offender_n at_o the_o best_a rate_n he_o can_v and_o that_o in_o every_o such_o case_n it_o shall_v and_o may_v be_v lawful_a for_o such_o person_n so_o contract_n with_o any_o sheriff_n for_o transport_v such_o offender_n as_o aforesaid_a to_o detain_v and_o employ_v every_o such_o offender_n so_o by_o they_o transport_v as_o a_o labourer_n to_o they_o or_o their_o assign_v for_o the_o space_n of_o five_o year_n to_o all_o intent_n and_o purpose_n as_o if_o he_o or_o she_o be_v bind_v by_o indenture_n to_o such_o person_n for_o
this_o act_n in_o the_o exercise_n of_o religion_n differ_v from_o the_o rite_n of_o the_o church_n of_o england_n then_o every_o such_o keeper_n of_o a_o gaol_n or_o house_n of_o correction_n shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o pound_n to_o be_v levy_v raise_v and_o dispose_a by_o such_o person_n penalty_n the_o penalty_n and_o in_o such_o manner_n as_o the_o the_o offence_n commit_v and_o that_o no_o person_n who_o shall_v be_v punish_v for_o any_o offence_n by_o virtue_n of_o this_o act_n shall_v be_v punish_v for_o the_o same_o offence_n by_o virtue_n of_o any_o other_o act_n or_o law_n whatsoever_o provide_v also_o and_o be_v it_o enact_v punish_v marry_a woman_n how_o to_o be_v punish_v that_o judgement_n of_o transportation_n shall_v not_o be_v give_v against_o any_o feme-covert_a unless_o her_o husband_n be_v at_o the_o same_o time_n under_o the_o like_a judgement_n and_o not_o discharge_v by_o the_o payment_n of_o money_n as_o aforesaid_a but_o that_o instead_o thereof_o she_o shall_v by_o the_o respective_a court_n be_v commit_v to_o the_o goal_n or_o house_n of_o correction_n there_o to_o remain_v without_o bail_n or_o mainprize_n of_o any_o jury_n or_o order_v to_o be_v examine_v upon_o interrogatory_n or_o be_v present_a in_o court_n shall_v refuse_v to_o take_v any_o judicial_a oath_n legal_o tender_v to_o he_o by_o the_o judge_n or_o judge_n of_o the_o same_o court_n have_v no_o legal_a plea_n to_o justify_v or_o excuse_v the_o refusal_n of_o the_o same_o oath_n or_o if_o any_o person_n or_o person_n be_v due_o serve_v with_o process_n to_o answer_v any_o bill_n exhibit_v against_o he_o or_o they_o in_o any_o court_n of_o equity_n or_o any_o suit_n in_o any_o court_n ecclesiastical_a shall_v refuse_v to_o such_o court_n acquit_v how_o such_o person_n may_v be_v acquit_v and_o take_v he_o or_o their_o oath_n in_o these_o word_n i_o do_v swear_v that_o i_o do_v not_o hold_v the_o take_n of_o a_o oath_n to_o be_v unlawful_a nor_o refuse_v to_o take_v aâ—_n oath_n on_o that_o account_n which_o oath_n the_o respective_a court_n and_o court_n aforesaid_a be_v hereby_o authorize_v and_o require_v â—ell_v at_o the_o say_a rate_n that_o then_o the_o say_a lord_n mayor_n and_o alderman_n and_o justice_n of_o peace_n respective_o be_v hereby_o authorise_v to_o appoint_v and_o empower_v such_o officer_n or_o officer_n or_o other_o person_n as_o they_o shall_v think_v fit_a to_o enter_v into_o any_o wharf_n or_o other_o place_n where_o such_o coal_n be_v store_v up_o and_o in_o case_n of_o refusal_n take_v a_o constable_n to_o force_v entrance_n and_o the_o say_a coal_n to_o sell_v or_o cause_n to_o be_v sell_v at_o such_o rate_n as_o the_o say_a lord_n mayor_n and_o alderman_n and_o justice_n respective_o shall_v judge_v reasonable_a render_v to_o such_o engrosser_n or_o retailer_n the_o money_n for_o which_o the_o say_v coal_n shall_v be_v so_o sell_v necessary_a charge_n be_v deduct_v act._n the_o continuance_n of_o this_o act._n provide_v that_o this_o act_n shall_v continue_v for_o three_o year_n next_o ensue_v and_o thenceforth_o to_o the_o end_n of_o the_o next_o session_n of_o parliament_n and_o no_o long_o provide_v also_o that_o no_o person_n or_o person_n that_o shall_v be_v sue_v by_o virtue_n of_o this_o act_n for_o not_o observe_v thereof_o shall_v be_v use_n only_o shall_v act_v or_o otherwise_o intermeddle_v in_o the_o set_n the_o price_n of_o coal_n any_o thing_n in_o this_o act_n to_o the_o contrary_a in_o any_o wise_n notwithstanding_o cap._n iii_o for_o the_o return_v of_o able_a and_o sufficient_a juror_n for_o the_o return_v of_o more_o able_a and_o sufficient_a juror_n for_o trial_n hereafter_o to_o be_v have_v between_o party_n and_o
