affair_n at_o home_n and_o abroad_o 3._o that_o our_o university_n court_n be_v of_o such_o antiquity_n that_o the_o common_a law_n book_n and_o some_o very_a ancient_a take_v frequent_a notice_n of_o it_o the_o proceeding●_n thereof_o be_v always_o allow_v by_o the_o common-law_n and_o the_o lord_n chief_a justice_n cook_n in_o his_o book_n of_o the_o jurisdiction_n of_o court_n in_o england_n late_o publish_v by_o authority_n of_o the_o honourable_a house_n of_o commons_o make_v honourable_a mention_n of_o the_o court_n in_o both_o the_o university_n 4._o that_o if_o the_o citizen_n be_v plaintiff_n as_o most_o common_o they_o be_v beside_o the_o expedition_n which_o they_o may_v find_v there_o they_o may_v have_v the_o benefit_n of_o the_o defendant_n oath_n to_o ease_v they_o in_o their_o proof_n they_o may_v have_v good_a surety_n put_v into_o court_n not_o only_o to_o bring_v in_o the_o defendant_n but_o also_o to_o pay_v the_o judgement_n and_o cost_v of_o suit_n they_o other_o complain_v of_o our_o court_n and_o the_o petitioner_n of_o all_o other_o have_v least_o cause_n 6._o that_o we_o do_v not_o challenge_v or_o exercise_v any_o other_o jurisdiction_n over_o the_o petitioner_n or_o other_o in_o the_o university_n court_n then_o the_o citizen_n of_o oxon_n themselves_o and_o all_o or_o most_o other_o city_n and_o borough_n in_o england_n do_v claim_v and_o to_o they_o and_o we_o in_o favour_n of_o learning_n that_o scholar_n may_v not_o be_v call_v abroad_o to_o answer_v suit_n to_o the_o great_a neglect_n of_o their_o study_n and_o expense_n of_o their_o time_n and_o money_n 8._o that_o in_o mix_a suit_n where_o one_o party_n be_v of_o the_o privilege_n of_o the_o university_n and_o the_o other_o of_o the_o city_n since_o it_o can_v be_v otherwise_o but_o such_o cause_n must_v be_v hear_v and_o determine_v either_o in_o our_o court_n or_o the_o town_n court_n or_o both_o must_v be_v subject_a to_o a_o foreign_a jurisdiction_n which_o will_v be_v equal_o repugnant_a to_o the_o privilege_n of_o both_o body_n no_o way_n advantageous_a untothem_n and_o extreme_o inconvenient_a for_o we_o we_o can_v but_o conceive_v it_o more_o consonant_a to_o justice_n and_o withal_o more_o convenient_a that_o the_o privilege_n of_o the_o university_n shall_v herein_o take_v place_n of_o they_o 1._o because_o this_o privilege_n have_v be_v ancient_o grant_v to_o we_o and_o we_o have_v be_v many_o hundred_o year_n in_o possession_n of_o it_o and_o it_o be_v also_o confirm_v unto_o we_o by_o act_n of_o parliament_n 2._o because_o the_o judge_n in_o the_o university_n court_n have_v no_o interest_n in_o the_o particular_a suit_n bring_v before_o they_o can_v be_v think_v other_o then_o indifferent_a whereas_o if_o scholar_n shall_v be_v sue_v in_o the_o towne●_n court_n where_o the_o major_a and_o bailiff_n judge_n and_o jury_n be_v all_o tradesman_n it_o be_v very_o much_o to_o be_v fear_v it_o will_v go_v hard_a with_o the_o poor_a scholar_n 3._o because_o as_o we_o humble_o conceive_v the_o university_n be_v still_o as_o it_o have_v always_o be_v repute_v the_o more_o noble_a corporation_n more_o serviceable_a in_o the_o public_a and_o in_o which_o the_o whole_a nation_n have_v a_o great_a interest_n then_o in_o the_o city_n or_o citizen_n who_o for_o the_o most_o part_n be_v behold_v to_o the_o university_n for_o much_o of_o their_o livelihood_n and_o subsist●nce_n as_o themselves_o in_o the_o five_o article_n do_v imply_v whereas_o we_o have_v no_o dependence_n upon_o they_o but_o only_a ware_n for_o our_o money_n at_o dear_a r●tes_n 4._o last_o because_o as_o we_o likewise_o conceive_v if_o the_o petitioner_n shall_v prove_v so_o unfortunate_o successful_a in_o their_o desire_n as_o to_o obtain_v the_o liberty_n of_o sue_v scholar_n in_o their_o town_n court_n it_o will_v prove_v in_o the_o end_n very_o prejudicial_a to_o themselves_o for_o beside_o that_o it_o will_v minister_v occasion_n of_o discontent_n and_o continual_a quarrel_n betwixt_o the_o body_n it_o will_v deter_v scholar_n from_o have_v any_o deal_n or_o commerce_n with_o their_o new_a judge_n the_o citizen_n ii_o to_o the_o reason_n of_o their_o second_o grievance_n make_v up_o with_o divers_a specious_a instance_n to_o cast_v aspersion_n upon_o the_o university_n right_o and_o privilege_n of_o the_o night-walk_n we_o answer_v 1._o that_o this_o right_a and_o custom_n be_v so_o ancient_a so_o strengthen_v by_o confi●mation_n of_o parliament_n and_o the_o benefit_n thereof_o so_o great_a to_o all_o inhabitant_n by_o the_o careful_a practice_n and_o exercise_v of_o it_o and_o the_o continuance_n of_o it_o so_o absolute_o necessary_a for_o the_o good_a government_n of_o the_o university_n especial_o for_o secure_v young_a scholar_n against_o the_o many_o temptation_n to_o lewdness_n and_o looseness_n which_o they_o ordinary_o be_v expose_v to_o by_o mean_n of_o such_o townsman_n as_o make_v their_o own_o advantage_n out_o of_o the_o other_o luxury_n and_o deboistness_n that_o no_o man_n of_o any_o civil_a conversation_n stranger_n sojourner_n citizen_n or_o other_o have_v ever_o
