arm_n or_o contributory_a thereunto_o and_o it_o shall_v be_v lawful_a to_o and_o for_o the_o respective_a lieutenant_n and_o deputy_n or_o any_o three_o or_o more_o of_o they_o as_o aforesaid_a to_o the_o proceed_v of_o those_o stock_n sometime_o in_o ready_a money_n sometime_o in_o commodity_n which_o they_o usual_o sell_v for_o money_n or_o exchange_v again_o by_o which_o mean_v the_o trade_n of_o those_o company_n be_v
such_o rate_n be_v make_v whereby_o they_o shall_v have_v power_n for_o their_o several_a county_n to_o raise_v upon_o the_o parish_n that_o lie_v in_o or_o near_o the_o say_a road_n and_o so_o will_v have_v a_o benefit_n therefrom_o such_o sum_n or_o sum_n of_o money_n as_o they_o shall_v see_v fit_a and_o convenient_a for_o the_o speedy_a effect_n of_o the_o say_v repair_v before_o mention_v which_o say_v sum_n and_o sum_n so_o to_o be_v rate_v as_o aforesaid_a shall_v be_v pay_v to_o the_o surveyor_n for_o the_o respective_a county_n where_o such_o rate_n be_v make_v or_o to_o their_o receiver_n or_o collector_n to_o be_v employ_v for_o the_o repair_n of_o the_o say_a way_n and_o place_n aforementioned_a and_o not_o otherwise_o and_o in_o case_n any_o person_n shall_v refuse_v to_o pay_v such_o rate_n so_o to_o be_v make_v that_o it_o shall_v and_o may_v be_v lawful_a for_o the_o say_a surveyor_n or_o their_o say_a receiver_n and_o collector_n to_o distrain_v for_o such_o sum_n or_o sum_n of_o money_n and_o the_o distress_n to_o sell_v render_v the_o overplus_n to_o the_o owner_n provide_v always_o and_o it_o be_v enact_v by_o the_o authority_n aforesaid_a that_o the_o say_a money_n so_o advance_v by_o the_o say_v several_a town_n in_o the_o say_v respective_a county_n shall_v again_o be_v repay_v with_o interest_n by_o the_o several_a surveyor_n for_o the_o several_a county_n as_o it_o do_v arise_v out_o of_o the_o say_a toll_n every_o county_n pay_v for_o what_o be_v so_o borrow_a within_o its_o own_o county_n and_o no_o further_o and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n not_o have_v any_o lawful_a cause_n to_o be_v allow_v as_o aforesaid_a surveyor_n the_o penalty_n for_o refuse_v to_o take_v the_o office_n of_o surveyor_n shall_v neglect_v or_o refuse_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n of_o surveyor_n be_v thereunto_o nominate_v and_o choose_v according_a as_o by_o this_o act_n be_v appoint_v or_o to_o do_v or_o perform_v he_o or_o their_o duty_n in_o the_o due_a and_o speedy_a execution_n of_o this_o present_a act_n the_o say_a justice_n of_o the_o peace_n for_o the_o several_a and_o respective_a county_n where_o such_o surveyor_n or_o surveyor_n dwell_v at_o their_o quarter-session_n shall_v and_o may_v hereby_o have_v power_n to_o impose_v on_o such_o person_n or_o person_n so_o refuse_v or_o neglect_v such_o fine_a or_o fine_n not_o exceed_a ten_n pound_n upon_o each_o person_n so_o refuse_v or_o neglect_v as_o to_o they_o shall_v seem_v meet_a and_o to_o cause_v the_o same_o to_o be_v levy_v by_o distress_n and_o sale_n of_o he_o or_o their_o good_n render_v to_o the_o party_n so_o distrain_v the_o overplus_n if_o fine_n or_o forfeiture_n to_o be_v impose_v or_o incur_v by_o virtue_n of_o this_o act_n shall_v be_v pay_v to_o the_o surveyor_n for_o the_o time_n be_v or_o any_o three_o of_o they_o or_o the_o treasurer_n of_o the_o say_a surveyor_n for_o the_o say_v respective_a county_n for_o and_o towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a and_o in_o case_n of_o refusal_n or_o if_o any_o person_n or_o person_n so_o choose_v to_o take_v upon_o he_o or_o they_o the_o say_a office_n shall_v happen_v to_o die_v or_o shall_v for_o any_o lawful_a impediment_n be_v discharge_v from_o the_o say_a office_n that_o then_o some_o other_o fit_a person_n or_o person_n within_o that_o county_n shall_v be_v appoint_v by_o two_o or_o more_o justice_n in_o the_o say_a county_n live_v near_o the_o say_a highway_n and_o place_n aforesaid_a in_o the_o place_n of_o he_o or_o they_o that_o shall_v so_o refuse_v die_v or_o be_v discharge_v and_o the_o person_n or_o person_n so_o choose_v shall_v and_o be_v hereby_o require_v upon_o notice_n thereof_o to_o he_o or_o they_o give_v under_o the_o hand_n and_o seal_n of_o the_o say_a justice_n by_o who_o he_o or_o provide_v also_o that_o all_o and_o every_o person_n and_o person_n who_o by_o law_n be_v chargeable_a towards_o the_o repair_n of_o the_o say_a highway_n and_o place_n aforesaid_a shall_v still_o remain_v so_o chargeable_a any_o thing_n in_o this_o act_n to_o the_o contrary_a thereof_o in_o any_o wise_n notwithstanding_o toll_n the_o continuance_n of_o this_o act_n for_o 11._o year_n only_o proviso_n for_o exempt_n certain_a person_n and_o thing_n from_o pay_v any_o toll_n provide_v also_o that_o neither_o this_o act_n nor_o any_o thing_n therein_o contain_v shall_v extend_v to_o any_o this_o act_n in_o the_o exercise_n of_o religion_n differ_v from_o the_o rite_n of_o the_o church_n of_o england_n then_o every_o such_o keeper_n of_o a_o gaol_n or_o house_n of_o correction_n shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o pound_n to_o be_v levy_v raise_v and_o dispose_a by_o such_o person_n penalty_n the_o penalty_n and_o in_o such_o manner_n as_o the_o whereby_o the_o king_n majesty_n or_o his_o commissioner_n or_o farmer_n shall_v or_o may_v be_v defraud_v in_o any_o manner_n of_o wise_a of_o the_o duty_n due_a for_o the_o same_o or_o any_o part_n thereof_o every_o such_o common_a brewer_n victualler_n and_o retailer_n for_o every_o barrel_n of_o béer_n or_o ale_n by_o he_o or_o they_o so_o mingle_v convert_v sell_v deliver_v hide_v conceal_a or_o convey_v away_o contrary_a to_o the_o true_a intent_n and_o meaning_n hereof_o shall_v forfeit_v and_o lose_v the_o sum_n of_o twenty_o shilling_n to_o be_v levy_v and_o recover_v in_o manner_n excise_n brewing-vessel_n and_o utensil_n subject_a to_o the_o debt_n and_o penalty_n of_o excise_n and_o utensil_n for_o brew_v into_o who_o hand_n soever_o the_o same_o shall_v come_v &_o by_o commissioner_n farmer_n or_o sub-commissioner_n of_o excise_n within_o the_o district_v of_o who_o office_n such_o common_a brewer_n do_v or_o shall_v inhabit_v and_o forthwith_o pay_v down_o unto_o the_o say_v respective_a commissioner_n farmer_n or_o sub-commissioner_n the_o full_a excise_n of_o all_o the_o say_v béer_o and_o ale_n upon_o pain_n that_o as_o well_o the_o brewer_n who_o shall_v september_n no_o brewer_n or_o other_o person_n whatsoever_o shall_v bribe_v or_o corrupt_v or_o give_v any_o money_n fee_n or_o other_o reward_n whatsoever_o to_o any_o gager_n or_o gagers_n or_o other_o officer_n whatsoever_o to_o make_v any_o false_a return_n or_o report_n into_o the_o office_n of_o excise_n of_o any_o béer_n ale_n or_o other_o liquor_n exciseable_a make_v or_o brew_v or_o to_o be_v make_v or_o brew_v within_o his_o or_o their_o charge_n division_n or_o walk_n or_o to_o forbear_v or_o omit_v the_o do_v or_o execute_v of_o his_o or_o their_o place_n or_o employment_n upon_o penalty_n of_o ten_o pound_n for_o every_o such_o offence_n and_o that_o no_o swear_a gager_n or_o gagers_n or_o other_o officer_n whatsoever_o shall_v direct_o or_o indirect_o take_v and_o receive_v any_o bribe_n money_n fee_n gift_n or_o other_o reward_n of_o any_o brewer_n or_o other_o person_n whatsoever_o for_o any_o cause_n or_o matter_n relate_v to_o the_o excise_n upon_o original_o prosecute_v shall_v pay_v he_o double_a cost_v but_o in_o case_n the_o first_o judgement_n shall_v be_v affirm_v the_o party_n appeal_n shall_v pay_v the_o like_a cost_v unto_o the_o commissioner_n or_o commissioner_n complain_v of_o any_o thing_n in_o this_o act_n or_o any_o other_o act_n or_o statute_n whatsoever_o to_o the_o contrary_a thereof_o contain_v in_o any_o wise_n do_v brew_v their_o own_o béer_n and_o ale_n within_o their_o own_o precinct_n and_o size_n it_o out_o to_o their_o respective_a member_n within_o their_o own_o precinct_n only_o be_v not_o liable_a to_o the_o payment_n of_o any_o duty_n of_o excise_n for_o the_o same_o either_o by_o this_o or_o any_o the_o forementioned_a acts._n provide_v also_o and_o be_v it_o enact_v that_o all_o difference_n appeal_n and_o complaint_n that_o shall_v happen_v and_o arise_v between_o party_n and_o party_n county_n complaint_n to_o be_v determine_v in_o the_o proper_a county_n in_o order_n to_o the_o payment_n of_o the_o duty_n of_o excise_n shall_v be_v hear_v and_o determine_v in_o the_o proper_a county_n or_o in_o the_o several_a riding_n and_o division_n of_o yorkshire_n and_o lincolnshire_n where_o they_o shall_v arise_v and_o not_o elsewhere_o fe_n commissioner_n or_o farmer_n may_v take_v no_o fe_n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o no_o farmer_n commissioner_n sub-commissioner_n or_o other_o officer_n of_o excise_n shall_v direct_o or_o indirect_o take_v or_o receive_v any_o money_n fee_n or_o reward_n for_o or_o concern_v the_o take_n of_o any_o bond_n or_o give_v any_o receipt_n or_o note_n in_o write_v relate_v to_o the_o excise_n to_o or_o from_o any_o person_n or_o person_n whatsoever_o upon_o pain_n that_o every_o such_o person_n so_o offend_v shall_v for_o every_o such_o offence_n forfeit_v the_o sum_n of_o ten_o shilling_n act._n who_o may_v hear_v and_o determine_v matter_n upon_o this_o act._n and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o the_o justice_n of_o the_o peace_n or_o any_o two_o or_o more_o of_o they_o or_o chief_a magistrate_n in_o the_o several_a county_n city_n division_n and_o place_n within_o england_n and_o wales_n respective_o shall_v meet_v once_o in_o every_o month_n in_o their_o respective_a division_n or_o often_o if_o there_o shall_v be_v occasion_n to_o hear_v determine_v and_o to_o adjudge_v all_o matter_n and_o offence_n against_o this_o or_o the_o aforesaid_a acts._n recover_v how_o the_o penalty_n upon_o this_o act_n shall_v be_v dispose_v and_o recover_v and_o be_v it_o further_o enact_v by_o the_o authority_n aforesaid_a that_o one_o three_o part_n of_o all_o fine_n penalty_n and_o forfeiture_n not_o herein_o otherwise_o dispose_v shall_v be_v to_o the_o king_n majesty_n his_o heir_n and_o successor_n &_o one_o other_o three_o part_n to_o the_o poor_a of_o the_o parish_n where_o the_o offence_n shall_v be_v commit_v &_o the_o other_o three_o part_n to_o he_o that_o shall_v inform_v and_o sue_v for_o the_o same_o and_o that_o all_o fine_n penalty_n and_o forfeiture_n for_o which_o no_o remedy_n be_v ordain_v for_o recovery_n thereof_o by_o this_o act_n shall_v be_v recover_v by_o action_n of_o debt_n bill_n plaint_n or_o information_n in_o any_o court_n of_o record_n within_o such_o county_n city_n or_o corporation_n where_o the_o offence_n shall_v be_v commit_v or_o by_o such_o other_o way_n and_o mean_n and_o in_o such_o manner_n as_o by_o the_o say_v former_a act_n be_v direct_v and_o appoint_v thereof_o appeal_v for_o matter_n in_o london_n and_o the_o limit_n thereof_o provide_v always_o that_o after_o the_o say_v three_o day_n of_o september_n no_o appeal_n in_o any_o matter_n or_o cause_n of_o excise_n within_o the_o immediate_a limit_n of_o the_o chief_a office_n of_o london_n nor_o within_o the_o limit_n of_o the_o present_a farm_n of_o london_n during_o the_o continuance_n of_o such_o farm_n shall_v be_v admit_v unless_o the_o same_o be_v bring_v within_o two_o month_n next_o after_o the_o first_o judgement_n and_o notice_n thereof_o give_v or_o leave_v at_o the_o dwellinghouse_n of_o the_o party_n or_o party_n concern_v therein_o nor_o shall_v any_o appeal_n in_o any_o matter_n or_o cause_n of_o excise_n in_o any_o other_o county_n city_n town_n or_o place_n be_v admit_v unless_o the_o same_o be_v bring_v within_o four_o month_n after_o the_o first_o judgement_n and_o notice_n give_v as_o aforesaid_a any_o thing_n in_o this_o act_n to_o the_o contrary_a subcollector_n of_o each_o parish_n or_o place_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n shall_v upon_o the_o collection_n of_o the_o whole_a sum_n appoint_v to_o be_v collect_v by_o they_o and_o payment_n thereof_o as_o be_v hereby_o and_o before_o appoint_v have_v and_o receive_v for_o their_o pain_n in_o collect_v and_o pay_v the_o money_n one_o penny_n in_o the_o pound_n which_o the_o say_v several_a head-collector_n be_v hereby_o authorize_v to_o pay_v unto_o they_o and_o the_o several_a head-collector_n which_o shall_v be_v appoint_v by_o virtue_n of_o this_o act_n realm_n and_o he_o and_o they_o in_o prison_n to_o detain_v and_o keep_v until_o the_o money_n so_o assess_v and_o the_o charge_n for_o the_o bring_n in_o the_o same_o be_v pay_v and_o satisfy_v and_o no_o long_o and_o the_o several_a and_o respective_a tenant_n or_o tenant_n of_o all_o house_n and_o land_n landlord_n tenant_n to_o pay_v such_o sum_n as_o be_v rate_v upon_o their_o landlord_n shall_v or_o ought_v to_o pay_v and_o bear_v and_o the_o say_a landlord_n both_o mediate_v and_o immediate_a according_a to_o their_o respective_a interest_n be_v hereby_o require_v to_o allow_v such_o deduction_n and_o payment_n upon_o the_o receipt_n of_o the_o residue_n of_o the_o rent_n and_o it_o be_v enact_v and_o declare_v that_o every_o tenant_n pay_v the_o say_a assessment_n do_v and_o be_v acquit_v against_o they_o for_o so_o do_v shall_v be_v acquit_v and_o discharge_v for_o so_o much_o money_n as_o the_o say_a assessment_n shall_v amount_v unto_o as_o if_o the_o same_o commissioner_n or_o any_o two_o or_o more_o of_o they_o in_o their_o several_a division_n shall_v and_o have_v hereby_o power_n to_o settle_v the_o same_o as_o they_o shall_v think_v fit_a and_o if_o any_o person_n or_o person_n shall_v find_v he_o or_o themselves_o aggrieve_v in_o that_o the_o assessor_n have_v overrate_v he_o or_o they_o and_o shall_v within_o six_o day_n after_o demand_v make_v of_o the_o sum_n of_o money_n assess_v on_o he_o or_o they_o complain_v to_o two_o or_o more_o commissioner_n whereof_o one_o of_o the_o commissioner_n who_o sign_v or_o allow_v he_o or_o their_o assessment_n to_o be_v one_o the_o say_v commissioner_n or_o any_o two_o or_o more_o of_o they_o shall_v have_v and_o have_v hereby_o power_n within_o twelve_o day_n after_o the_o demand_n of_o the_o to_o the_o true_a meaning_n thereof_o house_n rate_n upon_o person_n not_o of_o ability_n or_o empty_a house_n or_o that_o if_o any_o of_o the_o say_a assessment_n shall_v be_v rate_v and_o impose_v upon_o any_o person_n not_o be_v of_o ability_n to_o pay_v the_o same_o or_o upon_o any_o empty_a or_o void_a house_n or_o land_n where_o the_o same_o can_v be_v collect_v or_o levy_v or_o that_o through_o any_o wilfulness_n negligence_n or_o mistake_n or_o accident_n the_o say_a assessment_n charge_v upon_o each_o county_n city_n town_n or_o place_n by_o virtue_n of_o this_o act_n happen_v not_o to_o be_v pay_v to_o the_o receiver-general_n of_o the_o respective_a county_n as_o in_o this_o act_n be_v direct_v that_o then_o in_o all_o and_o every_o such_o case_n the_o several_a and_o respective_a commissioner_n assessor_n and_o collector_n aforesaid_a and_o every_o of_o they_o respective_o be_v hereby_o authorise_v and_o require_v to_o assess_v or_o re-assess_a or_o cause_n to_o be_v assess_v or_o re-assessed_n levy_v and_o pay_v all_o and_o every_o such_o sum_n or_o sum_n of_o money_n upon_o the_o respective_a county_n city_n town_n and_o place_n or_o upon_o any_o of_o the_o division_n hundred_o and_o parish_n therein_o as_o to_o the_o say_a commissioner_n or_o such_o number_n of_o they_o as_o by_o this_o act_n be_v authorise_v to_o cause_v the_o first_o assessment_n hereby_o require_v to_o be_v make_v shall_v seem_v most_o agreeable_a to_o equity_n and_o justice_n the_o say_v new_a assessment_n to_o be_v make_v collect_v and_o pay_v in_o such_o manner_n and_o by_o such_o mean_n as_o in_o this_o act_n for_o this_o assessment_n be_v delare_v and_o direct_v act._n the_o punishment_n of_o person_n neglect_v to_o perform_v
their_o duty_n in_o execution_n of_o this_o act._n and_o be_v it_o further_o enact_v and_o declare_v by_o the_o authority_n aforesaid_a that_o if_o any_o person_n or_o person_n shall_v wilful_o more_o of_o they_o shall_v have_v power_n to_o warn_v such_o person_n or_o person_n to_o appear_v before_o they_o at_o a_o day_n and_o place_n prefix_v to_o be_v examine_v touch_v their_o substance_n and_o value_n or_o touch_v other_o matter_n which_o may_v any_o waâ—_n concern_v the_o premise_n and_o if_o the_o person_n or_o person_n warn_v to_o be_v so_o examine_v shall_v neglect_v to_o appear_v not_o have_v a_o reasonable_a excuse_n for_o such_o his_o default_n every_o person_n so_o make_v default_n shall_v pay_v unto_o his_o majesty_n double_v the_o sum_n of_o the_o rate_n he_o shall_v or_o ought_v to_o have_v be_v set_v at_o and_o moreover_o the_o say_a commissioner_n or_o any_o three_o or_o more_o of_o they_o shall_v have_v power_n by_o all_o lawful_a way_n and_o mean_n without_o oath_n to_o examine_v and_o inquire_v into_o the_o value_n and_o substance_n of_o such_o person_n chargeable_a by_o this_o act_n and_o to_o such_o rate_n or_o rate_n upon_o every_o such_o person_n or_o person_n as_o shall_v be_v according_a to_o the_o true_a intent_n and_o meaning_n of_o this_o act._n division_n head-collectors_a to_o be_v appoint_v in_o the_o several_a division_n and_o be_v it_o enact_v that_o the_o say_a commissioner_n or_o any_o three_o or_o more_o of_o they_o in_o their_o respective_a division_n or_o hundred_o shall_v and_o be_v hereby_o empower_v to_o nominate_v and_o appoint_v under_o their_o hand_n and_o seal_n a_o honest_a able_a and_o responsible_a person_n to_o be_v head-collector_n unto_o who_o the_o money_n receive_v by_o the_o sub-collector_n shall_v be_v due_o pay_v as_o aforesaid_a who_o receipt_n shall_v be_v a_o sufficient_a discharge_n unto_o every_o such_o sub-collector_n which_o sub-collector_n for_o gather_v the_o say_v particular_a sum_n shall_v retain_v in_o his_o hand_n for_o every_o twenty_o shilling_n by_o he_o so_o pay_v two_o penny_n as_o a_o reward_n for_o his_o pain_n and_o service_n and_o the_o say_a head-collector_n be_v receipt_n and_o the_o say_a receiver-general_n acquittance_n shall_v be_v a_o sufficient_a discharge_n unto_o every_o such_o head-collector_n who_o shall_v retain_v in_o his_o hand_n for_o every_o say_a warrant_n estreat_n and_o duplicate_v in_o due_a time_n be_v it_o further_o enact_v that_o the_o commissioner_n clerk_n who_o shall_v respective_o perform_v the_o same_o shall_v by_o warrant_n under_o two_o or_o more_o of_o the_o commissioner_n hand_n have_v and_o receive_v from_o the_o respective_a head-collectors_a two_o penny_n in_o the_o pound_n of_o all_o such_o money_n as_o he_o shall_v have_v receive_v by_o virtue_n of_o such_o warrant_n and_o estreat_v who_o be_v hereby_o appoint_v and_o allow_v to_o pay_v the_o same_o according_o general_a payment_n by_o the_o head-collectors_a to_o the_o receiver_n general_a and_o be_v it_o further_o enact_v that_o if_o any_o head-collector_n shall_v not_o pay_v in_o to_o the_o receiver-general_a within_o the_o time_n limit_v by_o this_o act_n all_o sum_n of_o money_n by_o he_o receive_v by_o virtue_n of_o this_o act_n that_o then_o the_o say_a commissioner_n or_o any_o two_o or_o more_o of_o they_o be_v inform_v thereof_o be_v hereby_o empower_v and_o require_v to_o imprison_v every_o such_o head-collector_n and_o also_o to_o seize_v and_o secure_v the_o estate_n both_o real_a and_o personal_a of_o such_o head-collector_n or_o which_o shall_v from_o he_o descend_v or_o come_v into_o the_o hand_n or_o possession_n of_o his_o heir_n executor_n or_o administrator_n wherever_o the_o same_o can_v be_v discover_v or_o find_v and_o the_o say_a commissioner_n who_o shall_v so_o seize_v and_o secure_v the_o estate_n of_o any_o head-collector_n shall_v be_v and_o be_v hereby_o empower_v to_o appoint_v a_o time_n for_o the_o general_a meeting_n of_o the_o commissioner_n of_o such_o county_n city_n or_o town_n and_o there_o to_o cause_v public_a notice_n to_o be_v give_v at_o the_o place_n where_o such_o meeting_n shall_v be_v appoint_v ten_o day_n at_o least_o before_o such_o general_a meeting_n and_o the_o commissioner_n present_v at_o such_o general_a meeting_n or_o the_o major_a part_n of_o they_o in_o case_n the_o money_n detain_v by_o such_o head-collector_n be_v not_o pay_v or_o satisfy_v as_o aught_o to_o be_v according_a to_o the_o direction_n of_o this_o act_n shall_v and_o be_v hereby_o empower_v and_o require_v to_o sell_v and_o dispose_v of_o all_o such_o estate_n or_o any_o part_n of_o they_o which_o shall_v be_v for_o the_o cause_n aforesaid_a seize_v and_o thereby_o to_o secure_v and_o pay_v all_o the_o money_n in_o arrear_n in_o such_o head-collector_n hand_n for_o his_o majesty_n use_n and_o return_v the_o overplus_n deduct_v necessary_a charge_n to_o such_o head-collector_n his_o executor_n and_o administrator_n respective_o â—enalty_n â—enalty_n and_o if_o any_o person_n or_o person_n shall_v refuse_v to_o pay_v the_o several_a sum_n and_o sum_n and_o proportion_n appoint_v by_o this_o act_n for_o such_o person_n to_o pay_v upon_o demand_n make_v by_o the_o officer_n or_o collector_n of_o the_o place_n according_a to_o the_o precept_n or_o estreat_v to_o he_o deliver_v by_o the_o say_a commissioner_n it_o shall_v and_o may_v be_v lawful_a to_o and_o for_o such_o officer_n or_o collector_n who_o be_v hereby_o thereunto_o authorize_v and_o require_v for_o nonpayment_n thereof_o to_o distrain_v the_o person_n or_o person_n so_o refuse_v by_o his_o or_o their_o good_n or_o chattel_n and_o the_o distress_n so_o take_v to_o keep_v sell_v by_o the_o say_a officer_n for_o payment_n of_o the_o say_a money_n and_o the_o overplus_n come_v by_o the_o say_a sale_n if_o any_o be_v over_o and_o above_o the_o charge_n of_o take_v and_o keep_v the_o say_a distress_n to_o be_v immediate_o restore_v to_o the_o owner_n thereof_o and_o if_o any_o person_n or_o person_n assess_v by_o this_o act_n shall_v refuse_v or_o neglect_v to_o pay_v the_o sum_n or_o sum_n so_o assess_v by_o the_o space_n of_o twenty_o day_n after_o demand_n as_o aforesaid_a where_o no_o sufficient_a distress_n can_v or_o may_v be_v find_v whereby_o the_o same_o may_v be_v levy_v in_o every_o such_o case_n three_o or_o more_o of_o the_o commissioner_n by_o this_o act_n appoint_v for_o any_o such_o city_n county_n or_o place_n be_v hereby_o authorize_v by_o warrant_n under_o their_o hand_n and_o seal_n to_o commit_v such_o person_n or_o person_n to_o the_o common_a goal_n there_o to_o be_v keep_v without_o bail_n or_o mainprize_n until_o payment_n shall_v be_v make_v and_o if_o any_o person_n certify_v assess_v or_o rate_v find_v he_o or_o herself_o aggrieve_v with_o such_o assess_n or_o rate_v and_o do_v within_o ten_o day_n after_o demand_v to_o be_v employ_v in_o and_o towards_o the_o repair_n of_o the_o public_a building_n of_o the_o say_a city_n provide_v always_o that_o where_o any_o such_o offence_n shall_v be_v commit_v by_o any_o person_n or_o person_n of_o low_a and_o mean_a condition_n who_o the_o say_a justice_n or_o justice_n of_o the_o peace_n shall_v in_o his_o conscience_n believe_v to_o be_v unable_a to_o satisfy_v the_o say_a penalty_n that_o then_o and_o in_o such_o case_n the_o say_a justice_n or_o justice_n of_o the_o peace_n shall_v and_o may_v by_o order_n and_o warrant_v under_o he_o or_o their_o hand_n and_o seal_n cause_n such_o offender_n to_o be_v open_o whip_v near_o unto_o the_o place_n where_o the_o offence_n shall_v be_v commit_v till_o his_o body_n be_v bloody_a and_o that_o it_o shall_v of_o all_o building_n in_o and_o about_o the_o say_a city_n be_v henceforth_o make_v of_o brick_n or_o stone_n or_o of_o brick_n and_o stone_n together_o except_o door-case_n and_o window-frames_a the_o breast_n summer_n and_o other_o part_n of_o the_o first_o story_n to_o the_o front_n between_o the_o péer_v which_o be_v to_o be_v leave_v to_o the_o discretion_n of_o the_o builder_n to_o use_v substantial_a oaken_a timber_n in_o stead_n of_o brick_n or_o stone_n for_o conveniency_n of_o shop_n and_o that_o the_o say_v door_n breast_n summer_n and_o window-frames_a be_v sufficient_o discharge_v of_o the_o burden_n of_o the_o fabric_n by_o arch-work_n of_o brick_n or_o stone_n either_o straight_o or_o circular_a supervisor_n the_o duty_n of_o the_o surveyor_n and_o supervisor_n and_o be_v it_o enact_v that_o the_o say_a surveyor_n or_o supervisor_n so_o to_o be_v appoint_v as_o aforesaid_a and_o every_o of_o they_o within_o their_o several_a precinct_n shall_v take_v care_n that_o in_o building_n of_o all_o house_n within_o the_o say_a city_n and_o liberty_n thereof_o there_o be_v and_o it_o be_v hereby_o enact_v by_o the_o authority_n aforesaid_a that_o there_o shall_v be_v party-wall_n and_o party-péers_a set_v out_o equal_o on_o each_o bvilder_n ground_n to_o be_v build_v up_o by_o the_o first_o beginner_n of_o such_o building_n and_o that_o convenient_a tothe_n be_v leave_v in_o the_o front-wall_n by_o the_o say_v first_o builder_n for_o the_o better_a join_v of_o the_o next_o house_n that_o shall_v be_v build_v to_o the_o same_o and_o that_o no_o man_n be_v permit_v by_o the_o say_a surveyor_n to_o build_v on_o the_o say_a party-wall_n or_o on_o his_o own_o contiguous_a ground_n until_o he_o have_v full_o reimburse_v the_o say_v first_o builder_n the_o full_a moiety_n of_o the_o charge_n of_o the_o say_a party-wall_n and_o péer_v together_o with_o interest_n for_o the_o same_o after_o the_o rate_n of_o six_o pound_n per_fw-la cent._n per_fw-la annum_fw-la for_o forbearance_n thereof_o to_o be_v account_v from_o the_o begin_n of_o the_o say_v first_o building_n bvilder_n who_o may_v determine_v difference_n between_o first_o and_o late_a examination_n of_o the_o lord_n mayor_n and_o court_n of_o alderman_n who_o shall_v hear_v and_o final_o determine_v the_o same_o without_o any_o appeal_n to_o be_v have_v building_n house_n of_o first_o and_o less_o sort_n of_o building_n be_v one_o brick_n and_o a_o half_a as_o high_a as_o the_o say_a garret_n and_o that_o the_o thickness_n of_o the_o party-wall_n in_o the_o garret_n be_v of_o the_o thickness_n of_o one_o brick_n in_o length_n at_o the_o least_o and_o that_o the_o scantlings_n of_o timber_n and_o stone_n to_o be_v use_v about_o the_o build_n thereof_o be_v as_o in_o
